Kingsley Condo Project Takes Next Step

Ann Arbor planning commission meeting (July 15, 2014): Commissioners unanimously recommended approval of a new condo project near downtown – 121 Kingsley West, at Kingsley and Ashley. But because recommendations of approval require six votes – and only five commissioners were present – the development will be forwarded with a recommendation of denial.

Developer Tom Fitzsimmons and his partners Peter Allen and Mark Berg were assured that the city council would be informed of the circumstances under which the vote was taken.

The plans call for 22 condos in two new structures and an existing building. The request is for approval of a site plan, development agreement and rezoning – from a planned unit development (PUD) to D2 (downtown interface district). The PUD, which has expired, was for a larger development on that same site that was never built – Peter Allen’s Kingsley Lane.

The tallest building at 121 Kingsley West would be 58.4 feet high – just under the 60-foot height limit for D2 zoning.

In other action on July 15, commissioners elected new officers for the coming fiscal year, which began on July 1. Wendy Woods was unanimously elected to serve as the commission’s chair, replacing Kirk Westphal. She has served as vice chair for the past two years. Ken Clein, who has served as secretary, was elected vice chair, replacing Woods in that position. Westphal reported that Jeremy Peters had expressed interest in serving as secretary, though he did not attend the July 15 meeting. Peters was unanimously elected to that position. None of the officer elections were contested.

Planning commissioners also unanimously adopted a master plan resolution and list of resource documents used to support the master plan. This is part of an annual evaluation of the master plan that’s required by the commission’s bylaws. There are no significant changes. Separately, they voted to approve the FY 2015 work program, which planning manager Wendy Rampson characterized as ambitious. [Full Story]

Kingsley Development Moves to Council

The 121 Kingsley West condominium development will be moving to city council for consideration, following action at the Ann Arbor planning commission’s July 15, 2014 meeting.

CBRE Selected for Library Lot Brokering

Ann Arbor city administrator Steve Powers has indicated that he’s selected CBRE to assist the city with the marketing and sale of the Library Lane parcel. That announcement came in an email sent to councilmembers on July 1, 2014. The site is located north of the downtown Ann Arbor District Library, between South Fifth Avenue and Division.

Downtown Ann Arbor Hotel Gets OK

DDA OKs Partnerships Grant Policy

A policy on granting financial support to private developments has been approved by the Ann Arbor Downtown Development Authority board. Action came at the board’s June 4, 2014 meeting. [.pdf of DDA partnership grant policy]

The development of the policy was spurred by a request from First Martin Corp., which has asked the DDA to support its extended-stay hotel project at the corner of Ashley and Huron streets.

Ruth’s Chris Site Plan OK’d

Hotel Project Moves Ahead, Condos Delayed

Ann Arbor planning commission meeting (May 20, 2014): Development of a new extended-stay hotel on West Huron and North Ashley received a unanimous recommendation of approval from planning commissioners, following a lengthy discussion and concerns voiced by some residents and business owners at the adjacent One North Main building.

Issues included blocked views, noise from rooftop mechanicals, and problems with egress from One North Main’s underground parking. But even people who raised these concerns applauded the project, saying a hotel there would help bring vitality to that part of town. The site on the northeast corner, owned by First Martin Corp., now includes a building that houses the Ann Arbor Convention & Visitors Bureau and the bus depot for Greyhound, which will be relocating next month to the city’s Fourth & William parking structure.

First Martin’s proposal includes a six-floor, 88,570-square-foot building with a ground-floor restaurant or retail space facing Huron and an extended-stay hotel on the upper five levels, with an entrance off of Ashley. The hotel will be operated by Marriott. The bus depot facade – including an iconic art moderne sign – will remain in place.

The project will be forwarded to the city council for consideration.

Also heading to the council with a recommendation of approval is an expansion of the Bank of Ann Arbor’s downtown building at the northeast corner South Fifth and East Washington. The plan involves reorienting the main entrance – moving it from the center of the bank’s South Fifth Avenue side to the corner of Fifth and Washington. A 9,179-square-foot third-floor addition would be constructed over the rear of the building’s east side.

The bank has an existing drive-thru teller window on its north side, which will not be altered. The site’s D1 zoning requires a special exception use for drive-thrus, which the planning commission granted in a separate vote. Because the project is going through a site plan approval process, the requirement for a special exception use was triggered. Special exception uses do not require additional city council approval.

Commissioners amended the special exception use to limit the drive-thru to a financial institution, so that it can’t be used in the future for other businesses – like a pharmacy or fast food restaurant. That amendment, put forward by Sabra Briere, was approved on a 6-2 vote, over dissent from Wendy Woods and Eleanore Adenekan. Briere also proposed an amendment that would restrict the hours that the drive-thru could be open. The concern was that vehicles pulling out from the drive-thru onto Fifth Avenue could cause a threat to pedestrians and bicyclists in the evening. But after discussion – including some comments from Hans Maier, a senior executive for the bank – Briere withdrew that amendment.

Two other special exception use requests were granted during the May 20 meeting – from companies selling seasonal Class C fireworks for the July 4 holiday. Phantom Fireworks will be putting up a tent in the parking lot of the Maple Village Shopping Center, across from Veterans Memorial Park. In previous years the business operated in the parking lot of Colonial Lanes on South Industrial. Patriot Fireworks will be selling fireworks in the parking lot of the Twin Valley shopping center at 2750 Jackson Ave., west of the I-94 overpass. Both special exception uses were amended to limit the sales to fireworks only – not other seasonal items – and to put specific limits on the days of operation.

One item was postponed by commissioners on May 20 – a site plan for Mark Condominiums on West Liberty, brought forward by developer Alex de Parry. The postponement was based on a recommendation from the planning staff, to allow time for a public water system issue to be addressed. City staff determined that the six-inch water main along Liberty needs to be replaced with a 12-inch main. De Parry told commissioners that the development team had just recently been informed about this issue, and they are now analyzing the budget impact and alternatives they might pursue. [Full Story]

Bank of Ann Arbor Project Moves Ahead

An expansion of the Bank of Ann Arbor headquarters in downtown Ann Arbor took another step, as Ann Arbor planning commissioners recommended the project for approval at their May 20, 2014 meeting. It will next be considered by the city council.

Commissioners recommended approval of a site plan that involves reorienting the main entrance – moving it from the center of its South Fifth Avenue side to the southeast corner of South Fifth and East Washington. A 9,179-square-foot third-floor addition would be constructed over the rear of the building’s east side. Park Commissioners Question Council Action

But the council followed up at its April 7 meeting by considering a total of four resolutions on the Library Lane site – including the reconsideration of the two March 17 resolutions. At the end of the April 7 meeting, a portion of the site was still reserved for an urban park, and the city administrator was still directed to hire a broker to list the property for sale. A vote on how to use the proceeds of a possible sale was put off until June. On March 17, the city council had passed two resolutions regarding the site: (1) reserving a portion of the west side, along South Fifth Avenue, as the site for an urban public park; and (2) directing the city administrator to hire a broker to explore the sale of development rights on that site. The council’s meeting, which adjourned at about 1 a.m., included debate that lasted more than 2.5 hours on the future of this city-owned property, located north of the downtown library.

The following day, at PAC’s March 18 meeting, commissioners were briefed by the two councilmembers who also serve on PAC as ex officio members: Mike Anglin (Ward 5) and Christopher Taylor (Ward 3).

Anglin, who had co-sponsored the park resolution along with Jack Eaton (Ward 4), told commissioners that he’d been comfortable with both resolutions, and that he had voted for both of them.

Anglin said he hoped PAC would now start working on guidelines for developing a portion of the site, and to make sure all stakeholders are well-represented. “Feelings were hurt last night,” he said, “and so now we’re in damage control, and we’re also in the idea of further discourse. And we need to do that.” There needs to be a real dialogue, including the library, the Ann Arbor Downtown Development Authority, PAC and others in the community, he said – all stakeholders need to help decide what to do as a town.

For his part, Taylor pointed out that the council’s urban park resolution doesn’t actually ask PAC to do anything. The “resolved” clauses make no mention of PAC. He said he didn’t know the rationale for that – whether it was an attempt to go around PAC, or whether there’s an expectation that PAC will be brought in. “There’s a measure of uncertainty there,” Taylor said, so PAC’s role is unclear.

Taylor also noted that there’s complete consensus on the idea that there will be public space on the Library Lane parcel, to which the public has full access. “There is not complete consensus on who owns that element of the parcel,” he added. “Nor, I think, is there complete consensus on who will maintain and provide security for that part of the parcel.”

Ingrid Ault, PAC’s chair, noted that the commission had developed recommendations for downtown parks, adding that it was “very disappointing to feel that we weren’t listened to” as the council resolution was developed. If that had happened, she added, “we wouldn’t have hurt feelings.”

Though Anglin had supported the council’s March 17 actions, subsequently – at the council’s April 7 meeting – he co-sponsored another resolution that would have delayed hiring a broker until additional public process had been undertaken, including the possibility of reserving the entire site for a park. After a 40-minute debate and a recess to discuss a possible compromise, the council unanimously voted down that resolution – though it could be brought back for future consideration.

Anglin also supported another action on April 7, which passed, that increased the amount reserved for a park to 12,000 square feet, along the entire west side of the South Fifth Avenue parcel. Previously, the council had indicated a range for the space – between 6,500 and 12,000 square feet, with a northern boundary to be determined. A range, instead of 12,000 square feet, had been the result of an amendment made at the council table on March 17. During deliberations on April 7, Anglin said he hoped for an even larger park at the site.

PAC’s March 18 meeting agenda also included a resolution to recommend that the city apply for a grant to help renovate the Gallup Park pathway, which is part of the countywide Border-to-Border Trail. The grant application is to the federal transportation alternatives program (TAP), which is administered in this region by the Southeast Michigan Council of Governments (SEMCOG) and statewide by the Michigan Dept. of Transportation (MDOT). At its April 7 meeting, the city council authorized the grant application.

Also on March 18, Dave Borneman, parks and recreation deputy manager, gave an overview of volunteer efforts within the parks, recreation facilities and natural areas, and talked about how people in the community can participate. Ault encouraged others to volunteer, saying she’s taken part in the frog and toad survey for the past couple of years. “I’ve gone to places that I didn’t really know existed,” she said. “And I can tell you what a spring peeper and a leopard frog sound like.” [Full Story]

Planning Agenda: Art, Eats, Drive-Thrus

Ann Arbor planning commission meeting (April 1, 2014): Ordinance revisions, site plan approval and a look at proposed artwork for the East Stadium bridge filled the planning commission’s first meeting in April.

John Kotarski and Bob Miller of the city’s public art commission presented images of a revised design for public art on the East Stadium bridge, a $400,000 project that includes columns of louvered glass panels on the bridge as well as underneath it, along South State Street. The artist – Catherine Widgery, who’s based in Massachusetts – had changed her original proposal at the request of a selection committee. The public art commission is seeking feedback on this new design, including at a public forum on Monday, April 21 at the downtown Ann Arbor District Library.

The public art commission likely will vote on a recommendation at its April 23 meeting. The proposal would then be forwarded to the city council for approval.

Also heading to city council is the site plan for a new Ruth’s Chris Steak House, which planning commissioners voted to recommend on April 1. The plan involves major renovations to the existing building at 314 S. Fourth Ave., which most recently housed the Dream Nite Club that closed in 2012. The renovations include adding a second-floor mezzanine level to the front of the building.

Part of the planning commission’s discussion focused on whether there might be outdoor dining in front of the restaurant. The project’s architect, Stephen Fry, indicated that at this point, outdoor seating wouldn’t be appropriate, in part because of bus traffic. The building is located near the Blake Transit Center, a hub for public transportation. “Ruth’s Chris is about a known and consistent dining experience,” Fry said, “and we just don’t feel we can control it out there.”

Fry also reported that the restaurant will likely be using valet parking, with valets positioned in front of the building. “So we’re going to activate the street with humans that are dressed up and looking good,” he said.

Commissioners also reviewed proposed ordinance revisions related to drive-thrus, and recommended that the city council approve the changes. The amendments would add a definition of a “drive-thru facility” to Chapter 55 of the city code. Currently, the term used throughout the code is “drive-in,” which is not explicitly defined in the code.

In addition, the changes would require that drive-thru projects obtain a special exception use from the planning commission, and would be allowed only in the O (office), C2B (business service) and C3 (fringe commercial) zoning districts. Basic layout requirements would also be added to the ordinance. Currently, drive-thrus are allowed in C3 districts without a special exception use. They are allowed as special exception uses in the C2B district.

The changes will give planning commissioners more discretion in approving drive-thru businesses, including restaurants, banks, pharmacies and other types of drive-thrus. [Full Story]

Planning Group Gives Advice on Library Lane

One day after the Ann Arbor city council took action related to the city-owned Library Lane site, Ann Arbor planning commissioners weighed in with advice to the council about how to develop that South Fifth Avenue property. Planning commissioners passed a resolution on the item at their March 18, 2014 meeting.

On March 17, the council had passed a resolution directing the city administrator to hire a brokerage service to sell development rights to the Library Lane surface, where an underground parking structure is located. The council also engaged in a lengthy debate – two and a half hours of sometimes heated commentary – over a proposal reserving part of the surface for a publicly owned urban park. 624 Church Street Gets Parking Permit Extension

The  developer of the future 624 Church St. project in downtown Ann Arbor will now be able to extend for up to 15 years – for a total of 30 years – the contracts for 48 already-approved parking permits under the city’s contribution-in-lieu (CIL) program.

The Ann Arbor Downtown Development Authority board’s action to approve up to three five-year extensions came at its Jan. 8, 2014 meeting.

At its meeting on Nov. 6, 2013, the DDA board had already approved the purchase of 48 parking permits under the contribution-in-lieu (CIL) program – for a new version of the proposed residential development at 624 Church St. in downtown Ann Arbor. Ann Arbor On-Street Parking Space Removal: $45K+

Removal of an on-street metered parking space will cost developers in Ann Arbor more than $45,000 per space as a result of a policy approved by the city council at its Jan. 6, 2014 meeting. The payment would go to the Ann Arbor Downtown Development Authority, because the DDA manages the public parking system under a contract with the city.

Added at 11:07 p.m. after initial publication: An amendment to the policy made during the Jan. 6 meeting requires added payment to compensate for the projected revenue over the next 10 years, generated by the space to be eliminated. For an average space that would work out to around $20,000 in addition to the $45,000.

Planning Group Supports 624 Church Project

Ann Arbor planning commission meeting (Dec. 17, 2013): Three items – all of which had been previously reviewed by planning commissioners in some form – moved forward following action at the commission’s last meeting of 2013. The meeting started about 15 minutes late as the group awaited enough members to form a quorum. Three of the nine commissioners were absent.

The largest proposal was a revised version of a 14-story apartment complex at 624 Church St. The development, located in Ward 3, was expanded after an additional property was acquired next to the original site. The project is a 116,167-square-foot building with 123 apartments and about 230 bedrooms. It would stand adjacent to and over the existing two-story Pizza House restaurant at 618 Church, and would extend to the southeast corner of Willard and Church, where the building’s entrance will be located.

Questions from commissioners covered a range of topics, including concerns over the 48 parking permits that the developer has secured from the Ann Arbor Downtown Development Authority in the Forest Avenue parking structure. Two commissioners expressed concern that the structure is frequently full already, and that additional spaces taken up with 624 Church St. residents will make it even more difficult to park there.

Other issues raised during deliberations related to the location of the bike storage room, the use of a proposed outdoor plaza space next to Pizza House, the type of materials to be used in the building and design of the building. The vote to recommend approval of the project was unanimous.

Also recommended for approval on Dec. 17 was the zoning of two properties on South State Street – 1643 and 1645 S. State – as C1 (local business district). One of those properties houses Biercamp Artisan Sausage and Jerky. The land had been annexed into the city from Ann Arbor Township in 2011. That same year, a previous request for zoning the land as C3 had been recommended for denial by commissioners.

Another State Street project – a revised version of an expansion at Germain Motors – was recommended for approval by commissioners in a unanimous vote. The commission had voted to postpone action on Nov. 19, 2013, pending issues that were resolved in the version presented on Dec. 17. [Full Story]

Downtown Zoning Review to Wrap Up Soon

Ann Arbor planning commission meeting (Nov. 19, 2013): The main agenda item for the commission’s most recent meeting was a list of draft recommendations that would complete the current phase of a months-long downtown zoning review.

Planning commissioners made decisions on the majority of recommendations for revising the city’s downtown zoning ordinance, but adjourned after midnight before completing their final resolution for city council. Though they did not formally vote to postpone action on the resolution, the item will be taken up again at the commission’s Dec. 3 meeting. Generally, the changes reflect a downzoning in some locations in an attempt to lessen the impact of development on adjacent residential neighborhoods.

A public hearing on the downtown zoning review drew seven speakers, all of whom had previously addressed the commission on this topic. Andy Klein – one of the owners of a site at the southeast corner Main and William, which is being considered for downzoning – spoke against rezoning that property, calling himself the “lone dissenter.” Other speakers at the hearing were in favor of downzoning in general, including at that site. The recommendation for that property – possibly one of the most controversial – was not debated or acted on by commissioners at their Nov. 19 meeting.

Attached to the commission’s Dec. 3 agenda was a communication from Scott R. Bonney of Neumann/Smith Architecture, written on behalf of KRG Investments, the owners of the Main and William property. It suggests a third option to consider as a compromise, and indicates that Bonney will attend the Dec. 3 meeting to make a presentation about this proposal in person. [.pdf of Bonney's letter]

After the planning commission finalizes and approves its resolution regarding these downtown zoning recommendations, the resolution will be forwarded to the city council for consideration. The intent is for the council to review the recommendations and give direction to the commission about which recommendations to implement.

At that point, the commission’s ordinance revisions committee would work with city planning staff to craft actual ordinance language. Any specific ordinance changes would be reviewed by the full commission and ultimately would require city council approval before taking effect. That process would include additional opportunities for public input.

In addition to downtown zoning, three other projects were on the Nov. 19 agenda. Commissioners recommended approval of a proposal to build two restaurants adjacent to Macy’s at Briarwood Mall. They also recommended approval of a four-story addition to the existing two-story building at 210-216 S. Fourth Ave., between East Liberty and East Washington in downtown Ann Arbor, known as the Montgomery Building. The expansion will create 32 new housing units, including four studios, 14 one-bedroom, and 14 two-bedroom units.

One project that didn’t move forward was a proposed expansion of Germain Motors – the former Howard Cooper dealership on South State Street. Owner Steve Germain and his daughter Jessica Germain attended the meeting and described the growth of their business, with a 55% increase in combined sales compared to last year. They indicated that expanded showrooms and additional parking and vehicle display areas are needed to accommodate future growth. However, planning staff recommended postponement to address several outstanding issues, and commissioners acted on that advice. [Full Story]

Fourth Ave., between East Liberty and East Washington in downtown Ann Arbor. The plan calls for creating 32 new housing units, including four studios, 14 one-bedroom, and 14 two-bedroom units. Former Y Lot: Sold to Dahlmann for $5.25M

The Ann Arbor city council has approved the sale of city-owned property downtown – a parcel north of William Street between Fourth and Fifth avenues – to Dennis Dahlmann for $5.25 million. Council action approving the sale came at its Nov. 18, 2013 meeting at about 1:20 a.m.

Revised 624 Church St. Gets Parking OK

A revision to a proposed residential development at 624 Church St. in downtown Ann Arbor has resulted in approval by the Ann Arbor Downtown Development Authority board for the purchase of additional monthly parking permits – up to 48 such permits. The action was taken at the DDA board’s Nov. 6, 2013 meeting. The spaces will be provided in the Forest Avenue parking structure.

The original proposal for 624 Church, which received site plan approval from the city council at its March 4, 2013 meeting, was for a 13-story, 83-unit apartment building with approximately 181 beds. And for that version, the Ann Arbor DDA had authorized the project to purchase up to 42 monthly permits through the city’s contribution-in-lieu (CIL) … [Full Story]

Resolution on Y Lot: Dahlmann 1st Choice

A resolution added Friday to the Ann Arbor city council’s Nov. 7, 2013 agenda would direct city administrator Steve Powers to negotiate a sales agreement with Dennis Dahlmann for the purchase of the city-owned property north of William Street between Fourth and Fifth avenues in downtown Ann Arbor. Dahlmann has offered $5.25 million for the property, known as the Y lot. It had been listed at $4.2 million. [.pdf of Dahlmann offer 10.17.13]

If those negotiations are not successful, then the resolution directs the city administrator to negotiate with CA Ventures (Clark Street Holdings).

Feedback on Downtown Zoning Continues

Ann Arbor planning commission meeting (Oct. 15, 2013): Planning commissioners continued a discussion that began at their Oct. 8 working session over proposed changes to downtown zoning. But they took no action and will pick up the topic at their next meeting, on Nov. 6.

Questions and comments covered a range of issues, including potential conflict of interest over a lot next to city hall that’s owned by the University of Michigan Credit Union. Five commissioners are UMCU members, and the credit union president objects to a proposed rezoning of the site. Other discussion points included affordable housing premiums, the use of diagonals as a tool for influencing the shape of tall buildings, and concerns over rezoning public land.

Ten people spoke during a public hearing on the zoning review. Before the hearing began, planning commission chair Kirk Westphal stated that the hearing would likely continue at a future meeting, but that speakers would be allowed only one turn during the entire hearing – either that night, or at a subsequent meeting. Midway through the hearing, Sabra Briere raised an objection to Westphal’s ruling, and commissioners spent about 20 minutes debating the issue. The commission ultimately voted to allow for people to speak more than once when the public hearing is continued, over the objection of Westphal, Diane Giannola and Wendy Woods.

Consultant Erin Perdu of ENP & Associates attended the Oct. 15 meeting and answered questions from commissioners, but her contract for this project has now expired. Planning manager Wendy Rampson indicated that any additional work from Perdu would require city council approval.

In addition to the downtown zoning review, two development projects were on the Oct. 15 agenda. Commissioners recommended approval of an three-floor addition to the Running Fit building at East Liberty and South Fourth. The expansion will create six residential units.

During a public hearing on the project, Ali Almiri – who owns the adjacent building to the west at 119 E. Liberty – raised concerns that three bedroom windows in his building’s residential rental units would be blocked by this new structure. He and his attorney urged that the new project be required to accommodate those existing windows. The issue will continue to be investigated by planning staff, building staff and possibly the city attorney’s office prior to the project’s consideration by the city council.

Another proposal – related to plans for two new restaurants at Briarwood Mall, on the east side of Macy’s – was postponed, because of several outstanding issues that still need to be resolved.

During public commentary, Alex Perlman, a co-owner of the food carts The Beet Box and Cheese Dream, highlighted a project at 1215 S. University – the former location of Pinball Pete’s, which burned down in 2009. The project, called Eat the Hub, would repurpose the space as a temporary food cart yard that would accommodate between three to six carts. Perlman noted that current city ordinances “don’t reflect the ever-changing landscape that mobile food businesses require.” He said he’d appreciate any help to move this project forward. A proposal to build a three-story addition to the one-story building on the northwest corner of East Liberty and South Fourth – where Running Fit is located – received a recommendation of approval from the Ann Arbor planning commission at its Oct. 15, 2013 meeting.

Council Gets Advice on Y Lot Development

Ann Arbor planning commission meeting (Aug. 20, 2013): As the city council considers selling the former Y site at 350 S. Fifth, planning commissioners have outlined the kind of development they’d like to see at that location.

The commission voted unanimously to recommend that the council, if it decides to proceed with a sale, should use a request for qualifications (RFQ) and request for proposals (RFP) process.

The planning commission is also recommending that the council impose a set of conditions for future development. The list includes mixed-use development that encourages foot traffic and active first-floor uses, an entry plaza or open space, and mandatory compliance with the city’s design guidelines.

The site was one of five parcels that was the focus of the Ann Arbor Downtown Development Authority’s Connecting William Street project. Much of the Aug. 20 discussion centered on the use of CWS as a framework for the resolution.

Sabra Briere, who serves as the city council’s representative to the planning commission, suggested removing entirely references to the CWS project. The council never adopted the CWS report or took any action to implement the CWS recommendations, she noted. Briere felt that leaving those references to CWS in the commission’s resolution might make some councilmembers more resistant to it.

Wendy Woods, a former councilmember, countered that “our role is not to give pablum to council.” The commission’s role is to give advice as a body, regardless of how it might be received by the council, Woods said. She also pointed out that it’s not necessarily Briere’s role to advocate for positions taken by the commission. “The planning commission is its own advocate and we stand on our own,” Woods said.

Bonnie Bona and Diane Giannola, who drafted the resolution, pointed to the amount of public input that had been solicited during the CWS process, and felt that it was more powerful for the commission’s recommendations to be supported by that input. Giannola didn’t want to get into the politics of guessing what the council might support, but offered to extract references to CWS from the two resolved clauses. That compromise was acceptable to Briere and the other commissioners. [.pdf of amended Y lot resolution]

During the discussion, Briere also reported that the broker hired by the city to handle a possible sale has been meeting with councilmembers to talk about the Y lot. The broker is likely to suggest putting as few stipulations on the property as possible, she said, because he believes that such stipulations will lower the purchase price. That’s not necessarily what all councilmembers believe, she noted, but it’s what they’re being told.

The commission’s resolution will be forwarded to the city council as an item of communication, and will possibly appear on the agenda as soon as Sept. 3.

In other action, commissioners recommended approval of a two-story addition that more than doubles the size of the Honda vehicle testing facility on Ann Arbor’s south side. The existing 19,357-square-foot building, built in 1975, is located at 3947 Research Park Drive on a 2.72-acre site. During a public hearing on the project, a representative of American Honda Motor Co. reported that the expansion will include a state-of-the-art environmental testing chamber, to help Honda develop vehicles with cleaner fuel emissions. The $4.3 million project is expected to increase the number of employees who work at the site from 6 to 10.

Commissioners also recommended approval of (1) the site plan for a proposed Belle Tire at 590 W. Ellsworth – just east of the intersection with South State Street, and (2) an annexation and zoning request for 2640 Miller Road, on the city’s northwest side. [Full Story]

Planning Group Advises Council on Y Lot

Ann Arbor planning commissioners are formally making recommendations to the city council about the future of the former YMCA lot at 350 S. Fifth, which the city purchased in 2003. The recommendations were passed unanimously, in the form of a resolution, at the commission’s Aug. 20, 2013 meeting. [.pdf of original planning commission resolution, before amendments]

The city council is exploring whether to sell that property, located across from the downtown Ann Arbor District Library and south of Blake Transit Center. Earlier this year, the city selected Colliers International and local broker Jim Chaconas to handle the possible sale, as the city faces a $3.5 million balloon payment this year from the purchase loan it holds on that property.

Priorities Emerge in Downtown Zoning Review

Ann Arbor planning commission’s ordinance revisions committee meeting (Aug. 13, 2013): The committee received an update on the city’s downtown zoning review at a meeting that included about a half hour of public commentary.

Erin Perdu, the consultant hired by the city to lead this process, briefed the four commissioners who serve on the ordinance revisions committee, as the first phase of this effort draws to a close.

The work is the result of a city council resolution passed on April 1, 2013. It directed the planning commission to address three specific questions: (1) whether D1 zoning is appropriately located on the north side of Huron Street between Division and South State and the south side of William Street between South Main and Fourth Avenue; (2) whether the D1 residential FAR [floor area ratio] premiums effectively encourage a diverse downtown population; and (3) whether a parcel on the south side of Ann Street adjacent to city hall should be rezoned “to the appropriate zoning for this neighborhood.” That parcel, currently a surface parking lot, is now zoned D1, which allows for the highest density development. The council’s resolution set a deadline of Oct. 1 for the planning commission to deliver recommendations to the council.

Based on public meetings, interviews and survey responses, Perdu reported a general consensus that D1 zoning is not optimal. In particular, many people feel that the buildings allowed in D1 zoning districts are too tall and massive, and that other solutions should be explored for the sites mentioned in the council resolution. Possible solutions include rezoning those sites to D2, or making changes to the D1 zoning – such as allowing diagonals as a tool for controlling building shape, lowering the height or adjusting setbacks – so that it worked better with the adjacent neighborhoods. Some people suggested creating yet another type of zoning. “I think those are options that we’ll be exploring in the next phase of this,” Perdu said.

Another big issue that emerged was the design guidelines, Perdu reported, and a lot of people suggested that those guidelines need more teeth. Suggestions included making the guidelines a requirement in order to be eligible for premiums, which allow developers to construct larger buildings in exchange for providing certain features or public amenities.

There was also general agreement that the diversity of housing isn’t being achieved, Perdu said, but “how to fix that is up for debate.” Some ideas include making the premiums more specific, to encourage different types of residential units – that is, not granting a premium for simply any kind of residential development, as is currently the case. Other ideas for premiums include providing open space, or additional environmental and pedestrian amenities.

Perdu’s team will be developing visuals – including 3D models – showing how certain types of buildings might look if changes are made to D1 zoning on the sites mentioned in the council resolution. The consultants will also be doing research on possible options for premiums that would encourage specific kinds of residential development. In addition, they’ll be looking at how design guidelines can be strengthened and better integrated into the process.

Kirk Westphal, the planning commission’s chair who also serves on the ORC, requested that Perdu’s report reflect the history of how the D1 and D2 zoning were developed. During public commentary, several speakers objected to using Perdu’s time in this way. Former planning commissioner Eppie Potts said she felt like that history is being used against opponents of D1 zoning. “Hey, there was a lot of discontent and unhappiness, which nobody chooses to remember,” she said. “There were revolts at some of the meetings. It was not that pretty, as history.”

The next public forum will be held on Thursday, Sept. 19 at 7 p.m. at a venue to be determined. Perdu said she’ll also hold additional focus groups before then. The next ordinance revisions committee meeting will likely take place on Sept. 10. [Full Story]

Street-Closing Debate Extends Council Session

Ann Arbor city council meeting (Aug. 8, 2013): Counting all public hearings and public commentary, members of the public accounted for just 20 minutes of the council’s meeting. Still, councilmembers stretched a relatively light agenda to about four hours.

An hour of the meeting was taken up with a discussion of street closures around Michigan Stadium on football game days. The street closures are part of an effort to increase safety by creating a vehicle-free zone around the stadium. It involves a cooperative effort with the University of Michigan, U.S. Department of Homeland Security and the city of Ann Arbor police department.

Those deliberations ultimately resulted in a modification of the original plan, so that the southbound lane of Main Street would not be closed until an hour before the start of the game.

Other parts of the plan were approved as originally proposed, starting three hours before kickoff: E. Keech Street between S. Main and Greene streets will be closed, and access to Greene Street from E. Hoover to E. Keech streets will be limited to parking permit holders; the westbound lane on E. Stadium Blvd. turning right onto S. Main Street (just south of the Michigan Stadium) will be closed; and S. Main Street except for the southbound lanes will be closed from Stadium Boulevard to Pauline.

The council also amended the plan to require a report by its Oct. 7 meeting on how well the procedures are working. Even with the modification to the plan and the requirement to brief the council on Oct. 7, the proposal to close streets on football Saturdays was approved on just a 7-4 vote, with dissent from Sabra Briere (Ward 1), Sumi Kailasapathy (Ward 1), Margie Teall (Ward 4) and Marcia Higgins (Ward 4). That neighborhood is located in Ward 4.

Also during the meeting, the council denied a requested street closure for a non-university event on South University Avenue. The requested closing was for “Beats, Eats, and Cleats,” sponsored by The Landmark apartment building. It was planned for the evening before a football game between the University of Michigan and the University of Notre Dame. Councilmembers expressed concerns about the probability of alcohol consumption.

Another 40 minutes of the meeting was taken up with discussion of a bike share program, which did have a direct connection to the University of Michigan. The council was asked to contribute $150,000 from the city’s alternative transportation fund. That money provided a 20% local match on a $600,000 Federal Highway Administration Congestion Mitigation Air Quality (CMAQ) grant that the Clean Energy Coalition (CEC) has received. The CMAQ funds have to be spent on capital, such as bikes and stations. Operations will be supported in the first three years of the program by UM at a level of $200,000 annually for a total of $600,000. The program will be operated by the CEC using B-Cycle as a vendor. The council’s vote on the bike share program was 9-2, with dissent from Sally Petersen (Ward 2) and Marcia Higgins (Ward 4).

Higgins also dissented on a council resolution that called upon the state legislature to repeal Michigan’s version of a “stand your ground” law, as well as to repeal legislation that prevents local municipalities from regulating the sale, transfer, transportation, or possession of firearms and ammunition. That resolution came after public commentary on the verdict in the Trayvon Martin case at the council’s previous meeting. Higgins agreed with the sentiments in the resolution, but said she thought it would have a greater impact if people spoke as individuals. Other councilmembers expressed some skepticism that the resolution would have much impact, but it received their support.

The Kerrytown Place project – an 18-unit townhouse development planned for the location of the former Orthodox Greek church on North Main Street – was subjected to only brief remarks. The council unanimously approved its requested rezoning and site plans.

In other business, the council approved a $10,000 design budget for a sidewalk on Waldenwood near King Elementary School. Construction of the sidewalk would allow a mid-block crosswalk to be moved to a four-way stop intersection.

The council also agreed to accept $202,370 from the Federal Farm and Ranch Land Protection Program (FRPP) to help the city purchase development rights on land in Lodi Township, southwest of the city.

Over dissent from Jane Lumm (Ward 2) and Sumi Kailasapathy (Ward 1), the council approved $18,500 to pay for public art administrator Aaron Seagraves’ contract through the end of 2013.

Among the nominations to boards and commissions announced at the meeting, two were significant: Rishi Narayan, founder and managing member of Underground Printing, to the board of the Ann Arbor Downtown Development Authority; and Jack Bernard, chair of the University of Michigan’s council for disability concerns, to the board of the Ann Arbor Area Transportation Authority. Downtown Zoning Review Moves Forward

In late 2009, after a multi-year process and much debate, the city council adopted the A2D2 (Ann Arbor Discovering Downtown) zoning. The planning commission had for some time been intending to review the zoning, looking at whether the changes have resulted in the kind of downtown development that the city wants.

But interest in a review was heightened by a proposal for the 14-story 413 E. Huron apartment project on a site zoned D1, the highest density allowed. The proposal spurred controversy in part because of its location adjacent to a residential historic district.

So on April 1, 2013, the city council directed the planning commission to review A2D2 and address three specific questions: (1) whether D1 zoning is appropriately located on the north side of Huron Street between Division and South State and the south side of William Street between South Main and Fourth Avenue; (2) whether the D1 residential FAR [floor area ratio] premiums effectively encourage a diverse downtown population; and (3) whether a parcel on the south side of Ann Street adjacent to city hall should be rezoned “to the appropriate zoning for this neighborhood.” That parcel, currently a surface parking lot, is now zoned D1.

On April 1, the council set a deadline of Oct. 1 to deliver recommendations to the council. Councilmembers subsequently approved the 413 E. Huron project on May 13, 2013 on a 6-5 vote.

To lead the A2D2 review, the city hired consultant Erin Perdu of ENP & Associates, who has been holding public forums and interviews with individual stakeholders over the past two weeks. She updated planning commissioners at a July 31 meeting of the ordinance revisions committee, and described her approach to the upcoming Aug. 5 forum.

The Aug. 5 forum starts at 7 p.m. in the lower level conference room of the Washtenaw County administration building at 200 N. Main – at the intersection of Main and Ann. The purpose of that meeting is to review the priority issues that have emerged from feedback so far. The goal is to get confirmation that those issues are, in fact, priorities for the community, she said, and then to have more discussion about those priorities.

The meeting will focus on three main priority issues: (1) height and bulk, with character districts as part of that discussion; (2) premiums, with a focus on housing; and (3) the location of D1 and D2 zoning districts, with a focus on the three sites mentioned in the April 1 city council resolution.

Perdu also addressed technical problems with the online survey on A2 Open City Hall, noting that the issues have been fixed and the deadline extended until 5 p.m. on Aug. 5.

Planning commissioners and staff had a wide-ranging discussion at their July 31 meeting about the feedback they’ve received so far, and the scope of their review. Their discussion touched on design guidelines, historic districts, parking, and housing diversity, among other issues. For example, some critics point to the large amount of student housing that’s being built downtown as a negative outcome of A2D2.

But Kirk Westphal, chair of the planning commission, wondered whether it’s the city’s role to change zoning in respond to these “micro-trends.” He noted that the market might be trending toward student housing now, but in five years that trend might switch to one- and two-bedroom apartments, or offices.

Planning Group Strategizes on Downtown

Two major downtown projects – the possible sale of the former YMCA lot, and a review of the A2D2 zoning – were the main focus at a July 9 working session of the Ann Arbor planning commission.

Huron.

Zoning was also a point of discussion regarding the former Y site at 350 S. Fifth, across from the downtown Ann Arbor District Library and south of Blake Transit Center. The city council is exploring whether to sell that city-owned property, which was zoned D1 as part of the original A2D2 process. The 2.5-hour July 9 session also included a presentation by two Ann Arbor public art commissioners – John Kotarski and Bob Miller – about the finalists for artwork at the East Stadium bridges.
