DDA Submits FY 2015 Budget to City

The Ann Arbor Downtown Development Authority board has voted to submit its budget for fiscal year 2015 to the city of Ann Arbor. DDA board action came at the board’s March 5, 2014 meeting.

The budget shows $19.3 million in revenues from the public parking system and $4.8 million in tax increment finance capture. Overall, it shows $24,237,186 in revenues against $26,531,972 in expenses. The use of fund balance to cover the difference leaves the DDA with an estimated fund balance at the end of FY 2015 of about $3.3 million. FY 2015 runs from July 1, 2014 through June 30, 2015. DDA Might Increase Support for Transit

In the context of an approaching May 6, 2014 transit millage ballot question, the board of the Ann Arbor Downtown Development Authority has approved a resolution that pledges to work toward increasing the DDA’s support for transportation programs.

The 0.7 mill tax was placed on a May 6 ballot by the Ann Arbor Area Transportation Authority board on Feb. 20, 2014. The tax would be levied by the AAATA only if it wins a majority of support among voters across its three member jurisdictions: the city of Ann Arbor, the city of Ypsilanti and Ypsilanti Township.

Republic Parking Gets Full Incentive

The Ann Arbor Downtown Development Authority’s public parking system contractor has again this year been awarded the full $50,000 amount of a discretionary management incentive. The vote came at the DDA board’s March 5, 2014 meeting.

Republic Parking’s contract with the Ann Arbor DDA covers just actual costs, but also includes a $200,000 annual management fee. Of the $200,000 management fee, $50,000 is awarded to Republic on a discretionary basis. [.pdf of DDA staff memo on Republic Parking management incentive]

March 3, 2014 Council Meeting: Live Updates

Editor’s note: This “Live Updates” coverage of the Ann Arbor city council’s March 3, 2014 meeting includes all the material from an earlier preview article published last week. The goal is to facilitate easier navigation from live-update material to background material already in the file.

The council’s first regular meeting in March will include several items of business leftover from previous meetings, including one resolution on affordable housing, an ordinance on outdoor smoking, and several matters related to public art.

New to the agenda are several items related to non-motorized issues, most prominently a funding request to support the activity of an already-established task force on pedestrian safety and access.

The council will also be asked to fund requests related to city parks and other facilities like city hall and the airport. Eighteen new vehicles will also be added to the city’s fleet, contingent on council action on March 3.

The council will also consider a resolution that urges full funding of the state of Michigan’s fire protection grant program – for cities like Ann Arbor that host state-owned facilities like the University of Michigan.

In somewhat more detail, one public art issue, embodied in two different resolutions, was postponed from the council’s Feb. 18, 2014 meeting, when councilmembers could not agree on an approach to transferring money out of the public art fund back to the funds from which the money was originally drawn. The specific point dividing the council was not so much the transfer of money but rather a plan to fund the transition to a new approach to public art – after the council eliminated the Percent for Art funding mechanism last year.

Between council meetings, those issues have been separated out. The resolution ordered first on the agenda has been altered for consideration on March 3 so that it focuses exclusively on the public art program transition issue. The second resolution incorporates changes to reflect the council’s deliberations on Feb. 18: It transfers a total of $943,005 of Percent for Art money to its funds of origin, an amount that defunds the art project at Argo Cascades, but keeps funding for the Coleman Jewett memorial and for a project called Canoe Imagine Art. That disagreement over funding of the new approach to public art – created by the council last summer when it eliminated the Percent for Art funding mechanism – is also related to another public art item on the agenda. That’s a six-month contract extension for the city’s part-time public art administrator. The item first appeared on the council’s Jan. 21 agenda, but the council postponed that vote until Feb. 3, when it was defeated. On Feb. 18 it was then brought back for reconsideration, but immediately postponed until the March 3 meeting.

Also postponed from Feb. 18 is an item that would direct the city administrator to prepare for the council’s approval a budget resolution regarding affordable housing. The resolution would allocate $600,000 from the city’s affordable housing trust fund to support the Ann Arbor housing commission’s plan to renovate its properties. That allocation would be contingent on the closing of the sale of the former Y lot to Dennis Dahlmann, as the net proceeds of that sale are to be deposited into the city’s affordable housing trust fund.

Postponed from the Feb. 3 meeting was the first reading of an ordinance that would regulate smoking outside of public buildings and also potentially in areas of some city parks. Chuck Warpehoski (Ward 5), sponsor of the new proposed local law, appeared before the park advisory commission at its Feb. 25 meeting to brief commissioners on the proposal and solicit feedback.

New items on the March 3 agenda include a funding proposal for the pedestrian safety and access task force established by the city council late last year, with members appointed in late January. The $122,250 item also includes a $77,500 contract for facilitation services from Project Innovations. That’s the same firm contracted for similar work in connection with the city’s sanitary sewer wet weather evaluation – which is expected to conclude in the summer of 2014. [The total amount being appropriated for the task force project budget in the item is $197,250. The stated “estimated $122,500” is the approximate cost of the anticipated staff effort for this project. The total project budget includes $77,400 for the professional services agreement with Project Innovations, Inc.]

Other issues on the March 3 agenda with a non-motorized connection are three stretches of sidewalk. In the context of sanitary sewer design work that Fishbeck, Thompson, Carr & Huber Inc. is being hired to do, two sidewalks are included: a stretch along Barton Drive, and a stretch along Scio Church Road. The council will also be asked to pay for the construction of a stretch of sidewalk along Ann Arbor-Saline Road near the I-94 bridge – as part of a road reconstruction project that the Michigan Dept. of Transportation is handling.

Another new item is a resolution that Jack Eaton (Ward 4) had announced at the council’s Feb. 18 meeting that he’d be bringing forward. It would waive the attorney-client privilege on a staff memo about laws governing the assessment of homes. The resolution indicates that the memo addresses the effect that reducing the assessment for one year would have on the property tax assessment for the subsequent year, based on action by the Board of Review and/or the Michigan Tax Tribunal.

In other action, the council will be asked on March 3 to approve the purchase from Signature Ford of 18 new vehicles – most of them for use by the Ann Arbor police department. Total cost of the purchase is $457,393.

City parks factor into three agenda items: (1) a resolution to establish an urban park on part of the surface level of the Library Lane underground parking structure; (2) a paving contract for the replacement of basketball and tennis courts at Clinton Park; and (3) a grant application to the Michigan Dept. of Natural Resources Grants Management to support a universal access playground at Gallup Park. The Rotary Club of Ann Arbor has already pledged $250,000 toward such a playground.

The city hall (Larcom Building) is featured in two agenda items – to pay $160,923 for a secondary chiller unit and $28,469 for new light fixtures. An amendment to an agreement with MDOT for an already-completed fence project at the Ann Arbor municipal airport also appears on the agenda, and will cost the city $425.

After authorizing significant equipment purchases to support water main repair activity at its Feb. 18 meeting, the council will be asked to approve two additional items related to water main repair. One item is a $44,702 emergency purchase order to buy more aggregate material used for backfilling water main repairs. A second item authorizes an emergency purchase order for repairing and making a new connection for the water main at 1214 S. University. In both cases, the emergency purchase orders were authorized by the city administrator, and the work was done.

Street closures for two events are on the council’s March 3 agenda: Take Back the Night and the Monroe Street Fair.

Also on the agenda is a resolution that would encourage Gov. Rick Snyder, state senator Rebekah Warren, and state representatives Jeff Irwin and Adam Zemke to explore creative ways to fund the state’s fire protection grant program for municipalities like Ann Arbor, which host state institutions. In the last three years, the program has been only 40-55% funded.

DDA Mulls Role: Events, Marketing?

Ann Arbor Downtown Development Authority board meeting (Feb. 5, 2014): Highlights of the board’s hour and a quarter meeting were communications and transportation, on an agenda that featured no substantive voting items. The meeting consisted of various reports and discussion points.

A communications and marketing strategy for the downtown was the focus of Rishi Narayan’s report from the board’s partnerships committee, which had invited representatives from the four downtown area merchant associations to it most recent meeting. The message from those groups, Narayan reported, was a desire to see more events take place downtown.

A desire to see more signature events take place, especially during the winter, had been one of several items identified by board members at a recent retreat, held on Jan. 30, 2014 in the jury assembly room of the Justice Center, from noon to about 3:30 p.m. At its Feb. 5 monthly meeting, the follow-up discussion about the retreat also focused heavily on the idea of events and the possible role the DDA might play in facilitating more frequent events downtown. An initial reaction that appeared to be shared by several board members was this: The DDA should not necessarily be in the event-hosting business, but rather provide assistance to those organizations that are already hosting various events.

Board chair Sandi Smith also floated the idea of hiring an additional staff member to focus on marketing. City administrator Steve Powers stressed the importance of having a clear idea of the financial basis for the DDA’s capacity to undertake various projects on the list of its five-year plan. That five-year project plan, which Smith characterized as always in draft form, will be a focus of discussion when the board continues its retreat on Feb. 19. In addition to the five-year project plan, the board will focus on its 10-year financial projections at the Feb. 19 session. [Updated: The board has decided to continue its retreat on Feb. 26 at 1 p.m. at the DDA offices.]

Transportation was a topic addressed by the sole speaker during public commentary at the Feb. 5 monthly meeting, as Martha Valadez, an organizer with Partners for Transit, asked the DDA board to support a millage proposal that’s expected to be placed on the ballot by the Ann Arbor Area Transportation Authority. Late last month, the board’s operations committee had been briefed by AAATA staff on the five-year transit improvement plan – the set of service increases that are driving the likely request that voters approve an additional 0.7 mill tax.

Also related to transportation was a report from the board’s operations committee that included an update on the go!pass program, which the DDA has funded historically. Last year, the DDA granted the AAATA about $560,000 to pay for rides taken by downtown employees through the go!pass program. A request will be coming up soon for this next year’s funding.

In another transportation-related topic, the board also received an update on a possible part-time conversion of downtown on-street loading zones into taxi stands. Somewhat related to on-street right-of-way, the board was briefed on city council action to impose a fee on developers who cause the removal of on-street parking meters – unless the development has a more general public benefit. It will be up to the DDA to define what constitutes a public benefit – a task the board will now take up.

Related specifically to the public parking system, which the DDA manages under a contract with the city, the board reviewed the parking revenues for the second quarter of the fiscal year, compared to last year. It was the first full quarter for which the year-over-year comparison was for periods that did not include any parking rate increases. Revenue was essentially flat, showing just a 0.7% increase.

It’s not clear how much longer the former Y lot – located on William between Fourth and Fifth avenues – will continue to be used as a surface parking lot. Not mentioned at the Feb. 5 board meeting, but discussed at the Jan. 29 operations committee meeting, was a proposal from Dennis Dahlmann about leasing the lot back to the DDA after he completes the purchase of the city-owned land. The idea would be for the DDA to lease the property and continue to operate a surface parking lot on the parcel until Dahlmann is able to move a site plan forward. At the operations committee meeting, the idea was not warmly embraced.

Other updates included the regular report from the downtown area citizens advisory council. Chair of the group, Ray Detter, reported that the CAC was generally supportive of an effort now being made by Will and Mary Hathaway to work with some city councilmembers on a resolution about the future of the surface level of the Library Lane underground parking structure. The resolution would establish a significant part of that level – but not all of it – as an urban public space. [Full Story]

Public Housing Conversion Takes Next Step

Ann Arbor housing commission meeting (Jan. 15, 2014): Transitions for Ann Arbor’s public housing will continue in the new year, even while the housing commission is also dealing with the aftermath of a major fire in one of its complexes.

At their first meeting of the year, commissioners were briefed about the impact and aftermath of a Jan. 8 fire at Green Baxter Court, a public housing complex on Green Road next to Baxter Park on the city’s east side. They heard from Joan Doughty, executive director of Community Action Network, which operates a community center at that complex under contract with the city. CAN staff are helping AAHC provide support for families who were displaced by the fire.

At their Jan. 15 meeting, board members authorized up to $9,000 in extra funds to help pay for that emergency work. CAN is also seeking additional donations from the community.

In separate action, the board amended Chapter 14 of its housing choice voucher administrative plan to include a preference for families that have been involuntarily displaced due to a fire, natural disaster or any other reason. The vouchers would be used to subsidize rental housing, if no units are available in the city’s public housing system.

The Jan. 15 meeting also included an update from Lori Harris, vice president with Norstar Development, on a major initiative to upgrade the city’s public housing units. Specifically, she presented Norstar’s recommendation for an equity partner to purchase low-income housing tax credits awarded by the state to AAHC late last year. The board approved the recommended firm, Red Stone Equity Partners.

Investors had responded positively to Norstar’s request for proposals, Harris said, with higher-than-expected offers. “You have a very, very good story here, and it’s played very, very well in this process,” she told the board. The tax-credit transaction will provide the majority of funding for renovating five public housing complexes: Miller Manor, South Maple, Baker Commons, Hikone and Green Baxter. These properties make up the majority of public housing units in the AAHC portfolio – 248 out of a total 326 units.

However, AAHC executive director Jennifer Hall told the board that additional funding will still be required. As part of that, the AAHC is requesting $600,000 from the Ann Arbor Downtown Development Authority. Hall said she expects the DDA board to make a decision on that by March or April. The DDA previously gave the housing commission a $300,000 grant for capital improvements at Baker Commons, which is located within the DDA district. That approval came in March of 2013. And in October 2012, the DDA had provided a $260,000 grant primarily for replacing the Baker Commons roof.

In other action, the AAHC board approved a 3% cost-of-living adjustment for Hall, in line with other COLA increases given to city employees. The board also authorized changing the way its minutes are kept in order to begin using the city’s online Legistar system. The new approach will be less detailed in reporting deliberations, and will primarily provide a report on the outcome of action items. Currently, AAHC board minutes and board packets aren’t part of Legistar, but are provided on the AAHC page of the city’s website. Minutes from the AAHC board meetings are also attached to the city council agenda as an item of communication.

And near the end of the meeting, commissioner Marta Manildi reported that she is not seeking reappointment. Her term ends this spring, but she has offered to step down early. She was praised for her work in helping lead the AAHC through a difficult transition several years ago. Speaking during public commentary, Doughty said Manildi “really led the charge for a turnaround that’s been amazing to witness.”

A week later, at the Ann Arbor city council’s Jan. 21 meeting, mayor John Hieftje nominated Daniel Lee to serve out the rest of Manildi’s term. A confirmation vote is expected at the council’s Feb. 3 meeting. Hieftje described Manildi’s service on the commission as profound and beneficial. [Full Story]

624 Church St. Gets City Council OK

A 14-story, 116,167-square-foot building with 123 units and about 230 bedrooms – to be built at 624 Church St. in downtown Ann Arbor – has received approval from the Ann Arbor city council. The apartment building would extend to the southeast corner of Willard and Church, where the building’s entrance will be located. Existing buildings at 624 Church Street and 1117 Willard would be torn down.

Cold City Cash for Edwards Brothers Land?

Ann Arbor city council meeting (Jan. 6, 2014): On a bitter cold night, Ann Arbor city councilmembers ended their first regular meeting of the year with an item not originally on their agenda. They passed a resolution that directs city administrator Steve Powers and city attorney Stephen Postema to gather information to help the city council determine whether to purchase the 16.7-acre Edwards Brothers Malloy property on South State Street.

The direction came after the city council met in a closed session for about half an hour. Councilmembers emerged to craft and then pass the resolution. It gives direction to explore options to make the purchase financially feasible. That means finding a way to finance a $12.8 million deal. The sale of the Edwards Brothers property on South State Street is currently pending to the University of Michigan for $12.8 million, in an agreement that was announced in a Nov. 27, 2013 press release. The business – a fourth-generation Ann Arbor publishing and printing firm – had signaled its intent to put the property on the market in late July.

The topic of the possible land acquisition ties in to an upcoming Jan. 13 city council work session about economic development.

At the start of the Jan. 6 meeting, the council got an update from three key staff members about the city’s response to the snowstorm that had hit the entire Midwest over the weekend.

From public services area administrator Craig Hupy they heard an update on snowplowing, which was continuing during the meeting. From police chief John Seto, they heard an update on the police department’s support for relocating residents of a housing complex after a water pipe burst. And from Mary Jo Callan, Washtenaw County’s director of the office of community and economic development, they heard an update on efforts to address the needs of the homeless population during the freezing weather.

Concern for how the homeless were faring was the topic of eight out of nine speakers who signed up for public commentary reserved time.

In its regular business agenda, the council dispatched two items leftover from its last meeting of 2013. One of those items was the official termination of a four-year-old memorandum of understanding with the University of Michigan for construction of the Fuller Road Station project. That item was voted through with little controversy, although mayor John Hieftje compared it to digging someone up who died a couple of years ago and re-burying them.

Fuller Road Station was a planned joint city/University of Michigan parking structure, bus depot and possible train station located at the city’s Fuller Park near the UM medical campus. The council had approved the MOU on Fuller Road Station at its Nov. 5, 2009 meeting on a unanimous vote. However, a withdrawal of UM from the project, which took place under terms of the MOU, was announced on Feb. 10, 2012.

The other item delayed from last year was a resolution assigning a specific cost to the removal of on-street metered parking spaces, in connection with future developments: $45,000 per space. That amount was based on the cost of constructing a new parking space in a structure. After the policy was amended during the Jan. 6 meeting, it included a requirement that lost revenue also be compensated, based on projections of revenue for the space for the next 10 years. An average parking meter in the system generates $2,000 in annual income.

Apart from those previously delayed items, the rest of the council’s agenda was mainly filled with future development.

Accounting for two of the council’s Jan. 6 voting items was Traverwood Apartments – a First Martin development on the city’s north side. The site is located on the west side of Traverwood Drive, north of Plymouth Road. The council gave final approval of some rezoning necessary for the complex of 16 two-story buildings. And on a separate vote, the council gave site plan approval and a wetland use permit associated with the apartment complex.

The council also approved the upward expansion of the Montgomery Ward building on South Fourth Avenue in downtown Ann Arbor. The estimated $3.8 million project will expand the existing 17,273-square-foot building – a former Montgomery Ward’s department store – to 38,373 square feet, with housing on the second through fifth floors.

And finally, the council approved the site plan and development agreement for two restaurants at Briarwood Mall. The restaurants – one at 6,470 square feet, the other at 7,068 square feet – will be constructed on the east side of the Macy’s building. The restaurants would be operated by two chains: P.F. Chang’s and Bravo! Cucina Italiana.

As part of the consent agenda, the council approved agreements with Sprint for placing antennas at four facilities: the Plymouth Road water tower, the Manchester Road water tower, the Ann-Ashley parking structure, and the water treatment plant on Sunset Road. The contracts are being revised upwards to $45,000 a year at each location, with 4% annual escalators.

The council also approved appointments to the Ann Arbor Summer Festival board of directors.

Members of a pedestrian safety task force, established late last year, were also nominated at the meeting. A confirmation vote will come at the council’s meeting on Jan. 21. Related at least indirectly to that, city administrator Steve Powers has provided the council with the first part of his response to the council’s direction in connection with the city’s updated non-motorized transportation plan. DDA Acts on Elevator Design, Parking Term

Ann Arbor Downtown Development Authority board meeting (Jan. 8, 2014): In a meeting that lasted just 40 minutes, the DDA board handled two substantive items of business: funding for design work of a new parking structure elevator; and extension options for monthly parking permits associated with a planned new residential development.

The elevator in question is located at the southwest corner of the Fourth & William parking structure. The 994-space capacity makes it the largest structure in Ann Arbor’s public parking system, which offers around 8,000 parking spaces in lots, structures and on-street, metered parking.

The elevator is at least 30 years old, and was characterized at the meeting by DDA executive director Susan Pollay as one of the slowest in the Ann Arbor area, and the frequent subject of parking patron complaints. A trip from street level to floor 7 was timed by The Chronicle at about 45 seconds. That compares to 17 seconds for a similar trip on the elevator at Fourth & Washington, which is the DDA’s second-newest structure.

The board’s Jan. 8 resolution authorized $40,000 for Carl Walker Inc. to develop architectural renderings for the work at the Fourth & William parking structure. Carl Walker is the consulting firm used by the DDA for its routine maintenance inspection program for the parking structures. The design is supposed to allow for phased construction so that the parking structure could remain open during the construction period, which would not begin before next winter. The estimated construction cost for the project is $2.25 million.

In its other main business item, the board voted to allow the developer of the future 624 Church St. project in downtown Ann Arbor to extend for up to 15 years – for a total of 30 years – the contracts for 48 already-approved parking permits under the city’s contribution-in-lieu (CIL) program. At its meeting on Nov. 6, 2013, the DDA board had already approved the purchase of 48 parking permits through that CIL program for a new version of the proposed residential development at 624 Church St. in downtown Ann Arbor.

The spaces were approved to be provided in the Forest Avenue parking structure. The DDA board’s Jan. 8 resolution indicated that for the extension periods, the DDA might choose to allocate the spaces in some other structure than the Forest facility.

In an update at the meeting also related to parking, city administrator Steve Powers said that the surface parking lot at the former Y site would need to be closed no later than March, due to the sale of the city-owned property to Dennis Dahlmann. The property is located on the north side of William Street, between Fourth and Fifth avenues near the Blake Transit Center and downtown library.

The board also received an update on its initiative to pay for downtown ambassadors. And board members were alerted to the upcoming Jan. 13 city council work session about economic development. [Full Story]

Fourth & William Parking: Design for New Elevator

Preliminary design work costing $40,000 for a new elevator and stair tower on the southwest corner of the Fourth & William parking structure has been authorized by the Ann Arbor Downtown Development Authority board.

The board’s action to task Carl Walker Inc. to develop architectural renderings for the work at the Fourth & William parking structure came at the board’s Jan. 8, 2014 meeting. The funds for the design work would be drawn from the parking fund, not the DDA’s tax increment finance (TIF) revenue.

624 Church Street Gets Parking Permit Extension

The  developer of the future 624 Church St. project in downtown Ann Arbor will now be able to extend for up to 15 years – for a total of 30 years – the contracts for 48 already-approved parking permits under the city’s contribution-in-lieu (CIL) program.

The Ann Arbor Downtown Development Authority board’s action to approve up to three five-year extensions came at its Jan. 8, 2014 meeting.

Ann Arbor On-Street Parking Space Removal: $45K+

Removal of an on-street metered parking space will cost developers in Ann Arbor more than $45,000 per space as a result of a policy approved by the city council at its Jan. 6, 2014 meeting. The payment would go to the Ann Arbor Downtown Development Authority, because the DDA manages the public parking system under a contract with the city.

Added at 11:07 p.m. after initial publication: An amendment to the policy made during the Jan. 6 meeting requires added payment to compensate for the projected revenue over the next 10 years, generated by the space to be eliminated. Street Parking Space Removal Fee: Delayed Again

Developers who plan an Ann Arbor project that requires removal of an on-street metered public parking space may need to pay the Ann Arbor Downtown Development Authority $45,000 per space. But that’s still not decided after a second postponement of the question by the Ann Arbor city council. The payment would go to the Ann Arbor DDA, because the DDA manages the public parking system under a contract with the city.

The setting of that fee was postponed by the Ann Arbor city council at its Dec. 16, 2013 meeting after previously postponing at its Dec. 2 meeting.

DDA Tackles Street Lights, Land Sale Issue

Ann Arbor Downtown Development Authority board meeting (Dec. 4, 2013): At its last regular meeting of the year, the board approved the final funding necessary to replace 81 light poles on Main Street, passed a resolution waiving a claim to reimbursement for the DDA’s costs associated with the former Y lot, and formally accepted its audit report for the fiscal year that ended on June 30, 2013 (FY 2013).

The board also considered a resolution added to the agenda on the day of the meeting, related to the contribution-in-lieu (CIL) parking agreement for the 624 Church St. project – but ultimately decided to table that resolution pending further review at the committee level.

The DDA’s Dec. 4 resolution allocating $280,000 for the Main Street light pole replacement ended the political wrangling over who should pay for those downtown Ann Arbor light poles. Replacement of the deteriorating poles was identified by the city as a need in the first half of 2012. The source of an estimated $600,000 required for the project was specified in the city’s CIP (capital improvements plan) that year as coming from the DDA – though the funds were at that time not authorized by the board.

In the spring of 2013, the city council weighed how it might clarify the city’s ordinance that restricts the DDA TIF (tax increment finance) capture. In that context, DDA executive director Susan Pollay told the council that the DDA might not be able to afford to pay for the Main Street light pole project – if the council changed the ordinance language to clarify the calculations in a way that did not favor the DDA. The question of the DDA’s TIF capture was not ultimately settled until the council’s Nov. 18, 2013 meeting.

In the interim, the city council voted at its May 20, 2013 meeting to request that the DDA allocate at least $300,000 for the $580,000 light pole project. After the council then declined at its Oct. 21, 2013 meeting to approve a budget allocation for the remaining $280,000 that was needed for the project, the DDA board passed its Dec. 4 resolution, citing the urgency of replacing at least 36 of the poles as the reason for its decision.

According to the DDA’s resolution, staff will use the DDA funding to begin now with replacement of those poles most in need of being removed, with the remainder replaced in the summer of 2014.

Also at its Dec. 4 meeting – in connection with the city’s pending sale to Dennis Dahlmann of the former Y lot, at William Street and Fifth Avenue – the DDA board passed a resolution that waived claim to $1,439,959 in reimbursements from the sale that the DDA has calculated it might be owed. The city council adopted a policy on Oct. 15, 2012 that included depositing net proceeds (after reimbursements) from the former Y lot sale into the city’s affordable housing trust fund.

So the DDA board’s action is an attempt to increase the amount that will be deposited into the affordable housing trust fund. The resolution passed by the DDA board also calls on the city council to waive the city’s claim to reimbursements. The city purchased the property in 2003 for $3.5 million and has made interest-only payments for the last 10 years on a loan for that amount. The agreed-upon sale price to Dahlmann is $5.25 million.

In another formal action taken on Dec. 4, the DDA board accepted the audit report from the most recently concluded fiscal year – FY 2013, which ended June 30, 2013. The auditor issued an “unmodified” or clean opinion.

The board also considered a request, which was ultimately tabled, from the developer of the 624 Church St. project. The developer is asking for an extension of the contractual agreement under which parking permits could be purchased using the city’s contribution-in-lieu (CIL) program. The program allows a developer to satisfy certain zoning requirements that parking spaces be provided for a project – by purchasing monthly permits in the public parking system at a premium rate, instead of building the spaces on site. The developer of the 624 Church St. project wants the ability to extend the 15-year minimum to cover a 30-year financing period – based on feedback from firms that would be providing the financing. The DDA board ultimately voted to table the question pending further review by the board’s operations committee.

The board’s newest members introduced themselves at the meeting: city administrator Steve Powers and Main Street retailer Cyndi Clark.

Also at its Dec. 4 meeting, the board heard a range of updates on various projects and public commentary. Highlights included a report from the Main Street BIZ (business improvement zone), which has enough money in its fund balance to handle sidewalk snow removal for the coming winter, without collecting the winter tax assessment to which it is entitled. In a separate update, there’s a possibility that downtown ambassadors could be hired by the DDA as soon as the summer of 2014.

DDA Waives Claim to Y Lot Sale Proceeds

The board of the Ann Arbor Downtown Development Authority has voted to waive any claim to a reimbursement of about $1.4 million it might have had coming from the net proceeds of the pending sale of the city-owned property known as the former Y lot. The property is located on William Street between Fourth and Fifth avenues downtown.

Waiver of that claim could lead to the transfer of the money to the city of Ann Arbor’s affordable housing trust fund, under a policy established by the Ann Arbor city council a year ago. The DDA board’s action came at its Dec. 4, 2013 meeting. DDA Audit: Clean Opinion for FY 2013

In action taken at its Dec. 4, 2013 meeting, the Ann Arbor Downtown Development Authority board voted to accept the authority’s FY 2013 audited statements. The overall opinion was that the DDA’s records are a fair and accurate statement of the authority’s finances – an “unmodified” or clean opinion.

DDA Ponies Up for Main Street Light Poles

Political wrangling over who should pay for downtown Ann Arbor Main Street light poles has ended with a resolution passed by the Ann Arbor Downtown Development Authority board to allocate the remaining $280,000 for the project. The DDA board had previously allocated $300,000 for the $580,000 project to replace 81 light poles on downtown Main Street.

Planning Commission OKs Capital Plan

The city of Ann Arbor’s capital improvements plan (CIP), which provides a roadmap for investments in a wide variety of infrastructure projects, was approved by Ann Arbor planning commissioners at their Dec. 3, 2013 meeting. The CIP is prepared by city staff and is the basis for budget decisions made by the city council, but the council does not approve the CIP. That’s the purview of the planning commission.

The planning commission’s meeting also included a public hearing on the CIP, but no one spoke.

Required by state statute, the CIP must be developed and updated each year, looking ahead at a six-year period, to help with financial planning for major projects – permanent infrastructure like buildings, utilities, transportation and parks. It’s … [Full Story]

New Member of Ann Arbor DDA Board: Steve Powers

As a result of Ann Arbor city council action taken at its Dec. 2, 2013 meeting, city administrator Steve Powers has been appointed to serve for the next year on the board of the Ann Arbor Downtown Development Authority.

The state enabling statute allows for either the mayor or the city administrator to serve on the board of a DDA. Mayor John Hieftje has served that role for his 13-year tenure as mayor.

However, discussion had occurred throughout the council’s recent consideration of the city’s DDA ordinance about the possibility of appointing the city administrator instead of Hieftje to serve in the statutory slot on the DDA board. Hieftje has announced that he’s not seeking re-election as mayor in 2014.

Council Loan Extension on Y Lot: Timing Backup

As a hedge – against the possibility that not all the due diligence is completed and the closing on the sale of the former Y lot is delayed past Dec. 16 – the Ann Arbor council has approved a six-month extension on an installment purchase agreement with Bank of Ann Arbor for $3.5 million. That’s the amount the city owes as a balloon payment on the property it purchased 10 years ago.

Dec. 2, 2013 Ann Arbor Council: Live

The Ann Arbor city council’s Dec. 2, 2013 agenda is comparatively light, but might not lead to an especially short meeting.

Items that could result in considerable council discussion include final approval of a repeal of the city’s crosswalk ordinance. A scheduled public hearing on that issue could also draw a number of speakers. The council gave initial approval to the repeal at its Nov. 18, 2013 meeting – on a 9-2 vote.

The tally could be closer for the final vote, as mayor John Hieftje, Sabra Briere (Ward 1) and Chuck Warpehoski (Ward 5) could join Christopher Taylor (Ward 3) and Margie Teall (Ward 4), who had dissented on the initial approval. Also a possibility is that a compromise approach could be worked out. The possible compromise would leave intact the language about motorists stopping, but still limit the right-of-way to just pedestrians within a crosswalk – that is, it would not afford the right-of-way to those standing at the curb.

Some of the public’s perspective and council discussion on the crosswalk issue was aired out during the council’s Sunday caucus, held in council chambers at city hall. This week the caucus was rescheduled for 1 p.m. instead of its usual evening start time, to accommodate more discussion of the local crosswalk law. The caucus drew six councilmembers and a dozen members of the public, and lasted three hours.

Another topic that could extend the Dec. 2 meeting is related to the pending sale of the Edwards Brothers property on South State Street to the University of Michigan for $12.8 million, which was announced in a press release last week. A right of first refusal on the property is held by the city of Ann Arbor as a condition of a tax abatement granted by the city council almost three years ago, on Jan. 18, 2011.

There’s some interest on the council in holding a closed session on Dec. 2 to review the options and the impact of those options. Any interest on the council in acquiring the land, which seems somewhat scant, would be based on a desire eventually to put the land back on the tax rolls. The topic of land acquisition is one of the legal exceptions to the Michigan Open Meetings Act, which requires all deliberations of a public body to be open to the public. If the council holds a closed session on that topic, it could extend the Dec. 2 meeting.

One reason the council may have little appetite for acquiring the Edwards Brothers property is that the city has just now managed to sell a downtown property the city acquired 10 years ago – the old Y lot on William Street, between Fourth and Fifth avenues. Approval of the $5.25 million sale to Dennis Dahlmann came at the council’s Nov. 18 meeting. But it’s possible that not all the due diligence will be completed before Dec. 16, when the city owes the $3.5 million principal it used to purchase the property. As a hedge against that possibility, the council will be asked on Dec. 2 to approve a six-month extension on the installment purchase agreement with Bank of Ann Arbor for the $3.5 million.

In the meantime, the minutes of the Ann Arbor Downtown Development Authority’s most recent operations committee meeting reflect the DDA’s expectation that all of the equipment used to operate the public surface parking facility at the old Y lot will need to be removed by Dec. 31, 2013.

The city’s right of first refusal on the Edwards Brothers property is linked to a tax abatement. And on the council’s Dec. 2 agenda is an item that would establish an industrial development district (IDD) for a different property, at 1901 E. Ellsworth, where Extang Corp. and GSG Fasteners are located. Creating an IDD is a step in the process for granting a tax abatement.

Land control and use is a predominant theme among other Dec. 2 agenda items as well.

The council will be asked to give initial approval to a rezoning request for the Traverwood Apartments project – from ORL (office, research and light industrial district) to R4D (multiple-family district). The First Martin Corp. project would include 16 two-story buildings for a total of 216 one- and two-bedroom units – or 280 total bedrooms. The site plan and final rezoning approval would come before the city council at a future meeting. The Dec. 2 meeting will also include council’s consideration of a donation of 2.2 acres to the city from Bill Martin just north of the Traverwood Apartments project site. The acreage to be donated is next to the city’s Stapp Nature Area and the Leslie Park golf course.

At its Dec. 2 meeting, the council will also be asked to approve the site plan for a three-story addition to the Running Fit store at the northwest corner of Fourth Avenue and Liberty Street in downtown Ann Arbor. The first floor will be retained as retail space, but six residential units would be built on the upper three floors – one two-bedroom and five one-bedroom units.

The city council will also be asked to place a value on land currently used as on-street parking spaces – $45,000 per space. By formally adopting that figure, any future development that causes the removal of on-street parking could be charged that amount. It would be paid to the Ann Arbor DDA, which manages the city’s public parking system. In this matter, the council would be acting on a four-year-old recommendation, approved by the Ann Arbor DDA in 2009.

In non-land issues, the council will be introduced to newly hired firefighters at its Dec. 2 meeting. The budgeted staffing level for the fire department is 85. However, the statistical section from the city’s most recent comprehensive annual financial report (CAFR) shows 82 AAFD staff in fiscal year 2013. That’s because the council approved the hiring of additional firefighters after the fiscal year began, bringing the total to 85.

The CAFR itself is indirectly included in the council’s agenda – as part of a presentation that will be given by chief financial officer Tom Crawford on the result of this year’s audit. It was a clean audit that showed the general fund doing about $2.4 million better than budgeted.

Among the other myriad statistics in the CAFR are the number of parking violations recorded by the city – which are again down in the range of 90,000, as they’ve been for the last three years. That’s about half what they were in 2006 and 2007. Those numbers in the CAFR don’t include University of Michigan parking tickets – although the city and the UM have an agreement under which the city processes tickets and hears appeals for the university. A renewal of that agreement is on the council’s agenda for Dec. 2.

On Dec. 2 the council also has a fair amount of its own internal business to wrap up, associated with the seating of the new council, which took place on Nov. 18. That includes adoption of the council rules. Based on a less than 10-minute meeting of the council’s rules committee on Nov. 29, no changes to the rules would be put forward at this time. Based on that meeting, it appears that Sally Petersen (Ward 2) will replace Stephen Kunselman (Ward 3) on that council committee. The rest of the new council committee assignments are also supposed to be made at the Dec. 2 meeting.

The council’s calendar of regular meetings and work sessions will also be adopted at the Dec. 2 meeting. The basic pattern is first and third Mondays for regular meetings, except when there’s a holiday or an election during the week of the meeting.

Four-Year County Budget Sets Precedent

Washtenaw County board of commissioners meeting (Nov. 20, 2013): After a final debate, commissioners adopted the 2014-2017 general fund budget, an unprecedented long-term document that some commissioners believe will improve strategic investments and organizational stability.

At their Nov. 20 meeting, commissioners made several amendments, but did not substantively change the originally proposed budget submitted by county administrator Verna McDaniel in early October. Initial approval had been given during a six-hour meeting on Nov. 6, 2013. The Nov. 20 meeting lasted about two-and-a-half hours.

The vote was 7-1, with dissent from Ronnie Peterson (D-District 6) – though he cited three elements of the budget that he wanted to support: the community impact statements, outside agency funding, and position modifications. Rolland Sizemore Jr. (D-District 5) was absent. Dan Smith (R-District 2), who had dissented in the initial vote on Nov. 6, stated that he still had several concerns with the budget, but he voted for it because the budget supported many important activities throughout the county. He noted that although it spanned four years, the board is required by state law to approve the budget each year, so “technically it’s a one-year budget.”

Several new amendments were made during deliberations on Nov. 20. An amendment proposed by Conan Smith (D-District 9) directs the administration to conduct a study of county staff “to assess the capabilities of the organization to meet the community outcomes and processes.” Another amendment directs the administration to conduct a “citizens experience study” that would help inform board priorities.

Alicia Ping (R-District 3) proposed an amendment to shift $500,000 from the facilities, operations & maintenance fund to a contingency fund for parking. That contingency fund will serve as a placeholder as the county renegotiates parking contracts with the Ann Arbor Downtown Development Authority. The current contract, signed in 2004, runs through 2023.

As he has on previous occasions, Peterson argued against the four-year budget approach, preferring to maintain the current two-year budget process. He said that if he’s re-elected in 2014, he’ll fight to overturn the four-year budget and institute a one- or two-year budget instead. The board’s leadership – including Rabhi and Felicia Brabec (D-District 4), chair of the board’s ways & means committee – believe a four-year budget will improve long-term planning and stability, and could be transformational to the way that the county does business.

The board leadership also wants the board to be engaged in a continual process of monitoring the outcomes related to budget investments. To that end, on Nov. 20 the board also voted to adopt a set of “community outcomes” to guide that investment, as well as a framework for developing future budgets that reflect those desired outcomes. [.pdf of community outcomes resolution] Those outcomes are more detailed “impact statements” tied to budget priorities that the board approved on July 24, 2013.

A major discussion point at the Nov. 6 meeting – about the impact of budget cuts on the sheriff’s office – received much less attention on Nov. 20. However, after the meeting Rabhi told The Chronicle that discussions are underway with the sheriff, and that there will be a budget amendment brought forward soon that will address some of the concerns that have been raised by sheriff Jerry Clayton.

In addition to the budget, the board handled two items related to workforce development: (1) giving initial approval to accept $1,154,683 in funding from the Partnership Accountability Training Hope (PATH) program, which is part of Michigan’s welfare system; and (2) approving amended bylaws for the county’s workforce development board.

During public commentary, Christina Lirones advocated for the board to opt out of Pittsfield Township’s State Street corridor improvement authority (CIA). On Nov. 6, commissioners had voted to approve a tax-sharing agreement with Pittsfield Township and the CIA, which means that a portion of county taxes will be used to help fund the project. Lirones noted that there’s still time for the board to change its mind – as the board has one more meeting, on Dec. 4,

The board made one appointment on Nov. 20, adding York Township supervisor John Stanowski to an exploratory subcommittee for the future of the Washtenaw County road commission. Rabhi also indicated that nominations to other volunteer boards, committees and commissions would be brought forward for a board vote on Dec. 4. Though the deadline for submitting applications had passed, the deadlines have been extended until Dec. 1 for openings on three groups: the southeast Michigan’s Regional Transit Authority (RTA); the Washtenaw County historic district commission; and the Washtenaw County food policy council. At the end of the meeting, Rabhi reminded commissioners that a holiday reception will be held prior to the board’s next meeting on Dec. 4, in the lobby of the county administration building at 220 N. Main from 4-6 p.m. [Full Story]

Washtenaw County 2014-17 Budget Adopted

The Washtenaw County board of commissioners has adopted the 2014-2017 general fund budget, an unprecedented long-term document that some commissioners believe will improve strategic investments and organizational stability. At their Nov. 20, 2013 meeting, commissioners made several amendments, but did not substantively change the originally proposed budget submitted by county administrator Verna McDaniel. Initial approval had been given at a six-hour meeting on Nov. 6, 2013. The Nov. 20 meeting lasted about two-and-a-half hours.

The $103,005,127 budget for 2014 – which represents a slight decrease from the 2013 expenditures of $103,218,903 – includes putting a net total of 8.47 full-time-equivalent jobs on “hold vacant” status, as well as the net reduction of a 0.3 FTE position. The recommended budgets for … [Full Story]

Ann Arbor DDA TIF: Capped

A change to Ann Arbor’s ordinance (Chapter 7) regulating the Ann Arbor Downtown Development Authority’s tax increment finance capture and its board governance has been given final approval by the city council. The action came at the council’s Nov. 18, 2013 meeting on a 9-2 vote. Dissent came from Christopher Taylor (Ward 3) and Margie Teall (Ward 4).

The version of the Chapter 7 ordinance change given final approval by the council would allow for several million dollars in additional TIF capture by the DDA, compared to a different version that had been tabled. Column: Connecting Dots – DDA, FOIA

Some good news for open government came out of Lansing this last week, on Nov. 12.

A piece of legislation that would “modernize” Michigan’s Freedom of Information Act moved out of the House Oversight Committee.

Progress on that legislation will be interesting to track as the bill possibly makes its way into state law. [.pdf of HB 4001]

For now, I’d like to focus on just one clause of the proposed legislation. And I’d like to connect that to some otherwise unrelated dots, one of which is an upcoming Ann Arbor city council vote.

That vote – on an appointment to the board of the Ann Arbor Downtown Development Authority – will take place either at the council’s next meeting on Nov. 18 or possibly at its following meeting on Dec. 2. [Full Story]

DDA OKs Streetscape Contract, Parking Permits

Both items were approved on unanimous votes at the meeting, which featured perfect attendance by the 11 current members of the board. The following evening, on Nov. 7, the Ann Arbor city council confirmed the appointment of Cyndi Clark, owner of Lily Grace Cosmetics, to fill a vacancy on the 12-member DDA body. At its Nov. 6 meeting, the board did not discuss either Clark’s appointment or the other council agenda item affecting the DDA – a revision to the city ordinance that regulates the DDA TIF (tax increment financing) capture.

The sale of monthly parking permits for the 624 Church St. development was an issue that the DDA board had previously considered – for an earlier version of the project, which had actually completed the city approval process. It had gone through planning commission review and recommendation, with a site plan approved by the city council on March 4, 2013. For that earlier version, the project was required to provide 42 parking spaces for the additional residential square footage it contained beyond the by-right density under the city’s zoning code. Instead of providing the parking spaces on-site, the owner of the project sought to satisfy the requirement through the contribution in lieu (CIL) program – a request that was granted by the DDA.

For this revised and expanded version of the project – made possible through additional land acquisition – a greater number of parking spaces is required. And the project owner again sought to meet that requirement through the CIL program. So at its Nov. 6 meeting, the DDA board granted the project owner the ability to purchase 48 monthly parking permits in the Forest Avenue parking structure.

The DDA board also acted on its streetscape framework project. The contract awarded to SmithGroupJJR and Nelson\Nygaard is meant to provide guidance for developing future streetscape projects, not to design any specific streetscape project. The most recent streetscape improvement undertaken by the DDA was the Fifth and Division project, which included lane reconfigurations and bump-outs.

In addition to its voting items, the board received a raft of updates, which included reports on the first quarter financials. The DDA is essentially on course to realize $4.5 million in TIF capture revenue and about $19 million in parking revenue. Other updates included reports on preparations for the NHL Winter Classic hockey game, debriefing on the International Downtown Association conference attended by some board members and staff, Freedom of Information Act issues, and public commentary.

The board heard from Ray Detter, speaking on behalf of the downtown area citizens advisory council, about the ongoing downtown zoning review. Detter’s remarks were countered by DDA board members. Detter reprised his comments at the city planning commission meeting later that evening. Alternate DDA TIF Revision Gets First OK

Two different versions of a revision to Ann Arbor’s ordinance regulating TIF capture were considered by the Ann Arbor city council at its Nov. 7, 2013 meeting. One was tabled, while the other will move forward for final consideration at the city council’s Nov. 18, 2013 meeting.

The version to be considered by the council on Nov. 18 would set a cap on TIF (tax increment financing) revenue for the Ann Arbor Downtown Development Authority that would not apply at all until FY 2017. It would result in roughly $6.1 million of TIF revenue to the DDA that year, with an estimated return of $300,000 total to the other taxing jurisdictions. Nov. 7, 2013 City Council: Live Updates

Editor’s note: This “Live Updates” coverage of the Ann Arbor city council’s Nov. 7, 2013 meeting includes all the material from an earlier preview article. We think that will facilitate easier navigation from live-update material to background material already in the file.

The Thursday meeting, shifted from its usual Monday slot due to the Tuesday elections, is the last one with the current composition of the 11-member council. The outcome of Tuesday’s elections left all incumbents in place except for Marcia Higgins (Ward 4), whose departure was decided in the August Democratic primary. Ward 4 primary winner Jack Eaton will be the single new face on the council at its Nov. 18 meeting. At the Nov. 7 meeting, Higgins will likely receive a customary parting gift from her colleagues, to acknowledge her 14 years of service on the council.

The agenda is relatively heavy, featuring at least 34 voting items. This preview includes a more detailed explanation of several of those items, but first provides a thematic overview.

The city’s downtown factors prominently on the agenda in at least three ways. The city council will be asked to consider passing a resolution to direct the city administrator to negotiate a sales agreement for the city-owned property along William Street between Fourth and Fifth avenues, known as the old Y lot. The council will also be considering a revision to the city ordinance regulating the tax increment finance (TIF) capture of the Ann Arbor Downtown Development Authority. That’s been on the agenda since February, but now a committee of councilmembers and DDA board members has put forth a competing recommendation, which will also be on the Nov. 7 agenda.

Also related to downtown, the council will be formally accepting a report completed by the city’s park advisory commission with recommendations related to downtown parks.

Non-motorized issues also factor prominently as a theme of the Nov. 7 agenda. In addition to an update of the city’s non-motorized transportation plan, the council will consider establishing a pedestrian safety task force. The council’s agenda also includes the first of a series of resolutions for two separate sidewalk projects – one on Stone School Road and another on Scio Church Road. The council’s resolutions for those projects, directing the design work and detailed cost estimates, are the first actions necessary for some of the funding of the sidewalks to be special assessed to the adjacent property owners.

An additional project related to non-motorized issues, but not obviously so, is a contract with the Michigan Dept. of Transportation to resurface a portion of Huron Street from Main Street westward as Huron becomes Jackson Avenue on to I-94, as well as a section of South Maple. The intent is to re-stripe the roadway, reducing the lanes from four to three and adding bicycle lanes.

The sidewalk and street projects are among several capital improvement-related items on the agenda, including one that would help stabilize the earthen berm adjacent to Barton Dam. The council will also be considering a half dozen resolutions that will authorize applying for state grants that could fund capital asset projects for the city.

In addition to the items related to the city’s physical infrastructure, the council has several items that could be described as relating to the city’s social infrastructure. Those items relate to grants from the state and federal government to the 15th District Court for several of its specialty courts that focus on drug offenses, domestic violence, and veterans issues. The council will also be asked to approve a modified continuation of its coordinated funding approach to human services.

The agenda includes some council initiatives announced at the council’s previous meeting on Oct. 21. One of those is a resolution requesting that the University of Michigan decommission a recently constructed digital billboard near the football stadium.

Another one is a resolution directing the education of city officials on professional conduct. Related tangentially to those ethical considerations are the approvals of new bylaws for two of the city’s boards and commissions – the planning commission and the design review board.
