AAPS Board Starts 2013-14 Budget Discussion

Before receiving an “unqualified opinion” on the district’s 2011-12 audit and reviewing the first quarter financials from 2012-13, the board took a first pass at framing the discussion surrounding the development of the district’s budget for the 2013-14 fiscal year – a step the board has not typically taken as early as November.

Also at the meeting, the board approved the renaming of two facilities at Pioneer High School – the tennis courts and the planetarium. The tennis courts are being renamed for long-time tennis coach Tom “Brick” Pullen. And the planetarium is being co-named in regnition of a $100,000 gift from the IMRA America company.

The board also recognized Huron High School cross-country runner Allie Cell, for an extraordinary display of sportsmanship during a recent meet.  [Full Story]

Action Postponed on New Retail Development

Citing concerns over placement of the building on the site, commissioners postponed making a recommendation for a proposed retail development at 3600 Plymouth Road, immediately west of US-23. Called The Shoppes at 3600, the building is oriented with its back facing Plymouth. Commissioner Bonnie Bona, acknowledging the difficulty of positioning the building on this parcel, suggested that “perhaps this development is not right for this site.”

Also during the meeting, the commission continued the city’s ongoing annexation of township property by recommending the annexation of a Pittsfield Township parcel at 2503 Victoria, east of Packard Road. The recommendation includes zoning it for single-family residential (R1C) – a house is already under construction there.

An amendment to the city’s off-street parking ordinance was also recommended for approval. The change would allow more flexibility for temporary off-street parking for special events, such as hockey games at Michigan Stadium. Planning manager Wendy Rampson noted that there was not as much urgency to this amendment now, in light of the recent cancellation of the NHL’s Winter Classic at Michigan Stadium.

The commission also passed a resolution retroactively enabling three commissioners to attend the Michigan Association of Planning’s annual meeting, held on Oct. 17-19. The action enables commissioners to be reimbursed for their expenses.

The meeting closed with remarks of appreciation about and from commissioners Tony Derezinski and Evan Pratt, who are ending their terms. Derezinski, the commission’s representative from Ann Arbor city council, is leaving council after being defeated in the August Ward 2 Democratic primary by Sally Petersen. [Derezinski was subsequently, on Nov. 8, appointed by the council to planning commission as a citizen representative. It's expected that Sabra Briere (Ward 1) will be joining the commission as the council's next representative.] Pratt, elected as Washtenaw County water resources commissioner in the Nov. 6 general election, will be required to attend Tuesday evening meetings of the Washtenaw County parks and recreation commission, precluding membership on the planning commission, which also meets on Tuesdays. Pratt has served on the planning commission since 2004.

Ann Arbor School Board OKs Tech Upgrades

Ann Arbor Public Schools board of education regular meeting (Oct. 24, 2012): In its main business of the meeting, the board approved a $5,192,872 purchase for the district-wide replacement of the computer network and wireless infrastructure. Several central administrators noted that the infrastructure improvement is a cornerstone of the district’s technology plan.

And in keeping with superintendent Patricia Green’s desire to give annual updates to the board on a variety of topics, the AAPS board of trustees heard presentations from the human resources (HR) and informational technology (IT) departments.

Highlights from the human resources report were statistics showing that percentage-wise, more cuts have been made in the last few years to administrative positions than to teaching positions. Trustees also focused on recruitment of teachers that would reflect the same demographic profile as the student population.

Trustees were also given a report on the 2013-2015 technology plan.

In addition to the informational reports, the board was briefed on a partnership between AAPS and Toyota International. The district has been selected by Toyota as the sole participant in a pilot teaching program that will focus on Science, Technology, Engineering, and Mathematics (STEM) education. The partnership will bring the methods of Singapore, described as a leading country in STEM innovation, to AAPS.

Also at the meeting, a recommendation to rename the Argus Planetarium – to acknowledge the $100,000 donation to the facility made by IMRA America – was met with enthusiasm by trustees. They also welcomed another naming proposal – to name the Pioneer High School tennis courts after long-time tennis coach Tom “Brick” Pullen. Votes on the naming proposals will come at the next meeting of the board. [Full Story]

Art Group Reviews Public Outreach Effort

Turnout was lower than hoped – as only one resident attended the meeting held on Oct. 22 at Clague Middle School, though about 10 people came to a forum at Bryant Community Center the previous week. A fourth event will be held on Tuesday, Oct. 30 from 6:30-8:30 p.m. at the Ann Arbor Open @Mack cafeteria, 920 Miller Ave.

John Kotarski, who had attended all the forums, felt the events had achieved their purpose of achieving a presence in the community, and introducing residents to different kinds of public art. Bob Miller advocated adding an online element for soliciting more input. Commissioners discussed the possibility of using the city’s new A2 Open City Hall, a blog-type feature that allows people to get information and give feedback on specific projects.

Commissioners took action on other projects, voting to approve a $910 budget for the dedication of a new mural at Allmendinger Park – an event to take place on Sunday, Oct. 28 from 2-4 p.m. The mural was designed by Mary Thiefels of TreeTown Murals, incorporating artwork and found objects from the community.

Also approved was the location of a sign for the Herbert Dreiseitl water sculpture in front of city hall, though there was concern about the placement of a fence there. The city has decided to put the mesh metal fence on a section of the pedestrian bridge overlooking the sculpture. Some commissioners are frustrated that this safety issue wasn’t raised earlier, when it might have been addressed by the sculptor as part of the site design. Marsha Chamberlin, AAPAC’s chair, noted that Dreiseitl intended people to interact with the water that runs down from the fountain. “What’s driving this process – the aesthetics of the piece or risk management?” she asked. She ultimately abstained from the vote, stating ”I want to go on the record of being ornery about this.” It was approved by all other commissioners present at the meeting.

Commissioners were also updated on a range of other projects that are in various stages of development. The process has begun for soliciting artists for work at the East Stadium bridge and for an ongoing mural program. The deadlines for submitting statements of qualifications (SOQs) are in November. Aaron Seagraves, the city’s public art administrator, expects to post another SOQ – for artwork at Argo Cascades – next month. And legal staff is reviewing a request for proposals (RFP) for art at a rain garden being built at Kingsley and First.

Seagraves also reported that installation of a $150,000 hanging glass sculpture at the Justice Center lobby will be delayed a few months, until March or April of 2013. Fabricators selected by the artist Ed Carpenter aren’t available to do the work as soon as expected.

Another potential project emerged during the meeting. Chamberlin noted that the city has about 100 old aluminum canoes that it’s planning to get rid of. She said that Cheryl Saam, facilities supervisor for the city’s canoe liveries, had raised the possibility of using the canoes for some kind of community art project. After getting feedback from other commissioners that this is an idea worth pursuing, Chamberlin said she’d work up a more formal proposal for consideration at a future meeting.

As part of the Oct. 24 meeting packet, AAPAC got a budget update of Percent for Art funds, showing a balance of $1.533 million. Of that, $847,104 has been earmarked for previously approved projects, leaving about $686,000 unallocated. [.pdf of budget summary]

One notable topic was not discussed at the meeting – a public art millage that’s on the Nov. 6 ballot. Several commissioners are involved in advocating for the millage, but have taken a conservative approach to dealing with it during their regular business, and AAPAC meetings have not included discussion on the topic since the August 28, 2012  meeting. That approach stands in contrast to a recent park advisory commission meeting, when one of the park commissioners spoke during public commentary to urge support for the parks millage renewal. Transportation Dominates Council Meeting

A study that’s required as part of Ann Arbor’s approach to building a new train station will move forward with a $550,000 funding resolution approved by the council. The same resolution also includes a clause stating that construction of a new train station would be put to a popular referendum before proceeding.

The budget amendment, which passed with exactly the eight votes it needed on the 11-member council, allocated the $550,000 to provide new matching funds for a federal grant. The grant had been awarded through the Federal Railroad Administration’s High-Speed Intercity Passenger Rail (HSIPR) program. Dissenting on the vote were Jane Lumm (Ward 2) and Mike Anglin (Ward 5). Stephen Kunselman (Ward 3) was absent. Recent feedback from the FRA indicated that the city of Ann Arbor could not use previously expended funds to count as the local match – which had been the city’s original understanding.

The council also approved $30,000 for the continued study of a transportation connector between the northeast and south sides of Ann Arbor. The corridor runs from US-23 and Plymouth southward along Plymouth to State Street and farther south to I-94.

The council actually voted twice on that issue at the same meeting. On the first vote, the resolution failed. But a few minutes later, Marcia Higgins (Ward 4) – who had initially voted against it – asked for reconsideration of the vote, and changed her vote to support it, as did Mike Anglin (Ward 5). The council had previously considered and rejected funding for the study at its Sept. 4, 2012 meeting. But councilmembers reconsidered that vote two weeks later on Sept. 17, 2012, which resulted in a postponement until Oct. 15. The second reconsideration by the council during the Oct. 15 meeting required a suspension of the council’s rules, which don’t permit a question to be reconsidered more than once.

Wrapping up the transportation themes of the evening was a public call for volunteers to serve on the new 15-member transit authority board, recently incorporated under Act 196 of 1986. While it had been previously assumed that the seven Ann Arbor appointments to the new authority’s board would serve simultaneously on Ann Arbor Transportation Authority’s board, legal questions about simultaneous service on the two boards led to mayor John Hieftje’s announcement to recruit other volunteers.

The first two of the seven Ann Arbor nominations needed for the new transit authority board were made at the Oct. 15 meeting: Susan Baskett, who currently serves as a trustee on the Ann Arbor Public Schools board; and Tony Derezinski (Ward 2), who currently serves on the city council. Derezinski will be leaving the council in mid-November, because he did not prevail in his August Democratic primary race. His last city council meeting will be Nov. 8.

Nov. 8 would also mark the last council meeting for Carsten Hohnke (Ward 5) and Sandi Smith (Ward 1), who did not seek re-election. However, Smith announced on Oct. 15 that she would not be able to attend the Nov. 8 meeting, which meant that the Oct. 15 meeting was her last. She bid her colleagues farewell, and kind words were offered around the table.

It was a resolution from Smith that prompted the main non-transportation topic of the evening – an attempt to establish a formal policy to use the net proceeds of city-owned land sales to support affordable housing. The council approved a version of the policy, but it was far more restricted than Smith’s original proposal, which the council had considered but postponed on Sept. 17.

Smith’s initial proposal would have directed 85% of the net proceeds from the sale of any city-owned land in the Ann Arbor Downtown Development Authority district to be deposited in the city’s affordable housing trust fund. During the month-long postponement, the council’s budget committee discussed the proposal and made a recommendation that for only one city property – the Fifth & William lot, where the former YMCA building previously stood – the net proceeds from any future sale would be deposited into the city’s affordable housing trust fund. The budget committee also recommended that any other properties be considered on a case-by-case basis, considering all needs of the city. And that’s essentially the recommendation that the council adopted.

In other business, councilmembers authorized an extension to a third year for the city’s coordinated approach to funding for human services. And the council took the first step toward dissolving the sign board of appeals and transferring its responsibility to the zoning board of appeals. The council also accepted a total of $1 million in grants for city parks, and added about 125 acres to the city’s greenbelt program. And a $200,000 study was authorized to prevent flooding in the southwest part of the city.

A symbolic vote – calling for the U.S. Congress to send a constitutional amendment to the states to overturn the U.S. Supreme Court’s Citizens United v. Federal Elections Commission decision – resulted in passage, over dissent from Christopher Taylor (Ward 3), Marcia Higgins (Ward 4) and Jane Lumm (Ward 2).  [Full Story]

West Park Possible Location for New Dog Park

A committee that has focused on identifying possible locations for a new dog park recommended the West Park site – specifically, a parcel in the park’s northeast corner, where the city recently bought and demolished a house near the entrance off of Chapin Street. No formal vote was taken, but PAC’s support means that staff will bring back a proposal for PAC’s consideration, and hold a public meeting for community input.

PAC members did formally vote on a recommendation to relocate tennis courts within Windemere Park, to the east of the current location. Several residents of the neighborhood surrounding Windemere Park attended the meeting and advocated for a postponement on the decision. They noted that the option being recommended by staff had not been presented at an Oct. 8 neighborhood meeting. Colin Smith, the city’s parks and recreation manager, later explained that the fourth option had emerged from a consensus of ideas at the meeting.

Berla, who voted against the PAC resolution, felt there was nothing to lose in giving residents another month to review the proposal. But other commissioners believed that moving ahead was the best approach, and that no option would satisfy all residents – especially people with property facing the park. The resolution also recommended incorporating input from residents regarding landscaping around the courts, which was a concern raised by some of the homeowners.

In an unusual move, PAC member Ingrid Ault spoke to her fellow commissioners during public commentary. Telling them that she was speaking as a citizen, not a commissioner, Ault said she had formed a campaign committee – called Friends of the Parks – to support the park maintenance & capital improvements millage renewal, which is on the Nov. 6 ballot. The current 1.1 mill tax expires this year. A renewal would run from 2013-2018 and raise about $4.9 million next year. Ault brought yard signs to distribute, and encouraged commissioners and the public to support the renewal. PAC had passed a resolution in support of the millage at their June 2012 meeting.

As part of his manager’s report, Colin Smith noted that city staff will be meeting with representatives from the state on Nov. 2 to get a better understanding of concerns that have been raised regarding a planned whitewater section of the Huron River, near Argo Cascades. He said he’d have an update on that situation at PAC’s November meeting. [See Chronicle coverage: “EPA, Others Object to Whitewater Project.”]

Commissioners held their annual officer elections, re-electing Julie Grand as chair. Ingrid Ault was elected vice chair and Tim Doyle was tapped as chair of PAC’s budget and finance committee. All nominations were uncontested, and the votes were unanimous. PAC also welcomed Missy Stults to her first meeting as commissioner. Her nomination had been confirmed by the city council earlier this month. [Full Story]

County Board Debates Role in Transit Entity

Washtenaw County board of commissioners meeting (Oct. 17, 2012): With only two more meetings remaining in 2012 – both falling after the Nov. 6 election – county commissioners dispatched a range of agenda items on Oct. 17, including ordinance changes and budget-related action.

But they spent much of their discussion on a topic not on the agenda and not requiring a vote: public transit. It emerged that the county administrator now will be sending out additional notification letters to local jurisdictions about a new transit authority, called The Washtenaw Ride. The AATA had initially sent letters notifying jurisdictions of a 30-day window ending Nov. 2.

The new letters, which will likely be sent in early November and alert municipalities to a second 30-day window for opting out of the new authority, were originally expected to be sent by The Washtenaw Ride. But there’s been a delay in forming the new board, so the Ann Arbor Transportation Authority has asked that the county handle the notification process. The county had filed the articles of incorporation for the new entity in early October, at the AATA’s request.

Some commissioners were concerned about the cost –  because the agreement that lays out the process for forming the Washtenaw Ride indicated the county would not be financially responsible for any expenses. The following day, AATA CEO Michael Ford stated at the AATA board meeting that the county would be reimbursed for its expenses.

Part of the county board’s discussion on public transit also centered on proposed state legislation to set up a regional transit authority (RTA) for Detroit and the counties of Washtenaw, Wayne, Oakland and Macomb. Some commissioners wanted more information about Washtenaw County’s involvement, and asked for a working session on the topic.

Added to the agenda during the Oct. 17 meeting was a countywide civil infractions ordinance. It was given initial approval by commissioners – with a final vote and public hearing  scheduled for their Nov. 7 meeting. Currently, criminal misdemeanors are the only penalty that the county can apply for an ordinance violation – for infractions like not having a dog license. The intent of the proposed ordinance is to give the county more flexibility to designate violations of other county ordinances as a civil infraction, rather than a criminal misdemeanor. The proposed fines would be $50 for a first offense, $100 for a second offense, and $500 for a third or any subsequent offense.

The board also passed a policy to reduce barriers to breastfeeding in Washtenaw County facilities, and gave final approval to an ordinance change that shifts responsibility for the county’s accommodation tax from the county treasurer to the county finance director.  The accommodation tax is collected from hotels and motels.

Also approved was a one-year extension for the coordinated funding model that’s been piloted for two years as a way to more effectively fund local human services nonprofits. An evaluation of the program – a partnership between the county, city of Ann Arbor, United Way of Washtenaw County, Washtenaw Urban County, and the Ann Arbor Area Community Foundation – is expected early next year.

The board received a preliminary apportionment report for Washtenaw County, giving details of the 2012 taxable valuations for property in the county, by municipality. And commissioner Rob Turner reported that a new actuary has been selected to conduct reports on the status of the county’s employee pension and retirement health care funds. Turner is concerned that the fund balances are too low, leaving the county with unfunded liabilities that need to be addressed.

Speaking during public commentary, John Wagner – a volunteer for Camp Take Notice – urged commissioners to consider providing a county facility for the homeless, as winter approaches. The meeting also included recognitions of work done by SafeHouse Center, a domestic violence shelter, and local cooperatives like the Inter-Cooperative Council (ICC) of the University of Michigan. Gaia Kile, vice president of the board for the People’s Food Co-op, told commissioners that the hope is to turn these types of “highly democratic economic institutions” into the fastest-growing segment of the economy. AATA Ridership Up, Fiscal Reserves Down

Optimism was based on ridership data for the fiscal year that ended on Sept. 30 – which includes a record-setting 6,325,785 rides on the regular bus service, up 6.6% over the previous year, and 3.4% more than the previous record year of 2009.

Damping enthusiasm were the year-end budget numbers, which showed the AATA posting a deficit around $260,000 greater than the one it had budgeted for, leaving an excess of expenditures over revenues of $1,255,312. [.pdf of unaudited FY 2012 financials] That comes in the context of an approved budget for the just-begun current fiscal year, which includes an anticipated deficit of about $300,000. The board’s Oct. 18 deliberations revealed the fact that only by recalculating the amount in the AATA’s cash reserves did the organization currently have the required three-month operating reserve on hand.

In that financial context, board members were not inclined to add back in some elements that had recently been cut out of the new Blake Transit Center project, which would have brought the project budget to nearly $8.5 million. The construction contracts approved by the board at its meeting totaled a bit over $8 million, which was still dramatically larger than the smaller $3.5 million project the AATA had started with over three years ago. Instead of taking the less ambitious strategy, the AATA opted to locate the new, larger center on the opposite side of the same parcel where it currently stands. Construction on the two-story Fifth Avenue-facing center is now expected to start in late November or early December.

The board’s deliberations on the new transit center focused on whether to add back into the project some items that had been removed to bring the cost down from $8.5 to $8 million. Of the three items on the table – automatic ticketing kiosks, real-time bus arrival information displays, and LEED certification of the building – only the LEED certification was added back in, at a cost of $80,000.

At the Oct. 18 meeting, the board also got an update on the situation surrounding the incorporation of the new Act 196 board for The Washtenaw Ride. Michael Ford, AATA’s CEO, indicated that the AATA would be reimbursing Washtenaw County for the cost of renotifying jurisdictions in the county regarding their option not to participate in the new authority. He confirmed that AATA board members would not serve simultaneously on the current board and the board of the new authority, as previously expected. Ford indicated that AATA legal counsel believes that what the AATA has done to date already complies with the law, but the AATA is exercising extreme caution.

Several members of the future Act 196 board attended the meeting and had a voice at the table, but not a vote.

Library Board Gets Update on Bond Campaign

That update came from Ellie Serras, who leads the Our New Downtown Library campaign committee. She had briefed the board previously at its Aug. 20 meeting. If approved by voters on Nov. 6, the $65 million, 30-year bond proposal will fund the demolition of the existing library at 343 S. Fifth and the construction of a new building on that same site.

Speaking during public commentary, Serras catalogued the number of yard signs, buttons, postcard mailings, meetings and other efforts of the campaign. She described the campaign as being built on trust and confidence, “not rumor and innuendo,” and said the new library will be an expression of the community’s core values of education and equal access for all. Serras received a round of applause from board members after her remarks.

The other item tangentially related to the bond proposal was the uncharacteristic absence of AADL director Josie Parker from the meeting. Board president Margaret Leary reported that Parker was attending two separate township meetings that night to talk about the bond proposal. For the most part, the AADL district mirrors the Ann Arbor Public Schools district. In addition to the city of Ann Arbor, the district includes parts of the townships of Pittsfield, Scio, Ann Arbor, Lodi, Webster, Salem and Superior.

In addition to the bond proposal, there are four seats on the AADL board that are on the Nov. 6 ballot. Four incumbents – Rebecca Head, Nancy Kaplan, Margaret Leary and Prue Rosenthal – are running for re-election. The fifth candidate is Lyn Davidge, who attended the Oct. 15 meeting but did not speak during public commentary. During the Oct. 15 meeting, the board also got a brief report on library finances. And Leary notified the board that Parker has been appointed by Gov. Rick Snyder to the Michigan Commission for Blind Persons, an advisory group for state programs and services. The AADL administers the Washtenaw Library for the Blind & Physically Disabled. AAPS Focus: Achievement, Labor Contracts

Deputy superintendent of instructional services Alesia Flye and director of student accounting and research services Jane Landefeld, presented a comprehensive report on student achievement. While the trustees were pleased and excited to have such a detailed report, and there were several positive points in the data, they also expressed significant frustration at the disparity between the achievement of various subgroups. African American students in the district showed significantly lower achievement on standardized tests than students in other ethnic groups. Trustee Simone Lightfoot described herself as “fire mad” about some of the results in the report.

The conversation ranged from results and highlights to the challenges the district faces. Flye and her team indicated that the district would continued to work with this data and to implement the district’s established plans to address the achievement gap. Also at the meeting, a proposal for a technology upgrade to the network infrastructure prompted a conversation about labor contracts. The network upgrade was a first briefing item on which the board did not vote. But conversation about labor contracts continued as trustees heard a second briefing about outsourcing the noon hour supervisor positions. In a 4-3 decision, the board did not approve the a contract with PCMI, which had bid to provide noon hour supervisors at a 24.83% administrative cost. [Full Story]

DDA Green-Lights Housing, Transportation

Getting approval from the board was a $260,000 request from the Ann Arbor housing commission (AAHC), the bulk of which will pay for the emergency replacement of the roof on Baker Commons, a 64-unit public housing complex located at the intersection of Packard and Main streets. The sharply pitched roof will be made of steel, and is expected to last for 50 years, though it’s guaranteed for 20. Overall the board was positively inclined toward the request, but board member Newcombe Clark also wanted a clearer idea of how the DDA’s contribution fit into the AAHC’s capital maintenance and replacement schedule.

Also getting approval from the board was a resolution that authorized negotiating an arrangement for around 42 parking spaces in the public parking system for a proposed residential development at 624 Church St. The 13- or 14-story, 83-unit apartment building will include about 181 beds – a residential use that allows the project to qualify for a by-right “premium” under the city’s D1 (downtown core) zoning code.

The parking spaces for 624 Church St. can be provided through a contribution-in-lieu (CIL) program instead of providing them on site. That CIL program is administered by the DDA, because the DDA manages the public parking system under a contract with the city of Ann Arbor.

While the CIL authorization was perhaps at first glance only about housing, not transportation, two other items on the agenda were more obviously transportation-related.

A transportation connector study got a $30,000 contribution from the DDA. It’s contingent on the city of Ann Arbor contributing $30,000 as well, which is not a certainty. The total of $60,000 in city sources is part of $300,000 in local matching funds required for an already awarded $1.2 million federal grant. The remaining $240,000 is coming from the University of Michigan ($150,000) and the Ann Arbor Transportation Authority ($90,000). The corridor to be studied runs from US-23 and Plymouth southward along Plymouth to State Street and farther south to I-94. This alternatives analysis phase of the study is to result in identifying a preferred mode – such as bus rapid transit or light rail – and the location of stations and stops.

The board also authorized a 50-bike storage facility that would have the footprint of two vehicle parking spaces. The “cage” will be located in the downtown Ann Arbor’s Maynard Street parking structure.

In addition to the monthly parking report, the board received an update on the electric vehicle charging stations that are located in public parking structures. [Full Story]

School Board Mulls Millage, Proposal A

Ann Arbor Public Schools board of education committee of the whole meeting (Oct. 3, 2012): Trustees focused their committee meeting on the possibility of changing the district’s overall structural financial picture. They took care to contrast that effort with a different kind of discussion – about the budget. The topic of improving larger financial picture had been identified as one of the two goals for trustees at their August retreat. The other top goal was strengthening trust and building relationships among the board members.

The board’s committee discussion centered on four main topics: vision; revenue enhancement; action needed by the state legislature; and communication.

Discussion of revenue enhancement was highlighted by the possibility of asking voters to approve an enhancement millage through the Washtenaw Intermediate School District – which would entail a countywide vote. Voters in 2009 rejected such a proposal, which would have resulted in a 2 mill tax for five years, starting in 2010. It was projected to raise $30 million annually, to be divided among the 10 school districts in Washtenaw County. The AAPS share would have been a bit over $11 million. Board discussion at the Oct. 3 committee meeting acknowledged the need to generate support for such a proposal in other districts in the county besides AAPS.

Discussion of possible lobbying efforts directed at the state legislature was highlighted by the possibility of amending Proposal A, passed in 1994, which limits the ability of local communities to levy increased taxes to support schools. [Full Story]

County Board Debates, OKs Act 88 Tax Hike

Washtenaw County board of commissioners meeting (Oct. 3, 2012): A sometimes heated debate over whether to raise a tax for economic development resulted in narrow approval by the board. It was a 6-5 vote on the increase to 0.06 mills, up from 0.05 mills. As an example, the 20% hike means that taxes for economic development will increase from $5 to $6 for each $100,000 of a property’s taxable value. The issue had been previously discussed at the board’s Sept. 19 meeting, but postponed until Oct. 3.

The board is authorized to levy the tax under Act 88 of 1913 – and it does not require a voter referendum. Voting against the increase were commissioners Ronnie Peterson, Alicia Ping, Wes Prater, Dan Smith and Rob Turner. They cited several objections, including the timing of a tax increase while many taxpayers are struggling because of the economy, and the unlikelihood that the tax will be lowered in the future, when economic conditions improve. Peterson also felt that the Act 88 funds aren’t being used for their original purpose – to leverage matching dollars for economic development – and instead are being diverted to support county operations.” It was never meant to be a piggy bank for county government,” he said.

The final vote to levy the increased tax passed 8-3, with Ronnie Peterson, Wes Prater and Dan Smith voting against it. Alicia Ping has in the past also voted against the Act 88 tax, but supported it this time – though she voted against the amendment to increase the rate. She hoped commissioners would consider reallocating some funding for the western side of the county, pointing out that there are economic development needs there too, including a lack of decent Internet access.

Far less contentious was an initial vote to move control over administering the county’s 5% accommodation tax from the county treasurer’s office to the finance director. Two members of the Washtenaw County Hotel/Motel Association spoke in support of changing the accommodation ordinance in this way. The vote by commissioners was unanimous, though Dan Smith noted that this is the second time this year that the ordinance has been revised, and he hoped it would be the last. He also expressed some concern that all hoteliers aren’t being treated equitably. A final vote and public hearing on the change is set for Oct. 17.

Commissioners also approved a set of recommendations to guide county administrator Verna McDaniel in her negotiations with the Humane Society of Huron Valley for animal control services. The current contract with HSHV ends on Dec. 31. An accompanying report from a policy task force was discussed only briefly – in part because the final version had been sent to commissioners only that day and there had been little time to digest it, and in part because some commissioners wanted to adjourn so that they could watch the first presidential debate, which began at 9 p.m. The board plans to continue discussion of the issue at a future date.

During the meeting, board chair Conan Smith told commissioners that a caucus would be held immediately prior to the next board meeting – on Nov. 7, at 5:30 p.m. – to discuss appointments to various county boards, commissions and committees. AATA Keeps Rolling Toward Countywide

Ann Arbor Transportation Authority special board meeting (Oct. 2, 2012): As expected, the AATA board voted unanimously, with all seven members present, to request that the Washtenaw County clerk file articles of incorporation for a new transit authority, established under Act 196 of 1986 and called The Washtenaw Ride.

Based on discussion at the board’s Sept. 27 meeting, it was the AATA’s expectation that the articles would be filed as soon as Oct. 3, and the wording of the AATA’s resolution indicated that the filing should take place “immediately.”

And according to Washtenaw County clerk staff, that’s what happened. Representatives of the AATA were authorized as couriers by the clerk, and they conveyed the physical documents to Lansing.

Letters that included a notice of intent to file had been sent on Sept. 27 to every jurisdiction, and to every elected official in the county.

At the Oct. 2 meeting, board chair Charles Griffith and former chair Jesse Bernstein expressed thanks to staff and community members who’ve worked over the last two years to get the process to this point. The basic theme of most of the remarks was in the spirit of the long journey ahead.

The long journey begins with the entity that’s created by the filing – which will initially have no assets, staff, or ability to operate transportation service in the county. A 15-member board composition for the new authority is already reflected in the membership of the board of the pre-incorporated board (called the U196 board), which has been meeting already for a year. Some of those board members attended the Oct. 2 meeting – David Read (North Middle District), Bob Mester (West District), Bill Lavery (South Middle District) and David Phillips (Northeast District).

Districts that include multiple jurisdictions appoint their representatives under inter-local agreements made under Act 7. In the case of the city of Ann Arbor, the appointments to the new transit authority need to be made through the city council’s confirmation of mayoral nominations.

To make the transition from the AATA to The Washtenaw Ride, under terms of a four-party agreement, voters would need to approve a funding source adequate to pay for the proposed expanded service plan. The four-party agreement is between the AATA, the cities of Ann Arbor and Ypsilanti, and Washtenaw County.

The five-year service plan for expanded service includes: (1) countywide demand-responsive services and feeder services; (2) express bus services and local transit hub services; (3) local community connectors and local community circulators; (4) park-and-ride intercept lots; and (5) urban bus network enhancements. For Ann Arbor, the program includes increased bus frequencies on key corridors, increased operating hours, and more services on weekends. According to a Sept. 5 press release from the AATA, Ann Arbor and Ypsilanti will get a 56% increase in service hours compared to current levels.

The AATA has indicated that a possible funding scenario is to ask voters in Washtenaw County to fund the new transit authority with a property tax of 0.584 mills – in an election that could come as early as May 2013. For a house worth $200,000, with a state-equalized value of $100,000, an 0.584 mill transit tax would cost that property owner about $58 per year. For an Ann Arbor resident with a $200,000 house, adding the 0.584 mill tax to the existing city transit tax of roughly 2 mills works out to a transportation tax burden of about $258 a year.

Also under the four-party agreement, the two cities’ transit taxes would become part of The Washtenaw Ride’s funding.

The transition would potentially not take place at all, if a majority of voters don’t approve it. Under the terms of the four-party agreement, a voter-approved funding source for the expanded services must be identified by the end of 2014.

Washtenaw County’s role is limited to the filing of the articles of incorporation for the new transit authority. The act of incorporation will include by default all jurisdictions in Washtenaw County. However, filing of the articles opens a 30-day window for jurisdictions to opt out of the arrangement. That can be accomplished through a vote of a jurisdiction’s governing body.

Michael Ford, AATA’s CEO, said at the Oct. 2 meeting that he hoped to schedule the first meeting of The Washtenaw Ride’s board for Oct. 11.  Although it’s a fair assumption that the current AATA board members will be nominated by mayor John Hieftje to serve as Ann Arbor’s representatives to the new transit authority, there’s no council meeting scheduled between now and Oct. 11 when the council could vote to make those appointments official.  [Full Story]

Council Sails Through Flooded Agenda

The council voted to table a revision to its medical marijuana licensing ordinance, having postponed it twice previously. Tabling is unlike a postponement to a date certain, and leaves open the possibility that the council might not ever take the question up again. However, Sabra Briere (Ward 1) indicated she intended to take up the medical marijuana ordinance again within six months.

The council has yet to act on recommendations from the city’s medical marijuana licensing board, made at the start of the year, to award licenses to 10 dispensaries. In the meantime, those dispensaries continue to operate. At the council’s Oct. 1 meeting, city attorney Stephen Postema indicated he would be creating a public document for the licensing board that would include a summary of pending legislation and court cases.

The council tabled a resolution on establishing a citizens committee to study the question of how to use proceeds from city-owned land sales. That tabling came at the request of the resolution’s sponsor, Mike Anglin (Ward 5), who had originally brought it forward at the council’s previous meeting.

The council also voted to extend by another 180 days a moratorium on digital billboards in the city – which the council first enacted back in April.

Three of the items on which the council took final action were at least indirectly related to stormwater. The council confirmed the appointment of the top area administrator whose department is responsible for stormwater management – Craig Hupy. Hupy’s appointment as public services area administrator comes after 26 years of service with the city.

The council also approved a $300,000 stormwater improvements component of a much larger $6.5 million street reconstruction project for Miller Avenue. The council authorized $50,000 to study the feasibility of opening up the railroad berm near Depot Street, which might allow floodwater to flow unimpeded to the Huron River on the other side. The study is also meant to cover the possibility of a non-motorized transportation connection under the berm, for pedestrians and bicyclists.

Related to water only in name was a tax abatement granted by the council to Barracuda Networks, which is relocating from Depot Street to downtown Ann Arbor and expecting to add 144 jobs.

The council also approved a raft of proposals related to land use. Winning approval were site plans for a Fiat dealership on West Stadium Boulevard and an expansion of the Food Gatherers facility on Carrot Way. The rezoning of a strip around the perimeter of a parcel at Miller and Maple, where a Speedway gas station will be constructed, got final approval.

A proposed townhouse project on Catherine Street got its rezoning as well as site plan approved. At the public hearing neighbors praised the project and developer Tom Fitzsimmons for what he had done to work with them.

The Plymouth Green Crossings project, which has already been built, got initial approval for revisions to its planned unit development (PUD) supplemental regulations.

The council also added 73 acres to the land protected under the city’s greenbelt program by approving the purchase of development rights on the Hornback farm in Salem Township.

The council weighed in on a state ballot question – which would require electric utility companies in Michigan to provide 25% of their power with renewable sources by the year 2025 – by passing a resolution in support of it.

One of the more significant pieces of news to come out of the meeting was an announcement from Stephen Kunselman (Ward 3) that he could not attend the council’s Oct. 15 meeting. That’s when the council is due again to take up the question of putting $60,000 towards a $300,000 local match for a $1.2 million federal grant that would fund a transportation connector study. PAC: Downtown Park, More Input Needed

PAC took action on one of those topics, passing a resolution to give formal input on the Connecting William Street project. That effort, led by the Ann Arbor Downtown Development Authority, is process to examine five city-owned parcels for possible redevelopment. All but one of the sites are now used as surface parking lots.

PAC did not advocate that a particular site be turned into a park. Rather, the resolution recommends that the Ann Arbor city council seek additional evaluation of locations for a downtown park, the best mix of amenities for the population expected to use a downtown park, and the costs of developing and maintaining a new addition to the parks system. PAC also recommends that the council refrain from adopting plans for the five city-owned lots before resolving the question about open space in the Connecting William Street area. [.pdf of final Connecting William Street resolution]

At the start of the meeting, three members of the Library Green Conservancy – advocates of creating a commons on top of the Library Lane underground parking structure – spoke during public commentary. [The Library Lane site is one of the five properties included in the Connecting William Street project.] They urged commissioners to support their plan for a park at that location, adjacent to the library. The underground structure was built with a foundation to support a high-rise building on the site, in addition to a plaza area. PAC’s recommendation to the city council did not highlight that particular site.

Also during the meeting, commissioners heard from two speakers during public commentary who supported the creation of more dog parks. One speaker noted that despite potential problems – such as dog fights and the fact that ”pooping can occasionally go unnoticed” – a dog park poses no greater liability than a skatepark, pool or “even simply sidewalks.”

Colin Smith, the parks and recreation manager, told commissioners that staff did not support an unfenced option, but indicated that they’re exploring possible locations for one or more fenced-in dog parks. One possible site: A parcel on the east side of West Park, near the entrance off of Chapin.

PAC also was briefed on plans for rain gardens and other biodetention measures at Miller Nature Area and Garden Homes Park, in connection with a major reconstruction of Miller Avenue next year.

Smith also updated commissioners on letters of objection that had been submitted to the Michigan Dept. of Environmental Quality (MDEQ) regarding plans to build a section of whitewater in the Huron River, near the Argo Cascades. A permit is needed from the MDEQ before the project can move forward. For a full report on this issue, see Chronicle coverage: “EPA, Others Object to Whitewater Project.”

It was the last meeting for commissioner Doug Chapman, whose term ended on Sept. 30. At the city council’s Oct. 1 meeting, his replacement was confirmed: Melissa Stults, a doctoral student at the University of Michigan’s Taubman College of Architecture and Urban Planning. [Full Story]

AATA OKs Smaller Budget, Drives Ahead

Compared to an earlier draft budget, the one approved by the board was diminished on the revenue side by $800,000 in less-than-expected state operating assistance. Subsequent reductions in expenses still resulted in the need to use $300,000 in reserves to cover the gap. The reduction in state operating assistance for the AATA is related to a dramatic budget decrease by a Detroit transit agency – the state’s formula for making its allocations is sensitive to that.

The meeting’s budget discussion overlapped with conversation about the new transit authority, which is likely to be incorporated next week on Oct. 3. That’s the day after the AATA board is scheduled to meet in a special session, when it’s expected to request formally that the Washtenaw County clerk file articles of incorporation with the state. The new transit authority is to be called The Washtenaw Ride. Before any assets could be transferred from the AATA to The Washtenaw Ride, voters would need to approve a funding mechanism, likely through a millage to be placed on the ballot as soon as May 2013.

AATA board members made a point to stress that the planned operating deficits for the year that’s now ending (about $1 million) and the upcoming year ($300,000) are not sustainable. Instead, those budgets reflect an early implementation of some expanded services – like increased frequency on Route #4 between Ann Arbor and Ypsilanti – which the AATA would like to implement more permanently in the context of the broader governance and service area of a new transit authority. Some currently expanded services might need to be scaled back if the new authority winds up being dissolved at the end of 2014 – a possibility if voters do not authorize the necessary funding.

The incorporation of the new authority has statutory implications. Because the incorporation of a new transit authority will include by default all the jurisdictions in Washtenaw County, the filing of the articles opens a 30-day window for jurisdictions to opt out of participation. That can be accomplished through a vote by a jurisdiction’s governing body.

The possibility of several jurisdictions opting out prompted the introduction of a resolution at the Sept. 27 meeting that was not originally on the agenda. That resolution was meant to clarify that the AATA board is keen to allow all the constituencies to be represented on the new authority that have been represented for about a year on the as-yet-unincorporated board – up to the point when a millage is placed on the ballot. That is, the current AATA board members – who will also serve on the new board – do not intend that their first response to opt-outs would be to alter the new board’s composition.

The articles of incorporation for the new authority specify an initial board membership of 15 members in eight districts. Altering that membership would, by the articles of incorporation, require a 4/5 majority (12 votes). So the resolution floated at the Sept. 27 meeting was intended to give assurance that the seven AATA board members – as future members of the 15-member board – would not want to alter the composition of the new board until a decision is made about putting a transit millage on the ballot. At that point, a change likely would be made to avoid the possibility of “representation without taxation.”

Representatives of three of the seven non-Ann Arbor districts in the new authority attended the AATA’s Sept. 27 meeting and participated in the discussion: Karen Lovejoy Roe (Southeast District); Bill Lavery (South Middle District); and David Read (North Middle District). Lovejoy and Read reacted to the uncertainty that the resolution was meant to address by questioning the timing of the planned incorporation.

Another significant business item transacted at the meeting was the contingent approval of a contract with URS Corp. to continue studying a possible transportation connector between the northeast and south sides of Ann Arbor. The authorization of the contract is conditional on additional local funding – in the amount of $60,000. The $60,000 would be part of a total $300,000 local match for a $1.2 million federal grant. The Ann Arbor city council had voted initially to reject a request that it provide the $60,000, but then reconsidered and postponed the question until Oct. 15. In the meantime, the board of the Ann Arbor Downtown Development Authority has indicated some willingness to make a contribution – $30,000 of the requested $60,000.

The AATA board’s Sept. 27 meeting marked Jesse Bernstein’s final meeting as chair. He’s led the board for the last two years. At the meeting, Bernstein alluded to the tradition of rotating the chairship of the board, a tradition he wanted to continue. The board elected Charles Griffith as chair. [Full Story]

Art Commission Explores “Street Art” Program

John Kotarski made the proposal, explaining that street art could include anything from pedestrian benches to artistic manhole covers – similar to those that have been created in Japanese cities. The effort could involve schools and service clubs, he said, and might evolve into something as popular as the fairy doors found throughout Ann Arbor. Commissioners seemed generally supportive of the idea. The task force will do more research and make a formal proposal to AAPAC at a later date.

Commissioners also moved ahead on a new approach to getting more people involved in the selection of public art. Task forces will be formed in four quadrants of the city, using quadrants that are designated in the city master plan’s “land use elements” section: west, central, south and northeast. [.pdf map of quadrants]

Kickoff meetings for each quadrant are scheduled for October. Connie Rizzolo Brown, who’s spearheading this effort, described the goal of the first meetings as ”very gentle fact-finding missions,” as well as recruitment for potential task force members.

Also in October – on Sunday, Oct. 28 – a dedication is planned for the new mural being completed at Allmendinger Park. The work is by Ann Arbor muralist Mary Thiefels of TreeTown Murals, incorporating artwork and found objects from students and neighbors. Images from the work-in-progress are currently featured on AAPAC’s website.

Commissioners also discussed concerns about a descriptive sign planned for the Dreiseitl sculpture in front of city hall. Some commissioners feel that the proposed location for the sign detracts from the ability to enjoy the sculpture, while others expressed frustration that AAPAC had not been consulted about the sign’s location.

The meeting also included a variety of updates about projects that are underway. One major item that was not discussed was the public art millage that will be on the Nov. 6 ballot – Proposal B. Although it was alluded to on several occasions, AAPAC chair Marsha Chamberlin cautioned commissioners that they could not discuss it at the meeting. However, several commissioners are involved individually in the campaign to support the millage – B for Art. Chamberlin, for example, is hosting a dinner for the campaign in October.

At an Aug. 15 special meeting, the commission had voted to recommend that the city council place a millage on the ballot, despite voicing a range of concerns. The millage had been proposed by councilmember Christopher Taylor (Ward 3), who did not consult the arts community or AAPAC before bringing  the idea forward. The ballot proposal calls for a 0.1 mill tax for four years to support public art, temporarily replacing the current Percent for Art program. Sustainability Goals Shape Corridor Study

Eric Mahler recalled that both projects had been highlighted at a planning commission retreat two years ago, and that in some ways their completion marked a new era in city planning. The corridor study is the first project that incorporates the sustainability goals. The study’s recommendations are organized into the four main sustainability categories: resource management; land use and access; climate and energy; and community.

The recommendations themselves cover a wide spectrum of issues, from traffic and walkability to public art and zoning. [.pdf of draft report] Planning commissioners spent nearly two hours reviewing the recommendations in a working session immediately following their regular Sept. 18 meeting. They’ll likely address the project again before it’s forwarded to city council.

Also during the Sept. 18 meeting, planning manager Wendy Rampson reviewed highlights from an annual report of planning activities for the fiscal year 2012, which ended June 30, 2012. The report reflected an increase in development activity within the city. As one example, there were 28 site plans submitted during the year, up from 13 in FY 2011.

Several University of Michigan students attended the commission’s regular meeting on Sept. 18. Responding to a query from Tony Derezinski, they reported that they are graduate students in urban planning, taking a class from professor Dick Norton. District Weighs Options on Noon Hours

Ann Arbor Public Schools board of education meeting (Sept. 19, 2012): The board of trustees was briefed on three items they’ll have to vote on at their next meeting: a proposal for contracting out noon hour supervisor positions; some sexual heath program and curriculum recommendations; and an application for seat time waivers.

Board members gave mixed reactions to a proposal from Professional Contract Management, Inc. (PCMI) to provide outsourced noon hour supervision. PCMI’s proposal, made in response to an Aug. 8, 2012 RFP, was the only one received by the district.

PCMI’s bid is to charge the district 25.83% of the gross wages to be paid to the supervisors themselves. According to deputy superintendent for operations Robert Allen, that’s roughly 7% higher than bids the district has seen for similar services in the past. AAPS has used PCMI for substitutes and coaches in the past. Compared to current costs, which depend on hiring AAPS employees to supervise noon hours, the PCMI proposal offers savings of $55,000, or about 6% over the cost currently paid by the district. Deb Mexicotte, board president, was skeptical of the administrative fee PCMI would be charging the district.

A sexual health program for preschool through 2nd graders and a 15-minute video about puberty for 5th graders were the subjects of a first briefing given by the Sexual Health Education Advisory Committee (SHEAC). Any materials or curriculum must be vetted by that committee and be presented to the board. The first of two public hearings on the matter was held at the meeting. No member of the public spoke at the first one.

And students enrolled in a sufficient number of online classes in the Ann Arbor Public Schools will likely again be eligible this year to be counted as part of a school’s enrollment for the official count of students. Local districts receive an allocation from the state each year based on the number of students attending class on designated count days.

The AAPS board of trustees was briefed on the issue at its Sept. 18 meeting because the district is required to re-apply for its “seat time waiver” program by the Michigan Department of Education and must now have board approval. All districts with such programs were required to re-apply by Sept. 15, 2012 in order to receive full funding for eligible students. AAPS has operated its seat time waiver program since 2007.

Two informational presentations were also given to the board – an annual presentation on the physical properties department and an update on the Mitchell-Scarlett Teaching and Learning Collaborative with the University of Michigan.

Public commentary at the meeting included criticism from a Pioneer High School teacher that a hire for the principal’s job at that high school had not yet been announced, despite the fact that a committee had forwarded three recommended finalists to the superintendent some time ago.  [Full Story]

Library Board Updated on Strategic Plan

Although just six weeks remain before the Nov. 6 election – when voters will weigh in on a $65 million bond proposal for a new downtown library – that issue received scant mention.

But the bond proposal could be seen as the backdrop for a report by AADL director Josie Parker, who provided an update of the district’s five-year strategic plan, which the board adopted in 2010. Parker distributed a copy of the plan that highlighted achievements from the most recent fiscal year. “Our reach in the community is deep and it’s wide,” she said. “The strategic plan is our evidence.” [.pdf of highlighted strategic plan]

Board president Margaret Leary noted that as the community’s attention is rightly focused on the bond proposal, the goal of renovating or replacing the downtown building is only one item in the strategic plan. There are seven pages of actions that the library is taking, she said.

At last month’s board meeting Ellie Serras, chair of the Our New Downtown Library campaign committee, spoke during public commentary to brief the board on actions of that pro-bond group. And since then, two other efforts – to oppose the proposal – have emerged. A group called Protect Our Libraries was formed earlier this month. Its treasurer is Kathy Griswold, a former member of the Ann Arbor Public Schools board.

And Douglas Jewett, who had attended an August forum for potential AADL board candidates, filed paperwork on Sept. 25 for the Save the Ann Arbor Library ballot question committee. He did not file to run for the board. He previously had secured a sidewalk vendor permit on Aug. 20 for space in front of the downtown library at 343 S. Fifth. He uses the space to lobby against demolition of the current building, citing its architectural significance. The original portion of the building was designed by Alden B. Dow.

At the candidate forum, Jewett had praised the library, calling it the center of Ann Arbor. Four non-partisan board seats on the Nov. 6 ballot will be contested by five candidates: the four incumbents – Prue Rosenthal, Margaret Leary, Nancy Kaplan and Rebecca Head – as well as Lyn Davidge, who attended the Sept. 24 board meeting.

The positions will be elected by voters in Ann Arbor and portions of seven townships that are covered by the library’s district, in Pittsfield, Scio, Ann Arbor, Lodi, Webster, Salem and Superior. Those are the same boundaries served by the Ann Arbor Public Schools, with the exception of Northfield Township. The four-year terms begin Jan. 1, 2013. [Full Story]

City Council Punts on Several Agenda Items

Five significant items had been added: (1) a proposal to suspend temporarily the footing drain disconnection program in one area of the city; (2) a proposal to waive temporarily the city’s living wage requirement for certain nonprofits; (3) a proposal to establish a sidewalk gap elimination program; (4) a resolution on dealing with proceeds of city-owned land sales that competed with one already on the agenda; and (5) reconsideration of allocating $60,000 for a transit study – funding that the council had rejected at its previous meeting.

The first two items were added on Friday, Sept. 14. The second two were added the day of the meeting (Sept. 17), with the fifth item added at the council table. Of the added items, the council approved only one – to suspend temporarily the footing drain disconnect program. The rest were  postponed, withdrawn or voted down.

Postponed was the resolution added by Mike Anglin (Ward 5) to establish a committee of city officials and 10 residents – two from each ward, to be selected by councilmembers for respective wards – to address the issue of city-owned parcels in downtown Ann Arbor. The citizen committee to be established by Anglin’s resolution would study the available options for use of proceeds from the sale of downtown city properties.

Also postponed was the resolution that Anglin’s proposal was essentially challenging, which was brought forward by Sandi Smith (Ward 1). Smith wants to direct the proceeds from city-owned land sales to the city’s affordable housing trust fund. Her idea – which she first floated to her council colleagues in an email written in late August – enjoyed the support of nonprofits, as well as the Ann Arbor Downtown Development Authority board and the Washtenaw County board of commissioners.

While Anglin’s resolution was postponed until Oct. 1, Smith’s was referred to the council’s budget committee and postponed until the council’s Oct. 15 meeting.

Also postponed was a requested $60,000 contribution to fund further study of a transportation connector – for the corridor running from US-23 and Plymouth southward along Plymouth to State Street and farther south to I-94. The outcome of this phase is to identify a preferred choice of technology (e.g., bus rapid transit, light rail, etc.) and the location of stations and stops. The council had voted down the proposal at its Sept. 4 meeting, but it was brought back for reconsideration on Sept. 17, only to be postponed until Oct. 15. The $60,000 is meant to be the city’s share of a $300,000 local match for a $1.2 million federal grant that has already been awarded.

Withdrawn was the proposal to waive a requirement of the city’s living wage ordinance for those nonprofits that receive funding from the city to deliver human services. The ordinance has a provision for a hardship waiver, but states that a nonprofit must submit a plan for eventual compliance within three years. No nonprofits had submitted such plans, meaning that the council’s resolution would have amounted to an attempt by the council to amend the living wage ordinance through a simple resolution, which it cannot do. When the council reached the item on the agenda, it was withdrawn, with an indication that an ordinance revision would be brought forward to a future meeting.

Also at the Sept. 17 meeting, the council heard about an item related to nonprofit funding for human services that will be brought forward on Oct. 1: a request to continue the two-year pilot program for coordinated funding. That news came during a presentation from Mary Jo Callan, head of the city/county office of community and economic development.

Voted down was a plan to initiate a 5-year program to eliminate sidewalk gaps in the city. Councilmembers voting against the resolution pointed to the fact that the city’s non-motorized transportation plan takes a comprehensive approach to identifying such gaps. They feared that people might mistakenly believe that certain gaps would necessarily be filled through this program, and raised concerns about equity. The resolution sought to identify independent funding sources to pay for such projects – the city’s strategy in the past has been to levy special assessments on owners of property adjoining the sidewalks.

The footing drain disconnect program was the only one of the late additions to the agenda on which the council took final action. In the general vicinity of the Lansdowne neighborhood, where some houses have already had sump pumps installed as part of the disconnect program, residents have reported that during heavy rains, the overland stormwater flows and the sheer volume of water in the city’s stormwater system prevent sump pumps from being effective. At an Aug. 22 neighborhood meeting, residents had called for a moratorium on the program. That’s essentially what the council’s resolution did.

Flooding was also a topic included in other council business that had been placed on the agenda through the regular agenda-setting process. The council approved an update to the city’s hazard mitigation plan. It will allow the city to receive already-approved federal funds for demolishing two out-buildings located in the floodway at the city-owned 721 N. Main property.

Also related to emergency preparedness, the city council authorized the purchase of a light rescue vehicle that can be used by firefighters to respond to medical calls. Because its staffing requirement is just two firefighters instead of three, the use of the vehicle would allow response to medical calls without diminishing as much of the department’s response capability for fire calls.

The council also gave final approval to rezoning of an Eden Court property to public land. [Full Story]

County Board Puts Off Vote on Act 88 Tax Hike

Washtenaw County board of commissioners meeting (Sept. 19, 2012): After passing a tax increase to support services for indigent veterans, county commissioners debated and ultimately postponed action on increasing a tax for agriculture and economic development – also known as the Act 88 millage.

The indigent veterans tax was uncontroversial. Several Vietnam veterans attended the meeting and spoke passionately about the need to support soldiers returning from Iraq and Afghanistan. The tax was increased to 0.0286 mills, to be levied in December 2012. The current 0.025 mills brought in $344,486 in 2012. The increased millage is expected to raise $390,340 in revenues for use during 2013.

But a proposal by Conan Smith to increase the Act 88 millage generated debate, primarily related to procedural issues. On Sept. 5, commissioners had given initial approval to a tax of 0.05 mills, unchanged from the current rate. At the time, Smith raised the possibility of an increase to 0.06 mills and a change in the way the millage revenues are administered, but he made no formal amendment. The board set a Sept. 19 public hearing for the 0.05 mills, and several representatives from groups that receive revenue proceeds spoke in favor of the tax.

Later in the meeting – after the public hearing – Smith made a formal motion to amend the resolution, raising the tax rate to 0.06 mills, a 20% increase that would bring in $838,578. Ronnie Peterson objected to the process, saying that although it might be legal, but was not moral. Wes Prater said the move lacked integrity. Smith argued that the law didn’t require any public hearing at all, and that the board was going above and beyond its obligations. He pointed out that he had notified commissioners of his intent on Sept. 5, and had passed out a memo about his proposal at the Sept. 6 working session. Ultimately, a majority of commissioners voted to postpone action on Smith’s amendment until Oct. 3, when they also voted to set a second public hearing on the 0.06 mills proposal.

Also generating considerable debate was a resolution related to animal control services. The resolution, brought forward by Barbara Bergman, directs county administrator Verna McDaniel to begin negotiations with the Humane Society of Huron Valley toward a new contract for services. It further states that if McDaniel doesn’t believe sufficient progress is being made by Oct. 30, then she’s authorized to issue a request for proposals (RFP) to seek bids from other organizations. It passed on a 10-to-1 vote, with dissent from Alicia Ping.

Much of the debate over the second resolution centered on the fact that formal recommendations from the tasks force haven’t yet been presented to the board. There were also questions over how much flexibility McDaniel will have in her negotiations. The current 2013 budget has allocated $250,000 for animal control services. This year, the county is paying $415,000 to HSHV, down from $500,000 in 2011. Commissioners expect that the final amount negotiated for 2013 will be higher than the budgeted $250,000 – and if that’s the case, the board will need to amend the budget.

Ping objected to the process, saying that it could undercut HSHV’s position if the board eventually decides to issue an RFP, because other bidders would know how much HSHV is willing to bid. She also objected to taking action without knowing the task force recommendations. “This whole process is flawed on its face,” she said.

The board took a range of other actions, including changes to an ordinance for the county’s natural areas preservation program. Commissioners eliminated a previous restriction that only 7% of millage funds could be used for management or stewardship. In addition, they approved an amendment by Conan Smith eliminating a separate requirement for allocating 75% of the millage to the acquisition and maintenance of natural areas and 25% for agricultural land. Now, allocations can be made at the discretion of the county parks and recreation commission.

Commissioners approved a variety of state grant applications and reimbursements, as well as the 2012-2013 budget for its community support & treatment services (CSTS) department. Three resolutions of appreciation were also presented during the meeting – to Rodney Stokes, former director of the Michigan Dept. of Natural Resources; Susan Sweet Scott, a long-time county employee; and the Ann Arbor alumnae chapter of Delta Sigma Theta Sorority for 50 years of service in Washtenaw County. Round One of Building Demolition Hearings

Ann Arbor building board of appeals meeting (Sept. 13, 2012): At its Feb. 21, 2012 meeting, the Ann Arbor city council established a $250,000 fund to pay upfront costs – if necessary – to undertake demolitions of dangerous buildings. And at its Aug. 9, 2012 meeting, the council authorized signing contracts with four different demolition companies to do the work on an as-needed basis.

That set the stage for the building board of appeals to hold a first set of four show-cause hearings earlier this month.

If the board finds that the property in question is a dangerous building under the city’s ordinance and Michigan’s building code, and orders the property demolished, then a property owner has 20 days to undertake the demolition or appeal the board’s ruling to the circuit court.

Because the city now has demolition companies under contract and the funds set aside to pay for upfront costs, it can back up the demolition order if a property owner fails to comply with it – by going ahead and taking the building down. Although the city would pay the initial cost, the property owner would be assessed and invoiced for the cost of the demolition, which includes an administrative fee.

So it’s more cost-effective for property owners to demolish buildings themselves, compared to having the city do the work. When the owner of one of the four condemned properties arrived late a few minutes after the Sept. 13 hearings had concluded, Ann Arbor’s chief building official Ralph Welton told him: “We’d much rather you knock it down.”

That property was a residential garage, located at 2415 Dorchester Road in the southeastern quadrant of the city. The garage has apparently become a home to chicken hawks, which roost in the open roof.

The other three properties on the board’s agenda included two houses – one at 3123 Cherry Tree Lane, off Packard near US-23, which had additional construction done on the property in a non-compliant way, resulting in conditions the city found to be dangerous. The other house on the board’s agenda was 3010 Dexter Road, on the city’s west side.

In fairly straightforward fashion, the board found all three residential properties to be dangerous buildings under the local and state code, and called for their demolition.

The one property for which a representative of the owner was on hand was 175 N. Maple, where a former Chinese restaurant is located inside the Maple Village shopping center. That hearing took the longest of the four. The back-and-forth between the owner’s representative and the board resulted in a 30-day timeframe set by the board for a plan to be submitted to rectify the conditions, and subsequent to that plan approval, a 60-day window to effect the remedy. The owner’s representative came from Brixmor Property Group, a portfolio company of the Blackstone Group real estate fund.

It was evident that the board was handling the first round of show-cause hearings for the city’s recent efforts. To craft the wording of the board’s first motion of the meeting required a group effort, including much consultation with city attorney staff and Welton. [Full Story]

County Parks OKs More Natural Area Funds

Washtenaw County parks and recreation commission meeting (Sept. 11, 2012): Commissioners took another significant step toward receiving a $2.275 million $975,000 grant from the Michigan Dept. of Natural Resources Trust Fund to buy land for the Arbor Vistas Preserve natural areas connector – by approving $975,000 in matching county funds for the project. The property is located in Ann Arbor Township.

In other action related to natural areas preservation, WCPARC gave initial approval to commit $109,864 to purchase a conservation easement on 124 acres of the Donald Drake property in Lodi Township; and $64,200 toward the purchase of a conservation easement on 73 acres of the Hornback property in Salem Township. Both deals are in partnership with the Ann Arbor greenbelt program.

The commission also approved staff recommendations to increase spending by $522,260 – bringing the total to $1.4 million – on the River Terrace section of the Border-to-Border Trail in Dexter. And the group approved up to $205,587 to replace the pedestrian bridge at Sharon Mills Park, in southwestern Washtenaw County.

Several written financial reports on claims paid and fund balances for parks & recreation functions were approved. The commission also was briefed on a record-setting numbers of users and revenues at the county’s major outdoor parks & recreation facilities this summer – at Independence Lake Park, Pierce Lake Golf Course, and Rolling Hills Park and its water park. However, revenues and attendance for the Meri Lou Murray Recreation Center have declined.

During its Sept. 11 meeting, the commission passed a resolution of appreciation for the public service career of Rodney Stokes, former director of the Michigan Dept. of Natural Resources. Bob Marans, WCPARC’s president, noted that Stokes has helped Washtenaw County secure millions of dollars in state DNR trust fund grants over the years. Stokes is expected to attend the Sept. 19 meeting of the Washtenaw County board of commissioners, when a similar resolution of appreciation is on the agenda. [Full Story]

Task Force: Negotiate with Humane Society

Washtenaw County board of commissioners – animal control policy task force meeting (Sept. 13, 2012): With five of 11 county commissioners present, a task force for developing policies on the county’s animal control services thrashed through a list of recommendations to make to the full board, possibly at its Sept. 19 meeting.

But at the end of the two-hour task force session, commissioners also opened the door to start direct negotiations with the Humane Society of Huron Valley, rather than pursuing a request for proposals (RFP) from other vendors. For many years HSHV has held the contract to provide services to the county, including those that are state-mandated. Its current contract expires on Dec. 31, 2012. Key points of contention have been the amount that the county is willing to pay for animal control services, both mandated and non-mandated, and how much those services actually cost.

In advocating for negotiations with HSHV, Rolland Sizemore Jr. expressed concern that if the board pursues the RFP process, a service provider won’t be lined up by the end of this year. Then the county will be in the same position it was in the beginning of 2012 – scrambling to get a new contract. He also pointed out that if the county issues an RFP and no other organizations respond, then the HSHV will have more leverage over the county “because they’ll know we’re screwed.”

Tanya Hilgendorf, HSHV’s executive director, supported starting contract negotiations. She attended the Sept. 13 meeting and praised the work of the task force as well as a separate group led by sheriff Jerry Clayton, which has been analyzing costs for animal control services. People are more informed than they were when this process began in May, she said, adding that there was more trust between the county and HSHV, too.

At least one commissioner, Barbara Bergman, had explicitly stated earlier in the meeting that she didn’t trust HSHV yet. She said the last time that the county had trusted HSHV, commissioners didn’t get good data about the services that were being provided, and the cost of those services. Bergman – who had left the meeting by the time a suspension of the RFP process was discussed – has been a strong advocate for curbing costs related to animal control, in favor of funding programs for human services.

The task force reached consensus on eight recommendations for animal control services to include in an RFP, or for a contract with HSHV. Those include licensing all dogs at the point of adoption or recovery, holding all stray animals for the minimum number of days required by law, and providing animal cruelty investigations.

The group also reached agreement on broader policy recommendations, including several longer-term goals: creating a civil infractions ordinance and fee structure for unlicensed dogs, and working with local units of government to create a unified, countywide dog licensing program. Currently three other jurisdictions – Ann Arbor, Ypsilanti and Ypsilanti Township – have their own dog licensing programs, with varying fee levels.

Several other changes might be proposed in the future. Hilgendorf offered to draft language for an ordinance prohibiting ownership of certain types of exotic animals. She also hoped that commissioners eventually would consider an anti-chaining ordinance and spay/neuter ordinance – “even if it’s just for pit bulls,” which has worked well in Ypsilanti Township, she said. [The township has an ordinance requiring that pit bulls must be spayed or neutered.] Hilgendorf also suggested addressing the issue of feral cats, which are a problem in some parts of the county. HSHV already operates a “trap, neuter, return” program aimed at curbing the feral cat population.

When the task force was formed earlier this year, it were given a deadline of Oct. 15 to bring recommendations to the full board. It’s likely that will happen sooner, possibly at the board’s Sept. 19 meeting. As of Sept. 16, however, there was no agenda item for these recommendations on the board’s ways & means committee agenda or the regular board agenda.

County Tax Hike for Economic Development?

Washtenaw County board of commissioners meeting (Sept. 5, 2012): Board chair Conan Smith has floated a proposal to raise taxes that support economic development and agricultural programs, and suggested revising the way those revenues are administered.

The proposal came in the context of an initial board vote to levy an annual tax of 0.05 mills, unchanged from the current rate. The Michigan statute authorizing this millage (Act 88 of 1913) predates the state’s Headlee Amendment, so no voter approval is required. The board can levy the tax directly.

Ken Schrader, a PC technician with Washtenaw County, explained to the county commissioners that recently installed new microphones are more sensitive than the older ones. He jokingly warned them that they should be careful what they say now, because “you can’t take anything back.” Later in the meeting, the county’s information technology department was presented with an award from the Center for Digital Government.

The current rate is expected to bring in about $683,095 in 2013, and is allocated to a variety of organizations, including the economic development agency Ann Arbor SPARK ($200,000) and its Ypsilanti office SPARK East ($50,000). Smith and county administrator Verna McDaniel serve on SPARK’s executive committee.

Smith, a Democrat from Ann Arbor, suggested that by raising the rate to 0.06 mills, property owners would see only a slight increase in their annual taxes. For the average taxpayer, he estimated it would increase from $4.25 to $5.10 per year, while the amount raised countywide would increase about 20% to $838,577. He also proposed that the office of community and economic development – a joint county/city of Ann Arbor department led by Mary Jo Callan – should be given the authority to allocate the funding, rather than having the county board earmark amounts for specific organizations.

No formal amendment was made, but Smith circulated a three-page memo the following night outlining his proposal. [.pdf of Smith's Act 88 memo] It’s likely the board will take up this proposal as an amendment before a final vote at its Sept. 19 meeting. Initial approval was given on Sept. 5 for the current rate of 0.05 mills on a 7-to-3 vote, with dissent from Alicia Ping, Wes Prater, and Dan Smith. Ronnie Peterson was absent.

Another pre-Headlee tax – for support of indigent veterans – also got initial approval from the board, at a slightly increased rate. The initial approval increases that tax from 0.025 mills to 0.0286 mills. Staff of the county’s department of veterans affairs say the increase is needed because of rising claims and services from veterans due to a struggling economy, an anticipated increase in the number of returning soldiers, and a drop in property values. The millage is expected to raise $390,340 in revenues during 2013.

In other action related to tax revenue, commissioners gave initial approval to an ordinance governing the county’s natural areas preservation program. The change would remove the current restriction that only 7% of millage funds can be used for management or stewardship. The intent is to provide more flexibility in managing the funds, allowing the county to build a reserve for long-term stewardship. It’s viewed as an important goal, in the event that the NAPP millage is eliminated in the future. Yousef Rabhi, a Democrat who represents District 11 in Ann Arbor, proposed an amendment that would set a minimum of 25% to be spent on stewardship. The amendment failed on a 1-9 vote.

In an item viewed largely as a formality, county commissioners “ratified” the articles of incorporation for a new countywide transit authority. The document had been slightly revised from what the board had previously approved on Aug. 1, 2012 – on a 6-4 vote. This time, the vote was 6-3, with dissent from Alicia Ping, Wes Prater and Dan Smith. Rolland Sizemore Jr. and Ronnie Peterson were absent. Rob Turner, who had previously voted against the articles of incorporation, supported the item on Sept. 5.

Also approved was a resolution to support a policy change in the city of Ann Arbor related to affordable housing. The item was added to the Sept. 5 agenda during the meeting by Democrat Leah Gunn of Ann Arbor, and was not discussed by commissioners at the meeting. The resolution “encourages the Ann Arbor City Council to direct proceeds from the sale of the city-owned surface parking lots in the downtown to the city’s Housing Trust Fund, to be used to support sustainable, affordable housing.” [Earlier in the day, the Ann Arbor Downtown Development Authority board had passed a similar resolution of support. Gunn is chair of the DDA.] Dan Smith abstained from the vote. The following night, at a board working session, Alicia Ping announced that she had intended to vote against it, but had cited the wrong agenda number in casting her no vote.

Other action at the Sept. 5 meeting included initial approval of the county’s public health budget, which projects a 3.5 net increase in jobs. Voting against the budget were Alicia Ping and Dan Smith, who cautioned against adding new jobs as the county faces a deficit in 2013. A final vote is expected at the board’s Sept. 19 meeting.

Seth Best, a former resident of Camp Take Notice, addressed the board during public commentary about the need to tackle the root causes of homelessness. The homeless encampment had been evicted this summer from its most recent site in Scio Township.

And highlighting a letter that the county had recently received, commissioner Felicia Brabec raised concerns about the intent of Paxton Resources LLC to drill an exploratory oil and gas well in Saline Township. The board will likely revisit the issue of hydraulic fracturing, or “fracking,” at a future working session. Yousef Rabhi, who chairs those meetings, suggested wrapping it into a session he plans regarding the Pall/Gelman Sciences 1,4 dioxane plume. He sees a tie-in to the issue of industrial environmental contamination. [Full Story]

AAPS OKs Technology Upgrades

Ann Arbor Public Schools board of education meeting (Sept. 5, 2012): Trustees were briefed on two proposals for technology improvements – a purchase of 30 laptops with the new Macintosh Mountain Lion operating system and a contract for network infrastructure equipment and installation. The Ann Arbor Public Schools technology bond professional team asked that the board of trustees appropriate $54,540 to purchase 30 MacBook Pro laptop computers, in order to train and test on the new Mac operating system, Mountain Lion. The point of the testing is to check compatibility with the district’s current software applications as the district moves to replace all of its computers.

A $76,463 contract with Sentinel Technologies, Inc. for purchase and installation of computer network equipment was presented to the trustees. The new network equipment is supposed to make the district’s network and firewall more secure and reliable. The upgrade is also supposed to provide more internal and external bandwidth, and allow for increases in the future. The network equipment would be funded from the district’s technology bond.

Before hearing the briefings, the trustees were asked to consider them as special briefings, which meant they would be voted on at that same meeting. The change was driven by a decision the board made to alter its September meeting schedule.

The board also heard extensive public commentary at the start of the meeting on the issue of class sizes as the school year opened. Parents of Haisley Elementary School students asked the board for help in rectifying a situation they described as not viable – 32 students per class in 3rd and 4th grade classrooms. [Full Story]

Zoning, Transit Focus of Council Meeting

Ann Arbor city council meeting (Sept. 4, 2012): The council handled a mixed bag of items at its most recent meeting, ranging from land use to community events funding.

One item was apparently not handled the way that the majority of the council wanted, due to the absence of two councilmembers – Carsten Hohnke (Ward 5) and Marcia Higgins (Ward 4).

That item was a $60,000 appropriation – the city’s portion of a $300,000 local match for continued study of the Plymouth/State corridor, from US-23 and Plymouth southward along Plymouth to State Street, extending south to I-94. The local match is needed for a $1.2 million federal grant that has been awarded for the study. This alternatives analysis phase follows a basic feasibility study. The current study is supposed to result in a preferred choice of technology (e.g., bus rapid transit, light rail, etc.) as well as identifying stations and stops.

Because the $60,000 transfer from the general fund was a change to the city budget, it needed the votes of eight members on the 11-member city council. When Mike Anglin (Ward 5) led off the roll call by voting against it, it was clear that the council would have no more than seven votes in favor – because Jane Lumm (Ward 2) had already made plain during deliberations that she’d be voting against it. So some councilmembers voted against the resolution in order to be on the prevailing side. That gives them the right under parliamentary rules to bring back the item to the council’s next meeting for reconsideration. At that meeting it’s possible, but not certain, that supporters of the funding will have the necessary eight votes.

Several items on the agenda dealt with land use. The council gave final approval to a rezoning request for Knight’s Market, which will allow for expansion of the market at Spring and Miller streets. Winning initial approval was a rezoning requested by the developer of proposed townhouses on Catherine Street – from its current planned unit development (PUD) zoning to R4C (multi-family residential). Rezoning for part of a parcel in connection with a planned Speedway gas station at Maple and Miller also got the council’s initial approval. A related site plan for the station got its one and only required approval.

Also connected to land use was the council’s addition of two more properties to the greenbelt, using about $0.5 million in city funds from the open space and parkland preservation millage. The land from the two properties totals around 226 acres. Lumm cast a lone vote of dissent.

The council also authorized disbursements of community events funds to 13 organizations totaling $44,778, the bulk of which went to the Ann Arbor Summer Festival’s Top of the Park.

And the council set a public hearing for Oct. 1 on a tax abatement for Barracuda Networks. The firm is relocating to downtown Ann Arbor from its current location on Depot Street, in part to accommodate an additional 144 employees it expects to hire by July 1, 2014. [Full Story]

Greenbelt Group Briefed on Strategic Plan

Ann Arbor greenbelt advisory commission meeting (Sept. 6, 2012): Commissioners were briefed on two items at this month’s meeting – the greenbelt program’s strategic plan, and a design for the program’s logo.

It’s been three years since the strategic plan was last updated. In this latest version, no major changes are being made to the program’s existing priorities: protecting large blocks of farmland as well as natural areas in the Huron River watershed, and building partnerships to leverage other funding sources.

In addition to those, a new priority is being added: Educating Ann Arbor residents about the program’s efforts, and reaching out to landowners in the greenbelt to ensure that the flow of applications continues. [.pdf of revised strategic plan]

Commissioners gave additional feedback at their meeting, and the plan will be sent to funding partners for their input too. The greenbelt advisory commission is expected to vote on the final plan at its Oct. 4 meeting.

The group also weighed in on designs for a new logo to help brand Ann Arbor’s greenbelt program. The design is intended to show the connection to the city, as well as images representing both farmland and natural area preservation. There’s space for logos of partner entities, and text that indicates what kind of land is being preserved and whether the land is private or public. The intent is to use this image on signs at the properties that are protected by the greenbelt program, and on brochures and other materials.

In updates to the commission, Ginny Trocchio – who is the program’s support staff – highlighted plans to hold another bus tour of greenbelt properties on Saturday, Sept. 22. The trip will focus on the eastern portion of the greenbelt, and its connection to the Superior Greenway. She also noted plans to participate in the Sept. 8 HomeGrown Festival, an event showcasing local food.

In their main action item, commissioners voted to recommend that the city council partner with Washtenaw County and Webster Township, contributing 25.5% toward the purchase of a parcel identified as application number 2005-08. (The first four numbers signify the year in which the application was made.) Tom Bloomer abstained from the vote. He owns Bur Oaks Farm in Webster Township, and serves on the township’s farmland and open space board. He did not indicate his reason for abstaining.

Two days earlier, the city council had approved two purchase-of-development-rights (PDR) deals that GAC had previously recommended: the 90-acre Alexander farm in Webster Township, and a 136-acre property owned by Robert H. Schultz in Superior Township. Jane Lumm (Ward 2) voted against both deals, citing concern that no local partners contributed to the land preservation efforts.
