Ann Arbor park advisory commission meeting (Aug. 19, 2014): Liberty Plaza was the focus of two items that appeared on PAC’s Aug. 19 agenda: (1) extension of a fee waiver for events held at Liberty Plaza; and (2) feedback in response to city council action, which addressed Liberty Plaza and the potential park atop the Library Lane underground parking structure.

Regarding feedback on Liberty Plaza and Library Lane, PAC unanimously passed a resolution to form a subcommittee to study issues related to those urban parks, and to allocate or obtain resources to oversee programming there for up to a year.

Based on that effort, the subcommittee would analyze the outcome and deliver recommendations to council next year – no later than October 2015. This resolution, drafted by PAC chair Ingrid Ault and vice chair Graydon Krapohl, had been emailed to commissioners earlier in the day but was not available to the public prior to the meeting. The Aug. 19 discussion also included comments from Matthew Altruda, who programs the Bank of Ann Arbor’s Sonic Lunch weekly summer concert series at Liberty Plaza. Ault had invited Altruda to the meeting to describe that effort, which is widely cited as a successful use of Liberty Plaza.

Regarding the fee waiver, PAC voted unanimously to extend the waiver through October 2015 – coordinating with the subcommittee work on Liberty Plaza and Library Lane.

Both Aug. 19 items – the feedback to city council (but with no accompanying resolution) and fee waiver – had originally appeared on PAC’s July 15, 2014 agenda, but were postponed because three commissioners were absent at that meeting.

In other action, PAC recommended approval of three three-year professional services agreements (PSAs) for engineering services in the parks and recreation unit – with SmithGroupJJR, Stantec Consulting Michigan Inc, and Tetra Tech Inc. The amount was not to exceed $150,000 annually per agreement.

The commission also elected David Santacroce as chair for the coming year, replacing Ingrid Ault in that position. Paige Morrison was elected as vice chair. Each vote was conducted by “secret ballot” as stipulated in PAC’s bylaws. The one-year terms begin Sept. 1.

One topic that did not appear on PAC’s Aug. 19 agenda was a review of the proposed four-year extension on a University of Michigan lease of three parking lots at Fuller Park. The city council – at its meeting the previous night, on Aug. 18 – had indicated an interest in having PAC take another look at the lease renewal, but parks and recreation manager Colin Smith told commissioners that he didn’t have additional details on the request.

During deliberations on Aug. 18, mayor John Hieftje had recommended postponing council action until early October, in order to give PAC two meetings during which they could reevaluate the lease agreement. PAC had already recommended approval of the lease, after discussing it at their July 15, 2014 meeting. The parliamentary option chosen by the council was to postpone, not to refer to PAC.

The two council representatives on PAC – Mike Anglin (Ward 5) and Christopher Taylor (Ward 3) –  chose somewhat different points of emphasis in their characterizations of the council’s Aug. 18 action on the Fuller Park lease. When Anglin told commissioners that the council wanted PAC to review the lease again, Taylor stressed that the council action was “a straight postponement” – not a vote to refer the item back to PAC. He added that the council was interested in hearing if PAC has any further thoughts on the use of the site. [Full Story]

CBRE Selected for Library Lot Brokering

Ann Arbor city administrator Steve Powers has indicated that he’s selected CBRE to assist the city with the marketing and sale of the Library Lane parcel. That announcement came in an email sent to councilmembers on July 1, 2014. The site is located north of the downtown Ann Arbor District Library, between South Fifth Avenue and Division.

Liberty Plaza Redesign Referred To Parks Group

The future of Liberty Plaza, a park in downtown Ann Arbor at the corner of Division and Liberty streets, will receive some added attention from the park advisory commission, as a result city council action on June 16, 2014.

The resolution considered by the council would have directed the city administrator to “work collaboratively with the property owners adjacent to and near Liberty Plaza, the general public, PAC [park advisory commission], the Ann Arbor District Library, and the DDA to develop a conceptual design for an improved Liberty Plaza…” The resolution was sponsored by Christopher Taylor (Ward 3), mayor John Hieftje, Margie Teall (Ward 4) and Sabra Briere (Ward 1).

June 2, 2014: Council Live Updates

Editor’s note: This “Live Updates” coverage of the Ann Arbor city council’s June 2, 2014 meeting includes all the material from an earlier preview article published last week. The intent is to facilitate easier navigation from the live updates section to background material already in this file.

The council’s first meeting after adopting the budget for fiscal year 2015 – which was approved on May 19, 2014 – features a housekeeping adjustment for the current year’s budget, so that expenditures don’t exceed allocations.

But the June 2 meeting agenda is dominated by items related to the physical attributes and layout of the city. Several items deal with city-owned physical assets, while several more involve land use and planning.

Possibly one of the more controversial agenda items related to physical infrastructure – and future development in the city – is a contract extension with CDM Smith Inc. for work related to the city’s footing drain disconnection (FDD) program. While the city council suspended the program in certain areas of the city in 2012, it continued in other areas, backed by the city’s ordinance under which the city can require residents to disconnect their footing drains from the sanitary sewer system.

Also not suspended was the city’s developer offset mitigation program, which requires developers to offset the increased flow from new construction into the sanitary sewer system. The vote on the CDM Smith Inc. contract extension was postponed from the council’s May 5 meeting. The dollar amount of the contract extension has been substantially reduced in the meantime – from about $750,000 to $143,000.

Part of the backdrop of the CDM Smith contract extension is a lawsuit that’s been filed against the city, challenging the legal foundation of the footing drain disconnect ordinance. The city sought to remove the case from state court to the federal system, but at a hearing on the matter this week, a federal judge indicated he’d be remanding the case back to the Washtenaw County 22nd circuit court.

City assets on the June 2 agenda include trees – as the council will be asked to approve the city’s urban and community forest management plan. The council will also consider a resolution on the city’s possibly most recognizable asset – the city hall building. The resolution would remove a $4 million renovation of city hall (a “reskinning”) from the city’s capital improvements plan for 2017 and 2018. This resolution was postponed from the council’s May 19 meeting.

Another city-owned asset on the agenda is the Library Lane underground parking garage. The council has already directed the city administrator to engage a real estate broker to test the market for the development rights for the surface of the garage. The resolution on the June 2 agenda, which was postponed at the council’s April 7 meeting, would set a policy to deposit 50% of the net proceeds from the sale of the development rights into the city’s affordable housing trust fund.

Land use and planning items on the June 2 agenda include a roughly $300,000 contract for study of the State Street transportation corridor. Related to transportation infrastructure, the council will also be asked to approve resolutions that move along the process of special assessing property owners on Stone School Road for the cost of installing a sidewalk on the west side of the road in connection with a road reconstruction project.

Also related to land use, three Ann Arbor housing commission properties will be given initial consideration for rezoning. A site plan and associated rezoning for the Delta Gamma house will be given final consideration. Also up for final consideration is a revision to the ordinance regulating drive-thrus. Councilmembers will also consider the site plan for a new Ruth’s Chris restaurant to be located downtown on South Fourth Avenue.

A rate increase for Ann Arbor water, sewer and stormwater rates is on the June 2 agenda for final approval.

Two items connected to parks and recreation appear on the agenda. One is approval of the receipt of funding for a program that helps Bridge cardholders purchase local produce at the farmers market. The second item is approval of a five-year agreement with the Community Action Network to continue operating the city’s Northside and Bryant community centers.

The council will also be considering a resolution in support of the local development finance authority’s application to the Michigan Economic Development Corp. for a possible 15-year extension of the arrangement under which the LDFA captures taxes. The captured taxes are used to fund a business accelerator that’s operated by Ann Arbor SPARK through a contract with the LDFA. Without an extension, the LDFA would end in 2018.

Planning Group Gives Advice to Council, UM

Ann Arbor planning commission meeting (March 18, 2014): The planning commission has weighed in with advice on the use of two publicly owned sites: the city-owned Library Lane in downtown Ann Arbor, and the former Edwards Brothers property on South State that’s being bought by the University of Michigan.

One day after the Ann Arbor city council took action related to the Library Lane site, planning commissioners made recommendations to the council about how to develop that South Fifth Avenue property. The council’s action on March 17 included asking the city administrator to hire a brokerage service to sell development rights to the Library Lane surface, on top of an underground parking structure. The council also voted, after a long debate, to designate part of the surface for an urban public park.

On March 18, the commission’s advice focused on conditions for developing the site that would garner economic benefits to the city, such as a mixed-use development that generates foot traffic, with an entry plaza or open space and a design that “creates an iconic addition to the skyline.” The recommendations drew on material in several existing documents, including the Connecting William Street report that was completed by the Ann Arbor Downtown Development Authority about a year ago.

After the vote, Sabra Briere – who serves on both the planning commission and the city council – noted that many members of council don’t believe that the Connecting William Street project was successful in its public outreach. She also said that many councilmembers “do not believe that maximizing density, scale and mass of a building on that site is in the public interest.” Briere said she hadn’t raised these issues during the commission’s deliberations because she didn’t want anyone to feel that she was trying to tell the planning commission what to do.

In separate action on March 18, commissioners passed a resolution with recommendations on uses for the Edwards Brothers site on South State Street, which the University of Michigan is acquiring. The intent is to encourage representatives from the city and UM to discuss their mutual interests in that area – weighing the university’s need to expand its facilities against the city’s interest in strengthening its tax base. Issues include the possible private development of the section that fronts South State, impact on the park-and-ride lot in that area, and the extension of Oakbrook Drive from South State to South Main, through UM property. The city council is expected to consider the same resolution at its April 7 meeting.

Further south on the State Street corridor, at the intersection with Eisenhower Parkway, a proposal to renovate the Shell station, tear down the car wash, and add a drive-thru restaurant was recommended for approval by the commission on March 18. The existing convenience store and gas station would remain open during construction. The specific drive-thru restaurant to be located there is still being negotiated, according to the owner.

Some of the discussion on this project related to upcoming ordinance revisions that the commission will consider on April 1 regulating drive-thru restaurants.

Also recommended for approval on March 18 were an expansion to an office on Collingwood near West Stadium Boulevard, and an easement related to a new Belle Tire on West Ellsworth. [Full Story]

Library Board Weighs Urban Park, Survey

Ann Arbor District Library board meeting (March 17, 2014): About three hours before the Ann Arbor city council took action on the issue of a park at the Library Lane site, the Ann Arbor District Library board passed a resolution on that same topic.

On a 6-1 vote, the board asked the council to reject designating a portion of that city-owned site – which is adjacent to the downtown library – as a public park or plaza at this time. Nancy Kaplan cast the lone dissenting vote.

In presenting the resolution, Rebecca Head noted that the library hasn’t objected to the concept of open space at the Library Lane site, as part of overall development of that city-owned property. But the AADL board resolution states that the council resolution “does not allocate the City resources needed to create a successful park, such as physical maintenance, programming, and monitoring unsafe behavior; and … the City has not been able to allocate resources for those purposes to the nearby Liberty Plaza park, Wheeler park, Sculpture plaza on North 4th Ave., or the Kerrytown plaza. …”

Several trustees weighed in to support the resolution. Barbara Murphy said she was conflicted, because she supports having a park or plaza on the Library Lane site at some point. But the council resolution seemed to be putting the cart before the horse, she said. She pointed out that the AADL board resolution is not advocating for tall buildings – but some kind of development is needed, she said.

In dissenting, Kaplan described the long history of efforts to put a public park or plaza on the Library Lane site. She didn’t want to cut off that process. Kaplan also raised the point that the library board would be asking the council to reject a resolution without knowing the exact content of that resolution – because the council could amend the resolution during its deliberations later in the evening. [The council did make a significant amendment to the part of the resolution addressing the amount of square footage.]

Board president Prue Rosenthal told Kaplan that “I don’t think we’re trying to cut off anything.” All that the AADL is asking, Rosenthal said, is that issues should first be addressed – like how the park would be used, who’ll take care of it, how the security will be handled – “so that behavior we’ve seen around the outside of the [downtown library] building will not increase in that space and spill over into our library.”

AADL director Josie Parker attended the city council meeting, which started at the same time as the library board meeting but didn’t adjourn until 1 a.m. Parker read aloud the board’s resolution to the council, and described some of the challenges that the downtown library faces with security.

The downtown library was the focus of another part of the March 17 AADL board meeting, as trustees were updated on renovations to the front entrance. Ken Van Tine, an architect from InForm Studio, answered questions about possible design revisions since a March 13 public forum. InForm will be presenting a revised design to the board’s facilities committee, before the design is brought to the full board for approval.

Trustees also received results from an EPIC-MRA survey that the library had commissioned. About 500 respondents were surveyed in mid-February. Bernie Porn – president of the Lansing-based firm – described the outcome as “a great news poll, in terms of results, and I think you all should be very, very proud.” There are a couple areas of concern, he said, “but they’re not the kinds of things that can’t be overcome.”

The library previously did a survey in early 2012, in part to gauge public support for financing a new downtown library. The board later put a bond proposal on the November 2012 ballot to fund a new downtown building, but it failed to receive a majority of votes. Since 2012, the positive job rating for AADL has increased by 7 points – from 81% in 2012 to 88% in 2014. That’s a significant increase, Porn said. The 2014 survey also showed that only 3 in 10 respondents knew that AADL is “an independent governmental body” funded by its own separate tax assessment. This is one area of concern, Porn noted, adding that it’s certainly something that’s “solvable.”

The current survey results are expected to help guide development of the library’s next strategic plan, which will be completed later this year.

On March 17, the board also passed a resolution authorizing the library director to enter into a bike share program license agreement with the nonprofit Clean Energy Coalition. The CEC is managing the new program called ArborBike, which is launching this spring. It would include a bike station on AADL’s downtown library property on South Fifth Avenue, as well as locations at other sites in downtown Ann Arbor and on the University of Michigan campus. There will be about 14 bikes at the downtown AADL station on the north side of its property. [Full Story]

Library Board Weighs In On Urban Park

About three hours before the Ann Arbor city council took action on the issue of a park at the Library Lane site, the Ann Arbor District Library board passed a resolution on that topic. The board asked the council to reject designating a portion of that city-owned site – which is adjacent to the downtown library – as a public park or plaza at this time. The vote taken at the AADL board’s March 17, 2014 meeting was 6-1, with dissent from Nancy Kaplan.

The resolved clause states:

Concerns Voiced over Urban Park Proposal

Commissioners were briefed by Will Hathaway on behalf of the Library Green Conservancy, which has been advocating for a large section of the site to be designated as a park. He described a resolution that was later brought forward by Jack Eaton (Ward 4) at the council’s March 3, 2014 meeting.

Hathaway highlighted aspects of the proposal that drew on recommendations made by PAC to the city council last fall. He said he wasn’t asking for PAC to take any specific action on this proposal, but asked for feedback. Several commissioners raised concerns, including some that focused on the process of bringing this resolution forward without specific direction from the council. Hathaway noted that the resolution is intended to start the process, with council direction, to begin working with stakeholders, PAC, the public and others in the design and development of this park.

Subsequently, at the March 3 council meeting, PAC chair Ingrid Ault and former chair Julie Grand both spoke during public commentary and urged postponement of the resolution. Mayor John Hieftje, responding to the initiative, gave his own presentation on March 3 with a different vision for connected urban spaces downtown.

And Stephen Kunselman (Ward 3) told councilmembers that he wanted a postponement to have time to meet with Ann Arbor District Library board members about moving the library over to the surface of the Library Lane structure. He also plans to bring forward a resolution that would move towards hiring a broker to list development rights on the Library Lane surface for sale.

Ultimately, the council voted to postpone action until its March 17 meeting. At that meeting, it’s likely that Eaton will bring forward a revised resolution, a copy of which was provided to The Chronicle on March 13. The revised resolution indicates that the area designated as a park would be 12,000 square feet, compared to 10,000 square feet in the original resolution. That square footage reflects the actual dimensions of the proposed boundaries, according to a staff memo. The revised resolution also eliminates an October 2014 deadline for making design recommendations to the council, and deletes any reference to PAC. In other action at PAC’s Feb. 25 meeting, commissioners heard three other presentations related to city parks. Councilmember Chuck Warpehoski (Ward 5) described a proposed ordinance that he’s brought to council regarding outdoor smoking in public places, including parks. Elements of the ordinance include authorizing the city administrator to have signs posted designating certain parks or portions of parks as off limits for outdoor smoking.

Kerry Gray, the city’s urban forest & natural resources planning coordinator, gave a presentation to PAC about the urban and community forest management plan. The city recently released a draft and is seeking input. And Doug Kelly, Ann Arbor’s director of golf, gave an update on the city’s two golf courses at Huron Hills and Leslie Park.

In voting items, PAC recommended approval of an amendment to the city’s golf cart lease with Pifer Inc., and supported approval of contracts for work at Windemere and Clinton parks.

Commissioners also got a brief financial update for the current fiscal year, which runs through June 30, 2014. Bob Galardi, chair of PAC’s budget and finance committee, summarized the status this way: “Basically, we’re in great shape.” [Full Story]

Column: Rocking Back on the Library Lot

Collectively, we residents of Ann Arbor are a little bit like an old man who sits in a rocking chair telling the same old stories over and over again to anyone who will listen. Before we start, we do not say: Stop me if you’ve heard this before. Because even then we would not stop.

And so it is that we’ll talk about the nuisance of the deer herd in 2008 … and again in 2014. We’ll talk about slush puddles in the downtown in 2009 … and again in 2014.

We talk about those things not because we suffer from community-wide senility, but rather because they are issues that remain in some way unresolved.

And that is why we are again talking about the top of the Library Lane underground parking structure in downtown Ann Arbor. The project included not just the parking deck itself, but also streetscape improvements to Fifth and Division, other pedestrian improvements, and investments in foundations and other work to support future development – a total of about $59 million worth of stuff.

The bulk of that cost was financed through Build America Bonds. What are the implications of the BAB financing for the future use of the parking structure’s spaces? That’s the question prompting me to write this column. I’d like to orient the public to the city’s analysis of how those spaces can be allocated to private uses.

Related to that, a resolution to be placed on the city council’s March 17 meeting agenda by the council audit committee is good news. The resolution would waive attorney-client privilege on a document that I think will help clarify questions associated with those bonds.

Ann Arbor Delays on Downtown Urban Park

A resolution that proposes to build an urban park on top of the Library Lane underground parking structure has been postponed until March 17, 2014 by the Ann Arbor city council. Postponement came at the council’s March 3, 2014 meeting.

March 3, 2014: Ann Arbor Council Preview

The council’s first regular meeting in March will include several items of business leftover from previous meetings, including one resolution on affordable housing, an ordinance on outdoor smoking, and several matters related to public art.

New to the agenda are several items related to non-motorized issues, most prominently a funding request to support the activity of an already-established task force on pedestrian safety and access.

The council will also be asked to fund requests related to city parks and other city facilities like city hall and the airport. Eighteen new vehicles will also be added to the city’s fleet, contingent on council action on March 3.

The council will also consider a resolution that urges full funding of the state of Michigan’s fire protection grant program – for cities like Ann Arbor that host state-owned facilities like the University of Michigan.

In somewhat more detail, one public art issue, embodied in two different resolutions, was postponed from the council’s Feb. 18, 2014 meeting, when councilmembers could not agree on an approach to transferring money out of the public art fund back to the funds from which the money was originally drawn. The specific point dividing the council was not so much the transfer of money but rather a plan to fund the new approach to public art – after the council eliminated the Percent for Art funding mechanism last year.

Updated March 1, 2014: The first resolution has been altered for consideration on March 3 so that it focuses exclusively on the public art program transition issue. The second resolution incorporates changes to reflect the council’s deliberations on Feb. 18: It transfers a total of $943,005 of Percent for Art money to its funds of origin, an amount that defunds the art project at Argo Cascades, but keeps funding for the Coleman Jewett memorial and for a project called Canoe Imagine Art.  [public art resolution (1) for consideration on March 3, 2014] [public art resolution (2) for consideration on March 3, 2014]

That disagreement over funding of the newly created program is also related to another public art item on the agenda – a six-month contract extension for the city’s part-time public art administrator. The item first appeared on the council’s Jan. 21 agenda, but the council postponed that vote until Feb. 3, when it was defeated. On Feb. 18 it was then brought back for reconsideration, but immediately postponed until the March 3 meeting.

Also postponed from Feb. 18 is an item that would direct the city administrator to prepare for the council’s approval a budget resolution regarding affordable housing. The resolution would allocate $600,000 from the city’s affordable housing trust fund to support the Ann Arbor housing commission’s plan to renovate its properties. That allocation would be contingent on the closing of the sale of the former Y lot to Dennis Dahlmann, as the net proceeds of that sale are to be deposited into the city’s affordable housing trust fund.

Postponed from the Feb. 3 meeting was the first reading of an ordinance that would regulate smoking outside of public buildings and also potentially in areas of some city parks. Chuck Warpehoski (Ward 5), sponsor of the new proposed local law, appeared before the park advisory commission at its Feb. 25 meeting to brief commissioners on the proposal and solicit feedback.

New items on the March 3 agenda include a funding proposal for the pedestrian safety and access task force established by the city council late last year, with members appointed in late January. The $122,250 item includes a $77,500 contract for facilitation services from Project Innovations. That’s the same firm contracted for similar work in connection with the city’s sanitary sewer wet weather evaluation – which is expected to conclude in the summer of 2014.

Other issues on the March 3 agenda with a non-motorized connection are three stretches of sidewalk. In the context of sanitary sewer design work that Fishbeck, Thompson, Carr & Huber Inc. is being hired to do, two sidewalks are included: a stretch along Barton Drive, and a stretch along Scio Church Road. The council will also be asked to pay for the construction of a stretch of sidewalk along Ann Arbor-Saline Road near the I-94 bridge – as part of a road reconstruction project that the Michigan Dept. of Transportation is handling.

Another new item is a resolution that Jack Eaton (Ward 4) had announced at the council’s Feb. 18 meeting that he’d be bringing forward. It would waive the attorney-client privilege on a staff memo about laws governing the assessment of homes. The resolution indicates that the memo addresses the effect that reducing the assessment for one year would have on the property tax assessment for the subsequent year, based on action by the Board of Review and/or the Michigan Tax Tribunal.

In other action, the council will be asked on March 3 to approve the purchase from Signature Ford of 18 new vehicles – most of them for use by the Ann Arbor police department. Total cost of the purchase is $457,393.

City parks factor into three agenda items: (1) a resolution to establish an urban park on part of the surface level of the Library Lane underground parking structure; (2) a paving contract for the replacement of basketball and tennis courts at Clinton Park; and (3) a grant application to the Michigan Dept. of Natural Resources Grants Management (MDNRGM) to support a universal access playground at Gallup Park. The Rotary Club has already pledged $250,000 toward such a playground.

The city hall (Larcom Building) is featured in two agenda items – to pay $160,923 for a secondary chiller unit and $28,469 for new light fixtures. An amendment to an agreement with MDOT for an already-completed fence project at the Ann Arbor municipal airport also appears on the agenda, and will cost the city $425.

After authorizing significant equipment purchases to support water main repair activity at its Feb. 18 meeting, the council will be asked to approve two additional items related to water main repair. One item is a $44,702 emergency purchase order to buy more aggregate material used for backfilling water main repairs. A second item authorizes an emergency purchase order for repairing and making a new connection for the water main at 1214 S. University. In both cases, the emergency purchase orders were authorized by the city administrator, and the work was done.

Street closures for two events are on the council’s March 3 agenda: Take Back the Night and the Monroe Street Fair.

Also on the agenda is a resolution that would encourage Gov. Rick Snyder, state senator Rebekah Warren, and state representatives Jeff Irwin and Adam Zemke to explore creative ways to fund the state’s fire protection grant program for municipalities like Ann Arbor, which host state institutions. In the last three years, the program has been only 40-55% funded.

DDA Parking Trends Continue

The meeting did not feature one of its typical highlights – discussion of the monthly parking report. However, the data was released to the public at the meeting, and it was mentioned that the data was now available to the public in draft form.

So this meeting report adds that provisional parking data to the data set that The Chronicle maintains – to chart the activity in Ann Arbor’s public parking system as the DDA measures it.

Highlights from public commentary included appreciation from representatives of the Neutral Zone for grants the organization has received from the DDA. The board also heard an update – during public commentary and in its committee reports – on a proposal to install an artificial ice rink on top of the new Library Lane underground parking garage.

Committee reports included updates on a possible economic development task force initiated by Ward 2 city councilmember Sally Petersen. Other updates included getDowntown’s commuter challenge, which takes place during the month of May, and the opening of the “Bike House” bicycle parking facility inside the Maynard parking structure.

Parks Group Applauds “Status Quo” Budget

Park commissioners were briefed on budget details at their April meeting, and voted unanimously to recommend the budget for approval. The parks budget will be a component of the overall budget that the city council will vote on in mid-May. The public hearing on that budget will be held on May 6. “The message is status quo,” parks and recreation manager Colin Smith told commissioners.

In a separate vote, commissioners recommended raising fees – ranging between 4-9% – for rentals at the Gallup Park meeting room and Cobblestone Farm. It was the first fee increase at these facilities since 2007 and 2006, respectively.

In other action, commissioners unanimously recommended approval of a five-year contract with Coca-Cola Refreshments for cold beverage concessions. It will replace the 10-year contract with Pepsi that expires this summer. Pepsi was the only other bid received by the city for a new contract, but missed the deadline and was disqualified.

Commissioners also recommended that the city award a $535,000 contract to Pranam Global Tech Inc. to replace the nearly 40-year-old roof at Veterans Memorial Park Ice Arena. The project includes a 10% construction contingency of $53,500, bringing the total project budget to $588,500.

Updates from commissioners included ongoing efforts to find a new centrally located dog park, as well as more information-gathering work by the downtown parks subcommittee.

And in his manager’s report, Smith informed commissioners of an increase in spray-painted graffiti in the parks. The staff is collecting data on how much time they spend repairing areas that are hit with graffiti, “and it’s substantial,” he said. Even trees have been tagged, which is unusual, Smith reported. “There have been some rather inappropriate things painted on some very nice trees.” He added: “It’s extremely frustrating … We’re not in the business of providing spray-painting opportunities any more than we are in the business of providing apothecary options for people in the parks. AADL Weighs Small Tax Hike in FY 2014

The $12.475 million proposed budget calls for levying the AADL’s tax at a rate of 1.575-mill – a small increase from the current 1.55-mill rate, but still below the amount that AADL is authorized to levy. [.pdf of draft 2013-14 budget]

Ken Nieman – AADL’s associate director of finance, HR and operations – told the board that the budget includes a 3% increase in the merit raise pool for full-time employees and an increase in hourly base rates for part-time workers. The administration wanted to make sure that the library’s lower-paying jobs start at more than $9 per hour. “It will help us attract people and hopefully also keep people as we compete against other businesses out there,” he said.

The board is expected to vote on the budget and set the millage rate on May 6, but several trustees made comments about the draft budget during the April 15 meeting. Ed Surovell argued strongly against even a small tax increase, and said he wouldn’t be voting for a budget that includes any increase to the millage. It’s estimated that the additional 0.025 mills would increase the amount of the library tax for homeowners by $2.50 per year, for a home that has a taxable value of $100,000. The increase is estimated to result in an additional $185,000 in tax revenues, compared to a 1.55-mill rate.

The April 15 meeting also included a presentation by Stewart Gordon and Alan Haber, who are advocating to put a temporary, artificial ice-skating rink at the northwest corner of the Library Lane parking lot. They asked the board to designate a liaison from the library, to facilitate communications as the project unfolds – they hope to construct and open it by Oct. 15. Several commissioners board members expressed skepticism about the proposal, stressing concerns over financing and security issues.

The board also heard from five people during public commentary. Topics included concerns over the hiring of Allerton-Hill Consulting, and thanks for support the library’s support of the ArborWiki and Old News projects. [Full Story]

Parks Agenda: Downtown, Dogs, Dams, DTE

Commissioners discussed a proposal to build an ice-skating rink atop a portion of the city-owned Library Lane underground parking structure. They took no action on the item, but were briefed on the proposal by two advocates of the effort: Alan Haber and Stewart Gordon. The two men also attended a subsequent March 26 meeting of a PAC downtown park subcommittee. This report includes a summary of that session as well.

River-related items on PAC’s March 19 agenda included a resolution to recommend awarding a $295,530 contract to Gerace Construction Co. for repair work and repainting at Argo and Geddes dams, as well as site improvements around Argo Dam. Brian Steglitz, an engineer with the city, told commissioners that the work is being done in response to the most recent inspection by state regulators.

Commissioners also recommended awarding a $512,180 contract for improvements at the Gallup Park canoe livery to Construction Solutions Inc., which will be funded in part by a $300,000 state grant. Cheryl Saam, facility supervisor for the Argo and Gallup canoe liveries, gave commissioners a presentation on those operations, in preparation for budget recommendations that PAC is expected to consider at its April 16 meeting.

As part of her report, Saam noted that the city plans to issue another request for proposals (RFP) to design a whitewater section along the Huron River, downstream from the Argo Dam near the Argo Cascades. Parks and recreation manager Colin Smith reminded commissioners that the first attempt at this project wasn’t successful. The Michigan Dept. of Environmental Quality did not approve the initial design, and would not issue the necessary permit for the project. The staff is working with the state to address MDEQ’s concerns, he said. Smith also reported that DTE Energy still intends to pay for the project, which is located adjacent to property that the utility company is cleaning up.

DTE representatives were on hand at the meeting because of a different project: To request an easement on city-owned land in Riverside Park, where utility poles are located. The easement is needed as part of an $8 million new electrical substation that DTE is building on land adjacent to the park. Commissioners unanimously recommended that the city council approve the easement.

In another presentation to set the stage for next month’s budget discussion, PAC heard from Doug Kelly, the city’s director of golf, and Andrew Walton, recreational facility supervisor at Huron Hills. They reviewed the status of the city’s two golf courses – at Huron Hills and Leslie Park – and noted that both courses have seen significant revenue gains over the past five years.

The issue that drew the most public commentary during the meeting wasn’t on the March 19 agenda: a possible dog park on a knoll in West Park. Residents in that area aren’t happy about the prospect of barking dogs in their neighborhood. [Full Story]

Commissioners have been lobbied about the project during public commentary at previous meetings, most recently on Feb. 26, 2013. At that meeting, Haber – one of the organizers of the Library Green Conservancy – told commissioners that he hoped PAC could make a statement as a body or individually to the city council, urging them to give the rink a try for just two months. … [Full Story]

“Connecting William” To Be Resource Plan

Ann Arbor planning commission meeting (March 5, 2013): Despite protests by members of the Library Green Conservancy and hesitation by some commissioners, the city planning commission voted unanimously to add the Connecting William Street plan to its list of resource documents that support the city’s master plan. After the vote, Wendy Woods tried to reopen the item for reconsideration, but she was unsuccessful in garnering support from the majority of commissioners, so the initial decision stands.

The Connecting William Street project was undertaken by the Ann Arbor Downtown Development Authority at the behest of the city council. It focuses on recommendations for coordinated development of five city-own sites in the William Street area, on the south side of downtown. By becoming a resource document, the CWS plan carries less weight than it would if it were part of the city’s master plan.

Amber Miller of the DDA gave a presentation during the March 5 commission meeting, similar to those previously given to the council and the DDA board.

Much of the discussion among commissioners focused on the issue of open space. Miller noted that recommendations on that issue have been deferred to a committee of the city’s park advisory commission. That downtown parks committee is in the early stages of its work – it was scheduled to meet earlier in the day on March 5, but that meeting was canceled.

Commentary during a public hearing on the CWS plan also focused on open space, with several members of the Library Green Conservancy advocating for a centrally located park atop the Library Lane underground parking structure. They criticized the DDA’s process for developing the plan, and felt the planning commission had not adequately publicized the fact that a public hearing on Connecting William Street would be held that evening.

Additional public commentary came after the commission’s vote. Woods said her decision to ask for reconsideration of the item was prompted by concerns raised during this final public commentary. She felt it wouldn’t hurt to wait two weeks until the commission’s next meeting, so that more people could have the chance to weigh in, if they wanted.

Sabra Briere, who had expressed strong reservations before casting her original yes vote, said she supported Woods in her effort to reconsider the item, suggesting that postponement would be appropriate. She expressed concern that the commission was deciding to use the CWS plan as a future planning document – which would be referenced when the planning staff and commission make their recommendations to the city council on site plans and other planning and development actions. Given that importance, Briere – who also serves on city council – wanted to be absolutely certain before accepting it.

Other commissioners disagreed. Kirk Westphal, the planning commission’s chair, also served on a DDA leadership outreach committee (LOC) that helped craft the Connecting William Street plan. He said he felt extremely comfortable with the public process that had led to these recommendations. Eric Mahler also argued against reopening the item for another vote, saying the commission needed to bring closure to this long process. He was satisfied that sufficient public notice had been provided.

It’s unclear whether the city council will take any action on the Connecting William Street plan. As to what happens next, Susan Pollay, the DDA’s executive director, told planning commissioners that the DDA will be following the council’s guidance. Councilmembers have already taken a first step related to one of the five parcels – the former YMCA lot. At their meeting on March 4, 2013, councilmembers voted to direct the city administrator to prepare an RFP (request for proposals) for brokerage services to sell the lot. A $3.5 million balloon payment on the property is due at the end of 2013. [Full Story]

Parks Group Explores New Dog Park Site

Ann Arbor park advisory commission meeting (Feb. 26, 2013): An item generating the most discussion at this month’s PAC meeting related to two potential locations for a new fenced-in dog park: about 2 acres in and near South Maple Park, on the city’s west side off of West Liberty; and a roughly 1-acre section of West Park, on a knoll in the south-central area.

No action was taken, and a PAC committee will continue to evaluate these options with parks staff before making a formal recommendation to the full commission. The previously recommended site – at a different location within West Park, near the parking lot off Chapin Street – was ultimately not presented to the city council, following protests from the nearby New Hope Baptist Church.

Another PAC committee, focused on developing recommendations for a possible downtown park, gave only a brief update. Its next meeting is scheduled for Tuesday, March 5. However, commissioners heard from four people during public commentary who advocated for a new park atop the city’s Library Lane underground parking structure on South Fifth Avenue. Part of the commentary covered a proposal to build a temporary ice-skating rink on that site.

Commissioners also recommended approval of several contracts totaling over $180,000. The contracts cover landscaping work at multiple locations, golf cart leases, custodial work at Cobblestone Farm, renovations at Esch Park, and rental of an overflow parking lot for the Argo canoe livery. The landscaping work is being funded through a donation from the Henrietta Feldman Trust.

And in his monthly report, parks and recreation manager Colin Smith informed commissioners about a strategy the city is pursuing to deal with invasive aquatic plants – primarily Eurasian watermilfoil – at Geddes Pond. [Full Story]

DDA Sends William Street Project to Council

Ann Arbor Downtown Development Authority board meeting (Jan. 9, 2013): The first meeting of the year for the DDA’s board featured a packed agenda – with items ranging from budget adjustments to the adoption of recommendations on the Connecting William Street project. Also voted on by the board were grants to the nonprofit Dawn Farm, an allocation of funds for the DDA’s energy grant program, and two monthly parking permits for The Varsity residential development.

The budget adjustments to FY 2013 were made in order to account for roughly $2.6 million in construction costs associated with the Library Lane underground parking garage. They had been allocated in the previous year’s budget, but not paid last year – because the completion of the construction extended into this fiscal year.

The FY 2012 audit report, which the board also approved at its Jan. 9 meeting, shows that for FY 2012, the DDA spent about $2.5 million less than anticipated for that year – because the construction invoices were not all submitted to the DDA by the time books closed for the year.

The result of those changes leaves a budget with $22,237,924 in revenues against $26,339,555 in expenses for the year – which translates to a planned use of the DDA’s fund balance reserve of $4,101,632. That’s about half of the existing fund balance.

Not a part of the revised budget was the approval of two allocations made by the board – one of $50,000 in connection with the DDA’s existing energy grant program, and another of $150,000 for a grant to Dawn Farm, a nonprofit offering both residential and out-patient services supporting recovery for alcoholics and drug addicts. The energy allocation will essentially attempt to leverage energy audits completed through the DDA’s program for use in the Michigan Saves program, which offers low-interest financing for energy improvements.

The board also approved recommendations to be forwarded to the city council on the future redevelopment of five city-owned sites currently used for parking. The project, which is now named Connecting William Street (CWS), began with an April 4, 2011 city council resolution that directed the DDA to seek “robust public input” from experts, stakeholders and residents to develop a plan for those parcels.

In connection with the parcels in that area, the board also adopted a policy on possible grants from the DDA’s tax increment finance (TIF) funds to support development of the CWS properties. The policy makes clear that the DDA would not forgo its TIF capture on any property – but the amount of the grant would be calculated based on TIF revenue.

Also in connection with the CWS project, the board heard remarks during public commentary from representatives of the city’s park advisory commission as well as the State Street Area Association. The board also invited Doug Kelbaugh, a University of Michigan professor of architecture and urban planning, to share his thoughts on parks versus plazas – and why he thinks the site on top of the Library Lane parking garage is more likely to succeed as a plaza instead of a park. Parking As Residential Incentive: Where?

About 40 monthly parking permits in Ann Arbor’s public parking system – to be sold to a proposed project at 624 Church St. – have been the topic of discussion by the Ann Arbor Downtown Development Authority in the last few months.

Most recently, at the Dec. 19 meeting of the DDA’s operations committee, the discussion focused on location: For which of the six public parking structures would monthly permits be sold? The developer of the 624 Church St. project would prefer that the project be allowed to buy permits in the Forest parking structure.

The Forest facility, a joint venture of the DDA and the University of Michigan, is the structure closest to the proposed residential development. According to the developer’s Nov. 28 submittal to the city, the 13-story project would include more than 80,000 square feet of new floor area with the following configuration of apartments: 11 one-bedroom; 21 two-bedroom; 33 three-bedroom; and 11 four-bedroom units. That’s a total of 76 apartments, with 196 bedrooms.

The developer, Opus Development Corp., has already won approval from the DDA’s board to satisfy the project’s parking requirement without providing onsite spaces – by instead using the contribution in lieu (CIL) program. The CIL provides an option to purchase monthly permits, but the cost is at a rate 20% higher than standard pricing.

Discussion by the DDA operations committee on Dec. 19 centered around the issue of fairness: Would allowing the purchase of permits in the Forest structure give the developer of the 624 Church St. project an unfair competitive advantage in the South University area rental market? Raising the fairness issue was DDA board member Roger Hewitt, who owns Revive + Replenish, which is a tenant in the ground floor of the Zaragon Place on East University. Zaragon is a nine-story apartment building with almost 250 bedrooms, catering to the student rental market.

Other board members did not perceive the issue to be problematic, from the perspective of fairness to already-existing projects. And Susan Pollay, executive director of the DDA, pointed out that the decision to allow a project to purchase monthly parking permits is a tool that’s available to the DDA to help make a private development possible that otherwise would not be. In the case of 624 Church St., building parking spaces on that site isn’t feasible. Hewitt was concerned that the strategy – if the DDA allowed permits to be purchased at a structure very near to projects – might result in an incentive for developers in the future not to build any onsite parking.

The committee’s discussion was inconclusive, but committee members indicated they wanted to develop a formal policy on which parking structures would be chosen for monthly permits sold under the CIL program. The 624 Church St. project is due to come before the city planning commission on Jan. 15, so the developer would prefer to have the issue settled by then. But given the DDA’s desire first to establish a policy that would guide this and future decisions, it’s unlikely it will be finalized as early as mid-January.

Based on the committee’s discussion, capacity in the parking system does not appear currently to be a limiting factor on selling CIL permits. The committee also reviewed the latest monthly parking data, which shows continued increased usage of the new underground garage, Library Lane.

Revenues per space in the Library Lane structure are now beginning to approach those of on-street parking spaces, but are still the lowest of any facility in the system. That’s due in part to a discounted rate offered to induce holders of permits in other structures to move to Library Lane.

Also of interest at the operations committee meeting was a draft policy for holding events on top of the Library Lane structure, including the closure of the mid-block cut-through, Library Lane itself. [Full Story]

Prices to Get Tweaked as Parking Deck Opens

Ann Arbor Downtown Development Authority board meeting (May 2, 2012): The one action item on the board’s agenda was a resolution directing its operations committee to start applying demand-management principles to the pricing for permits in Ann Arbor’s public parking system. The resolution, which passed unanimously, notes that the goal of the pricing strategy is to attract patrons to those structures that are located farther away from the University of Michigan campus.

One of those structures farther west of the campus is the new underground parking garage on South Fifth Avenue, which is nearing completion. The garage, which the DDA is currently calling the “Library Lane” parking structure, is now expected to open by the time the art fairs begin, which this year fall on July 18–21. South Fifth Avenue between Liberty and William is expected to re-open by Memorial Day.

A characterization of that timing as “on schedule” was disputed during public commentary by Ali Ramlawi, owner of the Jerusalem Garden restaurant. Jerusalem Garden is adjacent to the construction site. Ramlawi noted that the structure was originally due to be completed by August 2011.

The future use of the top of the underground garage was the subject of public commentary from advocates who’d like to see it used as a green plaza. That suggestion was met with remarks from mayor John Hieftje, who sits on the DDA board, with a description of his expectation that three major parcels would soon be incorporated into the city’s park system – 721 N. Main, 415 W. Washington, and the MichCon property (located between the Amtrak rail station and the Huron River near the Broadway bridges). Hieftje’s point was that the additional financial burden for the maintenance of those parcels as parks might impact the city’s ability to add a downtown green plaza to the park system.

Requests for better information about the parking system and suggestions for disseminating information about the availability of open parking spaces were topics of additional public commentary.

Although it was not an action item, the board discussed a draft policy on supporting “brownfield” projects – a policy prompted by discussions at the board’s partnerships committee over the last few months. [.pdf of draft DDA brownfield policy]

The committee has been discussing a proposal by Dan Ketelaar for support of a proposed development at 618 S. Main, which received a positive recommendation from the Ann Arbor planning commission on Jan. 19, 2012. If the project moves forward, the 7-story building would include 190 units for 231 bedrooms, plus two levels of parking for 121 vehicles. Ketelaar has estimated that the tax on the increment between the current valuation of the property and the final built project would yield around $250,000 a year in TIF (tax increment finance) revenue to the DDA. If adopted as it’s currently worded in the draft, the formula in the policy would translate into up to $625,000 of support for 618 S. Main.

Navigating Library Lane

The Chronicle arrived about an hour late to the Oct. 19, 2009 board meeting for the Ann Arbor District Library, which began before the conclusion of an earlier meeting of the Ann Arbor Public Art Commission.

When we arrived, however, the board was not in the downtown library’s fourth-floor conference room where these meetings are held – they’d moved into a closed executive session. Waiting for their return were Susan Pollay, executive director of the Ann Arbor Downtown Development Authority, and Adrian Iraola, project manager for the DDA’s Fifth Avenue underground parking project.

Pollay and Iraola were there to talk to the board about the city’s request for a utility easement on library property, to the east of the library’s downtown building. The easement is needed so that the DDA can install a new water main leading to a fire hydrant on Library Lane, a proposed east-west street that would lie between the library on the south and the DDA parking structure on the north.

When the board returned from their executive session, Pollay and Iraola got an unanticipated response – one that’s resulting in an adjustment of the DDA’s construction schedule on the project. [Full Story]
