Linda Edwards-Brown, the county’s juvenile division administrator, told commissioners that there’s been an increase in young men “terrorizing” their communities. The sheriff’s office and court had started working together several months ago after they began observing an increase in gang-type activity, she said, including home invasions, firearm larceny, and assaulting police officers. They’d been hopeful that they could stem the tide of violence, she added, but it had escalated with a death in Ypsilanti earlier this summer.

So the sheriff’s office and court officials have reached consensus to remove some of these young men from the community and put them into residential facilities in other parts of the state, Edwards-Brown said. The juvenile division of the Washtenaw County trial court will place at least six youths in residential facilities this month, in addition to six youths who are currently in residential placements. According to a staff memo, residential placements are costly, with a typical length of stay at nine to twelve months.

At the July 9 meeting, commissioners and staff expressed the need to continue working on this issue as a community-wide effort.

In other action, commissioners were asked to pass a resolution making mid-year budget adjustments and allocating this year’s higher-than-expected property tax revenues, as well as putting the $3.9 million surplus from 2013 into unearmarked reserves.

The adjustments passed on a 6-2 vote, with Dan Smith (R-District 2) and Conan Smith (D-District 9) dissenting. Andy LaBarre (D-District 7) was absent. Dan Smith objected to spending more than was budgeted and making budget changes outside of the annual budget affirmation process, which takes place later this year. Conan Smith didn’t state his reason for voting against it on July 9, though in the past he has advocated for spending more of the surplus, rather than setting it aside in the fund balance.

Commissioners also authorized putting a proposal on the Nov. 4, 2014 ballot to renew a 10-year, 0.2353-mill countywide parks and recreation operations tax. They held public hearings related to other millages that the county plans to levy later this year: (1) for support of indigent veterans and their families; and (2) to fund economic development and agricultural activities, under Act 88. The hearings drew one speaker – Thomas Partridge.

Related to the health department, the board created a new board of health to help oversee public health services in the county. A state official was on hand to talk about the accreditation process that the Washtenaw County public health department completed earlier this year.

Commissioners voted to accept the recommendations of a task force that’s been working on a funding strategy to help end homelessness, and to sunset that task force. The board also made appointments to a new committee that’s charged with exploring funding options for road repair.

Several issues were raised during public commentary. Former Congressman Wes Vivian urged the county board to place a proposal on the Nov. 4, 2014 ballot enabling Washtenaw County voters to ask the state to support a constitutional amendment to overturn the Citizens United decision. That U.S. Supreme Court ruling has resulted in corporations “sloshing big money into our elections at all levels,” Vivian said.

Also during the meeting, commissioners honored Arthur Williams, who is retiring as principal of Huron High School in Ann Arbor after 19 years in that job. The board also passed proclamations welcoming the United Association (UA) of plumbers and pipefitters and the Ironworkers International. Both unions hold training programs in Washtenaw County each summer.

At the beginning of the meeting, Rabhi asked for a moment of silence in memory of Rowan David LaBarre, the newborn son of commissioner Andy LaBarre and his wife Megan LaBarre. Rowan David had passed away earlier in the week. “We all pray and hold Rowan in the light of our prayers and thoughts,” Rabhi said.

Funding to Address Juvenile Crime

The July 9 agenda included a resolution authorizing the use of $642,707 from the Child Care Fund balance to pay for a range of services overseen by the county’s dept. of human services. The use of $642,707 will drop the Child Care Fund balance from $1,041,882 to $399,175. [.pdf of staff memo]

The resolution authorized an amendment to the Child Care Fund (CCF) budget for the current fiscal year. The request came from the Washtenaw County Trial Court’s juvenile division and the county’s department of human services – the entities that oversee programs supported by the CCF.

According to a staff memo, the CCF is a collaboration between the state and county circuit courts to support programs that serve neglected, abused and delinquent youth in Michigan. The state reimburses counties for 50% of all eligible CCF expenses.

The specific request on July 9 was for an increase in the CCF budget from $1,872,928 to $2,500,000 for the 2014 county fiscal year, which runs from Jan. 1 through Dec. 31 – an increase of $642,707.

Expenditures for the children’s services department are expected to be $262,341 over the current budget during the county fiscal year. Those expenses relate to use of part-time temporary staff as well as overtime, according to the staff memo, “to ensure that Children’s Services remains in compliance with state licensing requirements for juvenile detention facilities.”

In addition, the Trial Court’s juvenile division planned to put at least six youths in out-of-home placements in July. Another six youths are already placed. The typical length of such placements is nine to twelve months at an average $260 per day, per youth. That cost can range from a low of $150 to a high of $522. The total cost for the remainder of the county fiscal year is projected to be $396,000.

In addition, detention beds in the county’s children’s services facility have been occupied at or near capacity for all of 2014, which has resulted in the need for part-time temporary staff as well as overtime pay.

Funding to Address Juvenile Crime: Board Discussion

Ronnie Peterson (D-District 6) asked about the timing of this request. Linda Edwards-Brown, the county’s juvenile division administrator, clarified that the request for funding is for the county’s fiscal year, through Dec. 31. However, the Child Care Fund (CCF) budget is aligned with the state’s fiscal year, from Oct. 1 through Sept. 30. Edwards-Brown noted that the budget amendment would run only through Dec. 31, 2014. “We’ll be back here in a few months to look at the 2014-2015 Child Care Fund budget,” she said.

Peterson expressed interest in seeing long-term budget projections. It’s not about the money, he added, but it’s important to find out what’s happening in the juvenile justice system. The county needs to know what its financial obligations are to address some of the issues that are occurring in the community, which are causing youth to end up in detention facilities.

Edwards-Brown told commissioners that a group of young men are “terrorizing” their communities. They are carrying weapons, displaying weapons on social media, committing home invasions, and stealing guns.

Several months ago, the sheriff’s office and the court started working together as they saw the beginning of what seemed to be gang-type activity, Edwards-Brown said. “We were hopeful that we would be able, by working together, to stem this tide of violence that we’re seeing in the community. We were unable to do that.”

Last month, a young man was murdered in Ypsilanti, Edwards-Brown said. It’s a problem that the sheriff’s office had predicted, she added. Now, collectively, the court and sheriff’s staff have decided they need to remove the young men from the community, she said. “So that’s the answer as to why we’re here tonight asking for more money for residential placements.”

The trial court has made a concerted effort over the last several years to keep youth in the community and work with them in their homes, Edwards-Brown said. But at this point, public safety is an issue, as well as the safety of these young men, she said. They can’t be “safely maintained” in the community, and need to be taken outside their homes, she said.

Derrick Jackson, director of community engagement for the sheriff’s office, reported that last summer, deputies started to notice an increase in juvenile violence and an escalation in crimes that juveniles were committing. He noted that in the early 1990s, there was gang activity in the area and a lot of those gang members were taken off the streets for 10-15 years. The question since then has been how can the community change so that when those men got back out, “things won’t go back to the way they were,” he said.

Fortunately, those men didn’t go back to criminal behavior, Jackson added, but some of their children, younger siblings and other relatives are now in their teens, and are starting to get involved in gang-type activity. The good thing about having a conversation now is that it’s at an early stage, he said, “and we’re hoping we can prevent some of this.”

They’re not saying that the answer is to lock up every kid who’s associated with these things, Jackson stressed. But this is one of the answers for a small percentage of kids who are very violent, carrying weapons, doing drugs and who ultimately committed homicide.

A large task force is coming together to talk about a “holistic, wrap-around response to what we’re seeing in the community,” Jackson said, because it’s such a significant issue. He noted that about 55 community leaders – including some county commissioners – had met recently to talk about the juvenile criminal justice system, and everyone had seen an increase in problems. When he talks to high school and middle school teachers in the eastern part of the county, they all say the same thing – they see a difference in how young people are acting.

Jackson said that when you see the train coming down the track, you can prepare to get run over or you can figure out a way to stop it. People in the county are working to stop the train, he said.

Lisa Greco, the county’s youth center director, noted that juvenile detention is where kids are placed when law enforcement removes them from the community. They’re held in secure custody until decisions can be made about what to do next. The juvenile detention center has seen more than a 25% increase in population and days of care, Greco said. Managing the dynamics in the community is challenging, she said, and managing those kids in the confined space of juvenile detention is also a challenge. “I think we’ve been up to it, and have taken good care of the kids,” she said.

The community is at a crossroads, Greco added. There’s a need for an immediate response, as well as a call to action to re-examine the juvenile justice system in Washtenaw County in its entirety. “We need alternatives to juvenile detention,” she said. There needs to be early identification, intervention and assessment for kids who are struggling in the community.

Rolland Sizemore Jr. (D-District 5) expressed concern about the kids who’ll be sent to places outside of Washtenaw County. “What happens when they get done and come back here?”

Edwards-Brown replied that none of the young men will be sent out of state. They’ll be sent to Maxey Boys Training School in Whitmore Lake, Turning Point Youth Center in St. Johns, and other facilities within Michigan. “We want them to have the opportunity for their families to visit them and to participate in family therapy while they’re in these placements,” she said.

These young men will eventually be returning home in nine to 12 months, Edwards-Brown noted. So it’s important to bring change to their homes, so that they won’t be returning to the same situation, she said.

Sizemore advocated for having an individual or entity examine all the programs in the county that help youth. He thought there were duplicative services, and the services should be better coordinated. He also hoped the school districts would get involved, and that parents would be supported. He praised Jackson, sheriff Jerry Clayton and deputies for doing difficult work. But it’s time to stop studying the situation and to put some money directly into programs that will help youth, he said.

Alicia Ping (R-District 3) said she first heard about the Ypsilanti murder on Facebook, from a friend who lived in that neighborhood. She thought that by removing these young men, it will help the community as a whole. It will provide hope to the people living there, since they won’t be living in a place of fear. It’s important to let residents know that the community cares about what’s happening in those neighborhoods, Ping said, and that action is being taken to help.

Edwards-Brown stressed that “this may not be the panacea.” Although the additional funding will help remove a certain number of young men, “there are brothers and sisters and nieces and nephews and cousins – so we have a bigger problem that we have yet to address,” she said. “We’re hoping to, quite frankly, save lives – the lives of these young men, and perhaps someone else in the community. But our work is far from done.”

Peterson said the problem isn’t just isolated to Ypsilanti – it’s something happening nationwide. He noted that the funding for this request is coming from the Child Care Fund reserves, but it’s unclear where funding will come from in the future. It could be a budget that inflates much higher, because the county has an obligation to provide services to all youth in need, he said.

Peterson suggested that the county administrator, Verna McDaniel, and the county board chair, Yousef Rabhi (D-District 8), work with staff to identify budget projections and future demand for services. If there’s a trend, the board should be aware of it well in advance, he said. “This is not going to be a gang haven,” he said. “The is not the Wild West.” Washtenaw County has the reputation as a great place to raise children, and they need to maintain that, Peterson added.

Jackson offered to make a presentation to the board with more details about the responses that are being planned. He said he’d spoken with three different mothers who had noticed that their sons were changing, but who couldn’t find help until the situation had escalated. That’s what needs to be addressed, he added – how to structure something in this community that will align the human services with the real issues that need attention.

Conan Smith (D-District 9) drew attention to the fact that fund balance is being used. The CCF fund balance will be depleted by two-thirds with just this one allocation, he noted. It’s an important allocation, and the kind of thing that fund balances are used for, he added. “But we’re doing it regularly now – dipping into departmental fund balances for programmatic expenditures.”

At the same time, Smith noted, the board is set to add money to the general fund reserves. He expected to see other proposals from departments later this year, also requesting to use their departmental fund balances. “This is a fiscal policy question that we really ought to be grappling with,” Smith said.

McDaniel pointed out that it’s actually a $1.3 million problem – the county’s $642,707, plus an equal amount that will be reimbursed by the state.

Outcome: Commissioners unanimously approved the Child Care Fund budget amendment.

Mid-Year Budget Adjustments

Commissioners were asked to pass a resolution making mid-year budget adjustments and allocating this year’s higher-than-expected property tax revenues, as well as a $3.9 million surplus from 2013.

The adjustments increased the general fund budget’s expenses and revenues by $720,486 for 2014, $733,233 for 2015, $745,980 for 2016 and $758,727 for 2017. The county operates on a four-year budget, with the fiscal year matching the calendar year.

The adjustments also followed the recommendation of county administrator Verna McDaniel, and set aside the $3,920,818 surplus from 2013 in unearmarked reserves, rather than spending it. The projected year-end 2014 fund balance is $20,638,675. The county board had previously approved a goal of holding a fund balance equal to 20% of its general fund budget. For 2014, the general fund budget is $103,127,202. [.pdf of staff memo and mid-year budget resolution]

In addition, the following mid-year budget adjustments were made to the general fund:

  • Structural adjustments resulting in a $494,677 increase in expenditures for (1) providing employee health care coverage for autism; (2) a consultant to help with the board’s budget priority work, (3) a “local government initiatives” intern; (4) reinstatement of two full-time equivalent positions in the sheriff’s office; and (5) salary adjustments for non-union employees.
  • Non-structural, one-time, adjustments that increased expenditures by $65,000 for homelessness initiatives.

The administration recommended that the remaining $160,809 be held as an undesignated allocation until budget projections improve as new information becomes available. The administration will present a second-quarter budget update at the board’s next meeting on Aug. 6, 2014.

Mid-Year Budget Adjustments: Board Discussion

Dan Smith (R-District 2) noted that it’s been less than three months since Raman Patel, the county’s equalization director, told the board about higher-than-expected tax revenues, which resulted in about $750,000 more revenue this year than had been budgeted for 2014.

Now, the board is already spending almost $600,000 of that surplus, which hadn’t been included in the original 2014 budget, Smith noted. There is no shortage of things to spend this money on, he continued, including over $234 million in unfunded liabilities “which we have no particular plan to pay for, other than amortizing payments over 26 years – something that our actuary is recommending against us doing.” The actuary would like to see that amount amortized over a much shorter period of 10 years.

Smith said he had no problem with making technical budget adjustments as they come along. But one of the reasons to have a four-year budget is to have a plan and then execute that plan, Smith said.

If the board wants to “be constantly in budget mode,” he said, then they could simply have a one-year budget. Unless there’s an emergency situation or deadlines that are outside of the county’s control, he thought it would be more appropriate to make these changes in the fall, during the board’s annual budget reaffirmation process.

There was no additional discussion on this item.

Outcome: The budget adjustments were passed on a 6-2 vote, over dissent by Dan Smith (R-District 2) and Conan Smith (D-District 9). Andy LaBarre (D-District 7) was absent.

County Parks & Rec Millage

The board was asked to pass a resolution that would authorize putting a proposal on the Nov. 4, 2014 ballot to renew a 10-year countywide parks and recreation operations millage.

The resolution on July 9 was for an amended version, compared to a resolution given initial approval on May 21, 2014. That’s because some state-mandated information had inadvertently been left off the proposed ballot language in the original resolution, according to a staff memo. [.pdf of staff memo]

The operations millage was first authorized by voters in November 1976 at 0.25 mills for a 10-year period and has been renewed three times. Because of the state’s Headlee amendment, the rate that’s actually levied has been rolled back and is now 0.2352 mills. The current millage expires in December 2016.

If renewed again, it would generate an estimated $3.4 million annually – or about half of the parks & rec annual operating expenses. Other revenue sources are admission/gate/membership fees charged seasonally at facilities including the Meri Lou Murray recreation center, the water/spray parks, and the Pierce Lake golf course. Funding is also received from state and federal grants as well as private donations.

The county parks system receives most of its funding from two countywide millages. In addition to the operations millage, another millage pays for capital improvements and park development. It was also originally levied at 0.25 mills, but has been rolled back to 0.2367 mills.

In addition, a third millage – levied at 0.25 mills but rolled back to 0.2409 mills – funds natural areas preservation, bringing in about $3 million annually. It was first approved by voters in 2000, and renewed for another 10 years in 2010.

The county’s parks & recreation department is overseen by a separate entity – the parks & recreation commission – whose members are appointed by the county board. The county board has the authority to put a parks millage proposal on the ballot, but does not authorize expenditure of the funds. That responsibility rests with the parks & recreation commission. The group meets monthly at the parks & recreation office at County Farm Park, and its meetings are open to the public.

County Parks & Rec Millage: Board Discussion

Conan Smith (D-District 9) advocated for support of this millage in November. The county parks & recreation commission has done incredible things, he said. [Conan Smith serves on the commission, along with Dan Smith (R-District 2) and Rolland Sizemore Jr. (D-District 5).] There’s a park or preserve or recreation facility in nearly every community throughout Washtenaw County, and most of the county facilities are free to the public, he noted. The parks & rec commission also leverages funds from the state, Smith added, on projects like the Border to Border trail. It’s worthy of the continued support of county citizens, he concluded.

Yousef Rabhi (D-District 8) said he hears a lot from people around the state and nation about how unique the county parks & rec system is. He also supported the millage renewal.

Outcome: The board unanimously approved placing the millage renewal on the Nov. 4, 2014 ballot.

Appointments

There were two sets of appointments on the July 9 agenda – for a road funding committee, and the board of public works.

Appointments: Road Funding Committee

Commissioners were asked to approve appointments to a new committee that’s charged with exploring funding options for road repair.

The board had created the road funding committee on June 4, 2014, after debating whether to levy a countywide road millage or put a millage proposal on the Nov. 4, 2014 ballot to fund road repair. The final vote to create the committee had been 6-1 vote, over dissent from Conan Smith (D-District 9). Commissioners Yousef Rabhi (D-District 8) and Dan Smith (R-District 2) were absent.

In arguing against levying a tax at that time, some commissioners cited the need to study funding options – including a possible Act 283 levy, which doesn’t require voter approval – before making a decision.

On July 9, Rabhi proposed an amendment to his original resolution, adding two new slots – one for the director of the Washtenaw Area Transportation Study (WATS), and one for an additional county commissioner slot, to make it an odd-numbered roster.

Rolland Sizemore Jr. (D-District 5) wondered why nine members were needed. Rabhi said he wanted to add the WATS representation because that group has been doing a lot of work on the road funding issue, and would like to participate. “It’s less a matter of the number of people, and more a matter of who we have at the table,” Rabhi said.

Outcome on amendment: Commissioners approved the amendment on a voice vote.

The following members were nominated by Rabhi:

  • Lew Kidder, representing the general public
  • Bill McFarlane, representing the road commission
  • Roy Townsend, managing director of the road commission
  • Rolland Sizemore Jr., the county board of commissioners’ liaison to the road commission
  • Dan Smith, county commissioner
  • Kent Martinez-Kratz, county commissioner
  • Rodrick Green, Superior Township trustee, representing townships
  • Steve Powers, Ann Arbor city administrator, representing incorporated municipalities
  • Ryan Buck, director of the Washtenaw Area Transportation Study (WATS)

The resolution directs the committee to meet within 60 days of this appointment to elect officers and draft bylaws. The committee is to report to the county board at its Sept. 17, 2014 meeting, and make quarterly updates after that with a final report due in December 2015.

The county administrator will help provide administrative support to the committee.

Outcome: Commissioners unanimously approved the appointments to the road funding committee.

Appointments: Board of Public Works

Yousef Rabhi nominated Steve Feinman to the county’s board of public works for the remainder of a three-year term ending Dec. 31, 2015.

According to the department of public works website, the board of public works “focuses on assisting local communities within Washtenaw County in addressing environmental and public health issues and development needs, including wastewater disposal and collection, water treatment and supply, lake management, and solid waste management.”

There was no discussion on this appointment.

Outcome: Feinman’s appointment was made on a unanimous vote.

Public Hearings: Act 88, Veterans Relief Millages

The board held two hearings on July 9 related to millages that the county plans to levy later this year: (1) for support of indigent veterans and their families; and (2) to fund economic development and agricultural activities.

For support of indigent veterans, the county’s position is that it is authorized to collect up to 1/10th of a mill without seeking voter approval. That’s because the state legislation that enables the county to levy this type of tax – the Veterans Relief Fund Act, Public Act 214 of 1899 – predates the state’s Headlee Amendment. The county first began levying this millage in 2008, and collects the tax in December. Services are administered through the county’s department of veterans affairs.

Since 2008, the county board has slightly increased the rate that it levies each year. In 2012, the rate was 0.0286 mills – or 1/35th of a mill. It was raised to a rate of 1/30th of a mill in December 2013, to fund services in 2014.

The current proposal is to levy 1/27th of a mill in December 2014, which is expected to raise about $540,887 in revenues for use in 2015.

No increase is proposed for the economic development millage, levied under Act 88 – another pre-Headlee law. The proposal is to levy 0.07 mills in December 2014, raising an estimated $1,022,276 in property tax revenues. In previous years, the resolution setting this millage has outlined how the revenues would be allocated. The largest allocations have gone to the county’s office of community & economic development, and to the nonprofit Ann Arbor SPARK.

However, at its Nov. 6, 2013 meeting, the board adopted a new policy for allocating Act 88 revenues, drafted by Conan Smith (D-District 9). [.pdf of Act 88 policy] The policy included creating an Act 88 advisory committee to make recommendations to the board and prepare an annual report that assesses how Act 88 expenditures have contributed toward progress of goals adopted by the board. The policy allows the committee to distribute up to 10% of annual Act 88 revenues without seeking board approval. The policy also allocates up to 30% of revenues to the county office of community & economic development, which administers Act 88 funding.

On July 9, only one person – Thomas Partridge – spoke at these public hearings. He endorsed the veterans relief millage, and questioned whether it would provide sufficient support for indigent veterans. He also questioned whether the amount levied under the Act 88 millage was sufficient for a county this size.

Outcome: This was not a voting item. A vote to levy these millages would be made at a future meeting.

Task Force on Homelessness

Commissioners were asked to accept the report and recommendations of a task force that’s been working on a funding strategy to help end homelessness. The resolution also sunsets that task force.

The leadership group for the Task Force on Sustainable Revenues for Supportive Housing Services to End Homelessness made a presentation at the board’s May 22, 2014 working session. Their recommendations include the goal of building a $50 million endowment over 20 years. Payouts from the endowment would fund supportive services – such as treatment for mental illness and substance abuse – with the intent of addressing the root causes of homelessness. The concept is called permanent supportive housing, and is part of the community’s broader Blueprint to End Homelessness, which was created in 2004 and is being updated.

A possible millage – recommended at 0.25 mills, for no more than 20 years – would help fund supportive services while the endowment is built. County commissioners are being asked to consider putting such a millage on the ballot, possibly in 2015.

Several steps have already been taken to achieve these goals. An endowment was established in 2011, with $2.1 million in commitments so far. That amount includes a $1 million gift from the St. Joseph Mercy Health System to create the endowment, which is called the Sister Yvonne Gellise Fund for Supportive Services for Housing. Gellise is the former CEO of St. Joe’s. She served on the task force and is a founding board member of the Washtenaw Housing Alliance. Another $1 million commitment comes from the Ann Arbor Area Community Foundation (AAACF), where the endowment is housed. AAACF CEO Cheryl Elliott is another task force member. In addition, an anonymous donor has contributed $100,000.

The first fund distribution – of $26,100 – will be made this fall in a competitive grant process. AAACF’s distribution committee – an all-volunteer group – will be responsible for making grant recommendations.

AAACF is also helping provide a three-year, part-time development job to support fundraising for this endowment. Funding for the position will come from the Washtenaw Housing Alliance ($25,000), the AAACF ($5,000) and an anonymous donor ($10,000).

The foundation posted the position earlier this summer, with the intent of making a hire as soon as possible. The position would be in place until at least mid-2017. The employee will report to AAACF’s vice president for development and donor services, and to the Sister Yvonne Gellise Fund development committee. Members of that committee are the same people who’ve served on the leadership team of the task force, Elliott said. In addition to herself, members include Bob Chapman, Sister Yvonne Gellise, Bob Guenzel, Norm Herbert and Dave Lutton.

There was no discussion on this item at the July 9 meeting.

Outcome: Commissioners unanimously voted to accept the report and sunset the task force.

Public Health Accreditation

Miller thanked commissioners and staff, including county health officer Ellen Rabinowitz and retired health officer Dick Fleece, who both attended the July 9 meeting. Miller presented certificates of accreditation, and praised the achievement. It’s the fifth cycle that Washtenaw County has completed, passing stringent standards in the accreditation program, he said. The standards are hard to meet, Miller added, especially when budgets are tight.

Ten program areas were reviewed, and of 140 indicators, the Washtenaw County health department only missed one, Miller reported. “I don’t get to go to too many counties and get to say that – generally, [other counties] miss quite a few more.” Washtenaw County eventually achieved 100%, he noted.

Washtenaw County also passed an optional quality improvement supplement, which only about half of the health departments in Michigan have achieved, Miller reported. It means the county has a comprehensive program for improvement.

“This performance is no fluke,” Miller told commissioners. The Washtenaw County health department maintains many partnerships, which allow it to leverage resources and provide better services for residents. That’s admirable, he said.

Miller highlighted several comments included in the accreditation report, including praise for the health department’s website and for support from county commissioners for initiatives like breastfeeding-friendly policies. He called out Sharon Sheldon, the program administrator for health promotion and disease prevention, for her unit’s work. Special recognition is deserved for the HIV/STD program, the report noted, because client return rates for HIV test results have exceeded 96%. Programs in hearing and vision care were also commended, as was the food safety unit, overseen by Kristen Schweighoefer, and several other programs. Miller also noted that Washtenaw County is a pioneer in trying to manage requests for vaccine waivers.

Miller concluded by saying the state was very impressed by the county health department’s efficient and innovative programs. “You guys have a really terrific health department here,” he said.

Board of Health

A resolution to create a board of health was originally on the board’s June 4, 2014 agenda for final approval, but was postponed until the July 9 meeting. The entity would provide advice on public health issues for the county. Commissioners had given initial approval to the item at their May 21, 2014 meeting.

A description of the board’s duties is outlined in a staff memo that accompanied the resolution:

The purpose and role of a Washtenaw County Board of Health will be to identify public health problems and concerns in the community, establish health priorities, and advise the Board of Commissioners and the Health Department on issues and possible solutions. The Board of Health will serve as advocates and educators for public health services and policies. The Board of Health will provide oversight and guidance to the Health Department, and will recommend a program of basic health services to the Board of Commissioners.

The new Board of Health will have the authority to hear appeals and requests for variances from the local public health and environmental regulations established under the Public Health Code. The Board of Health will have the authority to hear appeals regarding the suspension or revocation of food service licenses.

The resolution creating the health board also dissolves an existing environmental health code appeals board and the hearing board for the Health Department Food Service Regulation. The duties of those boards would be absorbed by the new health board. [.pdf of staff memo]

The recommended size is 10 members, including one ex-officio representative from the county board of commissioners. According to the staff memo, appointments could represent “health service delivery (physicians, dentists, mental health practitioners, administrators); environmental health and conservation, land use planning, food service and nutrition, academia, K-12 education, philanthropy, social service delivery, legal services, and consumers of public health services.”

Members would be compensated for attending each meeting. The total cost for the health board, including in-kind staff support, is estimated at $19,000 annually. The board of health would be expected to convene for the first time in October 2014.

Ellen Rabinowitz, the county’s public health officer, attended the July 9 meeting but did not formally address the board.

Board of Health: Board Discussion

Conan Smith (D-District 9), who had moved to postpone the resolution last month without explanation, told commissioners on July 9 that he had distributed three amendments to the board via email. All of them are making additions to the resolution, he said.

Smith noted that commissioners have talked about a board of health taking a leadership role in the county, coordinating public health responses across many agencies. He thought it was important for the board of health to think actively about its role as a coordinator, so one of his amendments included that sentiment in a whereas clause.

Smith also proposed adding two resolved clauses. One clause clarified the roles and expectations of the board of health, to do three things: (1) develop and oversee the strategic plan for the department of health; (2) recommend the annual budget to the county administrator; and (3) work with the county administrator to evaluate the performance of the county public health officer.

The second additional resolved clause is to ensure that the bylaws that will be developed for the board of health will be brought to the county board of commissioners for review and approval. “That’s the document that’s truly going to delegate any authorities that we have from this board,” Smith said.

There was no discussion on these amendments.

Outcome: Smith’s amendments were approved on a voice vote.

There was no additional discussion.

Outcome: On a 7-1 vote, commissioners approved creation of a board of health, over dissent from Rolland Sizemore Jr. (D-District 5). Andy LaBarre (D-District 7) was absent.

Later in the meeting, Ronnie Peterson (D-District 6) said that establishing the board of health is a major step in improving the health for residents of this community, especially children.

Communications & Commentary

During the July 9 meeting there were multiple opportunities for communications from the administration and commissioners, as well as public commentary. In addition to issues reported earlier in this article, here are some other highlights.

Felicia Brabec (D-District 4) reported that Susan McGraw has been hired as a consultant to work with the board on its budget priorities. That work will kick off later this month, she said.

Communications & Commentary: Taubman Fellowship

Yousef Rabhi (D-District 8) reported that he’d learned a lot earlier this summer at Harvard University’s Program for Senior Executives in State and Local Government at the John F. Kennedy School of Government. Ronnie Peterson (D-District 6) pointed out that Rabhi had received the Taubman Fellowship for Executive Excellence, which is given to selected officials and staff through the Southeast Michigan Council of Governments (SEMCOG). Peterson said that to be chosen for a fellowship is one of the highest recognitions that SEMCOG awards. “We should be honored to know that Washtenaw County and a Washtenaw County commissioner was selected,” Peterson said, joking “I just don’t know why they didn’t ask me.”

Board chair Yousef Rabhi (D-District 8) presented a proclamation honoring Arthur Williams, who is retiring as principal of Huron High School in Ann Arbor. [.pdf of Williams' proclamation]

Rabhi noted that he graduated from Huron High School “and Dr. Williams was my principal!” Williams was also a neighbor to Rabhi’s family as Rabhi grew up, so he knows Williams well. Williams has served as principal at Huron High since 1995.

Williams spoke briefly. As educators, he said, “we touch the future.” Many times they don’t know what the effects are of what they do in the schools, he added. Williams noted that Martin Luther King said everyone can be great, because everyone can serve. Williams said his goal has been to try to make this world a better place, by helping raise young people and families, and by trying to make an impact on lives.

He received a round of applause from commissioners and staff.

The board also made a proclamation to Mary Sue Coleman, who recently stepped down as president of the University of Michigan. Coleman did not attend the July 9 meeting.

Communications & Commentary: Proclamations – Ironworkers, UA

Mary Kerr, president of the Ann Arbor Visitors & Convention Bureau, was on hand to receive a proclamation welcoming the Ironworkers International annual instructor training program, which ran from July 12-18 this year. That program, held at Washtenaw Community College, brought in about 700 participants and an estimated economic impact of $2 million. It’s their fifth year holding the program in Washtenaw County. The board also gave a proclamation welcoming the United Association (UA) of plumbers and pipefitters for their 61st annual training program. For the past 25 years, that program has been held in Washtenaw County. [.pdf of UA proclamation]

This year, the program runs from Aug. 9-15, also on the WCC campus, bringing about 2,400 participants to the county with an estimated economic impact of $5 million.

Kerr noted that the county also hosts the training week for the National Joint Apprenticeship and Training Committee (NJATC) for the Electrical Industry. This year is a milestone for all three groups, she said. NJATC is in its 25th year and has been coming to Washtenaw County for six years. This year, the NJATC National Training Institute runs from July 26-Aug. 1 at the University of Michigan, and expects a 15% increase in participation compared to last year, Kerr reported.

Kerr said that a conservative economic impact estimate for all three programs is $12 million. “This is new spending in our community – spending that wouldn’t be here if these three training programs were not here,” she added. The spending is on hotels, restaurants, recreation, entertainment, shopping and transportation.

Her goal is to keep these events in Washtenaw County by providing a high level of service and making sure the unions know that they’re appreciated by the community. She thanked commissioners for their continued support.

Communications & Commentary: Proclamations – Gun Safety

The board passed a proclamation declaring July 20-26 as Gun Safety Week in Washtenaw County. [.pdf of gun safety resolution] The goal is to increase public safety “by raising awareness and educating residents of Washtenaw County about how to keep themselves and their families safe.”

During the week, local law enforcement agencies will be providing free gun locks and gun safety information. More information about the week is provided on the county’s website.

Speaking during public commentary, former Congressman Wes Vivian told commissioners that until four years ago, the U.S. had laws that prohibited or limited contributions by corporations to candidates for political office.

But four years ago, the U.S. Supreme Court overturned those laws in the Citizens United decision, he said. Now, “corporations are sloshing big money into our elections at all levels,” Vivian said. Polls show that about 90% of U.S. citizens oppose that Supreme Court decision. Furthermore, almost 20 state governments have asked the U.S. government to enact a constitutional amendment to overturn the Citizens United decision. “To date, the state of Michigan has not done so, even though it’s been asked to,” Vivian noted.

The Ann Arbor and Ypsilanti city councils have asked Michigan’s government to take action on this issue, Vivian said. But so far, the state legislature has refused to bring it up for a vote, he added. He asked the county board to place a proposal on the Nov. 4, 2014 ballot enabling Washtenaw County voters to ask the state to support a constitutional amendment to overturn Citizens United. He didn’t have suggested wording for such a ballot proposal, but said he’d be glad to work on it.

Yousef Rabhi (D-District 8), the board’s chair, thanked Vivian and said he hoped the board would take action of some sort at a later date. It was an issue about the sustainability of this nation’s democracy, he said.

Conan Smith (D-District 9) also thanked Vivian for raising this issue. The idea of corporate personhood has raised many challenges, he said, “and the notion that just regular citizens are somehow second class in our decision-making process has got to be pre-empted.” It’s incumbent upon elected officials and the county board as a body of elected officials to take a stand, he said. Smith liked the idea of asking county residents to weigh in, saying it would send a great signal to people throughout the state and nation.

Ruth Ann Jamnick also addressed the board during public commentary. She pointed out that she’s one of the four candidates in the Aug. 5 Democratic primary election for the District 5 seat on the county board. She provided a handout with information about her experience and accomplishments.

Referring to the board’s discussion about juvenile crime earlier in the evening, Jamnick noted that she had been involved in addressing similar issues years ago in Ypsilanti Township. What makes it different now are the ages of the young people who are involved, she said. At that time, it was youth in their late teens – but now, the youth who are creating these problems are younger. It’s important to make some changes and address these issues. She also noted that the situation isn’t isolated to Ypsilanti Township.

Jamnick concluded by thanking Rolland Sizemore Jr., the district’s current commissioner, for his work.

Earlier this year, Sizemore announced that he did not intend to seek re-election. In addition to Jamnick, the three other Democratic candidates are Victor Dobrin, Wilma Gold-Jones, and Keith P. Jason. The winner of that primary will face Republican Timothy King in the Nov. 4 general election. King is unopposed in the primary.

Thomas Partridge introduced himself as a recent candidate for the state legislature. He urged the public to elect Democrat Mark Schauer as governor in November, and to address the critical needs of affordable housing, public transportation, human rights and health care in Washtenaw County. Too many residents are vulnerable and don’t have the services they need, he said. He criticized the county board’s agenda for not including items that address ending homelessness, providing affordable housing and access to countywide public transportation, and supporting better health care and education for adults. These should be priorities for the board, he said.

County Parks Tax Renewal on Nov. Because of the state’s Headlee amendment, the rate that’s actually levied has been rolled back and is now 0.2352 mills. The current millage expires in December 2016.

If renewed again, it would generate an estimated $3.4 million annually – or about half of the parks & rec annual operating expenses. Other revenue sources are admission/gate/membership fees charged seasonally at facilities including the Meri Lou Murray recreation center, the water/spray parks, and the Pierce Lake golf course. Funding is also received from state and federal grants as well as private donations.

The county parks system receives most of its funding from two countywide millages. In addition to the operations millage, another millage pays for capital improvements and park development. It was also originally levied at 0.25 mills, but has been rolled back to 0.2367 mills.

In addition, a third millage – levied at 0.25 mills but rolled back to 0.2409 mills – funds natural areas preservation, bringing in about $3 million annually. It was first approved by voters in 2000, and renewed for another 10 years in 2010.

The county’s parks & recreation department is overseen by a separate entity – the parks & recreation commission – whose members are appointed by the county board. The county board has the authority to put a parks millage proposal on the ballot, but does not authorize expenditure of the funds. That responsibility rests with the parks & recreation commission. The group meets monthly at the parks & recreation office at County Farm Park, and its meetings are open to the public.

Regarding the June 4 vote to set the 2014 millage rate, this is an annual process that includes a public hearing, which was also held on June 4. One person – Thomas Partridge – spoke, advocating for more resources to provide services for the county’s most vulnerable residents.

Several other county millages are levied separately: emergency communications (0.2000 mills), the Huron Clinton Metroparks Authority (0.2146 mills), two for county parks and recreation (for operations at 0.2353 mills and capital improvements at 0.2367 mills) and for the natural areas preservation program (0.2409 mills). That brings the total county millage rate levied in July to 5.6768 mills, a rate that’s also unchanged from 2013. This is a mandatory procedural action, not a vote to levy new taxes. With a few minor exceptions, the county board does not have authority to levy taxes independently. Millage increases, new millages or an action to reset a millage at its original rate (known as a Headlee override) would require voter approval.

The rates will be included on the July tax bills for property owners in Washtenaw County.

The vote on levying a millage was 2-6, with support only from Dan Smith (R-District 2) and Conan Smith (D-District 9). Alicia Ping (R-District 3) was absent. The tax would have been levied under Act 283 of 1909, which does not require voter approval.

Several commissioners spoke against levying this kind of tax at this time. Andy LaBarre (D-District 7) advocated for waiting to see whether the state provides more funding for roads. Ronnie Peterson (D-District 6) reported that the boards of Willow Run and Ypsilanti public schools are considering levying tax increases this summer of 2.8 mills and 1.2 mills, respectively. The state passed legislation that enables school districts to levy millages for debt retirement without voter approval. Noting that a new public transit millage had been approved by voters earlier this month – in Ypsilanti, Ypsilanti Township and Ann Arbor – Peterson said the communities that he represents would be hard-pressed to handle yet another tax increase.

Dan Smith argued that there are few funding options available to the county to pay for road repair, and that the need for additional revenues is critical because the roads are in such bad shape. He said he was well aware of the reasons why this was a bad plan – even a terrible one – but added that the only thing worse would be to do nothing. Conan Smith pointed out that because all of the board seats are up for election this year, residents will have a way to weigh in on this decision, albeit indirectly. “This is the most defensible moment that we have” to levy a tax that doesn’t require voter approval, he said.

The May 21 meeting also included a public hearing on the possible levy. And the board heard from people on the topic during general public commentary. In total, seven people spoke about the road funding issue. Former county commissioner Barbara Bergman, who is an Ann Arbor resident, argued against levying the tax, while former state Rep. Rick Olson of York Township urged commissioners to levy the full 1-mill amount allowed under Act 283. Another resident argued against any tax that isn’t approved by voters, calling it taxation without representation.

After the tax levy resolution was rejected, Yousef Rabhi (D-District 8) brought forward a resolution to create a seven-member road funding committee that would explore options – including Act 283, as well as other possible revenue sources like bonding or a voter-approved tax. The initial vote to form the committee passed on a 6-2 split, over dissent from Conan Smith and Dan Smith. A final vote is expected on June 4. If approved, members would be appointed at a later date, with the direction to provide a road funding plan to the board in the fall.

Commissioners also weighed in to oppose oil exploration and drilling in the county, prompted by a company’s permit application to the state to drill in Scio Township. The vote was 7-1, over dissent from Dan Smith. Two residents spoke during public commentary,urging the board to oppose oil drilling.

During deliberations, Dan Smith argued that the issue was outside of the county’s purview, because the county can’t regulate oil drilling. He noted that the easiest way to prevent oil drilling is for property owners not to sign leases with companies that seek to drill on their land. Other commissioners supported the resolution, citing environmental and public health concerns, including the proposed drilling location’s proximity to the Huron River.

In other action on May 21, commissioners took initial steps to: (1) put a 10-year countywide parks and recreation operations tax renewal on the Nov. 4 ballot, at 0.2353 mills; (2) create a board of health that would give advice on public health issues; and (3) approve an application for a $940,000 federal grant that the county would make on behalf of Ann Arbor SPARK, the local economic development agency. Funds would be used to help redevelop the former General Motors Willow Run Powertrain plant in Ypsilanti Township for use as a connected vehicle testing facility.

Given final approval on May 21 was this year’s allocation to local nonprofits through the coordinated funding process, in which the county participates.

The board also approved a process that will determine how the $3.9 million budget surplus from 2013 will be allocated. Conan Smith said he felt “personally let down” by the approach, because the county administrator has already recommended to keep that amount in the general fund’s unearmarked reserves. He thought it was “turning out to be little more than a rubber stamp of a decision that’s already been proposed by the administration.” Felicia Brabec (D-District 4), who’s leading this process, stressed that commissioners will be discussing and making the final decision – which might differ from the administration’s recommendation.

Road Tax

The May 21 agenda included a proposal to levy a 0.4-mill countywide road tax in December. The tax could be levied under Act 283 of 1909, which does not require voter approval. The board also held a public hearing on the issue, and heard from several people during public commentary.

Prompted in part by what many view as a chronic underfunding of roads in Michigan – combined with a particularly harsh winter – county commissioners have been discussing for months how to generate more revenues to repair the county’s road network.

At the board’s May 7, 2014 meeting, Dan Smith (R-District 2) brought forward a resolution that would have authorized a 1-mill tax to be levied December 2014 – under Act 283. A 1-mill tax would generate $14.34 million “to repair 2013–14 winter damage to the roads, streets and paths in Washtenaw County.”

On May 7, the board debated the issue at length but ultimately voted to postpone the resolution until May 21 over dissent from Alicia Ping (R-District 3).

On May 21, Dan Smith brought forward a revised resolution that addressed some concerns raised by corporation counsel Curtis Hedger during the May 7 meeting. The new resolution proposed an 0.4-mill levy and included a list of specific projects that the tax revenues would fund. [.pdf of May 21 resolution]

The resolved clauses stated:

NOW THEREFORE, BE IT RESOLVED that pursuant to the authorization of Public Act 283 of 1909 (MCLA 224.20), the Washtenaw County Board of Commissioners approves a millage of 0.4 mills to be levied against all real property in the County, which will generate approximately $5,—,— to be collected in December, 2014, for use in calendar years 2014 and 2015 to keep existing Washtenaw County public roads, streets, paths, bridges and culverts in reasonable repair, and in condition reasonably safe and fit for public travel; and that this levy be exempt from capture by TIF Districts or TIFAs to the greatest extent allowed by law.

FURTHERMORE, BE IT RESOLVED that the Washtenaw County Board of Commissioners agrees with Washtenaw County Road Commission’s initial determination, as attached hereto and made a part hereof, and levies said millage for the purposes therein.

FURTHERMORE, BE IT RESOLVED that the Washtenaw County Board of Road Commissioners is invited to present a revised determination in accordance with Act 283 of 1909 to the Board of Commissioners at its annual meeting on September 17, 2014 for an additional levy not to exceed 0.6 mills.

FURTHERMORE, BE IT RESOLVED that Washtenaw County Corporation Counsel is directed to provide an exhaustive formal written opinion, by September 17, 2014, which clearly and convincingly details the exact mechanism under which Act 283 of 1909 taxes may be levied in excess of Article IX, Section 6 constitutional limits without a vote of the people; and that the Washtenaw County Board of Commissioners waives any attorney/client privilege concerning this opinion.

FURTHERMORE, BE IT RESOLVED that the Washtenaw County Board of Commissioners asks the county’s legislative delegation, State Senators Randy Richardville and Rebekah Warren and State Representatives Gretchen Driskell, Jeff Irwin, David Rutledge and Adam Zemke, to request an Attorney General opinion regarding the ability for counties to levy a tax under Act 283 of 1909 in excess of Article IX, Section 6 constitutional limits without a vote of the people.

Road Tax: Public Commentary

During the first opportunity for public commentary – at the board’s ways & means committee meeting – committee chair Felicia Brabec (D-District 4) announced that the device used to time the speaking turns was broken. Instead, time would be marked by holding up handwritten cards, she said.

Former county commissioner Barbara Bergman – a Democrat from Ann Arbor – urged commissioners not to levy a tax for roads. If they do, they’re sending a message to Lansing “that we are rich enough to take care of ourselves,” she said, and that the state doesn’t need to help meet the needs of its vulnerable citizens. But this is patently untrue, she said. There are huge unmet needs in Washtenaw County – for food, shelter, services for children and for adults who are returning to the community after incarceration.

Beyond the ethical considerations, Bergman said, the county doesn’t need to do this because “roads have very loud voices.” Officials at the local and state levels want to be re-elected, she noted, and she bet that funds could be found to repair the roads to ensure that motorists are happy. One way is for state legislators to adopt an equitable, progressive tax code for Michigan, she said. If that doesn’t happen, then local millages should be used to support those who are often invisible, she said. Mental health funds are about to be cut 30%, she noted, which means that services for 240 customers of the county’s Community Support & Treatment Services (CSTS) will be cut. Affordable housing and health insurance are also needed, Bergman said. “A millage to meet human services needs could pass a test with ethics,” she said. “A millage for roads cannot.”

Thomas Partridge spoke generally about the need to support the county’s most vulnerable, including affordable housing, public transportation, education and health care. Everyone needs adequate roads, he added, and if it’s left to Lansing, “we are left with potholes.” He also supported a progressive tax to generate more funds for local governments.

Rick Olson introduced himself as a York Township resident and former state representative of District 55. In 2011 he became very interested in transportation, he said, and generated a report on how much money would need to be spent to repair Michigan’s roads and bridges – $1.4 billion at that time. That was a figure used by the governor’s workgroup on infrastructure, on which Olson served. It led to a series of bipartisan bills that were introduced in January 2012, with the idea that $1.2 billion would be raised at the state level, he said, and the remainder raised through an optional county vehicle registration fee. Unfortunately, Olson said, the legislation wasn’t enacted. He said the amount needed has now been updated to just under $2.4 billion. Even if the legislature comes up with additional funding for roads, it likely won’t be enough, he said. Olson told commissioners that the county needs to invest a considerable amount, in addition to whatever the legislature does. He fully supported an Act 283 millage at the full 1-mill level.

A man who didn’t give his name said he opposed the road millage, especially if it were levied without a public vote. “Citing some law from 1909 doesn’t change the fact that this is taxation without representation,” he said. He told commissioners that 40% of county residents aren’t property owners, and wouldn’t pay the tax. “So once again, government is picking on a select group of people to pay for the benefit of all,” he said. “There is no word to describe this other than unfair.” Washtenaw County already has the highest average property tax in Michigan, he said. Prices are increasing, and people have to adjust their budgets accordingly. “We don’t have a golden pocket to reach into.” Yet government feels entitled to take more from its residents. He said he’s tired of his government telling him what they’re going to take, instead of listening to him tell them what they can have. “So I will organize, I will educate, I will motivate, and I will vote,” he said, so that government will be accountable for its budget and debts, just as the government holds him accountable.

Jim Bates of Ann Arbor Township asked if it would be possible for the county to assess a gas tax. He said he was just curious about that. [In Michigan, county governments don't have authority to levy a gas tax.]

Victor Dobrin said he’s been an Ypsilanti Township resident 23 years. [Dobrin is also a candidate for the District 5 seat on the county board.] The proposed road millage isn’t popular, he said. Government doesn’t always do what’s popular, but they look for the common good. He respected Olson’s opinion, however he thinks that solving any problem in society begins by defining the root cause. Government should take an engineering approach to problem solving. What is the root cause? Why are our roads crumbling? Is the proper work being done when roads are constructed or fixed? He noted that right now, you can see workers throwing shovels of asphalt into potholes, but that’s not going to solve the problem. It will result in wasting lots of money. The root cause is in the way that roads are engineered and built, he said.

Road Tax: Board Discussion

Andy LaBarre (D-District 7) responded to public commentary by thanking Barbara Bergman, noting that her comments reflect his own opinion. He also said the issue isn’t one of taxation without representation, as residents are represented by the county commissioners.

Rolland Sizemore Jr. (D-District 5) said he wouldn’t support a road tax. About a year ago, he said, he and Ken Schwartz – who was then a road commissioner – tried to get a group together to work on this issue, but Sizemore didn’t think that had happened. So he didn’t think enough work went into the current proposal, and he’d like to take more time to work on it.

Dan Smith (R-District 2) told commissioners he had modified his original resolution to address concerns that the county’s corporation counsel, Curtis Hedger, had laid out in a confidential memo to the board. The proposed millage is now 0.4 mills, rather than the full 1 mill. The resolution includes a list of proposed projects, and notes that this process is starting earlier than the board’s annual meeting because of the harsh winter.

Smith then formally withdrew his earlier resolution from May 7, and moved the new modified resolution for consideration.

Yousef Rabhi (D-District 8) thanked Smith for his work on this proposal. LaBarre echoed that thanks, but said he wanted to wait a bit to see what the state legislature does regarding road funding. The process required by Act 283 gives the board some breathing room, he said, “and hopefully it’s a moot issue.”

Kent Martinez-Kratz (D-District 1) agreed with Sizemore that the issue needed to be studied further. More funding is expected from the state, and a community in his district – Scio Township – recently approved a special assessment for roads, he noted. If the county levies a road tax, it would be a bit hard on those taxpayers, he added.

Martinez-Kratz wondered if Hedger had time to review Smith’s new resolution, to see if there were any concerns. Based on the previous memo from Hedger, levying an Act 283 millage wasn’t legal, Martinez-Kratz said. [The memo from Hedger was not released to the public.]

Regarding the list of projects from the road commission, Martinez-Kratz said not all communities would get funding, so some of his constituents think that’s inequitable.

Sizemore said that as the board’s liaison to the road commission, he’d be happy to work with county commissioners and road commissioners to come up with a plan. He didn’t think they could count on the state.

Ronnie Peterson (D-District 6) reminded the public that this effort was driven by the road commission, not by the county board – though he noted that Dan Smith has been an advocate for road funding.

Peterson said all local communities have the ability to address these road issues, and he wanted to work with communities within the county to help address their needs. But it’s the road commission that has responsibility, he said.

There isn’t any urgency to levy a tax now, Peterson continued. The board needs to be patient and see what comes out of Lansing, he said.

Peterson also noted that Ypsilanti and Ypsilanti Township, which he represents, already have high taxes. What’s more, the boards of Willow Run and Ypsilanti public schools are considering levying tax increases this summer of 2.8 mills and 1.2 mills, respectively. The state passed legislation that enables school districts to levy millages for capital improvement debt retirement without voter approval – which Peterson called a ridiculous law.

In addition, Ypsilanti and Ypsilanti Township will have another new millage, along with Ann Arbor, that was passed by voters earlier in May for public transit. In total, it’s “a huge increase in new taxes,” Peterson said. “And believe me – I’m no rock star conservative on taxes. I believe you pay for what you get.” However, Peterson said the communities that he represents – Ypsilanti, Ypsilanti Township and Superior Township – would be hard-pressed to handle yet another tax increase for roads.

Peterson indicated that he’d be interested in exploring the option of bonding to fund roads.

Dan Smith argued that there are few funding options available to the county to pay for road repair, and that the need for additional revenues is critical because the roads are in such bad shape. The proposed millage is only for 0.4 mills, he stressed – not the full 1 mill.

The easiest option is to do nothing, Smith said – to do more studies and plans, or wait for Lansing. “The reality is that the roads are terrible,” he said. Even if Lansing provides more funding – and he wasn’t hopeful about that – it won’t be enough for Washtenaw County. Smith pointed out that this would be an annual levy, and if there’s no need for it in 2015, the county wouldn’t levy it.

Smith also noted that the millage is tied to the road commission’s plan, which is similar to one that the road commission brought forward in the fall of 2013. There’s nothing surprising about it, he said.

Many communities don’t have the taxing ability to pay for maintenance of the county’s major roads that run through their jurisdiction, Smith said. The best example is the six miles of Austin Road in Bridgewater Township. It’s a major road in a township with the lowest taxable values in the county. So some communities just don’t have the capacity to deal with these major roads, he said.

Smith also didn’t think it was fair to require, for example, Northfield Township, Webster Township and Ann Arbor Township to take care of roads like Newport, North Territorial and Pontiac Trail – “roads that the much broader community uses,” he said. Some of these roads, like Newport, cross multiple jurisdictions. For these reasons, major roads should be taken care of by the county, Smith argued.

“This is a bad plan, for lots and lots of reasons,” Smith continued. “I would even say it might even be a terrible plan. The only thing that might be worse than this bad plan is to continue doing what we’ve been doing, which is absolutely nothing. The roads are crumbling underneath us.” There will not be a perfect plan, no matter how long they talk about it, he said.

There are two problems with a voter-approved levy, Smith said. First, it wouldn’t be on the ballot until November. Second, it would likely be for a larger amount and a longer period – like a half-mill for four years or more. The other problem is one that Conan Smith had raised during the May 7 discussion, Dan Smith noted – competing interests for millages that might go on the ballot. He pointed out that the parks & recreation operations millage renewal will be on the November 2014 ballot. Former commissioner Barbara Bergman had mentioned other possibilities for millages, he noted, such as funding for human services.

An Act 283 millage would be at a lower rate for only one year, Smith said. Even though he didn’t like it, “it is the least-bad option I think we have right now.”

Sizemore expressed frustration at not doing anything, then proposed sitting down with road commissioners and managing director Roy Townsend to figure out what to do.

Martinez-Kratz replied to Smith’s comments, saying that if it’s a bad or even terrible plan, then “it’s not worth spending taxpayers’ money on.”

Peterson asked if communities would have the ability to opt-out of an Act 283 levy. Hedger replied that there is no opt-out option.

Peterson then asked if any other local leaders – from city councils or township boards – had contacted the county in support of an Act 283 millage. He felt that if other elected officials were supportive, they’d be there tonight. All of the communication he’d received was urging him not to support an Act 283 millage, Peterson said. It’s difficult for him, especially during an election year, to take responsibility for a road tax when other elected officials aren’t also supporting it.

Conan Smith (D-District 9) asked how short the road commission was in terms of funding related to winter road maintenance. Townsend replied that the county had received some additional funding from the state to cover some of the winter overages, like salt usage, diesel fuel and overtime costs. “But what they didn’t really give us money for is to fix the roads,” he said.

Road conditions have continued to decline, Townsend said. He pointed to a handout he’d provided to commissioners, showing that Michigan ranks last among all 50 states in state highway expenditures per capita. The data was from 2011, but since then the state hasn’t increased its funding, he noted. Most states are putting in at least double the amount of per-capita funding for roads. For example, Pennsylvania’s per-capita spending was $557 compared to $135 in Michigan.

Townsend said the county’s infrastructure was in poor condition prior to this harsh winter, with deep freezes and thaws that made things even worse. Generally, the road commission uses about 400 tons of cold patch. This year, the commission used 1,400 tons – enough to fill about 300,000 potholes. These are temporary fixes, Townsend said.

Some of the projects on the plan that the road commission has presented to the board this year have been on previous plans presented since 2011, Townsend said – like work on North Territorial and Scio Church roads, among others. The plan would improve 44 miles of road, used by over 100,000 people every day. “So I think 100,000 people would probably appreciate that you could fix those 44 miles of road,” he said. The tax for an average $200,000 home would be just $40, he noted.

Townsend said that any state legislative action likely wouldn’t result in funding until 2015, so the roads would go through another winter. “And god help us what it’s going to look like next spring,” he said. There’s a short window for construction, he noted.

Conan Smith (D-District 9) said the upshot is that the roads are terrible, and they won’t get better as the county waits for legislative action from Lansing or for voters to weigh in this November. There’s an opportunity now, he said, with only a modest hit to taxpayers and an immediate benefit to the community.

C. Smith also responded to the public commentary about taxation without representation. That phrase emerged in a different context, he said. The people are represented in this process, he noted. The elected county commissioners have a duty to represent the interests of their constituents, to listen carefully to their needs. “This is a representative process by design,” he said.

Regarding the road tax issue, both sides have been well-articulated, C. Smith said. If there’s any time to do something like this without a vote of the people, it’s now – just a short time before an election. Because all of the board seats are up for election this year, Smith said, residents will have a way to weigh in on this decision, albeit indirectly. “This is the most defensible moment that we have” to levy a tax that doesn’t require voter approval, he said.

Felicia Brabec (D-District 4) spoke next, noting that the levy couldn’t occur until December, so there’s time to figure out what their other options are. She wants to take that time.

C. Smith asked Townsend how the finances would work with an Act 283 tax. Townsend explained that the road commission would want some kind of contractual agreement with the county before it bid out work this summer. It would be similar to how townships contract with the road commission, and then later reimburse the road commission for the work. It’s a legal question to be determined if Act 283 funds can be used for reimbursement, Townsend noted.

Dan Smith made a distinction between “funding” and “financing.” The funding mechanism would be through Act 283. If the board passed the road tax resolution that night, it would be a commitment to provide that funding when the tax is levied in December.

At this point, Dan Smith distributed another resolution – dated Oct. 15, 2014. According to Hedger, the board’s official vote to levy an Act 283 tax must occur in the fall, Smith noted. The draft resolution he distributed would ratify the funding decision regarding the 0.4 mills. The draft resolution also would give the board the option of levying an additional 0.6 mills. These decisions about funding are separate from how the county actually handles the financing, D. Smith explained. Sometimes the county issues tax anticipation notes – that’s what this would be, he said. There might be other options, like using the general fund’s fund balance or short-term borrowing. But the funding would still come through the Act 283 levy in December.

D. Smith also addressed Peterson’s comments about the lack of any other local leaders at the May 21 meeting. He said that one reason is because townships have no authority or responsibility for roads. It’s the county board that has the tools for funding and fixing the roads countywide. He acknowledged that some townships have been very aggressive in their road programs, and some municipalities have vastly better roads as a result.

At this point, Rabhi called the question – a procedural move designed to end discussion and move toward a vote. Commissioners unanimously approved calling the question.

Outcome on main resolution to levy an 0.4-mill tax under Act 283: The resolution failed on a 2-6 vote, with support only from Dan Smith and Conan Smith. Alicia Ping was absent.

Road Tax: Roads Funding Committee

Yousef Rabhi then proposed a resolution to create a roads funding committee. He read aloud the resolution that he’d written by hand during the previous deliberations.

The committee would consist of seven members: (1) a road commissioner or designee; (2) the road commission managing director or designee; (3) the county board’s road commission liaison; (4) one additional county commissioner; (5) a position representing townships; (6) a position representing incorporated municipalities; and (7) a member of the general public.

The county administrator would help provide administrative support to the committee. The resolution also stated that the road commission could present a road funding plan at the board’s annual meeting in the fall “as Act 283 of 1909 provides.”

Conan Smith said he appreciated the sentiment, but wouldn’t support it. The board just received recommendations from a previous committee that had worked on road commission issues, he noted – that happened on May 7, 2014. He noted that leaders of local government “made it abundantly clear at that point that they don’t think the county board of commissioners had a role to play in their road funding situation.”

There was a specific opportunity this year to intervene in funding, C. Smith said, because of the harsh winter. But he didn’t believe that road maintenance should be a higher priority than other things, like public safety, human services, public health and environmental health.

The board had just voted not to get involved by not levying an Act 283 tax, he said. “I think that should be the end of the conversation.”

Ronnie Peterson asked for an explanation about what the board had just voted on, and what Rabhi had subsequently proposed. Felicia Brabec explained that the board had rejected a resolution to levy the Act 283 tax. Now they were considering a proposal to form a road funding committee. Peterson said he just wanted the public to be clear about what had happened.

Andy LaBarre said that to him, the Act 283 issue was one of timing. None of these options are good, he added: “We’re choosing to pursue bad or less bad.” He felt the state legislature had the potential to shock everyone and do something proactive. If that doesn’t happen, it would be possible to consider the Act 283 levy this fall, he noted. If they do eventually levy the millage, it would help but wouldn’t be a comprehensive solution, LaBarre said.

Dan Smith noted that there are few mechanisms available for road funding – either levy a property tax under Act 283, or take a bond or millage proposal to the voters. The county can’t institute a gas tax or vehicle registration fee, he said. The board can spend the next six months talking about their options, but “barring some extraordinary action from Lansing, our options in six months are going to be exactly what they are now,” D. Smith said. And levying Act 283 in the fall “isn’t going to be any nicer than it is right now.”

Clearly frustrated, D. Smith said that instead of acting, the board is doing what government always does – forming yet another committee to study it more. The issue has already been studied, he said. “Nobody wants to touch this hot potato.”

Conan Smith observed that the county could issue general obligation bonds, which wouldn’t require a voter referendum.

Peterson noted that levying Act 283 was difficult for him during an election cycle. He said he was progressive so he didn’t worry about winning over conservatives, but he was interested in saving people’s tax dollars. Citizens haven’t brought forward this proposal, he said, nor has the request come from local community leaders.

Outcome: The resolution creating a roads funding committee was given initial approval a 6-2 vote, over dissent from Dan Smith and Conan Smith. Alicia Ping was absent. A final vote is expected on June 4.

Road Tax: Public Hearing

Later in the evening – after the road tax resolution was defeated – the board held a public hearing on the issue, which had been set at the May 7 meeting. Two people spoke.

Thomas Partridge said it was important to find funding for road repair. No business wants to locate in a county that doesn’t maintain its roads. Voters need to be educated about the importance of this issue, as well as other concerns like affordable health care, public transportation, and affordable housing. The state legislature backs away from supporting these critical needs. Partridge supported Democrat Mark Schauer for governor, saying that Schauer would support these issues.

Sandra Carolan told commissioners that she pays the taxes for her parents’ property in Chelsea. She was thankful for the discussion, but she can’t ask her 91-year-old mother who’s on a fixed income to support an increased millage “for a solution that really is just a band-aid.” New technology needs to be used on the roads. She said if she goes to the store to buy a blouse and only finds bad blouses, she doesn’t buy one at all.

Parks Millage Renewal

Voters will be asked to renew a 10-year countywide parks and recreation operations millage in November. On May 21, commissioners were asked initial approval to put the request on the Nov. 4 ballot.

During the May 21 county board meeting, Bob Tetens – director of Washtenaw County parks & recreation – sat next to the daughter of county commissioner Felicia Brabec (D-District 4).

The operations millage was first authorized by voters in November 1976 at 0.25 mills for a 10-year period and has been renewed three times. Because of the state’s Headlee amendment, the rate that’s actually levied has been rolled back and is now 0.2353 mills. The current millage expires in December 2016.

If renewed again, it would generate an estimated $3.2 million annually. That’s about half of the parks & recreation annual operating expenses of $6.7 million. Other revenue sources are admission/gate/membership fees charged seasonally at facilities including the Meri Lou Murray recreation center, the water/spray parks, and the Pierce Lake golf course. Funding is also received from state and federal grants as well as private donations. [.pdf of staff memo]

The county parks system receives most of its funding from two countywide millages. In addition to the operations millage, another millage pays for capital improvements and park development. It was also originally levied at 0.25 mills, but has been rolled back to 0.2367 mills.

In addition, a third millage – levied at 0.25 mills but rolled back to 0.2409 mills – funds natural areas preservation, bringing in about $3 million annually. It was first approved by voters in 2000, and renewed for another 10 years in 2010.

The county’s parks & recreation department is overseen by a separate entity – the parks & recreation commission – whose members are appointed by the county board. The county board has the authority to put a parks millage proposal on the ballot, but does not authorize expenditure of the funds. That responsibility rests with the parks & recreation commission. The group meets monthly at the parks & recreation office at County Farm Park, and its meetings are open to the public.

Comments were brief before the May 21 vote. Yousef Rabhi (D-District 8) said the parks staff do wonderful work. He thanked everyone who serves on the parks & recreation commission.

Outcome: Commissioners unanimously gave initial approval to put the millage renewal on the November ballot. A final vote is expected on June 4.

Board of Health

On May 21, commissioners were asked to take an initial step to create a board of health, an entity that would prove advice on public health issues for the county.

A description of the board’s duties is outlined in a staff memo that accompanied the May 21 resolution:

The purpose and role of a Washtenaw County Board of Health will be to identify public health problems and concerns in the community, establish health priorities, and advise the Board of Commissioners and the Health Department on issues and possible solutions. The Board of Health will serve as advocates and educators for public health services and policies. The Board of Health will provide oversight and guidance to the Health Department, and will recommend a program of basic health services to the Board of Commissioners.

The new Board of Health will have the authority to hear appeals and requests for variances from the local public health and environmental regulations established under the Public Health Code. The Board of Health will have the authority to hear appeals regarding the suspension or revocation of food service licenses.

The resolution creating the health board also dissolves an existing existing environmental health code appeals board and the hearing board for the Health Department Food Service Regulation. The duties of those boards would be absorbed by the new health board. [.pdf of staff memo]

The recommended size is 10 members, including one ex-officio representative from the county board of commissioners. According to the staff memo, appointments could represent “health service delivery (physicians, dentists, mental health practitioners, administrators); environmental health and conservation, land use planning, food service and nutrition, academia, K-12 education, philanthropy, social service delivery, legal services, and consumers of public health services.”

Members would be compensated for attending each meeting. The total cost for the health board, including in-kind staff support, is estimated at $19,000 annually. The board of health would be expected to convene for the first time in October 2014.

Ellen Rabinowitz, the county’s public health officer, attended the May 21 meeting but did not formally address the board. There was no discussion on this item.

Outcome: Initial approval was given on a 7-1 vote, over dissent from Rolland Sizemore Jr. Alicia Ping was absent. A final vote is expected on June 4.

Oil Drilling

Commissioners considered a resolution to oppose oil exploration and drilling in the county. The resolution was brought forward by board chair Yousef Rabhi (D-District 8) of Ann Arbor, working with Kent Martinez-Kratz (D-District 1). Rabhi had alerted the board about his plans at the previous meeting on May 7. He said he’d met with residents from the west side of the county about the threat of oil extraction. West Bay Exploration has applied to the state for a drilling permit in Scio Township, and residents are afraid that the state will grant the permit.

The two resolved clauses state:

BE IT THEREFORE RESOLVED, that Washtenaw County, Michigan:

1. Opposes said oil exploration and drilling, and any future oil exploration and drilling in this area and other areas within the boundaries of Washtenaw County; and

2. Respectfully requests that the Michigan Supervisor of Wells, as part of the Michigan Department of Environmental Quality, deny the permit application to drill the Wing 1-15 well as proposed; and

3. Hereby requests that the State of Michigan and federal legislators move to enact legislation and improve regulations to reduce the risks to public health, safety, welfare and the environment posed by the oil and gas industry, and re-commit to promoting and protecting quality of life, our economic well-being, and our environment through less reliance on non-renewable energy resources.

BE IT FURTHER RESOLVED, a copy of this resolution shall be transmitted as the County’s official comment on said oil drilling permit and application by the Clerk, to each elected official representing Washtenaw County in Lansing, the Office of the Governor, and the Michigan Department of Environmental Quality.

At its May 19, 2014 meeting, the Ann Arbor city council approved a similar resolution opposing oil exploration in Scio Township.

Oil Drilling: Public Commentary

Two people spoke on the topic during public commentary. Gus Teschke from the advocacy group Citizens for Oil-Free Backyards thanked Yousef Rabhi and Kent Martinez-Kratz for their work on the resolution opposing oil exploration and drilling in Washtenaw County. Citizens for Oil-Free Backyards was formed because of a proposed well at Miller and West Delhi, he said. If the company finds oil, then there could be a lot of oil wells in that area. That could impact individual residential wells as well as the Huron River, which provides 85% of Ann Arbor’s drinking water. Accidents can happen, and people are concerned about that, he said. About 1,200 people live within a mile of the proposed oil well, and are concerned about their health, noise and other issues. He hoped commissioners would support the resolution.

During the final opportunity for public commentary, Brian Herron introduced himself as a business owner in Ann Arbor and resident of Scio Township. Residents there find it very concerning that there’s a proposal to drill so close to residential properties. The proposed drilling would be less than a mile from the Huron River, he noted. It seemed inappropriate to allow drilling in a residential area. It doesn’t make sense, and he urged commissioners to support the resolution that opposes drilling.

Oil Drilling: Board Discussion

Yousef Rabhi (D-District 8) said that for him, this is a fundamental issue of protecting the environment in Washtenaw County, making sure the air, water and soil stayed healthy for generations to come. It’s time to take a stand, even though the county doesn’t have the ability to stop it outright, he said.

Ronnie Peterson (D-District 6) said he normally supports economic development so that residents have opportunities for jobs. But he’s in total opposition to drilling in this county. He wondered if there were any supporters of drilling at that night’s meeting, or any company representatives to talk about how the county would benefit from drilling. [No one came forward.] It seemed like they’d want to present their case to the public, he said.

Kent Martinez-Kratz (D-District 1), who represents an area that includes Scio Township, said he had attended a public forum about the proposed drilling. Someone had suggested being proactive regarding oil rights, rather than waiting for oil companies to secure them. He liked the idea, which entails having a community group purchase the oil rights and hold them in trust.

Felicia Brabec (D-District 4) said she’d visited the Irish Hills area near Jackson, where there’s been an increase in oil exploration. So she’s seen firsthand the economic, health and environmental impacts on a community. It’s very harmful, she said, and people there were distraught. It’s also frustrating, she added, because communities have little recourse and authority over these issues.

Andy LaBarre (D-District 7) characterized it as “a total NIMBY issue.” The problem is that no one in Lansing will listen to this resolution, he said, but he supported it. They also need to find ways to communicate with the state legislature, which he said has robbed local communities of their ability to make decisions regarding oil drilling.

Rabhi agreed that the issue was one of local control – and not just for oil drilling, but also for natural gas extraction. That’s the campaign that needs to be waged, he said. “We need legislators who respect local control.” The state should set a baseline standard for environmental health, but each community should have the right to set even stricter standards for cleaner air, water and other aspects of the environment, he said.

Martinez-Kratz agreed that it might be a NIMBY issue, but he argued that almost anything could be called NIMBY – like zoning and noise ordinances. The drilling proposal to him is alarming because it’s within a mile of the tributary that leads to Ann Arbor’s drinking water supply. He pointed to the 2010 oil spill in the Kalamazoo River that’s still not completely cleaned up. Even though there’s very little that the county government can do about this proposal, the board needs to take a stand, he said.

Dan Smith (R-District 2) opposed the resolution, noting that it does nothing and addresses an issue that’s outside of the board’s purview. The law is extraordinarily clear, he noted – that a county can’t control or regulate drilling. They might all wish that it was within their purview, and the concerns about drilling are valid, he said. “I certainly don’t want an oil well in my backyard either.” Concerns over environmental impacts are legitimate too. “Unfortunately, the oil is where it is, and there’s nothing any of us can do to move where the oil is located,” he said.

Smith said the oil has been untouched for years, but has finally become economically feasible to extract. That’s unfortunate, but it’s not under the county’s control, he stressed. There’s a very simple way to shut down all the drilling in the county, Smith added. “The property owners can simply refuse to lease their land to the oil companies. Problem solved.” But these property owners have signed leases with oil companies, and are getting money for that, he noted. They can put that money toward paying for their house, or a college education, or buying things or going out to eat. So there’s an economic benefit to Washtenaw County in that way, Smith said.

Smith reported that he’s recently heard about a Michigan chapter of a national service organization that had received over $500,000 annually from oil revenues, which in turn support local programs. This is an extremely complicated issue, he said, with lots of pros and cons. If commissioners don’t like the current law, they can take their case to Lansing, Smith added. There are six state legislators representing Washtenaw County, he added, including some that are “extraordinary close to members of this body.” [That was a reference to state Sen. Rebekah Warren, who is married to commissioner Conan Smith.]

D. Smith said he didn’t vote against a similar resolution opposing a mineral mining proposal in Lyndon Township, because the county parks & recreation commission is interested purchasing that property – so there was an option that the county could pursue. [Smith stated "present" during that vote, which took place on March 19, 2014.]

But in this case, the resolution serves no purpose and wastes and extraordinary amount of time, D. Smith said. “I really wish we would stop campaigning from the board table,” he concluded, saying there are much more effective ways to advocate for change.

Andy LaBarre (D-District 7) noted that Smith had been remarkably consistent in his position regarding these kinds of resolutions, which don’t have the force of law. Given that track record, it would be great to have Smith on board with this resolution, LaBarre said. “I think it would add an extra amount of credence to this.” It’s an issue of significance that they can all find ways to dislike, he said, and to express their displeasure. He hoped Smith would consider bending on this.

Rabhi also thanked Smith for his consistency, noting that Smith’s opposition wasn’t about the content of the issue, but rather about the county’s purview. But Rabhi said he had no problem campaigning from the board table, adding that he was campaigning for public health, the environment, and the welfare of county residents. He thought the county did have a role to play, as local governments are allowed to submit comments through the MDEQ’s public process. “It’s not for political gain – it’s for the community,” Rabhi said.

Outcome: The resolution passed on a 6-1 vote, over dissent from Dan Smith. Alicia Ping was absent, and Rolland Sizemore Jr. was not in the room when the vote was taken.

2014 Budget Calendar

The board considered a resolution setting a timeline for budget work in 2014. [.pdf of budget calendar resolution] Highlights are:

  • July 24, 2013: Board approved budget priorities. (That document was subsequently amended on Aug. 7, 2013.)
  • May 7, 2014: Board authorized county administrator to seek consultant for work on budget priorities. The review and selection process for that consultant is underway.
  • June 5, 2014: Budget discussion on the board’s working session agenda, to discuss the status of any general fund surplus or shortfall.
  • July 9, 2014: County administrator presents recommendation for using surplus or addressing shortfall, based on board priorities. Board to take initial vote on recommendation.
  • Aug. 6, 2014: Final vote set for surplus/shortfall recommendation.

The county had a 2013 general fund surplus of $3.9 million. County administrator Verna McDaniel has recommended to keep that amount in the general fund’s unearmarked reserves, to meet the county’s goal of having reserves that total 20% of the general fund budget.

Conan Smith (D-District 9) began the discussion by saying there were some foundational problems with this approach. One of those problems is that the county administrator has made a recommendation in advance of discussing this issue with the board, he said. The disposition of taxpayer dollars should be made by people elected to make those decisions, Smith said.

In fact, Smith added, since McDaniel has already made a recommendation, much of the work outlined in the timeline isn’t necessary. They should just discuss her recommendation at the board’s June meeting, and take a final vote in July.

Smith didn’t think the board had created an open and transparent process for the community or for county staff to give input on priorities and programs. The timeline also doesn’t give direction to the board about how commissioners can effectively engage in setting priorities for allocating surplus revenues. He expressed frustration that this process “is actually turning out to be little more than a rubber stamp of a decision that’s already been proposed by the administration.”

“I feel personally let down,” Smith continued. Part of his support for a four-year budget had been based on taking this process seriously, he said, and to “engage holistically” with the community in determining how to spend a budget surplus. “I feel personally frustrated because I was a huge part of developing the budgets that resulted in these surpluses,” Smith said. He added that he’d talked to department heads who were asked to make cuts, and had told them there would be discussion about how to get back some of that money if there were surpluses. But now it sounded like the decision has already been made, he said.

Felicia Brabec (D-District 4) – chair of the ways & means committee, who has been leading this process – replied that she sees things differently, and she was sorry that Smith was frustrated. She thought the process did take into account all of the things that Smith wanted to see. Hiring a consultant would help make that happen, she said, by engaging commissioners, staff and the community in moving the needle on their priorities.

Brabec said that McDaniel has shared her recommendation, and now it’s time for the board to discuss it in a very public way. It’s probably not happening as quickly as Smith would like, she noted, and she’d also like to move more quickly, but they’re doing it as quickly as they can.

Yousef Rabhi (D-District 8) said he agreed with some of Smith’s comments. He asked about a handout that Smith had provided to commissioners. [It had not been distributed to the public.] Smith replied that it was part of an email that he’d sent to commissioners in early May. [.pdf of Smith's email]

Smith asked if there was any expectation that the $3.9 million surplus would be used for any purpose other than the fund balance. Brabec said her expectation is that McDaniel’s recommendation will be discussed. “I don’t know what the fruits of that discussion will be,” she said.

Outcome: Earlier in the meeting – prior to this discussion – the resolution had been approved unanimously as part of the board’s consent agenda.

SPARK Grant

Commissioners were asked to approve an application for a $940,000 federal grant that the county would make on behalf of Ann Arbor SPARK, the local economic development agency. Funds would be used to help redevelop the former General Motors Willow Run Powertrain plant in Ypsilanti Township for use as a connected vehicle testing facility.

The Transportation Investment Generating Economic Recovery (TIGER) grant is available through the National Infrastructure Investments Program of the U.S. Department of Transportation. SPARK asked that the county’s office of community & economic development (OCED) act as the lead applicant and fiscal agent. OCED already submitted the grant application – on April 25, 2014. According to a staff memo, “due to the grant application deadline, it was not possible to bring the matter before the [board of commissioners] for approval prior to application submission.”

The project is a partnership with SPARK, the University of Michigan, the redevelopment firm Walbridge Aldinger and Ypsilanti Township, among others. According to a staff memo, the facility could lead to the creation of up to 7,800 new jobs in the skilled trades and research sectors. [.pdf of staff memo and resolution]

Outcome: Initial approval for the grant application was approved unanimously. A final vote is expected on June 4.

Coordinated Funding

Commissioners were asked to give final approval to allocate funding to local nonprofits as part of a coordinated funding approach for human services, in partnership with several other local funders. Initial approval had been granted at the board’s May 7, 2014 meeting, when the board had heard from several nonprofit and community leaders on this topic.

The county is one of the original five partners in the coordinated funding approach. Other partners are city of Ann Arbor, United Way of Washtenaw County, Washtenaw Urban County, and the Ann Arbor Area Community Foundation. It began as a pilot program in 2010.

This year, 105 applications were submitted by 50 local organizations totaling $8,732,389 in requested funding, according to a staff memo. A review committee recommended that 57 programs receive a total of $4,321,494 in available funding. Of that amount, the county is providing $1.015 million. Among the organizations that are being funded in this cycle are Corner Health Center, Interfaith Hospitality Network of Washtenaw County, Child Care Network, Catholic Social Services of Washtenaw, Food Gatherers and Legal Services of South Central Michigan. Several nonprofit leaders spoke during public commentary in support of this process, as did Ann Arbor city administrator Steve Powers.

The coordinated funding process has three parts: planning/coordination, program operations, and capacity-building. The approach targets six priority areas, and identifies lead agencies for each area: (1) housing and homelessness – Washtenaw Housing Alliance; (2) aging – Blueprint for Aging; (3) school-aged youth – Washtenaw Alliance for Children and Youth; (4) children birth to six – Success by Six; (5) health – Washtenaw Health Plan; and (6) hunger relief – Food Gatherers.

Funding for this cycle will start on July 1, 2014. In addition, the RNR Foundation will now be an additional funder in this process.

There was no discussion of this item.

Outcome: Final approval to the coordinated funding allocations was unanimous.

Appointments

The board took action on one appointment: Nicole Sandberg to the food policy council. Board chair Yousef Rabhi (D-District 8) brought the nomination forward. He reported that three applications had been received and reviewed by the council, who had recommended the selection of Sandberg.

The May 21 agenda originally included a slot to appoint someone to the board of public works, but Rabhi pulled the item, saying he wanted to solicit input from existing members of the board of public works.

Outcome: Nicole Sandberg was appointed to the food policy council.

Millage Rate

Washtenaw County commissioners were asked to take the first step in setting the county’s 2014 general operating millage rate at 4.5493 mills – unchanged from the current rate.

Several other county millages are levied separately: emergency communications (0.2000 mills), the Huron Clinton Metroparks Authority (0.2146 mills), two for county parks and recreation (for operations at 0.2353 mills and capital improvements at 0.2367 mills) and for the natural areas preservation program (0.2409 mills). That brings the total county millage rate levied in July to 5.6768 mills, a rate that’s also unchanged from 2013. [.pdf of staff memo]

This is an annual procedural action, not a vote to levy new taxes. With a few minor exceptions, the county board does not have authority to levy taxes independently. Millage increases, new millages or an action to reset a millage at its original rate (known as a Headlee override) would require voter approval.

The rates will be included on the July tax bills for property owners in Washtenaw County.

A public hearing on the millage rates is set for June 4.

Outcome: Commissioners took a unanimous initial vote to set the millage rate. A final vote is expected on June 4.

Proclamations

There were four resolutions honoring individuals or organizations: (1) a resolution of appreciation for Nancy Wheeler, the first African American woman to serve as a Washtenaw County trial court judge and who is retiring this year (she is the aunt of county commissioner Conan Smith); (2) a resolution of appreciation for Lynn Kneer, who is retiring after working as a judicial coordinator for judge Francis Wheeler; (3) a resolution proclaiming June 2014 as Relay for Life Month in Washtenaw County; and (4) a resolution honoring the 20th anniversary of the Interfaith Round Table of Washtenaw County.

Outcome: All resolutions were passed unanimously.

Communications & Commentary

During the May 21 meeting there were multiple opportunities for communications from the administration and commissioners, as well as public commentary. In addition to issues reported earlier in this article, here are some other highlights.

Communications & Commentary: Success by Six

Ypsilanti Township resident Shannon Novara, program manager at Washtenaw Success by Six Great Start Collaborative, thanked the board for its leadership in supporting the youngest members of the county. The nonprofit’s mission is to make sure every child in Washtenaw County enters kindergarten ready to succeed. She described the services that the nonprofit offers, and thanked its partners. Specifically, she thanked the county for its support of the annual Touch a Truck fundraiser that was held on May 10 at Ypsilanti Community High School. At least 1,250 children and their families participated, she said. She thanked commissioners and staff for their help, giving special recognition to Rolland Sizemore Jr. (D-District 5) for his work.

WCPARC has owned the 98-acre property in Superior Township since 2001, and Donald Staebler – who is 103 years old – still lives there in a lifetime agreement with WCPARC. The plan calls for adding fishing piers to the property’s two ponds, as well as putting in a trail system and other features. A second phase might involve developing a farm incubator program.

Commissioners also awarded $600,000 in grants through WCPARC’s Connecting Communities program, which supports trail projects throughout the county. Grants were given to projects in Ann Arbor Township, Northfield Township, Pittsfield Township, and the village of Manchester.

In non-voting business, WCPARC director Bob Tetens gave an update on the east county recreation center, a proposed partnership between the city of Ypsilanti and WCPARC in which the city would supply the property and WCPARC would provide the building. The center would be located on part of the 38-acre Water Street redevelopment area. Tetens said they’ve been working with the city of Ypsilanti on a development agreement.

Ypsilanti mayor Paul Schreiber and city councilmember Pete Murdock both spoke to the commission about Water Street during public commentary. Schreiber told commissioners that he wasn’t aware of any “show-stopping” issues. He also gave an update on Water Street Flats, an apartment project that’s planned for the site. The complex would be rental apartments for residents with between 50-90% of area median income.

In other action, commissioners approved about $500,000 for repairs at the Rolling Hills water park, and were briefed on several financial reports and project updates.

An issue that had been raised during public commentary at the Feb. 11, 2014 meeting emerged again on March 11: How should deer overpopulation be managed? Two residents – Maurita Holland and Barb Lucas – urged commissioners to play a role in dealing with the issue, which is affecting WCPARC parks and preserves. “We know there’s a lot of political fallout and a lot of education that needs to be done,” Holland said. She reported that a new group has formed – Washtenaw County for Ecological Balance. Members of WCEB include Larry Kestenbaum, Washtenaw County’s clerk/register of deeds, and Chris Graham, who serves on Ann Arbor’s environmental commission.

Commissioners discussed the issue at length. Jan Anschuetz advocated for a cautious approach, noting that it’s a complex problem that needs to be addressed by multiple entities, not just WCPARC. She also expressed concern that action by WCPARC could affect the 10-year renewal of the operations millage that WCPARC expects to be put on the November 2014 ballot. “If we do something that displeases our public, we will not have a millage and will not have a parks commission and we will not have a preserve,” she said.

Janis Bobrin noted that in this community, “If we start talking about killing anything, there are people who will just not hear anything after that.” There’s the actual management of the problem, she said, but also a major education piece that’s needed. “How do we begin to get a dialogue that isn’t one camp against another? That would seem to be a productive first step.”

Tetens told commissioners that WCPARC has applied for a $29,960 grant through the Michigan Dept. of Natural Resources wildlife habitat grant program. Those funds would allow WCPARC to quantify the deer impact on county parks and preserves more precisely. Everyone agrees that the growing deer population is a problem, Tetens said, but “nobody can solve it on their own.”

Commissioners also authorized Tetens to draft a letter opposing a proposed sand and gravel mine that McCoig Materials wants to start in Lyndon Township, on 189 acres north of Chelsea on M-52. The rural site is located near several parks and nature areas, including Waterloo State Recreation Area, the Pinckney State Recreation Area, Park Lyndon, the Green Lake Camping area, and the Waterloo-Pinckney Hiking Trail. WCPARC has been interested in buying the property for at least two decades, and is hoping to work with the current landowner to add the site to the county’s nature preserves, rather than being mined.

The March 11 meeting began with a moment of silence for Fred Veigel, a long-time parks & recreation commissioner who represented the road commission on WCPARC. He died on March 2. Commissioners also passed a resolution of appreciation for his work. A replacement to WCPARC will be appointed from one of the current three road commissioners: Barb Fuller, Doug Fuller or Bill McFarlane.

Staebler Farm

The meeting included two items related to a Michigan Dept. of Natural Resources trust fund grant application for Staebler Farm: a public hearing, and a presentation to commissioners about the project.

Coy Vaughn, WCPARC’s deputy director, told commissioners that this is a resubmission of an application that was originally made in 2013. Feedback from the state was that the original project emphasis was weighted too much toward preservation, education and agriculture, and not enough toward recreation. So WCPARC withdrew the application, modified it, and is resubmitting for the current grant cycle. “We’re confident that we have a much stronger application,” Vaughn said. [.pdf of staff memo]

By way of background, commissioners had approved the 2013 grant application at their March 12, 2013 meeting. The public hearing at that time had drawn four nearby property owners who raised concerns about trespassing. No one spoke at the public hearing on March 11.

The $300,000 grant would help a master plan for the Staebler Farm County Park. The 98-acre property, which straddles Plymouth Road in Superior Township, had been a family farm for nearly a century. WCPARC has owned the property since 2001, but Don Staebler – who is 103 years old – still resides there under a lifetime agreement with WCPARC. A farmer also raises hay on several acres south of Plymouth Road. Fleming Creek runs through the property, and it has frontage on Frains and Murray lakes. The acreage on the south side of Plymouth Road, where Staebler lives and which is still being farmed – will be part of a second phase, Vaughn explained. So the initial phase to develop for recreational use will focus on the north side of Plymouth. There are two ponds that were created as a result of the construction of M-14. There’s a demand for fishing from the public, he said, so the application is proposing a parking lot, a trail system with a pavilion and restroom, some improvements to Fleming Creek, and fishing piers in each pond. Vaughn noted that fishing piers receive extra points on the trust fund applications.

Eventually, the site will provide a learning center to teach the history of farming, including sustainable farming practices that are currently used. “We don’t want this to just be a farm theme park,” Vaughn said. “We want it to be an active farm.”

The total project is expected to cost about $700,000. WCPARC is asking for the maximum amount from the trust fund – $300,o00 – with the remainder coming from a $400,000 WCPARC match.

Rolland Sizemore Jr. asked if WCPARC would need to find a way to let people cross Plymouth Road. Vaughn said they hoped to discourage that, so the design will reflect that. Fences will be installed on both sides of the road, for example.

Sizemore then said he’d gone out to talk with Staebler recently, and had gotten the impression that Staebler was worried about upkeep on the property. “It’s the county’s building now, but it’s not up to our standards,” he said. He suggested spending $5,000 or $6,000 to clean it up and add gravel to the driveway. Sizemore also suggested organizing a volunteer day to help with the cleanup.

Vaughn replied that Staebler and his family have been part of the design process. Jan Anschuetz noted that a video interview of Staebler is posted online.

Evan Pratt clarified with Vaughn that revisions to the plan are still in line with what WCPARC wants to accomplish. Vaughn noted that Superior Township has also seen the new plans and is supportive. Pratt then asked if a farm management plan would be developed for the site, for the portion of the site that is being actively farmed. WCPARC director Bob Tetens said the tricky thing is that not a lot can be done while Staebler lives on the property. However, WCPARC has talked with Michigan State University about the possibility of a farm incubator program, Tetens said, as well as with the Veterans Affairs hospital about a possible program for veterans who are receiving treatment.

Dan Ezekiel noted that there’s a lot of pent-up demand for fishing, so he was glad to see the fishing piers as part of the project. He also supported the idea of a farm incubator. Pointing to the dramatic decrease in the butterfly population, Ezekiel wondered whether this project could incorporate habitat for butterflies – particularly the Monarch – into the pasture and meadow areas. Other commissioners and staff supported his suggestion.

Janis Bobrin clarified with Tetens that the fishing piers would be accessible to those with disabilities. Tetens replied that the plan’s goal is for universal accessibility throughout the site.

Jan Anschuetz noted that the County Farm Park’s playground has a farm theme, and she wondered if the playground on the Staebler Farm would also have that theme. “Everything we do out there is going to have a farm theme,” Tetens replied.

Sizemore asked if the project would include a petting zoo. It won’t, Tetens replied. Anschuetz noted the proximity to Domino’s Farms, which has a petting farm, and said WCPARC wouldn’t want to compete with a private enterprise.

Outcome: Commissioners unanimously approved applying for the MDNR trust fund grant for Staebler Farm.

Connecting Communities Grants

At WCPARC’s Feb. 11, 2014 meeting, commissioners had reviewed applications for this year’s cycle of Connecting Communities grants, which covered six proposed projects. By way of background, in May 2009 WCPARC authorized the Connecting Communities initiative. The program makes up to $600,000 available annually from 2010 through 2014 – a total of $3 million – toward the cost of eligible trail projects. According to a staff memo, “eligible projects will be those that accomplish the Commission’s primary objective of providing valuable non-motorized connections between communities and activity centers, offering a healthy alternative for recreation, transportation, fitness, and energy conservation.” Grant recipients have two years to fulfill any contingencies, such as acquiring grants from other organizations.

As an example, the city of Ann Arbor was granted $300,000 in 2013 (of total cost of $1 million) for 1,500 feet of trail, part of a project for the “development of pathways, storm water features to improve the quality of Allen Creek … on property which will serve as a trailhead for the proposed Allen Creek Greenway.” The site includes city property at 721 N. Main. Paths would connect Felch Street to both North Main and west Summit Street. The proposal stated that the city would also apply for a match from the Michigan Dept. of Natural Resources trust fund (MDNRTF), and that the city would consider using the adopt-a-park program to help maintain the facility. The grant required success with the MDNRTF, but the city’s application in 2013 failed. The city has another year to try again.

WCPARC developed criteria for selecting projects, which include 10 primary considerations. Among those considerations are projects that provide important links between communities, parks and other points of interest, that are adjacent to waterways, or that are major multi-jurisdictional efforts. There are 14 types of projects that generally are not eligible, such as trails solely within existing local parks.

Applicants must document a compelling need for a project. Six criteria that are used to evaluate the projects. For example, projects are evaluated based on whether they directly relate to the county’s important natural features, such as a river. The Huron River corridor is WCPARC’s highest priority. Five secondary criteria – such as land availability, or the likelihood of funding from other sources – are then applied to high-ranking projects.

The process for selecting projects to be funded involves a staff review of the applications. The projects are then presented to the Greenways Advisory Committee, which provides input that staff uses to prioritize the applications and make recommendations to WCPARC for final approval.

Connecting Communities: Applications & Staff Recommendations – Ann Arbor Township

Ann Arbor Township applied for $300,000. The total project cost is $1.2 million for two miles of pedestrian and bicycle trail connecting Parker Mill and Plymouth Road along Dixboro Road, to connect to the Parker Mill trail at Geddes and Dixboro on the south, and the proposed trail from Plymouth/Dixboro to Main Street/Cherry Hill on the north.

The application states that other confirmed project funders include $600,000 in private donor matching funds. Potential project funders include the Michigan Dept. of Natural Resources trust fund, the Washtenaw County road commission, the Michigan Dept. of Transportation alternatives program, and additional private donors. It’s part of a broader project that WCPARC has taken the lead on, hoping to build partnerships with the township and the University of Michigan to create a north-south Border-to-Border trail connection. The township has received no previous grants from the Connecting Communities program.

Dan Smith noted that he had attended a forum the previous night hosted by Ann Arbor Township about non-motorized pathways. He’d talked with some residents who live on Geddes Road, as well as someone from Pittsfield Township who rides mountain bikes in that area. Smith said he’d been taken aback because these people weren’t too keen about the trail project. The residents were concerned about increased traffic and parking. Parker Mill is already a popular destination. And the mountain biker prefers natural trails over engineered trails, Smith said. “You can’t make everybody happy, he said, adding that he fully supported this project.

WCPARC director Bob Tetens said they try to make the trails accessible to the broadest possible number of people. Last year, he noted, a cyclist had been hit along that section of road, so a non-motorized trail is needed in that area.

Evan Pratt clarified with staff that Ann Arbor Township had never received an MDNR trust fund grant. He suggested that WCPARC staff help out with the application. Tetens said that the staff works with all of the entities that apply for trust fund grants, when WCPARC is offering matching funds. Pratt said he knew that applications including regional trails score higher.

Responding to a query from Bob Marans, Vaughn indicated that the township hadn’t completed its design of the trails yet, but that WCPARC will be involved in that process.

Jan Anschuetz noted that the broader project has been on WCPARC’s “dream list” for more than 20 years, and they’ve put a lot of energy into it. “My poor husband has become a very old man – I don’t know if he’ll be able to walk this trail,” she quipped.

Tetens noted that the university hasn’t always been interested in providing trail connections in its property, which includes the Matthaei Botanical Gardens. But there are some new people who want to make it happen now, he said.

Staff recommendation: $250,000.

Connecting Communities: Applications & Staff Recommendations – Village of Manchester

The village of Manchester applied for $150,000 (of $225,000 total cost) to improve an existing rail bed owned by the village into a walking/biking trail traversing the entire community and linking several parks, businesses, schools, and neighborhoods, ending at the county’s Leonard Preserve.

The Chelsea Area Wellness Foundation will provide $100,000, and the Kiwanis Club of Manchester another $2,000. Potential additional funders include community fundraising and private donations; and grants such as the Moving Ahead for Progress in the 21st Century Act (MAP-21); Transportation Alternatives Program (TAP) and Surface Transportation Program (STP), which are both programs of the Federal Highway Administration in the federal Dept. of Transportation; and the Rails to Trails Conservancy.

The village had previously been awarded $150,000 from the Connecting Communities program in 2011, which it planned to use as matching funds for a Michigan Dept of Natural Resources trust fund grant. However, it decided not to apply for that grant, so the WCPARC funds weren’t awarded. The village now intends to apply for the state grant this year. WCPARC considers this a renewal of the previous 2011 grant, so the money won’t come from the $600,000 in Connecting Communities funds that are available this year.

Staff recommendation: $150,000 (renewal).

Connecting Communities: Applications & Staff Recommendations – Northfield Township

Northfield Township applied for $260,000 (of $600,000 total cost) for 2,925 feet of trail along Barker Road in Whitmore Lake, connecting Whitmore Lake’s downtown with the Northfield Township Library and Whitmore Lake Elementary School. This is the third phase of a project that received $120,000 in 2010 and $250,000 in 2011 from the Connecting Communities program.

Other confirmed project funders are $60,000 from Northfield Township, $60,000 from the Whitmore Lake Downtown Development Authority, $1,000 from the Northfield Area Chamber of Commerce, and $1,000 from the Kiwanis.

Staff recommendation: $250,000.

Connecting Communities: Applications & Staff Recommendations – Pittsfield Township

Pittsfield Township applied for $400,000 (of total cost of $1.9 million) for 1.8 miles of trail, phase 2 of the Lohr-Textile greenway, extending it east from the corner of Lohr and Textile, on Textile, to the Marshview Meadow Park and the Pittsfield Preserve.

Grants from WCPARC’s Connecting Communities project to the township were $300,000 in 2010; $290,000 in 2011; and $150,000 in 2013. Those 2013 funds were intended as matching funds for a MDNR trust fund grant, which the township did not secure.

Confirmed funding is from Pittsfield Township (up to $400,000); and MDOT/SEMCOG through the federal Transportation Alternatives Program (TAP) program ($1,064,708).

Bob Tetens noted that this project is compatible with the township’s State Road corridor improvement authority project. Coy Vaughn pointed out that Pittsfield Township has received more money from Connecting Communities and other WCPARC sources than other communities, but the township has been successful in completing its projects and in leveraging WCPARC’s money to secure other funds.

Staff recommendations: $250,000 as matching funds for the TAP grant. (Includes $100,000 in new Connecting Community funds, and renewal of the $150,000 from 2013.)

Connecting Communities: Applications & Staff Recommendations – Ypsilanti Township

Ypsilanti Township applied for $240,000 for two projects totaling 3,032 feet (total cost of $240,000). One project (2,032 feet) would run along the east side of Tuttle Hill Road from Textile Road north across South Huron River Drive and into Ford Lake Park. The other (1,000 feet) would run on the south side of Textile from just east of South Huron River Drive to the entrance of Lakeview mobile homes.

The township received WCPARC funding for trail projects in 2010, 2011 and 2013.

Bob Tetens noted that one of the criteria for new Connecting Communities funding is that any previously funded project must be completed. The township is still working on finishing the trail that was funded by WCPARC in 2013, he said.

Staff recommendation: No funding for this cycle.

Outcome: Commissioners unanimously approved all staff recommendations for Connecting Communities grants.

Connecting Communities: Next Steps

Bob Marans noted that this is the last year of the five-year Connecting Communities program. He wondered if WCPARC staff was going to recommend continuing it. “There’s always that option,” Bob Tetens replied.

Tetens told commissioners that the program has been extremely popular. In surveys of county residents, trails and open space typically rate the highest in terms of support. The Connecting Communities program was developed because WCPARC was receiving a lot of requests from local communities for help with trail projects, and it was difficult to objectively evaluate each project when there weren’t other projects to compare against.

Every year, requests are typically double the amount of available funding, Tetens said. In looking ahead, WCPARC staff had looked at using the funds that would be available after the end of the Connecting Communities program to instead fund debt payments from the proposed east county recreation center, if WCPARC decides to bond for that project. But given the popularity of Connecting Communities, Tetens said, the staff will likely propose keeping some version of it – assuming that the WCPARC operations millage is renewed by voters.

Rolland Sizemore Jr. jokingly asked if some of the money can be used to repair roads. Tetens noted that WCPARC has funded some road shoulder projects, in partnership with the road commission. WCPARC is usually involved in any significant trail project in the county, Tetens said. Much of that is through the Border-to-Border Trail project. In addition to projects in the Connecting Communities program, other trail projects are in the works for North Territorial, and an effort to connect Dexter and Chelsea, among others.

Dan Smith clarified that Tetens anticipates continuing Connecting Communities, but it’s contingent on the millage renewal. That’s right, Tetens replied. “It would be hard to do it if we don’t have that assured cash flow.”

Eastern County Recreation Center

Tetens said they’ve been working with the city of Ypsilanti on a development agreement. “There are some terms that we’re not fully comfortable with, and I think the city probably has the same feeling,” he said. WCPARC staff have met with attorneys several times to review the agreement, and work on that continues. He thought he’d have a better sense of how it was progressing at the commission’s April meeting.

Paul Schreiber, mayor of Ypsilanti, told commissioners that he wasn’t aware of any “show-stopping” issues.

Earlier in the meeting, Schreiber had spoken during public commentary to update WCPARC on actions by the city of Ypsilanti that affect the rec center. The previous week, on March 4, the Ypsilanti city council approved a purchase agreement for Water Street Flats, a development with 90 residential units. He thought it was something that’s good for the city.

The complex will be rental apartments for residents who earn 50-90% of area median income. For Ypsilanti, that comes out to market rate, he said. So it’s market-rate housing, Schreiber said, that’s being financed through low-income housing tax credits.

The apartments will bring more people to that area, Schreiber said. The development won’t be next to the rec center, but will be nearby – on the south edge of the Water Street property. He thought the complex would attract young professionals making $30,000 to $40,000 a year, just starting out after graduating from Eastern Michigan University or other institutions. There will be some Section 8 housing, he said. Other properties by the same developer – Herman and Kittle Properties – have had Section 8 units for between 4% and 21% of the entire development, he noted. Since this location is on the river, near downtown and the Border-to-Border Trail, “I think we’re going to be on the low end of that [percentage],” he said.

Schreiber told commissioners that there had been a “lot of spirited discussion against it,” but the majority of the Ypsilanti city council decided to approve it. The developer is applying for tax credits and financing. That’s a competitive process, he noted, so it’s still unclear how it will turn out.

Schreiber felt that the project fits in with the rest of the Water Street plans, including the rec center and WCPARC’s goals. Construction would be in 2015, with completion likely in 2016.

Ypsilanti city councilmember Pete Murdock also addressed commissioners, noting that the developer still owns similar properties that it built, “so they’re not just getting in on the front end and then leaving.” He said the developer would also be building a lot of infrastructure that would serve the rest of the site, including several roads, sidewalks and utilities.

Responding to a query from Rolland Sizemore Jr., Murdock said that even if the rec center isn’t built, the apartment project would move forward.

Rolling Hills Water Park Repairs

WCPARC director Bob Tetens described this item as the “convergence of several problems.” Part of the issue is related to the capital improvement program, but a lot is tied to conformance with current regulations, he said.

From the staff memo:

A few years ago, through dye testing, we discovered the Lazy River was leaking water from four of the seven floor and wall expansion joints. As result, this past fall we removed one of the leaking joints to investigate the extent of the problem. It was confirmed that the rubber membrane in the expansion joints had failed causing the leak. To remedy the situation each expansion joint will be removed and replaced.

The operation of the pools and Lazy River are regulated by several County/State and Federal codes or guidelines. One of these is the Virginia Graeme Baker Pool and Spa Safety Act (VGBA) of 2008 (with updates in 2011). This Act was enacted to prevent hazards of drain entrapments in public pools and spas. Since enactment of the VGBA, we initiated replacement of drain grates throughout the Main Pool facility to comply with the 2008 requirements. However, the drain grates within the Lazy River have not been replaced due to their custom configurations and other needed modifications. Now VGBA and State regulations mandate further changes be made to the drain sump structures and grates to be compliant.

“Slide Mountain” and its associate stairway system are some of the original features of the Waterpark. Over time through regular patron usage and weather, the stairs have developed significant deterioration requiring extensive repair and reconstruction.

Due to the complexity of the project work, Stantec Consulting of Michigan (a local engineering firm) was hired to evaluate the above issues and recommend corrective measures to address each. As a result, an RFP was developed and structured to allow a portion of the work to be completed this spring before opening, then resume after Labor Day shut-down. The scope of work is somewhat specialize and the documentation required perspective bidders to demonstrate previous years of experience with this type of project. [.pdf of full staff memo]

Four bids were received in response to the RFP. The low bid was by Baruzzini Construction Co. of Brighton, for $497,549. The firm had worked on the water slide addition last year and is familiar with the Rolling Hills facility, according to the staff memo. Baruzzini also is doing work on Rutherford Pool in Ypsilanti.

The staff recommended approval of this contract with Baruzzini, plus a $35,000 contingency for potential change orders.

Outcome: Commissioners unanimously approved the contract for work at the Rolling Hills water park.

Communications & Commentary

Each WCPARC meeting includes opportunities for public commentary, as well as various communications from staff and commissioners. Here are some highlights.

Communications & Commentary: Deer Management

Two people spoke on the issue of deer damage in the county. Maurita Holland noted that she’d spoken to commissioners at their previous meeting, on Feb. 11, 2014. A group has formed called Washtenaw County for Ecological Balance, she reported, with members including Larry Kestenbaum [Washtenaw County's clerk/register of deeds] and Chris Graham [who serves on Ann Arbor's environmental commission].

Holland pointed out that Time magazine had a picture of a deer on the cover of its last issue in 2013. A chart in the article shows that the deer population has grown more than any other animal since the middle of the last century. In the past 50 years, the U.S. deer population has increased about 800% to about 32 million head, she noted.

The Forest Preserves of Cook County, in Chicago, has developed a sustainability plan, Holland reported, which includes an annual cull of deer. She reported that the city of Jackson, Michigan, has been culling deer for several years. During that time, about 500 deer have been culled in the city and provided to food pantries there.

Holland concluded by asking commissioners what they needed. “We do understand that the political part of this is undoubtedly much more difficult than getting the MDNR in here with a special permit, if you were to vote as a board to do that,” she said. “We know there’s a lot of political fallout and a lot of education that needs to be done.” The new group is very dedicated to this cause, she said, but only in ways that can be as positive as possible.

Barb Lucas also spoke on this issue. She is contracted by Washtenaw County to do environmental shows on WEMU and Community Television Network – called the Green Room. The November show on WEMU focused on deer overpopulation. It had been very illuminating to interview different stakeholders about it, she said, and it led her to feel that people need to find commonalities because there are such passionate feelings on all sides.

Both sides want to preserve life, Lucas said. If the animal rights supporters were educated about the “web of life” and how there are so many different creatures that depend on the ecosystem, they might have a different view. If deer graze heavily in an area, other species will suffer and starve to death, she said. Animal rights activists talk about “species elitism,” Lucas said, so that’s something to talk about – whether it’s better to protect a “charismatic” species like deer or to protect a range of other species too. That might be a way to find common ground, rather than to start by talking about culling deer, which would “polarize everybody immediately,” she said. Lucas concluded by urging commissioners to listen to the Green Room segment on this issue.

Holland spoke again, noting that she’d spoken with Ann Arbor city councilmember Sabra Briere. Holland said that Briere was also very concerned about this issue, and had indicated that she’d be contacting WCPARC because it was a good idea to talk about how this affects both the city and the county. The deer right now are in the county’s northwest quadrant, Holland said, and are moving towards Ann Arbor. “This is going to be a moving target,” she said.

Tetens thanked Holland and Lucas for providing more information, and told commissioners that WCPARC staff would be collecting as much information as possible. He reported that WCPARC has applied for a $29,960 grant through the Michigan Dept. of Natural Resources wildlife habitat grant program. Those funds would allow WCPARC to quantify the impact on county parks and preserves more precisely.

Tetens told commissioners that this will now be a regular agenda item, as the staff continues to research this issue. He noted that the county board of commissioners held a working session in February that focused on the deer population in Washtenaw County, which included a presentation by Timothy Wilson of the U.S. Dept. of Agriculture.

Everyone agrees that the growing deer population is a problem, Tetens said, but “nobody can solve it on their own.”

Bob Marans asked about a timeframe for putting some kind of plan in place. Dan Smith, who serves on the county board representing District 2, described a couple of points from the February working session. The USDA would assist in helping carry out various remediations, he said, but only after some other entity assesses the problem. In Michigan, that falls to the DNR and local entities.

Smith also reported that the “lethal” technique was surprisingly expensive. He’d expected that to be the least expensive, but that wasn’t the case. According to the USDA, the most effective technique would be even more unpopular than other management efforts, Smith said – to bring back natural predators. “That would be even more unpopular than bow hunters.”

Marans asked Tetens where he saw this headed, in terms of WCPARC’s role. Tetens replied that the DNR is responsible for managing the deer population, so ultimately it would need to be a collaborative effort with the DNR, local communities, the Farm Bureau, and others.

Marans then asked: “Is it our responsibility to push the DNR?” It’s everyone’s responsibility, Tetens replied. Right now, it’s a problem that the county can’t manage alone. The USDA representative had noted that even if the problem is solved in one location, the deer move elsewhere, he said.

As a society, “we have created the perfect environment, with our rural residential development,” Tetens said. Scio Township has been in the top five municipalities statewide in terms of the number of deer-vehicle accidents, he noted. Hunting is limited, while suburban homes plant landscape gardens that attract deer. He likened it to putting up a sign that says: “We’re not going to hunt you. Here’s free food. Come on in!” There needs to be a cultural shift, Tetens said.

Dan Smith said that from a policy perspective, WCPARC can be a driver as far as the county is concerned, because it manages significant acreage in parks and natural areas. The elected county board of commissioners has indirect control, but the county board doesn’t directly own a lot of land.

Marans agreed that WCPARC plays an important role, but “the directive should come from the county board,” he said.

Smith noted that the townships in Michigan have the most control over land use issues, so it’s important to work with the township officials too. Based on his research, Smith said, it’s clear that there are conflicting interests – farmers want one thing, hunters want another, conservationists want yet another thing, depending on what type of conservationist they are.

Janis Bobrin referred to a point that Barb Lucas had made regarding the need to find common ground. “This is a community where if we start talking about killing anything, there are people who will just not hear anything after that,” she said. There’s the actual management of the problem, she noted, but also a major education piece. “How do we begin to get a dialogue that isn’t one camp against another? That would seem to be a productive first step.”

Jan Anschuetz said it would be presumptuous to say that culling deer would solve the problem. About five years ago, WCPARC considered the issue seriously, she said, adding that she’d spent about 40-50 hours researching the problem at that time. Studies that she’d read revealed that culling deer actually encourages reproduction. It’s a very complicated issue, she said, and WCPARC shouldn’t just jump into it.

Marans replied that clearly they need to move slowly. He described a deer management program at the Huron-Clinton Metropolitan Authority, which he said was very successful. [Marans also serves on the board of the HCMA, which oversees the Huron-Clinton Metroparks.] He noted that HCMA has more land than WCPARC, and it’s also hard to know what happens on land outside of the metroparks.

Anschuetz urged commissioners and staff to be “a little bit humble.” They need to work with and listen to the animal rights advocates, she said.

Dan Smith noted that it’s clear the deer are harming native plants and wildlife in the county’s preserves. The reason the county invests in these preserves is to ensure that native plants and wildlife have protected areas. He thought that managing the deer population could be part of the broader management efforts for those areas. But the success of that management isn’t known, he added. Smith said he’d read that deer have evolved so that their reproduction is a way to survive predators. When there are no predators – aside from vehicles – then they overpopulate.

Evan Pratt said it would be helpful to get feedback from staff about what WCPARC’s role should be. Should they be hosting symposiums? Or just providing information?

Anschuetz argued that WCPARC exists in order to serve the entire population of Washtenaw County that pays for parks. “If we do something that displeases our public, we will not have a millage and will not have a parks commission and we will not have a preserve,” she said. Deciding how to handle the deer issue is an important decision, she added – not just for the people who are concerned about this issue, but for the entire parks system.

Dan Ezekiel suggested seeing if there are any resources at the University of Michigan School of Natural Resources & Environment.

Dan Smith asked if Tetens would be comfortable preparing a recommendation over the next month or two. Smith said it sounded like Marans wanted direction from the county board of commissioners. Marans thought the county could be a leader in initiating a program, whatever that might be. It wasn’t wise to just be passive, he said.

Tetens said his staff hadn’t been able to spend much time on this issue so far. Marans wanted to see a proposal for various options within six months or so.

Regarding HCMA’s deer management, Anschuetz pointed out that HCMA’s millage is permanent and doesn’t require renewal. But WCPARC’s millage does need renewal, she noted, and “if we aren’t representing the community, we are in a very vulnerable position.” Marans countered that commissioners don’t know what the community thinks as a whole.

Bobrin said that Anschuetz’s point is well taken – WCPARC needs to understand that. Anschuetz told commissioners that she’s very involved in animal rights issues, and is very involved with the Humane Society. “I know what goes on,” Anschuetz said. “You may be underestimating the power of the people in this community.” She didn’t see WCPARC as leading this effort, but rather they should partner with other entities.

Pratt drew an analogy to weed control in lakes. Once you start spending money to try to manage it, “you’re just rolling the rock up the hill,” he said. “You just start this Sisyphean task when you try to force-fit nature into what you want it to be.” He said he wasn’t arguing against a deer management program, but WCPARC first needs to figure out what its role should be.

Dan Smith said he wasn’t suggesting that WCPARC take on deer management itself. But because they’ve invested in preserves, that’s why WCPARC has a role in it. “If the preserve just becomes a bunch of prairie grass, that’s not a very interesting preserve,” he said. “That’s not why we’re buying this land with tax dollars.”

Smith noted that if the best solution turns out to be introducing natural predators to the area, that introduces an entirely new set of problems. “Now the farmers will really be up in arms,” he said.

Communications & Commentary: Lyndon Township Mining Proposal

McCoig Materials is proposing a sand and gravel mine in Lyndon Township, on 189 acres north of Chelsea on M-52. The rural site is located near several parks and nature areas, including Waterloo State Recreation Area, the Pinckney State Recreation Area, Park Lyndon, the Green Lake Camping area, and the Waterloo-Pinckney Hiking Trail.

Bob Tetens reminded commissioners that the southern part of WCPARC’s Park Lyndon covers most of the edges of Lake Genevieve, and “we’ve always sort of felt, despite where the fences are at, that the whole lake was ours, and it’s not.” A small portion of the southern tip of the lake is part of the Cunningham family property – the site that McCoig wants to purchase.

In the past, WCPARC had talked to the family about possibly buying that land, Tetens said. WCPARC has been interested in it for at least two decades.

Residents in the area are very concerned about McCoig’s proposal, Tetens said. It would mean a lot of additional traffic from trucks – 60-80 round-trip gravel haulers each day would be driving through Chelsea, throughout the estimated 30-year life of the operation. There are also concerns about the impact on local ecosystems and hydrology, Tetens said.

Part of what makes the northwest part of Washtenaw County so special is its concentration of parks and recreation areas, Tetens said, so it doesn’t make sense to take 190 acres out of that for mining.

Tetens asked for the commissioners to support drafting a letter to Lyndon Township and state officials, opposing a special use permit that would allow the company to remove sand and gravel. He stressed WCPARC’s continued interest in buying the property for the county’s natural areas preservation program, and said that an application for NAPP had been sent to the Cunningham family. The resources are available in NAPP’s budget to buy the property at fair market value, Tetens said. Any added value related to mineral rights would have to be negotiated.

Tetens also reported that the Michigan Dept. of Natural Resources has been working with McCoig to try to find an alternative site – possibly property that the DNR owned or could acquire, that could be traded for the Cunningham property so that the ecosystem in that area could be maintained.

Janis Bobrin noted that because of relatively recent state legislation, it’s very difficult for local governments to turn down mining operations in their communities.

On its website, Lyndon Township has noted that its authority is limited:

Michigan State Legislators have greatly reduced township control by passing Act 110 of 2006 (125.3205). Under that law, the township must not “prevent the extraction, by mining, of valuable natural resources from any property unless very serious consequences would result from the extraction of those natural resources. Natural resources are considered valuable for the purposes of this section if a person, by extracting the natural resources, can receive revenue and reasonably expect to operate at a profit.” The township’s authority is limited to “reasonable regulation of hours of operation, blasting hours, noise levels, dust control measures, and traffic that are not preempted by part 632 of the Michigan environmental laws,” 1994 PA 451, MCL 324.63201 to 324.63223.

Communications & Commentary: Millage Renewal

Bob Tetens updated commissioners on the process of renewing the county’s 10-year parks & recreation operations millage, which is likely to be on the November 2014 ballot.

The countywide parks & recreation operations millage is a 10-year, quarter-mill tax that was first approved in November 1976 1978, and subsequently renewed in 1984, 1994, and 2004. The current millage expires on Dec. 1, 2016. Typically, a renewal proposal is put on the ballot two years before the existing millage expires.

Tetens said there will be two separate tracks. The county staff and commission can market its services and programs to the greatest extent possible – that’s well underway, he said. As part of that, staff are developing the next five-year strategic plan.

In 2004, when the millage was most recently renewed, the county board of commissioners – the elected body that has the authority to put a millage proposal on the ballot – was asked to do that in June, Tetens said. That’s likely the timeframe that will be followed this year. WCPARC staff will be making a presentation to the county board to describe what’s been done in the past 10 years. “We’ve got a good story to tell about that,” he said. The presentation will also include a planning document about how the millage would be used in the next 10 years.

Parallel to that is the organization called Friends of the County Parks. It’s the group that handles fundraising for the millage campaign itself, Tetens explained. Nelson Meade, the long-time WCPARC member who retired in December of 2013, used to lead that effort. Tetens said that commissioners might want to designate someone to serve as treasurer of that group, in place of Meade.

Financial Reports

Each month, staff provide several different financial reports to WCPARC, focused on the past month’s expenses (the claims report), monthly and year-to-date reports on expenses and revenues in the form of fund balance reports, and a listing of major non-recurring expenses when they are significant.

There are separate reports on parks and facilities, and on the natural areas preservation program (NAPP), which includes preservation of agricultural lands. Each of these has its own, separate funding, although WCPARC administers all of these programs.

Financial Reports: Claims Report

Director Bob Tetens began by saying that the reports reflect WCPARC’s off season. Parks and facilities paid a total of $113,859 in claims during February. Most of those expenses were for capital improvements, primarily at the Meri Lou Murray Recreation Center and Rolling Hills.

NAPP claims totaled $661,101 in February. Most of those expenses – $613,784 – were spent on a conservation easement for the Bloch property in Superior Township, which commissioners had approved at their Feb. 11, 2014 meeting.

Financial Reports: Fund Balance – Parks and Recreation

Tetens noted that there hadn’t been any dramatic changes since the previous month’s report.

January 2014 began with a fund balance of $10,521,250. [This is the total of the $3,146,250 fund balance on Dec. 31, 2013, plus the $6.7 million operating reserve and the $675,000 committed to funding partnerships.] Revenue as of Feb. 28, 2014 was $4,128,849 with expenses of $696,711. The operating reserve for 2014 is $6.7 million, and the funding commitments for partnerships is $820,000. [.pdf of February 2014 parks & rec fund balance]

The projected fund balance at the end of 2014 is $6,430,817.

Financial Reports: Fund Balance – NAPP

The February report started with the fund balance of $7,195,911 and showed revenue of $1,968,881. Expenses totaled $622,947, for a projected fund balance at the end of 2014 of $8,450,839. [.pdf of February 2014 NAPP fund balance]

There was no substantive discussion of the reports.

Outcome: WCPARC unanimously voted to receive, accept, and file the financial reports.

Recreation Reports

Typically, there are several monthly reports on attendance at WCPARC facilities where attendance can be counted, with information about participation in measurable activities and revenue received at those facilities. The reports include the current year-to-date summary as well as similar information for the prior two years.

For the March 11 meeting, only one recreation report was presented.

Recreation Reports: Meri Lou Murray Recreation Center

At the Meri Lou Murray Recreation Center, year-to-date participation as of Feb. 28, 2014 was 56,541 and revenue was $250,023. In 2013, year-to-date participation was 63,615 and revenue was $262,635. In 2012, participation was 67,824 and revenue was $249,565. [.pdf of MLM recreation center report]

WCPARC director Bob Tetens noted that activity had been slow during February, which he attributed to the bad weather. “People just weren’t getting out,” he said.

Tetens reminded commissioners that two years ago, the county’s Pierce Lake golf course opened in the third week of March, and in 2013 they opened in the last week in March. So things will be slow at the golf course this year too, he said.

Outcome: The recreation report was received and accepted for filing unanimously.

Projects and Activities

Staff of WCPARC provide monthly updates to commissioners about ongoing improvements at facilities, and activities at parks and natural areas. Some of this information is provided in writing in the board packet; more is provided with visuals and informal commentary. [.pdf of projects/activities report]

Here are some highlights of items discussed at the March meeting.

  • The annual ice fishing derby at Independence Lake had a good turnout, Coy Vaughn reported. Rolland Sizemore Jr. observed that in the photos that Vaughn showed of the event, there weren’t any minorities. He asked how WCPARC advertised the event. Vaughn replied that they used posters, partnered with businesses like Cabela’s and local bait shops, and posted information online. WCPARC director Bob Tetens said there is typically a larger turnout of minorities for events at Rolling Hills, on the county’s east side.
  • The annual “Daddy Daughter Dance” at the Meri Lou Murray recreation center on Feb. 22 drew 168 people this year. Vaughn played a clip from a feature about the dance that aired on Community Television Network’s FYI show.
  • A summer job fair was held at the gym in the Meri Lou Murray recreation center, with several county departments and the Michigan Works office represented. Attendees could apply and be interviewed on the spot. It drew over 100 people.
  • Vaughn showed two short videos that will be used to promote various WCPARC facilities online. He plans to show one or two new videos at each WCPARC meeting over the next few months. The videos shown on March 11 highlighted County Farm Park and the water parks at Rolling Hills and Independence Lake.

Remembering Fred Veigel

The March 11 board packet included a resolution of appreciation for Fred Veigel, who died on March 2. [.pdf of resolution] Veigel was a long-time WCPARC member who held a seat designated for a county road commission representative.

WCPARC director Bob Tetens described Veigel as “an even more colorful figure than we’d realized,” based on pictures that had been on display at Veigel’s memorial and funeral. Veigel had been a member of International Brotherhood of Electrical Workers Local 252 for 60 years, and the union is planning a memorial “toast and roast” on Friday, June 13.

Evan Pratt noted that the family is encouraging people to come and share stories about Veigel. “It sounded like there weren’t going to be many boundaries,” he said.

Outcome: Commissioners passed the resolution of appreciation.

Action included approving the purchase of a conservation easement on 129 acres in Superior Township – fronting Vreeland and Leforge roads – for $613,500. Purchase of another easement was authorized for $95,731 on the Rogers parcel, 157 acres in York Township.

Commissioners also heard an update on the proposed agreement between WCPARC and the city of Ypsilanti that would result in WCPARC building a new recreation center on 4.1 acres of land in the Water Street redevelopment area, next to the Huron River. Some of the changes in the draft agreement came at the request of the Ann Arbor YMCA, which is partnering on the project and would operate the center. The goal is to complete construction by late 2016.

Grant applications for WCPARC’s Connecting Communities initiative were reviewed. Requests from four townships and the village of Manchester totaled $1.35 million. That’s far greater than the $600,000 available for the grant program, which was created to build non-motorized trails across the county. Commissioners will decide at their March 11 meeting how to award the grants.

During public commentary, three residents spoke to the commission about the ill effects of over-abundant deer in the county, and urged WCPARC to address the situation.

The commission also welcomed its newest member to the group: Dan Ezekiel, a science teacher at Ann Arbor Public Schools and former chair of the Ann Arbor greenbelt advisory commission. One of the longest-serving commissioners – labor leader Fred Veigel, who has represented the county road commission on WCPARC – didn’t attend the meeting because of ill health. He died on March 2.

Natural Areas Preservation Program

The county’s natural areas preservation program (NAPP) is funded by a 10-year countywide millage of 0.2409 mills, which brings in about $3 million annually. Voters renewed the millage most recently in 2010, through 2020. The program enables WCPARC to purchase land worth preserving because of its natural features, and to purchase development rights on agricultural land.

The Natural Areas Technical Advisory Committee (NATAC) advises WCPARC on natural areas acquisitions. The Agricultural Land Preservation Advisory Committee advises WCPARC on the purchase of development rights for agricultural land.

NAPP: Bloch/Vreeland Road Property

Tom Freeman, retired WCPARC deputy director who now serves as a consultant, presented a report to support his recommendation, and that of ALPAC, that WCPARC purchase a conservation easement on the Bloch property – 129 acres in Superior Township at the southeast corner of the LeForge and Vreeland Roads. At their meeting on Dec. 10, 2013, commissioners had authorized staff to prepare a purchase offer for the conservation easement.

Freeman highlighted what he and NATAC found as the most valuable features. First, although the land is primarily in active agricultural use, it holds a seasonal stream that flows into the nearby west section of WCPARC’s Meyer Preserve, and has wetlands along Vreeland Road on the north edge of the property. Second, preserving the agricultural use of the property will serve to buffer the Meyer Preserve. A farmer will, Freeman said, buy the property and continue to use it for agricultural purposes.

Freeman reported that Bosserd Appraisal Services had valued a conservation easement on the property at $613,500, or $4,750 per acre; that Mannik & Smith group had done a phase 1 environmental assessment and did not identify any significant environmental concerns; and that the county had a boundary survey, legal description, and sealed survey drawing.

NAPP: Bloch/Vreeland Rd. Property – Commission Discussion

Robert Marans, WCPARC  president, asked why this conservation easement was being purchased by NAPP when the land is agricultural. Freeman answered that the existence and importance of the stream justifies using some of the 25% of NAPP’s money that can be used to purchase conservation easements on agricultural land.

Commission member Evan Pratt, who also serves as Washtenaw County water resources commissioner, asked whether WCPARC could require buffers along the stream. Yes, Freeman replied – the easement gives WCPARC the right to work on a management plan using guidelines from the National Resources Conservation Service [formerly known as the U.S. Soil Conservation Service].

Outcome: Unanimous approval of the recommendation to purchase a conservation easement on the Bloch/Vreeland Road property in Superior Township for $613,500.

NAPP: Rogers Property

Freeman also made the presentation for this recommendation, supported by ALPAC, to contribute $95,731 toward the purchase of a conservation easement on the Rogers family property in York Township. The property consists of three parcels located along the east and west sides of Saline-Milan Road at Judd Road. Together, the parcels comprise 157 acres.

Freeman explained the proposed arrangement. Because the Legacy Land Conservancy already holds easements on other nearby Rogers properties, the conservancy would hold this conservation easement too. The conservancy has obtained an award from the federal Farm and Ranchland Preservation Program (FRPP) for 39% ($88,734) of the price. The owner, Kendall Rogers, is willing to contribute another approximately 19% ($43,859), leaving $95,731, which Freeman recommends WCPARC provide. That amount works out to $1,449 per acre.

The justification for the purchase is to increase the total amount of protected acreage in the area to 725 acres. Freeman explained that WCPARC could set guidelines for the owner to ensure that the use of the land continues to be a positive influence on water quality.

NAPP: Rogers Property – Commission Discussion

Discussion focused on the details of the financial arrangement, and the question of why conservancy, which is not contributing anything to the proposed purchase, would hold the easement.

Freeman explained that WCPARC staff and ALPAC agreed to that arrangement because the Legacy Land Conservancy already holds easements on nearby properties, and because that nonprofit had obtained the FRPP grant, which would contribute toward the purchase price. Should the conservancy cease to exist, Freeman assured the commission, the easement would go to WCPARC.

Outcome: Unanimous approval of the recommendation that WCPARC contribute $95,731 toward the purchase of a conservation easement on the 157 acres of Rogers Property in York township, said conservation easement to be held by Legal Land Conservancy.

East County Recreation Center

A proposal to build a new recreation center on the east side of Washtenaw County, in downtown Ypsilanti, began over two years ago. It contemplates a partnership between the city of Ypsilanti and WCPARC in which the city would supply the property and WCPARC would provide the building. The Ann Arbor Y would then contract with WCPARC to manage the center, which would be located on part of the 38-acre Water Street redevelopment area. [For additional background, see Chronicle coverage from WCPARC's Dec. 10, 2013 meeting.]

Coy Vaughn, WCPARC’s deputy director, presented a summary of the proposed purchase and development agreement between the city of Ypsilanti and WCPARC. Commissioners had been briefed on the basic features of the agreement at their Dec. 10, 2013 meeting.

This was not an action item for WCPARC, but rather a review of the basic terms of the agreement and the changes under consideration. [.pdf of staff memo and draft agreement]

Vaughn reminded commissioners that there would be a second agreement, between WCPARC and the Ann Arbor YMCA, for the Y to manage the rec center after WCPARC builds it. Some of the proposed changes came at the request of the Y, he said.

Vaughn’s presentation reviewed what he had detailed in December:

  • Exact location and size of the parcel: 4.1 acres on the northwest corner of Water Street site, adjacent to Michigan Avenue and the Huron River, plus a 100-foot greenway.
  • Purchase price: $1, plus WCPARC’s contribution of infrastructure worth a total of about $900,000, including a border-to-border trail worth $650,000.
  • Size and orientation of the building: 45,000-50,000 square feet on Michigan Avenue with no more than a 10 foot setback. Pedestrian access across the site to the river.
  • The proposed site plan and building design: Building at least 35 feet tall; entrances from the parking lot, from Michigan Ave., and from the B2B trail.
  • Timeline for approvals, permits, and construction: Allows 270 days to secure all governmental approvals and closing within 30 days of approvals; termination clause if WCPARC can’t secure approvals or is not satisfied with the condition of property. Construction to start within 6 months of closing and be complete within two years.
  • Plan for infrastructure development beyond the parcel footprint: Vaughn stressed the flexibility to modify the parcel configuration and infrastructure, if opportunities arise to coordinate with a developer.
  • Roles and responsibilities: the city of Ypsilanti will maintain the linear park and trail. WCPARC will build Parsons Street and Water Street.
  • Terms of parcel transfer, and legal responsibilities for the development and opening of the recreation facility were also outlined.

Vaughn also briefly described the proposed changes to the agreement. Highlights included putting parking in the rear of the site; constructing all streets to city standards, including sidewalk and street trees; providing appropriate easements for pedestrian access across site; allowing flexibility for parking configuration and number of spaces; inserting language to prohibit future fitness centers on the site (a restrictive covenant); and adding a requirement to follow the local zoning ordinance.

East County Recreation Center – Commission Discussion

Discussion began with the proposed requirement to follow local zoning ordinances, with Vaughn saying that the county’s legal counsel had problems with it.

Dan Smith – a Republican who also serves as a county commissioner, representing District 2 – pointed out that the county doesn’t have to follow city zoning codes. These issues often relate back to costs, he said, because zoning compliance can add to the project’s costs. All taxpayers across the county will incur costs for this recreation center, he added, “and I’m not keen on it costing more to make Ypsi happy.” He was hesitant to agree that the county would unequivocally commit to following the city’s zoning.

WCPARC director Bob Tetens indicated that the entire Water Street site would probably be a planned unit development (PUD). [This type of zoning designation is in a sense customized, with zoning agreements developed specifically for a particular project. More information about Ypsilanti’s zoning map and ordinances is available on the city's website.]

Discussion then turned to timing. Tetens said he had talked to the YMCA, and it’s important to them to have a soft opening in December 2016 and the real opening in January 2017 for maximum membership. To achieve that, he continued, “We have to get going in the next two to three months.”

Commission member Jan Anschuetz asked whether WCPARC would put a proposal on the ballot this year for renewal of the county’s 10-year parks & rec operations millage. Tetens said yes, but that a proposal has not yet gone to the county board of commissioners. Any millage or bonding proposal must be put on the ballot by the county board.

The countywide parks & rec operations millage is a 10-year, quarter-mill tax that was first approved in November 1978, and subsequently renewed in 1984, 1994, and 2004. The current millage expires on Dec. 1, 2016. Typically, a renewal proposal is put on the ballot two years before the existing millage expires. Tetens indicated that it’s important to know if that millage funding will be available, prior to building the east county rec center.

As for the rec center, Tetens indicated there was no need to seek board approval until after bids for the project were in, likely next year. Waiting until next year also would “get it away from an election year, so it will not be a hot potato,” he said. Finally, he explained that the project needs hard numbers before being presented to the board.

Bob Marans – a professor emeritus at the University of Michigan’s Taubman College of Architecture and Urban Planning – brought up the issue of architect selection for this major project. Vaughn said that staff were thinking of a national search. Tetens added that there would be multiple presentations from potential architects, and that there would probably be teams of architects with different specialties.

Tetens said the agreement with the YMCA had to be finalized, with the help of a person from the national Y who looks at the numbers and helps with the agreement. He hopes to have a memo of understanding with the Y before WCPARC’s March meeting. All of these items will come back to the March WCPARC meeting.

Outcome: This was not a voting item.

Connecting Communities

Commissioners received a separate packet consisting of a background memo on the Connecting Communities program, and copies of five applications for funding, which covered six proposed projects. [.pdf of staff memo] [.pdf of applications]

According to the staff memo, in May 2009 WCPARC authorized the Connecting Communities initiative, through which it would make up to $600,000 available annually from 2010 through 2014 – a total of $3 million – toward the cost of eligible trail projects. According to the memo, “eligible projects will be those that accomplish the Commission’s primary objective of providing valuable non-motorized connections between communities and activity centers, offering a healthy alternative for recreation, transportation, fitness, and energy conservation.” Grant recipients have two years to fulfill any contingencies, such as acquiring grants from other organizations.

By way of background specific to Ann Arbor, the city was granted $300,000 in 2013 (of total cost of $1 million) for 1,500 feet of trail, part of a project for the “development of pathways, storm water features to improve the quality of Allen Creek…on property which will serve as a trailhead for the proposed Allen Creek Greenway.” The site includes city property at 721 N. Main. Paths will connect Felch Street to both North Main and west Summit Street. The proposal stated that the city would also apply for a match from the Michigan Dept. of Natural Resources Trust Fund (MDNRTF), and that the city would consider using the adopt-a-park program to help maintain the facility. The grant required success with the MDNRTF, but the city’s application in 2013 failed. The city has another year to try again.

WCPARC developed criteria for selecting projects, which include 10 primary considerations. Among those considerations are projects that provide important links between communities, parks and other points of interest, that are adjacent to waterways, or that are major multi-jurisdictional efforts. There are 14 types of projects that generally are not eligible, such as trails solely within existing local parks.

Applicants must document a compelling need for a project, and there are six criteria that are used to evaluate the projects. For example, projects are evaluated based on whether they directly relate to the county’s important natural features, such as a river. The Huron River corridor is WCPARC’s highest priority. Five secondary criteria – such as land availability, or the likelihood of funding from other sources – are then applied to high-ranking projects.

The process for selecting projects to be funded involves a staff review of the applications. The projects are then presented to the Greenways Advisory Committee, which provides input that staff uses to prioritize the applications and make recommendations to WCPARC for final approval.

Connecting Communities: Summary of Applications

The applications for 2014 include:

  • Ann Arbor Township: $300,000 (of total cost of $1.2 million) for two miles of pedestrian and bicycle trail connecting Parker Mill and Plymouth Road along Dixboro Road, to connect to the Parker Mill trail at Geddes and Dixboro on the south, and the proposed trail from Plymouth/Dixboro to Main Street/Cherry Hill on the north. The application states that other confirmed project funders include $600,000 in private donor matching funds; and potential project funders include the Michigan Dept. of Natural Resources Trust Fund, the Washtenaw County Road Commission, the Michigan Dept. of Transportation alternatives program, and additional private donors. The township has received no previous grants from the Connecting Communities program.
  • Village of Manchester: $150,000 (of $225,000 total cost) to improve an existing rail bed owned by the village into a walking/biking trail traversing the entire community and linking several parks, businesses, schools, and neighborhoods. The 13.4 acres of village-owned land has a value of at least $200,000. The Chelsea Area Wellness Foundation will provide $100,000, and the Kiwanis Club of Manchester another $2,000. Potential additional funders include community fundraising and private donations; and grants such as the Moving Ahead for Progress in the 21st Century Act (MAP-21); Transportation Alternatives Program (TAP) and Surface Transportation Program (STP), which are both programs of the Federal Highway Administration in the federal Dept. of Transportation; and the Rails to Trails Conservancy. The village has received no previous Connecting Communities grants.
  • Northfield Township: $260,000 (of $600,000 total cost) for 2,925 feet of trail along Barker Road in Whitmore Lake, connecting Whitmore Lake’s downtown with the Northfield Township Library and Whitmore Lake Elementary School. This is the third phase of a project that received $120,000 in 2010 and $250,000 in 2011. Other confirmed project funders are $60,000 from Northfield Township, $60,000 from the Whitmore Lake Downtown Development Authority, $1,000 from the Northfield Area Chamber of Commerce, and $1,000 from the Kiwanis.
  • Pittsfield Township: $400,000 (of total cost of $1.9 million) for 1.8 miles of trail, phase 2 of the Lohr-Textile greenway, extending it east from the corner of Lohr and Textile, on Textile, to the Marshview Meadow Park and the Pittsfield Preserve. Grants from WCPARC’s Connecting Communities project to the township were $300,000 in 2010; $290,000 in 2011; and $150,000 in 2013. Other potential project funders include MDNRTF ($300,000) and MDOT/SEMCOG ($1,064,708). Other confirmed funding is from Pittsfield Township (up to $400,000); and MDOT/SEMCOG ($1,064,708).
  • Ypsilanti Township: $240,000 for two projects totaling 3,032 feet (total cost of $240,000). One project (2,032 feet) would run along the east side of Tuttle Hill Road from Textile Road north across South Huron River Drive and into Ford Lake Park. The other (1,000 feet) would run on the south side of Textile from just east of South Huron River Drive to the entrance of Lakeview mobile homes. The township received $100,000 in 2010 and $250,000 in 2011, and has pledged $80,000 for project engineering.

Connecting Communities – Commission Discussion

Commissioner Jan Anschuetz commented on how difficult it would be to decide which projects get funded. She noted the popularity of new trails in Dexter, and asked whether WCPARC should authorize an extension to the Connecting Communities program.

WCPARC director Bob Tetens replied that all surveys show an 80% approval for trails. He said it would be worth discussing whether to continue the program, but noted that there are many elements to consider, such as the millage renewal and the retirement of debt on the Meri Lou Murray Recreation Center proposed east county recreation center.

Outcome: There was no vote. WCPARC staff expects to make recommendations to the commission at the March 11, 2014 meeting.

Communications & Commentary

Each WCPARC meeting includes opportunities for public commentary, as well as various communications from staff and commissioners. Here are some highlights.

Communications & Commentary: Deer Damage

There is seldom public commentary at WCPARC meetings, although time is set aside at the start of each meeting for that purpose. Three people attended the February meeting, giving a coordinated presentation to call WCPARC’s attention to the great damage being done by white tailed deer to the natural environment – flora, fauna, and water quality – which it is WCPARC’s mission to protect.

The first speaker was Toni Spears of Webster Township, making a second visit to talk to WCPARC about deer management in natural areas. She reminded the commission that its mission is to manage its land for the benefit of all native species and to maintain a diverse native plant population in the whole complex ecosystem. The Leonard Preserve, she said, had a deer population of over 200 per square mile, and the area from which deer are excluded has significantly more diverse life than the rest. [The Leonard Preserve is the county’s largest natural area, with 259 acres and a mile of the Raisin River.]

Outside of the deer exclosure, deer browsing on native plants has allowed invasives to thrive, frustrating WCPARC’s ability to eliminate invasives. Noting that the Huron-Clinton Metro Parks have protocols for deer management, Spears asked WCPARC to develop a long-term sustainable deer management program. She suggested starting with an assessment of the deer population this winter and developing a target level, perhaps starting with one natural area, culling the herd, and donating the harvest to those in need. “We know others will disagree,” she concluded, “but we are animal rights activists for all species. We want all to thrive. We want you to manage your property for the health of all native flora and fauna. The deer deserve to be in a healthy ecosystem.”

Andrea Matthies, the second speaker, owns five acres in Scio Township and is a master rain gardener. [Matthies is current chair of the Ann Arbor chapter of WildOnes.] She spoke of her unfulfilled hope, when she moved to the property, to create a paradise for native small mammals and birds. The deer, she said, are numerous and utterly fearless. She hired people to bow hunt and in the last 15 years the hunters have killed 100 deer on her five acres. She pointed out the damage done by car-deer collisions and Lyme disease, which she said is a major problem in every county in the state and more serious than most people think. [The Centers for Disease Control reports three cases in Michigan in 2003, increasing to a probable 98 cases in 2012.] The third danger deer pose is to spread chronic wasting disease, she said. [The state of Michigan has a website on CWD.]

The third speaker, Maurita Holland, is a master gardener and master rain gardener who once lived on 15 acres near Ann Arbor. She said she would invite hunters to cull deer there. She now lives in Ann Arbor’s northwest side on property through which Newport Creek runs. Her concerns include water quality. She noted that deer destroyed her rain garden last summer, which is especially unfortunate because her land drains 20 acres of neighboring land and the deer have ruined her efforts to filter the runoff.

In addition to eating her native plantings, the deer browse viburnum, and nine deer bed down in her yard. They eat holly through the netting she hoped would keep them away; since they can’t digest it, they vomit it. A deer died in her yard this year and she paid $300 for its removal. Deer dug up daffodil bulbs right after she planted them, even though they won’t eat daffodils. Holland closed by reminding WCPARC that county residents want protection, preservation, and management of natural resources and improvement of water quality. She asked: “Can we work together to accomplish some of these important goals?”

Communications & Commentary: Deer Damage – Commission Discussion

Bob Marans began by stating that the county board of commissioners is beginning to address this issue. Dan Smith, who also serves on the county board, added that there would be a working session on issues about deer, with a presentation by Timothy Wilson from the U.S. Dept. of Agriculture. [That session occurred on Feb. 20, 2014.]

Marans added that the Huron-Clinton Metropark Authority has done a survey and will do more. Jan Anschuetz raised a new issue in response to the concept of sharpshooters or bow hunters culling the herd: Is it legal to hunt on county land?

As background, county ordinance 128  – which established the NAPP program and assigned WCPARC to manage NAPP – begins with a “declaration of purpose” that includes this statement: “Passive recreation would be appropriate use of this land.”

The section on definitions includes this statement:

“Passive Recreation” means walking, jogging, bird watching, nature studies, quiet picnicking and other quiet inactive pastimes.

The discussion at WCPARC included some speculation about whether culling the herd would be “hunting,” or whether it would be carrying out the requisite “stewardship” of the land in the manner suggested by the three speakers.

Marans said he was anxious to know what the board of commissioners is thinking. He indicated that he’d like to know more about this from staff at the next meeting, and to know what the managers of the natural areas think.

Outcome: This was not a voting item.

Communications & Commentary: New, Outgoing Commissioners

Bob Marans invited the newest commission member, Dan Ezekiel, to talk about his expectations. Ezekiel expressed delight at joining WCPARC, adding that no one can replace Nelson Meade. [Meade, who has served on WCPARC from its formation in 1973, retired in December of 2013.]

Ezekiel said he has followed WCPARC by reading reports in The Chronicle, and that he has worked with Tom Freeman in the past. [Ezekiel formerly served on the Ann Arbor greenbelt advisory commission. He was appointed to WCPARC at the county board's Jan. 22, 2014 meeting.] Ezekiel described himself as an intrepid biker who commutes daily, with gloves and studded tires.

Jan Anschuetz thanked WCPARC staff for the wonderful party to honor Nelson Meade.

Communications & Commentary: Misc. Issues

Commission members discussed a letter that some of them, but not all, had received from residents along Jennings Road, which leads to Independence Lake Park. Concerns in the letter included the safety, trees, and drainage related to work the county road commission will undertake. Evan Pratt, who also serves as the county’s water resources commissioner, described the drainage problems caused by the soil, which is makes handling stormwater difficult and requires a ditch.

Marans reported that he, Anschuetz and Pratt will meet with deputy director Coy Vaughn to discuss the goals and objectives for WCPARC’s five-year revised master plan.

Financial Reports

Each month, staff provide several different financial reports to WCPARC, focused on the past month’s expenses (the claims report), monthly and year-to-date reports on expenses and revenues in the form of fund balance reports, and a listing of major non-recurring expenses when they are significant.

There are separate reports on parks and facilities, and on the natural areas preservation program (NAPP), which includes preservation of agricultural lands. Each of these has its own, separate funding, although WCPARC administers all of these programs.

Because there was no January meeting, the February meeting received reports for the last month of the 2013 fiscal year, and for January, the first month of the 2014 fiscal year. [WCPARC’s fiscal year is the calendar year.]

Financial Reports: Claims Report

Parks and facilities paid a total of $350,649 in December, and $86,343 in January. Most of those expenses were for capital improvements, primarily at the Meri Lou Murray Recreation Center, Rolling Hills and Independence Lake parks, plus a $75,000 contribution to Ypsilanti’s Rutherford Pool project.

NAPP claims far exceeded that with $1,445,807 in December, but only $1,390 in January. The NAPP expenses were almost entirely the cost of completing previously approved purchases of the Carr, Lippert, and Ramsey properties, a total of 235 acres in Northfield Township. [.pdf of NAPP claims]

Financial Reports: Fund Balance – Parks and Recreation

WCPARC director Bob Tetens introduced this report by saying that the fund balance was in good shape – revenues exceeded the budget, and expenses were 89% of what was budgeted.

The fund balance started the year at $12,950,815. As of Dec. 31, 2013, revenue totaled $9,917,338 – primarily from property taxes ($6,462,980) and fees and services ($3,384,207). Expenses for the year were $12,346,903. In addition, the parks budget includes an operating reserve of $6.7 million and ”partnership” funding commitments of $925,000. January 2014 began with a fund balance of $10,521, 250. [This is the total of the $3,146,250 fund balance on Dec. 31, 2013, plus the $6.7 million operating reserve and the $675,000 committed to funding partnerships.] Revenue as of Jan. 31, 2014 was $1,044,922 with expenses of $309,048. The projected fund balance at the end of 2014 is $3,737,124.

Financial Reports: Fund Balance – NAPP

The December report showed a Jan. 1, 2013 fund balance of $10,263,644. Through Dec. 31, 2013, revenue was $3,547,655  and expenses were $6,615,388. The projected fund balance for NAPP at the end of 2013 was $7,195,911. [.pdf of December 2013 NAPP fund balance]

The January report started with the fund balance of $7,195,911 and showed revenue of $453,208. Expenses totaled $27,474, for a projected fund balance at the end of 2014 of $7,621,645. [.pdf of January 2014 NAPP fund balance]

There was no substantive discussion of the reports.

Outcome: WCPARC unanimously voted to receive, accept, and file the financial reports.

Recreation Reports

These monthly reports include attendance at WCPARC facilities where attendance can be counted, with information about participation in measurable activities and revenue received at those facilities. The reports include the current year-to-date summary as well as similar information for the prior two years.

Recreation Reports: Meri Lou Murray Recreation Center

In December at the Meri Lou Murray Recreation Center, year-to-date participation as of Dec. 31, 2013 was 322,999 and revenue was $1,2274.466. In 2012, year-to-date participation was 324,817 and revenue was $1,163,354. In 2011, participation was 339,946 and revenue was $1,244,466.

As of Jan. 31, 2014, participation was 28,311 and revenue was $144,393. In 2012, the comparable numbers were 33,151 and $156,018. In 2012, participate was 34,901 with revenue of $142,232. [.pdf of MLM rec center report]

Recreation Reports: Pierce Lake Golf Course

As of the end of December 2013, 17,021 people had paid greens fees totaling $373,131 at Pierce Lake Golf Course. In 2012, the golf course served 19,278 people with revenues $399,049. In 2011, attendance was 15,836 with revenues of $346,049. [.pdf of Pierce Lake report]

Programming and retail operations brought in $590,975 in 2013. That compares to $110,589 in 2012; and $89,523 in 2011. Thus, total revenue in 2013 was $590,975, compared to $614,620 in 2012 and $526,501 in 2011.

There was no report for January 2014.

Recreation Reports: Rolling Hills Park and Water Park

There is an entrance fee, and gate count, for everyone who enters Rolling Hills Park. There is a separate fee, and gate count, for those who go on to enter the water park there. [.pdf of Rolling Hills report]

As of Dec. 31, 2013, 30,attendance was 836 with revenues of $241,038 for Rolling Hills Park. That compares to attendance of 34,786 people in 2012 and revenues of $268,288. In 2011, attendance was 34,844 with $267,130 in revenues.

The water park recorded higher attendance: 94,266 people bringing in $715,239 in 2013; 114,522 people in 2012 and revenues of $780,122; and 115,012 people in 2011 with revenues of $780,995.

Total revenue for all operations at Rolling Hills was $1,205,355 in 2013; $1,322,531 in 2012; and $1,310,515 in 2011. There was no report for January 2014.

Recreation Reports: Independence Lake Park and Blue Heron Bay

Blue Heron Bay is a water-feature area separate from the rest of Independence Lake Park. Because Blue Heron Bay opened in 2013, there are no comparisons to earlier years. [.pdf of Independence Lake/Heron Bay report]

As of Dec. 31, 2013, attendance was 15,437 with revenues of $122,363 for Independence Lake Park. In 2012, attendance was 17,743 with $137,217 in revenues; compared to 2011 attendance of 157,019 and revenues of $132,602.

Attendance at Blue Heron Bay was 17,668, for $69,787 in revenues. Total revenue for all of Independence Lake Park was, through December, $295,718 in 2013; $211,578 in 2012; and $209,960 in 2011. There was no report for January 2014.

Outcome: The recreation reports were received and accepted for filing unanimously.

Projects and Activities

Staff of WCPARC provide monthly updates to commissioners about ongoing improvements at facilities, and activities at parks and natural areas. Some of this information is provided in writing in the board packet; more is provided with visuals and informal commentary. This report summarizes the most significant items at the February meeting.

  • Rolling Hills Park: Construction bid documents to repair the Lazy River’s water leaks, drain cover compliance changes, and reconstruction of the stairs to Slide Mountain have been released and bids were due on Feb. 18. Eight bids were received to repair concrete walkways throughout the water park, and staff is reviewing the three lowest bids.
  • Ann Arbor skatepark: City of Ann Arbor staff had scheduled a meeting with the contractor for Feb. 18, 2014, to develop a timetable for the remaining construction work. A grand opening for June 21, 2014 is in the planning stages.
  • Staebler Farm: Staff began preparation of an application to the DNR for an Michigan Natural Resources Trust Fund (MNRTF) grant to develop the northern portion of the farm as a recreation-based park.
  • Border to Border Trail (B2B): The Michigan Dept. of Transportation is reviewing staff plans for the final 1/8-mile of the River Terrace Trail in Dexter. The project agreement for the MNRTF 2011 grant to the city of Ypsilanti to bridge the Huron River, cross Michigan Ave., and construct a fishing pier and connecting trails was executed, and WCPARC authorized design of the bridge and crossing. The Washtenaw Area Transportation Study (WATS) continues to lead the effort to produce revised and new maps for the B2B trail route.
  • Natural areas stewardship: A conservation plan for the agricultural portion of the Trinkle Marsh Preserve is in preparation for the Natural Resources Conservation Service.
  • WCPARC master plan: Staff have completed a preliminary draft and will hold public meetings in Ypsilanti, Dexter, Chelsea, and Saline in April.

Officer Elections

The nominations committee – Nelson Meade, Evan Pratt, and Rolland Sizemore Jr. – nominated Robert Marans to continue as president and Patricia Scribner as vice president. Jan Anschuetz was nominated as the new secretary-treasurer, replacing Nelson Meade, who retired from WCPARC in December 2013.

There were no competing nominations.

Outcome: Commissioners unanimously elected their slate of officers.

Yousef Rabhi, chair of the board, appointed Alma Wheeler Smith to fill an opening in the RTA. Richard Murphy – one of two RTA board members from Washtenaw County – was not seeking reappointment. The deadline to apply for this opening had been extended, but there were only two applicants. The other applicant was Jim Casha, but as a Canadian resident he was ineligible to be appointed for the seat to represent Washtenaw County. The RTA state enabling legislation (Act 387 of 2012) mandates that board members must be residents of the county or city that they represent.

Alma Wheeler Smith, a former state legislator, is the mother of county commissioner Conan Smith (D-District 9). Her term will be for three years, ending Dec. 31, 2016. She attended a portion of the Jan. 22 meeting but did not formally address the board. Conan Smith abstained from the vote, citing what he called a perceived conflict of interest. Because of that, he said, “I did my best to stay out of [the selection process], passionate though I am about the RTA and my mother.” Although the state statute authorizes the county board chair to make the RTA appointments, Rabhi put forward a resolution for all of his nominations – including the RTA – to be confirmed by the full board.

By way of background, the RTA was established by the state legislature in late 2012. It includes a four-county region – Macomb, Oakland, Washtenaw and Wayne – with each county making two appointments to the board, and the city of Detroit making one.

The county board chair appoints both of Washtenaw County’s members to the RTA board. Those appointments were first made at the end of 2012 by Conan Smith, who was chair through the end of that year. Liz Gerber, a University of Michigan professor of public policy, was appointed to a three-year term. Murphy, who works for Smith at the Michigan Suburbs Alliance, was appointed to a one-year term.

In other appointments made on Jan. 22, Dan Ezekiel was appointed to fill a term that was recently vacated by long-time county parks & rec commissioner Nelson Meade, who stepped down at the end of 2013. Ezekiel was one of the founding members of the Ann Arbor greenbelt advisory commission. His most recent term ended in mid-2013. He was term limited for that position. For the county parks & rec commission, Ezekiel’s term ends on Dec. 31, 2016. He also attended the Jan. 22 county board meeting, but did not formally address the board.

Jeremy Seaver and Sara Simmerman were appointed to the Washtenaw County food policy council, for terms ending Dec. 31, 2015.

The board also made its annual appointments of county commissioners to various boards, committees and commissions. In addition, during the Jan. 22 meeting the board created a new committee to explore the cost to the county for providing employee health insurance coverage for autism. Members of that committee are Felicia Brabec (D-District 4), Ronnie Peterson (D-District 6), and Andy LaBarre (D-District 7). The board had received a staff presentation earlier in the evening about the possibility of offering coverage for autism.

In addition to their salaries, commissioners receive stipend payments based on the number of meetings that a commissioner is likely to attend for a particular appointment. One or two meetings per year would pay $50, three or four meetings would pay $100, and the amounts increase based on the number of meetings. Each commissioner typically has several appointments. Commissioners who are appointed as alternates receive the same stipend as the regular appointments. Some appointments were not designated to be paid because no meetings were expected to be scheduled.

Commissioners can waive their stipends by giving written notice to the county clerk. Otherwise, the stipend payments are made automatically.

In 2013, only Dan Smith (R-District 2) waived all of his stipends, according to the county clerk’s office, which administers the stipends. Felicia Brabec (D-District 4) waived her stipend for the accommodations ordinance commission. Ronnie Peterson (D-District 6) was not appointed to any boards, committees or commissions and therefore did not receive any stipends.

For 2013, the following stipends were paid:

  • Yousef Rabhi (D-District 8): $2,700 (11 paid appointments, including several stipulated by virtue of Rabhi’s position as board chair, plus 3 unpaid appointments)
  • Rolland Sizemore Jr. (D-District 5): $2,350 (11 paid, 2 paid alternates, 1 unpaid)
  • Conan Smith (D-District 9): $1,800 (6 paid, 2 paid alternates, 1 unpaid)
  • Felicia Brabec (D-District 4): $1,450 (8 paid, 1 alternate with stipend waived)
  • Kent Martinez-Kratz (D-District 1): $800 (4 paid)
  • Andy LaBarre (D-District 7): $550 (3 paid, 1 unpaid)
  • Alicia Ping (R-District 3): $400 (2 paid, 2 unpaid)

In total, seven commissioners were paid $10,050 in stipends for 2013. There is no mechanism in place for validating attendance, other than checking the meeting minutes of these various groups. No one is designated to do that, however.

To commemorate his service, commissioners passed a resolution to rename the County Farm Park in Meade’s honor. The 141-acre park is at the southwest corner of Washtenaw Avenue and Platt Road in Ann Arbor, where WCPARC’s Meri Lou Murray recreation center is located. The meeting also included a video of remarks by county commissioner Ronnie Peterson, who described Meade as “a man of few words but unquestionable commitment.”

Applications are being accepted for Meade’s replacement on WCPARC, with a deadline of Jan. 12. The appointment will be made by the county board of commissioners.

Most of WCPARC’s other main action items related to potential acquisitions through its natural areas preservation program. The commission took the first step toward acquiring title or conservation easements on five parcels of land. Those properties include: (1) the 6.4-acre Heumann property on the west side of Sylvan Township, west of the Chrysler proving grounds with access from Sylvan Road south of old US-12; (2) 129 acres of the Bloch-Vreeland Road property, at the southeast corner of Leforge and Vreeland Roads in Superior Township; and (3) three parcels on Marshall Road in Scio Township, in partnership with the Scio Township land preservation program.

Action to finalize acceptance of a donation of the 10-acre Geddes Mill Ltd. property in Ann Arbor Township – valued at $1.27 million – was postponed pending completion an environmental assessment. The property is on the north side of the Huron River, immediately east of the US-23 northbound off ramp. There is a bit of frontage on both Dixboro Road to the east and Geddes Road to the north.

Items not requiring action included updates on the proposed Eastern County Recreation Center on Michigan Avenue in Ypsilanti, with details about terms of a development agreement as well as the latest proposal for site development. Updates also included a status report on the Ann Arbor skatepark. Construction is now 65% complete, but work has ceased for the winter.

The Nelson Meade County Farm Park

The December meeting was the last for Nelson Meade, and the meeting was preceded by an informal supper in honor of Meade’s more than 40 years of public service, with focus on his role in establishing WCPARC and serving on the commission from its beginning in 1973.

Meade had announced his plans to step down from WCPARC at its Nov. 12, 2013 meeting. A party in his honor was held at WCPARC headquarters on Dec. 6, and the county board of commissioners had honored him at their Dec. 4, 2013 meeting.

Meade served as president of WCPARC for over 14 years and is currently its secretary. During the Dec. 10 meeting, commissioners passed a resolution honoring him, which commission member Jan Anschuetz read. It referred to his energy and enthusiasm in a wide range of community service, including terms on the Ann Arbor city council and city planning commission, the Packard Community Clinic, and his involvement in starting the nonprofit Project Grow.

Meade appeared surprised and touched by the conclusion of the resolution: “Now therefore be it resolved, that the Washtenaw County Parks and Recreation Commission, in a respectful tribute to the lifelong dedicated public service of Nelson Meade, hereby renames County Farm Park in his honor – the Nelson Meade County Farm Park.”

The presentation included a video of Washtenaw County commissioner Ronnie Peterson praising Meade’s ability to “work closely and respectfully with others to create one of the best park systems in the state.” Peterson described Meade as “a man of few words but unquestionable commitment.” He said that the late Meri Lou Murray – after whom the recreation center in the County Farm Park is named, and who was a county commissioner during the creation of the park system – took Peterson aside when the county was having financial difficulties to tell him “no matter what else you wreck, don’t hurt Nelson Meade.”

Outcome: Commissioners unanimously passed the resolution recognizing Nelson Meade and his service, and naming the County Farm Park in his honor.

Eastern County Recreation Center

This project to build a new recreation center on the east side of Washtenaw County began almost two years ago. It contemplates a partnership between the city of Ypsilanti and WCPARC in which the city would supply the property and WCPARC would provide the building. The Ann Arbor Y would then contract with WCPARC to manage the center, which would be located on part of the 38 acre Water Street redevelopment area. [For additional background, see Chronicle coverage from WCPARC's November 2013 meeting.]

Eastern County Rec Center: Site Planning Update

Coy Vaughn, deputy director of WCPARC, updated commission members on this project. He told commissioners that the presentation would be similar to what he and Craig Borum would present to the Ypsilanti city council on Dec. 17, 2013. Vaughn reviewed the background of this project, which began about two years ago. He said that WCPARC has long wanted a recreation center for the eastern side of the county, and that it made sense to put it where the most people are, in downtown Ypsilanti, adjacent to the Huron River and the proposed extension of the Border-to-Border (B2B) trail  which now terminates in an overlook at Ypsilanti’s Riverside Park.

The plan is to extend the trail across the river and Michigan Avenue, through the Water Street site, to Waterworks Park and eventually to Grove Street – an idea first presented in the Olmsted Brothers 1913 plan for the city. Vaughn noted that the Michigan Dept. of Natural Resources trust fund has provided two grants for this part of the trail, and that the city of Ypsilanti recently closed the purchase of a triangular piece of property from Fischer Honda for one end of the bridge over the Huron River from Riverside Park. He hoped that WCPARC could work with the Y to provide outdoor recreation on the site, such as a soccer field.

Vaughn’s slides of the current site plan showed a 100-foot-wide greenway, which would hold a 10-foot-wide asphalt trail for non-motorized use. Ypsilanti’s master plans, he said, have for the last 20 years shown such a greenway.

The initial plans for the rec center showed a 12-acre site with 400 feet of frontage along Michigan Avenue, but this has now been pared down. The current proposal is for 4.1 acres (about 300 by 620 feet), or 5 acres including the greenway. By comparison, the Ann Arbor Y sits on about two acres, Vaughn noted. The presentation indicated a plan for future residential use on the southern 75% of the rest of the Water Street site, and future mixed use along Michigan Avenue.

Vaughn highlighted the purpose of the project: that WCPARC and the city would make an investment that would attract private developers, and that is happening because WCPARC has used a very public process, he said. Although interest has increased, there are no real solid proposals from the private sector yet, he concluded.

Craig Borum of PLY design – who also is a professor of architecture at the University of Michigan’s Taubman College of Architecture & Urban Planning – then described the building in more detail. [Jen Maigret and Maria Acquero, also on the Taubman College faculty, attended and have helped with the plan, but they did not speak to the commission. The design won a 2013 honor award from the American Institute of Architects for an unbuilt project.] Borum’s presentation was essentially the same as the one made at a public presentation in September 2012. The most significant change is that the building now being proposed would be about 45,000 square feet. The original proposal was for one about 10,000 square feet larger. The downsizing reflects a Y-sponsored survey about potential membership, which indicated support for a smaller facility.

Borum emphasized that his team had worked with staff from WCPARC and the city of Ypsilanti, so that “now everyone is happy with the location we’re proposing.” There will be parking for 152 cars in a lot that has generous landscaping and “leading edge” water management, he said. All the streets on the site will have parallel parking. The building will have entrances on three sides all leading to a single entry point. Other features include a running track; exercise facilities; a basketball court; and a swimming pool similar to the one at the Ann Arbor Y.

Borum closed by responding to a question about what the building would look like: “It won’t be a Gary Owen building; that’s one of the worst buildings in the city.” [The Owen Building houses Eastern Michigan University's College of Business at 300 West Michigan Ave.]

Eastern County Rec Center: Update on Development Agreement

The project has always contemplated a development agreement between the city of Ypsilanti and WCPARC. Vaughn’s presentation was the most detailed description to date of the possible terms of the agreement.

Vaughn laid out the major points of the five components of the agreement:

  • Parcel size and location:Defines the parcel size of 4.1 acres and location at the northwest corner of the Water Street site; the 100-foot-wide greenway would be a separate parcel. There is flexibility to modify the parcel configuration or the infrastructure commitment if opportunities arise to coordinate with the developer of adjacent property.
  • Purchase price: WCPARC proposes to purchase for site for $1. According to Vaughn, the city of Ypsilanti has assigned values to all parcels in the site. WCPARC’s offer of $1 is less than what a private entity would pay. To offset that loss, WCPARC will agree to provide funding for the development of the linear park (about $600,000) and construction of streets and utilities (about $300,000). WCPARC is already committed to spend $600,000 on the B2B trail, and the additional site infrastructure could bring its investment to an approximate total value of $900,000. Those values are, he added, still very much an estimate.
  • Building parameters: The building will be approximately 35-feet high. The agreement will also specify the building’s orientation and setbacks. The city wants to continue the qualities in downtown Ypsilanti, such as a 10-foot setback from the street, with variation if needed to accommodate a brownfield hot spot that remains on the site. Parking will be at the rear of the building with an entry at the rear, as well as an entry from Michigan Avenue and from the river side.
  • Infrastructure improvements: The proposed infrastructure improvements associated with the project, specifically water and other utilities and extending Parsons Street west, will be provided by WCPARC and will meet city standards.
  • Timelines: The agreement will include a 270-day contingency period to secure all governmental approvals, including a site plan, zoning approval, and state permits. It provides both parties an “out,” Vaughn said, if at any point approvals aren’t obtained. Construction must start within six months of closing and be done within 24 months.
  • Waiver: Both parties waive the right to seek monetary damages.

Eastern County Rec Center: Commission Discussion

Rolland Sizemore, Jr. – who represents District 5 on the county board of commissioners, which will have to approve the project’s bond funding – said he couldn’t “wait around forever until you ask for the county’s full faith and credit. That has to happen in the first quarter.”

WCPARC director Bob Tetens assured him on that point. Sizemore then asked whether the city was committed to maintain the B2B trail. Tetens said yes, the state Dept. of Natural Resources requires that, and if the city doesn’t maintain the trail, DNR will require return of its funding.

In response to a question from Bob Marans, Tetens said WCPARC staff and the architects had worked closely with city staff, especially planner Teresa Gillotti. Borum added that “the more feedback we get, the better the building will be – a public building should result from a public process.”

Outcome: This was an informational item only. No action was needed.

Natural Areas Preservation Program

The county’s natural areas preservation program (NAPP) is funded by a 10-year countywide millage of 0.2409 mills, which brings in about $3 million annually. Voters renewed the millage most recently in 2010, through 2020. The program enables WCPARC to purchase land worth preserving because of its natural features, and to purchase development rights on agricultural land. The Natural Areas Technical Advisory Committee (NATAC) advises WCPARC on NAPP acquisitions. The Agricultural Land Preservation Advisory Committee advises WCPARC on the purchase of development rights.

NAPP: Geddes Mill Ltd. Property

At the November meeting, WCPARC had authorized staff to perform the due diligence necessary to support accepting a donation of this 10 acres in Ann Arbor Township, located on the north shore of the Huron River south of Geddes Road between US-23 and Dixboro Road. The property was appraised at $1.27 million, and consists of four parcels: five acres, two acres, and two of one acre each.

This matter was on the WCPARC December agenda for final approval, but was pulled from the agenda because the environmental assessment was not yet complete. It will come back when that is done.

NAPP: Heumann Property

County planner Meghan Bonfiglio presented the case for purchasing this 6.4-acre site in Sylvan Township, calling it a “no-brainer” because of its geologic and botanical diversity.

The primary landform is wetland – the parcel is part of a larger wetland system in the area, according to her report. Two upland areas, which Bonfiglio indicated offer excellent viewing points of the wetland, extend into the wetland in two lobes – these are wooded with essentially no invasive plant species.

The property, west of Sylvan Road and south of old US-12, is not far from the county’s Squiers Preserve a bit to the south. Both Squiers and this property are “high value” areas on the Huron River Watershed Council’s bioreserve map. Also, NATAC identified the property as high priority for acquisition.

There was no substantive discussion.

Outcome: A unanimous vote to approve authorizing WCPARC staff to prepare a purchase offer for the Heumann property at a price of $16,000, or $2,500 an acre, contingent upon completion of all necessary due diligence examination of the property and the commission’s final approval.

NAPP: Bloch-Vreeland Road Property

Bonfiglio presented the report on this Superior Township property, 129 acres on the south side of Vreeland Road and the east side of Leforge Road. Most of the land is in active agricultural use, but it holds a number of significant features, she said, including a seasonal stream and wetland areas, especially on the north edge of the property along Vreeland Road.

NATAC has recommended its purchase. The property might seem familiar to commission members, she continued, because in 2010 WCPARC purchased, from the same owner, 40 adjacent acres for the Meyer Preserve immediately east of this property. The proposal is to purchase a conservation easement for $613,500 ($4,750 per acre) on the property, consistent with NATAC’s recommendation.

There was no discussion.

Outcome: Unanimous approval to authorize staff to prepare a purchase offer for a conservation easement on the Bloch-Vreeland Road property in Superior Township at a price of $613,500, contingent upon completion of all necessary due diligence examination of the property and the commission’s final approval.

NAPP: Marshall Road Properties

Bonfiglio continued the NAPP presentation with a description of three contiguous properties in Scio Township north of Marshall Road and east of Baker Road: 70 acres belonging to the Egeler Trust, 20 acres of Sloan property, and 35 acres owned by Dexter Land Holdings. NATAC had recommended the acquisition because much of the property is wooded and has steep slopes, and also has scattered wetlands.

WCPARC director Bob Tetens noted that the woodlot is one of the few remaining in this otherwise developed area. Bonfiglio described the proposal as more complicated than most, involving a partnership with the Scio Township land preservation program. The properties owned by Sloan and Dexter Land Holdings, she said, would be purchased outright by Scio Township for $103,000 and $178,000 respectively; WCPARC would contribute half the cost of each, of $51,500 and $89,000.

Scio Township would purchase on conservation easement on the entire Egeler Trust property and WCPARC would pay half the cost ($45,000) of the easement on 30 acres, a wooded area on the north side, adjacent to the Dexter Land Holdings property.

The total cost to NAPP would be $185,500, she concluded. It would assure that the property is preserved and made available for use by the public as a passive recreation area. Scio Township would assume responsibility for management and stewardship, and WCPARC would have a right of first refusal should the township decide to the sell any of it. The prices are based on appraisals of the three properties.

NAPP: Marshall Road Properties – Commission Discussion

The discussion highlighted Marshall Road’s “natural beauty status,” and the plan to provide access to the otherwise-landlocked Sloan, Dexter Land Holdings, and north side of Egeler properties through a subdivision to the west, and eventually through property now owned by University Bank on the east.

Outcome: Unanimous approval to authorize staff to prepare a participation agreement with Scio Township for protection of the Egeler Trust, Sloan, and Dexter Land Holdings properties at a total cost of $185,500, contingent on completion of all necessary due diligence examination of the property and the commission’s final approval.

Financial Reports

Staff provide several different financial reports to WCPARC each month, focused on the past month’s expenses (the claims report), monthly and year-to-date reports on expenses and revenues in the form of fund balance reports, and a listing of major non-recurring expenses when they are significant.

The December meeting reviewed reports for November. There are separate reports on parks and facilities, and on the natural areas preservation program (NAPP), which includes preservation of agricultural lands. Each of these has its own, separate funding, although WCPARC administers all of these programs. WCPARC’s fiscal year is the calendar year.

Financial Reports: Claims Report

Parks and facilities paid a total of $100,687 during November, according to the claims report. Unlike the last several months, only $15,400 of that was for capital improvements. NAPP claims far exceeded that with $597,507, the cost of completing purchase of property earlier approved by WCPARC. Total claims paid by WCPARC in November 2013: $698,193. Financial Reports: Fund Balance – Parks and Recreation

WCPARC director Bob Tetens introduced this fund balance report by saying the bottom line is better than expected. The fund balance projected for the year’s end is $7,766,901. The fund balance started the year at $12,950,815.

As of Nov. 30, 2013, revenue totaled $3,219,963 – primarily from property taxes ($6,408,702) and fees and services ($2,685,995). Expenses year to date were $11,523,297. In addition, the parks budget includes an operating reserve of $6.7 million and ”partnership” funding commitments of $925,000. Through November, $75,000 was provided to Ypsilanti to help rebuild Rutherford Pool, and $100,000 to Ypsilanti Township for a connecting communities trail on Textile Road. Financial Reports: Fund Balance – NAPP

The Jan. 1, 2013 fund balance for the natural areas preservation program (NAPP) was $10,263,644. Through Nov. 30, 2013, revenue was $3,513,641 and expenses were $5,065,543. The projected fund balance for NAPP at the end of 2013 is $10,410,585. [.pdf of NAPP fund balance report]

Recreation Reports

These monthly reports include attendance at WCPARC facilities where attendance can be counted, with information about participation in measurable activities and revenue received at those facilities. The reports include the current year-to-date summary as well as similar information for the prior two years. As he has for the last several months, WCPARC director Bob Tetens introduced the December reports with an explanation about the impact of weather on attendance, especially in comparison to 2012, which was much hotter and drier than this year.

Recreation Reports: Meri Lou Murray Recreation Center

The Meri Lou Murray rec center is doing better financially this year than the prior two, Tetens told commissioners. Year-to-date participation as of Nov. 30, 2013 was 296,042 and revenue was $1,143,360. In 2012, year-to-date participation was 296,888 and revenue was $1,084,563. In 2011, participation was 311,020 and revenue was $1,096,553. [.pdf of MLM rec center report]

Recreation Reports: Pierce Lake Golf Course

Again, Tetens recommended comparing Pierce Lake Golf Course’s use in 2013 to 2011 rather than 2012 because of the hotter weather in 2012, when the golf course opened two weeks earlier than normal. Through the end of November 2013, 17,008 people had paid greens fees totaling $372,901. In 2012, 19,278 people paid $399,192. In 2011, attendance was 15,075 with $336,309 in revenues.

Programming and retail operations brought in $110,874 in 2013; $110,589 in 2012; and $89,394 in 2011. So total revenue in 2013 was $590,653, compared to $614,570 in 2012 and $516,632 in 2011. [.pdf of Pierce Lake golf course report]

Recreation Reports: Rolling Hills Park and Water Park

There is an entrance fee, and gate count, for everyone who enters Rolling Hills Park. There is a separate fee, and gate count, for those who go on to enter the water park there.

In 2013, 30,699 people paid a total of $240,066 to enter Rolling Hills Park. In 2012 there was a gate count of 34,373 people with revenues $266.083. That compares to a gate count of 34,844 people in 2011 and $267,130 in revenues.

Attendance at the water park was significantly higher: 94,266 people with revenues $715,239 in 2013. That compares to a gate count of 114,522 people in 2012 with $780,122 in revenues; and 115,012 people in 2011 with revenues of $780,995.

Total revenue for all operations at Rolling Hills was $1,204,094 in 2013; $1,318,917 in 2012; and $1,310,515 in 2011. [.pdf of Rolling Hills report]

Recreation Reports: Independence Lake Park and Blue Heron Bay

Blue Heron Bay is a water-feature area separate from the rest of Independence Lake Park. In the past, Tetens has indicated that Blue Heron Bay’s water features appeal to younger children but it’s “not the type of facility where parents leave their kids all day” as compared to Rolling Hills Water Park, which attracts older children.

Because Blue Heron Bay opened in 2013, there are no comparisons to earlier years. In 2013, attendance at Independence Lake Park was 15,543 with revenues of $122,293. That compares to 2012 attendance of 17,743 people with $137,717 in revenues. In 2011, 17,008 people paid $132,527 to enter the park.

Attendance at Blue Heron Bay was 17,668, for $69,787 in revenue. Total revenue for all of Independence Lake Park was, through November, was $295,648 in 2013; $211,578 in 2012; and $209,885 in 2011. [.pdf of Independence Lake report]

Outcome: The recreation reports were received and accepted for filing unanimously.

Projects and Activities

Staff of WCPARC provide monthly updates to commissioners about ongoing improvements at facilities, and activities at parks and natural areas.

Ann Arbor skatepark, Washtenaw County parks & recreation commission, The Ann Arbor Chronicle

Some of this information is provided in writing in the board packet; more is provided with visuals and informal commentary. This report summarizes the most significant items at the Dec. 10 meeting.

Bob Tetens reported that construction of the Ann Arbor skatepark has stopped for the winter, and the project is bit behind schedule: it is 65% complete. [WCPARC contributed $400,000 to the project, which is located in the northwest corner of Ann Arbor's Veterans Memorial Park; Ann Arbor city council gave final approval in July, 2013  with costs that total $1,224,311.]

Tetens reviewed several other highlights from the update:

  • Rutherford Pool: The rebuilt pool will open next summer; WCPARC contributed $150,000 to this project at Ypsilanti’s recreation park on North Congress Street.
  • Year in review: WCPARC staff provided a lengthy presentation highlighting the year’s accomplishments, all of which were covered in earlier Chronicle articles. These included expanding and improving the Rolling Hills water park; installing a new spray park, denominated Blue Heron Bay, at Independence Lake county park, which won a design award from the National Association of Park & Recreation Officials; installing a new pedestrian bridge at Sharon Mills park; completing the final year of the “connecting communities” project with grants to Dexter, Ypsilanti Township and others; adding 12 properties to the natural areas preservation program, which now has 27 preserves; providing funds for a paved trail beside the Argo Cascades in Ann Arbor; putting on 193 programs and hikes and 23 mill tour days, with a collective 5,351 participants; and improving the bed of Mallett’s Creek as it flows through the County Farm Park.
  • Border-to-Border trail: Staff continue to work on the final 1/8 mile of the River Terrace trail in Dexter, but all the rest is completed. New maps of the B2B trail will be produced with help from the Washtenaw Area Transportation Study.
  • Lima Woods Preserve: The entry drive and parking lot construction has begun; preliminary trail layouts are done. This work is needed before the preserve can be open to the public.
  • 2015-2019 parks and recreation plan: A preliminary draft is nearly done.
  • 2014 meeting calendar: Commission members approved a calendar with meetings on the second Tuesday of each month with two exceptions: no meeting in July, and the November meeting will be on Nov. 18 instead of the 11th, which is a county holiday (Veterans Day).

Fleece has worked for the county for 38 years in the field of public and environmental health, and is retiring at the end of 2013. He was appointed the county’s environmental health director in 1994, and has served as the health officer since 2009. At the county board’s Nov. 6, 2013 meeting, commissioners appointed Ellen Rabinowitz as interim health officer.

Also on Dec. 4, commissioners honored Nelson Meade, who is stepping down from the Washtenaw County parks & recreation commission after serving for over 40 years. [.pdf of resolution of appreciation for Meade] He was an administrator at the University of Michigan’s School of Public Health and had served in various roles in city government, including two terms on the Ann Arbor city council. His departure from WCPARC was announced at its Nov. 12, 2013 meeting. Meade did not attend the Dec. 4 meeting, but will be given the framed resolution at a reception later in the month.
