Council Expresses Support for Greenway

At its Aug. 4, 2011 meeting, the Ann Arbor city council passed a resolution added late to the agenda, on Tuesday, Aug. 2, that expresses general support for the idea of constructing a greenway along the Allen Creek corridor.

The single “resolved” clause reads: “That the Ann Arbor City Council is fully supportive of the creation of the Allen Creek Greenway, and hereby directs City staff to continue to work with and to assist the Allen Creek Greenway Conservancy during the Greenway’s development and implementation phases.” [.pdf of Aug. 4 Greenway resolution]

The resolution comes as the possibility is becoming more real to construct the first section of the greenway close to the planned Near North housing project. On May 16, 2011, the city council approved neighborhood stabilization funds for the demolition of three houses as site preparation for the Near North project. Adjacent to the Near North site are additional houses that could be demolished and left as open space, which could become part of a greenway. But based on remarks made at the meeting by greenway advocates, it appears that the first segment to be constructed is most likely to be the portion running through 415 W. Washington.

During public commentary, the council heard that various key property owners like the University of Michigan and the Ann Arbor Railroad are interested in hearing a clear statement from the city expressing its commitment.

The 18 “whereas” clauses recite history dating back to 2005 when the city council appointed a task force to study the possibility of a greenway. The history recited by the resolution includes a measure approved by the council on July 6, 2009, which rezoned the First and William parcel as public land and set forth the council’s intention that the property (currently a parking lot) would eventually become part of a greenway. As a point of history, the July 6, 2009 meeting was the same meeting when the council authorized the start of a request for proposals (RFP) process for development of the city-owned Library Lot, which was eventually terminated  on April 4, 2011, without selection of a proposal.

Also included in the Aug. 4 resolution’s recitation of history is a Feb. 1, 2010 measure that started a process for re-developing the city-owned parcel at 415 W. Washington. The city had previously initiated an RFP process for 415 W. Washington. An RFP review committee met seven times from May to December 2008 to review and evaluate the three proposals the city had received. The RFP committee offered praise for all three proposals but did not designate any one of the three as preferred.

The committee punted the issue back to the city council, recommending that the council refine the RFP. The council’s Feb. 1, 2010 action did not follow that recommendation, and instead created a working group of city councilmembers, the Greenway Conservancy and the Arts Alliance to explore the re-use of the property.

Like the Aug. 4, 2011 resolution, the Feb. 1, 2010 measure was sponsored by mayor John Hieftje, Carsten Hohnke (Ward 5) and Margie Teall (Ward 4) and was also added late to the council’s agenda. The July 6, 2009 measure was sponsored by Hieftje and Hohnke.

After Resignation, Who Leads Mural Program?

Ann Arbor public art commission meeting (July 27, 2011): For the second month in a row, Ann Arbor’s public art commission had too few members to achieve a quorum and didn’t take any action at Wednesday’s meeting.  But commissioners discussed a range of projects already underway.

One issue: How to proceed with recommending a replacement for Jeff Meyers, who resigned from AAPAC in June, mid-way through his three-year term. The main concern among commissioners is who can take over leadership of a new mural program that Meyers had initiated. Margaret Parker indicated she’ll also be leaving the commission in the coming months, creating another vacancy on the nine-member commission.

The mayor, John Hieftje, is responsible for making nominations to AAPAC. Those nominations also require confirmation by the full city council. On Wednesday, AAPAC commissioners discussed the need for better communication with Hieftje, and said they hoped to find out what criteria he was using to make the selection – the most recent appointment Hieftje made to AAPAC was done without their input, after he rejected someone they’d recruited. Communication has also been lacking regarding Meyers’ resignation – in a phone interview with The Chronicle following AAPAC’s July meeting, Meyers said the mayor hasn’t acknowledged his resignation.

In other topics at Wednesday’s meeting, commissioners briefly discussed a written update they’d received about the Herbert Dreiseitl water sculpture being built for the entrance to the municipal center. Installation is still on track for next month.

Also in August – at city council’s Aug. 4 meeting – winners of the annual Golden Paintbrush awards will be honored. AAPAC selected the winners, who are recognized for their contributions to public art, via an online poll last month. This year, winners are: (1) Krazy Jim’s Blimpie Burger, for the Snow Bears sculptures they build each winter in front of their business at Packard and South Division; (2) Mary Thiefels and Treetown Murals for the mural outside the Alley Bar along West Liberty; and (3) Peter Allen & Associates, for rock sculptures on North Main Street. Ward Changes Paused, No Recycling Pay Hike

Ann Arbor city council meeting (July 5, 2011): Baked into the council’s post-Independence Day meeting was a fundamentally democratic theme: voting.

It began with public commentary on the topic of a proposed redrawing of the boundaries for the city’s five wards. The city charter requires the wards to be pie-shaped wedges. The redrawing of the lines themselves was not thought to be particularly controversial. But the timing of the redistricting stirred a representative of the American Civil Liberties Union to appear before the council to address councilmembers. Attorney John Shea, speaking for the ACLU, told them they shouldn’t enact boundary changes between the primary and the general elections. Ultimately, the council kneaded the advice into their thinking, and voted to postpone the whole question of redistricting.

The meeting ended with a voting snafu, when the council tried to convene a closed session to discuss land acquisition. So even though the vote was 6-3 in favor of entering into a closed session, a 2/3 majority of members present did not satisfy the statutory requirement of a 2/3 majority of the council’s 11 members. The vote was eventually recognized as only half-baked, and the council came out of their workroom, revoted 8-1 to re-enter the closed session, and completed the meeting without further complications.

Part of the meeting’s creamy dessert filling also depended on a somewhat infrequent parliamentary exercise that resulted in revoting an item that the council had approved two weeks earlier. That vote was on a contract for the reconstruction and relocation of water, sanitary sewer and stormwater lines in the vicinity of the proposed site for the Fuller Road Station. Mike Anglin (Ward 5) brought the resolution back for reconsideration, and council members voted unanimously to roll out the dough again by rediscussing and revoting the issue. The outcome was the same – it was approved – but Anglin registered his dissent this time by voting against it. He told his colleagues that when they’d voted two weeks ago, he had not realized that the project was related to the Fuller Road Station site.

Also part of the council’s meeting was a significant vote that received no discussion by the council. A proposal to voluntarily increase an already-approved contract with Recycle Ann Arbor was voted down 5-4, thus failing by one vote to achieve the six-vote majority it required.

The council also wrapped up a loose end from its previous approval of ordinances related to zoning and licensing of medical marijuana, by approving a non-disclosure policy. The policy ensures that private information of patients and caregivers is not divulged.

In an item added late to the agenda, councilmembers also approved a one-year contract with the city’s deputy police chiefs union.

In other business, the council set a new design review board fee at $500. It also approved three water-related projects: a porous pavement project in the Burns Park neighborhood, a rain garden on Kingsley Street, and a level-of-service study of the city’s water system.

The council also received a presentation from the director of the Ann Arbor District Library, Josie Parker. Highlights included data on the more than 600,000 annual visitors to the library’s downtown location. [Full Story]

Ann Arbor Cannabis Laws Done, For Now

Ann Arbor city council meeting (June 20, 2011): Two ordinances regulating medical marijuana businesses were finally approved by the council on Monday night, following more than a year of discussion in some form.

The first local law stipulates where medical marijuana businesses can be located in the city – it’s an addition to Ann Arbor’s zoning code. The second law establishes a licensing board for medical marijuana dispensaries and sets up an application process for the award of a maximum of 20 licenses to dispensaries in the first year of the program.

On Monday evening, the council undertook amendments to the licensing ordinance that were few compared to massive changes that have taken place at several council meetings dating back to January 2011. On Monday, the labeling requirements for marijuana packaging were changed so that dollar amounts are no longer required.

The council teetered on the edge of postponing the legislation, when city attorney Stephen Postema encouraged councilmembers to delay voting until the Michigan Court of Appeals issued an opinion on a case (Michigan v. McQueen) for which oral arguments were heard on June 7. Despite the support for postponement from mayor John Hieftje, an initial vote to postpone achieved only two other votes. A second vote achieved a total of five votes, leaving the postponement one vote short of the six-vote majority it required.

As some councilmembers observed that the council had invested a disproportionate amount of time on the medical marijuana legislation, Hieftje contended that it had not prevented the council from handling its other work.

On Monday, that other work included a collective bargaining agreement with its police service specialists union, which was an item added just that evening to the agenda. The council also heard public commentary critical of the recent budget approved on May 31 by the council, which includes the layoff of some firefighters and police officers. The meeting was preceded by a demonstration by the city’s public safety employees, at Fifth and Huron streets just outside city hall

The council  also approved two contracts in connection with the East Stadium Bridges replacement project and three purchase orders related to tree care. And the council gave final approval to sewer and water rate increases and a revision to its landscaping ordinance.

The council revised its debt/fund balance policy, and revised its budget to reflect the blending of its economic development fund back into the general fund. Also related to economic development, councilmembers approved the annual $75,000 funding for Ann Arbor SPARK and set a public hearing for a tax abatement for Picometrix.

The council established an affordable housing lien policy and gave initial approval to technical revisions to the city’s pension ordinance. They confirmed appointments to the new design review board, but postponed a vote on setting the design review fee. The council added a work session for July 11, which is likely to include an update on the planned Fuller Road Station.

Council OKs Affordable Housing Lien Policy

At its June 20, 2011 meeting, the Ann Arbor city council established a policy under which liens can be subordinated and city loans forgiven, in the interest of perserving affordable housing.

Key elements of the policy: at least one city or county lien will be maintained on the property; liens with federal affordability restrictions will be in the highest lien position possible; liens that do not have federal affordability restrictions will be discharged if needed to facilitate reinvestment of outside funding; the city administrator is authorized to approve lien subordinations and lien discharges.

The city council had discussed a specific case related to the forgiveness of loans and subordination of liens at its May 16, 2011 meeting. The context there was the appropriation of funds for the demolition of houses to prepare for construction of the Near North affordable housing project, located on the east side of North Main Street between Kingsley and Summit.

Ann Arbor Council Delays Budget Vote

But Monday, at its second meeting in May this year, the city council did not act, choosing instead to recess and continue the meeting the following week, on May 23. The decision to delay was prompted by uncertainty about revenue from the public parking system. The Ann Arbor Downtown Development Authority and the city were poised to ratify a new agreement on parking revenue on May 2, but that agreement was put off when questions were raised about the DDA tax increment finance (TIF) capture. The DDA later called a special meeting on Friday, May 20 to address that issue.

Even though the council did not act on the budget, most of the evening’s discussion was dominated by budget talk, including extensive public commentary on the proposed cuts in the police and fire departments. The council also got a briefing from its chief of police and interim fire chief, Barnett Jones, who responded to an article published in AnnArbor.com about fire department response times, calling the calculations presented in the piece inaccurate.

In addition to putting off action on the FY 2012 budget, the council also tabled decisions on human services funding, funding for a water system study, and fee increases for next year.

However, the council did transact some business. It authorized an increase in taxicab fares in light of rising gas prices. The council also approved neighborhood stabilization funds for demolition of three houses on North Main Street to prepare the site for construction of the Near North affordable housing project. Two large vehicle purchases – a street sweeper and a sewer truck – that had been postponed from the previous meeting were authorized.

The council also revised its administrative policy on how the 2006 parks millage is to be spent. Funds outside the general fund can count as general fund money for the purpose of the policy, as long as those funds are not drawn from the parks millage. The council also gave initial approval to an ordinance on design guidelines for new buildings downtown. [Full Story]

Demolition for Near North Project Prepped

At its May 16, 2011 meeting, the Ann Arbor city council approved an addition to its neighborhood stabilization program (NSP) budget and a corresponding expenditure to pay for the demolition of three houses as site preparation for the Near North affordable housing project on North Main.

The addition to the NSP budget came from a reimbursement. The owner of a house paid back NSP money to the city, previously expended to demolish the owner’s property. That reimbursement amounted to $24,135. NSP funds come originally from federal grants allocated through the Michigan State Housing Development Authority (MSHDA).

In addition, city staff identified an NSP homeowner acquisition and rehabilitation project that was completed under budget by $11,750. Combined, the additional revenue to the NSP budget and the savings on the rehabilitation project amount to $35,885. Of that amount, $33,292 will be used to pay for the demolition of 718, 722, and 724 N. Main St., with the remaining $2,593 going to administration costs in the office of community development. The money will be allocated to the nonprofit Avalon Housing, which is developing the Near North project with Three Oaks.

Council Delays Pot, Takes Shots at DDA

Ann Arbor city council meeting (April 19, 2011): The city council delayed a second and final vote on two local laws that involve regulation of medical marijuana businesses in the city – one on zoning and the other on licenses.

After public hearings on the two medical marijuana laws, the council did not deliberate long in deciding to postpone both votes until its next meeting, on May 2. Substantive amendments that had been presented to councilmembers late that day for consideration made them reluctant to attempt grappling with the amendments in detail. The May 2 vote on the two laws will likely count only as their initial approval, assuming the amendments are adopted at that meeting. The laws would then need an additional final reading after May 2 before they are enacted.

A tweak to the city’s panhandling ordinance was given its second and final approval at the April 19 meeting. That change to the existing ordinance had come as a recommendation from a task force that worked for six months on the issue, following up on a longer effort in the early 2000s that had led to adopting the language in the existing ordinance.

The longest deliberations of the night involved a resolution of instruction to the council’s “mutually beneficial” committee, which is currently negotiating a new contract under which the Ann Arbor Downtown Development Authority would continue to manage the city’s public parking system. The direction given to the committee was not to stay firm with its previous bargaining position, but rather to escalate the city’s expectations for revenues from the public parking system.

Previously, the city’s committee had taken the position that the city should receive 16% of gross parking revenues in the first two years of a 10-year contract, and 17.5% in remaining years. That compared with the DDA’s position that the city should receive a flat 16% across all years. But at the meeting, the council voted to direct its committee to take the position that the city should receive a flat 18%. The council’s deliberations included comments directed towards the DDA that could fairly be described as inflammatory.

Called to the podium to comment on the parking revenue figures and the DDA’s overall financial health was the city’s chief financial officer, Tom Crawford. Later in the meeting, Crawford was appointed interim city administrator, effective April 28. Current administrator Roger Fraser is leaving the post to take a job as a deputy treasurer for the state of Michigan.

Although councilmembers did not comment on it, Fraser was attending his last meeting of the council as city administrator. And in his final major act, he gave a formal presentation to the council of his proposed fiscal year 2012 budget, as required by the city charter. The charter stipulates that the council will need to amend and approve the budget by May 16, its second meeting that month. [Full Story]

Near North PUD Revisions OK’d

At its April 19, 2011 meeting, the Ann Arbor city council authorized revisions to the elevations of the Near North PUD affordable housing development on North Main Street. The city council originally approved rezoning for the project – a four-story, 39-unit mixed use residential building on a 1.19-acre site – on Sept. 21, 2009.

The changes include modification of the locations where the exterior materials – glazing, panelized exterior cladding materials, plus accent materials – will be used. Roof lines have also been proposed, but the building is still under the maximum height permitted. The changes, which were prompted by alterations to the interior layout of the building, were presented to the surrounding neighbors at a meeting on March 17, 2011.

Urban County Gets Grim Funding Update

Washtenaw Urban County executive committee meeting (Feb. 22, 2011): Leaders of local municipalities got a grim update on Tuesday about looming federal funding cuts that will likely affect projects in many of the county’s low-income neighborhoods.

“I am bringing you some troubling news,” said Mary Jo Callan, director of the Washtenaw County/city of Ann Arbor office of community development. “Do you want to start with the bad news, or the worst news?”

Callan reported that the two major programs that fund projects for low-income neighborhoods – the Community Development Block Grant and HOME Investment Partnership programs, both operated by the U.S. Dept. of Housing and Urban Development (HUD) – have been targeted by Congress and President Obama for significant cuts in both the current fiscal year and in 2012. Washtenaw County communities receive about $2.4 million annually from the CDBG program alone.

Though at this point it’s unclear exactly what the final federal budget will include, Callan said it’s nearly certain that some funding cuts will occur – her staff is planning for a 10% reduction in grants from those two programs for fiscal 2012. “It’s pretty bleak,” she said. [Full Story]

Urban County: Nonprofit Funding Update

Washtenaw Urban County executive committee meeting (Jan. 25, 2011): Urban County members – a group representing 11 municipalities in Washtenaw County – got an update on a new effort to coordinate the funding of local nonprofits.

Nonprofits are vying for funds from the city of Ann Arbor, Washtenaw County, the Urban County, and Washtenaw United Way. Nearly 60 nonprofits applied to the first phase of the process, in which they were asked to supply basic financial and governance documents. Of that group, 51 were qualified to respond to a request for proposals (RFP) that was issued Jan. 28.

It’s still unclear how much funding will be available, but it could be less than the nearly $5 million that was awarded from these groups last year. Budgets for Ann Arbor and the Urban County haven’t been finalized, and the 2011 county budget is facing about $1 million in as-yet-undetermined cuts.

At last week’s meeting, three members of the Urban County’s executive committee – Pittsfield Township deputy supervisor Barb Fuller, Ypsilanti mayor Paul Schreiber and Ann Arbor city councilmember Margie Teal – were appointed to review applications for the coordinated funding process. All governing boards of the four entities involved in this cycle’s funding will appoint members to a review committee. The fifth partner – the Ann Arbor Area Community Foundation – will fund capacity-building grants to nonprofits identified as needing help with internal operations, like infrastructure and staff development.

Also at last week’s meeting, Urban County members got an update on an annual plan being developed for the U.S. Dept. of Housing & Urban Development (HUD), which provides funding for low-income housing and neighborhood projects. The plan will include a list of proposed projects located within the Urban County area that would be eligible for HUD funding. To gather more input, a needs assessment public hearing is set for the Feb. 22 meetings of both the Ann Arbor city council and the Urban County.

Two people spoke during public commentary, both criticizing Avalon Housing for its handling of two low-income housing projects: 1500 Pauline, and Near North. The nonprofit was defended by Leah Gunn, who chairs the Urban County executive committee – she called Avalon one of the “stars of community development.” [Full Story]

Site Plan OK’d for Avalon Housing Project

Ann Arbor planning commission meeting (Jan. 20, 2011): After a public hearing that included comments by some residents of 1500 Pauline, planning commissioners unanimously approved the site plan for an affordable housing project at that location, proposed by the nonprofit Avalon Housing.

The project will include demolishing the existing structure and constructing five one- and two-story buildings and a community center. Though commissioners supported the project, some raised concerns over the relocation of current residents and the fact that the new complex, when completed, will have fewer units – 32, compared to the current 47 apartments. Of those, there will also be far fewer one-bedroom units – six, compared to the current 21.

Representatives from Avalon told commissioners that the lower number was sustainable – 35% of the units will be set aside for residents who’ll receive supportive services. They also said the location was more suited for families, and that there’s more need for two- and three-bedroom affordable housing units in the city.

Another project on the agenda – a site plan and special exception use for 630 Oxford – was postponed, as recommended by city planning staff. The Phi Kappa Psi fraternity wants to turn an existing rental duplex into their chapter’s permanent home, housing up to 24 residents. The housing director and some board members for the neighboring Delta Gamma sorority came to Thursday’s meeting to object to the plan, saying they did not want fraternity culture to disrupt their quiet neighborhood.

Commissioners also unanimously recommended approval of the annexation of 1575 Alexandra Blvd., a vacant 0.82-acre lot now in Ann Arbor Township. The lot is surrounded by the city’s Riverwood Nature Area – its owner plans to build a single-family home on the site.

Also at Thursday’s meeting, Wendy Rampson of the city’s planning staff reminded commissioners of a public meeting on Wednesday, Jan. 26 to get community feedback on draft recommendations for R4C and R2A residential zoning district ordinance revisions. The meeting runs from 6-8 p.m. at the lower level of the downtown Ann Arbor District Library, 343 S. Fifth Ave. [Full Story]

Developer Pitches Idea for Argo Art Walk

Ann Arbor public art commission meeting (Jan. 4, 2011): Marsha Chamberlin, as the commission’s acting chair, began Tuesday’s meeting by noting that many of the commissioners planned to attend a memorial gathering for Peter Pollack, a landscape architect and community activist who passed away last month. Because of that, she said, they would make the meeting as expeditious as possible – it lasted less than an hour.

Part of that time was spent hearing a proposal by local developer Peter Allen, who urged commissioners to consider creating some kind of art walk in the Argo Pond area, possibly installing sculptures and using Percent for Art funds from the recently approved millrace reconstruction project. Two city parks hug Argo Pond – Bandemer on the west and Argo on the east.

Allen cited the Michigan Legacy Art Park at the Crystal Mountain resort as an example of something that could be used as a model, and he offered to explore the possibility of seeking matching private funds for the project. [Full Story]

Ann Arbor Puts CIA Into First Gear

Ann Arbor City Council meeting (Dec. 20, 2010): The city council’s last meeting of the year included a somber piece of news, delivered by Marcia Higgins (Ward 4): Peter Pollack, familiar to many in the community as a landscape architect and stalwart public servant in various capacities, had entered hospice care. In its main business of the evening, the council approved a resolution of intent to coordinate with Pittsfield Charter Township, Ypsilanti Charter Township and the city of Ypsilanti to explore the establishment of a corridor improvement authority (CIA) along Washtenaw Avenue.

The initiative would take advantage of Michigan’s Corridor Improvement Authority Act to create a tax increment finance (TIF) district. A possible timeline for establishing the CIA would include public hearings in early 2011, formation of the CIA and appointment of its members in mid-2011, with development and approval of the corridor development plan by late 2011.

The vote on the resolution of intent came after intense scrutiny of the resolution’s wording to ensure that it conformed with the requirements of the state enabling statute, while also addressing councilmembers’ concerns that the language not inappropriately suggest that the establishment of the CIA was further along than it actually is.

Several members of the public addressed the council at the public hearing on the adoption of the Michigan Vehicle Code and the Uniform Traffic Code. The adoption of the two codes is motivated by the city’s desire to make its speed limits legally enforceable. As the extensive public commentary and council deliberations reflected, the challenge is to set speed limits in a way that is legally enforceable but has adequate consideration for non-motorized users of roadways.

The council voted to adopt the two codes, after having given initial approval at its Dec. 6, 2010 meeting. However, amendments to the language used to adopt the two codes made at Monday’s meeting were substantial enough that the proposed ordinance revision was reset to its first reading stage. All ordinances must be approved at a first and second reading before the council.

Attached as a communication to the council’s agenda was an item that will likely receive a great deal of discussion early next year – a draft of a city council resolution that would specify how the Ann Arbor Downtown Development Authority will go about facilitating development of downtown Ann Arbor surface parking lots. A key resolved clause of the draft resolution, apparently meant to address a historical point of friction between the city and the DDA, would require the city to reimburse the DDA for some of its expenses under certain scenarios.

Also at the meeting, in response to a report from the Environmental Working Group that the carcinogen hexavalent chromium had been detected in Ann Arbor’s drinking water – along with that of several other communities – city administrator Roger Fraser gave the city’s take on the study. Low-Income Housing Project Planned

Documents filed on Monday with the city of Ann Arbor’s planning staff show details of an affordable housing project at 1500 Pauline that includes tearing down the existing apartment buildings and rebuilding a combination of apartments, townhomes and a community center.

The project is being proposed by the Ann Arbor nonprofit Avalon Housing, though the property is still owned by the Washtenaw Affordable Housing Corp. Avalon took over operations of several WAHC properties, including 1500 Pauline, in 2009.

Also filing with the city on Monday was the Michigan Alpha Chapter of the Sigma Phi Epsilon fraternity, which is seeking a special exception use to transform the Memorial Christian Church building at the corner of Tappan and Hill into a fraternity house. [Full Story]

Urban County Finalizes Funding Model

Washtenaw Urban County executive committee meeting (Nov. 16, 2010): The final piece of a coordinated funding model that’s been in the works for more than a year fell into place on Tuesday, when the Washtenaw Urban County’s executive committee voted unanimously to join the effort.

Two people – Steve Dobson, past chair of the local United Way board, and community activist Lily Au – spoke to the group during public commentary, taking opposite sides of the issue. But there was little discussion among committee members before the vote. Mary Jo Callan, head of the county/city of Ann Arbor office of community development, briefly recapped a detailed presentation she’d given in September, outlining how Ann Arbor, Washtenaw County and the Urban County would join with the Ann Arbor Area Community Foundation and Washtenaw United Way to coordinate their funding to local nonprofits.

The coordinated funding, managed by Callan’s staff, will give priority to programs and services addressing six key areas: housing/homelessness, aging, school-aged youth, children from birth to six, “safety net” health and food/hunger relief. In total, the five funding entities provide about $5 million annually for local human services nonprofits. The Urban County – a consortium of 11 local governments – contributes roughly $350,000 of that amount.

The committee also voted on three items related to affordable housing efforts: 1) implementing “green” construction standards for builders funded with federal HUD dollars, 2) approving a draft budget and annual request for proposals (RFP) for developers of affordable houses funded through the Urban County, and 3) making changes to the budget tracking for the Urban County’s homebuyer program. No More “Felony Box” on County Job Forms

Washtenaw County board of commissioners (Aug. 4, 2010): A day after the primary election – one that brought victories to all commissioners who were running for office – the board faced a full agenda, but dispatched most of its business with minimal discussion.

Donald Staebler, who'll turn 100 later this month, was honored at Wednesday's county board meeting. He has lived on Staebler Farm, which is now owned by the county, for 98 years.

One item, however, yielded lengthy debate: A resolution that would remove the “felony box” from county job applications, and eliminate background checks for all jobs except those deemed sensitive. Several commissioners were uneasy with even partial elimination of background checks. The resolution was ultimately amended to deal with only the felony box, which asks applicants if they’ve ever been convicted of a felony. Commissioners ended up unanimously approving the removal of that question from job applications.

The board also agreed to put a 10-year millage renewal on the November ballot for the county’s natural areas preservation program, and approved brownfield plans for the Near North housing project and an expansion of Zingerman’s Deli. Both of the brownfield projects are located in Ann Arbor – brownfield status enables them to seek Michigan business tax credits and, in the case of Zingerman’s, to use tax increment financing (TIF) to get reimbursed for project-related expenses.

Commissioners got a second-quarter budget update, which revealed few surprises. However, projections indicate that the budget surplus they need to carry over into 2011 will fall short of their goal by about $987,000. Next year will be a challenging one.

The board had been expected to act on re-establishing a land bank for the county, but ended up tabling resolutions related to that effort until next month, citing the need to gather additional information.

The meeting also included time to honor two people from the community: Joseph N. Cousin Sr., pastor of Bethel AME Church in Ann Arbor, and Donald Staebler, a local farmer whose land is being turned into a county park – and who’ll turn 100 later this month. County Board OKs Near North Brownfield

At their Aug. 4, 2010 meeting, the Washtenaw County board of commissioners unanimously approved a brownfield plan for the Near North affordable housing development in Ann Arbor. The project, located just north of the Ann Arbor DDA district, is eligible for brownfield status because of cleanup needed on the 1.19-acre site along 626-724 N. Main St., south of Summit. Gaining brownfield status will allow the project to seek up to $720,000 in Michigan Business Tax brownfield redevelopment credits.

Ann Arbor Dems Primary: Ward 5 Council

On Thursday evening, July 15, just as a thunderstorm was rolling in, Tamara Real and Carl Rinne opened their home on Fountain Street to the Ann Arbor Ward 5 Democrats. As the former home to the Fountain Church of God in Christ, the venue is suitable for events like the candidate forum, which drew somewhere around 30 people – once all those who straggled in from the rain were counted.

The Ward 5 city council Democratic primary this year is contested by incumbent Carsten Hohnke and challenger Lou Glorie. City council representatives are elected for two-year terms and each of the city’s five wards has two seats on the council, one of which is elected each year.

In November, the  winner of the Aug. 3 Democratic primary will face a Republican challenge in John Floyd, as well as an independent challenge in Newcombe Clark.

Glorie portrayed herself as an underdog candidate – a citizen activist who’s not as interested in leading as in collaborating with ward residents to find consensus.

Hohnke focused heavily on various accomplishments during his first two years in office and sought to distance himself from the idea that he is a career politician.

Of interest to readers who follow city council meetings closely, Hohnke left open the possibility of bringing back some kind of proposal for a historic district in the Germantown neighborhood, as well as reconsideration and approval of the Heritage Row development – but not for exactly the same project. DDA Approves Grant for Zingerman’s

Ann Arbor Downtown Development Authority board meeting (July 7, 2010): In the main business at its regular monthly meeting, the DDA board approved a grant of up to $407,000 in support of a brownfield application by Zingerman’s Deli, which the deli is making to the state of Michigan. The board’s deliberations focused on the public improvements to sidewalks, curb ramps and signage as contrasted with the funding for LEED certification costs – a question of public versus private benefit.

The board also approved a recommendation for details of a payment-in-lieu-of-parking (PILOP) program that allows developers to build fewer parking spaces than otherwise prescribed by the zoning code. The program recommended by the DDA allows for developers to replace required on-site spaces with monthly permits – plus a 25% surcharge – in parking structures managed by the DDA.

The DDA made the recommendation to the city’s planning department because the department had requested the DDA’s input on PILOP after the city’s new rezoning of downtown A2D2 was approved last year by city council.

The board also approved revisions to the FY 2010 budget so that expenditures do not exceed budgeted amounts.

Immediately following the regular monthly meeting, the board held its annual meeting, during which executive director Susan Pollay ticked through the significant accomplishments of the board over the last year. Officers elected for the next year are: chair, Joan Lowenstein; vice chair, Gary Boren; treasurer, Roger Hewitt; secretary, Russ Collins.

County Board Moves Ahead on Land Bank

After more than an hour of discussion, a majority of commissioners approved a step toward bringing back the land bank, which they’d voted to dissolve in March. Several commissioners raised concerns over funding for the land bank and the expense of property maintenance and rehab, though most said they supported the entity in concept.

A land bank allows the government – through a separate land bank authority – to take temporary ownership of tax- or mortgage-foreclosed land while the county works to put it back into productive use. Commissioner Ronnie Peterson, whose district in Ypsilanti and parts of Ypsilanti Township has been hit hard by foreclosures, has been an advocate for the land bank for several months, and expressed his impatience and frustration during the meeting. A motion to rescind the dissolution of the land bank was not considered at the July 7 meeting, but might be brought forward next month.

The board also held a public hearing on expanding the road commission from three members to five – three residents spoke at the hearing, all opposing the expansion. An animated discussion with a somewhat unclear outcome followed the hearing – with Wes Prater moving to stop the process of expansion, and getting support from the majority of the board. Calling that move “symbolic,” Jeff Irwin said he plans to bring a resolution to the Aug. 4 board meeting that will officially propose the expansion.

Several other items related to financial matters. The board approved an initiative to put more government information online, especially regarding budget and finance. They discussed and authorized re-funding bonds requested by Dexter Township, and noted with some concern that Dexter Township isn’t alone in its struggle to meet bond payments. And county administrator Verna McDaniel signaled her intent to hire Kelly Belknap as the county’s new finance director, replacing Peter Ballios, a 38-year veteran of the county who retired at the end of 2009.

The board also approved a brownfield plan for a project in downtown Ypsilanti, and set public hearings for Aug. 4 regarding two additional brownfield plans – the Near North housing project and Zingerman’s Deli expansion, both in Ann Arbor. The board is also expected to vote on those plans at the Aug. 4 meeting. [Full Story]

On Thursday evening, the North Central Property Owners Association (NCPOA) hosted a forum for candidates in two Democratic primary races:  Ward 1 city council representative and mayor.

Before the forum began, as candidates worked the room – which would eventually be packed with around 60 people – they greeted their known supporters and detractors alike. Patricia Lesko was cheerily blunt with Ward 1 councilmember Sabra Briere, telling Briere:  “Hated what you had to say in The Observer about Lesko!” She was alluding to an article in The Ann Arbor Observer’s July edition, with the headline “Satan for Mayor?!

Briere was seated in the back row next to John Hilton, editor of The Ann Arbor Observer and a member of the NCPOA. The location of the forum at the Ann Arbor Community Center on North Main Street and its sponsorship by the NCPOA was significant – the site is across the street from Near North, a controversial affordable housing development approved by council in September 2009. The NCPOA had opposed the project most of the way through, but in the end wound up supporting a compromise version of the design.

Development and the definition of downtown was one of several topics raised by questions put to the candidates.

Incumbent mayor John Hieftje’s basic theme was that Ann Arbor was doing fine financially during tough economic times – especially when compared to other Michigan cities. For her part, Patricia Lesko questioned the ability of the city’s current leaders to make tough choices and described her own toughness with flourishes like: “You want a flower girl? Don’t vote for me!”

There is no Republican running for mayor – the winner of the Aug. 3 Democratic primary will not face a GOP challenger in November. Steve Bean and William Bostic Jr. plan to run as independents. [Full Story]

Kailasapathy stressed her expertise in financial matters as a CPA, but said that she was not merely a “bean counter.” She repeatedly returned to a theme of emphasis on the basic core services and eliminating waste in the budget. Through the course of the evening, she drew several laughs from the audience for various quips, like one suggesting that Ann Arbor was trying to become a “knock-off” of Southfield. [Full Story]

Zingerman’s Project Seeks Brownfield Status

The major renovation and expansion in the works for Zingerman’s Deli cleared its most recent major hurdle in May, gaining site plan approval from the Ann Arbor planning commission. While the site plan now moves on to city council, the business is taking action on another front as well: Applying for support from the local and state brownfield program.

On June 21, Zingerman’s hosted a public meeting to answer questions about their plans for the brownfield application. Matt Naud, the city’s environmental coordinator, was on hand as well, and distinguished between this project and those that are typically associated with the term “brownfield.” In the case of Zingerman’s Deli, “it’s economic development,” he said, “It’s not about environmental cleanup.”

Specifically, brownfield status would allow Zingerman’s to be eligible for tax increment financing (TIF), a mechanism that would let the business recoup certain qualified expenses related to the project – possibly as much as $817,000 over 15 years.

It’s a different approach than the brownfield application most recently approved by city council for the Near North affordable housing project on North Main. In that case, the site’s need for environmental cleanup qualifies it for a brownfield status. Zingerman’s application also differs from Near North’s in that Near North isn’t seeking reimbursement through TIF. Both projects plan to apply for Michigan Business Tax credits. [Full Story]

Development Déjà Vu Dominates Council

The number of houses to be renovated – called the “Seven Sisters” by some in the community who support their preservation – matched the number of votes the project received Monday night from the 11-member city council.

While that is a majority, the seven votes in favor of Heritage Row did not meet the eight-vote minimum that was required. The super-majority requirement came as a result of a protest petition that was successfully filed on the same day as the council’s last meeting, June 7. On that occasion, the council first considered this newest iteration of the project, but postponed it until their June 21 meeting.

The project rejected by the council on Monday in its 7-4 vote was a planned unit development (PUD), which would have required the city to amend its zoning. That leaves in play an already-approved earlier project at the same location, called City Place. City Place was authorized by the council last year as a “matter of right” (MOR) project – because it was judged to meet all applicable codes and zoning regulations.

The City Place (MOR) would demolish the seven houses and replace them with two apartment buildings separated by a parking lot. It’s a project that would be almost certainly denied by the city’s historic district commission – if a historic district were established in the area, as a study committee has recently recommended. The council is expected to make its final vote on the historic district at its July 6 meeting.

But the council gave its initial consideration to establishment of that historic district on Monday night. It’s more customary for councilmembers to vote for proposals on their first reading – to advance a proposal to a public hearing – even if they ultimately plan to vote against it. But Monday’s meeting saw three councilmembers already voting against establishing the district.

The council’s meeting also started off with the theme of historic preservation, as the city’s historic district commission presented its annual preservation awards.

In other business, the council gave a short extension to developer Village Green, which has an option-to-purchase agreement with the city for the city-owned parcel at First and Washington streets. The time for the extension is to be used to work with the city planning staff to put together milestones that need to be met. [Full Story]

Parking Deal Talks Open Between City, DDA

Almost a year ago, the city council appointed members to a committee that was to talk with a corresponding committee of the Ann Arbor Downtown Development Authority board about amending the contract under which the DDA manages the city’s parking system.

The two groups are known as the “mutually beneficial” committees, reflecting the language of a January 2009 city council resolution that called upon the DDA to begin a conversation about revising the parking contract in a “mutually beneficial” way.

On Monday morning, for the first time in public view, members of the DDA board and the city council met to discuss the contract.

The basis of these further discussions was a term sheet that had been produced in late April by some members of the city council and the DDA working outside of either body’s committee structure.

That term sheet had been the good faith basis on which the DDA board, on a 7-4 vote in May, voted to amend the parking contract. That unilateral amendment amounted to a payment from the DDA to the city of an additional $2 million that had not been required under the existing contract.

The specific outcomes of Monday’s meeting between the two committees were: (i) staff for the DDA and the city would be asked to develop a list of policy points that would need to be addressed in order for the DDA to assume responsibility of enforcing parking rules, but not other codes; and (ii) the DDA would be asked to develop a detailed plan by Sept. 13, 2010 describing the role of the DDA in the development of city-owned surface parking lots within the DDA district.

The planned schedule for meetings between the two committees will be the second Monday morning of each month at 8:30 a.m. at the DDA offices on Fifth Avenue. Members of the council’s committee are Margie Teall (Ward 4), Christopher Taylor (Ward 3) and Carsten Hohnke (Ward 5). Representing the DDA are Sandi Smith, Russ Collins, Roger Hewitt and Gary Boren. Heritage Row Likely to Need Super-Majority

Ann Arbor City Council meeting (June 7, 2010): Speculation that the vote on the Heritage Row project would be delayed was borne out on Monday night. Without discussion, the council postponed votes on the development’s rezoning and site plan until June 21.

Councilmembers were also informed that a protest petition had been filed on Heritage Row Monday afternoon, which – once validated – would bump the requirement for approval from a simple six-vote majority to eight out of 11 council votes. Petition filers have calculated that they’ve collected signatures from 51% of adjoining property owners, weighted by land area. That exceeds the 20% required for a successful petition, but as of late Wednesday, the city had not completed its verification process for the signatures. [Update: Early Thursday afternoon, the city confirmed the 20% threshold had been met.]

In other business, the council approved increases in water and sewer rates and gave initial approval to changes in the city code language on the placement of recycling carts.

A wording change in the list of permissible uses for public land was also given initial approval, but not without discussion. Thematically related to land use was a presentation during the meeting’s concluding public commentary in response to a request for proposals (RFP) for the privatization of the city-owned Huron Hills golf course.

Also receiving discussion was an item pulled out of the consent agenda that authorized $75,000 for Ann Arbor SPARK, for economic development.

Criticism during public commentary on the appointment and nomination process used by the mayor to fill seats on boards and commissions stirred mayor John Hieftje to defend shielding individual members of those bodies from public demands.

Public commentary also elicited from Stephen Rapundalo (Ward 1) an update on the development of the Library Lot – he chairs the committee charged with overseeing the RFP process. [Full Story]

Washtenaw Gets More Housing Funds

More than $400,000 in unanticipated federal funding – including a $250,000 “green” grant for Avalon Housing‘s Near North in Ann Arbor – allowed board members of the Washtenaw Urban County to boost funding for several low-income housing and community development projects at their April 27 meeting.

In addition to the grant for Near North – a proposed 39-unit affordable housing development on Main Street just north of downtown – the Urban County also received nearly $180,000 more than anticipated in federal funding through the Community Development Block Grant program for the coming fiscal year.

The board voted to divvy up those additional funds to projects in the Urban County’s three largest jurisdictions – Ann Arbor, Ypsilanti and Ypsilanti Township. They also approved setting aside nearly $27,000 for as-yet-unspecified human services support, in light of possible cuts in city of Ann Arbor funding to local nonprofits.

The focus on allocations at Tuesday’s meeting prompted this comment from Ypsilanti mayor Paul Schreiber: “It’s a pleasure to sit on a board that has money to spend!” [Full Story]

Commissioners Weigh In On Historic District

The committee finished a preliminary report in February, and is getting feedback before making a final report to the city council in May.

Planning commissioners first discussed the historic district report – and their possible response to it – at a March 9, 2010 working session. At that meeting, commissioner Diane Giannola, who also serves on the city’s historic district commission, raised concerns over the completeness of the report.

At Tuesday’s meeting, several commissioners pressed for clarification about the report. On hand to answer questions were Patrick McCauley, the committee’s chair and a member of the historic district commission, and Kristine Kidorf, a consultant hired by the city to assist the process. [Full Story]

“Urban County” Allocates Housing Funds

At their March 23 meeting, members of the Washtenaw Urban County – a consortium of 11 local municipalities that handles federal grants for low-income housing and other projects – approved over $2.6 million in allocations for the Ann Arbor/Ypsilanti area.

The group also had a frank discussion about problems with struggling Gateway Apartments in Ypsilanti Township – the complex is operating at a loss and is putting strains on the nonprofit Avalon Housing, which took over management from the nearly-defunct Washtenaw Affordable Housing Corp.

In addition, Urban County members reallocated federal funds that had previously been earmarked to support a county land bank. The county’s board of commissioners voted to dissolve the land bank earlier this month.

Also approved during Tuesday’s meeting was the draft of an annual plan for July 1, 2010 through June 30, 2011. The plan outlines projects and a nearly $4 million budget from two federal programs for low-income neighborhoods. Avalon Housing’s Near North apartment complex, the Delonis Center homeless shelter, and an owner-occupied housing rehab program are among the projects being funded.

Staff of the Office of Community Development, a joint county/city of Ann Arbor department which among other things manages the Urban County projects, also reported on efforts to recruit more local governments to join the Urban County.
