Equalization Report Shows Stronger Economy

The report was presented by Raman Patel, the county’s long-time equalization director. “Washtenaw County is showing improvements in the market,” he told commissioners. “We are slowly regaining our county’s equalized base. It appears that the worst part of the decline in market value is behind us.”

For 2014, taxable value in the county increased 2.02% to $14.18 billion. That’s a greater increase than the 1.68% climb in 2013, and an improvement over declines seen in recent years. Patel cautioned that several factors are impacting revenue for local governments, including the phase-out of personal property taxes, a variety of exemptions, and tax capture from entities like downtown development authorities.

More of the tax burden is also being shifted to residential property owners, he noted, compared to other categories, like commercial property. The category of residential property accounts for 67.34% of total property value in the county. Five years ago, in 2009, it was 63%.

In other action on April 16, commissioners gave initial approval to distribute proceeds from a countywide tax on hotels and other accommodations. For 2013, $472,846 was available for distribution. If the resolution is given final approval, the county will keep 10% ($47,285) to pay for enforcement of the accommodation ordinance. The remainder will be divided between the Ann Arbor Convention & Visitors Bureau ($319,171) and the Ypsilanti Convention & Visitors Bureau ($106,390).

During public commentary, Mary Kerr, president of the Ann Arbor Convention & Visitors Bureau, and Jason Morgan, director of government relations for Washtenaw Community College, highlighted the union training programs that will be coming to the area this summer. The CVBs have been instrumental in recruiting these kinds of events to Washtenaw County.

Commissioners also gave initial approval to the annual Urban County action plan, which outlines proposed projects funded by the U.S. Dept. of Housing and Urban Development. The Urban County is a consortium of Washtenaw County and 18 local municipalities that receive federal funding for low-income neighborhoods. Members include the cities of Ann Arbor, Ypsilanti and Saline, and 15 townships.

Final authorization was given to a two-year pricing proposal – for 2016 and 2017 – to provide police services to local municipalities through contracts with the county sheriff’s office. And commissioners gave final approval to a new brownfield redevelopment plan for the Thompson Block in Ypsilanti’s Depot Town.

In other action, the board passed a resolution declaring April 13-19 as National Public Safety Telecommunicator Week in Washtenaw County. They also honored Dr. Eugene Glysson, who had served on the county’s board of public works (BPW) since 1986, and was its chair since 1996. He died on April 2.

Several issues were raised during public commentary, including concerns about emergency sirens installed by a pasture in Scio Township. The owner told commissioners that the sirens spook his horses, causing a dangerous situation if anyone is riding them or standing nearby. Other topics discussed by the public included the creation of a new group to help end homelessness, called Our 2020 Vision, and efforts by University of Michigan students to reduce the use of plastic bags by imposing a per-bag usage fee. Final Approval Granted for Police Services

A two-year pricing proposal for contracts to provide police services to local municipalities has received final authorization from the Washtenaw County board of commissioners at its April 16 meeting.

For 2016 and 2017, the police services unit (PSU) price will be  $156,709 and  $158,276, respectively. An initial vote had been taken on April 2, 2014.

By way of background, on July 6, 2011, commissioners had authorized the price that municipalities would pay for a contract sheriff’s deputy through 2015. The price in 2012 – $150,594 per “police services unit” – was unchanged from 2011, but has been rising in subsequent years by about 1% annually. Homeless Issues Emerge on County Agenda

Washtenaw County board of commissioners meeting (April 2, 2014): Responding to several homeless residents who spoke during public commentary, commissioners spent about 90 minutes on April 2 discussing how to address short-term and long-term needs of the homeless.

The board ultimately voted to direct county administrator Verna McDaniel to work with community partners to address immediate needs of the homeless. In general, McDaniel has budgetary discretion to spend up to $50,000 on professional services contracts, and up to $100,000 for any proposed goods, services, new construction or renovation. Later in the week, she allocated $35,000 to the Delonis Center – which is run by the nonprofit Shelter Association of Washtenaw County – to keep its nighttime warming center open through April 30. The warming center had originally been slated to close for the season on April 6.

The resolution also directed the administration to develop a plan by May 7 for updating the county’s Blueprint to End Homelessness, which was adopted in 2004 but appears to be dormant. The process of updating that plan is to be completed by Oct. 1, 2014.

Conan Smith (D-District 9) had initially suggested allocating $40,000 to the shelter to keep the warming center open another month. Other commissioners had concerns about throwing money at the shelter without any input from shelter staff, and without knowing specifically how the money would be used. Because the item hadn’t been included on the agenda, representatives from the shelter staff didn’t attend the meeting.

Some commissioners thought there should be a strategic plan in place before any additional funding is given – and they seemed to assume that such a plan doesn’t already exist. Mary Jo Callan, director of the county’s office of community & economic development, noted that the city of Ann Arbor and several other entities are working on this issue, in partnership with the Shelter Association. The board had received a briefing from the association’s executive director, Ellen Schulmeister, at their Feb. 6, 2014 working session.

The vote on the resolution was 6-2, over dissent from Republicans Dan Smith (District 2) and Alicia Ping (District 3), who both objected to the process. Rolland Sizemore Jr. (D-District 5) was absent.

Dan Smith called it “completely and entirely inappropriate” to be making policy and budgetary decisions on the fly, in response to a few people who showed up to speak during public commentary. He supported updating the Blueprint to End Homelessness, but thought it was a discussion that should take place at a working session before taking action at a regular board meeting. Yousef Rabhi (D-District 8) responded by saying that commissioners are elected to work for the people. When people come to the board, it’s important to address their concerns in a serious manner, he said.

Because of the length of the meeting, some men who were staying at the shelter missed the 9:30 p.m. curfew. Typically, anyone showing up after that time isn’t allowed inside. Greg Dill, the county’s director of infrastructure management, contacted the shelter staff and made arrangements for the men to be accommodated.

In other action, commissioners gave initial approval to a two-year pricing proposal – for 2016 and 2017 – to provide police services to local municipalities through contracts with the county sheriff’s office. Some commissioners expressed concern about the financial sustainability of this approach to funding police services, and cited the need for new revenue sources for public safety. Sheriff Jerry Clayton was on hand to present the pricing proposal, and supported suggestions to seek a new funding source. As he’s done in the past, Clayton characterized the issue of public safety as one that encompasses economic development, human services and other aspects of the community.

Commissioners also gave initial approval to a new brownfield redevelopment plan for the Thompson Block in Ypsilanti’s Depot Town, and took final action to add autism coverage to the health care benefits for employees. They postponed action on a resolution related to the county road commission until May 7, following an April 17 working session that will focus on that issue. The board also was briefed on the 2013 audit and comprehensive annual financial report (CAFR), and received an award for financial reporting from the national Government Finance Officers Association.

During communications, Felicia Brabec (D-District 4) reported that the review of applications is underway for the current cycle of coordinated funding, a partnership to fund social service agencies that involves the county, city of Ann Arbor, and several other entities. For this cycle, 105 applications were received, representing $8.7 million in requests. The amount of available funding this year from all partners is $4.4 million. “So it’s a difficult, difficult process,” she said. Funding recommendations will be brought to the board in May.

On April 2, the board also honored five local businesses and institutions with “healthy workplace” awards, and recognized the Ann Arbor Community Center for 91 years of service. [Full Story]

County Board Seeks Details on Consolidation

Washtenaw County board of commissioners meeting (July 6, 2011): Much of the discussion at this month’s county board meeting focused on the proposed merger of three departments, creating a new office of community & economic development.

In the works for over a year, the consolidation would combine the office of community development, the economic development & energy department, and the employment training and community services (ETCS) department. The goal, according to county managers, is to cut costs by eliminating duplicated services in the face of declining revenues, while finding ways to deliver those services more efficiently to residents in need. The number of full-time employees in the merged departments would drop from 40 to 32, though most of those displaced workers will likely be moved to other county jobs. In total, about $500,000 in annual savings is expected from the merger.

While generally supportive of the change, several commissioners asked for additional details, and expressed frustration that they were provided new information – including a business plan – just hours before the meeting began. The proposal was originally on the agendas for initial approval at the Ways & Means committee meeting and final approval at the regular board meeting that same night, but commissioners decided to remove it from the board meeting agenda. They’ll likely consider it for a final vote at their Aug. 3 meeting. The consolidation will also be one of the topics at the July 11 Ann Arbor city council working session – the office of community development is a joint city/county unit.

Two other items that have received considerable – often contentious – discussion at previous meetings were passed with virtually no comment. Both relate to police services that are provided under contract to local municipalities by the sheriff’s office. On the first item, the county board approved the recommendation of a court-ordered facilitator in a lawsuit filed against the county in 2006 over the cost of police services. The recommendation states that Ypsilanti Township and Augusta Township should pay the county $749,427 for police services provided in 2006. The boards of those townships are expected to vote on the recommendation this week. If approved, it could lead to the closure of that legal battle.

On the second related item, the county board gave final approval to the price that municipalities will pay for a contract sheriff’s deputy through 2015. The price in 2012 – $150,594 – is unchanged from this year, but will rise in subsequent years by about 1% annually. The complex, politically-charged process of arriving at those figures involved more than a year of discussion between the sheriff’s office, other county officials and leaders of local municipalities that contract for these services.

Several other budget-related issues were addressed during the July 6 meeting, including initial approval to an agreement with the Michigan Nurses Association – Unit I, the union that represents 13 public health nurses and nurse coordinators in the county’s health services department. It’s the first of 15 union agreements being negotiated as part of the 2012 and 2013 budget cycle, and is expected to achieve an annual savings of $132,000. In total, the county hopes to see about $8 million in labor concessions for the two-year budget cycle, to help address a projected $17.5 million deficit.

Commissioners also voted to raise the fee for waiving the statutory three-day marriage license waiting period, increasing it from $5 to $50. County clerk Larry Kestenbaum, whose office processes marriage licenses, assured the board that the vast majority of applications are willing to wait the three days, and won’t incur this additional cost for expediting the process. Conan Smith joked that he had hoped Kestenbaum would come forward with a package discount deal – for marriage licenses and concealed weapons permits. [Full Story]

County Board OKs Police Services Lawsuit Deal

In a step that could lead to ending a lawsuit filed against the county in 2006, the Washtenaw County board of commissioners voted to approve the recommendation of a court-ordered facilitator. The recommendation sets $749,427 as the amount owed by Ypsilanti Township and August Township to the county for police services provided in 2006. That was the year those townships, along with Salem Township, filed a lawsuit against the county over the price of contract deputies. Salem Township reached a settlement with the county in 2010.

The bulk of the recommended payment – $732,927 – will come from Ypsilanti Township, which had contracted for 44 sheriff deputies in 2006. In addition to approval from the county board, the recommendation would also need to be voted … [Full Story]

Vote Coming on Police Services Lawsuit

The outcome of a vote at tonight’s Washtenaw County board of commissioners meeting could mean another step toward ending a years-long legal battle over the cost of sheriff deputy patrols.

A resolution is expected to be added as a supplemental agenda item at Wednesday night’s meeting, asking commissioners to approve the recommendation of a court-ordered facilitator. At issue is how much is owed by Ypsilanti Township and August Township to the county for police services that were provided by the county in 2006. That was the year those townships, along with Salem Township, filed a lawsuit against the county over the price of contract deputies.

While county representatives previously indicated they were seeking around $2 million, the recommendation calls for payment to the county of $749,427 – the bulk of that from Ypsilanti Township. In addition to approval from the county board, the recommendation would also need to be voted on by the boards of both townships. Those meetings are expected to occur next week.

On a related note, the county board is also expected to take a final vote at Wednesday’s meeting to set the price that municipalities will pay for a contract sheriff’s deputy through 2015. [Full Story]

Ann Arbor Reaches Accord with Police Specialists

At its June 20, 2011 meeting, the Ann Arbor city council approved a new collective bargaining agreement with its police service specialist union for a contract that goes retroactively from July 1, 2009 through June 30, 2013.

Key features of the contract are no wage increases and participating in the city’s health plan, which requires a contribution by employees to the cost. There are five members of the police service specialist union. They are civilians, who provide support services to police officers.

This leaves the contract with the much larger police officers union still unsettled – it expired on June 30, 2009.

County Funds Nonprofits, Sets Deputy Price

While the board’s previous meeting drew supporters from a range of human services groups, on Wednesday most public commenters spoke against funding of one specific nonprofit: Planned Parenthood of Mid and South Michigan. Their arguments on financial and moral grounds were ultimately unpersuasive to commissioners, who voted unanimously to approve support for Planned Parenthood and several other agencies, totaling $1.015 million through fiscal year 2013, including $53,040 from the county for Planned Parenthood.

Two commissioners raised concerns that county funding for human services in general is inadequate, especially in light of proposed changes that could bump thousands of beneficiaries statewide off the welfare rolls later this year.

In a vote that also holds budget implications, the board’s move to set the price for a contract sheriff’s deputy was remarkable mainly for its lack of debate – historically it’s been a contentious issue. Commissioners gave initial approval without comment. The price set in 2012 for a police services unit (PSU) is $150,594 – unchanged from this year. That’s followed by 1% annual increases through 2015. The difference between the actual cost of a PSU and the amount charged – roughly $25,500, based on current figures – would be covered by the county. The item will return to the board’s July 6 meeting for a final vote.

Meanwhile, a 2006 lawsuit filed against the county over the amount it charged at that time for contract deputies remains unresolved. Judge Joseph Costello of the 38th Circuit Court Chief has ordered the county and Augusta and Ypsilanti townships into non-binding facilitation, in a meeting set for June 22.

During Wednesday’s meeting, commissioners also approved a raft of other items, including: (1) the hiring of Monique Reeves as new medical director; and (2) five drain projects in Ann Arbor that require bonds backed by the county’s full faith and credit. The board also voted to add five new working sessions to its calendar: on June 16, July 21, Aug. 18, Sept. 15 and Oct. 13. All are focused on the 2012-2013 budget.

Finally, at the end of its meeting the board went into executive session for about an hour to address three issues: (1) a collective bargaining strategy; (2) possible settlement of pending litigation; and (3) review of a legal opinion. [Full Story]

The Price of Washtenaw Police Services

At its Wednesday, June 1 meeting, the Washtenaw County board of commissioners will be asked to give initial approval to the price that municipalities will pay for a contract sheriff’s deputy through 2015.

At a board working session on May 19, sheriff Jerry Clayton briefed commissioners about a recommendation from the police services steering committee (PSSC) to set the price in 2012 at $150,594 – the same amount that’s currently charged – with incremental increases over the following three years. By 2015, the price would reach $155,157 per police services unit, an amount that includes overhead and other costs.

For well over a year, the PSSC has been working on the contentious issue of how much it costs to provide sheriff patrols – and how much local municipalities should be charged. In late 2010, the committee brought forward a recommendation to the board that determined the cost of providing a police services unit (PSU) to be $176,108. At its Dec. 1 meeting, the board voted to accept that amount, with the understanding that they’d need to make a much harder decision – about the price that the county would charge for a PSU – at a later date.

That time has come.

The difference between the cost of a PSU and the amount charged – roughly $25,500, based on current figures – would be absorbed by the county. Leaders of two local municipalities – Ann Arbor township supervisor Mike Moran and Pat Vailliencourt, president of the Manchester village council – attended the May 19 work session. Both are members of the PSSC. They argued that the county benefits from supporting deputy patrols by creating a safer environment for residents and businesses, and ultimately strengthening the local economy.

Also during the May 19 working session, Clayton identified other policy issues that the board needs to address – issues that he’s raised a previous meetings as well. They include setting the contract length – Clayton favors longer terms – and developing a policy to handle requests from municipalities to add or subtract deputies.

If commissioners give initial approval to the price on June 1, the resolution would return for a final vote at the board’s July 6 meeting. The board is now operating on a summer schedule, with meetings held on the first Wednesday of the month. [Full Story]

What’s Next for Washtenaw Police Services?

Members of the Washtenaw County police services steering committee (PSSC) have spent more than a year working to reach agreement over the cost of putting a sheriff’s deputy on the road. The amount for what’s called a police services unit – $176,108 – was accepted in a unanimous vote by the county board of commissioners at their meeting in early December.

But when members of the PSSC gathered again in mid-December, they were already focused on what several members characterized as their next, far greater challenge: Determining the price that municipalities will actually pay for a contract sheriff’s deputy.

Sheriff Jerry Clayton told committee members that after board approval of the cost – “which I think we all agree is a good thing” – the committee needs to start working on a price recommendation, which the board must also ultimately approve. Starting Jan. 1, municipalities are paying $150,594 for each contract sheriff’s deputy they hire to patrol their jurisdiction, an amount that includes overhead in addition to salary and benefits. It’s a 4% increase over the 2010 rate – and one major question is how to set that price in the future. The difference between the cost and the price is paid out of the county’s general fund.

In addition to determining price, Clayton said other policy issues include setting the contract length – he’s in favor of four-year terms – and developing a policy to handle requests to add or subtract deputies from a municipality’s contract.

As part of a wide-ranging discussion with the committee, Clayton also noted that the two unions representing sheriff deputies had worked out new agreements that would save the county several million dollars. Those savings would, he hoped, help convince county commissioners to flatline the price for contract deputies at the 2011 rate. County Board Acts on Budget Items

Also during the meeting, the issue of appropriate compensation emerged again. Local attorney Tom Wieder, who had initially raised the issue in October, spoke during public commentary about the need for commissioner Mark Ouimet and others who were inappropriately reimbursed for per diem and mileage to repay the county. An independent accountant’s report on the matter, one that was commissioned by county administrator Verna McDaniel, has been completed but not yet publicly released. Commissioners will be meeting individually with accountants regarding the report next week, and it will then be released to the public.

A resolution that would have cut spending accounts for commissioners from $3,550 annually to $1,500 wasn’t brought forward for a vote – Conan Smith had circulated a draft of the resolution via email earlier in the day. But he said he decided not to introduce it, because after talking to individual commissioners before the meeting, it was clear that he couldn’t marshal enough votes to get it passed.

The board did take action on several budget-related items, with little discussion. Commissioners gave final approval to revisions in the 2011 budget, which among other things directs county administrator Verna McDaniel to make proposals for cutting $1,034,988 out of the original budget of $98,493,155. The board also voted to accept the county’s apportionment report, which gives details of the 2010 taxable valuations for property in the county, by municipality. The report also includes the amount of millages levied and the dollar amounts collected in taxes. December tax bills have already been mailed out to property owners, based on these calculations.

Also during Wednesday’s meeting, the board approved two appointments, nominated by board chair Rolland Sizemore Jr. Commissioner Conan Smith was appointed to the board of the land bank authority, and outgoing commissioner Ken Schwartz was appointed to the board of the Washtenaw County Road Commission. Washtenaw Board Debates Budget Issues

Washtenaw County board of commissioners meeting (Nov. 17, 2010): Budget-related issues drove much of the discussion during Wednesday’s board meeting, as county commissioners wrangled over a resolution proposed by Leah Gunn to eliminate per diem, travel and mileage payments to commissioners.

At some points during the debate there was a fair amount of confusion. A vote to eliminate per diem payments initially passed, but commissioner Ronnie Peterson then indicated that he’d intended to vote the opposite way. Because he’d voted on the prevailing side, parliamentary rules allowed him to bring the issue back for another vote – he switched his vote to no, and the resolution failed to pass. Ultimately, none of the proposed cuts won enough support to enact.

A resolution to set the cost of a police services unit (PSU) received little discussion – aside from some public commentary from Ann Arbor Township supervisor Mike Moran, and a response by commissioner Jeff Irwin. A PSU is the term used for a sheriff’s deputy who is hired on a contract basis to serve local townships and other municipalities. The board gave initial approval to set the cost at $176,108 and is expected to take a final vote on the issue at their Dec. 1 meeting. They’ll wait until next year to tackle the more contentious question of how much the county will charge contracting municipalities per PSU – an amount that will likely be lower, offset by a county general fund contribution.

In other budget-related matters, a public hearing on revisions to the 2011 budget drew only three speakers – including two representatives from local nonprofits who urged commissioners to consider the impact of any cuts they might contemplate for human services. The board also authorized soliciting bids for an internal audit, and discussed holding a special meeting in December to start setting priorities for upcoming budget discussions.

As he had during the Nov. 8 administrative briefing, board chair Rolland Sizemore Jr. expressed frustration with the management of the Washtenaw County Road Commission, and said he wants the board to address that issue. There’s a vacancy on the road commission board, a group that’s appointed by the county board and that has oversight for the road commission operations. Other county commissioners said they’d like to hold public interviews for the job – seven people have applied.

Also on Wednesday, members of the county’s Street Soccer team, the SSPORT, came to the meeting to ask commissioners to participate in the 24-hour Soccerthon, a fundraiser to be held at WideWorld Sports Center starting on Friday, Dec. 10 at 6 p.m. The team is part of the county’s homeless project outreach team (PORT), which provides mental health and other support services to the local homeless population. The players had participated in the third annual Street Soccer USA Cup this summer in Washington D.C., and one of the players, David Altherr, had been picked to play for the U.S. team at the 8th annual Homeless World Cup in Rio de Janeiro, Brazil in September.

During Wednesday’s meeting the board also passed a resolution declaring Nov. 14-20, 2010 as National Hunger and Homelessness Awareness Week. Former county administrator Bob Guenzel, chair of the nonprofit Washtenaw Housing Alliance, was on hand and told the board to expect a re-energized effort related to the county’s Blueprint to End Homelessness. He announced that the WHA has hired a new executive director to lead that effort – Julie Steiner, who has served as executive director of the Interfaith Hospitality Network of Washtenaw County at Alpha House. County Board Split on Police Services Issue

A discussion that at times grew heated during a Nov. 8 administrative briefing for the Washtenaw County board of commissioners reflected different views on the issue of how much it costs to put a sheriff’s deputy on patrol.

The briefing, held the week prior to the regular board meeting, is designed to review the upcoming agenda, and is typically attended by a majority of the 11 commissioners. This week, in addition to items already slated for the agenda, two commissioners proposed additional resolutions to be considered at the Nov. 17 meeting: 1) a resolution regarding a cost recommendation recently made by the county’s police services steering committee, and 2) a resolution to eliminate commissioner per diems and reimbursements for travel, conferences and other meetings.

Six commissioners attended the briefing, and debate on each of those proposed resolutions was vigorous during the hour-long meeting. However, commissioners seemed in agreement on another item brought up for discussion on Monday: discontent with the Washtenaw County Road Commission. [Full Story]

Washtenaw Police Services: What’s It Cost?

During Thursday’s working session, Clayton told commissioners it’s important to agree on the cost of delivering police services, before moving on to the question of price – or what the county will charge for that service, presumably a lower amount. He also outlined several policy issues that the board needs to address, including what metrics they’ll use to determine future adjustments in cost and price.

Currently, there are 74 county deputies paid through contracts with local municipalities, including Ypsilanti Township, Ann Arbor Township and Superior Township, among others. The current price is $144,802 per police services unit (PSU) – a term that includes direct costs like salary and fringe benefits, as well as indirect costs and overhead. Current contracts call for a 4% increase next year, bringing the price to $150,594.

The police services steering committee (PSSC), appointed by the board of commissioners, has been studying the cost of delivering this service for well over a year. Its recommendation, delivered by Clayton to the board at Thursday’s working session, is to set the cost per PSU at $176,108. Setting the price will be an issue to tackle next, and is likely to be a more contentious one. Current contracts run through 2011, and negotiations will begin next year for 2012 and beyond.

The idea of agreeing on a cost should help address the price issue, Clayton said, and should help to assure contracting municipalities that the dramatic price escalations of recent years will stabilize. County officials have said those increases were necessary because the price of the contracts has been significantly lower than the true cost of delivering police services.

Several PSSC members attended Thursday’s session, including leaders of Manchester and the townships of Ann Arbor, Dexter and Superior. They spoke to commissioners, in some cases quite poignantly, about the value that these contract deputies provide to the county as a whole – a value that’s not just limited to the municipalities that pay for the deputies, they stressed. The argument is meant to persuade the board to offset the cost of those deputies by charging a lower price. In the past, some commissioners have argued that the county is subsidizing the patrols in a way that’s unfair to residents of cities like Ann Arbor, who also pay for their own police force.

Notably absent from the meeting were representatives from Ypsilanti Township, the largest unit that contracts for deputies and a member of the PSSC. A year ago, voters defeated a millage that would have paid for police services, and township officials cut the number of deputies it uses from 38 to 31. [See Chronicle coverage: "County Board OKs Ypsi Twp. Deputy Cuts"] On Nov. 2, however, township voters approved a police services millage, with support from 58% of voters. A similar millage proposal in Augusta Township was voted down the same day. Meanwhile, Ypsilanti Township has been in talks with the city of Ypsilanti about consolidating the two municipalities’ police services – Ypsilanti has its own police force.

Then there’s the lawsuit that the townships of Ypsilanti, Salem and Augusta filed against the county in 2006 over the issue of contract deputy prices – commissioner Jeff Irwin pointed out during Thursday’s meeting that the case is “still lingering.” A judge will be hearing a motion on that case this Wednesday, as the county tries to recoup more than $2 million from two of the three townships.

The board did not take action on Thursday. Comments from commissioners indicate mixed views on the proposed cost model, with some arguing that more indirect or overhead costs should be included. However, nearly all of them praised Clayton for his leadership on this issue, thanking him for bringing civility to the discussion. It’s an indirect commentary on the board’s rocky relationship with Clayton’s predecessor, Dan Minzey, who was aligned with Ypsilanti Township and was defeated by Clayton in 2008. [Full Story]

Townships Lose Again in Deputy Patrol Case

The Michigan Supreme Court has refused to reconsider its decision to deny an appeal from three local townships in a long-running legal battle with Washtenaw County over the cost of sheriff deputy patrols. The decision, issued on Feb. 26, effectively ends the townships’ recourse with the state’s high court.

The county now plans to ask for a judgment for the amount it believes the townships of Augusta, Salem and Ypsilanti owe to cover previous costs of providing those deputy patrols in 2006. County officials had intended to make that move in September of 2009, when the Supreme Court first decided not to hear the case. At the time, the county was planning to seek payment in the $2 million range. [Full Story]

Budget Round 3: Where’s Your Emergency?

With limited success on Monday night, city administrator Roger Fraser prodded city councilmembers to confront the city’s budget impact statements. Each of the city’s service units had prepared the statements and made them available to the council a few weeks ago.

It was the third council meeting since the beginning of the year held to focus specifically on the budget, after the council’s budget retreat in December 2009.

In ballpark numbers, Ann Arbor faces a $5.2 million budget shortfall for FY 2011, which begins July 1, 2010. And even if every measure listed on the budget impact sheets is enacted, it would amount to $4.8 million in savings, leaving the city still almost $0.4 million short of balancing its budget.

The meeting did not include any discussion of possible other specific revenue sources, either in the form of payments from the Downtown Development Authority, a city income tax or a Headlee override. The Headlee option has been suggested in a recent “budget white paper” circulated by Sabra Briere (Ward 1), but only if certain conditions are met. Briere, along with Christopher Taylor (Ward 3) and Tony Derezinski (Ward 2), did not attend Monday’s meeting.

The meeting began with presentations on possible outsourcing of emergency management and IT functions at the city. Councilmembers as a group reflected the same lack of enthusiasm for outsourcing those functions as Barnett Jones, chief of police, and Dan Rainey, head of IT, had expressed in their respective presentations.

When mayor John Hieftje appeared ready to send everyone home without any discussion of the budget impact statements, Fraser reiterated a point he’d made earlier: His expectation was that council would discuss the budget impact statements – he had city staff on hand to answer any questions. The council indulged Fraser by quizzing Barnett Jones about the possible layoff of 9-12 sworn police officers. [Full Story]

County Board OKs Ypsi Twp. Deputy Cuts

Washtenaw County Board of Commissioners meeting (Dec. 7, 2009): In a continuation of last Wednesday’s board meeting, commissioners on Monday night approved a contract amendment with Ypsilanti Township, reducing by seven the number of sheriff deputies that will be dedicated to patrolling the township in 2010. Though several commissioners voiced concerns over the deal, only Jeff Irwin voted against the resolution.

Several issues remain unclear, however, including what the township will do regarding sheriff patrols in 2011, and how its decrease in patrols starting Jan. 1, 2010 will affect the rest of the county. Commissioner Kristin Judge said the situation demonstrates that the system of policing in Washtenaw County is broken.

And echoing an idea floated at Saturday’s Ann Arbor city council retreat, commissioner Barbara Bergman said that perhaps it’s time for the city of Ann Arbor to consider contracting its police services with the sheriff’s department, too. [Full Story]

County Board Faces Full Year-End Agenda

At what’s likely to be their final meeting of the year on Dec. 2, the Washtenaw County Board of Commissioners faces a heavy agenda – including items that generated some animated discussion at the board’s pre-meeting briefing on Nov. 24.

The agenda includes a final vote on the 2010-2011 budget, approval of two collective bargaining agreements, a presentation detailing how county funds are being awarded to local human services nonprofits, and a proposal by the sheriff to amend a police services contract with Scio Township.

Sheriff Jerry Clayton attended Tuesday’s administrative briefing for commissioners – held one day earlier than usual, due to the Thanksgiving holiday. He was there to answer questions about the Scio Township proposal, but the focus of commissioners’ questions related instead to the situation in Ypsilanti Township. Earlier this month, voters there rejected a public safety millage that would have paid for 10 of the 38 sheriff deputies that police the township, under contract with the county. Township officials have asked the county to amend the contract, reducing its number of deputies to 28.

As reported in The Chronicle’s preview of the upcoming Nov. 18 Washtenaw County Board of Commissioners meeting, the agenda includes an item to be presented by Sheriff Jerry Clayton, listed on the agenda as a “Recommendation of Policy for Adding Contract Deputies.”

At last week’s administrative briefing, few details were available about Clayton’s presentation. So when county administrator Bob Guenzel mentioned to commissioners that Clayton would be discussing the item at the county’s Police Services Steering Committee meeting, held on Monday, The Chronicle made a point to attend.

The issue of contract deputies has been contentious – one that resulted in a years-long legal battle between the county and three townships. The dispute has centered on how much municipalities have to pay to contract with the sheriff’s department for deputy patrols, and what the true cost of providing those patrols is –  a price versus cost issue. A policy change could be significant, if it addressed these issues.

At Monday’s meeting of the police services steering committee, which includes several township supervisors, public safety officials and four county commissioners, Clayton made it clear that any recommendation for broader policy change is a work in progress. [Full Story]

County’s Agenda: Budget, Police Services

It isn’t often that a member of the public attends the administrative briefing for the Washtenaw County Board of Commissioners, but on Tuesday, Mohammad Jama – a Washtenaw Technical Middle College student – showed up to fulfill a requirement for one of his classes.

Three of the 11 commissioners also showed up for the briefing, which is held the week before a regular board meeting. It’s a venue for the county’s administration to review informally the upcoming agenda. The agenda will be full for the Nov. 18 meeting, one that includes an update on the 2009 budget – it’s now showing a surplus – and a likely vote on the 2010/2011 budget, which had been pulled from the Nov. 4 agenda.

The briefing also touched on a potentially controversial agenda item: A request from Sheriff Jerry Clayton to change the policy related to police services contracts with local municipalities. Other items on the agenda for Nov. 18 include funding to support the homeless, a change in allocation of the accommodation tax, and appointments to more than a dozen county committees and commissions. State Supreme Court Ruling Favors County

Late last Friday, the county was notified that the state Supreme Court has denied an appeal request from three local townships in a years-long legal battle with Washtenaw County over the cost of sheriff deputy patrols. Now the county plans to seek a judgment for roughly $2 million from the townships of Augusta, Salem and Ypsilanti to cover previous costs of providing those patrols.

In an email sent to the county Board of Commissioners on Monday morning, Curtis Hedger – the county’s corporation counsel – wrote that the county plans to ask 38th Circuit Court Chief Judge Joseph Costello to issue a judgment in the case. “We estimate that given the number of hours provided to the Townships without a contract in 2006 at the rate approved by the Court of Appeals, plus judgment interest which goes back to January 2006, the judgment should be in the $2 million dollar range,” Hedger wrote. Police Services Lawsuit: On It Goes

At Saturday’s budget retreat for Washtenaw County commissioners, a discussion on public safety issues included mention of  the lawsuit that three townships filed against the county in 2006, disputing the cost of sheriff deputy patrols. That prompted us to ask for an update: Just what’s the status of that legal wrangling?

The last time we checked in, the state Court of Appeals had just handed the county a victory, and it appeared that the years-long courtroom battle might be ending. Not so. The three townships – Augusta, Salem and Ypsilanti – have appealed to the Michigan Supreme Court, and just last week the county filed its response, according to Curtis Hedger, the county’s corporate counsel. Now, the groups will have to wait until the court decides whether or not to hear the appeal. Hedger said the process could take several more months. [Full Story]

Court Hands County Legal Victory

Wednesday’s administrative briefing for the Washtenaw County Board of Commissioners was indeed brief, and its agenda didn’t contain the day’s biggest news: A state Court of Appeals ruling giving the county a legal victory, possibly marking the end of a years-long dispute with three townships – Ypsilanti, Salem and Augusta – over the cost of sheriff deputy patrols.

“The court completely vindicated the county’s position,” commissioner Jeff Irwin said after Wednesday’s meeting. [Full Story]
