I suppose they could argue whether you were a “newspaper published in the state” according to the terms of the statute; I asked for a fee waiver based on the publication of my blog, we’ll see if I get accepted or rejected.

It’s section (2), not section (1) that’s applicable, with the key phrase being “free of charge.”
