Ann Arbor Applies for SAW Funds

In action taken at its Nov. 7, 2013 meeting, the Ann Arbor city council has applied for six different state grants to support capital water projects. The applications were made under state legislation passed in 2012 that forms the statutory framework of the Stormwater, Asset Management and Wastewater (SAW) program – a grant program.

Nov. 7, 2013 City Council: Live Updates

Editor’s note: This “Live Updates” coverage of the Ann Arbor city council’s Nov. 7, 2013 meeting includes all the material from an earlier preview article. We think that will facilitate easier navigation from live-update material to background material already in the file.

The Thursday meeting, shifted from its usual Monday slot due to the Tuesday elections, is the last one with the current composition of the 11-member council. The outcome of Tuesday’s elections left all incumbents in place except for Marcia Higgins (Ward 4), whose departure was decided in the August Democratic primary. Ward 4 primary winner Jack Eaton will be the single new face on the council at its Nov. 18 meeting. At the Nov. 7 meeting, Higgins will likely receive a customary parting gift from her colleagues, to acknowledge her 14 years of service on the council.

The agenda is relatively heavy, featuring at least 34 voting items. This preview includes a more detailed explanation of several of those items, but first provides a thematic overview.

The city’s downtown factors prominently on the agenda in at least three ways. The city council will be asked to consider passing a resolution to direct the city administrator to negotiate a sales agreement for the city-owned property along William Street between Fourth and Fifth avenues, known as the old Y lot. The council will also be considering a revision to the city ordinance regulating the tax increment finance (TIF) capture of the Ann Arbor Downtown Development Authority. That’s been on the agenda since February, but now a committee of councilmembers and DDA board members has put forth a competing recommendation, which will also be on the Nov. 7 agenda.

Also related to downtown, the council will be formally accepting a report completed by the city’s park advisory commission with recommendations related to downtown parks.

Non-motorized issues also factor prominently as a theme of the Nov. 7 agenda. In addition to an update of the city’s non-motorized transportation plan, the council will consider establishing a pedestrian safety task force. The council’s agenda also includes the first of a series of resolutions for two separate sidewalk projects – one on Stone School Road and another on Scio Church Road. The council’s resolutions for those projects, directing the design work and detailed cost estimates, are the first actions necessary for some of the funding of the sidewalks to be special assessed to the adjacent property owners.

An additional project related to non-motorized issues, but not obviously so, is a contract with the Michigan Dept. of Transportation to resurface a portion of Huron Street from Main Street westward as Huron becomes Jackson Avenue on to I-94, as well as a section of South Maple. The intent is to re-stripe the roadway, reducing the lanes from four to three and adding bicycle lanes.

The sidewalk and street projects are among several capital improvement-related items on the agenda, including one that would help stabilize the earthen berm adjacent to Barton Dam. The council will also be considering a half dozen resolutions that will authorize applying for state grants that could fund capital asset projects for the city.

In addition to the items related to the city’s physical infrastructure, the council has several items that could be described as relating to the city’s social infrastructure. Those items relate to grants from the state and federal government to the 15th District Court for several of its specialty courts that focus on drug offenses, domestic violence, and veterans issues. The council will also be asked to approve a modified continuation of its coordinated funding approach to human services.

The agenda includes some council initiatives announced at the council’s previous meeting on Oct. 21. One of those is a resolution requesting that the University of Michigan decommission a recently constructed digital billboard near the football stadium.

Another one is a resolution directing the education of city officials on professional conduct. Related tangentially to those ethical considerations are the approvals of new bylaws for two of the city’s boards and commissions – the planning commission and the design review board.

Skatepark Rolls; Council Bails on Talk Time

Ann Arbor city council meeting (July 15, 2013): By recent standards, the council’s roughly three-hour meeting was relatively brief.

Of the Ann Arbor city council’s roughly 3-hour meeting, about a quarter of the time was taken up by deliberations on changes to the council’s rules (dark blue wedge), some of which would have affected public speaking time. About a quarter of that time was spent in deliberations on changes to the council’s own rules. That included a proposal to reduce the length of public speaking turns from three minutes to two minutes. After voting 10-1 – over the lone dissent of Margie Teall (Ward 4) – to eliminate the shortening of public speaking turns, the council discussed a number of the other proposed changes that had been recommended by the council’s rules committee.

Those changes include a shortening of councilmember speaking turns, adding public commentary to the council’s work sessions, moving nominations and appointments to a spot earlier on the agenda, and prohibiting the use of mobile devices for texting or phoning at the council table.

As councilmembers recognized that they would not be able to find their way to a clear consensus on the rules changes until they had longer deliberations, the council decided to postpone the item until its first meeting in September – which this year falls on Sept. 3.

So the council delayed launching itself off the lip of the legislative half-pipe to change its own internal rules. However, councilmembers took the advice of Stephen Kunselman (Ward 3) when they voted on the construction contract for a new skatepark: “Just go for it!” The unanimous vote on a $1,031,592 contract with Krull Construction came after some scrutiny led by Sally Petersen (Ward 2). Her questioning was based on the project’s additional cost, compared to its original budget.

The originally approved budget for the project was $800,000 – though the expectation was that it would cost about $1 million. The total budget now – including the construction contract, 10% contingency and $89,560 design contract – is $1,224,311, or $424,311 higher than the originally budgeted $800,000. Funds to pay for the skatepark include a $400,000 grant from the Washtenaw County parks & recreation commission, $300,000 from the Michigan Dept. of Natural Resources Trust Fund, and $100,00 raised by the Friends of the Ann Arbor Skatepark, which paid for the skatepark’s design. This particular effort by the Friends dates back to 2005.

An item added to the agenda the same day as the meeting led to considerable discussion about the relationship between the city and the University of Michigan. The council had failed on May 13 to approve a right-of-way occupancy for the university to install conduits under Tappan Street. An early departure from that meeting by Christopher Taylor (Ward 3) contributed in part to the council’s inability to achieve an eight-vote majority.

Whether an eight-vote majority is needed is the source of friction between the city and UM. Under the city charter, an eight-vote majority is required for the council to approve transactions involving an interest in land. The purpose of the conduits under Tappan Street is to connect a new emergency generator to the Lawyers Club buildings at 551 S. State St. The Lawyers Club and the generator are located on opposite sides of the street. The university’s view is that the agreement needs to convey an interest in land, something the city attorney’s office disagrees with. The council’s resolution approved on July 15 directs the city staff to renegotiate with UM.

The other item on the agenda receiving at least 15 minutes of discussion was one that granted a fee waiver for events held in Liberty Plaza. That action was prompted by public protests at previous council meetings about the possibility of charging a fee to the church that hosts Pizza in the Park – a homelessness outreach program that distributes food and other humanitarian aid.

The council handled a raft of other items, including three different contracts related to protecting the local environment. Two of the contracts include an educational component – one related to the city’s materials recovery facility (MRF), and the other to stormwater management. The third concerned monitoring the city’s now-closed landfill at Platt and Ellsworth.

The council also handled several other items related to stormwater management. Three of the items involved street reconstruction – on Stone School Road, Forest Avenue, and multiple streets in the Springwater subdivision. A fourth item approved by the council was a contract for tree planting, which will be paid for from the city’s stormwater fund.

Among other items, the council also approved the distribution of $1.2 million in human services funding to various nonprofits that do work under contract with the city.

In non-voting business, the council received an update from chief of police John Seto. He reported that through the first six months of the year, Part 1 crimes – the most serious types of offenses – are down 10% compared to last year in the city, while overall crime is down 7.5%. Seto also reported that the police department is analyzing the initial data collection from the electronic activity logs for officers.

During public commentary, the council heard from advocates for racial equity, who called for the council to take action in response to the not-guilty verdict in Florida’s Trayvon Martin shooting case. [Full Story]

Council OKs Stormwater Infrastructure

The Ann Arbor city council has approved several projects that relate to stormwater management.

Three of the items involved street reconstruction – on Stone School Road, Forest Avenue, and multiple streets in the Springwater subdivision. A fourth item approved by the council was a contract for tree planting, which will be paid for from the city’s stormwater fund. The council’s action on these items came at its July 15, 2013 meeting.

The Stone School Road stormwater project is part of a larger $4 million road improvement project. The council’s action was to approve a petition to the Washtenaw County water resources commissioner‘s office to apply for a state revolving fund loan of $1.2 million. July 15, 2013 Ann Arbor Council: Final

After its Monday, July 15, 2013 session, the Ann Arbor city council will depart from the more familiar rhythm of meeting every two weeks – by pausing 24 days before its next meeting on Aug. 8.

The longer-than-usual break stems from the regular meeting schedule, which actually calls for a meeting on the first and third Monday of the month, not every two weeks. The traditional shift from Monday to Thursday to accommodate the Tuesday, Aug. 6 Democratic primary will add three more days to the break.

Two councilmembers have primary challenges this year – incumbent Stephen Kunselman is competing with Julie Grand for the Democratic nomination in Ward 3; and incumbent Marcia Higgins is competing with Jack Eaton for the Ward 4 nomination.

At its last meeting before the Aug. 6 election, the council’s agenda is relatively full. Dominant themes cutting across several agenda items are concrete and water.

In the category of concrete, the council will be asked to approve $15,000 for the design of a section of sidewalk along Barton Drive. The council approved similar design budgets for a sidewalk on Newport Road at its Jan. 22, 2013 meeting and for a sidewalk on Scio Church Road on Nov. 19, 2012. The interest in having sidewalks was supported by petitions submitted by adjoining property owners.

The council will also be asked to accept some easements and the dedication of right-of-way near the intersection of Platt Road and Washtenaw Avenue – in connection with the Arbor Hills Crossing development, where construction is well underway. A sidewalk is to be built along Platt Road as part of the intersection work.

Sidewalks also appear in connection with an agenda item that would approve a $212,784 engineering services contract with CDM Smith Michigan. The contract covers design for a street reconstruction project in the Springwater subdivision, located southeast of Buhr Park, south of Packard Road. The work is scheduled for FY 2014-16, and includes the construction of new sidewalks.

The council will also be asked to approve a $965,990 contract with MacKenzie Co. for street reconstruction between South University Avenue and Hill Street on Forest Avenue. The scope of the project includes the reconstruction of sidewalk.

Adding to the concrete on the agenda is the $1,031,592 construction contract with Krull Construction to build a concrete skatepark at Veterans Memorial Park. Among the features of the skatepark will be pools and bowls.

Although they won’t be skate-able, bowls show up in another agenda item that asks the council to approve $216,000 for renovations of 13 restrooms in the old city hall building. The bathrooms are 50 years old.

In the category of water, the council will be asked to approve a $33,743 annual contract with the Huron River Watershed Council to assist in compliance with the city’s stormwater permit from the Michigan Dept. of Environmental Quality. HRWC’s work includes public education efforts, water quality monitoring and reporting assistance.

Stormwater is also on the agenda in the form of a Stone School Road reconstruction project. Of the $4 million project total, $1.2 million of it involves stormwater work on the county drain north of Ellsworth Road between Varsity Drive and Stone School Road. The council will be asked to approve a petition to the office of the county water resources commissioner for a loan under the state’s revolving fund (SRF) program. If approved by the state, the loan repayment would come from the city’s stormwater fund.

A loan that’s already been secured through the SRF will pay for another item on the agenda – a $509,125 contract with Margolis Companies Inc. for the purchase and planting of trees, as well as stump removal along city streets. The stormwater fund is used for this work because of the positive impact trees have on stormwater runoff.

Water also shows up in a consent agenda item that asks the council to approve a $43,788 annual contract with the Ecology Center to give tours of the city’s materials recovery facility (MRF). The cost of the contract is split 60%-40% between the solid waste fund and the drinking water fund. The drinking water funding is related to a Michigan Dept. of Natural Resources requirement that the city engage in source water protection educational efforts.

Leftover business from the council’s July 1, 2013 meeting includes changes to the council’s rules and the approval of the State Street corridor plan. Rules changes include reductions in speaking times for public commentary as well as for councilmembers.

Art Commission Updated on Program Revamp

Sabra Briere, who’s one of five city councilmembers on the committee, updated AAPAC on possible revisions to the city’s public art ordinance, as well as more general recommendations that are being prepared for the full council. Those proposed changes are likely to include eliminating the Percent for Art funding mechanism, creating a structure to solicit private donations and grants to support public art, directing staff to “bake in” artwork and architectural enhancements as part of overall city capital projects, and providing more administrative support – perhaps by contracting out those services.

AAPAC members had questions about the possible new approach, including questions about the commission’s own role. Briere advised them to continue working on existing projects that are funded through the Percent for Art approach, but noted that they should focus on future opportunities that don’t rely on Percent for Art funds.

The council committee continues to meet, and will eventually deliver recommendations and draft ordinance changes to the full council. This Chronicle report includes highlights from the committee’s most recent meeting on March 1. The committee next meets on March 15, before the council’s March 18 meeting. A moratorium on spending unallocated Percent for Art dollars expires on April 1.

In other action at AAPAC’s February meeting, commissioners heard from Jason Frenzel, stewardship coordinator for the Huron River Watershed Council, about a project that would raise awareness of how the city’s stormdrain system connects to the river. The project is proposed in two stages, starting with a chalk art contest at the June 14 Green Fair, during which artists would draw images and messaging around stormdrains on Main Street.

Commissioners also discussed how to move forward with a proposed memorial to Coleman Jewett – a bronze Adirondack chair at the Ann Arbor farmers market. A private donor has already committed $5,000 to the memorial, but details are still being worked out about how to manage the project. AAPAC chair Marsha Chamberlin indicated that she might call a special meeting in early March for commissioners to act on the proposal, which hasn’t formally been accepted by AAPAC. Update: The special meeting has been scheduled for Thursday, March 7 at 4:30 p.m. in the fifth-floor conference room at city hall, 301 E. Huron.

Other project updates were made via a written report from Aaron Seagraves, the city’s public art administrator. The report stated that a task force has selected four artists as finalists for artwork on the East Stadium bridges, and they have been invited to an April 1 site visit/open house. The finalists are: Volkan Alkanoglu, based in Atlanta, Georgia; Sheila Klein of Bow, Washington; Rebar Group of San Francisco; and Catherine Widgery of Cambridge, Mass. The project has a budget of $400,000.

Only four commissioners attended the Feb. 27 meeting, and when one commissioner left early, the meeting was adjourned for lack of a quorum – before all agenda items were addressed. In part because of attendance issues, officer elections – which AAPAC bylaws state should happen in January – have not yet occurred. Ballots were mailed to commissioners last week, and results will be announced at AAPAC’s March 27 meeting. It’s expected that vice chair Malverne Winborne will be elected chair.

And although it was not discussed at the meeting, Cathy Gendron resigned from AAPAC in late February. She had been reappointed to AAPAC at the city council’s Jan. 7, 2013 meeting for a term through Jan. 20, 2016, but had not attended the commission’s January or February meetings.

Responding to a Chronicle query, Gendron stated in an email that she had agreed to stay on the commission through March, but would be unable to attend AAPAC meetings and decided to resign. ”It’s time for someone else to take my place.” There are now three vacancies on the nine-member commission. Round 2 FY 2014: Capital Improvements

At the first of three work sessions scheduled on next year’s budget, the Ann Arbor city council was briefed on about $95 million worth of capital improvements to be undertaken over the next two years. That amount is roughly evenly split over fiscal years 2014 and 2015.

Generally, about 58% of funding for these projects comes from utility fees and dedicated millages, and 39% from state or federal funds, leaving about 3% to be covered by the city’s general fund. In dollar figures, the amount of improvements that will tap the city’s general fund – or for which funding is otherwise not yet identified – is greater for the second year of this two-year budget cycle. For FY 2015, about $3.4 million of the needed capital improvements will either need to come from the general fund or have some other yet-to-be-determined funding source.

For FY 2014, the amount needed from the general fund or as-yet-undetermined sources is closer to $1.3 million. The city of Ann Arbor’s total general fund budget is around $80 million.

The projects range across the broad categories of: (1) municipal facilities (buildings, parks); (2) transportation (streets, sidewalks, paths, parking decks, train station); and (3) utilities (sanitary, storm, and drinking water).

Cresson Slotten – a city engineer and manager for the city’s systems planning unit – gave the capital improvements briefing to the city council on Feb. 11. The presentation was based on the city’s capital improvements plan (CIP), which was approved by the city planning commission on Dec. 18, 2012.

Slotten also briefed the council on three significant study initiatives related to water systems – a city-wide stormwater study, a more focused study on the Malletts Creek watershed, and a sanitary sewer flow study. Those studies are part of the current year’s work.

In the course of Slotten’s presentation, councilmembers had questions about specific projects, including the footing-drain disconnection (FDD) program. Stephen Kunselman (Ward 3) noticed the FDD program has no funding indicated beyond the $2.5 million that’s called for next year, in FY 2014. Craig Hupy, the city’s public services area administrator, explained that the contract recently authorized by the council to study sanitary sewer flows would inform possible funding in future years.

Another project that drew scrutiny from councilmembers was a $540,000 for interim parking to support a possible commuter rail demonstration project. The city of Ann Arbor has told the Michigan Dept. of Transportation that it expects MDOT to pay for that parking. And Mike Anglin (Ward 5) asked for clarification of the $2.6 million slated for FY 2015 for the design of the “Ann Arbor Station.” City staff clarified that the location of a possible new Amtrak station is currently still the subject of a council-approved $2.75 million study, 20% of which the city is funding, with the remaining 80% covered by a federal grant.

A new station has been controversial in part due to an initially proposed location on Fuller Road near the University of Michigan hospital – on land designated as city parkland. In the CIP, the construction of such a new station is $44.5 million, slated for FY 2016. That cost was not included in the figures presented by Slotten, which went only through FY 2015.

The city council chambers appear in the CIP in connection with two capital projects. A renovation to the chambers – pegged at $300,000 in FY 2015 – seemed to meet with scant enthusiasm from councilmembers. Likely to have a bit more traction with the council is the remaining asbestos abatement in the city hall building. Asbestos abatement was partly completed when renovations were done in connection with construction of the adjoining Justice Center. For the city council chambers portion of city hall’s second floor, abatement would cost about $200,000, and is included in the CIP for FY 2014.

A query from Christopher Taylor (Ward 3) about Barton Dam projects drew out the fact that two projects listed for the concrete and steel portions of the dam  – a two-year total of about $1.65 million – could be joined by additional work that might be required on the adjoining earthen berm. The berm is part of the dam that holds the water in Barton Pond, the main source of the city’s drinking water. The possible berm project depends on the outcome of investigatory work that’s being done at the behest of the Federal Energy Regulatory Commission (FERC).

A runway extension at the municipal airport – included in the CIP for FY 2014 at a cost of $2.14 million – was met with the observation from Sabra Briere (Ward 1) that an environmental assessment (EA) had not yet been acted on by the Federal Aviation Administration. The council had approved the last bit of funding for that study on Aug. 20, 2012. Without the finalized EA in place, Briere ventured, it would be difficult for her to vote for a capital budget that included the runway project.

The budget on which the council will vote this year will include a separate breakout of capital spending. The substantive conversation about the capital budget as it relates to the council’s established priorities is expected to begin to unfold at the council’s March 11 work session. Before then, a second work session is scheduled for Feb. 25, with an additional session slated for March 25, if necessary. City administrator Steve Powers is required by the city charter to submit his proposed budget to the council by the second meeting in April, with any council amendments required by the second meeting in May. The city’s fiscal year begins July 1. [Full Story]

Ann Arbor OKs Another Stormwater Petition

A request of the Washtenaw County water resources commissioner to apply for $1.45 million in state revolving fund loans has been made by the Ann Arbor city council at its Dec. 17, 2012 meeting. It’s part of a street reconstruction project in the Springwater subdivision – with an overall project cost of $5.17 million.

The general location of the area is Platt and Packard roads. Streets that are part of the project include Nordman Road, Butternut Street, Springbrook Avenue, and Redwood Avenue.

The street reconstruction will use a traditional asphalt surface, but the management of stormwater will be achieved through oversized stormwater pipes. Construction is expected to start in late 2013 and will last three years. Sanitary sewer issues will also be … [Full Story]

Ann Arbor Petitions Water Office: $1M in Projects

Ann Arbor has petitioned the Washtenaw County office of the water resources commissioner to undertake design and construction of three stormwater control projects totaling $1.07 million.

A proposed project on South Fourth Avenue – between East Huron Street and East Liberty Street – will reconstruct the street using a traditional road surface, but will manage stormwater with infiltration basins under the road. The stormwater part of the $870,000 project will cost $320,000.

A similar project on South Forest Avenue – from South University to north of Hill Street – will have a total price of $688,500, with the stormwater component costing $454,400.

Council Sails Through Flooded Agenda

Ann Arbor city council meeting (Oct. 1, 2012): The council worked through its densely packed agenda in well under two hours, even though six separate public hearings were held.

The council voted to table a revision to its medical marijuana licensing ordinance, having postponed it twice previously. Tabling is unlike a postponement to a date certain, and leaves open the possibility that the council might not ever take the question up again. However, Sabra Briere (Ward 1) indicated she intended to take up the medical marijuana ordinance again within six months.

The council has yet to act on recommendations from the city’s medical marijuana licensing board, made at the start of the year, to award licenses to 10 dispensaries. In the meantime, those dispensaries continue to operate. At the council’s Oct. 1 meeting, city attorney Stephen Postema indicated he would be creating a public document for the licensing board that would include a summary of pending legislation and court cases.

The council tabled a resolution on establishing a citizens committee to study the question of how to use proceeds from city-owned land sales. That tabling came at the request of the resolution’s sponsor, Mike Anglin (Ward 5), who had originally brought it forward at the council’s previous meeting.

The council also voted to extend by another 180 days a moratorium on digital billboards in the city – which the council first enacted back in April.

Three of the items on which the council took final action were at least indirectly related to stormwater. The council confirmed the appointment of the top area administrator whose department is responsible for stormwater management – Craig Hupy. Hupy’s appointment as public services area administrator comes after 26 years of service with the city.

The council also approved a $300,000 stormwater improvements component of a much larger $6.5 million street reconstruction project for Miller Avenue. The council authorized $50,000 to study the feasibility of opening up the railroad berm near Depot Street, which might allow floodwater to flow unimpeded to the Huron River on the other side. The study is also meant to cover the possibility of a non-motorized transportation connection under the berm, for pedestrians and bicyclists.

Related to water only in name was a tax abatement granted by the council to Barracuda Networks, which is relocating from Depot Street to downtown Ann Arbor and expecting to add 144 jobs.

The council also approved a raft of proposals related to land use. Winning approval were site plans for a Fiat dealership on West Stadium Boulevard and an expansion of the Food Gatherers facility on Carrot Way. The rezoning of a strip around the perimeter of a parcel at Miller and Maple, where a Speedway gas station will be constructed, got final approval.

A proposed townhouse project on Catherine Street got its rezoning as well as site plan approved. At the public hearing neighbors praised the project and developer Tom Fitzsimmons for what he had done to work with them.

The Plymouth Green Crossings project, which has already been built, got initial approval for revisions to its planned unit development (PUD) supplemental regulations.

The council also added 73 acres to the land protected under the city’s greenbelt program by approving the purchase of development rights on the Hornback farm in Salem Township.

The council weighed in on a state ballot question – which would require electric utility companies in Michigan to provide 25% of their power with renewable sources by the year 2025 – by passing a resolution in support of it.

One of the more significant pieces of news to come out of the meeting was an announcement from Stephen Kunselman (Ward 3) that he could not attend the council’s Oct. 15 meeting. That’s when the council is due again to take up the question of putting $60,000 towards a $300,000 local match for a $1.2 million federal grant that would fund a transportation connector study. Council Debates Public Transit, Sets Hearing

Ann Arbor city council meeting (Jan. 9, 2012): The council’s first meeting of the year included: a metaphor comparing AATA buses to white blood cells; a desire to “inoculate” Ann Arbor against loss of control over its local bus system; and a fair number of councilmembers needling each other.

In the end, the council opted to delay voting on a four-way accord between the city of Ann Arbor, the Ann Arbor Transportation Authority (AATA), the city of Ypsilanti and Washtenaw County. The agreement among the four parties would set up a framework for, and contingencies on, the transition of the AATA to a countywide transit authority, incorporated under Michigan’s Act 196 of 1986. AATA currently operates under Act 55 of 1963.

The transition to a countywide funding base is intended to (1) ensure stability of funding for transit connections outside of the city of Ann Arbor, which has until now depended on purchase-of-service agreements; (2) provide a higher level of transit service inside the city of Ann Arbor; and (3) expand the area where transit service is provided.

The council’s vote was to delay the decision just for one meeting – until Jan. 23. The council also voted to set a public hearing for that date.

In other substantive action on the four-party agreement, the council amended it to stipulate that Ann Arbor’s transit tax would only be transferred to the new Act 196 authority if approval of a millage were to gain a majority of votes within the city of Ann Arbor.

In other business, the council gave initial approval to a revision of the Arlington Square planned unit development (PUD), located on the southeast corner of Washtenaw Avenue and Huron Parkway. The changes will allow for additional types of uses at the site – restaurants and an urgent care facility. Questions were raised about the number of existing parking spaces on the site.

The council also approved the set of fees associated with its property assessed clean energy (PACE) program, which was established last year.

In additional business, the council approved petitions to the Washtenaw County water resources commissioner for several stormwater projects, and approved a wetland mitigation plan for the Wheeler Service Center on Stone School Road. The council also authorized a pay increase for election workers who staff the polls on election day.

At the start of the meeting, councilmembers received an update on the skatepark planned for the northeast corner of Veterans Memorial Park. With most of the funding now in place, construction looks like it will start late in 2012 or the spring of 2013. [Full Story]

Ann Arbor Petitions for Stormwater Projects

At its Jan. 9, 2012 meeting, the Ann Arbor city council passed four resolutions petitioning the Washtenaw County water resources commissioner to undertake stormwater-related projects with a total cost of around $4.4 million.

The projects each have a portion that qualifies for low-interest (2.5%) state revolving fund (SRF) loans that eventually might be partially forgiven. That portion would be paid out of the city’s stormwater fund. The total of the individual annual loan repayments for the projects would be $133,425 a year for 20 years.

A $2.5 million project in the Allen Creek Drainage District would design and construct stormwater management control measures on Madison Avenue between South Seventh and South Main. The existing corridor would be reconstructed using a traditional road surface, with management of stormwater flow being done through the use of infiltration basins within the right-of-way. The city stormwater portion of the project would be $500,000, with the loan to be paid back over 20 years in annual installments of $31,800.

A $630,000 project on Willard Street, between East University Avenue and South Forest Avenue, would construct a porous road surface, with management of offsite storm flow coming from a pollutant separation unit. Of that project, a little over $300,000 is strictly stormwater-related. The rest would be funded through the city’s street repair millage. It will be financed through revolving loans to be paid in annual installments of $19,110.

A $1,050,000 project in Leslie Park would mitigate against streambank erosion. Financing through revolving fund loans would amount to annual payments of $62,415. [See previous Chronicle coverage of that project: "Creek Project Ramps Up at Leslie Park Golf"]

A $316,000 project throughout the city of Ann Arbor would plant street trees during 2013. The revolving load fund financing would result in annual payment of $20,100 over 20 years.

Ann Arbor to Plant More Trees

At its July 18, 2011 meeting, the Ann Arbor city council approved a $301,475 contract with Marine City Nursery Company to plant 1,200 trees in the right-of-way of streets in the Malletts Creek, Allen Creek, Traver Creek and Swift Run Drainage Districts. The money for the tree planting will come from the stormwater fund’s capital budget. The Washtenaw County water resources commissioner has obtained a low-interest loan on behalf of the city through the state’s revolving fund loan and will reimburse the stormwater fund for part of the project. The rationale for use of stormwater funds to plant trees is based on the idea that trees have a positive impact on the volume and quality of stormwater flow.

The city received only two bids for the tree-planting contract, and only the bid from Marine City Nursery Company was determined to be a responsible bid.

Ann Arbor Raises Water, Sewer Rates

At its June 20, 2011 meeting, the Ann Arbor city council gave final approval to increases in water, sewer and stormwater rates.

In terms of revenue generated to the city, the rate increases are expected to generate 3.36% more for drinking water ($664,993), 4% more for the sanitary sewer ($829,481), and 3.35% more for stormwater ($176,915). [.pdf of complete utility rate changes as proposed]

According to the city, the rate increases are needed to maintain debt service coverage and to maintain funding for required capital improvements.

The city’s drinking water charges are based on a “unit” of 100 cubic feet – 748 gallons. Charges for residential customers are divided into tiers, based on usage. For example, the first seven units of water for residential customers have been charged at a rate of $1.23 per unit. The new residential rate for the first seven units is $1.27.

The city’s stormwater rates are based on the amount of impervious area on a parcel and are billed quarterly. For example, the lowest tier – for impervious area less than 2,187 square feet – has been $12.84 per quarter. Under the new rate structure, that increases to $13.24.

Beyond Pot: Streets, Utilities, Design

Ann Arbor city council meeting (June 6, 2011, Part 1): While the largest chunk of time at the city council’s Monday meeting was devoted to consideration of ordinances regulating medical marijuana, the agenda was dense with other significant material.

For road users who head to the polls on Nov. 8, possibly the most important issue on the agenda was a brief presentation from the city’s project management manager, Homayoon Pirooz, on the city’s street repair tax, which would reach the end of its current five-year life this year, if not renewed by voters. The city council will convene a working session on June 13 to look at the issue in more detail.

Also related to infrastructure was the council’s initial action on setting rates for utilities (water, sewer, stormwater), voting unanimously to send the rate increases on to a second and final vote with a public hearing. The rate increases range from 3-4% more than customers are currently paying. All new and amended city ordinances require two votes by the council at separate meetings.

The council also approved an $800,000 agreement with the Michigan Dept. of Transportation for the initial, right-of-way portion of the East Stadium bridges replacement project. Construction on that public project is due to start later this fall.

For another public project, the council voted to add a previously budgeted $1.09 million to the construction manager contract for the new municipal center at Fifth and Huron.

In an action designed eventually to reduce employee benefits costs, the council passed a resolution – brought forward by its budget committee – that directs the city administrator to craft an ordinance revision that would alter the way non-union employee benefits are structured. What’s planned is a change from three to five years for the final average compensation (FAC) calculation, and a change from five to 10 years for vesting. In addition, retirees would receive an access-only health care benefit.

The city’s newest non-union employee is Chuck Hubbard, whose appointment as the new fire chief was approved by the city council on Monday night. Hubbard was previously assistant chief, which, unlike the chief’s job, is a union position. Hubbard has 25 years of fire protection experience, all of it in Ann Arbor.

Expected to begin construction this year – in late summer – is a private development on the First and Washington lot currently owned by the city. On that lot, Village Green is planning to build a 9-story, 99-foot-tall building featuring 156 dwelling units and a 244-space parking deck on the first two stories. After much discussion, the council approved a $100,000 reduction in the purchase price – from $3.3 million to $3.2 million – that Village Green will pay for the First and Washington parcel. The price break came in the context of water management and a decision to use a full “bathtub”-type design for the foundation. The unanimous vote came after two councilmembers had already left the meeting (which pushed nearly to midnight), but it seemed at one point to hang in the balance, with two of the remaining nine councilmembers expressing reservations. Because the resolution involved land purchase, it needed eight votes to pass.

Village Green’s project, a planned unit development (PUD) approved over two years ago, was not required to undergo the mandatory process of design review that is now part of the city’s code. The council gave final approval to that design review process on Monday night. The new ordinance sets up a seven-member design review board (DRB) to provide developers with feedback on their projects’ conformance to the design guidelines. While the DRB process is required, conformance with the recommendations of that body is voluntary.

Also receiving approval at first reading was a revision to the landscaping ordinance. Fuller Road Station also drew comment from the public and the council.

Final action on medical marijuana zoning and licensing is not expected until the council’s June 20 meeting. Council deliberations on medical marijuana will be covered in Part 2 of The Chronicle’s meeting report. [Full Story]

Planning Group Gets Stormwater Tutorial

Lawson described the city’s efforts to reduce or eliminate pollutants from entering the Huron River because of stormwater runoff, and fielded a range of questions from commissioners. Her presentation was likely the only time that the term “poo water” and a quote by the Scottish philosopher Thomas Carlyle have occurred during the same public meeting.

Also during Tuesday’s meeting, commissioners approved minor revisions to the city’s master plan, as part of a process that occurs each May. No one spoke during a public hearing on the revisions.

Wendy Rampson, the city’s planning manager, told commissioners that efforts to seek a consultant for a South State Street corridor study have been put on hold, following concerns raised by some city councilmembers over the project’s cost.

In other business, a public hearing was announced for the commission’s May 17 meeting regarding a request by Summers-Knoll School for a special exception use. If granted, the special exception would allow an office building at 2203 Platt Road to be converted into a private school. [Full Story]

Beyond Pot: Development, Liquor, Parks

Also postponed – until the council’s first meeting in April – was a resolution that would outline a way for the Ann Arbor Downtown Development Authority to lead the process of transforming surface parking lots currently owned by the city of Ann Arbor to alternate uses.

The resolution, which articulates the so-called “parcel-by-parcel plan,” had already been postponed once before. In explaining the rationale for the postponement, Christopher Taylor (Ward 3) cited the desire of the DDA to ensconce the parcel-by-parcel plan in a contractually binding agreement, which he said had not been previously indicated.

Not postponed was a vote on appointing a hearing officer for appeals of recommendations that liquor licenses not be renewed. The original resolution was to appoint the members of the council’s liquor license review committee to a hearing board, but it was amended at the table – to the surprise of some councilmembers – to allow for appointment of just one hearing officer: Tony Derezinski (Ward 2). Derezinski also serves on the liquor license review committee. Voting against the amendment, as well as the final appointment, were three councilmembers, including Stephen Rapundalo (Ward 2). Rapundalo chairs the council’s liquor license committee and has served on it since it became a permanent council committee in 2008, as well as before that, when it was an ad-hoc committee.

The council also approved the city’s Parks and Recreation Open Space (PROS) plan – an inventory, needs assessment and action plan for the city’s parks system, which is required by the state for certain grant applications. The deadline faced by the council to renew the five-year plan was April 1, 2011.

In other non-marijuana business, the council approved a “complete streets” policy, authorized a stormwater study in the Swift Run drain system, established a loan loss fund for the Property Assessed Clean Energy (PACE) program, and authorized the purchase of LED streetlight fixtures.

The council also heard its usual range of public commentary and communications from its own members. A public hearing was held on the establishment of a Washtenaw Avenue corridor improvement authority (CIA), during which Ypsilanti mayor Paul Schreiber spoke. Ann Arbor OKs Swift Run Stormwater Study

At its March 7, 2011 meeting, the Ann Arbor city council approved a $88,250 contract with J.F. New to conduct a study of the Swift Run drain system near the city’s composting facility. The study is prompted by a 2009 Michigan Dept. of Natural Resources and Environment (MDNRE) inspection. The inspection determined that a small pond near the northern compost pad required maintenance.

At that time, the MDNRE also requested improvements to the stormwater management system at the compost facility to reduce the impact of nutrient loading on the Swift Run drain. In 2004, the U.S. Environmental Protection Agency issued a Total Maximum Daily Load (TMDL) for biota in the Swift Run drain.

The concept behind the study is to examine the various interconnected ponds and ditches as a unified system, so that the MDNRE’s concerns can be satisfied. J.F. New was selected from seven engineering firms who responded to the city’s request for proposals.

Ann Arbor 2012 Budget: Trees, Trash, Streets

Editor’s note: The Ann Arbor city council has held two retreats to discuss the city’s FY 2012 budget – one in early December 2010 and another in early January 2011. A summary of the material covered in those retreats is provided in previous Chronicle coverage: “Ann Arbor: Engaging the FY 2012 Budget.”

Leading up to the city administrator delivering a proposed budget in April – for FY 2012, beginning July 1, 2011 – the city council is also holding a series of work sessions on the budget. Their typical scheduling pattern is for the weeks between council meetings. Previous work sessions have taken place on community services, as well as the 15th District Court and police and fire services. On Feb. 28, the council held its final budget work session of the season – on public services and the city attorney’s office. Streets, sidewalks, trash collection, trees in the right-of-way, water and sewers are all included under the general label of “public services” in the city. At Monday’s budget work session on those kinds of activities, public services area administrator Sue McCormick did not present the council with any news more dramatic than Roger Fraser did when he announced at the conclusion of the session that he’d be leaving his job by the end of April.

But McCormick did present the council with options for meeting reduction targets that would, if enacted, have a significant impact on the range of services offered by the city. In at least one case, the range of service would expand – the city (instead of adjoining property owners) could assume responsibility for sidewalk repair and replacement.

In another case – which McCormick stressed was not a recommendation, but rather just an informational ballpark amount for potential annual savings to the city ($2.1 million) – the city would get out of the business of trash collection. In another month, the city expects to give the council a report that provides more detail on possible alternatives to having city workers perform that task, including some kind of franchised trash collection operation.

Many of the specific reduction target tactics presented on Monday evening involved assigning costs to a unit outside the general fund. While the city’s total budget includes around $340 million in expenses, the annual discussion typically spotlights the general fund, which gets revenue from the general operations millage [listed on tax bills as CITY OPER] – and is currently levied at a rate of roughly 6 mills. The widely reported projected deficit of $2.4 million for the city’s budget is for the general fund.

During the work session, the assignment of costs to other funds caused Sandi Smith (Ward 1) to wonder if it was just a matter of “shuffling” money from one bucket to another. The answer she heard was: No – it’s a matter of assigning costs appropriately to whatever fund should properly bear the cost of a particular activity.

One of the largest instances of such a cost reassignment would use the stormwater utility fund, instead of the general fund, to pay for forestry operations for trees in the right-of-way. That move would save the city’s general fund around $660,000 a year.

Another example of that kind of “shuffling,” albeit with a smaller dollar figure ($35,000), was a proposal from the city attorney’s office to charge capital projects part of the cost of a paralegal specializing in easements, instead of burdening the city attorney’s budget with that expense. The city attorney’s reduction strategy, which had originally been scheduled for a prior work session, was also part of Monday evening’s presentation. [Full Story]

Council Plows Ahead With Human Services

Ann Arbor City Council meeting (Nov. 4, 2010): At its first meeting of November – held on Thursday instead of the usual Monday to accommodate Tuesday elections – the Ann Arbor city council transacted a fair amount of business in its relatively short session.

That business ranged from authorization of a coordinated human services funding approach to approval of new GIS software.

The coordinated funding approach to human services would extend the collaboration among the city of Ann Arbor, Washtenaw County and the Urban County to include two nonprofit funders – United Way of Washtenaw County and the Ann Arbor Area Community Foundation.

The GIS software will allow remote monitoring of engine and system performance on board the city’s vehicle fleet. The vehicle monitoring software has the ancillary benefit of allowing residents to view a real-time map of snowplow activity during a snowfall. At Thursday’s meeting, the council also authorized the purchase of $330,000 worth of road salt that city trucks will, if necessary, spread on the roads this winter.

In other business, the council gave final approval to a new stormwater code, which requires some kind of mitigation any time more than 200 square feet of impervious surface is added in residential areas.

The council again took no action on a $160,000 request from the 15th District Court to purchase furniture. The request had been postponed at the council’s previous meeting, pending production of a list of items to be purchased. The list was not ready, and the issue was again postponed.

The council received a presentation on the installation of a new HAWK pedestrian crossing signal at Chapin and Huron, which was in substance identical to one the board of the Ann Arbor Downtown Development Authority had received the day before.

A range of topics were addressed during comments from the public, perhaps most significantly remarks from Nicholas Nightwine, who spoke on behalf of the Local 369 AFSCME union on the issue of privatizing the city’s composting operation. The city council is due to hear a presentation at a Monday, Nov. 8 work session on the proposal, which they may vote on as early as Nov. 15. [Full Story]

City Council Mulls Zoning: Marijuana, Height

Ann Arbor City Council meeting (Oct. 18, 2010): On Monday night, the council gave an initial approval to a set of zoning laws that are intended to regulate medical marijuana use in the city. It also gave the city attorney direction to pursue the development of a license for medical marijuana facilities. All ordinances require an initial approval – a first reading – followed by a second and final reading at a later meeting.

Also related to zoning was the council’s second-reading consideration of changes in the city’s zoning code for areas outside the downtown, across most of the city’s zoning classifications. The changes affect area, height and placement (AHP). The final approval of the AHP zoning overhaul had been postponed from council’s first meeting of the month, on Oct. 5, at the request of Marcia Higgins (Ward 4).

At Monday’s meeting, Higgins brought forth amendments that confined a height cap on buildings to areas adjacent to residential areas. The amendments would allow taller buildings in some non-residential areas, like Briarwood Mall. After some deliberation on the merits of the amendments, Higgins withdrew them, and the council elected to postpone the measure. With Higgins’ amendments, the proposal would be substantively different from the proposal that had already received council approval at first reading, and would thus require an additional reading before final adoption.

In other matters before the council, it was also Higgins who provided much of the impetus for conversation. Two items involved modification to the city’s budget by drawing upon the general fund reserve. One involved a $153,116 expenditure for the city’s planning department to fund corridor planning, and the other was a $160,000 item to purchase furniture for the 15th District Court, which will soon take up residence in the new municipal center at Fifth and Huron. The planning department money was approved over Higgins’ dissent, while the court’s expenditure was postponed, pending the production of an itemized list of what’s being purchased. The two items prompted discussion of the projected budget deficit for FY 2012, which the city’s CFO had estimated in May to be $5 million.

In other business, the council took the final step to enact a special assessment of property owners along Washtenaw Avenue to fund a portion of a new non-motorized path. The council also approved its part of a two-year extension to the consent agreement with Glen Ann Place, which gave site-plan approval for a project at the corner of Glen and Ann streets. Council also gave initial approval to stricter stormwater management rules for impervious surfaces in residential zoning districts.

Council chambers were filled at the start of the meeting with many members of the community who came to hear a proclamation and watch councilmembers vote on a resolution giving council’s support to a similar Michigan Civil Rights Commission resolution. The MCRC condemned the conduct of assistant attorney general Andrew Shirvell, who has written blog posts targeting Chris Armstrong, an openly gay University of Michigan student leader. The Ann Arbor city council’s resolution also calls upon the state legislature to pass a proposed comprehensive hate crime bill and a school anti-bullying law currently before the state Senate. Ann Arbor Dems Primary: Ward 4 Council

On Tuesday evening, the Ward 4 Democratic Party hosted a forum at Dicken Elementary School so that residents could pose questions to primary candidates for one of the ward’s two city council seats. Margie Teall, the incumbent who has held the seat since 2002, and Jack Eaton, who has been active in politics on the neighborhood level, answered questions for a bit more than an hour.

City council representatives are elected for two-year terms and each of the city’s five wards has two seats on the council, one of which is elected each year. Also in attendance at Tuesday’s forum was Marcia Higgins, the Ward 4 council representative who won re-election in November 2009, defeating independent challenger Hatim Elhady.

Besides Higgins, other elected officials and candidates for office who were introduced at the forum included: LuAnne Bullington (candidate for the 11th District county board of commissioners seat), Ned Staebler (candidate for the 53rd District state Representative seat), Leah Gunn (county commissioner representing the 9th District of the county and seeking re-election), Patricia Lesko (candidate for Ann Arbor mayor). All the candidates are Democrats.

Eaton’s main theme was a need to focus more on infrastructure – those things we need, not the things that might be nice to have. Eaton was keen to establish that his candidacy was not meant as a personal attack on Teall, saying that he expected his supporters to focus on the issues and to conduct themselves in a civil way. His opening remarks were heavy on thanks and appreciation for Teall’s long service on council, particularly with regard to the creation of Dicken Woods, which is now a city-owned nature area.

In the course of the forum, a pointed question to Teall on her biggest regret while serving on the council elicited an acknowledgment from her that she regretted her contribution to the problem last year with city councilmembers emailing each other during council meetings. Eaton was quick to give Teall credit for publicly apologizing in a timely way for her role in the scandal.

For her part, Teall focused on setting forth accomplishments while serving on the council. Those ranged from the longer-term budgeting strategies that she said had helped ensure that Ann Arbor was weathering the economic crisis better than other Michigan cities, to the budget amendment she introduced and the council passed in May, which proposed using $2 million from the Downtown Development Authority, plus more optimistic estimates for state revenue sharing, to eliminate the need to lay off some police and firefighters.

The candidates exchanged different views on basic infrastructure issues like the Stadium Boulevard bridges and stormwater management, to single-stream recycling and leaf collection, to Georgetown Mall, and the transparency of government. [Full Story]
