Public Art Group Weighs Revamping Awards

As part of that, a proposal to overhaul the Golden Paintbrush awards – the city’s annual recognition of individuals and organizations who support public art in Ann Arbor – received the most attention. Commissioners John Kotarski and Connie Brown had recommended four categories of public recognition to replace the Golden Paintbrush, including a lifetime achievement award, a “Random Acts of Art” award, and public art awards to be presented at a formal social event that was described as an “Academy Awards-type” ceremony.

Although there was general consensus that the Golden Paintbrush needs to be improved, some commissioners felt that the proposed public recognition program was overreaching at this point. Malverne Winborne worried about “scope creep” – going too far afield of AAPAC’s role. Marsha Chamberlin thought that making some changes to the Golden Paintbrush, including a new name, could serve the same purpose. Ultimately, commissioners decided to give the proposal more thought before acting on it.

Also related to public engagement, Kotarski and AAPAC chair Bob Miller reported on efforts to get input on proposals by four finalists for artwork at the East Stadium bridges. The two men have been making presentations to a variety of groups, and are seeking feedback via two online surveys – one on Survey Monkey, another on A2 Open City Hall. Commissioners also talked about having a regular table at the Sunday artisan market and increasing their use of social media, including the commission’s Facebook page and Twitter account – @AAPublicArt. AAPAC also will have a table at the July 15 Townie Street Party.

In other action, commissioners voted to create exploratory task forces for possible projects at Arbor Oaks Park in southeast Ann Arbor, and at the wastewater treatment plant on Dixboro Road in Ann Arbor Township. Craig Hupy, the city’s public services area administrator, had approached AAPAC about the possibility of incorporating public art into the wastewater treatment project. He noted that of the remaining amount in the Percent for Art funds, much of it came from wastewater-related projects, and must be spent on public art with a “nexus” to wastewater. [Full Story]

New Public Art Projects In the Works

Ann Arbor public art commission meeting (Jan. 23, 2013): Despite uncertainty about the future of the city’s public art program, commissioners discussed several projects at their most recent AAPAC meeting – including some new efforts that likely won’t use city funding.

AAPAC chair Marsha Chamberlin described a collaboration with the city’s parks system to use old canoes for a community art project. The effort also involves the Main Street Area Association and Ann Arbor Convention & Visitors Bureau. She indicated the project would seek private donations and grants, but probably not funds from the city’s Percent for Art program, which is currently under review by the city council.

The commission also heard from Linda Tenza, a resident who came to the Jan. 23 meeting to make an informal proposal for creating murals on the ceilings of the farmers market shelter. Likening it to a Sistine Chapel effect, Tenza suggested painting food-themed murals on the ceilings of the structures that cover the market aisles. Possible themes include food as medicine, the local farm community, seasonal fruits and vegetables, and the history of farming.

Although Tenza’s project is still tentative, one public art project that’s definitely coming to Ann Arbor is the Detroit Institute of Arts’ Inside|Out program, which involves installing framed reproductions from the DIA’s collection at outdoor locations on building facades or in parks. Two private Ann Arbor businesses – Zingerman’s Deli and the downtown Borders store – were part of the program in 2010. Since then the DIA has been talking periodically with AAPAC and city staff about expanded participation.

The works will be hung from late March through June at several downtown locations, including on the facade of city hall and on the wall of the fire station that faces the Ann Arbor Hands On Museum. An official announcement about the project, including a listing of all locations, will be made at a Feb. 8 DIA press conference.

In other action at AAPAC’s Jan. 23 meeting, commissioners expressed frustration with the proposed design of a sign for the Herbert Dreiseitl water sculpture in front of city hall, calling it too “busy” with text and images that are unclear. Nor were they pleased with the proposed description of the piece that’s included on the sign: “Sculpture with Water Feature.” Chamberlin agreed to discuss their concerns with Ken Clein of Quinn Evans Architects, which handled the design.

Commissioners were also updated on several ongoing projects, including the selection of public art for the East Stadium bridges. A public engagement proposal for that $400,000 project – which might serve as a template for other projects – elicited some debate. John Kotarski objected to a recommendation that part of each artist’s interview with a selection panel should be held in private. He felt strongly that the process should be open and transparent. Wiltrud Simbuerger, who presented the recommendation, felt that the selection panel needs a “safe place” for their deliberations.

The Jan. 23 meeting included a discussion of officer elections, which AAPAC’s bylaws call for in January. The elections were ultimately postponed because only four commissioners were present at that point in the 2.5-hour meeting. Chamberlin has been serving as chair since April of 2011. Also factoring into the issue of officer elections was the uncertainty of AAPAC’s future. The city council has suspended expenditures for future projects pending review of the public art program by a council committee appointed last December. Chamberlin, who has attended all meetings of that committee, gave an update to commissioners, but noted that no decisions have yet been made. The committee is expected to give its recommendations to the full council in mid-February – its next meeting is on Feb. 7. This report includes a summary of the committee’s most recent deliberations. City To Seek Feedback On Public Art Program

The group discussed this approach at its second meeting since being appointed by the full council on Dec. 3, 2012. Sally Petersen (Ward 2) had proposed a survey at the committee’s first meeting on Dec. 11, but the idea had gained no traction then. She reintroduced the proposal on Jan. 7, saying she felt the committee needed better direction about public art and the types of funding residents might support.

A2 Open City Hall allows users to give open-ended responses to questions, to select priorities, and to give votes of support to comments left by others. It’s a relatively new system, and committee members talked about the need to promote it so that more people will participate. They plan to invite Lisa Wondrash, the city’s communications manager, to come to the next committee meeting and give advice on crafting questions for Open City Hall, as well as ways to publicize it. The Open City Hall system wouldn’t be the only way to get input, Petersen stressed.

Committee members include Peterson, Sabra Briere (Ward 1), Stephen Kunselman (Ward 3), Margie Teall (Ward 4) and Christopher Taylor (Ward 3). At this point, the consensus of the committee appears to be for a continued public art program that would not rely exclusively on the current Percent for Art funding model. That approach sets aside 1% of the budget for each of the city’s capital projects – up to a cap of $250,000 – for public art. The ordinance was enacted in 2007, but has been controversial for a variety of reasons. [.pdf of public art ordinance] It is now being evaluating in light of a public art millage that was rejected by 56% of voters on Nov. 6, 2012.

The council has asked this committee to make recommendations about the city’s public art program by Feb. 15, 2013. The group is exploring several options, including possible public/private partnerships and hiring a full-time administrator. There seems to be general agreement that if a Percent for Art approach is kept in place, it should be modified and only provide a portion of funding for public art. Tom Crawford, the city’s chief financial officer, attended the Jan. 7 meeting and reported that the accounting for Percent for Art is “very detailed and very difficult. It’s very administratively heavy.”

Moving away from Percent for Art funding would also give the city more flexibility on the types of public art it can pursue. Currently, because funding comes from capital projects, the artwork must be permanent and linked thematically to the fund paying for the project. That means that temporary installations, or events like the annual FestiFools parade, can’t be funded in this way.

Taylor wasn’t confident that the committee could craft a new plan by its February deadline. Instead, he suggested that the committee could provide concrete direction, but perhaps the city should hire a consultant or ask city staff to review the current program and make further recommendations.

During the Jan. 7 meeting, Kunselman gave a brief update on his plan to make a request of the state attorney general’s office for an opinion about the legality of Ann Arbor’s current Percent for Art program. The request must come from a state legislator, and Kunselman said that state Rep. Jeff Irwin – a Democrat from Ann Arbor representing District 53 – has “reluctantly” agreed to help if the council passes a resolution to seek the AG opinion.

Also at the meeting, committee members heard from four people during public commentary, who gave suggestions on how to proceed: Marsha Chamberlin and John Kotarski of the Ann Arbor public art commission; former AAPAC chair Margaret Parker; and Sarah Gay, an arts administrator who grew up in Ann Arbor. Kotarski, Parker and Gay all recommended hiring a full-time administrator for Ann Arbor’s public art program.

The committee’s next meeting is set for Monday, Jan. 14 at 5:30 p.m. in the first-floor conference room at city hall, 301 E. Huron. These meetings are open to the public. Art Commission Contends with Limbo Status

Marsha Chamberlin, AAPAC’s chair, briefed commissioners on a Dec. 11 meeting of the city council committee that will be making recommendations on the future of Ann Arbor’s public art program. The committee’s work comes in the wake of a failed public art millage that voters rejected on Nov. 6. That committee includes councilmember Sabra Briere, who attended AAPAC’s Dec. 19 meeting as well.

At the meeting, Briere participated in a discussion with commissioners about the source of funding for a hanging sculpture to be installed in the lobby of the Justice Center. AAPAC and city councilmembers have been under the impression that the $150,000 project – called “Radius,” by Ed Carpenter – was part of the city’s Percent for Art budget. However, it now seems that’s not the case, based on communications from the city’s chief financial officer. The news stunned commissioners, who noted that the project appears in the budget summaries they regularly receive – including one provided in the Dec. 19 meeting packet – as a line item, under “Court/PD Facility.” [.pdf of December 2012 budget summary]

By way of background, during the May 7, 2012 city council meeting when the Radius project was ultimately approved, councilmembers debated the issue for about an hour. Specifically, Jane Lumm (Ward 2) had proposed an amendment that would have canceled Carpenter’s project and appropriated the art project funds to investments in the city hall building. Her amendment failed, with several councilmembers – and assistant city attorney Mary Fales – arguing that the public art ordinance prohibits the transfer of public art funds to other funds.

A new, different understanding that seems to have emerged is the following: The money for public art in the Justice Center building budget was not set aside as an application of the public art ordinance, but rather was set aside administratively – in February 2009, well after the building fund had been established. The building fund had been established prior to 2007, when the public art ordinance was enacted. So the 2009 set-aside was made in the spirit of the 2007 public art ordinance, applied in some sense retroactively. In a phone interview, Briere told The Chronicle that this is the understanding she has of the situation. And in response to an emailed query from The Chronicle, Stephen Kunselman (Ward 3) – who also serves on the council’s public art review committee – confirmed he had the same understanding. That understanding has implications for use of the balance of the $250,000 that was set aside for Justice Center art.

In other action at the Dec. 19 meeting, commissioner John Kotarski expressed concern about AAPAC’s task force process, after attending a recent session for the East Stadium bridges project. He didn’t feel the task force is getting sufficient administrative support as it works to select up to five finalists from a set of 36 submissions. To help, he proposed allocating $5,000 to hire a consultant who would serve as a curator to conduct an initial vetting of the artists. The suggestion did not gain much traction among other commissioners, at least for this project, though the idea of a facilitator seemed well-received.

Kotarski updated commissioners on a course that Roland Graf, an assistant professor at the University of Michigan’s School of Art & Design, will be teaching this coming semester called “Public Art and Urban Intervention.” Graf intends to make assignments related to public art in Ann Arbor and on the UM campus, and it’s expected that students will eventually make presentations of their projects to AAPAC.

Kotarski also was the catalyst for a review of AAPAC’s long-term strategic plan for fiscal 2013-2016, prompting commissioners to identify the status of each objective. Several objectives are on hold, pending the outcome of the city council’s review of the overall Percent for Art program.

The council’s pending action also has resulted in some uncertainty regarding AAPAC appointments. Terms for Cathy Gendron and Connie Brown expire on Dec. 31, 2012. They’ve agreed to continue serving until the council makes a decision about the Percent for Art program. The vacancy left by the resignation of Theresa Reid in November remains unfilled. Council’s Public Art Committee Begins Work

The group consists of councilmembers Sally Petersen (Ward 2), Sabra Briere (Ward 1), Stephen Kunselman (Ward 3), Margie Teall (Ward 4) and Christopher Taylor (Ward 3). They’d been appointed at the city council’s Dec. 3 meeting, when the council also voted to halt the spending of funds accumulated through Ann Arbor’s Percent for Art program  – except for projects that are already underway. The moratorium on spending lasts until April 1, 2013.

The committee was asked to recommend amendments to the city’s public art program, and make those recommendations to the council by Feb. 15, 2013. Among the possibilities the task force is expected to consider is a complete repeal of the current program, perhaps to be replaced with an alternative.

Peterson – the newest councilmember on the committee, who was elected on Nov. 6 – brought to the Dec. 11 meeting a draft survey for residents, to help clarify public sentiment about using city funds for public art. She noted that the outcome of a public art millage, which was defeated by about 56% of voters on Nov. 6, didn’t directly measure how people felt about the public funding of art. The four-year millage would have temporarily replaced the current Percent for Art program, which sets aside 1% of each city capital project to use for public art.

But other committee members – particularly Teall and Kunselman – expressed little enthusiasm for a survey, although the group agreed to bring back other ideas for public outreach to their next meeting.

Much of the committee’s discussion focused on exploring other funding options. Taylor suggested the possibility of a new nonprofit, which could help secure more private funding. He said he’s already been communicating with the city attorney’s office about this option. It was Taylor who had brought forward the millage proposal this summer, to the surprise of many in the local arts community. The arts community was unsuccessful in its efforts to urge the city council not to put the proposal on the Nov. 6 ballot.

The committee set its next meeting for Monday, Jan. 7 at 5:30 p.m. – before to the 7 p.m. city council meeting. Before then, committee members agreed to work on several tasks, including gathering information about how other communities handle funding for public art. And Kunselman plans to draft a resolution for the council to make a request of the state attorney general’s office – likely via state Rep. Jeff Irwin – for an opinion about the legality of Ann Arbor’s current approach.

The Dec. 11 meeting also was attended by two members of the Ann Arbor public art commission – Marsha Chamberlin, AAPAC’s chair, and John Kotarski – as well as Aaron Seagraves, the city’s part-time public art administrator. Public Art Commission Eyes Uncertain Future

Aaron Seagraves, the city’s part-time public art administrator, highlighted several projects that have been in the pipeline and that will likely be completed in 2013: a $150,000 hanging glass sculpture by Ed Carpenter, to be installed in the Justice Center lobby this spring; artwork for a new rain garden being built at Kingsley & First next spring; and public art for the East Stadium bridges, with a $400,000 budget. Artists haven’t yet been selected for those last two projects, but it’s hoped that the work will be finished by the end of 2013.

Much of the conversation among commissioners focused on how to  improve promotion and coordination of the work they’ve done to date, and to explain their vision for public art in Ann Arbor.

“We’ve got a fair amount of work to do in the next few months,” said Marsha Chamberlin, AAPAC’s chair.

Two members of the arts community – former AAPAC chair Margaret Parker and Deb Polich, executive director of the Arts Alliance and president of Artrain, who had also co-chaired the “B for Art” millage campaign committee – attended the meeting. During public commentary, Parker volunteered to help with outreach efforts, and gave commissioners a list of suggestions for promoting the city’s public art program.

Also attending the Nov. 28 meeting was city councilmember Sabra Briere (Ward 1). She has proposed changing the public art ordinance to narrow the type of projects that could be tapped for public art funding. The effect would be to dramatically cut the amount of funds available for public art. A second proposal, by Jane Lumm (Ward 2), would simply eliminate the program. Both of those proposals were tabled by the council on Nov. 19. But at its Dec. 3 meeting, the city council is expected to act on yet another proposal – made by Marcia Higgins (Ward 4) – to appoint a committee to study the city’s approach to public art. Her proposal would also suspend the expenditure of funds, with several exceptions, that have accumulated for public art.

Update: At their Dec. 3 meeting, the city council voted to suspend the spending of funds accumulated through Ann Arbor’s Percent for Art program until April 1, 2013 – except for projects that are already underway. A committee consisting of Sally Petersen (Ward 2), Sabra Briere (Ward 1), Stephen Kunselman (Ward 3), Margie Teall (Ward 4) and Christopher Taylor (Ward 3) has been appointed to recommend amendments to the city’s public art program. The committee is charged with making a recommendation to the council by Feb. 15, 2013.

AAPAC faces other changes as well. At the Nov. 28 meeting, Chamberlin noted that Theresa Reid has resigned from the commission. Reid, who is executive director of the ArtsEngine at the University of Michigan, had been appointed to AAPAC in February 2012. In response to an email query from The Chronicle, Reid cited time commitments for work and family, and said her resignation was not related to the Nov. 6 defeat of the public art millage.

During the Nov. 28 meeting, Chamberlin urged commissioners to solicit potential candidates for a replacement. An appointment will be made with a nomination by the mayor and confirmation by the full city council. An application for all city boards and commissions is available on the city clerk’s website. Pre-Thanksgiving Council Pre-Heats Oven

Legislative activity on the public art ordinance resulted from the Nov. 6 rejection by voters of an alternate means of funding public art – a 0.1 mill tax that would have generated roughly $450,000 annually. At the Nov. 19 meeting, Jane Lumm (Ward 2) proposed ending the existing public art program, which requires that 1% of the budget for all capital projects in the city be allocated for public art – with a limit of $250,000 per project. A competing proposal, from Sabra Briere (Ward 1), would narrow the type of capital project from which Percent for Art funds could be allocated. Briere’s proposal would have the practical effect of reducing – by about 90% – the amount of public art funds generated by the existing program. In the last two years the program has generated over $300,000 a year, and more in previous years.

The council wound up tabling both proposals, a parliamentary move that means there’s no particular time in the future when the council must consider them. The proposals will expire, if the council does not take them up off the table in six months. However, the council’s strategy will likely be to appoint a committee to study the matter and to suspend temporarily the existing program. A resolution to that effect was added to the council’s agenda during the meeting, after the tabling of the other proposals – but that third resolution was then postponed until the council’s Dec. 3 meeting.

Also postponed was a set of revisions to the city’s living wage ordinance. The main change would be to exempt those nonprofits from the ordinance that receive funding through the city’s human services allocation, which has totaled roughly $1.2 million each year for the last several years. The ordinance currently has a waiver provision, requiring a city-council-approved plan for compliance with the living wage ordinance within three years. Only one such waiver has been sought since the living wage ordinance was enacted in 2001. That came at the council’s meeting earlier this month, on Nov. 8, 2012.

Based on council deliberations at the Nov. 19 meeting, the living wage revisions in their current form seem likely to be approved only with great difficulty. Some councilmembers seemed more interested in pursuing exemptions for categories of workers – temporary or seasonal – instead of exempting categories of organizations. The living wage ordinance revisions were postponed until Feb. 19.

Getting initial approval were changes to two other city ordinances – on noise and the storage of cars on streets.

The changes to the noise ordinance were prompted by the impact that recent construction of the Landmark building at 601 S. Forest had on neighbors. If given final approval by the council, the changes would make clear that holidays are to be treated like Sundays and that supervisors can be cited under the ordinance, not just a worker who’s operating a piece of equipment.

The revision to the towing ordinance would make it easier to prevent people from storing inoperable vehicles on city streets. Like all changes to city ordinances, it will need a second vote by the council, after a public hearing.

In other business, the council authorized a $15,000 budget for analyzing alternatives for installing a sidewalk along a section of Scio Church Road. Residents in the area have petitioned the city for a sidewalk.

And Stephen Kunselman (Ward 3) used his communications time toward the end of the meeting as an occasion to deliver harsh criticism of the Ann Arbor Transportation Authority and mayor John Hieftje.

In the first meeting for newly elected councilmembers, the council also chose Marcia Higgins (Ward 4) to serve as mayor pro tem, as she has for the last three years. The order of succession to the mayor, based on seniority lines, was also set. [Full Story]

Column: Mapping Ann Arbor’s 2012 Elections

With the 2012 general elections well behind us, it’s time for politicians to put on their very serious faces and make very serious pronouncements like, “The voters have spoken.”

I prefer to make a funny face and ask: How is a judicial candidate like the city park system? Or for a question that sounds less like the set-up to a punch line: What’s the deal with downtown Ann Arbor and its connection to the art millage and the library bond proposal?

Of course, politicians are at least partly right when they say that the voters have spoken. But what did the voters actually say? It’s easy to make true statements about voter sentiment – if you stick to the text of the ballot.

For example, in the non-incumbent race for judge of the 22nd Circuit Court, more voters preferred to have Carol Kuhnke decide future Washtenaw County court cases than to have Jim Fink decide them. You can tell that just from the ballot and from the results. But it’s possible to make a stronger claim: More voters preferred the kind of person Kuhnke is – a candidate endorsed by the city of Ann Arbor Democratic Party. And to support that claim, we’d need to look at other results, like those from the presidential election.

Or by way of another example, the election results indicate that a majority of Ann Arbor voters said they do not want the city to levy an 0.1 mill tax to pay for art in public places. That’s all you can tell from the ballot question and the results. To make stronger claims – related, for example, to what (if anything) voters were trying to say about the existing Percent for Art program – you’d need to find some other way to explore the content of voters’ minds.

The same goes for the Ann Arbor District Library bond proposal and the parks maintenance and capital improvements millage renewal. “Do not tax us to make the bond payments for a new downtown library building, but please continue to tax us to pay for city park needs.” That’s all voters said. They didn’t say anything about their favorite books, or which city park is the best. (By the way, it’s West Park, located in Ward 5, which is indisputably the highest-numbered ward in the city.)

Yet we’d like to divine something more from the results than just the results.

This column, which is heavy on impressionistic conclusions based on maps, and light on rigorous statistical analysis, begins with mapped illustrations of some basics. For example, mostly Democrats live in the eastern portion of Washtenaw County. And in Ann Arbor, Wards 2 and 4 are the strongest city wards for Republicans – even though those wards also lean Democratic. That’s still true 20 years after Ann Arbor’s ward boundaries were drawn to achieve that effect.

Final Roundup: Ann Arbor Nov. 6 Election

Democrats gained ground in local elections on Tuesday, but two high-profile Ann Arbor ballot initiatives were defeated.

Voters rejected a public art millage and a $65 million bond proposal for a new downtown Ann Arbor District Library building. But renewal of a millage for park maintenance and capital improvements won overwhelming approval.

In countywide races, Carol Kuhnke of Ann Arbor defeated Jim Fink of Ypsilanti for a judgeship on the 22nd Circuit Court, replacing Melinda Morris, who is retiring. Incumbent judge Tim Connors retained his seat over challenger Mike Woodyard.

The Washtenaw County board of commissioners will see changes following Tuesday’s election. Incumbent Republican Rob Turner was defeated by Democrat Kent Martinez-Kratz, decreasing the number of Republicans on the nine-member board from three to two. Republican Alicia Ping won the District 3 seat over Democrat Wes Prater – the two incumbents faced each other due to redistricting that took effect with this election cycle. Other incumbents won their seats, as did Democrat Andy LaBarre, who secured his first term on the board.

Democrats prevailed in all local races for the Michigan House of Representatives, most notably with Gretchen Driskell – the current mayor of Saline – defeating incumbent Republican Mark Ouimet in District 52.

Ann Arbor Voters Reject Public Art Millage

A more flexible funding mechanism for public art in Ann Arbor was defeated by voters on Nov. 6. The 0.1 mill tax – which was expected to generate around $450,000 annually – was rejected by 28,166 voters (55.86%), with support from 22,254 voters (44.14%).

The proposal won a majority of votes in just 13 out of 59 precincts with the most support coming from Ward 5, Precinct 4 where 60.5% of voters supported the public art millage. Ward 5 had six of the 13 precincts where the proposal achieved a majority. And the proposal finished in a dead heat in Ward 5, Precinct 5 with 471 voting for and against it.  Opposition among in-person voters was strongest in Ward 1, Precinct 9, … [Full Story]

Art Group Reviews Public Outreach Effort

Turnout was lower than hoped – as only one resident attended the meeting held on Oct. 22 at Clague Middle School, though about 10 people came to a forum at Bryant Community Center the previous week. A fourth event will be held on Tuesday, Oct. 30 from 6:30-8:30 p.m. at the Ann Arbor Open @Mack cafeteria, 920 Miller Ave.

John Kotarski, who had attended all the forums, felt the events had achieved their purpose of achieving a presence in the community, and introducing residents to different kinds of public art. Bob Miller advocated adding an online element for soliciting more input. Commissioners discussed the possibility of using the city’s new A2 Open City Hall, a blog-type feature that allows people to get information and give feedback on specific projects.

Commissioners took action on other projects, voting to approve a $910 budget for the dedication of a new mural at Allmendinger Park – an event to take place on Sunday, Oct. 28 from 2-4 p.m. The mural was designed by Mary Thiefels of TreeTown Murals, incorporating artwork and found objects from the community.

Also approved was the location of a sign for the Herbert Dreiseitl water sculpture in front of city hall, though there was concern about the placement of a fence there. The city has decided to put the mesh metal fence on a section of the pedestrian bridge overlooking the sculpture. Some commissioners are frustrated that this safety issue wasn’t raised earlier, when it might have been addressed by the sculptor as part of the site design. Marsha Chamberlin, AAPAC’s chair, noted that Dreiseitl intended people to interact with the water that runs down from the fountain. “What’s driving this process – the aesthetics of the piece or risk management?” she asked. She ultimately abstained from the vote, stating ”I want to go on the record of being ornery about this.” It was approved by all other commissioners present at the meeting.

Commissioners were also updated on a range of other projects that are in various stages of development. The process has begun for soliciting artists for work at the East Stadium bridge and for an ongoing mural program. The deadlines for submitting statements of qualifications (SOQs) are in November. Aaron Seagraves, the city’s public art administrator, expects to post another SOQ – for artwork at Argo Cascades – next month. And legal staff is reviewing a request for proposals (RFP) for art at a rain garden being built at Kingsley and First.

Seagraves also reported that installation of a $150,000 hanging glass sculpture at the Justice Center lobby will be delayed a few months, until March or April of 2013. Fabricators selected by the artist Ed Carpenter aren’t available to do the work as soon as expected.

Another potential project emerged during the meeting. Chamberlin noted that the city has about 100 old aluminum canoes that it’s planning to get rid of. She said that Cheryl Saam, facilities supervisor for the city’s canoe liveries, had raised the possibility of using the canoes for some kind of community art project. After getting feedback from other commissioners that this is an idea worth pursuing, Chamberlin said she’d work up a more formal proposal for consideration at a future meeting.

As part of the Oct. 24 meeting packet, AAPAC got a budget update of Percent for Art funds, showing a balance of $1.533 million. Of that, $847,104 has been earmarked for previously approved projects, leaving about $686,000 unallocated. [.pdf of budget summary]

One notable topic was not discussed at the meeting – a public art millage that’s on the Nov. 6 ballot. Several commissioners are involved in advocating for the millage, but have taken a conservative approach to dealing with it during their regular business, and AAPAC meetings have not included discussion on the topic since the August 28, 2012  meeting. That approach stands in contrast to a recent park advisory commission meeting, when one of the park commissioners spoke during public commentary to urge support for the parks millage renewal. Art Commission Explores “Street Art” Program

John Kotarski made the proposal, explaining that street art could include anything from pedestrian benches to artistic manhole covers – similar to those that have been created in Japanese cities. The effort could involve schools and service clubs, he said, and might evolve into something as popular as the fairy doors found throughout Ann Arbor. Commissioners seemed generally supportive of the idea. The task force will do more research and make a formal proposal to AAPAC at a later date.

Commissioners also moved ahead on a new approach to getting more people involved in the selection of public art. Task forces will be formed in four quadrants of the city, using quadrants that are designated in the city master plan’s “land use elements” section: west, central, south and northeast. [.pdf map of quadrants]

Kickoff meetings for each quadrant are scheduled for October. Connie Rizzolo Brown, who’s spearheading this effort, described the goal of the first meetings as ”very gentle fact-finding missions,” as well as recruitment for potential task force members.

Also in October – on Sunday, Oct. 28 – a dedication is planned for the new mural being completed at Allmendinger Park. The work is by Ann Arbor muralist Mary Thiefels of TreeTown Murals, incorporating artwork and found objects from students and neighbors. Images from the work-in-progress are currently featured on AAPAC’s website.

Commissioners also discussed concerns about a descriptive sign planned for the Dreiseitl sculpture in front of city hall. Some commissioners feel that the proposed location for the sign detracts from the ability to enjoy the sculpture, while others expressed frustration that AAPAC had not been consulted about the sign’s location.

The meeting also included a variety of updates about projects that are underway. One major item that was not discussed was the public art millage that will be on the Nov. 6 ballot – Proposal B. Although it was alluded to on several occasions, AAPAC chair Marsha Chamberlin cautioned commissioners that they could not discuss it at the meeting. However, several commissioners are involved individually in the campaign to support the millage – B for Art. Chamberlin, for example, is hosting a dinner for the campaign in October.

At an Aug. 15 special meeting, the commission had voted to recommend that the city council place a millage on the ballot, despite voicing a range of concerns. The millage had been proposed by councilmember Christopher Taylor (Ward 3), who did not consult the arts community or AAPAC before bringing  the idea forward. The ballot proposal calls for a 0.1 mill tax for four years to support public art, temporarily replacing the current Percent for Art program. Zoning, Transit Focus of Council Meeting

Ann Arbor city council meeting (Sept. 4, 2012): The council handled a mixed bag of items at its most recent meeting, ranging from land use to community events funding.

One item was apparently not handled the way that the majority of the council wanted, due to the absence of two councilmembers – Carsten Hohnke (Ward 5) and Marcia Higgins (Ward 4).

That item was a $60,000 appropriation – the city’s portion of a $300,000 local match for continued study of the Plymouth/State corridor, from US-23 and Plymouth southward along Plymouth to State Street, extending south to I-94. The local match is needed for a $1.2 million federal grant that has been awarded for the study. This alternatives analysis phase follows a basic feasibility study. The current study is supposed to result in a preferred choice of technology (e.g., bus rapid transit, light rail, etc.) as well as identifying stations and stops.

Because the $60,000 transfer from the general fund was a change to the city budget, it needed the votes of eight members on the 11-member city council. When Mike Anglin (Ward 5) led off the roll call by voting against it, it was clear that the council would have no more than seven votes in favor – because Jane Lumm (Ward 2) had already made plain during deliberations that she’d be voting against it. So some councilmembers voted against the resolution in order to be on the prevailing side. That gives them the right under parliamentary rules to bring back the item to the council’s next meeting for reconsideration. At that meeting it’s possible, but not certain, that supporters of the funding will have the necessary eight votes.

Several items on the agenda dealt with land use. The council gave final approval to a rezoning request for Knight’s Market, which will allow for expansion of the market at Spring and Miller streets. Winning initial approval was a rezoning requested by the developer of proposed townhouses on Catherine Street – from its current planned unit development (PUD) zoning to R4C (multi-family residential). Rezoning for part of a parcel in connection with a planned Speedway gas station at Maple and Miller also got the council’s initial approval. A related site plan for the station got its one and only required approval.

Also connected to land use was the council’s addition of two more properties to the greenbelt, using about $0.5 million in city funds from the open space and parkland preservation millage. The land from the two properties totals around 226 acres. Lumm cast a lone vote of dissent.

The council also authorized disbursements of community events funds to 13 organizations totaling $44,778, the bulk of which went to the Ann Arbor Summer Festival’s Top of the Park.

And the council set a public hearing for Oct. 1 on a tax abatement for Barracuda Networks. The firm is relocating to downtown Ann Arbor from its current location on Depot Street, in part to accommodate an additional 144 employees it expects to hire by July 1, 2014. [Full Story]

Art Commission Strategizes as Millage Looms

Dealing with the millage wasn’t the commission’s main agenda item, but they did spend some time talking about the need for a separate campaign committee. AAPAC chair Marsha Chamberlin stressed that the commission itself can’t advocate for the millage, ”but we can educate out the wazoo.”

As individuals, though, commissioners will likely be very active – Chamberlin will be among those organizing the campaign, along with Arts Alliance president Deb Polich, who attended AAPAC’s Aug. 22 session. Mark Tucker of FestiFools was there too, and told commissioners that he and others were brainstorming on free or inexpensive ways to support the millage – including a “surprise” that involves football Saturdays and is “FestiFoolian in nature” to attract media coverage.

Ken Clein also volunteered to help. He was on hand to update commissioners on the status of the Herbert Dreiseitl water sculpture in front of city hall, as a follow-up to concerns raised in June about the installation. Clein is a principal with Quinn Evans Architects, the Ann Arbor firm that handled the design of the new Justice Center and oversaw its construction. Though delayed, the Dreiseitl installation is nearly completed and will be handed off to the city soon, along with a two-year maintenance warranty.

The sculpture is the largest and most expensive project coordinated by the commission, and the first one approved under the Percent for Art program. The two newest public art projects were added to the pipeline at the Aug. 22 meeting, on unanimous votes. They’ll eventually be located at: (1) Forest Avenue Plaza, next to the Forest Avenue parking structure near South University; and (2) a future roundabout at Ellsworth and South State.

In a written report, commissioners were given an update on available funds in the Percent for Art budget. Of the $1.668 million balance, $856,997 is earmarked for projects already approved by AAPAC, including $400,000 for artwork at the East Stadium bridges and $150,000 for Argo Cascades – but aspects of those projects are still under review by the city’s legal staff. That leaves $810,276 in unallocated funds. The largest amounts are in revenues from sewer projects ($451,955) and street millage projects ($241,951).

The commission also finalized its four-year strategic plan, and moved ahead on a new effort to involve residents in planning for public art in each of four quadrants in Ann Arbor. [Full Story]

Council Puts Art on Ballot; Lets Land Leaven

Ann Arbor city council meeting (Aug. 20, 2012): City council actions finalized the set of ballot questions for Ann Arbor voters on Nov. 6: A public art millage will join the Ann Arbor District Library’s bond proposal and the city of Ann Arbor’s parks maintenance and capital improvements millage on the ballot.

The public art millage would be levied at a rate of 0.1 mill, which would raise around $450,000 from Ann Arbor taxpayers annually. Passage of the public art millage would, according to the corresponding charter amendment, suspend the city’s public art funding mechanism embedded in the Percent for Art ordinance – but only for the duration of the four-year millage.

A selling point of the millage, compared to the current Percent for Art program, is that millage money could be used more flexibly than money set aside under the Percent for Art program. The Percent for Art ordinance requires that 1% of all city capital projects be set aside for art. But this funding mechanism carries with it a legal requirement that art paid for through the program be in some sense “monumental” art that is permanent. Performance art or temporary installations would not qualify under the current program.

Even though a millage offers more flexibility, leaders in the arts community are concerned about a possible perception that it would be completely flexible – which led the council to change the ballot language and charter amendment from “public art” to “art in public places.”

A proposal from Jane Lumm (Ward 2) to begin the process of revising the Percent for Art ordinance in advance of the millage vote got little traction from the council. Lumm indicated that she wanted to offer voters a clear choice – that unless the millage were approved, public funding for art would disappear. But her resolution was voted down, with additional support only from Stephen Kunselman (Ward 3) and Mike Anglin (Ward 5).

The majority of councilmembers felt that such a move was “premature.” Mayor John Hieftje indicated that he was open to a scenario in which the millage passed, the tax was levied for four years (which would generate roughly $1.8 million in money that could be spent flexibly), but then was not offered to voters for renewal after four years, which would mean an automatic reversion to the current Percent for Art program.

In other business, the council declined to take action on two pieces of land at opposite ends of the downtown – 414 N. Main St. (site of the old St. Nicholas Church), and 350 S. Fifth Ave. (the former YMCA lot). The council rejected a proposal to begin the rezoning process for the St. Nicholas Church property – in advance of a public auction of the land starting Sept. 6. The council also declined to support a directive to the city administrator to prepare for disposition of the old Y lot, citing an ongoing planning process for the area of downtown Ann Arbor that includes the city-owned parcel. That process – Connecting William Street – is being led by the Ann Arbor DDA under direction from the city council.

The council transacted a mixed bag of other business, including approval of a collaborative effort with Washtenaw County to handle towing. The council also approved the final grant contract necessary for completing an environmental study in connection with a runway extension at the Ann Arbor municipal airport.

The council rejected a proposal from Comcast for a new franchise agreement, opting instead to allow the current arrangement to stay in place at least through the end of its term in 2017.

The meeting ended around midnight with jostling among councilmembers on the issue of mayoral appointments. Prompting the discussion was the reappointment of Sandi Smith (Ward 1) to the board of the Ann Arbor DDA. Kunselman and Lumm voted against the reappointment, objecting to Smith’s dual service on the city council and the DDA board. Smith was originally appointed to the board before her election to the council in 2008 and is not seeking re-election this term. Other councilmembers defended Smith’s selection.

Less controversial was the appointment of Michael Benson to the taxicab board. That body had been unable to meet because it had only two voting members out of five, and could not achieve a quorum. If all three members show up now, that body can hold its meeting. [Full Story]

Despite Worries, Art Commission Backs Millage

Ann Arbor public art commission special meeting (Aug. 15, 2012): Ann Arbor city councilmember Christopher Taylor stunned many in the arts community by unexpectedly proposing a public arts millage for the Nov. 6 ballot. He took that action at the council’s Aug. 9 meeting – two days after the Aug. 7 primary.

At that meeting, he indicated a desire to start a conversation about public arts funding, and expressed the hope of getting input from the Ann Arbor public art commission and the community in general.

Some of that conversation took place at the public art commission’s Aug. 15 meeting, which ended in a vote of support for the millage proposal.

Much of the reaction so far from the arts community has focused on the short timeframe until the November election, and the lack of clarity that a yes or no vote would indicate, based on the wording of the proposal.

In response to that perceived lack of clarity, on Friday, Aug. 17, councilmember Jane Lumm (Ward 2) added a resolution to the Aug. 20 council agenda that would lead to a choice for voters on Nov. 6 between: (1) a millage to support public spending on art; or (2) no continued accumulation of public funds to be spent on art. Her resolution would direct city attorney staff to prepare ordinance language to repeal the funding mechanism in the Percent for Art ordinance – effective July 1, 2013. The intent is to repeal the ordinance in a way that allows funds already set aside for art to be spent on art, and to provide for maintenance of existing works.

If approved by the council on Aug. 20, Lumm’s resolution would lead in late September to the first of two city council votes necessary to repeal the ordinance section. In part, Lumm’s resolution states that “to truly enfranchise residents, voters should be offered a clear, yes/no choice on public funding for public art rather than an either/or choice of the mechanism used to fund public art; …” [.pdf of Lumm's draft resolution and memo]

Lumm’s resolution hadn’t been proposed when AAPAC held its special meeting on Wednesday to focus on Taylor’s millage proposal. The commission had essentially been forced to call a special session because its next regular meeting, on Aug. 22, falls after an expected vote by the council on Aug. 20.

The special meeting drew more public commentary than at any of AAPAC’s previous meetings. Nine people spoke, including leaders of several local arts institutions: Deb Polich of the Arts Alliance, Russ Collins of the Michigan Theater, Mark Tucker of FestiFools, and former AAPAC chair Margaret Parker, among others. Several more people attended but did not formally address the commission.

It seemed clear that neither commissioners nor members of the arts community who spoke during public commentary had been consulted about the millage proposal, and only a few had been informed that it would be brought forward. While there was broad support for the idea of a public arts millage, many people questioned the timing and felt that 11 weeks until the Nov. 6 election was too short a time to mount a successful millage campaign.

When asked by commissioners who would lead such a campaign, Taylor said he assumed it would be led by the arts community, with money raised from private contributions. He felt the amount of time was sufficient, and that the millage would be approved by voters. He thought the November election would be a good time for the vote, with higher participation by students and renters – that’s a good core, he said.

During AAPAC’s meeting, Taylor told commissioners that if a millage vote is delayed, that puts the current Percent for Art program at risk. He said his sense is that the risk is growing, though he was unclear about why he believes that’s the case. Marsha Chamberlin, AAPAC’s chair, wondered whether the concern stems from a change in composition to the council, following the November election. Taylor did not respond directly to that question.

In the Aug. 7 primary election, Democrat Sally Petersen defeated incumbent Tony Derezinski in Ward 2 – Derezinski also is a member of AAPAC, though he has not attended a regular meeting since May, and did not attend the Aug. 15 special session. No incumbents ran in the Ward 1 and Ward 5 races, where Democrats Sumi Kailasapathy and Chuck Warpehoski prevailed in their respective primaries. No Republican is running against Petersen or Kailasapathy in November. And though Warpehoski faces Republican Stuart Berry in Ward 5, it’s likely that Warpehoski will win that heavily Democratic ward. Taylor is also running for re-election, but was unopposed in the Ward 3 Democratic primary and is unchallenged in November.

In a pre-election survey conducted by the Arts Alliance, Petersen indicated support for the Percent for Art program, though she suggested some changes. Warpehoski supported “looking for ways to establish a more flexible funding stream for the arts.” Kailasapathy did not respond to the survey, according to the alliance, but her campaign website did not list public art among her priorities. In general, another complicating factor with the millage proposal is a separate effort to develop a countywide plan and funding mechanism for public art. The Arts Alliance is leading that initiative, and earlier this year applied for a $100,000 grant through the National Endowment for the Arts “Our Town” program to help fund it. At AAPAC’s Aug. 15 meeting, Polich – the alliance’s executive director – advocated for more time so that a fully-developed, comprehensive strategy could be prepared.

Polich questioned how the millage rate was determined in Taylor’s proposal – a 0.1 mill tax for four years. She raised the concern that the city is “leaving money on the table” – that is, it’s possible that voters would be willing to pay more for public art than the amount proposed. Polich also mentioned concerns about the millage’s potential impact on private contributions to arts and cultural organizations, which wouldn’t necessarily get funding from a public arts millage. There might be confusion about that, making fundraising more difficult.

Despite a range of concerns, AAPAC ultimately voted unanimously to recommend that the council place the proposal on the Nov. 6 ballot. Among the commissioners, John Kotarski appeared to be the most enthusiastic supporter of the proposal, praising Taylor for bringing it forward. [Full Story]

Ballot Questions: Parks, Public Art Funding

At its Aug. 9 meeting, the Ann Arbor city council considered three different charter amendments for inclusion on the Nov. 6 ballot. Two were for millages, and a third was for a restriction on the contractual powers of the city with respect to parkland.

The council voted unanimously to place on the ballot a renewal of the city’s parks maintenance and capital improvements millage at the rate of 1.1 mills. One mill is $1 for every $1,000 of taxable value on a property. So for a house worth $200,000, with a state-equalized value of $100,000, a 1.1 mill tax would cost that property owner $110 per year. A renewal would run from 2013-2018 and raise about $5 million next year.

Examples of park maintenance activities include forestry and horticulture, natural area preservation, park operations, recreation facilities, and targets of opportunity. Capital improvement projects would cover parks, forestry and horticulture, historic preservation, neighborhood parks and urban plazas, park operations, pathways, trails, boardwalks, greenways and watersheds, and recreation facilities. The city’s park advisory commission (PAC) had voted unanimously nearly two months ago at its June 19, 2012 meeting to recommend placing that millage renewal before voters.

But one day before the council’s Aug. 9 meeting, PAC had voted unanimously against recommending that another park-related question be placed on the ballot – one that would have asked voters if they wanted to amend the city charter to require a referendum to lease parkland for non-park or non-recreational use for longer than five years. PAC was able to consider a recommendation only because the council had postponed the measure at its July 16, 2012 meeting.

And at its Aug. 9 meeting, the city council did not meet the 7-vote threshold on the 11-member body to place that charter amendment on the ballot. It got just four votes – from Marcia Higgins (Ward 4), Mike Anglin (Ward 5), Jane Lumm (Ward 2) and Stephen Kunselman (Ward 3). Sabra Briere (Ward 1), who had co-sponsored the original resolution, did not vote for it, after modifications to the wording had failed to win the council’s approval.

Not originally on the council’s Aug. 9 agenda, but added at the start of the meeting, was a resolution to place a ballot question before voters in November that would ask them if they want – at least temporarily – to change the way that funds are accumulated to pay for public art in the city. Currently, funds must be set aside as part of most capital improvement project budgets – 1% up to a limit of $250,000 per project.

The ballot proposal on public art would levy a 0.1 mill tax for a four-year period – which translates roughly to $450,000 per year. In its current version, the wording of the proposal would suspend the collection of Percent for Art funds under the city’s ordinance just for the four-year period of the millage. So if voters approved the public art millage this year, and then failed to approve a millage renewal four years from now – either because the council did not place a renewal on the ballot, or voters rejected the renewal – the Percent for Art ordinance would again require that funds from capital project budgets be set aside for public art.

The reaction from councilmembers to the proposal from Christopher Taylor (Ward 3) was generally positive; however, there was considerable dissatisfaction expressed – at the meeting and subsequently – with the secretive nature of the work that had produced it. Taylor’s apparent goal in placing it on the agenda at all was to reveal the content of the proposal, without asking his colleagues to vote on it. Taylor asked for postponement of the resolution after reading aloud a speech about it. The council agreed unanimously to postpone action until its next meeting, on Aug. 20.

Voting on Aug. 20 to place the question on the ballot would allow for some public discussion before taking action on that issue, while still meeting the statutory deadline for delivering ballot language to the Washtenaw County clerk.

The public art commission has called a special meeting for Aug. 15 in order to weigh in on the subject.

Public Art Millage Mooted, Postponed

A resolution that would place a question on the Nov. 6 ballot, asking Ann Arbor voters to pay a 0.1 mill tax for four years to support public art was added to the city council’s Aug. 9 meeting at the very start of the session. When considered later in the meeting, the resolution was postponed until the council’s Aug. 20 meeting.

The strategy pursued by the resolution’s sponsor, Christopher Taylor (Ward 3), was to reveal the details of the proposal on Aug. 9, but to seek its immediate postponement. Ann Arbor Art Millage Idea Floated

Responding to a phone call from The Chronicle, Marsha Chamberlin, chair of the Ann Arbor public art commission, reported that a city council resolution about a millage to support public art might be discussed at the council’s Aug. 9 meeting. [It was, in fact, subsequently added to the agenda.]

Chamberlin’s understanding of the proposal is for a question to be placed on the Nov. 6 ballot, asking voters to pay a 0.1 mill tax to support public art – which would replace Ann Arbor’s current funding strategy for the public art program.

Push to Make Art Commission More Accessible

Ann Arbor public art commission meeting (July 25, 2012): A push for greater public engagement was a theme throughout the July AAPAC meeting, with John Kotarski – one of the newer commissioners – proposing several ways to get more public input.

At Kotarski’s suggestion, commissioners considered three items related to AAPAC meetings: (1) adding a second opportunity for public commentary; (2) changing its meeting times; and (3) alternating the locations of its meetings. Kotarski also raised the possibility of recording the proceedings to be broadcast on Community Television Network (CTN).

The additional public commentary – offering speakers a second three-minute slot at the end of each meeting – was ultimately approved. Less enthusiasm was expressed for pushing back meeting times to later in the day. AAPAC meetings currently start at 4:30 p.m. on the fourth Wednesday of each month, and are held in the basement conference room at city hall. Kotarski proposed moving the meetings to different locations throughout the city, such as schools or other public sites, to make it easier for more people to attend. Commissioners had reservations about that idea too, nor was there much support voiced for a suggestion to record the meetings for broadcast by CTN. Kotarski plans to bring a specific proposal on these items to an upcoming meeting.

Another proposal by Kotarski – to include support for local sourcing as part of AAPAC’s strategic plan – was rejected by other commissioners. Some commissioners felt the idea didn’t fit into a strategic plan, because it was not an action item. Others questioned whether local sourcing of art projects was within AAPAC’s purview, because the commission doesn’t have authority over the city’s purchasing policies. They’ve also been advised that they can’t put geographic constraints on their selection of artists, and felt this would apply to sourcing, too.

Ultimately a four-year strategic plan was approved without Kotarski’s revision. The plan’s goals, in summary form, are: (1) increasing the number of public art pieces throughout the city; (2) diversifying the public engagement and participation in selecting public art; (3) increasing the public’s support and appreciation for public art through PR efforts; and (5) pursuing private funding for public art. More detailed objectives are provided for each of the goals.

Kotarski also was unsuccessful in convincing other commissioners to support an endorsement policy for non-city-funded art projects. AAPAC passed a resolution stating that the commission would not make endorsements – and Kotarski cast the lone dissenting vote. In a separate item, Kotarski joined his colleagues in a unanimous vote to establish an SOQ (statement of qualifications) process that creates an artist registry/database. The intent is to streamline the selection of artists for future projects.

During the July 25 meeting, commissioners were updated on several ongoing projects, including a follow-up on concerns raised last month about the Dreiseitl installation in front of city hall, artwork at a planned rain garden at Kingsley & First, and the status of security checkpoints allowing access to a hanging sculpture in the Justice Center lobby.

There were no updates for some projects because those projects are still being reviewed by the city attorney’s office. Several commissioners expressed frustration at the length of time these reviews are taking. One commissioner wondered what tools AAPAC can use to influence the process, perhaps by appealing to another level within the city administration. AAPAC chair Marsha Chamberlin agreed to draft a letter on the issue, and to discuss it with city councilmember Tony Derezinski, who serves on the commission but has not attended its June or July monthly meetings.

Action was deferred on proposed projects for public art at two locations: (1) a plaza next to the Forest Avenue parking structure near South University; and (2) a future roundabout at Ellsworth and South State. Commissioners wanted more time to visit those sites. They also debated whether to postpone action until task forces are formed to represent four quadrants of the city – it’s part of a new approach they’re planning to take to help guide the selection of projects and ensure that all parts of the city are represented.

The commission is likely to get more advance notice of possible projects, as Aaron Seagraves – the city’s public art administrator – will now be attending meetings of the capital improvements plan (CIP) team. The CIP is relevant to the art commission because funding for the Percent for Art program comes from the city’s capital projects –  with 1% of each capital project, up to a cap of $250,000 per project, being set aside for public art. The CIP also indicates which major projects are on the horizon that might incorporate public art. By identifying such projects, AAPAC can start planning the public art component as early as possible, as part of the project’s design, rather than as an add-on. [Full Story]

Questions Raised over Dreiseitl Sculpture

Ann Arbor public art commission meeting (June 27, 2012): A written report from the public art administrator – explaining why there’s been no water in the Dreiseitl sculpture in front of city hall – led to a broader discussion at AAPAC’s June meeting about that signature piece of public art.

Commissioned by the city from German artist Herbert Dreiseitl and dedicated in October of 2011, the work was designed to use rainwater collected from the roofs of city hall and the adjacent Justice Center. But water has flowed through the fountain only sporadically. The original water pumps clogged and malfunctioned, and are being replaced with a new pump. Yet even when that new pump is functioning, the two tanks, which can hold a total of 2,300 gallons of water are currently dry, and no water is available at this point to run through the sculpture.

Saying that people have asked him why the fountain isn’t working, commissioner John Kotarski asked whether Dreiseitl intended the sculpture to reflect the seasonal rain cycle. Kotarski said he previously hadn’t heard that narrative applied to the sculpture, until it was mentioned in the report by Aaron Seagraves, the city’s public art administrator. Kotarski was appointed to AAPAC well after the sculpture was approved.

Cathy Gendron, who was serving on AAPAC when the project was recommended for approval in 2009, said her expectation had been that water would be a standard part of the piece. She wondered whether something had changed during the engineering process. She noted that it was the first project undertaken by the commission after its formation as part of the city’s Percent for Art program. [It is also the city's largest public art expenditure to date, costing over $750,000.]

Kotarski praised the project, calling Dreiseitl a world-renowned sculptor and noting that Ann Arbor now has something in its public art collection that other cities would love to have. But he called for a full report of the project ”with all of its glory and all of its warts,” so that AAPAC could find out and learn from what has happened.

Commissioners agreed to compile a list of questions to be forwarded to the project’s design team. There was no formal action taken regarding the kind of report that Kotarski requested.

Later in the meeting, commissioners did take action on two items related to AAPAC’s mural program: (1) approval of the final design for a mixed-media mural at Allmendinger Park; and (2) approval of a statement of qualifications (SOQ) to seek potential artists for future murals.

Also at the June 27 meeting, AAPAC vice chair Malverne Winborne made a strategic planning proposal that he had first floated at the commission’s retreat in February. The idea is to approach a plan for public art by looking at quadrants of the city, to help guide the selection of projects and ensure that all parts of the city are represented. Commissioners were supportive of the general concept, but ultimately tabled the item for further discussion at their July 25 meeting.

Two other items were tabled until that July meeting: (1) a discussion on a possible endorsement policy for privately funded art projects; and (2) action on two new proposed public art projects, at the Forest Avenue Plaza in the South University area, and at the future roundabout at South State and Ellsworth.

Commissioners also discussed plans for AAPAC’s participation in the July 16 Townie Street Party. The event is hosted by the Ann Arbor Street Art Fair as a kickoff to the annual art fairs, which run this year from July 18-21. AAPAC has a table in the “Creative Connections” tent. Hannah Nathans, a University of Michigan student intern with the city, has painted a five-foot-tall poster evoking a well-known mural on East Liberty Street by Richard Wolk. It’s intended to be an interactive feature – people can poke their faces through cut-out holes and get their pictures taken. [Full Story]

Public Art Commission Works on Strategic Plan

Ideas included public art at the planned South State and Ellsworth roundabout, projects in underserved neighborhoods, the traffic island at the Washtenaw split with East Stadium, the dog park at Ellsworth and Platt, the non-motorized path along Washtenaw Avenue, and the skatepark at Veterans Memorial Park. About $500,000 is available in unallocated Percent for Art funds, with an estimated $200,000 to $300,000 coming in to the program annually from upcoming capital projects.

The discussion led some commissioners to speculate on the possibility of changing the composition of AAPAC to increase the number of commissioners, so that more people would be available to handle the work. Another possibility  they discussed was making the public art administrator’s job a full-time position. Currently, the public art administrator’s job is defined as 20 hours per week, with additional hours added for management of specific projects. After some discussion, it seems unlikely that commissioners will pursue either of those options at this time.

The commission handled two action items during the May 23 meeting. Connie Rizzolo Brown was recommended to represent AAPAC on a new city task force for the North Main/Huron River corridor. The task force had been established by the city council at its May 7, 2012 meeting with 10 members, then expanded at the council’s May 21 meeting to include four additional members. The council vote to add an AAPAC representative had passed on a 6-5 split, with some councilmembers concerned that the group was getting too large.

At their May 23 meeting, art commissioners also voted to fully fund the mural project at Allmendinger Park for $12,000. Previously, an initial $10,000 budget later had been increased to $12,000, with $7,200 of that amount to be paid for with a grant from the Ann Arbor Area Community Foundation. But the city council first must formally accept the grant, and that’s not expected to happen until its June 18 meeting. Meanwhile, Percent for Art funds will be allocated to the project so that a contract can be executed with artist Mary Thiefels. The foundation grant will eventually reimburse the program for this project.

Also discussed at Wednesday’s meeting were the upcoming Golden Paintbrush awards, which will likely be presented at the city council’s June 18 meeting. The awards recognize local contributions to public art. This year, former AAPAC chair Margaret Parker will be among those artists honored. [Full Story]

Public Art Rehashed by Ann Arbor Council

Ann Arbor city council meeting (May 7, 2012) Part 2: Public art was one of two highlighted themes of the council meeting, along with possible future additions to the park system. The future additions to public parks and open space are handled in Part 1 of this meeting report: “Council Parcels Out Tasks: Open Space.”

Public art was featured in two specific agenda items. One was a presentation of the annual public art plan given by Wiltrud Simbuerger, a member of the city’s public art commission. The council gave the presentation a basically positive reception.

But the second agenda item required a vote – on a $150,000 piece of art proposed by Ed Carpenter, to be hung in the lobby of the new Justice Center. The city’s public art commission had selected Carpenter from responses to a request for proposals. A vote on the artwork, a piece called “Radius,” had been postponed from the council’s April 2, 2012 meeting over concerns about public access to the Justice Center lobby, where the sculpture will be hung.

A nearly one-hour debate unfolded about the Carpenter piece, with the specific artwork serving as a kind of proxy for a rehash of previous council debates on the city’s Percent for Art ordinance. The ordinance requires that all city capital improvement projects include 1% for public art, up to a cap of $250,000 per capital project. For capital projects that aren’t suitable to have public art incorporated into them, the 1% is “pooled” for use in some other public art – which must be related to the purpose of the funding source. For example, the fountain outside the new Justice Center, designed by German artist Herbert Dreiseitl, is funded with money pooled from 1% of some sanitary sewer projects, drinking water projects, and stormwater management projects.

Jane Lumm (Ward 2) proposed an amendment that would have canceled Carpenter’s project and appropriated the art project funds to invest instead in the city hall building. That amendment failed, but piqued mayor John Hieftje into announcing that he’d be sponsoring a future resolution to take $50,000 from public art funds, and deposit that amount into the general fund. That move is susceptible to the same critique made by several councilmembers as well as the assistant city attorney against Lumm’s amendment: The public art ordinance prohibits transfer from public art funds to other funds. Stephen Kunselman (Ward 3) stated that he would be content for the council simply to violate that ordinance. Carpenter’s sculpture eventually was approved over the dissent of Kunselman and Lumm.

Besides public art, the council approved the city’s portion of the State/Ellsworth traffic roundabout project, which includes an improvement for a water main connection – to pipe water from a well on the property of Ann Arbor’s municipal airport to the city’s water treatment plant. The airport also made it onto the agenda in the form of a resolution that settled outstanding legal issues surrounding the construction of hangars on the property.

Prompting extended discussion by the council was a resolution that invalidates sidewalk occupancy permits for vendors in a specific area around Main Street between Huron and William, whenever Main Street is closed down for special events.

The council delayed action on a tax abatement for the battery technology company Sakti3, pending review by the city council’s budget committee. And the council authorized another five-year extension of its contract with Waste Management to haul the city’s trash to a landfill.

The council also heard its usual range of public commentary. The public hearing on the fiscal year 2013 budget enjoyed light participation. The council will vote on that budget, and any amendments, at its May 21 meeting. [Full Story]

City Council OKs Justice Center Art

At its May 7, 2012 meeting, the Ann Arbor city council approved the use of $150,000 for a public art project in the lobby of the new municipal building called the Justice Center – located on the northeast corner of Huron Street and Fifth Avenue in downtown Ann Arbor. The money will pay for a sculpture called “Radius” by Ed Carpenter of Portland, Oregon. The resolution passed over dissent from Jane Lumm (Ward 2) and Stephen Kunselman (Ward 3).

The Justice Center, a new building next to city hall, houses the 15th District Court and the Ann Arbor police department. Previously council had postponed the approval of public art funds at its April 2, 2012 meeting.

Art for E. Stadium, Argo Cascades Moves Ahead

Ann Arbor public art commission meeting (April 25, 2012): Two action items on this month’s AAPAC agenda advanced art projects to be located at the East Stadium bridges and Argo Cascades.

Commissioners approved a $150,000 budget for artwork at the new Huron River bypass near the Argo Pond canoe livery – called Argo Cascades. A task force recommended that the artwork have a “water” theme, and use the bulk of $155,561 that has accumulated from the city’s Percent for Art funds from water-related capital projects. The city will issue a request for artists to submit a statement of qualification (SOQ), and from those submittals a smaller number of artists will be paid $1,000 each to submit formal proposals.

In a separate vote, commissioners approved issuing a request for proposals (RFP) for artwork at the East Stadium bridges. They had previously set a budget of $400,000 for that project, which potentially will incorporate multiple locations on and near the reconstructed bridges.

Several other projects were discussed at the April 25 meeting, but no formal action was taken. During public commentary, commissioners heard from Dave Konkle and Tim Jones regarding a large Whirlydoodle installation they hope to build. The devices were invented by Jones as miniature wind generators, with LED lights that vary in color depending on wind speed – about two dozen are currently placed around the downtown area. A large-scale installation would help people to visualize wind currents and prompt a discussion about alternative energy, he said.

Konkle is the city’s former energy coordinator who now does consulting work for the Ann Arbor Downtown Development Authority as energy programs director. He told commissioners that a display of 1,000 Whirlydoodles – possible at the former landfill at Platt and Carpenter – would result in Ann Arbor having more wind generators than any other city in the world, and would bring the city national attention. The two men asked AAPAC to endorse the proposal, but commissioners did not act on it or discuss it in depth at the meeting.

They did discuss the status of a glass sculpture that AAPAC recommended for the lobby of the Justice Center, which awaits city council approval. At their April 2, 2012 meeting, councilmembers postponed a vote on the $150,000 project until their May 7 meeting, hoping to address concerns about access to the lobby. Visitors must pass through a security checkpoint to enter, and some councilmembers hope that the checkpoint can be relocated. AAPAC commissioners talked about the need to decouple the artwork approval from the broader concerns about access to the lobby, so that the art project can move forward.

During the meeting, two other potential projects were introduced: (1) an art loan program, to select work from individual artists or galleries that would be installed on city-owned property for a temporary period; and (2) a proposal to fund poles in the downtown area that would be used to hang banners over the street. Tony Derezinski, an AAPAC member who also serves on the city council, brought forward the idea for banner poles, to provide an alternative to the current anchors that are affixed to building facades. He described the poles as easels for the banners, which he characterized as artwork. The banners typically are purchased by organizations to promote upcoming events.

Commissioners also received updates on several ongoing projects at their April meeting: (1) the Golden Paintbrush awards, which will be presented in June; (2) a mural at Allmendinger Park; (3) artwork in the proposed city rain garden at Kingsley and First; and (4) signs for the city hall plaza and Herbert Dreiseitl water sculpture.

Commissioners also reached a consensus to hold another retreat in May, following up on a four-hour retreat on Feb. 26, 2012, to address the creation of a master plan for public art, among other issues. [Full Story]

City Council on Art, DDA: Status Quo Is OK

Ann Arbor city council meeting (April 2, 2012) Part 2: At a long meeting that stretched until midnight, the council handled multiple items involving direction to city staff – one of which was related to enforcement of medical marijuana laws. All medical marijuana issues from the meeting are covered in Part 1 of The Chronicle’s meeting report.

Neither of the other two resolutions involving direction to staff got much support on the council. Failing on a 3-7 vote was a resolution that would have directed the city attorney to provide a written opinion on the transfer of funds from the city’s street millage fund to the public art fund. The resolution got support only from its sponsors, Stephen Kunselman (Ward 3) and Sabra Briere (Ward 1), who were joined by Mike Anglin (Ward 5). The council postponed a separate item that would have authorized $150,000 for a piece of art that the public art commission has recommended for the lobby of the new Justice Center.

Failing on a 4-6 vote was a resolution related to the Ann Arbor Downtown Development Authority. It directed city staff to “to review, analyze, and report on the compliance of the DDA provided TIF calculation and capture amount” – an issue that relates to excess capture of taxes identified last year. The three who supported the resolution requesting an opinion on public art were joined by Jane Lumm (Ward 2) in supporting the TIF resolution. Only 10 councilmembers attended the meeting – Marcia Higgins (Ward 4) was absent. But even if Higgins had voted for the two resolutions, they still would have failed.

Generating some controversy were two items involving automobiles. The council gave final approval to changes in parking regulations that include a provision allowing the developer of a downtown project to meet minimum parking requirements without building parking spaces on site. The alternative is to make a payment in lieu of building parking spaces, or to sign a long-term contract to purchase monthly parking permits in the public parking system. Anglin voted against the ordinance change as well as the specific policy governing the payments in lieu of parking.

On another automobile-related item, Anglin was joined by Lumm in opposing a resolution that made a formal request to the Michigan Dept. of Transportation to convert a segment of Jackson Road between Maple Road and South Revena from four traffic lanes to three. That request will move forward. In another road-related item, the council unanimously approved a $3,647,344 construction contract for the first set of streets to be repaired in the 2012 program. That will be followed at the council’s next meeting, on April 16, by a second contract for an additional set of streets.

The council also gave approval to three different site plans – for Arbor Hills Crossing on Washtenaw Avenue, Les Voyageurs near Argo Pond, and Noodles & Co. on West Stadium Boulevard.

Long-Term Planning for Ann Arbor Public Art

A task force had recommended that the project be well-funded, because the location would be a highly visible landmark marking an entrance into the city – it’s near Michigan Stadium and the Crisler Center, for example. No artist has been selected yet, nor has a request for proposals been issued – that’s under review by the city attorney’s staff.

The artist would have a large role in selecting locations for the artwork. Places for art might include the underpass and staircases at South State Street; the fence along Rose White Park, which is adjacent to East Stadium Boulevard; or the bridges themselves, spanning over railroad tracks and South State Street. Any final project and budget would require the city council’s approval.

The commission postponed action on a proposal related to artwork at Argo Cascades, the new Huron River bypass near Argo Pond. Neither of the two commissioners who serve on a task force for the project – Malverne Winborne and John Kotarski – attended the AAPAC meeting, and other commissioners felt more information was needed before moving forward.

Final touches were put on an annual public art plan for FY 2013, describing projects that AAPAC intends to work on between July 1, 2012 and June 30, 2013. [.pdf of FY 2013 annual public art plan] In addition to specific art projects like those for the East Stadium bridges and a mural at Allmendinger Park, the two-page document calls for developing a master plan for public art to guide future decision-making through 2016.

During the meeting, Aaron Seagraves – the city’s public art administrator – noted that nominations are being accepted through April 13 for the Golden Paintbrush awards, which recognize local contributions to public art. A nomination form can be downloaded from the commission’s website.

The March 28 meeting was attended by three people who were not affiliated with the commission, including Jack Urban, a Kalamazoo County commissioner and chair of the Kalamazoo public arts commission. He noted that unlike Ann Arbor, the Kalamazoo public art commission does not have a funding source. So the group is looking to establish itself and seek financial support, he said. [Full Story]

Ann Arbor Delays $150K Justice Center Art

At its April 2, 2012 meeting, the Ann Arbor city council postponed a vote on the use of $150,000 for a public art project in the lobby of the new municipal building called the Justice Center, located on the northeast corner of Huron Street and Fifth Avenue in downtown Ann Arbor. The Justice Center, a new building next to city hall, houses the 15th District Court and the Ann Arbor police department. The postponement will be for one month, until the council’s first meeting in May – May 7.

In what some city workers say is the first demonstration at the new plaza in front of city hall, a group has gathered on International Women’s Day to protest funding spent on the Herbert Dreiseitl water sculpture, saying it could be better spent on women’s issues – supporting, for example, SafeHouse Center, a shelter for victims of domestic violence. A police officer has emerged and has taken down cardboard signs that were tied with string to the sculpture. Shaping Ann Arbor’s Public Art Landscape

Ann Arbor public art commission retreat (Feb. 26, 2012): At a four-hour retreat on Sunday, the nine-member public art commission began developing a master plan to guide the allocation of Ann Arbor’s Percent for Art funds and the selection of future public art projects.

The Percent for Art program, overseen by AAPAC, allocates 1% for public art from all of the city government’s capital projects. The program faced potential cuts by the city council last year, though a majority of councilmembers ultimately voted against decreased funding. There’s also been criticism that the commission, which was formed in 2008, has been too slow in funding works of art. The commission itself has seen recent turnover, with three new commissioners appointed since late 2011.

It’s in this context that AAPAC decided to work on a master plan – the retreat was a step toward that goal, though it’s expected to take several more months to complete. Meanwhile, the commission is also preparing an annual plan to approve at its next meeting, on March 28, with a list of specific projects it intends to pursue in the coming fiscal year. The public art ordinance requires that the annual plan be submitted to the city council by April 1.

Sunday’s retreat covered a broad range of topics. Commissioners discussed the need to address all aspects of their mission, as spelled out in the ordinance – including education, outreach and promotion of public art. John Kotarski, one of the newest commissioners, proposed a motto to reflect that goal: “The educated resident is the best consumer of public art.”

Questions were raised about whether Percent for Art funds could be used for outreach and promotion – in the past, AAPAC has been told by city staff that funding is restricted to permanent capital projects. Kotarski advocated for including temporary projects, such as an artist-in-residence program or events like FestiFools. If the ordinance doesn’t currently allow temporary work, he suggested amending it.

When Kotarski urged the commission to seek clarity from the city attorney’s office, Tony Derezinski – a commissioner who also serves on the city council – said the city attorney’s staff is already working on legal opinions related to questions from councilmembers. He indicated that the legal staff would be willing to attend a future AAPAC meeting to answer these questions.

Also during the meeting, Aaron Seagraves, the city’s public art administrator, presented preliminary results of an online survey of residents, which yielded 437 responses. [.pdf of preliminary survey report] In response to one of the questions – “Where are the public places in the city that would benefit from a public art project?” – the top three responses were parks (27 responses), “none” (25 responses) and Main Street (23 responses.)

Other items emerged at the retreat. Theresa Reid, the newest commissioner who was appointed earlier this year, reported that she and others are working to apply for a National Endowment for the Arts “Our Town” grant, to help pay for a countywide public arts planning process. Derezinski indicated that the Detroit Institute of Art’s Inside|Out project, which involves installing framed reproductions from the DIA’s collection at outdoor locations on building facades or in parks, likely won’t come to Ann Arbor until 2013. When originally proposed in October 2011, it was expected to take place this year.

Another possible project on the horizon is tied to the resurfacing of Main Street in 2013. AAPAC chair Marsha Chamberlin said the Main Street Area Association and Downtown Development Authority are interested in some kind of “street stamping” project. It’s a project that’s in the very early stages, she said, but might include ideas like creating patterns on the street at crosswalks, for example.

Though discrete projects were mentioned, the focus of the retreat remained on big-picture goals. Common themes included the importance of public art in creating a sense of identity for the community, and of its role in supporting the local economy. [Full Story]
