Ann Arbor Looks to Future: Housing, Transit

Ann Arbor city council meeting (June 3, 2013): At a meeting that lasted until nearly 1 a.m., the council took major steps that will affect the future of services in two core areas: housing and transportation.

On the housing side, a unanimous vote of the council approved the transfer of ownership for city properties managed by the Ann Arbor Housing Commission (AAHC) to the commission itself – an arrangement that’s actually more common across housing commissions in other cities. That step will allow conversion of the AAHC’s 355 public housing units to a project-based voucher system under HUD’s Rental Assistance Demonstration (RAD) program. AAHC will then be pursuing low-income housing tax credits through a ground lease of the properties to a private/public limited partnership. The tax credits are intended to fund several million dollars in needed capital improvements to the existing properties, as well as build 20-30 new units.

Other unanimous votes related to the AAHC’s plan included: a resolution to approve a payment in lieu of taxes (PILOT) for the properties now owned by AAHC – so that no property taxes will be owed; a resolution declaring that AAHC employees are and will remain city employees; and a $200,000 allocation from the city’s affordable housing trust fund to support improvements to Miller Manor.

On the transportation side, the council unanimously authorized membership of the city of Ypsilanti in the Ann Arbor Transportation Authority, by approving changes to the articles of incorporation for the AATA. The number of board seats is expanded from seven to nine, with one of the seats to be appointed by the city of Ypsilanti. The transportation authority will go by the name Ann Arbor Area Transportation Authority. The board of the AATA and the city of Ypsilanti also will need to formally approve the new articles, but are expected to do that in a straightforward fashion.

While the amendment of the articles of incorporation changes only the governance of the AAATA, the intent is to provide the potential for increased transportation funding. The AAATA could, with voter approval, levy a uniform millage on all member jurisdictions of the authority – now the cities of Ann Arbor and Ypsilanti. It’s a right the current AATA already has, but has never exercised. Each city itself already levies a transit millage, and transmits the proceeds of those taxes to the AATA. For Ypsilanti, the advantage of a transit authority millage is that it would not count against the state constitutional 20-mill cap that a city can levy – a cap that Ypsilanti has already reached.

Deliberations on those two agenda items – housing and transportation – did not begin until after 11 p.m.

Taking an hour of the council’s time before that was a debate on a change to the city’s public art ordinance. The council unanimously supported eliminating the requirement of an automatic 1% set-aside for public art in the budget for every capital project – known as Percent for Art. But lengthy deliberations unfolded about an additional change: A provision that would allow for the return of previous years’ public art allocations to their funds of origin.

The ordinance revision that had already been given initial approval by the council allowed for such a return just for the FY 2014 public art set-asides. In the end, the council opted for an ordinance change that did not provide for a return of previous years’ public art allocations. That leaves roughly $845,000 in funds that can be used for the public art program as defined in the revised ordinance – one that places the onus on city staff to identify capital improvement projects that might be suitable for incorporating public art.

Another significant item on the council’s June 3 agenda was a resolution encouraging the Ann Arbor Downtown Development Authority to allocate funding for three police officers. That resolution passed on an 8-2 vote. The council also gave final approval to utility rate increases (an annual item) and a reduction in utility improvement charges imposed on first-time connections.

Other business included final approval of rezoning requests for Parkway Place and State Street Center. The Parkway Place rezoning – at 490 Huron Parkway – was from R3 (townhouse dwelling district) to R1B (single-family dwelling district). The State Street Center rezoning, near the intersection of South State and Ellsworth, was from O (office district) to C3 (fringe commercial district).

In anticipation of the upcoming July 4 holiday, the council took initial action on an ordinance that would restrict use of fireworks to the hours of 8 a.m. to midnight.

During public commentary, the topic of Pizza in the Park was reprised as a theme from the council’s previous meeting. Advocates for the homeless community lobbied for a written commitment from the city that a parks and recreation fee would not be imposed on a church that distributes food and other aid at Liberty Plaza, a downtown city park. Dems Forum Part 3: Connections

Editor’s note: A forum hosted by the Ann Arbor Democratic Party on Saturday, June 8, 2013 drew six of seven total city council candidates who’ve qualified for the primary ballot.

In the Aug. 6 Democratic primary, only two wards offer contested races. In Ward 3, Democratic voters will choose between incumbent Stephen Kunselman and Julie Grand. Ward 4 voters will have a choice between incumbent Marcia Higgins and Jack Eaton. Higgins was reported to have been sick and was unable to attend.

The format of the event eventually allowed other candidates who are unopposed in the Democratic primary to participate: Mike Anglin (Ward 5 incumbent), Sabra Briere (Ward 1 incumbent), and Kirk Westphal, who’s challenging incumbent Jane Lumm in Ward 2. Lumm, who was elected to the council as an independent, was in the audience at the forum but didn’t participate. The event was held at the Ann Arbor Community Center on North Main Street. The Chronicle’s coverage is presented in a multiple-part series, based on common threads that formed directly in response to questions posed to the candidates, or that cut across multiple responses.

One question posed to candidates explicitly involved transportation: What do we do to implement an effective transportation plan for Ann Arbor that would decrease congestion and encourage alternative modes of travel? But transportation fit into a broader set of themes at the forum that could be collected under the notion of “connection” – connectedness of citizens not just to physical locations, but to their local government.

Candidates had clearly prepared to talk about the topic of transportation generally. Jack Eaton criticized last year’s demised countywide planning effort, based on the fact that other communities were not asked to defray the costs of that planning. At the same time he called for better maintenance of roads, partly out of concern for bicyclist safety. He also called for more frequent bus service during extended hours – but cautioned that he was focused on spending Ann Arbor’s local transit millage money on transit in Ann Arbor.

As far as millages go, Mike Anglin was clear that he would vote for a possible new millage resulting from the admission of Ypsilanti to the Ann Arbor Transportation Authority. However, Anglin was emphatic that he did not support trains, but rather only buses – with a focus on moving people around inside the city.

Julie Grand said she was glad that the possibility of adding rail service was being studied, and that by council resolution, the question of possibly using the Fuller Road site for a new train station would go to the voters. She pointed out that the park advisory commission, on which she serves, focuses on the potential for non-motorized connections when it considers parcels to acquire as parkland. She called transit a regional issue, but said that ultimately we need to focus on transit within the community.

Stephen Kunselman was specific with a suggestion of how to return a focus to the city’s own transportation needs: Remove the city’s transportation program manager, Eli Cooper, from the AATA board – so that Cooper could focus on issues like sidewalk gaps and bicycle lanes. Kunselman also stated that he would be proposing that the city council rescind its memorandum of understanding with the University of Michigan to build a parking structure as part of the Fuller Road Station project.

Although UM has withdrawn from participation in that project under the MOU, Kunselman said he wanted to “kill it.” That way, he said, the conversation could turn away from using the designated parkland at the Fuller Road Station site as a new train station, and could instead be focused on the site across the tracks from the existing Amtrak station.

Sabra Briere ventured that the community did not have a consensus about the basic question of what kind of transportation system is best for Ann Arbor – one that was geared primarily to commuters or one that was designed mainly for city residents as a replacement for personal automobiles.

Kirk Westphal told the audience that he’d chosen a house to buy in Ann Arbor based on its proximity to a bus line. He ventured that the transportation system needs to be robust enough to attract people out of their cars, and that to be financial viable, a certain amount of density is required. It’s important to support development near transit lines to provide that density, he said.

In addition to the question about connecting people to physical locations (i.e., transportation), candidates at the forum responded to a question about connecting people to local government. The question was specific to involving youth in local government. But candidates also delivered a range of comments throughout the forum related to the theme of connecting residents to government.

Among the specific suggestions was one from Westphal, who floated the idea of a “citizens academy” for general government along the lines of Ann Arbor’s citizens police, courts and fire academy.

Ann Arbor Council OKs Ypsi in AATA

The city of Ypsilanti’s membership in the Ann Arbor Transportation Authority has been approved by the city of Ann Arbor in action taken by the Ann Arbor city council on June 3, 2013.

The specific action taken by the council was to approve changes to AATA’s articles of incorporation. The AATA itself and the Ypsilanti city council will also need to approve the document. Ypsi Waits at Bus Stop, Other Riders Unclear

Two recent meetings of the “urban core” communities near the city of Ann Arbor have provided some quiet momentum toward possible improved public transportation services in the Ann Arbor area. The effort’s regional focus is reflected in the location of the meetings, which have taken place outside Ann Arbor – at Pittsfield Township hall and Saline city hall.

However, at the more recent meeting in Saline, which took place on April 25, 2013, Ypsilanti Township supervisor Brenda Stumbo stated her expectation that the city of Ann Arbor would provide the necessary leadership for better transportation. The meetings of elected officials, which have been coordinated by the Ann Arbor Transportation Authority, include representatives from the cities of Ann Arbor, Ypsilanti and Saline, the village of Dexter, as well as the townships of Pittsfield and Ypsilanti.

The effort to focus on improved transportation within a narrower geographic footprint near Ann Arbor – instead of the whole of Washtenaw County – has come after an attempt to establish a countywide transit authority unraveled in the fall of 2012. Of the communities in the more narrowly focused urban core, Ypsilanti has been the most assertive in pushing for action.

At the Ypsilanti city council’s April 23 meeting, councilmembers made a formal request to join the AATA under the transit authority’s existing enabling legislation – Act 55 of 1963. That request will now be considered by the AATA board. It also will require the cooperation of the Ann Arbor city council – to amend the AATA’s articles of incorporation.

For the city of Ypsilanti, joining the AATA represents a new way to generate more funding for transportation. Because the city already levies at the state constitutional limit of 20 mills, the city itself can’t add an additional tax burden. But the AATA could ask voters of all member jurisdictions to approve a levy of its own – something that it currently does not do. And that would not count against the 20-mill limit.

Ann Arbor city councilmembers who attended the April 25 urban core meeting expressed cautious support of the idea of adding Ypsilanti to the AATA. Stephen Kunselman (Ward 3) described himself as “tickled” to see the analysis and breakdown of governance and funding options in the meeting packet. Chuck Warpehoski (Ward 5) ventured that if the effort required a “coalition of the willing,” then he was willing. But he expressed some caution about the amount of additional tax money Ann Arbor voters might be willing to approve.

Ann Arbor mayor John Hieftje ventured that the Ann Arbor city council might be able to address the issue in June – after the fiscal year budget is approved in May. He suggested specifically an additional AATA board seat for Ypsilanti as well as one for Ann Arbor, which would bring the board to a total of nine. Hieftje indicated a possibility that the August deadline for placing a millage on the November ballot could be met. Sally Petersen (Ward 2) expressed her view that Ann Arbor voters would need a clearer idea of what the improvements would be, before they’d support an additional tax.

If a decision were not made until August to place a measure on the November ballot, that would result in a relatively aggressive timeline for a millage campaign. For the AATA’s part, board chair Charles Griffith reiterated at the April 25 meeting the same sentiments he’d expressed a week earlier at the board’s April 18, 2013 meeting – that the AATA would give Ypsilanti’s request full consideration. He also stressed that the AATA didn’t want to take an action that could preclude other approaches to governance.

Those other approaches to governance could include a range of possibilities, such as membership of additional jurisdictions in the AATA – like Pittsfield and Ypsilanti townships. But in terms of their readiness to see a millage put on the ballot, neither township seems as ready as the city of Ypsilanti.

Based on remarks made on April 25 by Stumbo and township clerk Karen Lovejoy Roe, Ypsilanti Township’s first priority is to get a fire and police services millage approved by voters – likely in August. After that, they’d turn their attention to transportation. At the earlier urban core meeting – which took place at Pittsfield Township hall on March 28 – Lovejoy Roe had expressed some enthusiasm for moving ahead more quickly with transportation in November. But recent minutes of the township board indicate a desire to keep November as a possibility for a re-ask, in case the fire and police services millage doesn’t pass in August.

For Pittsfield Township supervisor Mandy Grewal, it was the cost allocation in one of the proposed transit scenarios that appeared to give her some pause. On that scenario, the cost of services compared with the amount of revenue generated resulted in Pittsfield Township getting back $0.79 in services for every dollar that residents contributed – the least of any jurisdiction in the mix.

Saline mayor Brian Marl expressed solid support for some kind of expansion of services to include the city of Saline, but reserved comment on the details of any of the cost or governance proposals.

County Board Ends “Washtenaw Ride”

The Washtenaw County board of commissioners voted officially to dissolve a countywide public transit authority known as the Washtenaw Ride. The 7-1 vote took place at the board’s April 17, 2013 meeting, without discussion, and followed initial approval given on April 3. Voting against the resolution was Conan Smith (D-District 9), but he did not comment on his decision during the meeting. Rolland Sizemore Jr. (D-District 5) was absent.

The Act 196 authority, created in mid-2012 and spearheaded by the Ann Arbor Transportation Authority, was for all practical purposes ended late last year when the Ann Arbor city council voted to opt out of the transit authority at its Nov. 8, 2012 meeting. County Board Briefed on Audit, Financials

Washtenaw County board of commissioners meeting (April 3, 2013): With a third of the board absent, commissioners were briefed on the county’s 2012 audit – with a look toward changes that will impact future financial statements. The audit was clean.

The county’s finance staff, along with the auditor, Mark Kettner of Rehmann, highlighted several points, including a relatively dramatic increase in the general fund balance over the last few years – from $9.7 million in 2009 to $16.8 million at the end of 2012. Kettner also explained upcoming accounting changes that will require unfunded liabilities from the county’s pension and retirement healthcare plans – now totaling nearly $250 million – to be recorded in a different way, with more disclosure.

The new accounting changes – required by the Governmental Accounting Standards Board (GASB) – won’t begin until 2015, but commissioner Dan Smith (R-District 2) wondered whether the county could implement the changes sooner. It might be possible, Kettner replied, but “I don’t know why you’d want to do it.” He suggested that the board hold a working session to go over the upcoming changes in more detail.

Kettner also pointed out that the changes will affect government entities in different ways. For example, it’s likely that there will be more impact on the city of Ann Arbor, because of how its many “enterprise” funds might be affected and the implications that would have on outstanding bonds. At minimum, the changes will mean more work for finance staff.

Also at the April 3 meeting, commissioners voted to add 39 new jobs in the community support and treatment service (CSTS) department, which provides mental health and substance abuse services to county residents. The work is primarily funded by the Washtenaw Community Health Organization, a partnership between the county and the University of Michigan Health System. Most of the new jobs are union positions. Dan Smith expressed concern about adding to the county’s payroll, but supported the resolution along with other commissioners in a unanimous vote.

The board also took an initial vote to dissolve The Washtenaw Ride. That Act 196 authority is a remnant of a failed attempt to create a countywide transit system last year. Efforts to expand the current reach of the Ann Arbor Transportation Authority are still underway, but don’t require the structure that was put in place under Act 196.

The topic of public transportation was raised later in the meeting as well, as Ronnie Peterson (D-District 6) asked about the county’s role in the southeast regional transit authority (RTA). The RTA was formed by the state legislature last year to coordinate regional transit in the city of Detroit and counties of Wayne, Macomb, Oakland and Washtenaw. There was not uniform support for Washtenaw County to be part of this effort, and it’s not yet clear what the impact will be on the AATA.

In other discussion, Yousef Rabhi (D-District 8) highlighted a proposal in front of the Ann Arbor city council regarding possible ordinance changes governing the Ann Arbor Downtown Development Authority. Depending on what the council decides, there might be implications for the county, he said, so he wanted to put it on the board’s radar. Also briefly mentioned was a discussion that occurred at a late March county pension commission meeting, raising questions about the new labor contracts that the board approved on March 20, 2013. At issue is whether the county complied with a state law requiring supplemental actuarial analysis before pension benefit changes are adopted. The county administration subsequently conferred with outside legal counsel, and confirmed their view that no new actuarial analysis was necessary.

And although it wasn’t discussed at the April 3 board meeting, the recent labor contracts resulted in another issue related to compliance with state law: Elimination of the county’s healthcare benefits for domestic partners. [Full Story]

Gerber, Murphy Named to Transit Board

Liz Gerber and Richard “Murph” Murphy have been appointed to represent Washtenaw County on the new southeast Michigan regional transit authority board. Gerber lives in Ann Arbor and is a professor at the University of Michigan Ford School of Public Policy. Murphy is an Ypsilanti resident and programs director for the Michigan Suburbs Alliance.

The appointments were made by Conan Smith, chair of the Washtenaw County board of commissioners – who also serves as executive director of the Michigan Suburbs Alliance. Smith announced his decision in a Dec. 31 email time-stamped 4:45 p.m.

Five Finalists To Be Interviewed for RTA Board

Five candidates will be interviewed on Thursday, Dec. 27, 2012 for two board positions to represent Washtenaw County on a new southeast Michigan regional transit authority (RTA). The finalists are: (1) David Nacht, a Scio Township resident, local attorney and board member of the Ann Arbor Transportation Authority; (2) Richard “Murph” Murphy, an Ypsilanti resident and programs director for the Michigan Suburbs Alliance; (3) John Waterman, a Saline resident and founder of the nonprofit Programs to Educate All Cyclists (PEAC); (4) Liz Gerber, an Ann Arbor resident and professor at the University of Michigan Ford School of Public Policy; and (5) Wendy Woods, current Ann Arbor planning commissioner and former Ann Arbor city councilmember.

Regional Transit Authority Board: 17 Apply

Seventeen people have applied for two board positions to represent Washtenaw County on a new southeast Michigan regional transit authority (RTA). The deadline to apply was Dec. 21. The legislation enacting the RTA was signed by Gov. Rick Snyder on Dec. 19.

The Regional Transit Authority board will have two appointees from each of four counties, and one from the city of Detroit.

The authority – intended to coordinate regional public transportation initiatives – covers the city of Detroit and counties of Wayne, Macomb, Oakland and Washtenaw. The governing board will consist of two appointees from each county, one appointee from Detroit, and one non-voting member appointed by the governor. The Washtenaw County board members are required to be residents and registered electors of the county. County employees, elected officials or employees of a public transportation provider – like the Ann Arbor Transportation Authority – are not eligible.

Several high-profile community members have applied for the new board positions, including Republican legislator Rick Olson – who co-sponsored the RTA legislation in the state House – and David Nacht, a current Ann Arbor Transportation Authority board member. Also applying is Richard “Murph” Murphy, programs director for the Michigan Suburbs Alliance, an organization led by Conan Smith.

Smith will be making the RTA appointments. The legislation states that the county executive – or county board chair, in counties like Washtenaw where the executive is not an elected position – is authorized to make appointments to the RTA board. Smith, a Democrat representing one of the county commissioner districts in Ann Arbor, has served as chair for the past two years. It’s the county board’s custom to rotate that position, and elections will be held on Jan. 2, 2013 for the next board chair. There is no stipulation that the RTA appointments must be made in 2012, only that they be made within 90 days of the RTA’s creation. County Seeks Applications for RTA Board

Washtenaw County issued a press release on Friday, Dec. 14 announcing the intent of Conan Smith, chair of the county board of commissioners, to appoint two representatives to a new 10-member regional transit authority (RTA) board. State legislation creating the RTA was passed earlier this month in a flurry of activity during the lame duck session, but has not yet been signed into law by Gov. Rick Snyder. That action is anticipated to happen next week.

Ann Arbor Council Protests RTA

On an 11-0 vote taken during a special session, the Ann Arbor city council approved a resolution protesting the Michigan state legislature’s enactment of a bill last week establishing a regional transit authority (RTA) that includes Washtenaw County – where Ann Arbor is located. Ann Arbor Council: Special Meeting on RTA

The city of Ann Arbor has announced a special meeting of the city council scheduled for Monday, Dec. 10, 2012 at 4 p.m., in the jury room on the fourth floor of the Justice Center at 301 E. Huron. AATA Looks to Ride Over Bumps

A week before the AATA board’s meeting, the Ann Arbor city council had voted to withdraw from the new authority and to terminate an agreement between four parties – the cities of Ann Arbor and Ypsilanti, Washtenaw County and the AATA – that would have governed a transition from the AATA to The Washtenaw Ride.

AATA Route #5 between Ann Arbor and Ypsilanti has two variants – 5A and 5B. The leg that is mostly within the city of Ann Arbor will have increased frequency starting at the end of January 2013, based on an AATA board resolution.

Since the incorporation of the new authority on Oct. 3, 2012, the “bumps” have included a divergence of views by legal counsel – about the start of the 30-day opt-out period, and the ability of someone to render simultaneous service on boards of the AATA and The Washtenaw Ride. Bumps also include decisions by a majority of municipalities countywide to withdraw from the authority, including some that the AATA had expected would participate. Ann Arbor’s withdrawal ended this approach to expanding transit. Until Ann Arbor’s decision to opt out, a majority of the county’s population was still included in the areas that would have participated.

Nevertheless, the mood of AATA’s Nov. 15 meeting was moderately optimistic. The Ann Arbor city council’s resolution had encouraged the AATA to pursue expanded service – but with a narrower focus. And CEO Michael Ford reported that following the council’s decision, a meeting had been held with representatives of eight different jurisdictions who were interested in pursuing some alternative to the Act 196 incorporation.

Having attended both the city council meeting and the subsequent meeting with representatives of interested jurisdictions, AATA board member Roger Kerson said, “The second was more fun than the first.” It’s expected that in December, it would be possible to start settling in on a geographic footprint for communities that would opt into an arrangement for expanded service and more stable funding.

Paul Schreiber, the mayor of Ypsilanti, attended the board’s meeting and encouraged the establishment of a more stable funding source than the purchase-of-service agreements (POSAs), through which the AATA has historically provided service to areas outside of Ann Arbor – like Ypsilanti.

The relatively optimistic tone of the board’s discussion was backed by two votes in support of expanded services: (1) the purchase of 25 additional vans to expand the AATA’s vanpool service; and (2) an allocation of funds to increase the frequency of service on the Ann Arbor branch of Route #5, which runs down Packard toward Ypsilanti.

The vote to increase service frequency on Route #5 came only after considerable debate and over the dissent of two board members. The AATA staff had recommended the increased service for Route #5 – but on a timetable that would have included a more thorough financial analysis of other services. Those other services have been added based on anticipated additional funding that would have been available through the newly incorporated Act 196 authority. They include: increased Route #4 frequency, the AirRide airport service, expanded NightRide service, and commuter express service to Chelsea and Canton. [Full Story]

AATA: Increased Service on Route #5

The Ann Arbor Transportation Authority’s Route #5 will be getting increased service starting at the end of January 2013, based on a vote taken by the AATA board at its Nov. 15, 2012 meeting. The resolution took the form of a re-programming of funds from the AATA’s AirRide service, which is covering its costs and generating more passenger revenue than forecast. AirRide service will not be affected by the board’s move.

AATA OKs Vehicle Purchase for Vanpool

The purchase of about two dozen 2013 Dodge Caravans at $21,356 apiece – as part of the Ann Arbor Transportation Authority’s vanpool program – was authorized by the board of the AATA board at its Nov. 15, 2012 meeting. The funds used for the 25 vans come from federal and state sources.

At the board’s Jan. 19, 2012 meeting, the AATA board had previously authorized the purchase of seven Dodge Caravans (model year 2012) for $21,272 each (total = $148,904), with an option to purchase up to a total of 25 vans (total = $531,800). 2013 County Budget Includes Board Pay Bump

Taking another step toward addressing a year-long controversy over how much to pay for animal control services, the board authorized contracting with the Humane Society of Huron Valley for $500,000 annually. The action enables the administration to negotiate a contract with HSHV for up to four years, with the option of adjusting the amount based on changes to the taxable value of property in the county. Voting against the resolution were Dan Smith, Wes Prater and Rolland Sizemore Jr. Ronnie Peterson was absent.

The county would not likely pay that entire amount. There are preliminary commitments from five municipalities with their own animal control ordinances, to help the offset the cost of the HSHV contract. Those entities are the cities of Ann Arbor and Ypsilanti, Ypsilanti Township, Pittsfield Township, and Superior Township.

Several commissioners expressed concern that the county is essentially in the same position as it was when this process began. Wes Prater objected to the fact that the county’s procurement policy wasn’t being followed, because a request for proposals (RFP) wasn’t issued.  Ultimately, a sufficient number of commissioners agreed to back the resolution, giving it final approval. The contract itself will not require authorization by the board.

In another move related to animal control services, the board gave final approval to a civil infractions ordinance, giving the county more flexibility to designate violations of other county ordinances as a civil infraction, rather than a criminal misdemeanor. [.pdf of proposed ordinance] In the context of animal control, enforcement of the county’s dog licensing ordinance is low because the current penalty – a criminal misdemeanor of 90 days in jail or a $500 fine – is relatively harsh. The idea is that enforcement would improve if a lesser civil infraction could be used.

Commissioners also debated options for changing their own compensation, ultimately giving initial approval to boost their base salaries from $15,500 to $15,750 annually and replacing per diem payments with stipends, effective Jan. 1, 2013. An amendment by Yousef Rabhi also increased the pay for chairs of the ways & means committee and the working session – bringing them to the same level as the board chair, at $3,000 more annually than the base salary of other commissioners. Voting against the changes as amended were Dan Smith and Rolland Sizemore Jr. A final vote is expected at the board’s Dec. 5 meeting, when a final vote on the overall 2013 budget will also occur.

In non-budget items, Dan Smith brought forward a resolution to rescind the board’s previous support for a regional transit authority (RTA) that’s being proposed in Lansing. The RTA would include the city of Detroit and the counties of Washtenaw, Wayne, Oakland and Macomb. Conan Smith has been an advocate for that effort, both as chair of the county board and in his role as executive director of the Michigan Suburbs Alliance. During deliberations on the item, some commissioners criticized Conan Smith for acting on behalf of the board and not keeping them fully informed. Wes Prater felt Conan Smith’s actions reflected disrespect for other commissioners – but Smith said he meant no disrespect.

A sense of disrespect was also felt by a resident who attended the Nov. 7 meeting to advocate for the county’s help in establishing a daytime warming center for the homeless. Alexandra Hoffman chastised the board because no commissioner responded to commentary about a warming center, and instead the remarks by advocates for the center had been followed by “disturbingly lighthearted talk about haircuts.”

Hoffman was referring to an announcement earlier in the meeting by Yousef Rabhi, whose hair is longer than any other commissioner, male or female. He hopes to get donations of $500 for every inch he cuts, to raise money for three local nonprofits: Shelter Association of Washtenaw County, Interfaith Hospitality Network, and SafeHouse Center. Rabhi told Hoffman that he was simply trying to raise awareness and money for the same issues that the warming center advocates supported.

The meeting fell the day after the Nov. 6 general election, which had resulted in the defeat of two of the nine commissioners who were running for re-election: Republican Rob Turner and Democrat Wes Prater. In District 1, Turner was outpolled by Democrat Kent Martinez-Kratz, decreasing the number of Republicans on the future nine-member board from three to two. Republican Alicia Ping won the District 3 seat over Prater – as the two incumbents faced each other due to redistricting that took effect with this election cycle. The last meeting for Turner and Prater – as well as for Democrats Leah Gunn and Barbara Bergman, who did not seek re-election – will be on Dec. 5.

It’s likely that the new board, which takes office in January, will eventually deal with a controversial topic that was raised during an appointments caucus on Nov. 7: Possible consolidation of the Washtenaw County road commission with county operations. During the caucus, held immediately prior to the regular meeting, Conan Smith suggested not yet reappointing the one road commissioner, Doug Fuller, whose term is expiring – though Fuller will continue to serve. Smith wanted to give the new county board some flexibility in discussing the future of the road commission. Some of the other issues emerging during the appointments caucus related to the role of the county’s historic district commission, economic development corporation, and the criminal justice community collaborative. Ann Arbor Opts Out of Countywide Vehicle

On a 10-0 vote, the Ann Arbor city council has opted out of the new transit authority – called The Washtenaw Ride – that was incorporated on Oct. 3, 2012, a little over a month ago. Incorporation of the new transit authority under Act 196 of 1986 had been preceded by the development of a 30-year transit master plan and a five-year service plan by the Ann Arbor Transportation Authority, over a more than two-year period.

End of Road for County Transit Effort?

The expansion of transit services throughout Washtenaw County appears to be taking turn away from some specific approaches that have been intensively discussed for the last couple of years.

Act 196 Transit Authority

Possible action by the Ann Arbor city council this week could lead to dissolution of a newly incorporated Act 196 transit authority – called The Washtenaw Ride – just as it is emerging.

At its Nov. 8 meeting, the Ann Arbor city council is now scheduled to vote on the question of opting out of a newly incorporated countywide transit authority – an initiative that the city of Ann Arbor had been expected to help lead. With Ann Arbor’s withdrawal, this particular approach to expanding transportation services would be effectively ended.

Update: The Ann Arbor city council did decide to opt out of the transit authority, on a 10-0 vote taken at the Nov. 8 meeting.

And the topic of transit has already been raised at the post-election Nov. 7 meeting of the Washtenaw County board of commissioners. Dan Smith, a Republican who represents District 2 covering northern parts of the county, had been prepared to introduce two transit-related resolutions at the meeting, but wound up placing only one of them on the agenda. The one he brought forward was a proposal to rescind support for a metro Detroit regional transit authority (RTA) – which the board had given in September of 2011. Although board chair Conan Smith has been a champion of legislation to enable an RTA, Dan Smith’s resolution passed on a 6-4 vote.

More significantly, Smith had also considered bringing forward a resolution to dissolve The Washtenaw Ride, a new countywide transit authority created under Act 196 of 1986 when the county filed articles of incorporation last month with the state. The Oct. 3 filing was undertaken as part of a four-party transit agreement between the county, the cities of Ann Arbor and Ypsilanti, and the Ann Arbor Transportation Authority, which is leading this initiative. Since then, all but five of the 28 municipalities in the county have voted to opt out of the new authority. However, those that are still participating include several of the county’s largest population centers: Ann Arbor, Ypsilanti, Ypsilanti Township, and Saline.

Dan Smith’s resolution indicated that because so few municipalities are participating, the Act 196 authority should be dissolved. He held off introducing it, however, in part because of pending action by the Ann Arbor city council the next day. As The Chronicle reported in mid-October, Ann Arbor city councilmember Stephen Kunselman had said he planned to pursue the possibility of Ann Arbor opting out – because he felt he’d have the required six-vote majority after the new city councilmembers are sworn in on Nov. 19.

But now the city council will take up the issue of withdrawing from the new transit authority at its Nov. 8 meeting. And that withdrawal will be accomplished with the support of at least some of those on the council who previously advocated to expand the AATA’s governance and service area through incorporation of the new authority. A resolution on withdrawal of Ann Arbor from the Act 196 authority was added to the Nov. 8, 2012 agenda the day before the meeting – sponsored by not just Kunselman, but also mayor John Hieftje, and councilmembers Sabra Briere, Christopher Taylor and Marcia Higgins. That indicates the city council’s resolution on withdrawal is almost certain to pass.

Under the terms of the four-party agreement, once the city of Ann Arbor withdraws from the Act 196 authority, the city can terminate the entire agreement. The council’s resolution indicates encouragement to the AATA to continue to work towards regional transportation, but not with the mechanism of this Act 196 authority.  [Full Story]

Column: Pass Go, Collect Bus Pass – And More?

In my wallet I have a transit pass. By sliding this pass through the farebox card reader aboard any Ann Arbor Transportation Authority bus, I get access to a public transportation system that served our community with 6.3 million rides this past fiscal year.

This go!pass, subsidized by the Ann Arbor Downtown Development Authority, lets its holder ride AATA buses an unlimited number of times.

If I rode the AATA buses to and from work every day and paid the full $1.50 fare each way, the cash value of that card would be about $750 per year. Of course if I were actually riding the bus that frequently, I’d be somewhat better off purchasing a 30-day pass for $58 a month, which would come out to just a bit under $700 annually.

What I actually paid for that card this year was $10 – just a bit over 1% of its potential cash value.

So what sort of dark magic subsidizes my potential rides on AATA buses? And why do I have access to this magical go!pass card, when you, dear Chronicle reader, likely do not?

Along the road to answering these questions, I’d also like to make a proposal. It’s a vision for broadening the program, getting more transit passes into the hands of Ann Arbor residents, and expanding the possible uses for the go!pass – including (shudder) the ability to use a transit pass to pay for parking. Transportation Dominates Council Meeting

A study that’s required as part of Ann Arbor’s approach to building a new train station will move forward with a $550,000 funding resolution approved by the council. The same resolution also includes a clause stating that construction of a new train station would be put to a popular referendum before proceeding.

The budget amendment, which passed with exactly the eight votes it needed on the 11-member council, allocated the $550,000 to provide new matching funds for a federal grant. The grant had been awarded through the Federal Railroad Administration’s High-Speed Intercity Passenger Rail (HSIPR) program. Dissenting on the vote were Jane Lumm (Ward 2) and Mike Anglin (Ward 5). Stephen Kunselman (Ward 3) was absent. Recent feedback from the FRA indicated that the city of Ann Arbor could not use previously expended funds to count as the local match – which had been the city’s original understanding.

The council also approved $30,000 for the continued study of a transportation connector between the northeast and south sides of Ann Arbor. The corridor runs from US-23 and Plymouth southward along Plymouth to State Street and farther south to I-94.

The council actually voted twice on that issue at the same meeting. On the first vote, the resolution failed. But a few minutes later, Marcia Higgins (Ward 4) – who had initially voted against it – asked for reconsideration of the vote, and changed her vote to support it, as did Mike Anglin (Ward 5). The council had previously considered and rejected funding for the study at its Sept. 4, 2012 meeting. But councilmembers reconsidered that vote two weeks later on Sept. 17, 2012, which resulted in a postponement until Oct. 15. The second reconsideration by the council during the Oct. 15 meeting required a suspension of the council’s rules, which don’t permit a question to be reconsidered more than once.

Wrapping up the transportation themes of the evening was a public call for volunteers to serve on the new 15-member transit authority board, recently incorporated under Act 196 of 1986. While it had been previously assumed that the seven Ann Arbor appointments to the new authority’s board would serve simultaneously on Ann Arbor Transportation Authority’s board, legal questions about simultaneous service on the two boards led to mayor John Hieftje’s announcement to recruit other volunteers.

The first two of the seven Ann Arbor nominations needed for the new transit authority board were made at the Oct. 15 meeting: Susan Baskett, who currently serves as a trustee on the Ann Arbor Public Schools board; and Tony Derezinski (Ward 2), who currently serves on the city council. Derezinski will be leaving the council in mid-November, because he did not prevail in his August Democratic primary race. His last city council meeting will be Nov. 8.

Nov. 8 would also mark the last council meeting for Carsten Hohnke (Ward 5) and Sandi Smith (Ward 1), who did not seek re-election. However, Smith announced on Oct. 15 that she would not be able to attend the Nov. 8 meeting, which meant that the Oct. 15 meeting was her last. She bid her colleagues farewell, and kind words were offered around the table.

It was a resolution from Smith that prompted the main non-transportation topic of the evening – an attempt to establish a formal policy to use the net proceeds of city-owned land sales to support affordable housing. The council approved a version of the policy, but it was far more restricted than Smith’s original proposal, which the council had considered but postponed on Sept. 17.

Smith’s initial proposal would have directed 85% of the net proceeds from the sale of any city-owned land in the Ann Arbor Downtown Development Authority district to be deposited in the city’s affordable housing trust fund. During the month-long postponement, the council’s budget committee discussed the proposal and made a recommendation that for only one city property – the Fifth & William lot, where the former YMCA building previously stood – the net proceeds from any future sale would be deposited into the city’s affordable housing trust fund. The budget committee also recommended that any other properties be considered on a case-by-case basis, considering all needs of the city. And that’s essentially the recommendation that the council adopted.

In other business, councilmembers authorized an extension to a third year for the city’s coordinated approach to funding for human services. And the council took the first step toward dissolving the sign board of appeals and transferring its responsibility to the zoning board of appeals. The council also accepted a total of $1 million in grants for city parks, and added about 125 acres to the city’s greenbelt program. And a $200,000 study was authorized to prevent flooding in the southwest part of the city.

A symbolic vote – calling for the U.S. Congress to send a constitutional amendment to the states to overturn the U.S. Supreme Court’s Citizens United v. Federal Elections Commission decision – resulted in passage, over dissent from Christopher Taylor (Ward 3), Marcia Higgins (Ward 4) and Jane Lumm (Ward 2).  [Full Story]

County Likely To Send Out Transit Notice

It appears that Washtenaw County will now be the entity sending out an official letter to local municipalities in early November, informing them that the official 30-day “opt out” period for leaving the new Washtenaw Ride transit authority will start at that time. Curtis Hedger – the attorney for Washtenaw County – informed county commissioners of that news at their Oct. 17, 2012 meeting, in response to a query from commissioner Wes Prater.

Many commissioners expressed surprise at the county’s involvement in this way. AATA Keeps Rolling Toward Countywide

Based on discussion at the board’s Sept. 27 meeting, it was the AATA’s expectation that the articles would be filed as soon as Oct. 3, and the wording of the AATA’s resolution indicated that the filing should take place “immediately.”

And according to Washtenaw County clerk staff, that’s what happened. Representatives of the AATA were authorized as couriers by the clerk, and they conveyed the physical documents to Lansing.

Letters that included a notice of intent to file had been sent on Sept. 27 to every jurisdiction, and to every elected official in the county.

At the Oct. 2 meeting, board chair Charles Griffith and former chair Jesse Bernstein expressed thanks to staff and community members who’ve worked over the last two years to get the process to this point. The basic theme of most of the remarks was in the spirit of the long journey ahead.

The long journey begins with the entity that’s created by the filing – which will initially have no assets, staff, or ability to operate transportation service in the county. A 15-member board composition for the new authority is already reflected in the membership of the board of the pre-incorporated board (called the U196 board), which has been meeting already for a year. Some of those board members attended the Oct. 2 meeting – David Read (North Middle District), Bob Mester (West District), Bill Lavery (South Middle District) and David Phillips (Northeast District).

Districts that include multiple jurisdictions appoint their representatives under inter-local agreements made under Act 7. In the case of the city of Ann Arbor, the appointments to the new transit authority need to be made through the city council’s confirmation of mayoral nominations.

To make the transition from the AATA to The Washtenaw Ride, under terms of a four-party agreement, voters would need to approve a funding source adequate to pay for the proposed expanded service plan. The four-party agreement is between the AATA, the cities of Ann Arbor and Ypsilanti, and Washtenaw County.

The five-year service plan for expanded service includes: (1) countywide demand-responsive services and feeder services; (2) express bus services and local transit hub services; (3) local community connectors and local community circulators; (4) park-and-ride intercept lots; and (5) urban bus network enhancements. For Ann Arbor, the program includes increased bus frequencies on key corridors, increased operating hours, and more services on weekends. According to a Sept. 5 press release from the AATA, Ann Arbor and Ypsilanti will get a 56% increase in service hours compared to current levels.

The AATA has indicated that a possible funding scenario is to ask voters in Washtenaw County to fund the new transit authority with a property tax of 0.584 mills – in an election that could come as early as May 2013. For a house worth $200,000, with a state-equalized value of $100,000, an 0.584 mill transit tax would cost that property owner about $58 per year. For an Ann Arbor resident with a $200,000 house, adding the 0.584 mill tax to the existing city transit tax of roughly 2 mills works out to a transportation tax burden of about $258 a year.

Also under the four-party agreement, the two cities’ transit taxes would become part of The Washtenaw Ride’s funding.

The transition would potentially not take place at all, if a majority of voters don’t approve it. Under the terms of the four-party agreement, a voter-approved funding source for the expanded services must be identified by the end of 2014.

Washtenaw County’s role is limited to the filing of the articles of incorporation for the new transit authority. The act of incorporation will include by default all jurisdictions in Washtenaw County. However, filing of the articles opens a 30-day window for jurisdictions to opt out of the arrangement. That can be accomplished through a vote of a jurisdiction’s governing body.

Michael Ford, AATA’s CEO, said at the Oct. 2 meeting that he hoped to schedule the first meeting of The Washtenaw Ride’s board for Oct. 11.  Although it’s a fair assumption that the current AATA board members will be nominated by mayor John Hieftje to serve as Ann Arbor’s representatives to the new transit authority, there’s no council meeting scheduled between now and Oct. 11 when the council could vote to make those appointments official.  [Full Story]

Charles Griffith to Lead AATA Board

Charles Griffith has been elected by his colleagues to lead the Ann Arbor Transportation Authority board for the coming year. The vote for board chair was uncontested, as it typically is, and was taken at the board’s Sept. 27, 2012 meeting. Jesse Bernstein has served as board chair for the last two years and will continue to serve on the board, but said at the meeting he wanted to see the chairship rotated.

City Council Punts on Several Agenda Items

Ann Arbor city council meeting (Sept. 17, 2012): The council’s initial agenda, released on Wednesday before the Monday meeting, was relatively light. But by the time the council had approved that agenda to start the meeting, it had grown considerably heavier.

Five significant items had been added: (1) a proposal to suspend temporarily the footing drain disconnection program in one area of the city; (2) a proposal to waive temporarily the city’s living wage requirement for certain nonprofits; (3) a proposal to establish a sidewalk gap elimination program; (4) a resolution on dealing with proceeds of city-owned land sales that competed with one already on the agenda; and (5) reconsideration of allocating $60,000 for a transit study – funding that the council had rejected at its previous meeting.

The first two items were added on Friday, Sept. 14. The second two were added the day of the meeting (Sept. 17), with the fifth item added at the council table. Of the added items, the council approved only one – to suspend temporarily the footing drain disconnect program. The rest were  postponed, withdrawn or voted down.

Postponed was the resolution added by Mike Anglin (Ward 5) to establish a committee of city officials and 10 residents – two from each ward, to be selected by councilmembers for respective wards – to address the issue of city-owned parcels in downtown Ann Arbor. The citizen committee to be established by Anglin’s resolution would study the available options for use of proceeds from the sale of downtown city properties.

Also postponed was the resolution that Anglin’s proposal was essentially challenging, which was brought forward by Sandi Smith (Ward 1). Smith wants to direct the proceeds from city-owned land sales to the city’s affordable housing trust fund. Her idea – which she first floated to her council colleagues in an email written in late August – enjoyed the support of nonprofits, as well as the Ann Arbor Downtown Development Authority board and the Washtenaw County board of commissioners.

While Anglin’s resolution was postponed until Oct. 1, Smith’s was referred to the council’s budget committee and postponed until the council’s Oct. 15 meeting.

Also postponed was a requested $60,000 contribution to fund further study of a transportation connector – for the corridor running from US-23 and Plymouth southward along Plymouth to State Street and farther south to I-94. The outcome of this phase is to identify a preferred choice of technology (e.g., bus rapid transit, light rail, etc.) and the location of stations and stops. The council had voted down the proposal at its Sept. 4 meeting, but it was brought back for reconsideration on Sept. 17, only to be postponed until Oct. 15. The $60,000 is meant to be the city’s share of a $300,000 local match for a $1.2 million federal grant that has already been awarded.

Withdrawn was the proposal to waive a requirement of the city’s living wage ordinance for those nonprofits that receive funding from the city to deliver human services. The ordinance has a provision for a hardship waiver, but states that a nonprofit must submit a plan for eventual compliance within three years. No nonprofits had submitted such plans, meaning that the council’s resolution would have amounted to an attempt by the council to amend the living wage ordinance through a simple resolution, which it cannot do. When the council reached the item on the agenda, it was withdrawn, with an indication that an ordinance revision would be brought forward to a future meeting.

Also at the Sept. 17 meeting, the council heard about an item related to nonprofit funding for human services that will be brought forward on Oct. 1: a request to continue the two-year pilot program for coordinated funding. That news came during a presentation from Mary Jo Callan, head of the city/county office of community and economic development.

Voted down was a plan to initiate a 5-year program to eliminate sidewalk gaps in the city. Councilmembers voting against the resolution pointed to the fact that the city’s non-motorized transportation plan takes a comprehensive approach to identifying such gaps. They feared that people might mistakenly believe that certain gaps would necessarily be filled through this program, and raised concerns about equity. The resolution sought to identify independent funding sources to pay for such projects – the city’s strategy in the past has been to levy special assessments on owners of property adjoining the sidewalks.

The footing drain disconnect program was the only one of the late additions to the agenda on which the council took final action. In the general vicinity of the Lansdowne neighborhood, where some houses have already had sump pumps installed as part of the disconnect program, residents have reported that during heavy rains, the overland stormwater flows and the sheer volume of water in the city’s stormwater system prevent sump pumps from being effective. At an Aug. 22 neighborhood meeting, residents had called for a moratorium on the program. That’s essentially what the council’s resolution did.

Flooding was also a topic included in other council business that had been placed on the agenda through the regular agenda-setting process. The council approved an update to the city’s hazard mitigation plan. It will allow the city to receive already-approved federal funds for demolishing two out-buildings located in the floodway at the city-owned 721 N. Main property.

Also related to emergency preparedness, the city council authorized the purchase of a light rescue vehicle that can be used by firefighters to respond to medical calls. Because its staffing requirement is just two firefighters instead of three, the use of the vehicle would allow response to medical calls without diminishing as much of the department’s response capability for fire calls.

Washtenaw Board to Re-Vote on Transit Accord

Again on the agenda of the Washtenaw County board commissioners for Sept. 5 will be the articles of incorporation for a new countywide transit authority. The intended outcome is not for the board to rescind or amend in a significant way the articles it approved on Aug. 1, 2012 – on a 6-4 vote.

Once again on the agenda for the Washtenaw County board of commissioners meeting on Sept. 5 will be the articles of incorporation for a new transit authority. It’s expected to be a stamp of approval for some administrative changes, not a chance to change the document or rescind the board’s previous decision to approve the document.

Instead, the point of re-introducing the agenda item is to provide an opportunity for the board to affirm the administrative changes to the articles of incorporation that took place after the board’s Aug. 1 vote.

The administrative changes were already included in the documents by the other three parties to the four-party agreement when they subsequently ratified the document. Those parties are the cities of Ann Arbor and Ypsilanti, and the Ann Arbor Transportation Authority, which is leading this effort. The Ann Arbor city council voted (for a third time) to approve the articles of incorporation at its Aug. 9, 2012 meeting; the Ypsilanti city council voted at its Aug. 14 meeting (also for a third time); and the AATA board voted (for a second time) at its meeting on Aug. 16.

News of the agenda item came from an email sent by Washtenaw County board chair Conan Smith to other commissioners on the evening of Aug. 22. It’s not entirely clear whether the board will: (1) take a vote that affirms the administrative (non-substantive) nature of the changes that were made after the board approved the document on Aug. 1; or (2) take a vote that amends the document to match the version approved by the other three parties.

Previous re-votes have been driven by substantive amendments made by one of the parties to the agreement. For example, the Ypsilanti city council amended the four-party accord after the Ann Arbor city council first voted, on March 5, 2012. That amendment involved service charges applied to the respective cities’ existing millages. When the agreement went back to the Ann Arbor city council, that body amended the document further – which meant that it returned to the Ypsilanti city council for its approval again. The AATA board then ratified the agreement.

It was expected to be approved by the Washtenaw County board of commissioners without further substantive amendment. But on Aug. 1 the board made a change to the size of the majority needed, in order for the new transit authority’s board to change the articles of incorporation – from 2/3 to 4/5 of the 15 board members. That triggered the most recent round of approvals by the various bodies.

But those approvals incorporated some changes that were driven by a desire to harmonize the county board’s amendment with the rest of the document, as well as with Act 196 of 1986 – the act under which the new transit authority will be incorporated. For example, the 4/5 majority requirement for changes to the articles of incorporation is at apparent odds with one kind of change to the articles specifically mentioned in Act 196 – a change in jurisdictions that are part of the authority. Act 196 explicitly indicates that a 2/3 vote is required. So an administrative change undertaken after the board’s Aug. 1 meeting was to add the clause: “… unless another vote of Board is required under the terms of these Articles or provided for in Act 196.”

The view of legal counsel for the four parties was apparently that it’s not actually necessary for those changes to be explicitly re-voted and affirmed by the county board of commissioners. However, there is at least some sentiment on the county board that the changes might be construed as substantive and contrary to the intent of the county board, which could become an unnecessary point of contention down the road.

The AATA is current finalizing the details of a five-year service plan that will need to be published as one of several conditions that must be met before the AATA could transition into the newly incorporated authority, to be called The Washtenaw Ride. This week, the AATA board called a special meeting for Sept. 5 to unveil that service plan.

Earlier in the year, the AATA had hoped to be in a position to possibly place a transit millage proposal on the ballot this November. But at this point, that won’t be possible. Any transit millage proposal will come at a later election.

County Board OKs Amended Transit Deal

Taking another step in a months-long process to secure the foundation for a broader public transit authority, Washtenaw County commissioners on a 6-4 vote gave final approval to a four-party agreement and articles of incorporation for a new entity tentatively called the Washtenaw Ride Transportation Authority. The vote was taken at the board’s Aug. 1, 2012 meeting, following a public hearing on the proposal. Eleven people spoke at the hearing, most of them in support of expanded public transit. Voting against the agreement and articles of incorporation were Alicia Ping, Wes Prater, Dan Smith and Rob Turner. Rolland Sizemore Jr. was absent.

AATA Grapples With Health Care Issue

However, the longest and most vigorous discussion took place on an item not actually on the published agenda: compliance by the AATA with Michigan’s Public Act 152, signed into law in September 2011, which limits employer health care contributions to a fixed dollar amount. At their July 16 meeting, board members took no further action on the issue, letting the vote taken at their previous meeting on June 21, 2012 stand – for now. An additional special meeting might be called sometime in the next week.

The board’s discussion of new information, obtained from the Michigan attorney general’s office, as well as additional analysis of Act 152, suggested a kind of vindication for the position of two dissenters – Charles Griffith and Roger Kerson – in the board’s June 21 action.

That action had been to limit the AATA’s contributions to no more than 80% of the non-union employee health care cost. Adopting the 80% limit is another way for a public entity to comply with Act 152. And the board had voted on June 21 to do that for its non-union employees – because open enrollment was fast approaching for those employees.

As part of that compliance decision, AATA put together a new health care option, which would allow its non-union employees to choose a health care option that would cost them the same as before – but increase their co-pays. And by the time of the July 16 meeting, employees were participating in the open enrollment process, using the boardroom for that activity.

So the board met in a smaller workroom to handle its business for the July 16 special meeting.

That business included a $60,000 increase in the contract with Steer Davies Gleave, the international consulting firm the AATA hired to assist with the development of its transit master plan. The work has included identifying new service options and financial analysis for AATA’s initiative to expand its governance and service area countywide. With this and other previous increases, the value of the contract now totals $780,622, from a deal first signed in April 2010 for just under $400,000. Some of the additional $60,000 will essentially be passed through to a local consulting firm, Carlisle Wortman Associates.

In other business, the board struck a task-order style deal for marketing and advertising with Quack! Media and Pace & Partners Inc. – a three-year arrangement that could be extended for another two years. The $500,000 total authorized by the board works out to $100,000 a year.

The board also authorized an increase in the contract it has with Blue Cab to provide its NightRide service, which operates after the hours when fixed-route service stops running. The increase is from $28 to $32 per service hour for a contract that extends through 2013. Of the $4 increase, $3 is attributed to the AATA’s relatively new living wage policy.

In a final piece of business, the board authorized a $104,000 contract with RBV Contracting to relocate a fire hydrant as part of AATA’s bus garage expansion project. [Full Story]

AATA Increases NightRide Contract

At a special meeting held on July 16, 2012, the Ann Arbor Transportation Authority board authorized an increase in its contract with Blue Cab, which the AATA contracts with to operate its NightRide service. The increase is from $28 to $32 per service hour for a contract that extends through 2013.

The NightRide is a shared cab service with a basic fare of $5, which is available weekdays from 11 p.m. to 6 a.m. and weekends from 7 p.m. to 7 a.m. Those are hours when the AATA’s regular fixed-route service does not operate.
