Library Board Updated on Strategic Plan

Ann Arbor District Library board meeting (Sept. 24, 2012): The public session of Monday’s library board meeting lasted only 15 minutes. Although just six weeks remain before the Nov. 6 election – when voters will weigh in on a $65 million bond proposal for a new downtown library – that issue received scant mention.

But the bond proposal could be seen as the backdrop for a report by AADL director Josie Parker, who provided an update of the district’s five-year strategic plan, which the board adopted in 2010. Parker distributed a copy of the plan that highlighted achievements from the most recent fiscal year. “Our reach in the community is deep and it’s wide,” she said. “The strategic plan is our evidence.” [.pdf of highlighted strategic plan]

Board president Margaret Leary noted that as the community’s attention is rightly focused on the bond proposal, the goal of renovating or replacing the downtown building is only one item in the strategic plan. There are seven pages of actions that the library is taking, she said.

At last month’s board meeting Ellie Serras, chair of the Our New Downtown Library campaign committee, spoke during public commentary to brief the board on actions of that pro-bond group. And since then, two other efforts – to oppose the proposal – have emerged. A group called Protect Our Libraries was formed earlier this month. Its treasurer is Kathy Griswold, a former member of the Ann Arbor Public Schools board.

And Douglas Jewett, who had attended an August forum for potential AADL board candidates, filed paperwork on Sept. 25 for the Save the Ann Arbor Library ballot question committee. He did not file to run for the board. He previously had secured a sidewalk vendor permit on Aug. 20 for space in front of the downtown library at 343 S. Fifth. He uses the space to lobby against demolition of the current building, citing its architectural significance. The original portion of the building was designed by Alden B. Dow.

At the candidate forum, Jewett had praised the library, calling it the center of Ann Arbor. Four non-partisan board seats on the Nov. 6 ballot will be contested by five candidates: the four incumbents – Prue Rosenthal, Margaret Leary, Nancy Kaplan and Rebecca Head – as well as Lyn Davidge, who attended the Sept. 24 board meeting.

The positions will be elected by voters in Ann Arbor and portions of seven townships that are covered by the library’s district, in Pittsfield, Scio, Ann Arbor, Lodi, Webster, Salem and Superior. Those are the same boundaries served by the Ann Arbor Public Schools, with the exception of Northfield Township. The four-year terms begin Jan. 1, 2013. [Full Story]

City Council Punts on Several Agenda Items

Five significant items had been added: (1) a proposal to suspend temporarily the footing drain disconnection program in one area of the city; (2) a proposal to waive temporarily the city’s living wage requirement for certain nonprofits; (3) a proposal to establish a sidewalk gap elimination program; (4) a resolution on dealing with proceeds of city-owned land sales that competed with one already on the agenda; and (5) reconsideration of allocating $60,000 for a transit study – funding that the council had rejected at its previous meeting.

The first two items were added on Friday, Sept. 14. The second two were added the day of the meeting (Sept. 17), with the fifth item added at the council table. Of the added items, the council approved only one – to suspend temporarily the footing drain disconnect program. The rest were  postponed, withdrawn or voted down.

Postponed was the resolution added by Mike Anglin (Ward 5) to establish a committee of city officials and 10 residents – two from each ward, to be selected by councilmembers for respective wards – to address the issue of city-owned parcels in downtown Ann Arbor. The citizen committee to be established by Anglin’s resolution would study the available options for use of proceeds from the sale of downtown city properties.

Also postponed was the resolution that Anglin’s proposal was essentially challenging, which was brought forward by Sandi Smith (Ward 1). Smith wants to direct the proceeds from city-owned land sales to the city’s affordable housing trust fund. Her idea – which she first floated to her council colleagues in an email written in late August – enjoyed the support of nonprofits, as well as the Ann Arbor Downtown Development Authority board and the Washtenaw County board of commissioners.

While Anglin’s resolution was postponed until Oct. 1, Smith’s was referred to the council’s budget committee and postponed until the council’s Oct. 15 meeting.

Also postponed was a requested $60,000 contribution to fund further study of a transportation connector – for the corridor running from US-23 and Plymouth southward along Plymouth to State Street and farther south to I-94. The outcome of this phase is to identify a preferred choice of technology (e.g., bus rapid transit, light rail, etc.) and the location of stations and stops. The council had voted down the proposal at its Sept. 4 meeting, but it was brought back for reconsideration on Sept. 17, only to be postponed until Oct. 15. The $60,000 is meant to be the city’s share of a $300,000 local match for a $1.2 million federal grant that has already been awarded.

Withdrawn was the proposal to waive a requirement of the city’s living wage ordinance for those nonprofits that receive funding from the city to deliver human services. The ordinance has a provision for a hardship waiver, but states that a nonprofit must submit a plan for eventual compliance within three years. No nonprofits had submitted such plans, meaning that the council’s resolution would have amounted to an attempt by the council to amend the living wage ordinance through a simple resolution, which it cannot do. When the council reached the item on the agenda, it was withdrawn, with an indication that an ordinance revision would be brought forward to a future meeting.

Also at the Sept. 17 meeting, the council heard about an item related to nonprofit funding for human services that will be brought forward on Oct. 1: a request to continue the two-year pilot program for coordinated funding. That news came during a presentation from Mary Jo Callan, head of the city/county office of community and economic development.

Voted down was a plan to initiate a 5-year program to eliminate sidewalk gaps in the city. Councilmembers voting against the resolution pointed to the fact that the city’s non-motorized transportation plan takes a comprehensive approach to identifying such gaps. They feared that people might mistakenly believe that certain gaps would necessarily be filled through this program, and raised concerns about equity. The resolution sought to identify independent funding sources to pay for such projects – the city’s strategy in the past has been to levy special assessments on owners of property adjoining the sidewalks.

The footing drain disconnect program was the only one of the late additions to the agenda on which the council took final action. In the general vicinity of the Lansdowne neighborhood, where some houses have already had sump pumps installed as part of the disconnect program, residents have reported that during heavy rains, the overland stormwater flows and the sheer volume of water in the city’s stormwater system prevent sump pumps from being effective. At an Aug. 22 neighborhood meeting, residents had called for a moratorium on the program. That’s essentially what the council’s resolution did.

Flooding was also a topic included in other council business that had been placed on the agenda through the regular agenda-setting process. The council approved an update to the city’s hazard mitigation plan. It will allow the city to receive already-approved federal funds for demolishing two out-buildings located in the floodway at the city-owned 721 N. Main property.

Also related to emergency preparedness, the city council authorized the purchase of a light rescue vehicle that can be used by firefighters to respond to medical calls. Because its staffing requirement is just two firefighters instead of three, the use of the vehicle would allow response to medical calls without diminishing as much of the department’s response capability for fire calls.

The council also gave final approval to rezoning of an Eden Court property to public land. [Full Story]

County Board Puts Off Vote on Act 88 Tax Hike

The indigent veterans tax was uncontroversial. Several Vietnam veterans attended the meeting and spoke passionately about the need to support soldiers returning from Iraq and Afghanistan. The tax was increased to 0.0286 mills, to be levied in December 2012. The current 0.025 mills brought in $344,486 in 2012. The increased millage is expected to raise $390,340 in revenues for use during 2013.

But a proposal by Conan Smith to increase the Act 88 millage generated debate, primarily related to procedural issues. On Sept. 5, commissioners had given initial approval to a tax of 0.05 mills, unchanged from the current rate. At the time, Smith raised the possibility of an increase to 0.06 mills and a change in the way the millage revenues are administered, but he made no formal amendment. The board set a Sept. 19 public hearing for the 0.05 mills, and several representatives from groups that receive revenue proceeds spoke in favor of the tax.

Later in the meeting – after the public hearing – Smith made a formal motion to amend the resolution, raising the tax rate to 0.06 mills, a 20% increase that would bring in $838,578. Ronnie Peterson objected to the process, saying that although it might be legal, but was not moral. Wes Prater said the move lacked integrity. Smith argued that the law didn’t require any public hearing at all, and that the board was going above and beyond its obligations. He pointed out that he had notified commissioners of his intent on Sept. 5, and had passed out a memo about his proposal at the Sept. 6 working session. Ultimately, a majority of commissioners voted to postpone action on Smith’s amendment until Oct. 3, when they also voted to set a second public hearing on the 0.06 mills proposal.

Also generating considerable debate was a resolution related to animal control services. The resolution, brought forward by Barbara Bergman, directs county administrator Verna McDaniel to begin negotiations with the Humane Society of Huron Valley toward a new contract for services. It further states that if McDaniel doesn’t believe sufficient progress is being made by Oct. 30, then she’s authorized to issue a request for proposals (RFP) to seek bids from other organizations. It passed on a 10-to-1 vote, with dissent from Alicia Ping.

Much of the debate over the second resolution centered on the fact that formal recommendations from the tasks force haven’t yet been presented to the board. There were also questions over how much flexibility McDaniel will have in her negotiations. The current 2013 budget has allocated $250,000 for animal control services. This year, the county is paying $415,000 to HSHV, down from $500,000 in 2011. Commissioners expect that the final amount negotiated for 2013 will be higher than the budgeted $250,000 – and if that’s the case, the board will need to amend the budget.

Ping objected to the process, saying that it could undercut HSHV’s position if the board eventually decides to issue an RFP, because other bidders would know how much HSHV is willing to bid. She also objected to taking action without knowing the task force recommendations. “This whole process is flawed on its face,” she said.

The board took a range of other actions, including changes to an ordinance for the county’s natural areas preservation program. Commissioners eliminated a previous restriction that only 7% of millage funds could be used for management or stewardship. In addition, they approved an amendment by Conan Smith eliminating a separate requirement for allocating 75% of the millage to the acquisition and maintenance of natural areas and 25% for agricultural land. Now, allocations can be made at the discretion of the county parks and recreation commission.

Commissioners approved a variety of state grant applications and reimbursements, as well as the 2012-2013 budget for its community support & treatment services (CSTS) department. Three resolutions of appreciation were also presented during the meeting – to Rodney Stokes, former director of the Michigan Dept. of Natural Resources; Susan Sweet Scott, a long-time county employee; and the Ann Arbor alumnae chapter of Delta Sigma Theta Sorority for 50 years of service in Washtenaw County. Round One of Building Demolition Hearings

And at its Aug. 9, 2012 meeting, the council authorized signing contracts with four different demolition companies to do the work on an as-needed basis.

That set the stage for the building board of appeals to hold a first set of four show-cause hearings earlier this month.

If the board finds that the property in question is a dangerous building under the city’s ordinance and Michigan’s building code, and orders the property demolished, then a property owner has 20 days to undertake the demolition or appeal the board’s ruling to the circuit court.

Because the city now has demolition companies under contract and the funds set aside to pay for upfront costs, it can back up the demolition order if a property owner fails to comply with it – by going ahead and taking the building down. Although the city would pay the initial cost, the property owner would be assessed and invoiced for the cost of the demolition, which includes an administrative fee.

So it’s more cost-effective for property owners to demolish buildings themselves, compared to having the city do the work. When the owner of one of the four condemned properties arrived late a few minutes after the Sept. 13 hearings had concluded, Ann Arbor’s chief building official Ralph Welton told him: “We’d much rather you knock it down.”

That property was a residential garage, located at 2415 Dorchester Road in the southeastern quadrant of the city. The garage has apparently become a home to chicken hawks, which roost in the open roof.

The other three properties on the board’s agenda included two houses – one at 3123 Cherry Tree Lane, off Packard near US-23, which had additional construction done on the property in a non-compliant way, resulting in conditions the city found to be dangerous. The other house on the board’s agenda was 3010 Dexter Road, on the city’s west side.

In fairly straightforward fashion, the board found all three residential properties to be dangerous buildings under the local and state code, and called for their demolition.

The one property for which a representative of the owner was on hand was 175 N. Maple, where a former Chinese restaurant is located inside the Maple Village shopping center. That hearing took the longest of the four. The back-and-forth between the owner’s representative and the board resulted in a 30-day timeframe set by the board for a plan to be submitted to rectify the conditions, and subsequent to that plan approval, a 60-day window to effect the remedy. The owner’s representative came from Brixmor Property Group, a portfolio company of the Blackstone Group real estate fund.

It was evident that the board was handling the first round of show-cause hearings for the city’s recent efforts. To craft the wording of the board’s first motion of the meeting required a group effort, including much consultation with city attorney staff and Welton. [Full Story]

EPA, Others Object to Whitewater Project

Four entities – including the federal Environmental Protection Agency and the local Huron River Watershed Council – have filed letters of objection with the state of Michigan to a project that would add a recreational section of whitewater along the Huron River, next to the new Argo Cascades.

Colin Smith, Ann Arbor’s parks and recreation manager, informed the park advisory commissioners about the opposition at PAC’s Sept. 18, 2012 meeting, describing the news as “not especially positive.” Other letters filed against the project were from the state Dept. of Natural Resources fisheries division and the U.S. Fish & Wildlife Service.

The project requires a permit from the Michigan Dept. of Environmental Quality (MDEQ) because it affects the Huron River, a state waterway. The project was originally approved by the Ann Arbor city council in 2010, as part of a larger effort that included building the Argo Dam bypass, which wrapped up earlier this year. Subsequent to that council approval, DTE Energy offered to pay for and oversee the whitewater aspect, to coordinate it with environmental remediation work that’s taking place on property it owns along that stretch of the river, just downstream of Argo Dam.

DTE is the applicant for the whitewater permit, although the company is working closely with the city on the project. The city is interested in acquiring the DTE property along the Huron after remediation is completed – and it’s hoped that the company might gift it to the city as a park.

Smith told PAC members that the EPA objection – because it comes from a federal environmental oversight agency – has triggered a process that might stop the project. The EPA filed its letter on Aug. 15. From that date, the MDEQ has 90 days [until Nov. 13] to resolve the EPA’s concerns with the applicant.

The EPA’s letter from Tinka Hyde, director of the agency’s water division, states that the project could significantly degrade the Huron River by inhibiting fish passage and increasing the water velocity, which in turn could affect sediment flow and degrade the stability of that section of the river. Another concern cited is that the project could constrain public use of the river. Because of these issues, the EPA believes the project does not comply with the federal Clean Water Act. Similar concerns were cited in the other letters of objection. Additional issues raised include water quality concerns that could affect the health of those using the whitewater area, who might come in contact with E.coli in the river; and exacerbated flow problems during drought periods. The DNR fisheries letter – signed by Jeffery Braunscheidel, senior fisheries biologist – also alludes to the contentious “dam in/dam out” debate involving Argo Dam. Structures used to create the whitewater are in essence dams, he stated, and the division does not support new dam construction. “Planning should provide for a naturally functioning system below Argo Dam as history has made clear that, at some point in time, the Argo Dam will be modified or removed. Impediments should not be constructed in the river that the public will again be asked to address.”

But it’s the EPA’s objection that carries the most weight. If the EPA does not withdraw its objection and the MDEQ still decides to grant the permit, then DTE would also need to seek a permit from the U.S. Army Corps of Engineers before the project can move forward. [Full Story]

County Parks OKs More Natural Area Funds

Washtenaw County parks and recreation commission meeting (Sept. 11, 2012): Commissioners took another significant step toward receiving a $2.275 million $975,000 grant from the Michigan Dept. of Natural Resources Trust Fund to buy land for the Arbor Vistas Preserve natural areas connector – by approving $975,000 in matching county funds for the project. The property is located in Ann Arbor Township.

In other action related to natural areas preservation, WCPARC gave initial approval to commit $109,864 to purchase a conservation easement on 124 acres of the Donald Drake property in Lodi Township; and $64,200 toward the purchase of a conservation easement on 73 acres of the Hornback property in Salem Township. Both deals are in partnership with the Ann Arbor greenbelt program.

The commission also approved staff recommendations to increase spending by $522,260 – bringing the total to $1.4 million – on the River Terrace section of the Border-to-Border Trail in Dexter. And the group approved up to $205,587 to replace the pedestrian bridge at Sharon Mills Park, in southwestern Washtenaw County.

Several written financial reports on claims paid and fund balances for parks & recreation functions were approved. The commission also was briefed on a record-setting numbers of users and revenues at the county’s major outdoor parks & recreation facilities this summer – at Independence Lake Park, Pierce Lake Golf Course, and Rolling Hills Park and its water park. However, revenues and attendance for the Meri Lou Murray Recreation Center have declined.

During its Sept. 11 meeting, the commission passed a resolution of appreciation for the public service career of Rodney Stokes, former director of the Michigan Dept. of Natural Resources. Bob Marans, WCPARC’s president, noted that Stokes has helped Washtenaw County secure millions of dollars in state DNR trust fund grants over the years. Stokes is expected to attend the Sept. 19 meeting of the Washtenaw County board of commissioners, when a similar resolution of appreciation is on the agenda. [Full Story]

Task Force: Negotiate with Humane Society

Washtenaw County board of commissioners – animal control policy task force meeting (Sept. 13, 2012): With five of 11 county commissioners present, a task force for developing policies on the county’s animal control services thrashed through a list of recommendations to make to the full board, possibly at its Sept. 19 meeting.

But at the end of the two-hour task force session, commissioners also opened the door to start direct negotiations with the Humane Society of Huron Valley, rather than pursuing a request for proposals (RFP) from other vendors. For many years HSHV has held the contract to provide services to the county, including those that are state-mandated. Its current contract expires on Dec. 31, 2012. Key points of contention have been the amount that the county is willing to pay for animal control services, both mandated and non-mandated, and how much those services actually cost.

In advocating for negotiations with HSHV, Rolland Sizemore Jr. expressed concern that if the board pursues the RFP process, a service provider won’t be lined up by the end of this year. Then the county will be in the same position it was in the beginning of 2012 – scrambling to get a new contract. He also pointed out that if the county issues an RFP and no other organizations respond, then the HSHV will have more leverage over the county “because they’ll know we’re screwed.”

Tanya Hilgendorf, HSHV’s executive director, supported starting contract negotiations. She attended the Sept. 13 meeting and praised the work of the task force as well as a separate group led by sheriff Jerry Clayton, which has been analyzing costs for animal control services. People are more informed than they were when this process began in May, she said, adding that there was more trust between the county and HSHV, too.

At least one commissioner, Barbara Bergman, had explicitly stated earlier in the meeting that she didn’t trust HSHV yet. She said the last time that the county had trusted HSHV, commissioners didn’t get good data about the services that were being provided, and the cost of those services. Bergman – who had left the meeting by the time a suspension of the RFP process was discussed – has been a strong advocate for curbing costs related to animal control, in favor of funding programs for human services.

The task force reached consensus on eight recommendations for animal control services to include in an RFP, or for a contract with HSHV. Those include licensing all dogs at the point of adoption or recovery, holding all stray animals for the minimum number of days required by law, and providing animal cruelty investigations.

The group also reached agreement on broader policy recommendations, including several longer-term goals: creating a civil infractions ordinance and fee structure for unlicensed dogs, and working with local units of government to create a unified, countywide dog licensing program. Currently three other jurisdictions – Ann Arbor, Ypsilanti and Ypsilanti Township – have their own dog licensing programs, with varying fee levels.

Several other changes might be proposed in the future. Hilgendorf offered to draft language for an ordinance prohibiting ownership of certain types of exotic animals. She also hoped that commissioners eventually would consider an anti-chaining ordinance and spay/neuter ordinance – “even if it’s just for pit bulls,” which has worked well in Ypsilanti Township, she said. [The township has an ordinance requiring that pit bulls must be spayed or neutered.] Hilgendorf also suggested addressing the issue of feral cats, which are a problem in some parts of the county. HSHV already operates a “trap, neuter, return” program aimed at curbing the feral cat population.

When the task force was formed earlier this year, it were given a deadline of Oct. 15 to bring recommendations to the full board. It’s likely that will happen sooner, possibly at the board’s Sept. 19 meeting. As of Sept. 16, however, there was no agenda item for these recommendations on the board’s ways & means committee agenda or the regular board agenda.

Municipal Math: How Fast Can You Re-Count?

Editor’s note: This is an occasional column that presents simple math puzzles stumbled over by The Chronicle “in the wild,” while covering local government. The puzzles are meant to be accessible to kids in high school, junior high, or elementary school.

Tick marks like these are the same technique used to recount elections.

On Aug. 7, 2012, ballots were cast in primary elections – to finalize the ballot choices for voters in the Nov. 6 general election.

And  last week, on Sept. 4, 2012, the Washtenaw County board of canvassers conducted a recount of some of those ballots. Several different races were recounted, including some from Augusta Township, Sylvan Township, the city of Ypsilanti, and the city of Ann Arbor.

In the city of Ann Arbor, it was the Ward 4 city council contest that was recounted. That race had offered a choice for voters between incumbent Margie Teall and Jack Eaton.

The initial count of ballots across Ward 4 showed Teall with a total of 866 votes, compared to 848 votes for Eaton. That’s a difference of 18 votes. Another way of putting that: There was an average difference of exactly two votes per precinct in Ward 4. [Warm-up puzzle: How many precincts are in Ward 4?]

In the recounted totals, each candidate lost a vote in Precinct 9. In Precinct 6, Teall picked up one vote and Eaton lost one. That left Eaton and Teall with 846 and 866 votes, respectively. So the hand-counting of the paper ballots essentially confirmed the result of the optical scanners used on election day.

I’ve now covered four recounts for The Chronicle in the last five election cycles. At a recount event, as many as four separate tables might be set up in the room. Of course, the candidates in the races being recounted and their supporters are interested in watching the recounting of the ballots – to make sure everything is done properly. So it’s typical that four or five people stand around each of the tables watching the recounting as it takes place.

The actual recounting of the ballots for a given precinct is done by three people seated at the table. One person examines each paper ballot and calls out the name of the candidate who received a vote. The two other people each record a tally mark on a grid. At the end of the recounting, the hand-recorded totals on the two grids must match each other. If they don’t, everything must be re-recounted.

So the recounting procedure depends on the ability of the talliers to hear the person who is calling out the candidate name for each ballot. Because of that, everyone in the room always observes strict silence, without even being told by members of the board of canvassers that they must be quiet.

I’m kidding. It’s always necessary for a member of the board to shush everyone – more than once. That’s because we all fall prey to the belief that we can have our own side conversations that are quiet enough not to disrupt the counting – unlike those other loudmouths.

One reason those side conversations take place is that people need a way to pass the time. That’s because watching a recount is just plain boring. (That’s how you know it’s important.) So as you’re standing there watching, you start to wonder: How long is this going to take?

And as you look at the number of people assembled in the room, some of whom are being paid $12 an hour to do the recounting, you also wonder: How much is this going to cost? [Full Story]

County Tax Hike for Economic Development?

Washtenaw County board of commissioners meeting (Sept. 5, 2012): Board chair Conan Smith has floated a proposal to raise taxes that support economic development and agricultural programs, and suggested revising the way those revenues are administered.

The proposal came in the context of an initial board vote to levy an annual tax of 0.05 mills, unchanged from the current rate. The Michigan statute authorizing this millage (Act 88 of 1913) predates the state’s Headlee Amendment, so no voter approval is required. The board can levy the tax directly.

Ken Schrader, a PC technician with Washtenaw County, explained to the county commissioners that recently installed new microphones are more sensitive than the older ones. He jokingly warned them that they should be careful what they say now, because “you can’t take anything back.” Later in the meeting, the county’s information technology department was presented with an award from the Center for Digital Government.

The current rate is expected to bring in about $683,095 in 2013, and is allocated to a variety of organizations, including the economic development agency Ann Arbor SPARK ($200,000) and its Ypsilanti office SPARK East ($50,000). Smith and county administrator Verna McDaniel serve on SPARK’s executive committee.

Smith, a Democrat from Ann Arbor, suggested that by raising the rate to 0.06 mills, property owners would see only a slight increase in their annual taxes. For the average taxpayer, he estimated it would increase from $4.25 to $5.10 per year, while the amount raised countywide would increase about 20% to $838,577. He also proposed that the office of community and economic development – a joint county/city of Ann Arbor department led by Mary Jo Callan – should be given the authority to allocate the funding, rather than having the county board earmark amounts for specific organizations.

No formal amendment was made, but Smith circulated a three-page memo the following night outlining his proposal. [.pdf of Smith's Act 88 memo] It’s likely the board will take up this proposal as an amendment before a final vote at its Sept. 19 meeting. Initial approval was given on Sept. 5 for the current rate of 0.05 mills on a 7-to-3 vote, with dissent from Alicia Ping, Wes Prater, and Dan Smith. Ronnie Peterson was absent.

Another pre-Headlee tax – for support of indigent veterans – also got initial approval from the board, at a slightly increased rate. The initial approval increases that tax from 0.025 mills to 0.0286 mills. Staff of the county’s department of veterans affairs say the increase is needed because of rising claims and services from veterans due to a struggling economy, an anticipated increase in the number of returning soldiers, and a drop in property values. The millage is expected to raise $390,340 in revenues during 2013.

In other action related to tax revenue, commissioners gave initial approval to an ordinance governing the county’s natural areas preservation program. The change would remove the current restriction that only 7% of millage funds can be used for management or stewardship. The intent is to provide more flexibility in managing the funds, allowing the county to build a reserve for long-term stewardship. It’s viewed as an important goal, in the event that the NAPP millage is eliminated in the future. Yousef Rabhi, a Democrat who represents District 11 in Ann Arbor, proposed an amendment that would set a minimum of 25% to be spent on stewardship. The amendment failed on a 1-9 vote.

In an item viewed largely as a formality, county commissioners “ratified” the articles of incorporation for a new countywide transit authority. The document had been slightly revised from what the board had previously approved on Aug. 1, 2012 – on a 6-4 vote. This time, the vote was 6-3, with dissent from Alicia Ping, Wes Prater and Dan Smith. Rolland Sizemore Jr. and Ronnie Peterson were absent. Rob Turner, who had previously voted against the articles of incorporation, supported the item on Sept. 5.

Also approved was a resolution to support a policy change in the city of Ann Arbor related to affordable housing. The item was added to the Sept. 5 agenda during the meeting by Democrat Leah Gunn of Ann Arbor, and was not discussed by commissioners at the meeting. The resolution “encourages the Ann Arbor City Council to direct proceeds from the sale of the city-owned surface parking lots in the downtown to the city’s Housing Trust Fund, to be used to support sustainable, affordable housing.” [Earlier in the day, the Ann Arbor Downtown Development Authority board had passed a similar resolution of support. Gunn is chair of the DDA.] Dan Smith abstained from the vote. The following night, at a board working session, Alicia Ping announced that she had intended to vote against it, but had cited the wrong agenda number in casting her no vote.

Other action at the Sept. 5 meeting included initial approval of the county’s public health budget, which projects a 3.5 net increase in jobs. Voting against the budget were Alicia Ping and Dan Smith, who cautioned against adding new jobs as the county faces a deficit in 2013. A final vote is expected at the board’s Sept. 19 meeting.

Seth Best, a former resident of Camp Take Notice, addressed the board during public commentary about the need to tackle the root causes of homelessness. The homeless encampment had been evicted this summer from its most recent site in Scio Township.

And highlighting a letter that the county had recently received, commissioner Felicia Brabec raised concerns about the intent of Paxton Resources LLC to drill an exploratory oil and gas well in Saline Township. The board will likely revisit the issue of hydraulic fracturing, or “fracking,” at a future working session. Yousef Rabhi, who chairs those meetings, suggested wrapping it into a session he plans regarding the Pall/Gelman Sciences 1,4 dioxane plume. He sees a tie-in to the issue of industrial environmental contamination. [Full Story]

AATA Budget Preview: No Deficit

A small $22,692 surplus is projected in the draft budget of the Ann Arbor Transportation Authority for its upcoming fiscal year, which begins on Oct. 1, 2012. The budget is attached to the Ann Arbor city council online agenda for its Sept. 17 meeting. It shows that the AATA is expecting the 2013 fiscal year essentially to balance expenses against revenues in an overall operating budget of $33,344,048.

That’s an increase of around $3 million over the current year’s budget, which called for the AATA to spend $30,410,622 against only $29,418,998 in revenues. The nearly $1 million planned deficit for that fiscal year – which ends on Sept. 30, 2012 – was previously characterized by the board as a way to “catapult” the organization forward by offering some increased levels of service, in advance of AATA’s possible transition to a new, broader transit authority. Despite budgeting for that $1 million deficit, current projections included in the FY 2013 budget show that the AATA now expects to finish FY 2012 with a much smaller deficit of $296,378 – about one-third of what was projected.

For the new FY 2013 budget, an increase in revenues is accounted for in part by increased passenger revenues. Increased ridership is expected to generate about $750,000 more in fares in the coming year, compared to the fares collected in the fiscal year that’s nearing its end on Sept. 30. The AATA is also budgeting for about $300,000 more in state operating assistance for FY 2013. And the AATA anticipates about $3 million more in federal operating assistance, compared to what it actually received in the current fiscal year. A chunk of that is for a connector study from the northeastern part of the city to its southern edge.

Ann Arbor’s local transit tax, levied at a rate of just over 2 mills, is expected to show stable revenue levels compared to FY 2012, generating about $9.3 million. For the coming year, the AATA does not expect to use any of the local tax levy to help fund commuter express services from Canton and Chelsea, as it has since launching the service. Instead, the AATA will be using $105,217 of federal funds to cover that cost. Responding to an emailed query from The Chronicle, AATA controller Phil Webb explained that the AATA is taking advantage of newly expanded regulations that allows up to $1.47 million of AATA’s programmed federal funds to be used to pay for early investments in the AATA’s 5-year transit program. The AATA released the final draft of that plan on Sept. 5, 2012. [Full Story]

Zoning, Transit Focus of Council Meeting

Ann Arbor city council meeting (Sept. 4, 2012): The council handled a mixed bag of items at its most recent meeting, ranging from land use to community events funding.

One item was apparently not handled the way that the majority of the council wanted, due to the absence of two councilmembers – Carsten Hohnke (Ward 5) and Marcia Higgins (Ward 4).

That item was a $60,000 appropriation – the city’s portion of a $300,000 local match for continued study of the Plymouth/State corridor, from US-23 and Plymouth southward along Plymouth to State Street, extending south to I-94. The local match is needed for a $1.2 million federal grant that has been awarded for the study. This alternatives analysis phase follows a basic feasibility study. The current study is supposed to result in a preferred choice of technology (e.g., bus rapid transit, light rail, etc.) as well as identifying stations and stops.

Because the $60,000 transfer from the general fund was a change to the city budget, it needed the votes of eight members on the 11-member city council. When Mike Anglin (Ward 5) led off the roll call by voting against it, it was clear that the council would have no more than seven votes in favor – because Jane Lumm (Ward 2) had already made plain during deliberations that she’d be voting against it. So some councilmembers voted against the resolution in order to be on the prevailing side. That gives them the right under parliamentary rules to bring back the item to the council’s next meeting for reconsideration. At that meeting it’s possible, but not certain, that supporters of the funding will have the necessary eight votes.

Several items on the agenda dealt with land use. The council gave final approval to a rezoning request for Knight’s Market, which will allow for expansion of the market at Spring and Miller streets. Winning initial approval was a rezoning requested by the developer of proposed townhouses on Catherine Street – from its current planned unit development (PUD) zoning to R4C (multi-family residential). Rezoning for part of a parcel in connection with a planned Speedway gas station at Maple and Miller also got the council’s initial approval. A related site plan for the station got its one and only required approval.

Also connected to land use was the council’s addition of two more properties to the greenbelt, using about $0.5 million in city funds from the open space and parkland preservation millage. The land from the two properties totals around 226 acres. Lumm cast a lone vote of dissent.

The council also authorized disbursements of community events funds to 13 organizations totaling $44,778, the bulk of which went to the Ann Arbor Summer Festival’s Top of the Park.

And the council set a public hearing for Oct. 1 on a tax abatement for Barracuda Networks. The firm is relocating to downtown Ann Arbor from its current location on Depot Street, in part to accommodate an additional 144 employees it expects to hire by July 1, 2014. [Full Story]

Greenbelt Group Briefed on Strategic Plan

It’s been three years since the strategic plan was last updated. In this latest version, no major changes are being made to the program’s existing priorities: protecting large blocks of farmland as well as natural areas in the Huron River watershed, and building partnerships to leverage other funding sources.

In addition to those, a new priority is being added: Educating Ann Arbor residents about the program’s efforts, and reaching out to landowners in the greenbelt to ensure that the flow of applications continues. [.pdf of revised strategic plan]

Commissioners gave additional feedback at their meeting, and the plan will be sent to funding partners for their input too. The greenbelt advisory commission is expected to vote on the final plan at its Oct. 4 meeting.

The group also weighed in on designs for a new logo to help brand Ann Arbor’s greenbelt program. The design is intended to show the connection to the city, as well as images representing both farmland and natural area preservation. There’s space for logos of partner entities, and text that indicates what kind of land is being preserved and whether the land is private or public. The intent is to use this image on signs at the properties that are protected by the greenbelt program, and on brochures and other materials.

In updates to the commission, Ginny Trocchio – who is the program’s support staff – highlighted plans to hold another bus tour of greenbelt properties on Saturday, Sept. 22. The trip will focus on the eastern portion of the greenbelt, and its connection to the Superior Greenway. She also noted plans to participate in the Sept. 8 HomeGrown Festival, an event showcasing local food.

In their main action item, commissioners voted to recommend that the city council partner with Washtenaw County and Webster Township, contributing 25.5% toward the purchase of a parcel identified as application number 2005-08. (The first four numbers signify the year in which the application was made.) Tom Bloomer abstained from the vote. He owns Bur Oaks Farm in Webster Township, and serves on the township’s farmland and open space board. He did not indicate his reason for abstaining.

Two days earlier, the city council had approved two purchase-of-development-rights (PDR) deals that GAC had previously recommended: the 90-acre Alexander farm in Webster Township, and a 136-acre property owned by Robert H. Schultz in Superior Township. Jane Lumm (Ward 2) voted against both deals, citing concern that no local partners contributed to the land preservation efforts. Both deals include federal grants to cover a significant portion of the costs. [Full Story]

Ann Arbor DDA Board Addresses Housing

Ann Arbor Downtown Development Authority board meeting (Sept. 5, 2012): The only agenda item requiring a vote by the board was a resolution encouraging the Ann Arbor city council to adopt a policy that would direct proceeds from the sale of city-owned land to support affordable housing. And board members voted unanimously to support the resolution, which DDA board member Sandi Smith had brought forward. Smith, who also represents Ward 1 on the Ann Arbor city council, is planning to bring the policy resolution to the council for consideration at its Sept. 17 meeting.

DDA board members were positively inclined toward their own resolution, but sought to clarify that the “proceeds” meant net proceeds – that is, whatever is left after any debt associated with city-owned land is paid off. The loan for the city’s acquisition of the former YMCA lot, for example, still has a principal of $3.5 million associated with it. Smith indicated at the meeting that the resolution she brings to the council might involve the DDA forgoing the repayment on investments it has made in city-owned property – like interest payments on the former YMCA lot or the demolition costs associated with that property.

The board also made an amendment to the resolution during the meeting, adding the phrase “a percentage of [proceeds].” The change gives the council flexibility to adopt a policy that doesn’t require the entire amount of the net proceeds to be directed to the affordable housing trust fund.

At the Sept. 5 meeting, the board also heard a request from the executive director of the Ann Arbor Housing Commission, Jennifer L. Hall, for a $260,000 allocation from the DDA’s own housing fund. The DDA has a housing fund that’s not necessarily dedicated to affordable housing. But the request Hall was making was for Baker Commons, a public housing project located within the DDA’s geographic district, at Packard and Main. The money would primarily go toward replacing the roof with one made of metal.

The board also got its regular update on the parking system. The basic message: revenue is up, and usage is up. The board also had a look at the unaudited financial figures for the end of fiscal year 2012, which concluded on June 30. Except for capital expenses, which were less than budgeted, most categories were on target. The DDA had budgeted all expenses for the new Library Lane parking structure for that fiscal year, but not all invoices have come in yet.

The board was also updated on a possible change to the way that transportation planning and funding takes place in Washtenaw County. Discussions by the policy board of the Washtenaw Area Transportation Study (WATS) suggest the  possibility that Washtenaw County could form its own metropolitan planning organization (MPO). Currently, the Southeast Michigan Council of Governments (SEMCOG), which includes a total of seven counties, serves as the MPO  for Washtenaw County. The change would affect how federal transportation funding is administered locally. [Full Story]

AATA 5-Year Program: May 2013 Tax Vote?

According to a press release announcing the 5-year service plan’s final draft, a millage to support The Washtenaw Ride could be placed on the ballot by May 2013.

The estimated cost of the service in the plan is now 0.584 mills, an increase of 0.084 mills compared to the estimated cost in a draft plan that was released in April. Compared to the draft plan, the final version also includes several additional services, which were added based on input from district advisory committees (DACs).

The 5-year service plan includes: (1) countywide demand-responsive services and feeder services; (2) express bus services and local transit hub services; (3) local community connectors and local community circulators; (4) park-and-ride intercept lots; and (5) urban bus network enhancements. For Ann Arbor, the program includes increased bus frequencies on key corridors, increased operating hours, and more services on weekends. According to the Sept. 5 press release, Ann Arbor and Ypsilanti will get a 56% increase in service hours compared to current levels.

The possible transition from the AATA to The Washtenaw Ride will take place under the framework of a four-party agreement between the city of Ypsilanti, the city of Ann Arbor, Washtenaw County and the AATA.

The other vote taken by the AATA board at its Sept. 5 meeting stemmed from a formal protest in connection with the AATA’s award of a contract for handling advertising on its buses – to CBS Outdoor Advertising of Lexington, New York. The contract previously had been held by Transit Advertising Group Ann Arbor (TAG).

TAG president Randy Oram addressed the board during public commentary at the Sept. 5 meeting. Also during the meeting, AATA CEO Michael Ford pointed the board to his written response to the protest and asked board members to uphold his decision to award the contract to CBS. The board voted in a formal resolution to support the advertising contract award to CBS. [Full Story]

Park Commissioners: More Green, Please

Ann Arbor park advisory commissioners had a wide-ranging conversation on Tuesday, Sept. 4, 2012 – mostly focused on responding to a Connecting William Street presentation that was made at PAC’s Aug. 21 meeting.

Their consensus: That the potential development scenarios presented by the Ann Arbor Downtown Development Authority – focused on five city-owned properties along William Street – did not include sufficient parkland or green space.

Commissioners plan to craft a resolution for their Oct. 16 meeting, recommending that the DDA incorporate more green space into its final proposal to the city council. The council had directed the DDA to develop a coordinated planning approach for the five sites, to guide future development. The parcels include the lower level of the Fourth & William parking structure, plus four surface parking lots: (1) the Kline’s lot on Ashley; (2) the lot next to Palio restaurant at Main & William; (3) the old YMCA lot between Fourth and Fifth; and (5) the top of the Library Lane underground parking garage on South Fifth, north of the downtown library.

PAC’s resolution will also likely suggest specific attributes they’d like to see in a downtown park, such as grassy areas, interactive sculptures, or a performance space. Other attributes might include a visible location with mixed-use development around it, and programming or activities to attract people to the site.

Despite consensus that more green space is needed, commissioners were less unified about where that green space should be located, and expressed some frustration that they didn’t have more time for this task. One possibility discussed was a downtown greenway, making connections between different parcels where pedestrians could walk from Main Street to the library on South Fifth, and possibly continuing to State Street.

Other ideas included setting aside one of the five sites – either Main and William, or Fifth and William were suggested – as a park. Commissioners also discussed a possible park or plaza on the Library Lane site. There was some sentiment that having an outdoor space next to the library would be positive, though they acknowledged the concerns raised by library officials about putting a park there.

Liberty Plaza, one of the city’s current downtown parks, was part of the mix, although it’s not included in the Connecting William Street project. Commissioners have been asked by mayor John Hieftje to look at that park and some staff suggestions for improving it. More broadly, Hieftje has asked PAC to help prioritize the needs for downtown parks and the possibility of adding more parks into the system.

Colin Smith, Ann Arbor’s parks and recreation manager, encouraged commissioners to review the city’s parks and recreation open space (PROS) plan, which includes recommendations for downtown parks. Some of these issues have been discussed for years, he noted, and it’s important not to “reinvent the wheel.”

The follow-up discussion to requests from Hieftje and the DDA was held at PAC’s land acquisition committee meeting on Sept. 4 in the city council workroom. It was attended by seven of the nine park commissioners: Julie Grand, Ingrid Ault, Tim Berla, Tim Doyle, Alan Jackson, John Lawter and Karen Levin. Not at the meeting were the two city councilmembers – Mike Anglin and Christopher Taylor – who are ex-officio members of PAC.

Also absent was Bob Galardi, the commission’s most recently appointed member. His absence was noted by some commissioners, who had hoped to hear his perspective as a member of the DDA’s leadership and outreach committee for the Connecting William Street project. [Full Story]

County Parks & Rec System Plans for Future

On Sept. 5, 2012, the Washtenaw County board of commissioners will consider amending an ordinance for the county’s natural areas preservation program. The intent is to create more flexibility in setting aside funds for stewardship, with the goal of eventually building a $6 million fund for ongoing maintenance of county preserves.

Since the NAPP initiative was established in 2000, nearly 2,500 acres of land have been preserved countywide. The millage-funded program is overseen by the Washtenaw County Parks and Recreation Commission (WCPARC), a body appointed by the county board that also oversees the much older parks and recreation system, which was established in 1973.

WCPARC also partners with other organizations on special initiatives, including the countywide Border to Border Trail, (B2B), the Connecting Communities program, and planning for an east county recreation center on Michigan Avenue in Ypsilanti. That center’s planning effort is also taking another step forward this month, with WCPARC staff holding an open house on Thursday, Sept. 27 to review two design options for the center. The open house will be held at Spark East (215 W. Michigan Ave. in Ypsilanti) from 3-8 p.m., with formal presentations at 4 p.m. and 8 p.m.

In the context of current proposals – the NAPP ordinance change and possible new recreation center in Ypsilanti – this report looks at the history, budget, and scope of the county parks and recreation system, as well as its master planning for the future and its partnerships with local, state and national organizations with a similar purpose. Municipal Math: How Tall Is the Schoolhouse?

Today marks the first day of classes for students in the Ann Arbor Public Schools and many other local districts.

So I’m taking advantage of the occasion to launch an occasional series that is meant to present math puzzles I’ve stumbled over “in the wild,” in the course of covering local government. It will appear only as time allows, so this could very well be the only installment of the series.

The puzzles are meant to be accessible to kids in high school, junior high, or elementary school – so for many Chronicle readers, they will be trivial.

But these puzzles might offer readers’ children a chance to apply what they’ve learned in math class to an actual, authentic real-life example – drawn from the municipal workings of the city in which they live.

Today’s puzzle has a geometric flavor. The basic question: How tall is the schoolhouse in Figure 1?

First, let’s please agree not to argue about the quality of the drawing. I admit that it may look more like a church than a schoolhouse. I took as my starting point a photograph included in a recent piece by local history columnist Laura Bien.

The drawing is not Laura’s fault, of course. The drawing differs from that photo in many ways. For example, the drawing lacks a belfry and an American flag on the roof. I left them out, because they make the math puzzle more complicated than necessary.

Another reason I left them out: The real-world example – on which the puzzle is based – was not a schoolhouse. I chose a schoolhouse for the drawing just to honor today as the first day of school. The real world-example is a two-building apartment complex called City Place, located on South Fifth Avenue, just south of William Street.  [Full Story]

Food Gatherers hopes to expand its large warehouse, adding cooler and freezer space to accommodate its focus on fruits, vegetables and other fresh food. The Carrot Way site, on Ann Arbor’s far north side, is a hub for the nonprofit’s food distribution – staff and volunteers distributed about 5.75 million pounds tons of food in the last fiscal year to those in need. Several commissioners praised the work. They had only a few questions or comments about the project, including a suggestion to use graywater for irrigating gardens on the site.

Also winning approval was a plan to build a new Fiat showroom next to the post office on West Stadium Boulevard, now owned by the Suburban Collection of Troy. The color scheme for Fiat is scarlet and gray, which elicited some ribbing from commissioners that the building’s designer had heard before. And no, he said, there’s no maize-and-blue dealership being planned for Columbus, Ohio.

The third project on the commission’s Aug. 21 agenda was also competitively colored: Changes in the site plan for Plymouth Green Crossings. The owner is asking for several alterations to a 2006 plan – adding parking spaces, eliminating a proposed freestanding restaurant, and more than doubling the permitted amount of space that can be used for restaurants on the site. Currently, the complex includes a bank and two mixed-use buildings with housing and retail/commercial businesses.

City Council to Focus on Land Sale Policy

In the coming weeks, the Ann Arbor city council will be taking up discussion of a policy that was changed a half-decade ago – as part of a land sale by the city.

A June 4, 2007 city council action authorized the sale of city-owned property on East Eisenhower for $23,750. But the council’s action that summer also included a “resolved” clause that rescinded the city’s policy dealing with the proceeds from the sale of city-owned land. As a result of that “resolved” clause, proceeds from the sale of city-owned land were no longer required to be deposited into the city’s affordable housing trust fund.

The city council will soon be reviewing that policy, with this possible outcome: It could again become official city policy that the proceeds from sales of city-owned land will be designated at least in part to support affordable housing.

Leah Gunn, chair of the Ann Arbor Downtown Development Authority board, conveyed news of the upcoming policy discussion to her colleagues at an Aug. 29 meeting of the DDA’s operations committee. But it’s Sandi Smith – a city councilmember representing Ward 1 and a DDA board member – who is leading the effort to reconsider the land-sale-proceeds policy. She emailed her colleagues on the city council earlier in the week alerting them of her intention to revisit the issue – with an action item to come at the council’s Sept. 17 meeting.

Gunn will be seeking support from the rest of the DDA board, encouraging the city council to revert to the previous policy in some form – so that proceeds from the sale of city-owned land are designated to support affordable housing. That resolution of support will be on the DDA board’s Sept. 5 meeting agenda. Gunn also indicated that she’d ask her colleagues on the Washtenaw County board of commissioners to pass a resolution of support for the city council to change the policy. The county board’s next meeting is also on Sept. 5.

Any change in the current policy will come in the context of the DDA’s current planning effort, called Connecting William Street, for five city-owned parcels in downtown Ann Arbor, some of which could eventually be sold.

The upcoming council discussion, focusing just on this policy, will take place five years later than Ward 3 city councilmember Stephen Kunselman had wanted. On June 4, 2007 Kunselman had objected to including the policy shift as one of many “resolved” clauses in a land transaction resolution, saying that it wasn’t consistent with transparent governance.

The motivation for the change in policy back in 2007 involved a desire to put the $3 million in proceeds from selling the First and Washington parcel toward the building fund of a new police/courts building (now officially dubbed the Justice Center). The property was sold to Village Green, which is currently constructing City Apartments, with 156 residential units and a 244-space parking structure on the bottom two floors. The parcel was previously the site of a 199-space parking structure. Of the 156 units in the City Apartments project, 16 are supposed to be affordable to those earning between 60-80% of the area median income (AMI) – a requirement of the project’s planned unit development (PUD) zoning.

Provision of “affordable” housing within a project like City Apartments is one of at least two different strategies used by the city to address the need for a diversity of affordable housing options. Another strategy is for a developer to make a payment in lieu of providing the units themselves – a payment that is deposited into the affordable housing trust fund.  The idea behind that strategy is that affordable units might be constructed more economically elsewhere, using money from the trust fund.

While downtown Ann Arbor is in some ways an ideal location for affordable housing – because it’s easier to provide supportive human services to those residents who need them – the cost of real estate in the downtown area is higher than elsewhere in Washtenaw County. That’s a secondary piece of the policy discussion that the city council will likely have about the land-sale-proceeds policy.

In a phone interview with Mary Jo Callan, head of the city/county office of community and economic development, she described how one of her first tasks since taking the position in 2007 was to find strategies for replacing the 100 units of single resident occupancy supportive housing in the former YMCA. Those units had been lost when the building – owned by the city at that time – was condemned and subsequently demolished. Since the city’s affordable housing trust fund’s inception, Callan said the fund has invested in 399 units of affordable housing.

A look back to the city council meeting on June 4, 2007 shows that local government today still deals with many of the same topics – dog parks, affordable housing, transparency. Although the origin of the land-sale-proceeds policy and its connection to affordable housing goes back even further, to 1996, we’ll begin this report with the June 2007 action.  [Full Story]

Column: How Many Daves of the Condor?

“I’m smarter than you.”

That’s an idea that defines the character of Ann Arbor better than anything you might read in a brochure, or see in a Pure Michigan video.

If you didn’t already know that, well, I guess that makes me … an Ann Arbor resident.

Besides writing op-ed pieces adorned with footnotes [1], another way Ann Arbor residents prove they are smarter than you is to deploy extraordinary words you’ve never heard before, possibly from a dead language – with an ever-so-slightly aggressive nonchalance, calculated to elicit from their listeners some kind of concession like “I’m sorry, but I’m not familiar with that term.” [Alternatively, super-long, syntacticky sentences.]

And then the conversation may continue along the lines of, “Oh, I’m sorry – I thought that expression was so common. But there I go again, just assuming that everyone is as … much a resident of Ann Arbor as I am.”

And those of us who observe these interactions, which depend on a carefully scripted casualness, wonder smugly to ourselves, “Does he not realize everyone can see exactly what he’s doing? I mean, it’s like he thinks he’s the only … person who lives in Ann Arbor!”

Many elected officials in Ann Arbor have a variant on this gambit, which involves not extraordinary bits of vocabulary, but perfectly regular words – to which some special technical sense is given, outside of any reasonable expectation. By way of example, the word “regular” itself has (apparently) a technical sense that can transform a special meeting of the city council into a “regular meeting.” That technical sense  of “regular meeting” can be paraphrased roughly as: Any meeting the city council chooses to label as “regular” by voting to label it as such in a formal resolution. [2]

Given that we all live here in Ann Arbor – i.e., we are all smarter than each other – local governance leads to arguments about the meaning of words, even those that are perfectly ordinary. By way of additional examples (beyond “regular” and “special”) these pairs might sound familiar to some readers: “sell” versus “lease”; “opinion” versus “memo” [3]; “committee” versus “work group” [4].

But at the most recent meeting of the city council, on Aug. 20, 2012, part of the argument at the council table depended crucially on the meaning of the word “many.” I’m not making that up. Carsten Hohnke (Ward 5) disputed a contention made by Jane Lumm (Ward 2) that began “Many Ann Arbor residents believe …” The nature of their disagreement can, I think, be analyzed in terms of a numerical understanding of “many” compared to a proportional one.

It’s actually a standard puzzle from the sub-field of linguistics called semantics, which I have studied at an institution of higher learning. Otherwise put, I live here in Ann Arbor even more than you do. And the standard example sentence used by semanticists to illustrate the meaning of “many” involves condors.

So let’s begin with a treatise on condors. The bird with the Latin name Gymnogyps californianus … Heh. I’m kidding.

By “kidding” I mean “not actually totally kidding.” See, you need to understand something about condors before you can understand the example. One thing you probably already know is that condors don’t live in Ann Arbor.  [Full Story]

Art Commission Strategizes as Millage Looms

Dealing with the millage wasn’t the commission’s main agenda item, but they did spend some time talking about the need for a separate campaign committee. AAPAC chair Marsha Chamberlin stressed that the commission itself can’t advocate for the millage, ”but we can educate out the wazoo.”

As individuals, though, commissioners will likely be very active – Chamberlin will be among those organizing the campaign, along with Arts Alliance president Deb Polich, who attended AAPAC’s Aug. 22 session. Mark Tucker of FestiFools was there too, and told commissioners that he and others were brainstorming on free or inexpensive ways to support the millage – including a “surprise” that involves football Saturdays and is “FestiFoolian in nature” to attract media coverage.

Ken Clein also volunteered to help. He was on hand to update commissioners on the status of the Herbert Dreiseitl water sculpture in front of city hall, as a follow-up to concerns raised in June about the installation. Clein is a principal with Quinn Evans Architects, the Ann Arbor firm that handled the design of the new Justice Center and oversaw its construction. Though delayed, the Dreiseitl installation is nearly completed and will be handed off to the city soon, along with a two-year maintenance warranty.

The sculpture is the largest and most expensive project coordinated by the commission, and the first one approved under the Percent for Art program. The two newest public art projects were added to the pipeline at the Aug. 22 meeting, on unanimous votes. They’ll eventually be located at: (1) Forest Avenue Plaza, next to the Forest Avenue parking structure near South University; and (2) a future roundabout at Ellsworth and South State.

In a written report, commissioners were given an update on available funds in the Percent for Art budget. Of the $1.668 million balance, $856,997 is earmarked for projects already approved by AAPAC, including $400,000 for artwork at the East Stadium bridges and $150,000 for Argo Cascades – but aspects of those projects are still under review by the city’s legal staff. That leaves $810,276 in unallocated funds. The largest amounts are in revenues from sewer projects ($451,955) and street millage projects ($241,951).

The commission also finalized its four-year strategic plan, and moved ahead on a new effort to involve residents in planning for public art in each of four quadrants in Ann Arbor. [Full Story]

Park Commission Focuses on Downtown, Dogs

In their main action item, commissioners voted to direct PAC’s dog park subcommittee to develop recommendations that could lead to additional off-leash dog parks, to be located in central Ann Arbor. Those recommendations will likely be presented at PAC’s Sept. 18 meeting.

The commissioner who’s been spearheading this effort for more than a year, John Lawter, didn’t attend the meeting. That disappointed one member of the public, Steve Thorp, who advocated for West Park to be considered as a potential site for a dog park. He dubbed Lawter “Citizen Canine” and said the ballfield at West Park could be a spot for a temporary dog park during certain hours of the day or times of the year.

Commissioners also heard from mayor John Hieftje, who asked PAC to help prioritize action on downtown parks. He highlighted possible improvements at Liberty Plaza and a process for moving that work forward. [.pdf of Liberty Plaza staff memo] But he also listed several other city-owned properties that he’d like to see as part of a greenway – including the 721 N. Main and 415 W. Washington sites – as well as the DTE/MichCon property that’s being cleaned up along the Huron River.

Commissioner Tim Berla asked how the Library Lane site – atop the new underground parking structure on South Fifth Avenue – fits into the mayor’s vision for downtown parks. Hieftje said he’d attended a picnic there this summer hosted by the Library Green advocates. He felt it was a little disingenuous of them to show images of a possible future park with large, mature trees – because there’s only three inches of soil, he said, so if you’re looking for greenery and shade, that’s not the best place. There’s room for a plaza, Hieftje added, but the question is how large it should be.

The Library Lane site is one of five city-owned properties that are being evaluated as part of the Connecting William Street effort, which aims to coordinate planning and possible development on those properties. At the Aug. 21 meeting commissioners were briefed about that project, led by the Ann Arbor Downtown Development Authority. The DDA was seeking feedback from PAC on three development scenarios that, generally speaking, represent low density, moderate density and high density development.

Several commissioners expressed disappointment that the scenarios did not include more green space. Susan Pollay, the DDA’s executive director, urged PAC to give specific feedback about where they’d like to see more green space and how they envision it being used, in the context of other downtown parks. She said the city needs to find a “sweet spot” between parks and the population density needed to support those parks.

Also on the agenda was an update from the nonprofit Community Action Network. CAN operates Bryant Community Center and Northside Community Center under contract with the city, which owns those properties. [Full Story]

Council Puts Art on Ballot; Lets Land Leaven

Ann Arbor city council meeting (Aug. 20, 2012): City council actions finalized the set of ballot questions for Ann Arbor voters on Nov. 6: A public art millage will join the Ann Arbor District Library’s bond proposal and the city of Ann Arbor’s parks maintenance and capital improvements millage on the ballot.

The public art millage would be levied at a rate of 0.1 mill, which would raise around $450,000 from Ann Arbor taxpayers annually. Passage of the public art millage would, according to the corresponding charter amendment, suspend the city’s public art funding mechanism embedded in the Percent for Art ordinance – but only for the duration of the four-year millage.

A selling point of the millage, compared to the current Percent for Art program, is that millage money could be used more flexibly than money set aside under the Percent for Art program. The Percent for Art ordinance requires that 1% of all city capital projects be set aside for art. But this funding mechanism carries with it a legal requirement that art paid for through the program be in some sense “monumental” art that is permanent. Performance art or temporary installations would not qualify under the current program.

Even though a millage offers more flexibility, leaders in the arts community are concerned about a possible perception that it would be completely flexible – which led the council to change the ballot language and charter amendment from “public art” to “art in public places.”

A proposal from Jane Lumm (Ward 2) to begin the process of revising the Percent for Art ordinance in advance of the millage vote got little traction from the council. Lumm indicated that she wanted to offer voters a clear choice – that unless the millage were approved, public funding for art would disappear. But her resolution was voted down, with additional support only from Stephen Kunselman (Ward 3) and Mike Anglin (Ward 5).

The majority of councilmembers felt that such a move was “premature.” Mayor John Hieftje indicated that he was open to a scenario in which the millage passed, the tax was levied for four years (which would generate roughly $1.8 million in money that could be spent flexibly), but then was not offered to voters for renewal after four years, which would mean an automatic reversion to the current Percent for Art program.

In other business, the council declined to take action on two pieces of land at opposite ends of the downtown – 414 N. Main St. (site of the old St. Nicholas Church), and 350 S. Fifth Ave. (the former YMCA lot). The council rejected a proposal to begin the rezoning process for the St. Nicholas Church property – in advance of a public auction of the land starting Sept. 6. The council also declined to support a directive to the city administrator to prepare for disposition of the old Y lot, citing an ongoing planning process for the area of downtown Ann Arbor that includes the city-owned parcel. That process – Connecting William Street – is being led by the Ann Arbor DDA under direction from the city council.

The council transacted a mixed bag of other business, including approval of a collaborative effort with Washtenaw County to handle towing. The council also approved the final grant contract necessary for completing an environmental study in connection with a runway extension at the Ann Arbor municipal airport.

The council rejected a proposal from Comcast for a new franchise agreement, opting instead to allow the current arrangement to stay in place at least through the end of its term in 2017.

The meeting ended around midnight with jostling among councilmembers on the issue of mayoral appointments. Prompting the discussion was the reappointment of Sandi Smith (Ward 1) to the board of the Ann Arbor DDA. Kunselman and Lumm voted against the reappointment, objecting to Smith’s dual service on the city council and the DDA board. Smith was originally appointed to the board before her election to the council in 2008 and is not seeking re-election this term. Other councilmembers defended Smith’s selection.

Less controversial was the appointment of Michael Benson to the taxicab board. That body had been unable to meet because it had only two voting members out of five, and could not achieve a quorum. If all three members show up now, that body can hold its meeting. [Full Story]

AADL Board Briefed on Public Library Trends

Ellie Serras, chair of the Our New Downtown Library campaign committee, spoke during public commentary to brief the board on actions of that group. It was formed earlier this year to support a $65 million, 30-year bond proposal that the board voted to put on the Nov. 6 ballot. Serras described the committee’s outreach efforts, including its website, Twitter account (@OurNewLibrary), Facebook group, promotional mailing, yard signs, and meetings with individuals and groups in the community.

Committee members are committed to this project and they want everyone to know how important it is, she said. ”It’s a life changer.”

In the context of the proposed building project, AADL director Josie Parker told the board that library staff are being asked about the relevancy of public libraries, so she thought it was appropriate to address that question at a formal board meeting by looking at changes that public libraries are facing. Associate director Eli Neiburger described how the library is responding to changes in the publishing industry regarding digital content. Currently, publishers are fairly restrictive in allowing public libraries to access digital content for patrons. So the Ann Arbor library has started negotiating licensing deals directly with creators – including filmmakers of the 2009 “Grown in Detroit” documentary, and the author of the graphic novel “Poopy Claws” – to allow AADL patrons to access those works through online streaming and limitless downloads, respectively.

Associate director Celeste Choate described the library’s non-media, non-traditional collections, which include art prints, energy meter readersScience to Go kits, telescopes and electronic musical “tools.” The full list of collections is on the “Unusual Stuff to Borrow” page of AADL’s website. Additional collections are in the works, including art tools and kits for science experiments.

Though Neiburger described storage needs for digital media as trivial – he could keep 200,000 copies of “Poopy Claws” on his cell phone, if he were so inclined – the needs for non-traditional physical items are more challenging. The library’s tracking/circulation software is well-suited to adapt, because that system doesn’t care about size, he said. “But the shelf sure does.” It was an implicit reference to some of the arguments put forward in the board’s decision to pursue a new downtown building.

Also during the Aug. 20 meeting, Choate reported on a recent satisfaction survey for patrons of the Washtenaw Library for the Blind and Physically Disabled, which is operated by AADL and serves over 400 people. The library received high marks from those who responded to the survey, she said. [.pdf of survey results] [Full Story]

Washtenaw Board to Re-Vote on Transit Accord

Again on the agenda of the Washtenaw County board commissioners for Sept. 5 will be the articles of incorporation for a new countywide transit authority. The intended outcome is not for the board to rescind or amend in a significant way the articles it approved on Aug. 1, 2012 – on a 6-4 vote.

Once again on the agenda for the Washtenaw County board of commissioners meeting on Sept. 5 will be the articles of incorporation for a new transit authority. It’s expected to be a stamp of approval for some administrative changes, not a chance to change the document or rescind the board’s previous decision to approve the document.

Instead, the point of re-introducing the agenda item is to provide an opportunity for the board to affirm the administrative changes to the articles of incorporation that took place after the board’s Aug. 1 vote.

The administrative changes were already included in the documents by the other three parties to the four-party agreement when they subsequently ratified the document. Those parties are the cities of Ann Arbor and Ypsilanti, and the Ann Arbor Transportation Authority, which is leading this effort. The Ann Arbor city council voted (for a third time) to approve the articles of incorporation at its Aug. 9, 2012 meeting; the Ypsilanti city council voted at its Aug. 14 meeting (also for a third time); and the AATA board voted (for a second time) at its meeting on Aug. 16.

News of the agenda item came from an email sent by Washtenaw County board chair Conan Smith to other commissioners on the evening of Aug. 22. It’s not entirely clear whether the board will: (1) take a vote that affirms the administrative (non-substantive) nature of the changes that were made after the board approved the document on Aug. 1; or (2) take a vote that amends the document to match the version approved by the other three parties.

Previous re-votes have been driven by substantive amendments made by one of the parties to the agreement. For example, the Ypsilanti city council amended the four-party accord after the Ann Arbor city council first voted, on March 5, 2012. That amendment involved service charges applied to the respective cities’ existing millages. When the agreement went back to the Ann Arbor city council, that body amended the document further – which meant that it returned to the Ypsilanti city council for its approval again. The AATA board then ratified the agreement.

It was expected to be approved by the Washtenaw County board of commissioners without further substantive amendment. But on Aug. 1 the board made a change to the size of the majority needed, in order for the new transit authority’s board to change the articles of incorporation – from 2/3 to 4/5 of the 15 board members. That triggered the most recent round of approvals by the various bodies.

But those approvals incorporated some changes that were driven by a desire to harmonize the county board’s amendment with the rest of the document, as well as with Act 196 of 1986 – the act under which the new transit authority will be incorporated. For example, the 4/5 majority requirement for changes to the articles of incorporation is at apparent odds with one kind of change to the articles specifically mentioned in Act 196 – a change in jurisdictions that are part of the authority. Act 196 explicitly indicates that a 2/3 vote is required. So an administrative change undertaken after the board’s Aug. 1 meeting was to add the clause: “… unless another vote of Board is required under the terms of these Articles or provided for in Act 196.”

The view of legal counsel for the four parties was apparently that it’s not actually necessary for those changes to be explicitly re-voted and affirmed by the county board of commissioners. However, there is at least some sentiment on the county board that the changes might be construed as substantive and contrary to the intent of the county board, which could become an unnecessary point of contention down the road.

The AATA is current finalizing the details of a five-year service plan that will need to be published as one of several conditions that must be met before the AATA could transition into the newly incorporated authority, to be called The Washtenaw Ride. This week, the AATA board called a special meeting for Sept. 5 to unveil that service plan.

Earlier in the year, the AATA had hoped to be in a position to possibly place a transit millage proposal on the ballot this November. But at this point, that won’t be possible. Any transit millage proposal will come at a later election.

Next Steps for AATA’s Possible Transition

As part of that goal of establishing the new authority, the AATA board gave final approval to a four-party agreement – between the city of Ann Arbor, the city of Ypsilanti, Washtenaw County and the AATA. The agreement would establish a framework for the transition of the AATA to a transit authority incorporated under Act 196 of 1986 – to be called The Washtenaw Ride. That authority would have a 15-member board.

An unincorporated version of the Washtenaw Ride’s board (the U196) has been meeting since late 2011. The three guests at the table for the Aug. 16 AATA board meeting are representatives of three districts in the possible new authority: Karen Lovejoy Roe (Southeast District), Bob Mester (West District) and David Phillips (Northeast District).

Those three were not there to vote, and did not participate in deliberations, though they could have. However, Lovejoy Roe – who serves as Ypsilanti Township clerk, an elected position – gave one of the most enthusiastic statements of support for the countywide initiative that’s been heard at the AATA board table over the last two years. “I’m just really excited about where we’re headed as a community, as a county at large. I know that there’s been a lot of hiccups, but I think that that’s normal … I’m committed, and I think that those who’ve asked me to be here working willingly and openly to do what’s best for all county residents [are, too] …”

One element of the 30-year vision that the AATA has developed for countywide transportation is a north-south commuter rail connection between Ann Arbor and Howell, in Livingston County. And the planning effort was given continued support at the Aug. 16 meeting when the board awarded a $105,200 contract to SmithGroupJJR for station location and design services in connection with the WALLY (Washtenaw and Livingston Railway) project.

That overall planning effort was given a boost by a somewhat unexpected $640,000 federal grant to the AATA and Michigan Dept. of Transportation. The grant was awarded on Aug. 6, 2012 under the Transportation, Community and System Preservation (TCSP) program. AATA had applied for the grant last November, but did not have high expectations, given the competitive nature of the grants.

In other business, the board decided to accept a non-applicable penalty – which has no actual impact – and not comply with Michigan’s Public Act 192 for its unionized employees. The act mandates limits on how much public employers can contribute to their employee health care costs. The decision was essentially based on deference to a federal law that applies to agencies receiving federal funding – like the AATA. That federal law requires benefits like health care to be collectively bargained, not stipulated. Under the state law, failure by the AATA to comply would just mean that it would be denied state funds to which it is not even entitled.

In the meeting’s other business item, the AATA approved a three-year contract with CBS Outdoor Advertising of Lexington, New York, to handle placement of ads on its buses and bus stops. Planning Group Briefed on William St. Project

At their recent working session, Ann Arbor planning commissioners got their first detailed look at the Connecting William Street project – an effort to coordinate planning for five city-owned sites in downtown Ann Arbor.

Led by the Ann Arbor Downtown Development Authority at the behest of city council, the project’s goal is to build a framework to guide possible development of those sites, which are primarily surface parking lots: (1) the Kline’s lot (on the east side of Ashley, north of William), (2) the lot next to Palio restaurant (northeast corner of Main & William), (3) the ground floor of the Fourth & William parking structure, (4) the old YMCA lot (on William between Fourth and Fifth), and (5) the top of the Library Lane underground parking garage on South Fifth, which recently opened north of the downtown library.

Amber Miller of the DDA and Cheryl Zuellig of SmithGroupJJR led the Aug. 14 discussion and solicited feedback on three development scenarios. Broadly speaking, the scenarios represent low density, moderate density and high density development, and all conform to current zoning. They were created based on input from interviews, focus groups, an online survey, and the work of land use economist Todd Poole. [.pdf of Poole's market study]

Miller stressed that these scenarios are not recommendations for development, but are being used as conversation starters to get additional feedback. The final recommendation to the city council, which is expected in late October, will likely be a hybrid of the ideas in these scenarios.

The planning commission had a wide-ranging discussion, floating questions and suggestions. Ideas included: (1) creating spaces for food carts to give downtown workers more low-cost lunch options; (2) building structures that are adaptable, and that could easily be transformed from office to residential space; and (3) incorporating aspects of the city’s recently approved sustainability framework, as well as elements of a climate action plan that’s being developed.

Wendy Rampson, the city’s planning manager, raised concerns over Ann Arbor becoming a “Disneyland of foodies,” and stressed the importance of diversity for a healthy downtown. Poole’s market study indicates that Ann Arbor residents spend 1.6 times the national average on dining out and entertainment.

Eric Mahler, a planning commissioner who served on a committee that had recommended a development on top of the Library Lot, cautioned that the public’s response to any proposal can’t be underestimated. People will likely challenge any assumptions related to market demand, he said, such as demand for a conference center. He also indicated that parking and traffic concerns shouldn’t be underestimated – people will raise those issues, too.

Miller noted that one of the lessons they’ve learned from previous unsuccessful efforts is the importance of having conversations in advance of specific proposals, and of reaching out to a more diverse group of people. That’s what they’ve been doing with Connecting William Street, she said, and it’s what they’ll continue to do in the coming weeks as they gather input for a final recommendation. [Full Story]

Rezoning Process for N. Main Site on Agenda

Several additions to the Ann Arbor city council’s Aug. 20 meeting agenda came on Friday, after the initial Wednesday publication.

And two of those items involve city ownership of land parcels – at opposite edges of downtown Ann Arbor. One of the properties is already owned by the city of  Ann Arbor – the parcel at 350 S. Fifth. Situated on the southern edge of downtown, it’s also known as the Fifth and William parking lot (because it’s currently used as a surface parking lot in the city’s public parking system) or the Old Y Lot (because it’s the location of the former YMCA building).

The resolution would direct the city administrator to evaluate the parcel for possible public or corporate use; and if none is found, to report back to the city council with a timeline for the disposition of the property – based on state and city laws and policies. The resolution, sponsored by Stephen Kunselman (Ward 3), is somewhat unlikely to gain much traction with the council. That’s because it explicitly indicates that the city administrator’s efforts are to be independent of the Ann Arbor Downtown Development Authority’s Connecting William Street planning effort, which includes the 350 S. Fifth parcel.

The Connecting William Street project was undertaken by the DDA based on a directive from the city council, on a unanimous vote, given at its April 4, 2011 meeting. Kunselman voted for that planning effort to take place – but was also vocal at the time, as well as before, about his view that the Old Y lot should simply be put up for sale one way or another.

A second piece of property on the council’s Aug. 20 agenda is located on the northern edge of downtown at 414 N. Main St., near Beakes Street – the site of the old St. Nicholas Church. In 2006, owners of the site received approval for a planned unit development (PUD) zoning designation from the city council. The PUD would allow construction of The Gallery, an 11-story building (158 feet tall) that would include 224 parking spaces and 123 units of residential housing, 18 of which would meet the definition of affordable housing derived by a formula based on area median incomes.

That 414 N. Main property does not belong to the city. But the result of a foreclosure process has put it in the hands of another public entity – the Washtenaw County treasurer’s office. It’s being offered at public auction (on auction.com) starting Sept. 6 through Sept. 11, at a price of $365,051. County treasurer Catherine McClary told The Chronicle in a phone interview that the price includes the demolition costs – and that she’s selected a demolition firm to start the work. Asbestos abatement is already underway, and the demolition itself is expected to begin before the auction, though it will likely not be complete by then, as it will take 15 days.

What would the council’s resolution on the 414 N. Main property actually do? It would start the process to change the PUD zoning to that of the surrounding property, which is D2 (downtown interface) – allowing a maximum building height of 60 feet. The resolution, also sponsored by Kunselman, gives as part of its rationale the fact that the original developer is no longer pursuing the project.

If the property doesn’t sell at the Sept. 6 auction, it will be offered at a second auction. If it doesn’t sell at the second auction, the property would revert to the city. The city could exercise a right of first refusal and acquire the property for the minimum $365,051 bid – but that would require the city to make the purchase for a “public purpose.”

Despite Worries, Art Commission Backs Millage

Ann Arbor public art commission special meeting (Aug. 15, 2012): Ann Arbor city councilmember Christopher Taylor stunned many in the arts community by unexpectedly proposing a public arts millage for the Nov. 6 ballot. He took that action at the council’s Aug. 9 meeting – two days after the Aug. 7 primary.

At that meeting, he indicated a desire to start a conversation about public arts funding, and expressed the hope of getting input from the Ann Arbor public art commission and the community in general.

Some of that conversation took place at the public art commission’s Aug. 15 meeting, which ended in a vote of support for the millage proposal.

Much of the reaction so far from the arts community has focused on the short timeframe until the November election, and the lack of clarity that a yes or no vote would indicate, based on the wording of the proposal.

In response to that perceived lack of clarity, on Friday, Aug. 17, councilmember Jane Lumm (Ward 2) added a resolution to the Aug. 20 council agenda that would lead to a choice for voters on Nov. 6 between: (1) a millage to support public spending on art; or (2) no continued accumulation of public funds to be spent on art. Her resolution would direct city attorney staff to prepare ordinance language to repeal the funding mechanism in the Percent for Art ordinance – effective July 1, 2013. The intent is to repeal the ordinance in a way that allows funds already set aside for art to be spent on art, and to provide for maintenance of existing works.

If approved by the council on Aug. 20, Lumm’s resolution would lead in late September to the first of two city council votes necessary to repeal the ordinance section. In part, Lumm’s resolution states that “to truly enfranchise residents, voters should be offered a clear, yes/no choice on public funding for public art rather than an either/or choice of the mechanism used to fund public art; …” [.pdf of Lumm's draft resolution and memo]

Lumm’s resolution hadn’t been proposed when AAPAC held its special meeting on Wednesday to focus on Taylor’s millage proposal. The commission had essentially been forced to call a special session because its next regular meeting, on Aug. 22, falls after an expected vote by the council on Aug. 20.

The special meeting drew more public commentary than at any of AAPAC’s previous meetings. Nine people spoke, including leaders of several local arts institutions: Deb Polich of the Arts Alliance, Russ Collins of the Michigan Theater, Mark Tucker of FestiFools, and former AAPAC chair Margaret Parker, among others. Several more people attended but did not formally address the commission.

It seemed clear that neither commissioners nor members of the arts community who spoke during public commentary had been consulted about the millage proposal, and only a few had been informed that it would be brought forward. While there was broad support for the idea of a public arts millage, many people questioned the timing and felt that 11 weeks until the Nov. 6 election was too short a time to mount a successful millage campaign.

When asked by commissioners who would lead such a campaign, Taylor said he assumed it would be led by the arts community, with money raised from private contributions. He felt the amount of time was sufficient, and that the millage would be approved by voters. He thought the November election would be a good time for the vote, with higher participation by students and renters – that’s a good core, he said.

During AAPAC’s meeting, Taylor told commissioners that if a millage vote is delayed, that puts the current Percent for Art program at risk. He said his sense is that the risk is growing, though he was unclear about why he believes that’s the case. Marsha Chamberlin, AAPAC’s chair, wondered whether the concern stems from a change in composition to the council, following the November election. Taylor did not respond directly to that question.

In the Aug. 7 primary election, Democrat Sally Petersen defeated incumbent Tony Derezinski in Ward 2 – Derezinski also is a member of AAPAC, though he has not attended a regular meeting since May, and did not attend the Aug. 15 special session. No incumbents ran in the Ward 1 and Ward 5 races, where Democrats Sumi Kailasapathy and Chuck Warpehoski prevailed in their respective primaries. No Republican is running against Petersen or Kailasapathy in November. And though Warpehoski faces Republican Stuart Berry in Ward 5, it’s likely that Warpehoski will win that heavily Democratic ward. Taylor is also running for re-election, but was unopposed in the Ward 3 Democratic primary and is unchallenged in November.

In a pre-election survey conducted by the Arts Alliance, Petersen indicated support for the Percent for Art program, though she suggested some changes. Warpehoski supported “looking for ways to establish a more flexible funding stream for the arts.” Kailasapathy did not respond to the survey, according to the alliance, but her campaign website did not list public art among her priorities. In general, another complicating factor with the millage proposal is a separate effort to develop a countywide plan and funding mechanism for public art. The Arts Alliance is leading that initiative, and earlier this year applied for a $100,000 grant through the National Endowment for the Arts “Our Town” program to help fund it. At AAPAC’s Aug. 15 meeting, Polich – the alliance’s executive director – advocated for more time so that a fully-developed, comprehensive strategy could be prepared.

Polich questioned how the millage rate was determined in Taylor’s proposal – a 0.1 mill tax for four years. She raised the concern that the city is “leaving money on the table” – that is, it’s possible that voters would be willing to pay more for public art than the amount proposed. Polich also mentioned concerns about the millage’s potential impact on private contributions to arts and cultural organizations, which wouldn’t necessarily get funding from a public arts millage. There might be confusion about that, making fundraising more difficult.

Despite a range of concerns, AAPAC ultimately voted unanimously to recommend that the council place the proposal on the Nov. 6 ballot. Among the commissioners, John Kotarski appeared to be the most enthusiastic supporter of the proposal, praising Taylor for bringing it forward. [Full Story]

Council Meeting: Floods, Fires, Demolition

Ann Arbor city council meeting (Aug. 9, 2012) Part 2: Ballot initiatives for the Nov. 6, 2012 election – two about parks and one on public art – were the dominant theme of the council’s meeting. Those are covered in Part 1 of the meeting report.

But the council transacted several other pieces of business as well, some of which could be grouped into the general thematic pattern of land and property use. Most obviously connected to land use was the council’s initial approval of a rezoning request in connection with an expansion proposal from Knight’s Market, at the corner of Miller and Spring streets. The rezoning would allow a house to be converted into a bakery. It would also allow for eventual approval of a site plan to build a 1,200-square-foot addition to the existing grocery store and to expand, reconfigure, and improve the existing parking lot.

The council also passed a resolution to deal with an issue stemming, in part, from land use decisions made decades ago that resulted in residential development in the area of the Malletts Creek drainage district. Recently, residents in the area have been faced with severe localized flooding. The council’s resolution directed staff to start negotiations with the Washtenaw County water resources commissioner to identify “opportunities for stormwater conveyance and stormwater quality improvement in the area of the Malletts Creek drainage district.”

Related at least tangentially to land use at the level of a specific parcel was a resolution the council passed establishing the property at 317 Maynard in downtown Ann Arbor as an industrial development district. The move sets the stage for an expected application from the future tenant of the space, owned by First Martin Corp., for a tax abatement that would be worth around $85,000. The tenant is Barracuda Networks.

And the council took another step in implementing a strategy to eliminate blight. The city had previously set aside funds that could be used to demolish blighted buildings – if the city is unsuccessful in getting property owners to demolish them. The council’s action last Thursday authorized the city to sign contracts with four different companies to do such demolition work on an as-needed basis. It was announced at the meeting that the houses on North Main – at the site of the planned Near North affordable housing project – will likely be among the first to be demolished under the contracts authorized by the council.

To the extent that transportation systems have an impact on future land use, another item related to land use was a reapproval of the articles of incorporation for a possible new countywide transportation authority. The articles of incorporation are part of a four-party agreement to establish a framework for possibly expanding the governance and service area of the Ann Arbor Transportation Authority.

The four-party agreement is between the cities of Ann Arbor and Ypsilanti, Washtenaw County and the AATA. The Ann Arbor council changed the minimum threshold of votes required on the proposed new 15-member transit authority board, an action that brought the council in line with a version that the Washtenaw County board of commissioners had approved earlier this month. That threshold was increased from a 2/3 majority (10 votes) to a 4/5 majority (12 votes).

In other business, the council authorized the hiring of three additional firefighters for the next two years, using a federal grant. It also authorized the purchase of a new aerial fire truck.

Nominations to city boards and commissions made at the meeting included reappointment of Sandi Smith, Roger Hewitt and Keith Orr to the board of the Ann Arbor Downtown Development Authority. And Sally Petersen, who won the Ward 2 Democratic primary on Aug. 7, was nominated for the city’s commission on disability issues.
