Project LIFT Grant Application Approved

At its June 6, 2012 meeting, the Washtenaw County board of commissioners gave final approval to apply for a $1,348,853 federal grant from the U.S. Dept. of Labor to fund Project LIFT, a jobs training and service program for juvenile ex-offenders run by the county sheriff’s office. Final OK for County Bond Re-Funding

Final approval for the re-funding of bonds previously issued by Washtenaw County was given by the county board of commissioners at its June 6, 2012 meeting. The action – advised by the county’s bond counsel, John Axe of Axe & Ecklund of Grosse Pointe Farms – consolidates two previous bond issues and is expected to save $889,000 over the life of the bond repayments. Initial approval was given at the board’s May 16, 2012 meeting.

The county board approved a bond sale of $6.365 million in 2004 to fund energy efficiency improvements in county facilities. Children’s Summer Food Grant Approved

Washtenaw County commissioners voted to apply for a $108,364 federal grant – available through reimbursements from the Michigan Dept. of Education – to fund a summer food program for children of low-income families. The program will be supplemented with $37,386 in additional federal Community Services Block Grant funding. The action came during the board’s June 6, 2012 meeting.

The program will serve about 13,000 breakfasts, 37,000 lunches, and 21,000 snacks to children at 12 sites throughout the Ann Arbor/Ypsilanti area, including schools, recreation centers, community centers, or other community-based organizations. It will be administered by the office of community and economic development, a joint county/city of Ann Arbor unit. County Millage Rate Gets Final OK

At their June, 2012 meeting, Washtenaw County commissioners gave final approval to set the 2012 county general operating millage rate at 4.5493 mills – unchanged from the current rate. A public hearing on the millage rates drew one person, Thomas Partridge, who called on the board to review the current millage rates in light of overwhelming need for increased services. He urged commissioners to find ways to increase revenues to address these needs.

Several other county millages are levied separately: emergency communications (0.2000 mills), the Huron Clinton Metroparks Authority (0.2146 mills), two for county parks and recreation (0.2353 mills and 0.236 mills) and for the natural areas preservation program (0.2409 mills). That brings the total county millage rate to 5.6768 mills, a rate that’s also unchanged … [Full Story]

Food Policy Council Members Appointed

In action taken at their June 6, 2012 meeting, Washtenaw County commissioners appointed 15 members to a new Washtenaw Food Policy Council, and passed amended bylaws. The board of commissioners had given final approval to create the council at its March 21, 2012 meeting.

Members appointed with one-year terms are: Bill Alt (faith-based organization); Amanda Edmonds (urban agriculture); Dena Jaffee (food service); Liz Dahl MacGregor (citizen); Nicole Miller (emergency food system); Lindsey Scalera (education); Dayle Wright (health care); and Patti Smith (human Services).

Ypsi Council Re-Adopts Transit Accord

The Ypsilanti city council has reconsidered and ratified the four-party public transportation agreement intended to be the foundation for a future countywide transportation authority. Under the new authority, the Ann Arbor Transportation Authority’s governance and area of service would be expanded.

The version of the four-party agreement adopted by the Ypsilanti council now matches that which was approved by the Ann Arbor city council the previous day on June 4, 2012. That version, now approved by both bodies, provides for different treatment of a 1% municipal service charge by each city.

Under the agreement, Ann Arbor will apply the 1% charge before forwarding its transit millage revenues to a possible new transportation authority to be formed under Act 196 of 1986. Ypsilanti will not assess … [Full Story]

Next Steps on County’s Animal Control Policy

It was the second meeting scheduled. The first one – on May 9 – was canceled after only two commissioners showed up. The intent is to set policy that will guide a request for proposals that the county plans to issue later this year, for its next contract to provide animal control services. Those services are currently handled by the Humane Society of Huron Valley (HSHV), in a contract that expires at the end of 2012.

The wide-ranging discussion revealed tensions between the push to control costs – a point that’s been driving these changes – and a desire by some to provide a higher level of service than what’s mandated by the state. There seemed to be at least some initial consensus that while the state mandate focuses on stray dogs and animal cruelty, the county should support a broader range of animal control services, depending on the cost.

Also discussed was the need to bring more communities into the conversation – at least those that have their own animal control ordinances, including Ann Arbor, Ypsilanti and Ypsilanti Township. Representatives from those municipalities are participating in a separate work group, led by sheriff Jerry Clayton, that’s developing a cost structure for animal control services. The hope is that other communities will also give financial support to HSHV, or possibly another service provider.

Four additional task force meetings are scheduled: on June 13, July 25, Aug. 22 and Sept. 12. All meetings are open to the public and will provide an opportunity for public commentary. They’ll take place from 8-10 a.m. at the county’s Learning Resource Center, 4135 Washtenaw Ave., and are being facilitated by representatives of the Dispute Resolution Center. [Full Story]

Budget Items Dominate County Board Session

The 2012 budget update covered the first three months of the year, but also looked at projections for the full year. Overall revenues for the general fund are now projected to be about $1.165 million more than budgeted  in 2012 – thanks in large part to about $2.5 million more in property tax revenues than originally anticipated, but offset by revenue shortfalls in other areas. Total revenues for the 2012 general fund are expected to reach $99.9 million.

But expenditures for the general fund are $893,527 more than budgeted, primarily due to $669,000 in higher-than-expected costs in the sheriff’s office from greater use of part‐time temporary workers and overtime, operating supplies, and jail medical/food contracts.

The 2012 budget had anticipated a surplus of $1.889 million, but the administration is now projecting a surplus of just $272,238. That surplus is intended to carry over into the 2013 fund balance – so the county faces a $1.617 million shortfall in the amount it had budgeted for the fund balance contribution in 2013. Currently, the county has a $14.5 million fund balance.

Tina Gavalier, the county’s finance analyst, told commissioners that she’ll have a much clearer picture of the budget outlook when she gives a second-quarter update at the board’s Aug. 1 meeting. She listed out several areas that the administration intends to monitor closely, including medical costs, state revenue-sharing, personal property tax reform, and actuarial valuations for the retirement plan and retiree health benefits.

The board also took an initial vote to set the 2012 county general operating millage rate at 4.5493 mills – unchanged from the current rate. Several other county millages are levied separately: emergency communications (0.2000 mills), the Huron Clinton Metroparks Authority (0.2146 mills), two for county parks and recreation (0.2353 mills and 0.236 mills) and for the natural areas preservation program (0.2409 mills). That brings the total county millage rate to 5.6768 mills, which is also unchanged from 2011. One mill is equal to $1 for every $1,000 of a property’s taxable value.

This is an annual procedural action, not a vote to levy new taxes, and it’s typically passed without discussion. But this time Wes Prater raised concerns about a $29 million fund balance for the parks and recreation department, saying it was too high and wondering whether it indicated that the tax levy for parks should be lowered. Several other commissioners – including those who serve on the parks & recreation commission (which oversees those funds) – defended the fund balance, noting that several major capital projects are in the works that will tap that money.

In another budget-related action, commissioners gave final approval to the Urban County’s annual plan for July 1, 2012 through June 30, 2013 with a $3.59 million budget. The Urban County is a consortium of local municipalities that receive federal funding for projects in low-income neighborhoods. In a separate vote, the board approved adding Webster Township to the consortium, which includes the city of Ann Arbor, Ypsilanti and several townships.

Two residents spoke during public commentary, objecting to funding for Planned Parenthood that was included in the annual plan. That particular funding had already been approved last year by the board, as part of a coordinated funding model that pools includes money from the county, the Urban County, Washtenaw United Way, and the city of Ann Arbor to fund several dozen human services nonprofits.

Two commissioners commented on issues related to animal control services during the May 16 meeting. Barbara Bergman noted that there had been a “failed meeting” of a task force on May 9 – only she and board chair Conan Smith had attended from the board, although the task force is open to all commissioners. [See Chronicle coverage: "Low Turnout for Animal Control Task Force."] The intent is to set policy that will guide a request for proposals that the county plans to issue later this year, for its next contract to provide animal control services. Those services are currently handled by the Humane Society of Huron Valley (HSHV), in a contract that expires at the end of 2012. [A subsequent task force meeting on the morning of May 23 drew five of the 11 commissioners, and will be reported in a separate Chronicle article.]

A separate work group on animal control services is being led by the sheriff’s office. That group is tasked with developing a methodology to determine the cost of providing animal control services. It includes representatives from HSHV, the county, and other municipalities that have animal control ordinances. Commissioner Rob Turner, who serves on the group, reported that the HSHV has agreed to work with the county’s finance department to come up with a cost breakdown for the services it currently provides.

The May 16 meeting also included a brief swearing-in ceremony for Felicia Brabec, who won a May 8 special election to represent District 7. Brabec had been appointed to the board last October following Kristin Judge’s resignation. [Full Story]

Borregard Off Ballot in County Board Race

In the District 2 race for Washtenaw County board of commissioners, Democrat Eric Borregard will be removed from the ballot in District 2, leaving Republican incumbent Dan Smith unchallenged by any partisan candidates in the primary and general elections.

The decision came after the state Bureau of Elections indicated late Friday afternoon that a determination made by county clerk Larry Kestenbaum earlier in the week was inappropriate. Ed Golembiewski, chief deputy county clerk and elections director, told The Chronicle on Saturday that Borregard had been apprised of the situation, and will be officially informed in writing on Monday, when his name will be removed from the list of candidates on the county’s election website.

Borregard, a Dexter resident, had originally filed to run in District 1, which is the current district in which he resides. However, because of redistricting that takes effect for the upcoming election, his home will be located in the new District 2. Shortly after the 4 p.m. filing deadline on Tuesday, May 15, the county clerk’s office was alerted to this error by Kent Martinez-Kratz, a Democrat who’s running in District 1 against incumbent Republican Rob Turner. Acting to correct what he deemed a clerical error, Kestenbaum, a Democrat, approved an amendment to Borregard’s paperwork to allow him to appear on the District 2 ballot.

On Friday afternoon at 2 p.m., Kestenbaum told The Chronicle that he had talked with the county’s corporation counsel [Curtis Hedger] earlier in the week, as well as to staff in the state Bureau of Elections, and that he was comfortable that the change was within his authority to make. He said it was important not to create barriers to running for office. “There’s no trickery here,” he said.

Later that afternoon, Secretary of State spokesman Fred Woodhams told The Chronicle that staff were reviewing the situation and would potentially weigh on in it early next week. The Bureau of Elections is a division of the office of Secretary of State, a position held by Republican Ruth Johnson.

But just a few minutes before 5 p.m. on Friday, an official from the Bureau of Elections contacted the county clerk’s office, according to Golembiewski. The state’s view is that it was not appropriate to accept changes to the filing after the 4 p.m. deadline. As a result, Borregard’s name will not appear on the ballot. Kestenbaum left town Friday afternoon to attend an out-of-state funeral over the weekend and could not be reached. Golembiewski said that Kestenbaum had previously indicated he would abide by the state Bureau of Elections decision.

Borregard, who ran for county commissioner in 2010 but was defeated in the Democratic primary, has the option of challenging the decision in court. He could also choose to run as an independent in the Nov. 6 general election – the filing deadline for candidates who are not affiliated with a political party is July 19 at 4 p.m.

In another county board race, two Ypsilanti Township candidates who had previously filed to run for the commissioner seat in District 5 – Rick Roe and Michael White – have withdrawn from that Aug. 7 primary race. The deadline to withdraw was 4 p.m. Friday, May 18. That leaves incumbent Democrat Rolland Sizemore Jr. unchallenged in the primary.

Urban County Plan OK’d, Webster Twp. Joins

Washtenaw County commissioners took two actions related to the Washtenaw Urban County at their May 16, 2012 meeting.

Commissioners gave final approval to the Urban County’s annual plan for July 1, 2012 through June 30, 2013 with a $3.59 million budget. A public hearing on the plan had been held at the board’s May 2, 2012 meeting. The annual plan describes how the Urban County expects to spend the federal funding it receives from the Community Development Block Grant (CDBG), HOME Investment Partnerships Program (HOME) and Emergency Shelter Grant (ESG) programs, operated by the U.S. Dept. of Housing and Urban Development (HUD).

Sugar Creek Drain Bonds Get Final OK

At its May 16, 2012 meeting, the Washtenaw County board of commissioners gave final approval to pledge the county’s full faith and credit for up to $270,000 in bonds to fund an extension of the Sugar Creek drainage district. The financing request came from water resources commissioner Janis Bobrin, whose office is managing the project. It had been given initial approval at the board’s May 2 meeting.

The project – which in total is budgeted at $349,899 – is being done at the behest of the Washtenaw County road commission. It entails relocating a portion of the county drain, including a section of 1,850 feet adjacent to Platt Road between Judd and Stoney Creek roads in York Township. Republican Floyd Files in County Board Race

On Monday, May 14, two additional candidates have filed in races for the Washtenaw County board of commissioners. One day remains before the 4 p.m. May 15 filing deadline for candidates affiliated with political parties running in the Aug. 7 primary.

John Floyd has filed as the only Republican candidate in the new District 9 so far. Incumbent Conan Smith, who serves as the current board chair, is the only Democrat so far in that race. Floyd most recently was a Republican candidate in the 2010 Ward 5 Ann Arbor city council race, losing with 21.9% of the vote to incumbent Democrat Carsten Hohnke – in a three-way race that included Newcombe Clark, who ran as an independent. Update: Washtenaw County Candidate Filings

With two days remaining before the filing deadline for candidates in the Aug. 7, 2012 primary election, several incumbents remain unchallenged so far for Washtenaw County offices. The filing deadline for candidates affiliated with political parties is Tuesday, May 15 at 4 p.m.

Sheriff Jerry Clayton, county prosecuting attorney Brian Mackie and county clerk Larry Kestenbaum – all incumbent Democrats – were the only candidates to have filed by the end of the day on Friday, May 11. No candidates have filed yet for the office of county treasurer – including incumbent Democrat Catherine McClary. Low Turnout for Animal Control Task Force

Only two of 11 Washtenaw County commissioners – board chair Conan Smith and Barbara Bergman – showed up for a Wednesday morning policy task force meeting on animal control issues, so the meeting was canceled. Smith had convened the meeting as the first of six for commissioners to discuss a range of policy issues, including identifying the county’s state-mandated animal control services, selecting the non-mandated services the board would like to offer, and identifying the revenue sources available to fund those services.

Brabec Wins District 7 County Board Seat

In the May 8 election against Republican Richard Conn, Democrat incumbent Felicia Brabec won the Washtenaw County board of commissioners seat for District 7, to represent Pittsfield Township on the 11-member county board. Brabec received 934 votes (60.1%) compared to 610 votes (39.25%) for Conn. There were 10 write-in votes. Of the 10 precincts in Pittsfield Township, Brabec received a majority of votes in all but one – precinct 8.

This was the only election for the county board, for a term that will run through the end of 2012. (County commissioners typically serve two-year terms.) The unusual timing of the race stems from the October 2011 resignation of former District 7 commissioner Kristin Judge. County Responds to Sylvan Twp. Debt Crisis

Chief among those was a report on the debt crisis in Sylvan Township. The county picked up a $175,000 interest payment on May 1 that the township couldn’t afford to make, related to $12.5 million in bonds that were issued 11 years ago – and backed by the county’s full faith and credit – to build a water and wastewater treatment plant there.

Rob Turner – who represents District 1 on the county’s west side, where the township is located – reported that township officials hope to seek voter approval in August for a 20-year, 4.4 mill tax to cover the remaining payments. However, some commissioners expressed skepticism that township voters would approve a tax now, after rejecting a similar proposal in November. The county is also pursuing legal action for breach of contract, and is working with the township to reach a consent agreement that can be submitted to the court to outline a repayment strategy. If the millage doesn’t pass, it will be up to a judge to determine a tax levy. Commissioners were told that township residents will be assessed for the debt, one way or another.

In another report to the board, county administrator Verna McDaniel told commissioners that the county had agreed to a one-year extension to continue administering the Washtenaw Head Start program, through July 31, 2013. As part of the budget process last year, the county board had voted to relinquish its 46-year administration of the program on July 31, 2012. But the process to find another entity to administer Head Start has taken longer than expected, so the county reached an agreement with federal officials to operate the program another year.

McDaniel reported that the agreement waives a 20% local match of about $750,000 that the county had previously been required to provide. Because of that decrease there will be program changes, though details haven’t yet been worked out. While several commissioners praised the decision for easing the eventual transition to a new Head Start administrator, Ronnie Peterson expressed concern that the program’s high standards would be compromised.

The board also got an update on ongoing efforts to address how the county handles animal control services, in preparation to issue a request for proposals (RFP) later this year. Those services are currently being handled through a contract with the Humane Society of Huron Valley, which ends on Dec. 31, 2012. Board chair Conan Smith passed out a schedule for the board’s animal control policy task force meetings, with the first one set for Wednesday, May 9 from 8-10 a.m. at the county’s Learning Resource Center, 4135 Washtenaw Ave. The policy task force meetings will be open to the public.

Financial reports were also on the May 2 agenda, including the 2011 audit and an update on long-term liabilities. Wes Prater voiced concern that the county now has dramatically more in long-term liabilities than it did just five years ago. Total legacy liabilities, including pension and retiree health care benefits, have increased from $302.198 million at the end of 2007 to $346.572 million at the end of 2011.

Other items addressed during the meeting included: (1) an update from Yousef Rabhi on plans to put Project Grow gardens on the county-owned Platt Road site of the former juvenile justice center; (2) approval of up to $270,000 in bonds to fund an extension of the Sugar Creek drainage district in York and Augusta townships; (3) a resolution of support for the U.S. Clean Air Act; and (4) public commentary regarding the dangers of DTE Energy’s “smart” meters.

Commissioners also honored Hazel Bowman for her 25 years of volunteer service in the county’s foster grandparent program, giving her a standing ovation. [Full Story]

County Supports Clean Air Act

A resolution passed by the Washtenaw County board of commissioners at their May 2, 2012 meeting expresses support for the U.S. Clean Air Act, and opposes “attempts to weaken, dismantle, overrule or otherwise impede the Environmental Protection Agency from enforcing or implementing” the act. Rob Turner (R-District 1) voted against the resolution, citing concerns about the impact on business and employment. Dan Smith (R-District 2) abstained.

The resolution was requested by Dick Fleece, director of the county’s public health department. A staff memo accompanying the resolution notes that since the Washtenaw County Clean Indoor Air Regulation was implemented in 2003, the number of county residents using tobacco has dropped from 18% in 2003 to 12% in 2012. Initial OK for Sugar Creek Drain Bonds

Acting on a request from water resources commissioner Janis Bobrin, the Washteanw County board of commissioners gave initial approval to pledge the county’s full faith and credit for up to $270,000 in bonds to fund an extension of the Sugar Creek drainage district.

The project – which in total is budgeted at $349,899 – was requested by the Washtenaw County road commission. It entails relocating a portion of the county drain, including a section of 1,850 feet adjacent to Platt Road between Judd and Stoney Creek roads in York Township. A second phase includes removing sediment and vegetation, as well as making wingwall repairs, at the drain crossings of US-23, McCrone Road, and Gooding Road.

Report: Better-than-Expected ’12 Tax Revenue

Washtenaw County board of commissioners meeting (April 18, 2012): Most of the recent county board meeting was devoted to what’s become an annual ritual: Delivery of the county equalization report.

The report includes a calculation of taxable value for all jurisdictions in the county, which determines tax revenues for those entities that rely on taxpayer funding, including cities and townships, public schools, libraries and the Ann Arbor Transportation Authority, among others.

It was the 41st report that Raman Patel, the county’s equalization director, has completed – and he delivered some positive news. The county’s general fund budget was approved with a projection of $59.734 million in tax revenues. But actual revenues, based on 2012 taxable value, are now estimated at $62.395 million – for an excess in 2012 general fund revenues of $2.66 million.

Despite reporting better-than-expected taxable value, Patel cautioned that if the potential repeal of the state’s personal property tax is passed – being considered by legislators in a set of bills introduced last week – it could result in a loss of more than $5 million in annual revenues for the county government alone, and more than $40 million for all taxing jurisdictions in Washtenaw County.

Although most of the meeting focused on Patel’s presentation, other business covered a variety of issues. Commissioners discussed the next steps in an effort to deal with mandated animal control services in the county. A work group has met that includes representatives from the county, the Human Society of Huron Valley, and other municipalities that have animal control ordinances, such as the cities of Ann Arbor and Ypsilanti, and Ypsilanti Township. Some commissioners highlighted the need to develop a policy to guide the work group, which will give recommendations about the cost of animal control services.

Related to the March 15 tornado that touched down in the Dexter area, board chair Conan Smith reported that he had declared a state of emergency earlier this month and sent a letter to Gov. Rick Snyder requesting reimbursement to local municipalities for costs incurred as a result of the devastation. Local governments itemized about $1 million in costs, but the total – primarily in damages to residences – is estimated at over $9 million. During the meeting, the board also passed a proclamation recognizing the National Training Institute, put on by the National Joint Apprenticeship & Training Committee – a partnership of the International Brotherhood of Electrical Workers (IBEW) and the National Electrical Contractors Association (NECA). The training institute is held in Ann Arbor at the University of Michigan and this year runs from July 25-Aug. 3, bringing more than 3,000 people to town. Commissioner Rob Turner, an electrical contractor, is a member of both the IBEW and NECA.

Among the other action items at the April 18 meeting, commissioners (1) set a public hearing for May 2 to get public input on an annual plan for the Washtenaw Urban County, which gets federal funding for projects in low-income neighborhoods; (2) authorized the issuance of up to $6 million in notes at the request of the Washtenaw County road commission, for work in Ypsilanti Township; and (3) approved the hiring of Nimish Ganatra as assistant prosecuting attorney over the dissent of Wes Prater, who objected to paying a salary above the midpoint range. Washtenaw Taxable Value: Signs of Recovery

Following a presentation by Raman Patel, director of the county’s equalization department, the Washtenaw County board of commissioners approved the 2012 equalization report at its April 18, 2012 meeting. Equalized (assessed) value is used to calculate taxable value, which determines tax revenues for the county as well as its various municipalities and other entities that rely on taxpayer dollars, including schools, libraries and the Ann Arbor Transportation Authority, among others.

For 2012, taxable value in the county has fallen 0.77% to $13.7 billion. That’s an improvement over declines in recent years, when taxable value fell 2.85% in 2011 and 5.33% in 2010. Weatherization Projects Get Final OK

Two items related to federal funding for Washtenaw County’s weatherization program for low-income residents got final approval at the April 18, 2012 meeting of the county board of commissioners. Initial approval had been given at the board’s April 4 meeting.

Commissioners authorized acceptance of $185,326 in federal funds for the weatherization program. The federal program was cut by 65% compared to 2011, but the state of Michigan is reallocating the previous year’s unspent funds as “carry-forwards” for 2012. In 2011, the county received $241,863 for this program.

The funding is expected to provide air leakage testing, health and safety evaluations, furnace assessments, refrigerator efficiency testing, post-inspection of the completed work, and consumer education services to 25 units. To qualify for the program, residents … [Full Story]

Ganatra Hired as Asst. Prosecuting Attorney

At its April 18, 2012 meeting, the Washtenaw County board of commissioners gave final approval to hiring an assistant prosecuting attorney at a salary of $81,690. The vacancy opened in December, following an employee retirement. The hire requires board approval because the salary is above the $69,038 midpoint of an authorized range ($68,074 to $96,565).

The position will be filled by Nimish Ganatra, who currently serves as assistant prosecutor for Jackson County, and previously was an assistant prosecutor with the Washtenaw County prosecutor’s office from 2001-2009. He is a graduate of Ann Arbor Pioneer High School, the University of Michigan, and Wayne State University Law School.

Public Hearing Set for Urban County Plan

A public hearing to take commentary on the annual plan for the Washtenaw Urban County was set for the May 2, 2012 meeting of the Washtenaw County board of commissioners. The board’s vote to set the hearing came at its April 18 meeting.

The annual plan describes how the Urban County expects to spend the federal funding it receives from the Community Development Block Grant (CDBG), HOME Investment Partnerships Program (HOME) and Emergency Shelter Grant (ESG) programs, operated by the U.S. Dept. of Housing and Urban Development (HUD). County Working on Farmland Preservation

As the Washtenaw County parks and recreation commission moves closer to making its first decisions about farm properties to include in its land preservation program, the county board of commissioners got an update on the process at its April 5 working session.

Susan Lackey, executive director of the Legacy Land Conservancy – an Ann Arbor-based nonprofit that’s under contract to help manage the program – told commissioners that about $1.6 million is available to preserve farmland, using a portion of proceeds from the natural area preservation millage renewed by voters in November of 2010. That 10-year, 0.25-mill countywide tax also funds the acquisition of natural areas and land preserves.

Prior to 2010, the natural areas ordinance allowed for outright acquisition of land, but not for the purchase of development rights (PDR). PDR is a common mechanism for protecting farmland, letting landowners keep their property for farming but preventing – via a conservation easement – its development. In May of 2010, the county board approved an ordinance revision that incorporated farmland into the county’s natural areas preservation program and clarified the use of PDR for that purpose.

The county received 57 applications for its first round of potential deals, Lackey reported. That list has been narrowed down to seven parcels for final consideration, covering 1,100 acres. The locations of the parcels won’t be released until a final vote by the parks and rec commission. That vote will be taken when the deals are ready to close. That’s likely to happen later this year.

Yousef Rabhi was among the commissioners who praised the program, noting how it ties in with the food policy council that the county board recently created, as well as the food-related business incubator and job training program – called Seeds for Change – focused on the eastern part of the county. Rabhi serves on the Agricultural Lands Preservation Advisory Committee (ALPAC), which makes recommendations to the parks and rec commission about farmland deals.

County Board Tackles “Fracking” Concerns

Washtenaw County board of commissioners meeting (April 4, 2012): Much of the county board’s recent meeting was devoted to an item not on their agenda – concerns about proposed oil and gas drilling in the Saline area using a technique known as hydraulic fracturing, or “fracking.”

Several residents spoke on the topic during public commentary, citing concerns over health, well contamination, property devaluation, and damaged roads caused by company tanker trucks, among other effects. They noted that state regulators aren’t providing adequate oversight or protection, and urged the board to take action.

Speakers included Mitch Rohde, CEO of Saline-based Quantum Signal and founder of “NoPaxton.com,” which has mobilized against drilling in this area by Paxton Resources, a company based in Gaylord, Mich. The company recently notified the county that it has filed an application with the Michigan Dept. of Environmental Quality for permission to drill an exploratory oil and natural gas well in Saline Township. [.pdf of notification letter]

Several commissioners thanked the speakers for coming and expressed their own intent to look into the issue, though it’s not clear what action can be taken at the county level. An April 19 working session will focus on the topic. That meeting begins at 6 p.m. at the county administration building, 220 N. Main St. in Ann Arbor.

In other items at the April 4 meeting, commissioners honored county dispatchers and got an update on cleanup from the March 15 tornado that touched down in the Dexter area. Marc Breckenridge, the county’s director of emergency management and homeland security, gave an estimate of $5 million in damages to private homes and property, and another $2 million in response costs – expenses incurred from the road commission, county workers, the sheriff’s office and others. The county intends to apply to the state for help in covering some of these costs.

Funding controlled by the state was key to another item on the April 4 agenda: A resolution urging state legislators not to eliminate the personal property tax, unless 100% replacement revenues are guaranteed. More than $40 million in PPT revenues are received by local units of government within Washtenaw County. Leah Gunn, who wrote the resolution, expressed skepticism that legislators would pay attention to the county’s concerns, but said it would at least send the message: ”Don’t mess with us.”

Two action items were related to the county’s criminal justice system. The board approved the appointment of Elisha V. Fink as magistrate of the 14A District Court. She’s filling a vacant part-time position previously held by Camille Horne, who left the job at the end of 2011. Commissioners also gave initial approval to hire Nimish Ganatra as an assistant prosecuting attorney at a salary of $81,690. The vacancy opened in December, following an employee retirement. The hire requires board approval because the salary is above the $69,038 midpoint of an authorized range. While several commissioners praised the hire and the office of county prosecuting attorney Brian Mackie, Wes Prater cast a dissenting vote. Citing ongoing budget challenges, he objected to hiring someone at an above-midpoint level.

Several other items were handled during the meeting, including: (1) final approval for the county to become a charter member of the Washtenaw Health Initiative, at an annual cost of $10,000; (2) initial approval to accept federal grants for the county’s weatherization program for low-income residents; and (3) acceptance of federal grants for local workforce development programs.

During public commentary, Douglas Smith talked about a lawsuit he’s filed against the county over a denial of his Freedom of Information Act request. The FOIA related to a surveillance video of an incident in Ypsilanti Township involving the theft of $20 from a court employee’s car – Smith alleges the money was taken by a high-level staffer with the sheriff’s office. Smith has spoken about this issue at previous board meetings, asking the board to intervene. [Full Story]
