Homeless Issues Emerge on County Agenda
Washtenaw County board of commissioners meeting (April 2, 2014): Responding to several homeless residents who spoke during public commentary, commissioners spent about 90 minutes on April 2 discussing how to address short-term and long-term needs of the homeless.
The board ultimately voted to direct county administrator Verna McDaniel to work with community partners to address immediate needs of the homeless. In general, McDaniel has budgetary discretion to spend up to $50,000 on professional services contracts, and up to $100,000 for any proposed goods, services, new construction or renovation. Later in the week, she allocated $35,000 to the Delonis Center – which is run by the nonprofit Shelter Association of Washtenaw County – to keep its nighttime warming center open through April 30. The warming center had originally been slated to close for the season on April 6.
The resolution also directed the administration to develop a plan by May 7 for updating the county’s Blueprint to End Homelessness, which was adopted in 2004 but appears to be dormant. The process of updating that plan is to be completed by Oct. 1, 2014.
Conan Smith (D-District 9) had initially suggested allocating $40,000 to the shelter to keep the warming center open another month. Other commissioners had concerns about throwing money at the shelter without any input from shelter staff, and without knowing specifically how the money would be used. Because the item hadn’t been included on the agenda, representatives from the shelter staff didn’t attend the meeting.
Some commissioners thought there should be a strategic plan in place before any additional funding is given – and they seemed to assume that such a plan doesn’t already exist. Mary Jo Callan, director of the county’s office of community & economic development, noted that the city of Ann Arbor and several other entities are working on this issue, in partnership with the Shelter Association. The board had received a briefing from the association’s executive director, Ellen Schulmeister, at their Feb. 6, 2014 working session.
The vote on the resolution was 6-2, over dissent from Republicans Dan Smith (District 2) and Alicia Ping (District 3), who both objected to the process. Rolland Sizemore Jr. (D-District 5) was absent.
Dan Smith called it “completely and entirely inappropriate” to be making policy and budgetary decisions on the fly, in response to a few people who showed up to speak during public commentary. He supported updating the Blueprint to End Homelessness, but thought it was a discussion that should take place at a working session before taking action at a regular board meeting. Yousef Rabhi (D-District 8) responded by saying that commissioners are elected to work for the people. When people come to the board, it’s important to address their concerns in a serious manner, he said.
Because of the length of the meeting, some men who were staying at the shelter missed the 9:30 p.m. curfew. Typically, anyone showing up after that time isn’t allowed inside. Greg Dill, the county’s director of infrastructure management, contacted the shelter staff and made arrangements for the men to be accommodated.
In other action, commissioners gave initial approval to a two-year pricing proposal – for 2016 and 2017 – to provide police services to local municipalities through contracts with the county sheriff’s office. Some commissioners expressed concern about the financial sustainability of this approach to funding police services, and cited the need for new revenue sources for public safety. Sheriff Jerry Clayton was on hand to present the pricing proposal, and supported suggestions to seek a new funding source. As he’s done in the past, Clayton characterized the issue of public safety as one that encompasses economic development, human services and other aspects of the community.
Commissioners also gave initial approval to a new brownfield redevelopment plan for the Thompson Block in Ypsilanti’s Depot Town, and took final action to add autism coverage to the health care benefits for employees. They postponed action on a resolution related to the county road commission until May 7, following an April 17 working session that will focus on that issue. The board also was briefed on the 2013 audit and comprehensive annual financial report (CAFR), and received an award for financial reporting from the national Government Finance Officers Association.
During communications, Felicia Brabec (D-District 4) reported that the review of applications is underway for the current cycle of coordinated funding, a partnership to fund social service agencies that involves the county, city of Ann Arbor, and several other entities. For this cycle, 105 applications were received, representing $8.7 million in requests. The amount of available funding this year from all partners is $4.4 million. “So it’s a difficult, difficult process,” she said. Funding recommendations will be brought to the board in May.

The plan relates to a renovation of an abandoned 77,700-square-foot warehouse at 140 Buchanan in the city of Chelsea. The company plans to invest more than $4 million in the project, according to a staff memo that accompanied the Oct. 16 resolution.

County Board Debates Taxes, State Laws
Washtenaw County board of commissioners meeting (Oct. 16, 2013): A packed agenda and extensive public commentary resulted in a meeting lasting over six hours, with the majority of discussion focused on three issues: (1) the state’s Stand Your Ground law; (2) an increase to the Act 88 tax, and questions about the legality of such a levy; and (3) the county’s participation in a Pittsfield Township corridor improvement authority for State Street.
About three dozen people spoke to the board about the Stand Your Ground resolution, which urged the state legislature to repeal that law. Although there were speakers on both sides of the issue, more than 20 voiced opposition to the resolution, including several who attended the meeting wearing sidearms.
It was after midnight when the board took a 5-to-4 vote to pass the resolution, over dissent from Kent Martinez-Kratz (D-District 1), Dan Smith (R-District 2), Alicia Ping (R-District 3), and Rolland Sizemore Jr. (D-District 5). In support of the resolution were Felicia Brabec (D-District 4), Ronnie Peterson (D-District 6), Andy LaBarre (D-District 7), Yousef Rabhi (D-District 8) and Conan Smith (D-District 9).
The following week, David Raaflaub of Ypsilanti – a former candidate for county commissioner – filed a complaint against the board in the 22nd Circuit Court. The complaint asks the court to determine two issues: (1) what authority the board has that enables it to “draw conclusions of law,” and (2) what authority the board has to represent the county in seeking changes to state law. Dan Smith has indicated that he would bring forward a resolution to rescind the board’s Oct. 16 action, if it’s determined that the county will incur additional costs – such as fees for outside legal counsel – to defend the lawsuit.
Another major debate on Oct. 16 related to an increase in the Act 88 tax levy, which funds economic development and agriculture – including activities of Ann Arbor SPARK. The board ultimately gave initial approval to increase the tax from 0.06 mills to 0.07 mills, following a long discussion and a failed attempt by Conan Smith to increase the tax even more, to 0.09 mills. His proposal for a draft policy to guide the allocation of Act 88 funds did win support from the majority of commissioners, however.
The county’s position is that it’s authorized to collect the Act 88 millage – as well as a levy for veterans relief services – without seeking voter approval. That’s because the state legislation that enables the county to levy these taxes predates Michigan’s Headlee Amendment. During deliberations, Dan Smith raised questions about whether levying this kind of tax is constitutional. He also questions whether the language of the Act 88 statute allows the kind of general interpretation the county is using to define eligible uses of funds generated by the levy.
Dan Smith also proposed amendments for both the Act 88 and veterans relief millages in the future exempt them from capture by tax increment financing (TIF) districts or authorities in the county. Those exemptions, which were approved by the board, would apply to tax capture from a proposed State Street corridor improvement authority (CIA) in Pittsfield Township. After about 90 minutes of debate, the board gave initial approval to participate in that project, with Dan Smith casting the only dissenting vote. He had unsuccessfully proposed postponement, then floated an opt-out resolution that did not secure enough votes to pass. The board is expected to take a final vote on participating in the CIA at its Nov. 6 meeting.
In other action, the board (1) gave initial approval to a proposed brownfield redevelopment plan by the Chelsea Milling Co., makers of Jiffy Mix; (2) appointed Barb Fuller to the county road commission; (3) took an initial vote to extend the coordinated funding approach, which supports local nonprofits; and (4) authorized the annual apportionment report, with details of the 2013 taxable valuations for property in the county.
And in a vote taken after midnight, the board rejected a proposal that would have given notice to eliminate a lump-sum budgeting approach for Washtenaw County’s court system. That vote was 3-6, with support from only Dan Smith (R-District 2), Conan Smith (D-District 9) and Kent Martinez-Kratz (D-District 1). [Full Story]

County Board Sets 4 Public Hearings
Washtenaw County commissioners set four public hearings for Oct. 16 to get input on items they’ll be considering at upcoming meetings. The action took place at the county board’s Oct. 2, 2013 session.
Three of the hearings that will take place on Oct. 16 relate to:
- An increase to the Act 88 millage from 0.06 mills to 0.07 mills. The millage would be levied in December 2013 and would raise an estimated $972,635.
- The proposed 2014-2017 budget, which was presented by county administrator Verna McDaniel on Oct. 2. The board is required to approve the $103 million general fund budget for 2014 by the end of this year. [.pdf of draft 2014-2017 budget]

County Gets Input on Bonding, Despite Delay
Washtenaw County board of commissioners meeting (July 10, 2013): A non-voting item – the county’s bonding proposal, which is now on hold – was the focus of most public commentary at the board’s July 10 meeting, which also included a previously scheduled public hearing on the topic.
Several of those who spoke are affiliated with the Washtenaw Watchdogs. The group has raised concerns about the bonding and is prepared to launch a petition drive that would force the proposal to be put on the ballot for voters to approve.
The bond initiative, publicly proposed in May, was intended to cover unfunded pension and retiree healthcare obligations – for the Washtenaw County Employees’ Retirement System (WCERS) and Voluntary Employees Beneficiary Association (VEBA). The original maximum amount for the bonds had been estimated at up to $345 million. But updated actuarial data resulted in a lower estimate of about $295 million.
However, on July 3, board chair Yousef Rabhi (D-District 8) and county administrator Verna McDaniel issued a joint statement announcing a decision not to put bond-related action items on the July 10 agenda. They cited the need to address unanswered questions, including uncertainty about the state approval process. No date has been set to reschedule action, if any, on the proposal.
In addition to the bond proposal hearing, the board held three other public hearings during its July 10 meeting: on two brownfield plans in Ann Arbor – for 544 Detroit St. and Packard Square (the former Georgetown Mall) – and for annexing land from Scio Township into the village of Dexter to accommodate the expansion of Dexter Fastener Technologies, known as Dextech. All items were subsequently approved by commissioners.
The board also gave final approval to a range of infrastructure projects totaling about $5 million for county government facilities – including redeveloping the Platt Road site in Ann Arbor where the old juvenile center was located. An amendment brought forward by Andy LaBarre (D-District 7) called for creating a 9-member advisory committee to guide the dispensation of the Platt Road site, which is located in his district. Ronnie Peterson (D-District 6) raised concerns about the authority of such a committee. He was assured that the board retains control over whether to act on the committee’s recommendations. Details of how the advisory committee will be appointed, as well as the committee’s formal mission, will require approval from the board at a later date.
In other action, the board gave initial approval to a modest increase in staff for the Washtenaw County clerk/register of deeds office – bumping up a staff position from part-time to full-time – primarily to handle an increase in processing passports and concealed pistol license applications. Commissioners also made several appointments to various boards and commissions, nominated by Rabhi as board chair. He announced he wasn’t yet ready to make nominations to the county’s historic district commission.
Also pushed back was a final vote on a notice of intent to eliminate a lump-sum budgeting approach for Washtenaw County’s court system. Initial approval for this action came on a 5-4 vote at the board’s June 5, 2013 meeting. But on July 10, Alicia Ping (R-District 3) – who had originally brought forward the proposal – asked for postponement until the board’s Oct. 16, 2013 meeting, citing communications she’d had with trial court chief judge Donald Shelton. The vote to postpone was 6-2, with dissent from Dan Smith (R-District 2) and Conan Smith (D-District 9). Rolland Sizemore Jr. (D-District 5) was absent.
In addition to feedback about the bonding proposal, commissioners heard from leaders of two nonprofits – Washtenaw Success by 6 Great Start Collaborative and Interfaith Hospitality Network-Alpha House – about the need to support human services funding. Uncertainty about the upcoming budget has caused concern among nonprofits that have been historically funded by the county.
Also during public commentary, two members of the Church of the Good Shepherd in Ann Arbor thanked commissioners and staff for quickly restoring domestic partner benefits to nine county employees, following recent court rulings that enabled the county to reinstate such benefits.
Facial hair got a minor mention at the July 10 meeting, when Rabhi told Dan Smith: “Your beard is epic – congratulations on it.” Smith used the opening to mention that he’s growing the beard for his role as Lazar Wolf in the upcoming production of “Fiddler on the Roof.” The show runs from July 19-21 at the Whitmore Lake High School Theater. Two brownfield plans – both for projects located in Ann Arbor – were given approval by the Washtenaw County board of commissioners at its July 10, 2013 meeting, following public hearings on each plan. The projects are at Packard Square (the former Georgetown Mall) and 544 Detroit St. The Ann Arbor city council had signed off on the plans at its June 17, 2013 meeting.
Since the city of Ann Arbor joined the Washtenaw County Brownfield Redevelopment Authority (WCBRA) in 2002, brownfield projects located in the city must receive approval by the county board. Plans OK’d: State Street, 544 Detroit, Packard Square
At its June 17, 2013 meeting, the Ann Arbor city council gave approvals in connection with three developments.
First, the council approved the site plan for the State Street Center, near the intersection of South State and Ellsworth. The project calls for demolishing a vacant 840-square-foot house on this site. In its place, the developer plans a one-story, 1,700-square-foot drive-thru Jimmy John’s restaurant facing South State Street. The rezoning of the parcel for this site plan was given final approval at the council’s June 3, 2013 meeting.

County Board Deals with Transit, Budget, Labor
Washtenaw County board of commissioners meeting (Aug. 1, 2012): In a move that extends the approval process for a countywide public transportation system, commissioners amended the articles of incorporation for a new transit authority then ultimately approved that document and a related four-party agreement on a 6-4 vote.
Because the articles were amended, they will need to be reconsidered by the other three parties in the agreement: the city councils of Ann Arbor and Ypsilanti, and the board of the Ann Arbor Transportation Authority, which is spearheading this effort. Those governing bodies are expected to take up the issue at meetings later this month. It will be on the Ann Arbor city council agenda for its Aug. 9 meeting.
Before the county board’s Aug. 1 vote, about a dozen people spoke during a public hearing on the issue, the majority of them in support of the agreement and of expanded public transit in general.
Although amendments had been considered and voted down at the board’s July 11 meeting, on Aug. 1 Rob Turner proposed a new amendment to the articles of incorporation. The original draft stipulated that a two-thirds majority of the new authority’s board would be required to amend the articles of incorporation. Turner’s amendment would have stipulated that a unanimous vote by the new authority’s board would be needed to make such changes. Leah Gunn offered a compromise – a four-fifths majority, or 12 of the new authority’s 15 board members. That amendment to Turner’s amendment passed on a 6-4 vote, with dissent from Turner, Conan Smith, Felicia Brabec and Wes Prater. The vote on the amended amendment itself – requiring the four-fifths majority – passed unanimously.
Turner felt his original amendment offered safeguards for smaller communities. It’s possible for communities to decide to join the new transit authority, only to have the articles of incorporation – the “rules of the game” – changed after they’ve joined, he said. If his amendment had been approved, Turner said he would have supported the four-party agreement and articles of incorporation. He said it no longer seemed like a countywide authority – it seemed like an Ann Arbor system that others could join. That saddened him, he said.
Joining Turner in his final vote against the overall agreement and articles of incorporation were Alicia Ping, Wes Prater and Dan Smith. Rolland Sizemore Jr. was absent.
A range of other items were on the Aug. 1 agenda. Commissioners suspended the county’s use of Construction Unity Board (CUB) agreements, responding to a change in state law. They also gave final approval to a change in the county’s accommodations ordinance, exempting bed & breakfasts, cottages and individuals who occasionally lease out rooms from the 5% accommodations tax. And addressing a need for veterans, the board authorized the county clerk to offer photo IDs that can be used to redeem discounts offered at local businesses.
On an 8-2 vote, commissioners also approved a brownfield financing plan for a $39 million residential development at 618 S. Main St. in Ann Arbor. Before the board’s vote, both Felicia Brabec and Yousef Rabhi praised the development, but said they were voting against it because of concerns about affordability. They did not feel that most young professionals would be able to afford living there, and stressed the importance of having more affordable housing in the downtown area.
The board also heard a report from the county treasurer, and got a second-quarter financial update from staff. Commissioners then approved a $1,263,994 mid-year adjustment to its 2012 general fund budget, bringing the 2012 general fund budget to $101,162,770.
In one of the least controversial items of the meeting, commissioners passed a resolution commending the Washtenaw Community Concert Band – formerly the Ypsilanti Community Band – on its 35th season. Dan Smith, who plays the trumpet, is a member of that group. [Full Story]

At its June 18, 2012 meeting, the Ann Arbor city council approved the site plan and the brownfield development financing for the 618 S. Main project.
The 618 S. Main project is an apartment complex that developer Dan Ketelaar intends to market to young professionals. The 7-story building would include 190 units for 231 bedrooms, plus two levels of parking for 121 vehicles. The project had received approval from the city planning commission on Jan. 19, 2012.
At 85-feet tall, the project is 25 feet higher than permitted in the D2 (downtown interface) zoning district where the site is located. County Board Votes on Brownfield Plans
Action was taken on two brownfield plans during the Dec. 7, 2011 meeting of the Washtenaw County board of commissioners.
The board gave final approval to a brownfield plan for Ford Motor Co’s Rawsonville plant, after holding a public hearing on the plan earlier in the meeting. The plan would allow Ford to apply for $625,000 in Michigan Business Tax credits. According to a staff memo, the plan – with the potential tax credits – would allow the company to retain 260 jobs by bringing back work that’s currently done in China and Mexico. Investment in 2012 would be about $20 million, with total jobs stabilized at about 700 workers.

City Council OKs Arbor Hills Crossing Plan
At its Nov. 21, 2011 meeting, the Ann Arbor city council approved the site plan for Arbor Hills Crossing, a proposed retail and office complex at Platt and Washtenaw.
The project involves tearing down three vacant commercial structures and putting up four one- and two-story buildings throughout the 7.45-acre site – a total of 90,700-square-feet of space for retail stores and offices. Three of the buildings would face Washtenaw Avenue, across the street from the retail complex where Whole Foods grocery is located. The site would include 310 parking spaces.
The city’s planning commission unanimously recommended approval of the site plan at its Oct. 18, 2011 meeting. Action had been postponed at the commission’s June 7, 2011 meeting so that the developer – Campus Realty – could address some outstanding issues with the plan.
The council also approved the brownfield plan for the project, which includes $6.7 million in tax increment financing to be paid back over a 19-year period. The Washtenaw County board of commissioners will still need to sign off on the brownfield plan. Washtenaw Sets Brownfield Plan Hearings
At its Nov. 16, 2011 meeting, the Washtenaw County board of commissioners set two public hearings regarding brownfield plans for projects in Ann Arbor and Ypsilanti Township. Because Ann Arbor and Ypsilanti Township are members of the Washtenaw County Brownfield Redevelopment Authority, the brownfield plans require approval by the county board.
A public hearing for a brownfield redevelopment at Ford Motor Co’s Rawsonville plant was set for Wednesday, Dec. 7 during the county board meeting, which begins at 6:45 p.m. in the administration building at 220 N. LaFontaine Brownfield Plan Gets Final Approval
At its June 1, 2011 meeting, the Washtenaw County board of commissioners gave final approval to the brownfield plan for the LaFontaine Chevrolet redevelopment project in Dexter.
The LaFontaine brownfield plan would enable the use of up to $330,330 of tax increment financing (TIF) for four years to pay for cleanup work, including asbestos and lead abatement. Of that amount, $25,410 would support the county’s brownfield program management, and $50,820 would be deposited into the county’s Local Site Remediation Revolving Fund. The project is expected to retain 76 jobs and create 50 new ones, and to increase the annual tax revenues to the county from $4,516 to $11,119 after the TIF ends.

Loan Request Pulled for Packard Square
Washtenaw County board of commissioners chair’s briefing (May 24, 2011): Developers for the Packard Square project in Ann Arbor have decided not to apply for a state loan that had spurred debate among county commissioners. The board was told of the decision at a May 24 agenda briefing.
At their meeting last week on May 18, Washtenaw County commissioners had postponed action on a request to approve a $1 million loan application to the state Dept. of Environmental Quality for brownfield cleanup at the former Georgetown Mall site. Developers were asking to use the county’s full faith and credit as a guarantee for the loan – a request that caused concern over entering into a relationship with a private developer that might pose a financial risk for the county.
The board was expected to take up the request again at their June 1 meeting, along with consideration of a broader public-private investment policy they’re developing, which was also postponed from the May 18 meeting. But now that there’s no loan in play, commissioners seemed inclined to defer action on the policy as well, giving the county’s attorney more time to analyze the issue.
Other items previewed from the June 1 agenda include: (1) five drain projects in the city of Ann Arbor that require bonds backed by the county’s full faith and credit, totaling $6.54 million; (2) acceptance of $455,000 in federal stimulus funds for the county’s weatherization program, which has already received over $4 million in grants over the past three years, and (3) approval of a new public health medical director. Packard Square Proposal Moves Ahead
Washtenaw County board of commissioners meeting (May 18, 2011): Two topics took up the bulk of time and attention during the most recent county board meeting: (1) proposals related to the Packard Square development in Ann Arbor; and (2) funding recommendations for nonprofits that provide human services to county residents.
After much discussion, commissioners gave final approval to a brownfield plan for the Packard Square project, which will help fund environmental cleanup on the site of the former Georgetown Mall. The board also approved a $1 million grant application to the state Dept. of Environmental Quality for brownfield cleanup at the proposed $48 million development. Commissioner Wes Prater voted against the brownfield plan and the grant application.
The board postponed action until June 1 on a $1 million loan application to the MDEQ, as well as a request to authorize designation of the county’s full faith and credit as a guarantee for any loan that might be awarded, up to $1 million. They also discussed but ultimately postponed action on a broader public-private investment policy they’re developing, a policy spurred in large part by the request to back the MDEQ loan.
The policy discussion will likely be pushed back even further. At a May 24 briefing to review the June 1 agenda, commissioners learned from county staff that The Harbor Cos., developers of Packard Square, decided not to apply for the MDEQ loan. In light of that decision, the board is expected to take more time to flesh out details for its policy on public-private investment. The other major item on the May 18 agenda related to funding for local human services nonprofits. The recommendations were made as part of a coordinated funding approach, combining support from the county, the city of Ann Arbor, the United Way of Washtenaw County, and the Washtenaw Urban County. More than 20 people spoke on the issue during public commentary, urging continued support for the county’s most vulnerable residents.
Commissioners were asked to give initial approval to $507,500 in human services funding for 2011. Additional funds for 2012 and 2013 were also approved, contingent on the board’s passing those budgets later this year – it’s possible that allocations will change, as the county works to eliminate a $17.5 million deficit. Commissioner Dan Smith voted against the allocations, citing an objection to one line item. He later clarified for The Chronicle that he objected to funding for Planned Parenthood.
The board acted on several other items during its May 18 meeting, including: (1) approval of a brownfield plan for LaFontaine Chevrolet in Dexter; (2) setting the 2011 rate for the county’s general operating millage; and (3) initial approval to hire Experis (formerly known as Jefferson Wells) to perform internal auditing services for the county.
The board also gave inital approval to apply for a federal Dept. of Justice grant worth nearly $500,000 to support the Washtenaw County Cyber Citizenship Coalition (WC4). Commissioner Kristin Judge, who spearheaded the WC4 initiative, reported that Gov. Rick Snyder has asked the coalition to host with him a statewide “cyber summit” later this year. [Full Story]

County Board to Vote on Packard Square
On Tuesday, May 17, 2011 the Washtenaw County board of commissioners spent three hours at a special working session continuing a discussion of the Packard Square brownfield project in Ann Arbor, and debating how to craft a broader policy related to issuing the county’s full faith and credit for projects with private developers. The board is expected to take an initial vote on the Packard Square project at its May 18 meeting.
The board had been asked at its May 4 meeting to give initial approval of a $1 million grant application and $1 million loan from the Michigan Dept. of Environmental Quality, for brownfield cleanup at the proposed $48 million Packard Square development – site of the former Georgetown Mall. The board was also asked to authorize designation of the county’s full faith and credit as a guarantee for any loan that might be awarded, up to $1 million. It was that guarantee that raised concerns among some commissioners, who were uncomfortable putting the county potentially on the hook for a private developer – especially since back taxes are owed on the property, and the county is facing a large deficit in the coming years.
Instead of voting, the item was taken up at a May 5 working session, and then again at Tuesday’s special working session, where the same issues were raised during a wide-ranging debate. The meeting was attended by Ann Arbor city councilmember Marcia Higgins, who represents the area (Ward 4) where the project is located, and Matt Naud, the city’s environmental coordinator. Representatives of the developer, Bloomfield Hills-based Harbor Companies, were also on hand, as were several members of the public and county staff.
Ultimately, commissioners tentatively agreed to move ahead with an initial vote on the Packard Square brownfield plan and state grant application at their Wednesday, May 18 meeting, but to hold off on a vote for the state loan. Board chair Conan Smith also agreed to draft a full faith and credit policy to give to commissioners on Wednesday, drawing on the discussion at Tuesday’s special working session.
Elements of the policy could include: (1) ensuring that the project has a clearly articulated public benefit; (2) setting a cap on the county’s financial exposure, as expressed by a dollar amount or as a percentage of its cash reserves; (3) requiring taxes to be paid before the project moves forward; and (4) requiring that the local munipality where the project is located put up its full faith and credit as well.
Packard Square’s 6.5-acre site includes land contaminated by a dry cleaning business that operated there. The developer is proposing a mixed-use development, with retail and office space along with 230 apartments. The project’s site plan and brownfield plan had been approved by the Ann Arbor city council on Monday, May 2.

Washtenaw County board of commissioners working session (May 5, 2011): Continuing a debate that began at their regular board meeting the previous day, county commissioners spent part of their most recent working session getting more information about a brownfield proposal for the Packard Square project in Ann Arbor.
The board had been asked at its May 4 meeting to give initial approval of a $1 million grant application and $1 million loan from the Michigan Dept. of Natural Resources and Environment, for brownfield cleanup at the proposed Packard Square development. The board was also asked to authorize designation of the county’s full faith and credit as a guarantee for any loan that might be awarded, up to $1 million.
It was that guarantee that raised concerns among some commissioners, who were uncomfortable putting the county potentially on the hook for a private developer – especially as the county faces a $17.5 million deficit over the next two years.
Also was a concern that the developer – Bloomfield Hills-based Harbor Companies – had not paid off back taxes owed on the site.
Commissioners discussed having county staff talk with representatives of the city of Ann Arbor, to ask whether the city would be willing to back the loan, rather than the county. The site plan and brownfield plan for Packard Square had been approved by the Ann Arbor city council on Monday, May 2.
Subsequent to the May 5 working session, the county board announced that it will hold a special working session on Tuesday, May 17 to continue discussion of the Packard Square project and a possible change to the county’s full faith and credit policy. That meeting is set to begin at 6:30 p.m. at the Washtenaw County administration building, 220 N. Main St. in Ann Arbor.

County Budget: “Not Out of the Woods”
Washtenaw County board of commissioners meeting (May 4, 2011): Budget challenges touched most agenda items, either directly or tangentially, during a four-hour board meeting.
The board got a quarterly update for the current year’s budget, as well as a progress report on development of the 2012-2013 budget. County administrator Verna McDaniel reported that thanks to a less-than-expected drop in property tax revenues, a two-year projected deficit has fallen from nearly $21 million to $17.5 million.
To address the deficit, the county is preparing to begin negotiations with its 17 labor unions, hoping to get $8 million in cuts to employee compensation and benefits over the next two years. They also hope to make $8 million in savings from organizational restructuring.
An item not on the agenda drew attention, particularly from commissioner Ronnie Peterson. A coordinated funding effort for local nonprofits – allocating funds from the county, the city of Ann Arbor, Washtenaw Urban County and Washtenaw United Way – is nearing its final stages. The county board will be asked to vote on funding recommendations at its May 18 meeting. However, nonprofits leaders have already been notified of those recommendations, and some attended the May 4 meeting to lobby for support. Peterson sharply criticized the process – which the board had approved last year – saying they seem to have ceded decision-making authority for the funding. He didn’t like it.
A development-related issue also raised financial concerns for some commissioners – the proposed Packard Square development in Ann Arbor. The board was asked to give initial approval of a $1 million grant application and $1 million loan from the Michigan Dept. of Natural Resources and Environment, for brownfield cleanup at the site. After some debate, Prater’s motion to postpone action on Packard Square was approved by a majority of commissioners, moving it to a working session the following day. The meeting also included approval of expanded IT collaboration with the county, the city of Ann Arbor and the Ann Arbor Transportation Authority, and the appointment of Michael Smith as the new director for the county’s veteran services office. And during the time for communications from the board, commissioner Dan Smith indicated that he and Yousef Rabhi are working on changes to compensation for commissioners – they’ll likely be bringing a proposal to the board later this year.
