Heritage Row Proposal Withdrawn

According to a city council source, developer Jeff Helminski has withdrawn the revised proposal for Heritage Row, a planned unit development on South Fifth Avenue. A different project, City Place, is now expected to be built on the same site by the same developer, though some possibility exists to contest the City Place project via the city’s zoning board of appeals.

The plan for the matter-of-right City Place would demolish seven houses and construct two apartment buildings separated by a parking lot. The two City Place buildings would comprise 144 bedrooms in 24 6-bedroom units. By contrast, Heritage Row would have constructed three buildings behind the row of seven houses and either rehabilitated or reconstructed the seven houses. That project would have included up to 85 units with 180 bedrooms. [Full Story]

Despite Concerns, The Varsity Moves Ahead

Changes to a University Bank site plan for property at 2015 Washtenaw Ave., known as the Hoover Mansion, were approved unanimously, despite some concerns voiced by neighbors during a public hearing on the proposal. The changes – which primarily relate to creation of a new parking lot – required amending the supplemental regulations of the site’s planned unit development (PUD) zoning district originally approved in 1978.

Also back for review was The Varsity, a proposed “planned project” consisting of a 13-story apartment building with 181 units at 425 E. Washington, between 411 Lofts and the First Baptist Church. Intended for students, it’s the first project to go through the city’s new design review process. Only minor changes had been made since the proposal was first considered at the planning commission’s Sept. 20 meeting.

Fourteen people spoke during a public hearing on The Varsity, including several residents of the nearby Sloan Plaza who raised concerns about traffic at the Huron Street entrance, as well as aesthetic issues with the building’s facade facing Huron. The project was supported by a paster pastor at the First Baptist Church and the head of the State Street merchant association.

In addition to public hearings held on these two projects, one person spoke during public commentary at the start of the meeting. Rick Stepanovic told commissioners that he’s a University of Michigan student, and that Wendy Rampson – head of the city’s planning staff – had spoken to one of his classes last year. Among other things, she’d mentioned the city’s need for more student input, he said. Since then he’s been elected to the Michigan Student Assembly, and was offering to provide that input, either as a resident – he lives in the neighborhood near Packard and Hill – or by taking an issue back to MSA for broader student feedback.

Stepanovic indicated his intent to attend future planning commission meetings, but noted that MSA meetings are held at the same time – on Tuesday evenings. [Full Story]

Planning Commission OKs Varsity Site Plan

Two weeks after the Ann Arbor planning commission postponed action on a site plan for The Varsity at Ann Arbor, the same group recommended approval at its Oct. 4, 2011 meeting. The city’s planning staff previously had recommended postponement to give the developer – Potomac Holdings of Bethesda, Maryland – more time to address several outstanding issues, which were described as minor. The project will now be forwarded to the city council for its consideration.

The Varsity Prompts Design, Traffic Concerns

The Varsity is a 13-story apartment building proposed for 425 E. Washington St., east of the 411 Lofts building and west of the First Baptist Church. Currently on the site is a two-story office building that formerly housed the Prescription Shop. The proposed 177,180-square-foot apartment building would include 181 apartments with a total of 415 bedrooms, to be marketed to university students.

Four residents spoke during a public hearing on the project, and were generally supportive. However, they cited concerns over the attractiveness of the facade facing Huron Street and traffic issues that might arise from that entrance. Some commissioners also raised issues about parking and design, and wondered about the possibility of retail space on the first floor. The developer’s representatives felt retail wasn’t feasible at this time.

City planning staff recommended that site plan approval be postponed, so that some relatively minor issues could be resolved. Commissioners followed that advice, and postponed action on the project. It’s expected to be on the agenda again for the commission’s Oct. 4 meeting.

In addition to The Varsity, Tuesday’s meeting included several communications from staff and commissioners. Wendy Rampson, head of the city’s planning staff, reported that a Sept. 21 meeting of the R4C/R2A advisory committee had been postponed and will be rescheduled. City planning staff had heard from several committee members who felt they needed more information before reconvening. The advisory group is developing recommendations for zoning changes in Ann Arbor’s near-downtown residential neighborhoods.

Tony Derezinski, a commissioner who also serves on city council, reported on planning-related items that emerged at the council’s Sept. 19 meeting. He noted that although it wasn’t on the council’s agenda or discussed publicly, the issue of the City Place apartment complex, which is poised to break ground in the coming weeks, was “quietly being discussed” among councilmembers, he said. While it looks like the project will move forward and that an alternative project on that site called Heritage Row won’t be realized, Derezinski said – somewhat cryptically – there’s “many a slip twixt the cup and the lip.”  [Full Story]

Action Postponed on The Varsity Site Plan

Column: Tax Capture Is a Varsity Sport

On July 7, 2011 at the Michigan League on the University of Michigan campus, representatives of “The Varsity at Ann Arbor” hosted a gathering of citizens to introduce them to the planned 13-story building. The project is proposed for Washington Street, between the 411 Lofts building and the First Baptist Church, and will be purpose-built to house 418 students in 173 rental units.

To me, the highlight of that meeting had nothing to do with the site plan or the building design – which has evolved somewhat since The Varsity’s review on June 22 by the city’s newly created design review board.

Instead, I think the most exciting play of the citizen participation game was a kind of Hail Mary forward pass flung down the field by John Floyd, a former candidate for city council. The ball was snagged out of the air, just before it hit the turf, by Tom Heywood, executive director of the State Street Area Association.

I don’t think Floyd and Heywood play for the same team – nobody was wearing numbered jerseys at the meeting – so that might count as an interception, not a completed forward pass.

Floyd’s Hail Mary was this question: What is the benefit to Ann Arbor’s bottom line, if the new taxable value from The Varsity is subject to “capture” through the Ann Arbor Downtown Development Authority’s TIF district? [Full Story]

Downtown Planning Poised to … Pause

The July 13 partnerships committee meeting of the Ann Arbor Downtown Development Authority drew an audience of around 35 people, many of them prominent community members.

Based on the committee’s May and June meetings, many in the audience expected the committee to come up with some kind of recommendation for a public engagement process that would ultimately lead to alternate uses of some downtown city-owned parcels. The parcels currently serve as part of the public parking system. The context of the DDA’s planning for the public engagement effort is a city council resolution, approved on April 4, 2011, that outlined a detailed plan for the DDA to lead the process.

The so-called parcel-by-parcel plan emerged in late 2010 as part of “mutually beneficial” committee meetings that handled negotiations lasting over a year between the city of Ann Arbor and the DDA on a new parking contract. Under the new contract, which the two bodies finally ratified in May 2011, the DDA will continue to operate the city’s public parking system for the next 11 years.

The city council’s approval of the parcel-by-parcel plan in April and DDA partnerships committee meetings in May and June – the three months prior to Wednesday’s meeting – had provided some momentum towards translating the city council resolution into an actual timeline with action steps.

In fact, two attendees of Wednesday’s meeting had pitched their professional services to the DDA to lead that public engagement process, with events tied to tentative calendar dates. Doug Kelbaugh, former dean of the University of Michigan’s college of architecture and urban planning, and Kit McCullough, a lecturer at the college, had provided a detailed timeline of meetings they could host during the fall, with delivery of a concept plan in January 2012, which could then be used to craft requests for proposals from developers.

If the process would not be led by Kelbaugh and McCullough, the committee was expected by many in attendance at its Wednesday meeting to chart some other path forward. But that’s not where the conversation led. DDA board member John Mouat described it as a “far-reaching, vague conversation,” which he had expected it would be. At one point, committee members even expressed uncertainty about whether the DDA or the city council would lead the process.

Typically, DDA executive director Susan Pollay gleans specific direction from the vaguest of conversations by her board’s committees. But when asked by Mouat at the conclusion of the meeting if she had clear direction, Pollay allowed only that she felt like she had more direction than before the meeting.

Based on the conversation at the meeting, part of that direction is that some kind of timeline for the process – which committee members thought would take at least a year – should, if possible, be included in an October 2011 city council working session.

In a follow-up phone interview, Pollay told The Chronicle that having the October 2011 working session as a target for a proposed plan would allow the committee and the full board to use their meetings over the next two months to work on the content of that presentation to the council. Checking in with the council on the public process before settling on it, she said, was important to the board. [Full Story]

Ann Arbor DDA Continues Planning Prep

The parcels are currently used for parking – except for the Library Lot. It’s the construction site for an underground garage that, when completed, will offer around 640 parking spaces. The structure is engineered to bear the weight of a building on top of it that’s as tall as 180 feet.

The main event of the June partnerships meeting was a formal proposal to lead a public engagement process that would take place starting this fall. The proposal came from Doug Kelbaugh, former dean of the University of Michigan’s college of architecture and urban planning, and Kit McCullough, who teaches at the college.

The two had attended the May partnerships meeting and given a more conversational, informal version of the proposal. As laid out by Kelbaugh and McCullough this month, the process would include three phases: (1) a data gathering phase; (2) a public meeting phase – one in October to solicit input, and one in November to present two or three concepts for the public’s response; and (3) a presentational phase – in January 2012, they’d consolidate feedback into a final concept plan, which would describe massing, ground floor uses, public/civic uses and pre-schematic site design.

Before Kelbaugh and McCullough presented their proposal, the conversation among committee members and other attendees ranged across several topics – the nature of suburban versus urban, the conceptual compared to the real, and the contrast between consensus and unanimity. The attendees, both at the table and in the audience, were a formidable group. They included local developer Peter Allen, who with his brother Lane presented a more elaborate version of the “four corners” concept that Allen had briefly sketched for the DDA board at their June 1 meeting. Those corners are the Allen Creek greenway (Ann Arbor downtown); the riverfront of the Huron River; the proposed Fuller Road Station near the University of Michigan’s medical complex; and the university’s central campus.

Also in attendance was Albert Berriz, CEO of McKinley Inc., a real estate development and property management firm. When asked for his advice, Berriz emphasized dealing with real people who had real capital and real ideas. He pointed to the McKinley Towne Centre renovation at Liberty and Division streets as an example of the kind of capital and commitment that’s required. Now eight years into that project, Berriz said, it’s really only just beginning. He anticipated it would take 20 years altogether to bring the project to full fruition.

Jesse Bernstein – chair of the Ann Arbor Transportation Authority board, and former head of the Ann Arbor Area Chamber of Commerce (now the Ypsilanti-Ann Arbor Regional Chamber) – drew on the AATA’s experience over the last year or more in transit master planning. That had included a significant investment in educating the public as well as the AATA board, he said, simply in terms of what transit options are available. He also stressed that for him, “consensus is a special word.” It’s not about unanimity, he said, but rather about what you can live with.

DDA board member Russ Collins, executive director of the Michigan Theater, revisited a theme he’s highlighted before at DDA board meetings over at least the last year: Suburban versus urban development. The U.S. has seen 70 years of investment in suburban development, he said, and part of the idea of a downtown development authority is to direct at least a trickle of reinvestment in the existing infrastructure of urban centers.

Collins summed up his view of a path forward, based on the morning’s discussion, by saying, “We need to facilitate, educate and get real.” Susan Pollay, executive director of the DDA, suggested that the next partnerships meeting in July should be treated more like a retreat. The committee could settle in and figure out exactly how the DDA would meet the city council’s directive to facilitate a public engagement process to find alternate uses for downtown city-owned property. Regular Budget Maintenance for DDA

Ann Arbor Downtown Development Authority board meeting (June 1, 2011): At its regular monthly meeting, the DDA board performed the annual exercise of revising its budget to match actual expenditures for the fiscal year, which ends June 30. It was the only item on the agenda requiring a vote, which was unanimous. The DDA’s FY 2011 budget showed $23,038,310 in expenses against $19,111,321 in total income.

At Wednesday’s meeting, the board also recapped the previous night’s session of the Ann Arbor city council, which had been a continuation of the meeting that began on May 16. At that meeting, the council had finally ratified its side of a new contract under which the DDA would continue to manage the city’s public parking system.

Key elements of that contract include a transfer to the city of Ann Arbor of 17% of annual gross parking revenues, reporting requirements by the city to the DDA about parking enforcement and street repair, and the ability of the DDA to set parking rates and hours without a city council veto.

The DDA board will likely schedule an extended board meeting in September to prepare for a contractually-required joint working session with the city council, which will include a discussion of parking rates and hours of enforcement.

Included in the usual range of the DDA’s reports from its committees was a review of a recent partnerships committee meeting, when DDA board members began to consider how they would handle the responsibility to plan future uses of city-owned surface parking lots downtown. The parcels are currently used as surface parking lots – except for the Library Lot, which is the construction site for an underground parking garage that, when completed, will offer around 640 parking spaces. It was previously a 192-space surface parking lot.

The committee meeting included a presentation on the city’s sewer system from Cresson Slotten, a manager with the city of Ann Arbor’s systems planning unit.  The agenda also included a conversation with Doug Kelbaugh, former dean of the University of Michigan’s college of architecture and urban planning, and Kit McCullough, who teaches at the school. The two are interested in helping facilitate the public process stipulated in the city council parcel-by-parcel resolution. Also interested in sharing information he’s gathering from downtown property owners is Peter Allen, a local developer who attended the partnerships meeting.

One major theme that emerged during the committee’s discussion is the idea that a public space can be successful if it is programmed, used and supported by the community, even if its design is lacking.

The parcel-by-parcel resolution was passed at the same meeting that the council voted to terminate the review process for proposals the city had solicited for use of the top of the underground parking structure.

The termination of that RFP review process came just before the council was supposed to consider formally signing a letter of intent to hammer out a development agreement for the finalist project – a hotel/conference center proposed by Valiant Partners. Balancing Ann Arbor, Detroit – and a Vision

“I don’t want to be another city. I resent the fact that we are compared to other cities when projects are being proposed.”

That was Ali Ramlawi, owner of the Jerusalem Garden on South Fifth Avenue in downtown Ann Arbor, addressing the April 4, 2011 meeting of the Ann Arbor city council. He was criticizing the Ann Arbor Downtown Development Authority, and advocating against a proposed conference center and hotel project on the Library Lot – the council voted the project down later that evening.

“Ann Arbor will change … but it won’t become Detroit.”

That was Dante Chinni, while riding the the teeter totter on my front porch last Thursday afternoon. Chinni has made it part of his job to compare communities like Ann Arbor – Washtenaw County, actually – to other places in the country.

Who is Dante Chinni? And why should Ann Arbor care what he thinks?

On his website, Chinni describes himself as a “a card-carrying member of the East Coast Media Industrial Complex.” The part of his job that lets him compare one place to another – in a statistically sophisticated way – is a project Chinni conceived called Patchwork Nation. It’s funded by the Knight Foundation. The effort has already produced a book, which he co-authored with James Gimpel: “Our Patchwork Nation: The Surprising Truth about the ‘Real’ America.”

Washtenaw County is featured in the chapter that introduces readers to the concept of a “Campus and Careers” community type. The classification, as well as a read through Dante’s Talk, confirm that mostly what defines Ann Arbor – at least for people on the outside looking in – is its place as the home of the University of Michigan. And certainly for people on the inside, it’s difficult to argue that UM isn’t currently the single most important institution in the community.

But some insiders – and by this I mean not just people who live, work and play here, but actual Ann Arbor insiders – are starting to float the question of what else Ann Arbor might aspire to be besides home to “the most profound educational institution in the Midwest.” [Full Story]

Planning Commission OKs Design Review

One person, former planning commissioner Ethel Potts, spoke during a public hearing on the topic. Potts said she was glad the design review comes early in the project approval process, but she wondered how the review would be used – that could be a challenge. Commissioners discussed the issue only briefly before the vote.

In the city’s project approval process, the design review would take place before the mandatory citizen participation meeting, so that the design review board’s comments could be incorporated into the project’s design before it’s presented to citizens. However, developers aren’t required to act on the review board’s recommendations. Though the review process is mandatory, implementation of the board’s suggestions is voluntary. [Full Story]

Ann Arbor Council Focuses on Downtown

Councilmembers voted on two major downtown-related agenda items – one affecting the immediate future of an individual parcel, the city-owned Library Lot. The other item involves a process by which the Ann Arbor Downtown Development Authority would lead the planning of development for multiple downtown parcels, including the Library Lot.

The council voted, over dissent from two of its members, to end the RFP process for the Library Lot and to reject a draft letter of intent they’d discussed at a March 14 work session, which would have called for the city to work with Valiant Partners to craft a development agreement for construction of a conference center and hotel on the lot. The Ann Arbor DDA is currently building a roughly 640-space underground parking garage on that parcel.

Based on a separate resolution passed by the council, the future use of the Library Lot could emerge from a process to be led by the DDA. The council required lengthy deliberations before narrowly approving an amendment that reduced the area of focus for the DDA-led process. The amendment limited the area to the square bounded by Ashley, Division, Liberty and William streets, which would include the Library Lot on South Fifth Avenue, the Kline Lot on Ashley, the old YMCA Lot at Fifth and William, and the Palio Lot at Main and William.

The resolution on the DDA-led process is part of a broader ongoing negotiation between the city and the DDA, related to the contract under which the DDA operates the city’s public parking system. That contract is being renegotiated, and since January, the city has not budged from its position that the DDA should pay the city a percentage-of-gross parking revenue of 16% in the contract’s first two years and 17.5% in years thereafter. It appears that the DDA board is gradually conceding to the city’s bargaining position. That will become clearer at the DDA board meeting on Wednesday, April 6.

The city’s negotiating position is based in part on the idea that the DDA is, as mayor John Hieftje has described it, “an arm of the city.” Hieftje’s view of the DDA as part of the city was further accentuated on Monday, when he announced at the end of the council’s meeting that he would be inviting the DDA to move its offices into newly-renovated space in the city hall building. The DDA currently leases space about a block south of city hall.

Also a part of Monday’s downtown-themed meeting was initial approval the council gave to a revision to the city’s ordinance on panhandling. That ordinance revision – which added some areas where panhandling is prohibited – will require a second reading and a public hearing in front of the council before it can be enacted.

An additional part of the downtown discussion came at the start of the council’s meeting, with a presentation on work being done to plan and study the 415 W. Washington parcel for future use as a center for artists and as a greenway park.

In non-downtown business, the council accepted a series of easements that will set the stage for TIGER II grant funds – already awarded by the federal government – to be formally obligated to the city. At stake is $13.1 million, which is currently still part of a continuing resolution for the federal budget. But that continuing resolution expires April 8, so the council was acting with some urgency.

The council also gave necessary approvals for a bus pullout to be constructed on Washtenaw Avenue, and authorized emergency purchase orders for furniture. And the council heard a presentation from Andrew Brix, the city’s energy programs manager, about efforts to increase the percentage of renewable energy that the city uses. [Full Story]

Packard Square, Fraternity Site Plans OK’d

Despite concerns raised by some commissioners, as well as residents who spoke during a public hearing, the planning commission ultimately voted to recommend approval of the site plan and development agreement for Packard Square, a complex off of Packard Street. The plan calls for 230 apartments and 23,790-square-feet of retail space in a single building.

The commission also recommended approval of two other site plans: (1) at 630 Oxford, between South University and Hill, where the University of Michigan chapter of Phi Kappa Psi plans to convert a rental duplex  into a fraternity house for up to 24 occupants; and (2) at 215 N. Fifth, where owners want to tear down the former Bessenberg Bindery building and construct a two-story, single-family house.

Work Session Called on Conference Center

On Tuesday, March 8, 2011, a committee appointed by the Ann Arbor city council and charged with reviewing proposals for future use of the Library Lot – the top of the Fifth Avenue underground parking structure – met for the first time since November. The expected result of Tuesday’s meeting had been that the committee would move a proposed hotel/conference center project forward to the city council.

And that’s what the committee voted to do – specifically, to recommend to the city council that a letter of intent (LOI) be signed with Valiant, the developer, which could eventually lead to a development agreement. The city council will receive a presentation on the letter of intent at a work session on Monday, March 14 at 7 p.m. at the Washtenaw County Board room at 220 N. Main St.

In the draft of the LOI unveiled at Tuesday’s committee meeting, the city and Valiant would try to strike a development agreement no later than four months after the signing of the LOI, with construction to start 15 months after the signing of the development agreement.

Attending the committee meeting on Tuesday was David Di Rita of The Roxbury Group, which has served as a consultant to the committee. In November, Di Rita had delivered a report to the committee recommending Valiant’s proposal over a similar project proposed by another developer – Acquest.

The majority of Tuesday’s meeting time was taken up with Di Rita delivering introductory remarks – a self-described “soliloquy” – and walking the committee through the main points of the draft LOI, or responding to committee member questions.

In his introductory remarks, Di Rita distinguished between the idea of analyzing the financial viability of a specific proposal – which he stressed that The Roxbury Group had not done – and the overall economic validity of a concept.

Key points in the draft LOI are the idea that Valiant would pay for the acquisition of development rights on the property, but could use part of that payment for the design and financing of the conference center. The city of Ann Arbor would own the conference center, and would not be held liable for its maintenance and operation costs, unless Valiant were to cease holding the management agreement. The city’s ownership could, according to the draft LOI, possibly implicate payments by Valiant to the city in lieu of taxes. The draft LOI also calls for reserving no fewer than 350 daytime parking spaces in the underground parking garage, currently under construction, for the hotel/conference center.

In addition to committee members, more than 20 people attended the meeting, filling the fourth floor conference room of city hall. Attendees in the audience included Ward 1 councilmember Sabra Briere; Ann Arbor District Library director Josie Parker; and AADL board member Nancy Kaplan. Several people who attended have expressed objections to the hotel/conference center project, based on either the substance of the proposal itself or the decision-making process.

Related to complaints about the decision process, the meeting began with an adamant request from local attorney Tom Wieder to be allowed to address the committee, which was denied by the committee’s chair, Stephen Rapundalo. [Full Story]

Marijuana Issue Lingers; DDA-City Deal Stalls

After amending the licensing proposal heavily at its Jan. 3, 2011 meeting, the council had decided to postpone the measure until Tuesday’s meeting. After a relatively brief attempt to undertake further amendments, the council decided to postpone consideration again – until its Feb. 7, 2011 meeting. They also voted to extend the moratorium on opening additional marijuana dispensaries and cultivation facilities through March 31, 2011.

Not relatively brief were Christopher Taylor’s (Ward 3) opening remarks about a resolution that would have authorized the Ann Arbor Downtown Development Authority to design a plan to develop city-owned downtown parking lots.

In the end, the council decided to postpone consideration of the DDA parcel-by-parcel proposal – on a 6-4 vote, with some of those voting against postponement looking to vote it down. The effect of the postponement was likely similar to what outright rejection would have been. The clear message was this: Substantial revision to the proposal would be required to gain the kind of overwhelming support the measure will likely need to persuade DDA board members that the council is in agreement with the proposal.

Another piece of major business, which passed quietly, was approval of an overhaul of the ordinance language defining the city’s retirement system. An additional tax abatement for Edwards Brothers received a lot of discussion, but was ultimately approved.

The city also accepted a grant from the Home Depot Foundation for sustainability work, that earned praise for the city’s environmental coordinator, Matt Naud. In other city environmental action, David Stead was reappointed to the city’s environmental commission, and Steve Bean’s decision was announced that he had not sought reappointment to that commission, after a long tenure.

Th site plan for Lake Trust Credit Union at the southeast corner of West Liberty and West Stadium Boulevard was approved. And two additional parcels were added to the land that is protected by the city’s greenbelt program.

As budget season looms, Stephen Rapundalo (Ward 2), who serves on both the city council’s budget committee and the labor and administration committee, gave a status update on the city’s negotiations with its unions. [Full Story]

Ann Arbor Council Delays DDA-led Plan

At its Jan. 18, 2011 meeting, the Ann Arbor city council delayed action on a resolution that would have authorized the city’s downtown development authority to create a parcel-by-parcel plan for the development of downtown city-owned surface parking lots. The postponement was accomplished on a 6-4 vote – Margie Teall (Ward 4) was absent. Voting against postponement were: Stephen Kunselman (Ward 3), Marcia Higgins (Ward 4), Stephen Rapundalo (Ward 2), and Sabra Briere (Ward 1). Kunselman, Higgins, and Rapundalo were clear that they were prepared to vote against the resolution, if the motion to postpone had not passed.

At its Jan. 5 board meeting, the Ann Arbor DDA had passed a resolution urging passage of the council resolution, which had been circulated as early as the city council’s Dec. 20, 2010 meeting, when Christopher Taylor (Ward 3) attached a copy of the the draft resolution to the council’s meeting agenda, and alerted his council colleagues to it at that meeting.

Heritage Row Redux: Again

Based on its Dec. 6, 2010 agenda, on that evening the Ann Arbor city council will begin a multiple-meeting reconsideration of the Heritage Row proposal from Alex de Parry. The Heritage Row project was previously presented to the city council as a residential project for South Fifth Avenue that would renovate seven houses and construct three new 3.5-story apartment buildings behind those houses, with an underground parking garage and a maximum 82 apartments, with no more than 163 bedrooms.

The proposal to be reconsidered includes the following revisions: (1) The top floor the new south building would be removed from the design; (2) The density is reduced from 79 units to 76 units and the number of bedrooms is reduced from 154 to 147; (3) The project will include five affordable units at the 50% AMI (average median income) level, in addition to six affordable units at the 80% AMI level; and (4) The three new buildings will be LEED certified [.pdf of current proposal] Except for the removal of a top floor from one of the newly designed buildings, de Parry had in principle indicated agreement with the other revisions at a Sunday evening council caucus on Sept. 19. DDA: Dogged Enough for Development?

At a three-hour retreat Wednesday morning, the Ann Arbor Downtown Development Authority board met to discuss ongoing negotiations about the city-DDA parking agreement. The DDA manages the city’s parking system under an agreement last amended in 2005, which provides for a total payment of $10 million in rent through 2015. This May, the DDA agreed to make an additional $2 million not required by that contract.

Wednesday morning’s retreat was meant to focus on the role of the DDA in future development of the downtown area and the role of the DDA in parking enforcement.

The outcome of the retreat was essentially that the DDA is interested in cleaning up various aspects of the parking agreement language, but not in pursuing a role for the DDA in the enforcement of parking regulations. Further, greater support was expressed for the DDA as a facilitator of process, rather than as a driver of development through land acquisition and sale. [Full Story]

DDA-City Development Ideas

On Monday morning, the respective “mutually beneficial” committees (MBCs) of the city council and the Ann Arbor Downtown Development Authority continued their work on renegotiating the parking agreement under which the DDA manages the city’s parking system.

The discussion provided some clarity about what’s feasible with respect to the DDA’s role in enforcing parking regulations. And though parking enforcement appeared ready to slide completely off the table at the last committee meeting due to practical concerns, it appears now that the issue could be back in play, at least from the perspective of technical feasibility.

Concerns of Main Street merchants were also aired at the meeting, with Maura Thomson, executive director of the Main Street Area Association, addressing the two committees to suggest that any additional payment by the DDA to the city be partially earmarked for downtown public safety – that is, downtown police patrols.

But the highlight of the meeting was a more fleshed-out version of an outline that DDA executive director Susan Pollay provided, which describes a process by which the DDA would lead the community in comprehensive site-planning for the downtown’s city-owned surface parking lots, based on work that’s been done over the last half-decade – including the Calthorpe process, the A2D2 rezoning process, and the downtown plan.

DDA board member Russ Collins wanted to know if the process addressed any specifics regarding payments from the DDA to the city. Pollay responded to Collins by acknowledging that DDA board member Newcombe Clark – who does not serve on the DDA’s MBC – was keen to see the DDA purchase land from the city as part of the process. She indicated that would be a topic addressed by the DDA at its retreat, scheduled for Sept. 22.

However, the focus for Monday morning’s meeting, said Pollay, was not on the idea of land purchases, but rather on a comprehensive site-planning process: If the process feels like it resonates, she said, then the discussion could move on later to include land purchases. City councilmember Carsten Hohnke then zeroed in on a crucial question: “How do we come to a conclusion it’s resonating?” [Full Story]

Seniors Host Ann Arbor Mayoral Forum

In his introductory remarks, Bill Kinley joked that this was the first mayoral debate – and possibly the last ever – held at University Commons, a condominium community for people over 55 that was founded by University of Michigan faculty. They’d have to see how it turned out, he said.

Bill Kinley moderated a mayoral debate at University Commons on Monday between incumbent John Hieftje and challenger Patricia Lesko.

Kinley, a University Commons resident and local developer, moderated Monday’s event, which drew about 50 people to listen as incumbent mayor John Hieftje and challenger Patricia Lesko answered questions for an hour on a range of topics, from Argo Dam and Fuller Road Station to the city budget and possible income tax.

It’s the latest in a series of exchanges between the two candidates, as the Democrats head into next week’s Aug. 3 primary election. [See Chronicle coverage: "Ann Arbor Forums: The More, The Mayor-ier" and "Ann Arbor Dems Primary: Mayoral Race."]

After introducing the candidates, Kinley cautioned that the residents there are “a group of wordy people.” They know that “platform” and “platitude” derive from the French word “plat,” he said, “so if you can keep platitudes to a minimum, you’ll find the reception here is much more responsive.”

Each candidate was given two minutes to answer the question. The first person who answered was also given the option of an additional one minute response. Questions had been developed by Kinley and the program committee for University Commons. [Full Story]

The Constitution of Historic Districts

At a recent forum hosted by the Ann Arbor city Democratic party for candidates of the 52nd and 53rd District state House races, the topic of the state’s constitution arose in the form of an audience question. Did the candidates favor holding a convention to rework the state’s document of basic law?

The state’s constitution also came up in a recent letter conveyed to the city of Ann Arbor by an attorney for Alex de Parry, the developer of a proposed project called Heritage Row along Fifth Avenue south of William Street. The project was voted down at the Ann Arbor city council’s June 21 meeting on a 7-4 vote in favor, thus failing to meet the eight-vote majority required. [Chronicle coverage of that meeting is forthcoming.]

The main focus of the letter, sent to the city by de Parry’s legal counsel the same day as the council met to vote on Heritage Row, is not that project per se, but rather the historic district that the council may decide to establish at its next meeting on July 6. The recommended historic district, which includes the parcels that were to be used to build Heritage Row, received its initial consideration by the council at their June 21 meeting.

While its more customary for councilmembers to vote for a proposal at its first reading, even if they’re against it, three councilmembers at the June 21 meeting chose to oppose the establishment of the district already at its first reading. Tony Derezinski (Ward 2), Stephen Rapundalo (Ward 2) and Marcia Higgins (Ward 2 Ward 4) all voted against the historic district.

None of the three cited the specific issues raised in the letter from de Parry’s legal counsel as reasons for voting against the district – Derezinski had voted at the council’s Aug. 6, 2009 meeting against establishing a committee to study the question. And Rapundalo had supported a postponement of that vote.

But for the final vote on July 6, the points raised in the letter from de Parry’s legal counsel may well factor explicitly into the council’s deliberations. The legal reasoning in the letter leads to the conclusion that the way local historic districts are set up in Michigan potentially violates the state’s constitution. And if the reasoning in the letter stands legal scrutiny, it could change the way any future historic districts in the state of Michigan are established. [Full Story]

Moving Ahead on Zaragon Place 2

Ann Arbor Planning Commission meeting (June 15, 2010): With only minor suggestions from planning commissioners, the 14-story Zaragon Place 2 apartment complex was unanimously approved by the commission, and will next be considered by the city council, likely at one of their August meetings.

The project – to be located at the southeast corner of William and Thompson, next to Cottage Inn restaurant – drew support from two representatives of neighboring businesses, who said they were eager for new residents to arrive as potential customers. The site has been vacant and considered blighted for more than a decade.

Unlike recent proposals for two other residential developments – Heritage Row and The Moravian – Zaragon Place 2 does not require special zoning and has not faced opposition from neighborhood groups.

Some of the discussion by commissioners centered on the 40 parking spaces to be provided within the structure, as well as 40 spaces for bikes in a secured storage room. The ground level will include retail space fronting William. Also as part of the project, the city’s parks unit is asking the developer for $48,000 to help pay for new parks in the area, or to enhance existing parks.

In other business, the commission approved a special exemption use for Big Shot Fireworks to set up a tent in front of the Quarter Bistro, in the Westgate Shopping Center. Commissioners were schooled in fireworks-related legislation – anything that spins, explodes or leaves the ground can’t be sold in Michigan to the general public.

And a rezoning of a previously unzoned parcel on Jackson Avenue – site of the former Barnard Plating factory, next to Hillside Terrace Retirement Center – passed without discussion.

Finally, the commission discussed and passed a resolution that more formally outlines their plan to work with the city’s environmental and energy commissions toward the goal of building a sustainable Ann Arbor. It’s the outgrowth of a joint meeting the three commissions held in April, and was characterized by planning commission chair Bonnie Bona as the beginning of a community conversation about sustainability. Parking Deal Talks Open Between City, DDA

Almost a year ago, the city council appointed members to a committee that was to talk with a corresponding committee of the Ann Arbor Downtown Development Authority board about amending the contract under which the DDA manages the city’s parking system.

The two groups are known as the “mutually beneficial” committees, reflecting the language of a January 2009 city council resolution that called upon the DDA to begin a conversation about revising the parking contract in a “mutually beneficial” way.

On Monday morning, for the first time in public view, members of the DDA board and the city council met to discuss the contract.

The basis of these further discussions was a term sheet that had been produced in late April by some members of the city council and the DDA working outside of either body’s committee structure.

That term sheet had been the good faith basis on which the DDA board, on a 7-4 vote in May, voted to amend the parking contract. That unilateral amendment amounted to a payment from the DDA to the city of an additional $2 million that had not been required under the existing contract.

The specific outcomes of Monday’s meeting between the two committees were: (i) staff for the DDA and the city would be asked to develop a list of policy points that would need to be addressed in order for the DDA to assume responsibility of enforcing parking rules, but not other codes; and (ii) the DDA would be asked to develop a detailed plan by Sept. 13, 2010 describing the role of the DDA in the development of city-owned surface parking lots within the DDA district.

The planned schedule for meetings between the two committees will be the second Monday morning of each month at 8:30 a.m. at the DDA offices on Fifth Avenue. Heritage Row Likely to Need Super-Majority

Councilmembers were also informed that a protest petition had been filed on Heritage Row Monday afternoon, which – once validated – would bump the requirement for approval from a simple six-vote majority to eight out of 11 council votes. Petition filers have calculated that they’ve collected signatures from 51% of adjoining property owners, weighted by land area. That exceeds the 20% required for a successful petition, but as of late Wednesday, the city had not completed its verification process for the signatures. [Update: Early Thursday afternoon, the city confirmed the 20% threshold had been met.]

In other business, the council approved increases in water and sewer rates and gave initial approval to changes in the city code language on the placement of recycling carts.

A wording change in the list of permissible uses for public land was also given initial approval, but not without discussion. Thematically related to land use was a presentation during the meeting’s concluding public commentary in response to a request for proposals (RFP) for the privatization of the city-owned Huron Hills golf course.

Also receiving discussion was an item pulled out of the consent agenda that authorized $75,000 for Ann Arbor SPARK, for economic development.

Criticism during public commentary on the appointment and nomination process used by the mayor to fill seats on boards and commissions stirred mayor John Hieftje to defend shielding individual members of those bodies from public demands.

Public commentary also elicited from Stephen Rapundalo (Ward 1) an update on the development of the Library Lot – he chairs the committee charged with overseeing the RFP process. [Full Story]

Ann Arbor DDA: Let’s Do Development

Friday morning before the Memorial Day weekend marked the first public meeting of the city council’s so-called “mutually beneficial” committee – first created and appointed back in July 2009.

And later in the afternoon, the board of the Ann Arbor Downtown Development Authority met for a retreat to give direction to its own “mutually beneficial” committee.

The two committees are charged with the task of redefining the agreement between the city and the DDA that allows the DDA to manage the city’s parking system.

From the city councilmembers’ perspective, the ball was in the DDA’s court. They were hoping that the DDA’s retreat later in the day would reduce the items on the term sheet that is supposed to underpin the city-DDA conversation.

At their retreat, the DDA board did eliminate an item on the term sheet – code enforcement, other than parking regulations, was not something for which they wanted to assume responsibility. The remaining three term sheet items – parking enforcement, provision of services, and development of city-owned property – stayed on the white board. The clearest consensus among board members seemed to be around the idea that the DDA should focus on development.

But a couple of additional items were added into the mix – issues related to Village Green’s City Apartments project. That project, located at First and Washington, has previously seen its site plan approval option to purchase extended through June 30, 2010. City council action would be required in the next month, if it’s to be extended again.

Downtown police beat patrols were also left on the board as an additional item of discussion.

At Friday’s retreat, the board heard the same message from Susan Pollay, the DDA’s executive director, that she’d conveyed at a partnerships committee meeting two weeks earlier – the reason for the DDA’s existence was to spur private investment in the downtown.

But as a group, there was an uneven embrace of that message. Some board members preferred to identify “development” as meaning something broader than building new infrastructure, suggesting that a more general “economic development” approach might also be appropriate for the DDA.

And one other idea was thrown up on the white board, but did not stick: altering the DDA district boundaries. [Full Story]

City Accepts $2 Million, DDA to “Retreat”

At its May 5 board meeting, the Ann Arbor Downtown Development Authority approved a $2 million payment to the city of Ann Arbor. And about two weeks later, at its May 17 meeting, the city council used the additional revenue in the city’s FY 2011 budget to help reduce the number of planned layoffs in its police and fire departments from 35 to 5.

The $2 million payment was based on a term sheet that a “working group” of councilmembers and DDA board members had put together out of public view over the first four months of the year. The term sheet was adequate to convince a 7-member majority of the 12-member DDA board that the $2 million should be paid by the DDA to the city in advance of a long-term revision to the city-DDA contract, under which the DDA manages the city’s parking system.

The parking contract was most recently renegotiated in 2005 and provided for a maximum payment by the DDA to the city of $10 million over the period from 2005 to 2015. The city drew $10 million in the first five years and had requested in January 2009 that the DDA open discussions to renegotiate the contract.

With the term sheet now out in the open, it’s clear that its content is problematic for councilmembers and DDA board members who were not part of the working group that produced it. Several councilmembers and DDA board members alike have expressed strong opposition to one of the key ideas in the term sheet – that the DDA would assume responsibility for parking violations and other code enforcement.

But based on the term sheet discussion at the May 12 meeting of  DDA’s partnerships committee, the piece of the term sheet of most interest to DDA board members is one that is also the most politically controversial: The DDA would be acknowledged as the engine for developing city-owned land in the DDA district.

The DDA partnerships committee conversation on May 12 came against the backdrop of recent questions raised by the mayor and the city council about what kind of legal authority a DDA has in the context of the city’s system of governance.

And the outcome of the partnerships committee meeting was a decision to hold another full board retreat, this one on May 28 at 2 p.m. at the DDA board room. The general topic of the retreat, which is open to the public, will be the term sheet. The DDA already held its semi-annual retreat about two months ago, on March 16. [Full Story]

UM Credit Union Eyes Former News Building

The University of Michigan Credit Union is real-estate shopping and is looking at the now-vacant Ann Arbor News building on the southwest corner of Huron and Division streets.

However, the three-story News building is only one of several properties being considered as a potential home for the credit union’s administrative offices, says Jeff Schillag, the institution’s vice president of marketing and community relations.

Not all the potential sites are downtown, Schillag says. And any acquired space would replace leased office space.

Opened in 1936, the Albert Kahn-designed News building was shuttered last July when Advance Publications closed the daily newspaper. [Full Story]

Zaragon, Heritage Row and The Moravian

Monday afternoon’s public forum for Zaragon Place 2 – a proposed 14-story apartment building at the southeast corner of Thompson and William, next to Cottage Inn – was held by the developer and his team to comply with the city’s citizen participation ordinance.

But among those attending the two-hour open house at the Michigan Union were developers for both The Moravian and Heritage Row – two residential projects that have been vigorously opposed by some residents in the city’s near-south side.

There are significant differences among the three projects, but some connections as well, especially among the project teams. And all are at different stages of the process: plans for Zaragon Place 2 haven’t yet been submitted to the city’s planning department, while Heritage Row has been recommended by the planning commission and is expected to come before the city council in May. Meanwhile, in a grueling April 5 city council meeting that lasted well past 1 a.m., The Moravian failed to get the eight votes it needed for approval. Nearly 90 people – both supporters and opponents – spoke during a 3.5-hour public commentary on the project.

Based on reactions at Monday’s open house for Zaragon Place 2, it seems unlikely this latest project will arouse similar passions. [Full Story]

Six-Vote Majority Leaves The Moravian Short

Ann Arbor City Council meeting (April 5, 2010) Part 1: In a six-to-four vote on Monday night, the Ann Arbor city council did not give The Moravian development the required 8-vote super-majority it needed for approval. A petition signed by greater than 20% of adjoining property owners meant that the project needed eight instead of the six votes it actually received to win the council’s endorsement.

The five-story, 62-unit building proposed for the section of East Madison Street between Fourth and Fifth avenues near downtown Ann Arbor had come before the council with the recommendation of the city’s planning staff and a 7-1 vote recommendation from the city’s planning commission.

The public hearing on The Moravian included remarks from around 90 people on both sides of the issue. The Moravian alone – counting the public hearing, plus the deliberations by the council – took up over four hours of the meeting, which lasted well past 1 a.m.

Besides The Moravian, the council’s business included an item that would have reconsidered its recent decision to replace the entire Ann Arbor housing commission board. The motion for reconsideration was voted down, with no support, not even from its two sponsors – Stephen Kunselman (Ward 3) and Mike Anglin (Ward 5). Kunselman cited the late hour as part of the reason for his lack of enthusiasm for pursuing the matter.

The council also tabled a proposed city ordinance that would ban cell phone use while driving. The council had postponed the measure to a specific date a few times previously. The tabling means that the ordinance can be brought back for consideration by the council, but by council rule it will die unless it is brought back within six months.

Also receiving brief discussion was a possible council rule on email that the council is now forced to  consider publicly at its next meeting under terms of a recent lawsuit settlement.
