Editor’s note: This “Live Updates” coverage of the Ann Arbor city council’s April 7, 2014 meeting includes all the material from an earlier preview article published last week. The intent is to facilitate easier navigation from the live updates section to background material already in this file.

The council’s April 7 agenda features two significant items of old business: a first reading of an ordinance that would regulate outdoor smoking in certain locations; and an allocation of funds for the work of a pedestrian safety and access task force.

The pedestrian safety task force funding resolution is now expected to be withdrawn. At the first meeting of the task force, held on Friday, April 4, Ward 1 councilmember Sabra Briere, speaking from the audience, told the group that it was her intent to withdraw the funding resolution when the council meets on April 7. Even if the resolution is withdrawn at the April 7 meeting, however, the task force will be able to continue its work.

Pedestrian issues form one of the themes of the meeting agenda – as the council will be approving annual contracts for the sidewalk repair program, as well as applying for a grant to renovate the pathway in Gallup Park – from the Geddes Dam at the east end of the Gallup Park pathway, to the parking lot east of Huron Parkway. Along with the sidewalk maintenance program contracts, the city council will also be asked to approve the annual street resurfacing program contracts.

Another main theme of the meeting is land use. Carried over as a topic from the council’s March 17 meeting is the surface of the city-owned Library Lane underground parking structure in downtown Ann Arbor. After voting on March 17 to hire a real estate broker, the council will consider a resolution on April 7 that would allocate to the city’s affordable housing trust fund half of the proceeds of any sale of the site’s development rights.

But on April 7, the council will also be considering an amendment to the March 17 resolution that directed the city administrator to list the surface of the Library Lane parking structure for sale. The amendment would require a public process to take place before brokerage services are obtained or the real estate is listed for sale. That public process is supposed to allow discussion of the possibility that the entire surface of the underground parking garage could be used as a park or plaza. The amendment is sponsored by Mike Anglin (Ward 5) and Jack Eaton (Ward 4).

The council will also be considering some items that arrived on its agenda via the city’s planning commission: rezoning of a nature area to PL (public land); and a resolution calling on the University of Michigan to incorporate the city’s land use recommendations as it considers the future use of the Edwards Brothers property on South State Street. The April 7 agenda also includes, as an item of communication, a resolution passed by the city planning commission on March 18, 2014 that gives advice to the council about how to develop the Library Lane property.

In other business, the council will be considering a resolution to approve an expansion of the Main Street business improvement zone (BIZ). The geographic area of the self-assessment district – which handles sidewalk snow removal, sweeping and other upkeep for property owners – would more than double. The final decision rests with the property owners in the expanded area.

Also at its April 7 meeting, the council will consider a resolution asking that Michigan state officials stop opposing a recent court ruling that allows same-sex marriages.

The council’s agenda also includes several street-closing approvals for upcoming events: Taste of Ann Arbor on June 2; The Event on Main Street on June 19; the Ann Arbor Jaycees Fourth of July Parade on July 4; and the Townie Street Party on July 14.

Among the reports and communications attached to the agenda is the final report of a council economic collaborative task force.

April 7, 2014: City Council Meeting Preview

The first council meeting in April comes after a somewhat rare three-week gap between council meetings. The first-and-third Monday schedule most often yields an every-other-week pattern.

Planning Bylaws Clarify Council Interactions

Ann Arbor planning commission meeting (Feb. 20, 2014): Wrapping up a process that began last year, planning commissioners voted to revise their bylaws related to two issues: how city councilmembers interact with the commission; and public hearings.

Commissioners had debated the proposed revisions at a Feb. 4, 2014 working session. Some of the same issues were raised during the Feb. 20 discussion, which was relatively brief.

One revision clarifies the limitations on a city councilmember’s interaction with the commission. The revised section states: “A member of the City Council shall not be heard before the Commission during the Councilmember’s term in office.” The intent is to prevent undue influence on the commission, and to avoid the possibility of legal action against the city.

Other revisions affect speaking turns at public hearings. The intent is to clarify how many turns the same person can speak at a public hearing, and how public hearings are continued if an item is postponed.

In other action, commissioners recommended rezoning a parcel on the city’s north side to public land (PL). The 2.2-acre site at 3301 Traverwood Drive, donated to the city by developer Bill Martin, is being added to the adjacent Stapp Nature Area, near the Leslie Park golf course. It was originally zoned R4D (multi-family dwelling) and had been part of a larger site that’s being developed with an apartment complex.

During communications, Kirk Westphal reported on a project that the environmental commission is working on: a neighborhood mini-grant program. Volunteers would coordinate a competitive grant program for community groups, who could apply to fund projects that address one of the city’s goals in its sustainability framework. That’s in the planning stages, he said.

Westphal also distributed a copy of a resolution recently passed by the city’s energy commission. It supports a recommendation to hire a full-time employee to focus on projects that help achieve goals in the city’s climate action plan. Westphal indicated that the planning commission’s executive committee would be discussing it. The energy commission would like a supporting resolution from the planning commission.

Commissioners also heard from two Skyline High School students, who spoke during public commentary as part of a class assignment. They talked about the importance of the Huron River and of the Huron River Watershed Council‘s River Up project. The planning commission’s work plan includes looking at how to implement recommendations from city’s North Main Huron River corridor task force. [Full Story]

Donated Land Rezoned for Nature Area

Land that’s been donated to the city by developer Bill Martin is in the process of being rezoned as public land, following action at the Feb. 20, 2014 meeting of the Ann Arbor planning commission. The 2.2-acre parcel is being added to the adjacent Stapp Nature Area, near the Leslie Park golf course.

Rezoning for Delta Gamma Moves to Council

Ann Arbor planning commission meeting (Jan. 23, 2014): Only one project was on the agenda for consideration by the planning commission on Jan. 23: rezoning and an area plan for a house that the Delta Gamma sorority wants to convert into a residential annex.

The 515 Oxford property is near the main sorority house at 626 Oxford, and is currently split into three apartment units. Planning commissioners recommended approval of the request to rezone the parcel from R4A (multi-family dwelling) to R2B (two-family dwelling and student housing).

Additional approvals for the project itself will be required before the project’s construction work can begin.

The proposal for a renovation would accommodate a maximum of 20 residents, including a required resident manager. A special exception use will also be required to allow for a sorority use. That request will be made to the planning commission at a later date, along with a more detailed site plan.

The house was designed by architect George Brigham and built in 1940 as his home and studio. He designed over 40 houses in Ann Arbor, including many in Arbor Hills and Barton Hills. Planning staff reported that they were contacted about this site by a2modern, a group created to highlight mid-century modern architecture in Ann Arbor. On Jan. 23, the group posted a “statement of concern” about the proposal on its website.

At the planning commission meeting, Robb Burroughs, the project’s architect, said that until they were alerted by a2modern, the design team hadn’t been aware of the site’s history. They’ve now done research at the Bentley Historical Library and have met with a representative from a2modern, and are working on the site plan to preserve to the greatest extent possible the exterior view of the house.

The rezoning request and area plan, which commissioners also recommended for approval, will now be considered by the city council.

In other action on Jan. 23, commissioners voted to recommend that the city council reappoint Kirk Westphal as the planning commission’s representative to the environmental commission. Westphal, who chairs the planning commission, did not participate in the vote, and vice chair Wendy Woods led the meeting as the commission acted on that item.

During communications time, planning manager Wendy Rampson noted that the city council had passed a resolution at its Jan. 21, 2014 meeting regarding the downtown zoning review. The council has directed the planning commission to develop ordinance language that would enact the commission’s recommendations for zoning revisions, with a deadline of Oct. 20, 2014. The commission’s ordinance revisions committee will meet on Feb. 4, before the regular planning commission meeting, to start figuring out how to implement these council directions.

In other communications, Bonnie Bona reported that the energy commission plans to propose a commercial energy disclosure ordinance for the city council’s consideration. They’d like the planning commission to consider a resolution in support of that. An energy disclosure ordinance would require owners of certain properties to report how much energy their buildings use. [Full Story]

Downtown Items OK’d, Public Art Delayed

Ann Arbor city council meeting (Jan. 21, 2014): Council communications at the start of the meeting highlighted an already-established pedestrian safety task force – and signaled that the evening could be contentious. It proved to be a night featuring some political friction, with the meeting extending past 1 a.m.

The pedestrian safety and access task force appeared on the agenda because confirmation of its nine members was a question before the council. As part of that vote, as well as during council communications, Stephen Kunselman (Ward 3) revived the recent controversy over an attempted repeal of the city’s crosswalk ordinance – an effort that mayor John Hieftje ultimately vetoed. The task force was appointed at Tuesday’s meeting, after Kunselman established that he was still interested in revising the city’s crosswalk ordinance so that motorists would be required to stop for pedestrians only if they could “do so safely.”

In other business, the council approved the site plan for a revised, expanded version of the 624 Church St. project, located in the block just south of South University Avenue. The revised plan is for a 14-story, 116,167-square-foot building with 123 units and about 230 bedrooms. The approval came after an hour and a half of debate on the site plan, focusing on the way the project is satisfying a zoning requirement to provide parking spaces – through the city’s contribution-in-lieu (CIL) program. The Ann Arbor Downtown Development Authority had approved three five-year extensions for the CIL monthly permits – beyond the standard CIL term of 15 years. When Kunselman’s bid to eliminate the extended term failed – a move that would have jeopardized the project’s financing – he told Sean Spellman, representing the developer: “I’m sorry if I scared you …”

Also related to downtown development, the council moved along a process to revise downtown zoning regulations. The council accepted the planning commission’s recommendations, and in turn tasked the planning commission to develop ordinance language to implement the recommendations. In general, the planning commission’s recommendations were intended to create more of a buffer between downtown development and adjacent or nearby residential neighborhoods. Several other recommendations focused on the issue of “premiums” – certain features that a developer can provide in exchange for additional by-right floor area ratio (FAR).

During its Tuesday meeting, the council added some direction of its own: (1) consider rezoning Huron Street from Division to Fourth Avenue to conform with the East Huron 1 character district, and consider incorporating 25-foot minimum side setbacks and 10-foot front setbacks where feasible in the East Huron 1 character district; and (2) consider whether other D1-zoned areas that do not have buffering from adjacent residential neighborhoods, including some areas of South University and Thayer Street, should be rezoned to D2. A date certain was also added by which the planning commission is to report to the council on all its work on this issue – Oct. 20, 2014.

In other zoning action at its Jan. 21 meeting, the council gave initial approval for the zoning of two unzoned properties on South State Street – 1643 and 1645 S. State. They are proposed to be zoned C1 (local business district). One of those properties houses Biercamp Artisan Sausage and Jerky.

In another item related to South State Street property, the council approved with no discussion a $25,550 contract with Atwell LLC for environmental site assessment services to evaluate 2500 S. State St. That’s the Edwards Brothers Malloy property for which the council is currently exploring options to purchase. The item was added to the agenda on Friday, Jan. 17, after the initial publication of the agenda.

Delayed by the council was a six-month extension of the contract with the city’s public art administrator, Aaron Seagraves, and a proposal to add $18,500 to his compensation to cover the added term. The postponement was made amid concern about the remaining $839,507 unallocated balance in the now-defunct Percent for Art fund. The political horse-trade made at the council table was to postpone the contract extension, with the expectation that it would be supported at the council’s next meeting – but at the same time, a process would start to return the better part of the $839,507 to the various funds from which that money was drawn.

The city’s new public art program relies on the idea of integrated or “baked-in” art for capital projects. It was developed by a five-member council committee, which included all four of the councilmembers who have announced that they’re running for mayor in 2014 – Sabra Briere (Ward 1), Sally Petersen (Ward 2), Christopher Taylor (Ward 3) and Stephen Kunselman (Ward 3). The fifth member of that committee was Margie Teall (Ward 4), who cast the only vote against postponing the contract extension for Seagraves – as she wanted to approve it at Tuesday’s meeting.

Also at its Jan. 21 meeting, the council approved $6,818 of general fund money to build a sidewalk from the northeast corner of Penberton Court and Waldenwood northward – to connect to a path leading the rest of the way to King Elementary School. The item, which has a history of at least four years, drew about 15 minutes of discussion.

Taking a half hour of council deliberations was another sidewalk-related item. The council approved the first of four steps in the process to impose a special assessment on property owners for a sidewalk on the east side of Pontiac Trail, between Skydale and Dhu Varren Road. Debate centered on a proposal from Kunselman to ask the city administrator to consider city funding for 80% of the project.

The council dispatched quickly two liquor-license related items: recommendation of a special downtown development liquor license for The Lunch Room at 407 N. Fifth Avenue, and a change in the classification of Silvio’s Organic Pizza license from a Tavern License to a Class C License.

Rezoning Recommended for Delta Gamma Annex

Traverwood Apartments Gets Council OK

A residential complex on the west side of Traverwood Drive, north of Plymouth Road, has now received all the necessary approvals from the Ann Arbor city council. First Martin’s Traverwood Apartments is estimated to cost $30 million, and would include 16 two-story buildings for a total of 216 one- and two-bedroom units – or 280 total bedrooms. Eight of the buildings would each have 15 units and 11 single-car garages. An additional eight buildings would each have 12 units and 8 single-car garages.

The council approved two separate items on its Jan. 6, 2014 agenda related to the Traverwood Apartments project – one for the rezoning required for the project, and the other for the site plan and wetland use permit.

Action Postponed on Traverwood Apartments

Ann Arbor planning commission meeting (Sept. 17, 2013): A major new apartment project in northeast Ann Arbor was discussed but ultimately postponed by planning commissioners, pending unresolved issues that the planning staff did not have sufficient time to review.

Traverwood Apartments is a proposed complex of 16 two-story buildings and 216 one- and two-bedroom units on nearly 22 acres off of Traverwood Drive, north of Plymouth Road. It’s one of the first large residential developments in the last few years that’s come forward outside of downtown Ann Arbor. For part of the site, a rezoning would be required – from ORL (office, research and light industrial) to R4D (multi-family residential).

Developer First Martin Corp. is making the proposal. In response to a query from commissioner Bonnie Bona, Mike Martin explained that although the site would allow for denser development – taller buildings and more units – the cost of construction would have been high, and they didn’t think they’d be able to charge the amount of rent necessary to make a larger project feasible.

The site is east of the city’s Leslie Park golf course, and south of Stapp Nature Area – created on land that First Martin sold to the city in 2003. Some of the discussion on Sept. 17 centered on pedestrian connections between those parks and the apartment complex, which will include a path running along the west side of the site, next to Leslie Park.

During a public hearing on the project, resident Paul Bruss supported the concept of that kind of public trail. He described a vision he shares with others, of a trail that would start at Stapp and loop south then west around the Leslie Park golf course, going north all the way to the Dhu Varren Woods Nature Area. “If we could figure out a way to connect all that as a necklace around Leslie golf course, this would be one of the premium trails in Ann Arbor,” Bruss said.

Commissioners Bona and Ken Clein advocated for more of a pedestrian focus within the complex. Calling First Martin and the architect firm Hobbes + Black “kind of the dream team for developing in Ann Arbor,” Clein – a principal with Quinn Evans Architects – expressed disappointment at the “cookie cutter” site design.

Depending the outcome of a staff review, the apartment project might be on the planning commission’s agenda for consideration as early as Oct. 1.

The other action item on Sept. 17 was authorizing two planning commissioners – Paras Parekh and Sabra Briere, who also serves on city council – to attend the Michigan Association of Planning annual conference, held this year from Oct. 2-4 in Kalamazoo. Their expenses will be paid for out of the city’s training budget for planning staff and related commissions.

Also during the meeting, planning manager Wendy Rampson gave a brief update on the work of consultants who are developing recommendations as part of a downtown zoning review. The consultants – Erin Perdu and Megan Masson-Minock – plan to present their report at the planning commission’s Oct. 8 working session, with commissioners considering the recommendations at their Oct. 15 regular meeting. Traverwood Apartment Project Postponed

Ann Arbor planning commissioners postponed action on the proposed Traverwood Apartments, a complex of 16 two-story buildings on the west side of Traverwood Drive, north of Plymouth Road. The project – being developed by Ann Arbor-based First Martin Corp. – requires site plan approval and rezoning, as well as approval of a wetland use permit. Former Vivian Land Gets Initial OK for Rezoning

A rezoning request for 3875 E. Huron River Drive from R1A (single-family dwelling) to PL (public land) has been given initial approval by the Ann Arbor city council. The site, which is adjacent to the city’s South Pond park, will be used as parkland. The initial action by the council came at its Sept. 16, 2013 meeting. An additional vote will be required for final approval.

Aug. 19, 2013 Ann Arbor Council: Final

An extraordinarily light agenda offers the council a rare opportunity to dispatch with a meeting in about an hour tonight. No proclamations or presentations are scheduled for the start of the meeting.

Besides the consent agenda, the council will need to vote on just eight items. And half of those eight are standard easements, which are rarely subjected to any council discussion.

But those easements also mean that not too many councilmembers would have the chance to take the night off. As conveyances of land interest, the easements will require an 8-vote majority on the 11-member council. Two of the easements are related to the construction of a new Tim Hortons on South State Street, one is related to the Arbor Hills Crossing development at Washtenaw and Platt, and the fourth is linked to construction of the new Blake Transit Center in downtown Ann Arbor.

The other land-related item on the agenda is initial consideration of a rezoning request for a site that has been annexed into the city from Ann Arbor Township. The final vote on the item would come at a subsequent meeting after a public hearing at that meeting. The Aug. 19 agenda doesn’t include any items that require a public hearing.

The council will be asked to approve a $107,000 purchase order for continued participation in CLEMIS (Courts and Law Enforcement Management Information System). The service is used by several public safety agencies in southeast Michigan. Among the support services provided by CLEMIS are computer-aided dispatch (CAD), mobile CAD, report management system, fingerprinting and mug shots.

The council will also be asked to approve the issuance of $3.15 million in revenue bonds to fund some electrical improvements for the water supply system.

The final voting item on the agenda is confirmation of several nominations to city boards and commissions made at the council’s previous meeting.

The agenda still offers some opportunity for stretching long. For example, the council could separate out some of the nominations for individual consideration. Among those nominations, the council will be asked to confirm appointments to the boards of two high-profile organizations – the Ann Arbor Downtown Development Authority and the Ann Arbor Area Transportation Authority. Rishi Narayan, founder of Underground Printing, is the nominee to the DDA board. Jack Bernard, who works in the University of Michigan’s office of the general counsel, is the nominee to the AAATA board.

The council could also pull individual items off the consent agenda for separate consideration. Two of those items are street closures for downtown bars to host Oktoberfest activities on Sept. 20-21. It’s possible those items could be pulled out for separate consideration – but not because of a desire to deny the requests. Instead, a possible reason to consider them separately would be to highlight what’s different about the Oktoberfest street closures, compared to a similar request made at the council’s last meeting for “Beats, Eats, and Cleats.” That request, which was denied, was for an event sponsored by The Landmark apartment building. It was scheduled for Friday, Sept. 6, 2013, the evening before the football game between the University of Michigan and the University of Notre Dame.

The Oktoberfest event also takes place on a weekend when the Michigan football team plays a game. But that game against the UConn Huskies will be contested on the gridiron of Rentschler Field in East Hartford, Conn. – over 700 miles away from the intersection of Washington and Main Streets in Ann Arbor, Mich.

Councilmembers also have the opportunity at three different points in the agenda to share communications with the public and their fellow councilmembers.

Planning Group: No Duplex on Packard

Ann Arbor planning commission meeting (Aug. 7, 2013): A light agenda for the planning commission led to two straightforward decisions on rezoning requests for parcels outside the downtown, well away from the area that has generated ongoing controversy. The decisions were both unanimous, with opposite outcomes.

The planning commission heard a request to rezone 3325 Packard from R1C (single-family dwelling) to R2A (two-family dwelling) – and voted unanimously to deny that request. A house had burned on the lot, which sits at the corner of Fernwood and Packard. The economics of rebuilding a single-family house and trying to sell or rent it out weren’t realistic, owner Steve Weaver told the commission.

A duplex, Weaver argued, could help stem the commercial creep coming from the west at Packard and Platt, and provide a “thumb in the dike” to preserve the residential character of that stretch.

But planning commissioner Bonnie Bona reflected the view of commissioners and planning staff that the decision was a “no-brainer” in the context of the city’s master plan, which clearly designates the area for single-family houses. They were reluctant to engage in “spot zoning.”

In voting unanimously to deny the rezoning request, commissioners encouraged Weaver to work with neighboring property owners with the idea of bringing forward a request to rezone an entire blockface.

Weaver has said he will exercise his option to make his rezoning request directly to the city council, even without the planning commission’s support.

The other rezoning request on the commission’s Aug. 7 agenda was to designate some city-owned property on 3875 E. Huron River Drive as PL (public land). The move was characterized as a housekeeping step for the planning commission. During the public hearing on the question, one person addressed the commission indicating support, but with some concern about the range of activities that would be promoted there.

One idea mentioned at the meeting was the possibility that the parcel – sold to the city in 2010 by former U.S. Congressman Wes Vivian – could become the headquarters for the city’s natural area preservation program (NAP). Commissioners encouraged nearby residents to work with the park advisory commission (PAC) as that group helps decide the parcel’s eventual use within the park system.

The commission also heard remarks from the representative of a neighbor opposed to a requested land division on Traver Street. But the decision on that item will be made by planning staff, not the planning commission or the city council. [Full Story]

Street-Closing Debate Extends Council Session

Ann Arbor city council meeting (Aug. 8, 2013): Counting all public hearings and public commentary, members of the public accounted for just 20 minutes of the council’s meeting. Still, councilmembers stretched a relatively light agenda to about four hours.

An hour of the meeting was taken up with a discussion of street closures around Michigan Stadium on football game days. The street closures are part of an effort to increase safety by creating a vehicle-free zone around the stadium. It involves a cooperative effort with the University of Michigan, U.S. Department of Homeland Security and the city of Ann Arbor police department.

Those deliberations ultimately resulted in a modification of the original plan, so that the southbound lane of Main Street would not be closed until an hour before the start of the game.

Other parts of the plan were approved as originally proposed, starting three hours before kickoff: E. Keech Street between S. Main and Greene streets will be closed, and access to Greene Street from E. Hoover to E. Keech streets will be limited to parking permit holders; the westbound lane on E. Stadium Blvd. turning right onto S. Main Street (just south of the Michigan Stadium) will be closed; and S. Main Street except for the southbound lanes will be closed from Stadium Boulevard to Pauline.

The council also amended the plan to require a report by its Oct. 7 meeting on how well the procedures are working. Even with the modification to the plan and the requirement to brief the council on Oct. 7, the proposal to close streets on football Saturdays was approved on just a 7-4 vote, with dissent from Sabra Briere (Ward 1), Sumi Kailasapathy (Ward 1), Margie Teall (Ward 4) and Marcia Higgins (Ward 4). That neighborhood is located in Ward 4.

Also during the meeting, the council denied a requested street closure for a non-university event on South University Avenue. The requested closing was for “Beats, Eats, and Cleats,” sponsored by The Landmark apartment building. It was planned for the evening before a football game between the University of Michigan and the University of Notre Dame. Councilmembers expressed concerns about the probability of alcohol consumption.

Another 40 minutes of the meeting was taken up with discussion of a bike share program, which did have a direct connection to the University of Michigan. The council was asked to contribute $150,000 from the city’s alternative transportation fund. That money provided a 20% local match on a $600,000 Federal Highway Administration Congestion Mitigation Air Quality (CMAQ) grant that the Clean Energy Coalition (CEC) has received. The CMAQ funds have to be spent on capital, such as bikes and stations. Operations will be supported in the first three years of the program by UM at a level of $200,000 annually for a total of $600,000. The program will be operated by the CEC using B-Cycle as a vendor. The council’s vote on the bike share program was 9-2, with dissent from Sally Petersen (Ward 2) and Marcia Higgins (Ward 4).

Higgins also dissented on a council resolution that called upon the state legislature to repeal Michigan’s version of a “stand your ground” law, as well as to repeal legislation that prevents local municipalities from regulating the sale, transfer, transportation, or possession of firearms and ammunition. That resolution came after public commentary on the verdict in the Trayvon Martin case at the council’s previous meeting. Higgins agreed with the sentiments in the resolution, but said she thought it would have a greater impact if people spoke as individuals. Other councilmembers expressed some skepticism that the resolution would have much impact, but it received their support.

The Kerrytown Place project – an 18-unit townhouse development planned for the location of the former Orthodox Greek church on North Main Street – was subjected to only brief remarks. The council unanimously approved its requested rezoning and site plans.

In other business, the council approved a $10,000 design budget for a sidewalk on Waldenwood near King Elementary School. Construction of the sidewalk would allow a mid-block crosswalk to be moved to a four-way stop intersection.

The council also agreed to accept $202,370 from the Federal Farm and Ranch Land Protection Program (FRPP) to help the city purchase development rights on land in Lodi Township, southwest of the city.

Over dissent from Jane Lumm (Ward 2) and Sumi Kailasapathy (Ward 1), the council approved $18,500 to pay for public art administrator Aaron Seagraves’ contract through the end of 2013.

Among the nominations to boards and commissions announced at the meeting, two were significant: Rishi Narayan, founder and managing member of Underground Printing, to the board of the Ann Arbor Downtown Development Authority; and Jack Bernard, chair of the University of Michigan’s council for disability concerns, to the board of the Ann Arbor Area Transportation Authority. Rezoning Request Denied for 3325 Packard

Ann Arbor planning commissioners have recommended denial of a request to rezone 3325 Packard from R1C (single-family dwelling) to R2A (two-family dwelling). The vote was unanimous among the six commissioners present on the nine-member body.

Kerrytown Place Gets Initial Rezoning OK

Kerrytown Place – a proposed development on North Main Street – has received an initial approval from the Ann Arbor city council for its requested rezoning. The initial action came at the council’s July 1, 2013 meeting.

Kerrytown Place is a project that Tom Fitzsimmons is planning to build on the site of the former Greek Orthodox church on Main Street. The rezoning would be from PUD (planned unit development district) to D2 (downtown interface base district). The 18-unit townhouse development that Fitzsimmons is planning to build is much smaller than The Gallery, for which the PUD zoning had originally been approved at the request of a different owner.

Rezoning for Car Dealership Denied

A rezoning request for 2271 S. State St. that would have allowed the owner to sell cars on the parcel has been denied by the Ann Arbor city council. The action took place at its July 1, 2013 meeting.

The council was asked to give initial approval to a rezoning of 2271 South State St. from M1 (limited industrial district) to M1A (limited light industrial district). The city planning commission vote on the recommendation was taken at its May 21, 2013 meeting. That vote came out 1-8, with only Eric Mahler supporting it. So the planning commission’s recommendation was for denial.

June 3, 2013 Ann Arbor Council: In Progress

The Ann Arbor city council’s June 3, 2013 meeting agenda features two significant topics that will have an impact on the future of public housing and public transportation in the city.

The council will be asked to vote on a series of resolutions related to a proposed conversion of the city’s 355 public housing units to a project-based voucher system under HUD’s Rental Assistance Demonstration (RAD) program. The council had been briefed at a Feb. 11, 2013 work session on the details of the proposal.

Key steps the council will be asked to take on June 3 include transferring ownership of properties managed by the Ann Arbor Housing Commission (AAHC) from the city of Ann Arbor to the AAHC. Because it involves the transfer of a land interest, approval will require an 8-vote majority on the 11-member council. The properties would eventually be owned by a public/private partnership. The AAHC selected a co-developer earlier this year at its Jan. 10, 2013 meeting.

AAHC is seeking to undertake with this initiative in order to fund several million dollars worth of needed capital improvements. On the RAD approach, they would be funded in large part through low-income housing tax credits (LIHTC).  The council will also be asked to approve a payment in lieu of taxes to the AAHC, so that no property taxes will be owed by AAHC.

The AAHC had originally conceived of converting its properties to project-based vouchers in phases over a few years. The impact of federal sequestration had led AAHC to contemplate converting all the properties this year, to soften part of that impact. However, a hoped-for change in HUD’s rules that would allow the all-in-one-go approach was not made, AAHC learned last week. So “Scenario 3″ described in the staff memo accompanying the council resolution is no longer possible. The negative financial impact of that HUD decision totals around $550,000 over the course of three years.

On the public  transportation side, the council will be asked to approve a change to the articles of incorporation for the Ann Arbor Transportation Authority. The change will admit the city of Ypsilanti as a member of the authority, and expand the AATA board from seven to nine members. The name of the authority would change to Ann Arbor Area Transportation Authority. One of the board members would be appointed by the city of Ypsilanti.

The request comes in the context of a demised attempt in 2012 to expand the AATA to all of Washtenaw County. Since then, conversations have continued among a smaller cluster of communities geographically closer to Ann Arbor. Previous Chronicle coverage includes “Ypsilanti a Topic for AATA Planning Retreat” and “Ypsi Waits at Bus Stop, Other Riders Unclear.

While the change will affect the governance of the AATA, the goal of the governance change is to provide a way to generate additional funding for transportation. The AATA could, with voter approval, levy a uniform property tax on the entire area of its membership – but the AATA does not currently do that. The cities of Ann Arbor and Ypsilanti currently levy their own millages, which are transmitted to the AATA. However, Ypsilanti is currently at its 20-mill statutory limit. A millage levied by the AATA would not count against that 20-mill cap.

Other significant items on the council’s June 3 agenda include a resolution encouraging the Ann Arbor Downtown Development Authority to allocate funding for three police officers. The council will also be considering a final vote on ordinance changes to which it’s already given initial approval: public art (eliminating the 1% capital project budget set-aside); utility rate increases (an annual item); and a reduction in utility improvement charges imposed on first-time connections.

In anticipation of the upcoming July 4 holiday, the council may also take initial action on an ordinance that would restrict use  of fireworks to the hours of 8 a.m. to midnight. The local regulation is only possible as a result of a change in the state law that has been passed by the Michigan House and is expected to be ratified and signed into law before July 4. The item had not yet been added to the city council’s agenda as of 4 p.m. today.

Kerrytown Place Praised, Despite Parking

Ann Arbor planning commission meeting (May 21, 2013): A proposed condominium project on North Main and North Fourth Avenue – called Kerrytown Place – won planning commission approval, though some commissioners expressed disappointment with the amount of surface parking on the site.

The development covers four parcels – at 402, 408 and 414 N. Main and 401 N. Fourth, with the Main Street parcels separated from the North Fourth site by a public alley, which runs north-south. The vacant St. Nicholas Church had been located on the North Main property, but was demolished last year.

McKinley Inc.’s headquarters is south of the site on North Main, and the firm holds a permanent easement for 57 parking spaces on the Kerrytown Place land. Those spaces will be provided on the development’s surface parking lots. Developer Tom Fitzsimmons told commissioners that finding a way to accommodate those parking requirements into the design had been “challenging.”

The North Main site will include 16 townhouse units in a building with a central courtyard. A 3-story structure with 8 units will front Main Street, and a 4-story structure on the east side of the parcel will have 8 additional units facing the courtyard. There will be an underground garage, and additional parking in 12 carport spots and 24 surface spaces.

On the North Fourth site – now a surface parking lot, with an entrance across from the Ann Arbor farmers market – the plan calls for constructing a duplex with a 2-car garage for each unit and a 21-space parking lot behind the building, accessed from the alley. Each unit of the duplex would face North Fourth.

The project includes a rezoning request and modifications to the city’s landscaping and setback requirements. Commissioners praised the development, but Bonnie Bona in particular was critical of the surface parking. She was reluctant to compromise on the developer’s request to decrease a 15-foot minimum setback, saying that “when I’m giving up front yard for more asphalt, I’m just not as happy.”

City planning staff pointed out that the parking easement “runs with the land,” meaning that any development would need to accommodate those parking spaces. Ultimately, commissioners unanimously approved all requests related to the project, which will now be forwarded to the city council for consideration.

In other action at the May 21 meeting, commissioners held a public hearing on suggestions related to the city’s master plan, but postponed action until their June 18 meeting. A review is required by the planning commission’s bylaws to be done annually. The hearing drew six speakers on a range of topics, including development in Lowertown, a park in downtown Ann Arbor, and adequate sidewalks, cleared of vegetation, so that kids can walk to school safely.

There is also a list of resource documents that are used to support the master plan. [.pdf of resource document list] Commissioners spent a fair amount of time discussing why the Calthorpe report isn’t included on the list. The commission appeared to reach consensus that it would be worth reviewing the entire list of resource documents.

Also on May 21, the commission held a public hearing to get input on the South State Street corridor plan, as a possible addition to the city’s master plan. Commissioners and staff have been working on this project for more than two years. No one spoke at the hearing, and commissioners voted to add the South State Street corridor plan to the city’s master plan, as an amendment to the plan’s land use element. The city council will also need to vote on this item.

One request that commissioners rejected was rezoning for 2271 S. State St., where owners would like to sell cars. The vote was 1-8, drawing support only from Eric Mahler. Some commissioners had leaned toward approval, saying it would be good to have some kind of use on the long-vacant site, where Pilar’s restaurant had once been located. But others expressed concern that it didn’t fit with the goals of the South State corridor, and that it could set a precedent for other rezoning requests. It would be possible for the owner, Capital Investments, to bring the rezoning request to the city council, even though it did not receive a recommendation of approval by the planning commission.

During public commentary, commissioners heard from three people expressing concerns about development and city services in southeast Ann Arbor, along the Ellsworth corridor. They asked for a moratorium on any zoning changes or high-density housing there, until the area can be further studied. Residents have formed a task force to pursue the issue. [Full Story]

Kerrytown Place Project Moves Ahead

Rezoning for 2271 S. State Denied

Following advice from city staff, the Ann Arbor planning commission voted to recommend denial of a rezoning request for 2271 S. State St., where owners would like to locate an auto dealership. The vote was 1-8, drawing support only from Eric Mahler. However, the commission did waive an area plan requirement for the site, an action that will allow for a certain amount of auto sales at that location. The waiver was approved on a 7-2 vote, with dissent from Kirk Westphal and Wendy Woods.

The project had previously been on the commission’s Dec. 18, 2012 agenda, when action was postponed.

State Street Center Zoning: Initial OK

A rezoning request for State Street Center, near the intersection of State and Ellsworth, has received initial approval from the Ann Arbor city council. The action came on May 13, 2013 – at a continuation of the council’s May 6 meeting. A site plan for the project has not yet received council action.

The project calls for demolishing a vacant 840-square-foot house on this site. In its place, the developer plans a one-story, 1,700-square-foot drive-thru Jimmy John’s restaurant facing South State Street. A one-story, 6,790-square-foot retail building will be built behind the restaurant. The driveway off South State Street would be relocated and widened. The site would include 39 parking spaces, as well as covered bicycle parking between the buildings.

May 13, 2013 Ann Arbor Council: In Progress

The Ann Arbor city council’s May 13, 2013 session of its May 6 meeting will begin with consideration of the site plan for 413 E. Huron St. – a 14-story residential building proposed for the northeast corner of Division and Huron streets in downtown Ann Arbor. The May 13 session – scheduled to start at 7 p.m. – will begin immediately with the agenda item on the 413 E. Huron site plan, unless the agenda is re-opened and amended in some fashion. None of the routine elements associated with the start of meetings, like public commentary reserved time, will be included. Those items were already dispatched on May 6.

It was around 11:30 p.m. on May 6 when the council decided to recess the meeting, and to resume it on May 13. At that point the council had completed eight public hearings and voted on a number of other items, before reaching the 413 E. Huron site plan.

While the 413 E. Huron site plan will be the first item that the council confronts, several other significant items appear on the remainder of the council’s agenda.

The council is scheduled to hear a first reading of proposed changes to the city’s public art ordinance. The proposal includes removing the requirement that 1% of all capital project budgets be set aside for public art.

Another ordinance change to which the council will be asked to give initial approval is a change to utility connection charges for undeveloped property.

In addition to initial consideration of changes to those two ordinances, the council will be asked to give an initial approval to rezoning of two different parcels – a property at 490 Huron Parkway and on South State Street. The property on Huron Parkway is supposed to be rezoned from R3 (townhouse district) to R1B (single-family dwelling) and would allow the currently vacant 1.22-acre site, located north of Ruthven Park, to be divided into three separate lots.

The State Street Center project is located adjacent to a new Tim Hortons restaurant, which opened last year. The rezoning request is from O (office) to C3 (fringe commercial). It would make the actual zoning consistent with the city’s official zoning map, which had been mislabeled. The site plan calls for demolishing a vacant 840-square-foot house and building a one-story, 1,700-square-foot building with a drive-thru Jimmy John’s restaurant facing South State Street.

An expansion to the Theta Delta Chi house on State Street is also on the agenda for approval.

The Ann Arbor fire department shows up on two different items – one to accept a federal grant that will pay for exhaust fume removal systems for fire stations, and another to appropriate funds to replace protective gear worn by firefighters.

And the University of Michigan appears in two different agenda items. One item authorizes a contract for the city worth more than $600,000 in connection with the vehicle-to-vehicle study – for which the UM Transportation Research Institute (UMTRI) won a $14 million federal grant. The other item related to UM involves a right-of-way agreement for the placement of electrical conduit under Tappan Street, so that an emergency generator can serve a law school dorm.

Other agenda items include some resolutions necessary to impose a special assessment on property owners along Miller Avenue, to help pay for construction of new sidewalks. And the council will be asked to choose Coke over Pepsi as the vendor for Ann Arbor’s city parks. [Full Story]

South State Retail Project Moves to Council

Ann Arbor planning commission meeting (April 2, 2013): A new retail project – with plans for a Jimmy John’s restaurant – will now move to the city council for approval, following a recommendation from planning commissioners this week.

Called the State Street Center, the project will be located on a thin strip of land off of South State, just north of Ellsworth and adjacent to a relatively new Tim Hortons. Commissioners recommended approval of the site plan and for rezoning the parcel to C3 (fringe commercial). The Jimmy John’s will face South State. A separate one-story retail building will be located behind the restaurant.

Some commissioners expressed concern that the businesses in the retail building won’t be very visible from South State. Jim Cernuto, the owner’s project manager, noted that the State and Ellsworth corridor is “coming alive” after the opening of Costco, and that there’s strong interest from potential tenants. The proposed C3 zoning is the most inclusive type of non-residential zoning, allowing for a wide range of businesses, including convenience stores, dry cleaners, wholesalers and warehousing.

Also during the meeting, several commissioners brought up items for future discussion. Bonnie Bona noted that the city’s energy commission plans to develop recommendations for the city council regarding future development of the former YMCA site, on William between Fourth and Fifth avenues. She suggested that planning commissioners should discuss whether they also want to make recommendations, laying out what councilmembers should consider in deciding the site’s future. At its March 4, 2013 meeting, the council voted to direct the city administrator to prepare an RFP (request for proposals) for brokerage services to sell the lot.

Sabra Briere raised the issue of a whether the city should develop a “solar blocking” policy. If someone puts solar panels on the roof of their house, she noted, there is no ordinance to protect the home from other buildings that might be constructed nearby and block the sun – even though the city is encouraging this kind of solar energy use. Although she didn’t explicitly mention it, the issue of shading has been an argument against the proposed development at 413 E. Huron. In that case the issue has concerned the impact of building shade on trees, not solar panels. Briere also serves on the city council representing Ward 1. Councilmembers voted on April 1 to postpone action on that project.

Related to the 413 E. Huron project is a recent council directive to the planning commission to review the city’s downtown core (D1) zoning. Also on April 1, councilmembers provided specific guidance for that review, along with an Oct. 1 deadline for the completion of the work. Briere communicated the council’s direction to commissioners at their April 2 meeting, but there was no further discussion about it.

The commission’s regular meeting on April 2 was relatively brief, lasting about an hour. It was followed by a working session, where commissioners got an update from Nathan Voght, project manager for Reimagine Washtenaw. The effort is aimed at improving the Washtenaw Avenue corridor between Ann Arbor and Ypsilanti. Voght works for Washtenaw County’s office of community & economic development, which is overseeing the project. [Full Story]

State Street Center Gets Planning Approval

Ann Arbor planning commissioners have recommended approval of a proposed site plan for State Street Center, near the intersection of State and Ellsworth, as well as rezoning for the site. The unanimous vote took place at the commission’s April 2, 2013 meeting.

Planning, DDA: City Council to Set Course?

Ann Arbor city council meeting (March 18, 2013) Part 1: The two main events of the council’s meeting centered around planning in the downtown area: (1) consideration of a possible moratorium on D1 (downtown core) site plans; and (2) consideration of the site plan for 413 E. Huron, located in a D1 district.

The council decided to conduct a review of D1 zoning, without imposing a moratorium. That cleared the way to consider the 413 E. Huron project, which the council eventually voted to postpone – at roughly 1:30 a.m. Because of the amount of time spent on just those items, they’ll be included in a separate Chronicle report.

Apart from those two items, the council’s agenda still included a planning and land use focus, as well as a downtown theme. An additional theme was the city council’s relationship to two other public bodies – the city planning commission and the board of the Ann Arbor Downtown Development Authority.

In the case of the planning commission, the council for a second time balked at the commission’s recommendation of R3 (townhouse) zoning for a recently annexed parcel on Ellsworth near Stone School Road – planned as the site of Summit Townhomes, which would be a 24-unit development. The council postponed consideration of the Summit Townhomes site plan and the zoning, having previously postponed the zoning. The council also had previously referred the zoning recommendation back to the planning commission for re-review. The council’s second postponement on March 18 came after the commission’s re-affirmation of its original recommended R3 zoning. The council sent no explicit communication to the planning commission requesting action, beyond the implicit message of postponing the vote.

In the case of the DDA board, the council is weighing changes to the city ordinance governing the composition of that body, but postponed those changes for a second time at its March 18 meeting. The more significant of the ordinance changes involves clarifying how the Ann Arbor DDA’s tax increment finance capture is calculated, which has implications for millions of dollars for the DDA, the city of Ann Arbor, Washtenaw County, Washtenaw Community College and the Ann Arbor District Library.

Also related to the DDA, early in the council’s meeting an oral report was given on a session of the council’s audit committee – held the previous week to review the DDA’s FY 2012 audit. In the middle portion of the council meeting, councilmembers postponed the ordinance changes. And in the early morning hours of March 19, after the voting agenda was concluded, a member of the audit committee – Sally Petersen (Ward 2) – announced her intention to propose a task force on the DDA.

Related to other boards and commissions, the council confirmed the appointment of a chair for the zoning board of appeals (ZBA): Alex Milshteyn. He replaces Carol Kuhnke, who resigned in December 2012 after being elected judge of the 22nd Circuit Court.

In other business, the council gave approval for the zoning and site plan of The Shoppes at 3600, a proposed retail development on Plymouth Road.

The council also voted to object to the renewal of a liquor license for The Arena, a downtown bar located at Division and Washington streets. The basis for the objection – which will be forwarded to the Michigan Liquor Control Commission for final action – was non-payment of taxes.

The council also gave initial approval to a revision to the city’s sign ordinance. It would essentially maintain current conditions, but provide for certain limited digital signs with a restricted range of changeable elements.

Council communications included a briefing on upcoming changes the council will be asked to consider for the city’s public art ordinance. In other communications, the council will be giving a fire station reconfiguration plan some additional explicit discussion at a future working session – although it appears that the idea has insufficient traction to move forward.

Public commentary at the meeting covered a range of topics, including a call for the council to waive privilege on legal advice that councilmembers had received on the D1 moratorium issue – because they’ve now voted not to enact the moratorium. [Full Story]
